“When justice is dead can the nation survive?” asks a features item in a fairly popular news siteƒÆ’-¡ƒ”š‚  seemingly popular with its supportive myopics rather than the more intuitive and perceptive populace of the NationƒÆ’-¡ƒ”š‚ which more often than not tends to show bias against the Government of Sri Lanka perhaps by virtue of the anti government lackeys who fund it and support it in more ways than one and a very idiosyncratic trait in Sri Lanka.
ƒÆ’-¡ƒ”š‚
However for the sake of proper perspective needing to be outlinedƒÆ’-¡ƒ”š‚ the question probably needs to be re-phrased to read “Can A Nation Survive When Its Justice System Is Intimidated and Compromised By incompetent Legislators And Renegade Chief JusticesƒÆ’-¡ƒ”š‚  banding together to discredit a legitimately elected Government which hads done more than its fair share towards nation preservation, rebuilding asƒÆ’-¡ƒ”š‚  well as fight off and eliminate a dreaded enemy which threatened the nation’s very existence?”
ƒÆ’-¡ƒ”š‚
The issue is beyond doubt as the demands for “proper justice” seem to stem from some recently retired legislators with a total lack of gratitude towards their mentors as well as other government criticsƒÆ’-¡ƒ”š‚ with a willy nilly mentality towards which political group they should support! This then becomes a joke that such types have been tolerated by an administration which put up with their cockamanie albeit said to be intellectual reckoning withoutƒÆ’-¡ƒ”š‚ throwing the book at them when they began stepping out of turn long before their tem ended!
ƒÆ’-¡ƒ”š‚
IndeedƒÆ’-¡ƒ”š‚  these days the discussions on the military trial of the retired GeneralƒÆ’-¡ƒ”š‚  Sarath Fonseska,ƒÆ’-¡ƒ”š‚  also the common opposition candidateƒÆ’-¡ƒ”š‚ for the last election is naturally taking place as the notƒÆ’-¡ƒ”š‚ “so called” but a veryƒÆ’-¡ƒ”š‚  visible as well as credibly assigned trial fixed for the 18th of March 2010.
ƒÆ’-¡ƒ”š‚
Naturally there will be all kinds of cynical remarksƒÆ’-¡ƒ”š‚  heard about this trial from the disgruntled and defeated opposition political rivals of the present Administration withƒÆ’-¡ƒ”š‚ their own opinionated viewsƒÆ’-¡ƒ”š‚ about the legal and binding implications of what the Retd. Gen Fonseka has accrued against his name by way of treasonous as well as deliberate breaches ofƒÆ’-¡ƒ”š‚  legislation laid down by the the National Justice System which is debilitating for a man of his statureƒÆ’-¡ƒ”š‚ who once held high officeƒÆ’-¡ƒ”š‚ but does not seem to know what the statutes of limitations are with respect to what he can do and not do in his capacity!
ƒÆ’-¡ƒ”š‚
The President in a very clearly outlined dossier recentlyƒÆ’-¡ƒ”š‚ explained to the Nation as well as the world what exactly the General did beyond his capacity and why he was being incarceratedƒÆ’-¡ƒ”š‚ where no rocket science seems necessary towards comprehending it as the ground rules broken by the General albeit grave and very seriousƒÆ’-¡ƒ”š‚  are very elementary!
ƒÆ’-¡ƒ”š‚
This is the key cognizant and legally binding factorƒÆ’-¡ƒ”š‚ by those who have adjudicated the trial including President Rajapaksha who not only know what they are talking about but are alsoƒÆ’-¡ƒ”š‚ confident that the charges against the General will prevail as legal and binding regardless of the hooing and haaing of certain ex officio adjudicatorsƒÆ’-¡ƒ”š‚  et al whose actions at times during their tenure were not only somewhat contentious, overpowering and high handed but also beyond the authority they claimed and now have the audacity to turn against an Administration which succoured them and carried their clout to sustain them.
ƒÆ’-¡ƒ”š‚
ƒÆ’-¡ƒ”š‚ Strong Case in point for some investigative actions against these typesƒÆ’-¡ƒ”š‚ in response toƒÆ’-¡ƒ”š‚ questions asked by many legal analysts as to “where the hell” they got their mandate as well as information for all their allegationsƒÆ’-¡ƒ”š‚ from and “why the hell” are they being toleratedƒÆ’-¡ƒ”š‚ with impunityƒÆ’-¡ƒ”š‚ relative to their present modus operandi and rhetoricƒÆ’-¡ƒ”š‚ which not only seems Nation Unfriendly but also treasonous much in keeping with the retiredƒÆ’-¡ƒ”š‚  GeneralƒÆ’-¡ƒ”š‚  they seem to want to champion who attempted to upend the present Administration through his so called military ploys but failed miserably?
ƒÆ’-¡ƒ”š‚
Indeed when some say “why not add the death sentence also as the punishment?” and ƒÆ’-¡ƒ”š‚ another adds “why not have summary execution also,”ƒÆ’-¡ƒ”š‚ it does make some sense beyond the alluded toƒÆ’-¡ƒ”š‚ joke or metaphorƒÆ’-¡ƒ”š‚ which will probably completes the equation of what it takes to quell the problems created by the jokers who make such lopsided arguments knowing fully well that theirsƒÆ’-¡ƒ”š‚  is a kind of rhetoric stemming from anti Government fervour brought on by their incapacity to grab the reins of powerƒÆ’-¡ƒ”š‚ which control the Nation. In places like China for example such actions would surely have merited capital punishment perhaps for much less!ƒÆ’-¡ƒ”š‚ And perhaps they are unaware that the death penalty and summary executions do exist in a benign capacity and need to caution their language as the ratification of capital punishment for their treasonous rhetoric might not be too far off where only the requisite paperwork and Gazetting needs to be completed!

ƒÆ’-¡ƒ”š‚
No references to ancient history and the inceptions of the Legal Justice System of Sri Lanka norƒÆ’-¡ƒ”š‚ garbled analytical jargon is acceptable as norms towards defending the guilt of Retd. General Fonseka who has fallen from grace due to his own lack of self preservation, insightƒÆ’-¡ƒ”š‚ and the wisdom to conduct his administrative duties with patriotic benevolence and has furthermore to add insult to injury been baited by the enemies of the State.
ƒÆ’-¡ƒ”š‚
It is painfully obvious that the Nation of Sri Lanka is rife with undesirables who constantly attempt to undermine what the present Administration does with every good intent but no amount of lobbying for what these types envision as what’s best for the Nation( most often mired in circumspect confused idealogy bordering on the sublime to the ridiculous at times)ƒÆ’-¡ƒ”š‚ will ever be accomplished as long as they fail to recognize the great heights reached by the present Administration where even the victims of the horrors of the Elam Insurgency now envision the President and his forces as their saviours and a healthy majority of Sri Lankans uphold his Administrative capabilitiesƒÆ’-¡ƒ”š‚ !
