“ƒ”¹…”Kotelawala, Bandaranayake guilty of crimes against humanity’

United Nations High Commissioner for Human Rights Navi Pillay should keep her hands off the internal affairs of Sri Lanka, the Golden Key Depositors Association charged, in a letter addressed to Ms Navy Pillay.

The Association regretted that she has poked her nose repeatedly into the internal affairs of Sri Lanka for the past two years, the letter stated, adding that depositors had been “victimized in the South Asian region’s highest valued, white-collar criminal fraud.”

The letter also said: “Before showing your concern over the impeachment of Sri Lanka’s former Chief Justice Dr Ms Shirani Bandaranayake you should have made an in-depth analysis of all relevant facts leading to the impeachment process of Sri Lanka’s Parliament, but instead you have listened to one sided flimsy stories of few bankrupt power hungry politicians in Sri Lanka, Tamil Diaspora, certain Western power blocks and nonsensical NGO’s who day-dream of destabilizing and dividing the Island.”

“We request the UNHRC to provide assistance to the 9000+ victims of human and fundamental rights violations in the Golden Key debacle and to take immediate action not against the Government of Sri Lanka, but against both Mrs Cecily Kotalawala and Dr Ms Shirani Bandaranayake for committing despicable crimes against humanity unprecedented in Sri Lanka’s history.

Over twenty GK depositors committed suicide and many others suffer from serious mental agony and stress related illnesses.

Thousands of GK depositors live without any hope for future; their families were cruelly subjected to poverty, hunger and misery without any avenues for their children’s education and money for medical treatments,

because of the loss of their life long earnings and savings.” The Association refuted the speculation that Sri Lanka is a failed state. “Our country is governed democratically and peacefully by the most popular government ever in the long history of our beautiful island,” the letter added.

“Sri Lanka is now headed by our national hero, His Excellency Mr. MahindaRajapaksa the President who united the country after eradicating the world’s most brutal Liberation Tamil Tiger Eelam Terrorist Organization (LTTE). The Tamil separatist war, lasting nearly 30 years, was funded by stooges of the so-called Western World. They wanted Sri Lanka divided and ruled by their lackeys,” the members stated.

The full text of the letter is as follows: “We are the members of the above named Golden Key Depositors’ Association. Some of the selected members our association are petitioners in the Fundamental Rights Case No. 191/2009 filed in the Supreme Court of Sri Lanka. They represent all 9000+ depositors who lost their monies in the horrendous scam of Golden Key Credit Card Co. Ltd in Colombo 10.

“Our course of action in the Supreme Court was highlighted in the recent Parliamentary Select Committee (PSC) proceedings of the impeachment of the former Chief Justice. Therefore, it is our bounden duty to protect our lawfully and democratically elected government of Sri Lanka from the baseless allegations levelled against it. All such allegations are based on speculations and misinformation, without provable facts, generated by Sri Lanka’s antagonists in the Western world, having a hidden agenda of their own.

“Members of the Golden Key All Depositors’ Association are the victims of the South Asian region’s highest valued, white collar criminal fraud, masterminded by Chairman Lalith Kotalawala, his wife and his directors of the Ceylinco Group of Companies of Sri Lanka. Our fundamental rights case no. 191/2009 provided abundant evidence to prove charges against the former Chief Justice, Her Lordship Ms Shirani Bandaranayake, in the recent impeachment action against her. It was purely an internal matter to be solved in accordance with Sri Lanka’s constitutional provisions and Parliamentary traditions.

“The supreme power derived from the citizens at Parliamentary elections is given to their elected representatives in the Parliament. There is nothing wrong in the impeachment, because it finally re-established the independence of the judiciary, saving it from avile, corrupt Chief Justice. Annexed Doc marked as A1 relates to notice of the motion (dated 06.11.2012) of impeachment charges against the former CJ issued by the PSC and the document marked A2 is the telegram/fax dated 31.10.2012 from our association to His Excellency the President of Sri Lanka, extending our support to the government’s righteous action of impeachment.

“We are sorry to bring to your notice that for the past two years or more you have poked your nose again and again into the internal affairs of Sri Lanka. After all, Sri Lanka is not a failed state or a rouge nation. Our country is governed democratically and peacefully by the most popular government ever in the long history of our beautiful island. “If you carefully study the 1978 Constitution of Sri Lanka you would find that no one has violated the Human Rights of Dr. Ms. Shirani Bandaranayake, the former CJ. She is the cause of all her troubles. Sri Lanka Parliament has conducted the impeachment process well within the provisions of 1978 Constitution. If ever there has been HR violation it was perpetrated by none other than Dr. Ms. Bandaranayake. She has transgressed and trampled the human rights of over 9000+ deposit holders and their dependents of the Golden Key Credit Card Company Limited of Ceylinco Group based in Sri Lanka. She has wilfully and fraudulently denied justice to the GK depositors by derailing the fundamental rights petition case SC F/R/191/2009 filed by the said depositors in the Supreme Court of Sri Lanka for recovering their deposit money from the biggest credit card white collar scam in the whole of South Asia. The desperate GK depositors have lost a total sum of SL Rupees 26.5 billion (US$ 265 million).

“Before usurping control over our FR case, the former CJ changed the bench of judges who had heard the case earlier and named herself as the head of the new bench to hear the case. After he takeover of the four year long FR case, the former CJ, as the presiding judge, manipulated the case in favour of defendant Lalith Kotalawala and his directors of the GK Company. She ignored the orders given by the previous CJ and judges who had heard the case earlier and blocked the plan to bring relief to GK depositors. Lalith Kotalawala, who has proved to be Sri Lanka’s biggest racketeer rewarded Dr. Ms. Bandaranayake for the favours she did him by transferring millions of Rupees to a mysterious many of number of bank accounts, for purchasing a super luxury apartment at a discount of Rupees 1.6 million from the Trillenium Residencies in Colombo 8.

This high-end condo is owned by one of the companies under the wing of Kotalawala and his Ceylinco Group. In this surreptitious purchase Dr. Ms. Bandaranayake and Kotalawala ignored the orders of previous CJ, Sarath N. de Silva, “ƒ”¹…”prohibiting transfer or sale of any assets which had been declared to Courts earlier by Kotalawala for settling payments to the depositors of Golden Key and other failed finance companies under him.’ the previous CJ also ordered that such assets should be sold, whenever necessary, at the highest value, as per directives of the Courts.’

“In the annals of Sri Lanka’s judicial history there has never been such corrupt, morally depraved Chief Justice as Dr. Ms. ShiraniBandaranayake. As demanded by law, she has not even declared the colossal sum of money (both foreign and local currencies) in her bank accounts to the Judicial Service Commission, or the Inland Revenue Department.

“All the above facts were revealed before the PSC that investigated the former CJ’s shady dealings. She withheld giving evidence to disprove the charges levelled against her and on the second day she dramatically walked out of the PSC proceedings with her team of defence lawyers, casting a silly remark. “We don’t have any trust in the PSC.”

“We as common citizens of Sri Lanka condemn such actions by the former CJ; it is a contemptuous behaviour and utterance against the sacred Constitution of our country by none other than the former head of the judiciary. Therefore, there is nothing wrong legally and ethically in impeaching and ousting the corrupt former CJ for the good of the country. Annexed, 27th January 2013, Sunday Island newspaper article marked as A3, Impeachment to Action by LAWASIA “….after considering the prevailing situation against CJ, the LAWASIA, the Lawyers’ Association of the Asia Pacific region, in which The Bar Association of Sri Lanka (BASL) is also a member, decided on Friday, 25th January 2013 not to take any steps….”

“As the Golden Key scam showed international ramifications we looked towards Great Britain, the mother of Parliamentary democracy and the Rule of Law. What did we find? It’s all Fundamental and Human Rights violations of 9000+ GK depositors by Great Britain super power. GB has provided a safe haven to one of the most wanted fugitives from South Asia. She is Mrs. Cecily Kotalawala, the ninth accused/respondent in our FR case before the Supreme Court. She is absconding fro the Supreme Court and all the other related Courts in Sri Lanka. The Interpol has issued an arrest warrant on her, with a Red Notice.

“Annexed herewith are the news items marked as A4 of Sunday Leader newspaper of 27/01/2013, which reports that she has been granted citizenship in the United Kingdom; Our Association’s petition to the British High Commissioner, marked as A5, dated 11/05/2012, requesting the extradition of Mrs. Cecili Kotalawala to Sri Lanka; The Sunday Island newspaper article of 27/01/2013 marked as A6, titled; “GK depositors pushed for Cecily’s deportation from UK.” Isn’t it a shameful act of UK for violating human and fundamental rights of Desperate Depositors? We request the UN to intervene in this regard for the sake of justice and fair play on your part towards the depositors of Sri Lanka. Are we to expect any good results at the forthcoming UNHR sessions in Geneva during the months February/March 2013? “We request the UNHRC to provide assistance to the 9000+ victims of human and fundamental rights violations in the Golden Key debacle and to take immediate action not against the Government of Sri Lanka, but against both Mrs. Cecily Kotalawala and Dr. Ms. Shirani Bandaranayake for committing despicable crimes against humanity unprecedented in Sri Lanka’s history. We also appeal for assistance for our Hon. President’s “Mahinda Chinthana Policy” in developing the Socio Economic status of our fast developing land. With assistance of UNHR, other UN bodies and also our friendly countries we are certain that our nation will soon reach “developed nation status” and become the “Miracle of Asia”.     If NAVI PILLAI the raciasts minded Tamil African UNHRC OFFICIAL has an atom of a brain to read the above letter and act intelligently, she will realise the lot of mistakes she has committed AGAINST AN INDEPENDANT DEMOCRATIC NATION,SRI LANKANS bylistening only to TAMIL LTTE SUPPORTERS’ GOSSIPS.NP OR CH4 never ever speaks of the heines crimes committed by LTTE BY KILLING BUDDHIST PRIESTS,BUDDHIST AND MUSLIM DEVOTEES AT TEMPLES AND MOSQUES,INNOCENT POOR FARMERS AND SMALL CHILDRENS as this WOMAN IS A TAMILS-LTTE BIASSED TRAITOR.Her FACIAL EXPRESSIONS IN PHOGRAPHS SHOWS WHAT AN ILLETERATE WOMAN SHE IS!!!

    To The Golden Key Depositors Association:

    I first read your letter, supposed to have been sent to the Commissioner of UNHRC, in the Daily News. Then I read it in this site. Let me tell you all, I really feel sorry for the plight in which you are placed as of today beginning a few years back. Having said that, I do not intend to discuss matters pertaining to the court case and the events that have and are taking place as of date.

    My concern is now as regards this letter. You say “The Association regretted that Ms. Navi Pillai has poked her nose repeatedly into the internal affairs of Sri Lanka………..”. Then after that wht you do. You go on to discuss your predicament and direct a scathing attack on Kothalawala and Dr. Ms. Shirani Bandaranayake. You become so hysterical and place the entire case before this very person whom you accuse of being “poking into internal affairs of Sri Lanka, in the following manner:

    “We request the UNHRC to provide assistance to the 9000+ victims of human and fundamental rights violations in the Golder Key debacle and to take immediate action not against the Government of Sri Lanka, but against both Mrs. Cecily Kotalawala and Dr. Ms. Shiriani Bandaranayake for committing despicable crimes against humanity unprecdented in Sri Lanka’s history……”

    You start by accusing this Commissioner for directly “porking” into internal matters of Sri Lanka, but go on to “plead” with her to take “immediate action” against some who are subject and already subjected to our own internal inquiry mechanisms. My question to you is: Why are you so HYPOCRITICAL?

    I don’t sympathize or pardon you anymore for doing this hyprocirtical action and will not hesitate in naming you a “Traitor” for the reasons below:

    1. You while accusing this person for “poking” on our internal matters, place before her a case and plead for action, thereby encouraging and inviting her to initiate investigations and actions as regards a domestic affair.

    2. By placing your case, (which is an internal issue) before the UNHRC and UN, you indirectly find fault with and accuse the failure of our own systems of dealing with the issues, thereby giving the impression that our Government is inactive, lethargic and undermine human rights.

    3. You by requesting the High Commissioner of UNHRC and UN to intervne give them evidence to accuse our Government and conclude that this is a “Failed State” that is not competent even to handle matters internally and according to the Judicial System of the country.

    4. You provided evidence for these “International Community and Diaspora Vultures” to carry out a campaign against my country.

    In the above circumstances and evidence, I have no hesitation in pointing the finger at you as a “TRAITOR”. However this in any case does not mean to discredit or undermine the sufferings of those 9000 odd depositors
