Fonseka now a prisoner in the open – Former CJ Sarath N. Silva

Former Chief Justice Sarath Nanda Silva yesterday observed that President Rajapaksa had not granted a full pardon to Gen. Sarath Fonseka.

The presidential pardon had not been backdated to the beginning of his sentence passed by the second military court martial, therefore he had lost his civic rights for seven years, the former Chief Justice said.

Making further observations on the pardon, Silva said when the President exercised his powers to grant a pardon to any prisoner it should not be done as a political act, but done as an act of a State leader.

Sarath Fonseka needed to be pardoned in two cases. They were the High Court conviction in the White Flag case and the second conviction by a military court. He had been fully pardoned from the High Court conviction, but he had not been pardoned from the part of the sentence already served from the second court martial conviction. What he had been pardoned from was the remaining part of the sentence, the ex-CJ said.

As he had not been pardoned from the portion of the sentence he had already served, he was liable to lose his civic rights for the next seven years. Gen. Fonseka had been made a prisoner in the open, he said.

    What else do you expect for a convicted criminal and corrupt official who has secretly collaborated with a foreign agency to install a dictatorship in Sri Lanka. He is the Augusto Pinochet of Sri Lanka.

    This govt has abundantly shown that this govt is very poor in financial management (they imported everything they could and emptied the foreign exchange) and is very corrupt (from top to bottom both politicians and bureaucrats are corrupt). There only excuse is that it is the JRJ who created this mess and now they have all the power in the world including 18th amendment and 2/3rd power in the parliament. Even then only complaining and no work.

    That is why General Fonseka should organize and lead the opposition, it does not matter whether he is in the parliament or not, to lead the country for a better future.

    This govt is full of corruption, mismanagement, nepotism, wastage and theft.

    Very true but he was not convicted when he commited day to day crimes. Only when went against the country he was convicted. That is fair eneough. This fellow is a FOOL. There is no way he can go anywhere. Only way is through making terrorist attempt by sabotage – he is such a coward. I will never call him a “hero”. It was other people who conducted war. The real heroes died to keep this burglerer alive.

    AnuD, You know what? Late JRJ created a Republic, a Constitution and an Executive Presidency so that Tamil Nadu Tamils can be killed yesterday, today and tomorrow. So if you are a Tamil Nadu Tamil, then there is case filed against you (TNA)in the Supreme Court. A hamuduruwo did it. Lets see what happens.

    Anud If Fonseka can do anything I can do better my dear. Who will follow a corrupt, dangerous,foul mouthed traitor like him. Are you out of your mind? Never Ranil has a better chance at least in his dreams. How many innocents were given strict punishments while he was the Commander in the Army? Did anyone understands his language? Who gave him the Commander post and who made him a General? Have you all forgotten? Dont waste time on him.Let him rest in peace in his Government given home and facilities at least. Not worth talking about him we have so many topics to talk about rather than this stupid man. The politicians who have vast experience dont have a place in our political arena so then how come this guy can win any elections.Do you think our peoples are all fools like him? When gallup poll say 90% approve of Rakapaksa handling the country’s affairs well and he is leading among Asian leaders how come this stupid guy can win the Presidency?

    Dont insult the real heros who gave their lives to save our country by calling this guy a hero. He have a dirty mind and a dirty heart. Greedy for money and hungry for power.
