UNHRC cracking under overbearing weight of Navy Pillai

UNHRC is stuck in a crisis of its own making. It has begun to crack under the watch of Ms. Navy Pillai, the UN High Commissioner. It is time for her to get her act together and hold the scales evenly to preserve the image of the UNHRC as a credible institution for all the nations to rally round it.

The first ominous crack came when Israel walked out virtually telling Ms. Pillay to fly a kite. This is the first time that a nation has quit the UNHRC. Whether we like its politics or not, Israel has been the first island of democracy — and still is — in the sea of authoritarian Middle East. The “Arab Spring” is yet toƒÆ’-¡ƒ”š‚ ƒÆ’-¡ƒ”š‚ put down its tap roots deep into the soil and prove that democracy is there to stay and grow. At the other end, is N. Korea, a rogue state armed with nuclear weapons, asking the UNHRC to shove its Darusman report — yes, it’s same man who wrote the long distance report on Sri Lanka — on human rights in N.Korea up the insensitive nose of UNHRC.

Even the pleadings of US, Irael’s best ally, could not persuade Israel to come back. As for N. Korea, Ms.Pillay knows that it would rather drop its latest nuclear bomb on Geneva rather than give in to the terms laid down by UNHRC. So UNHRC is assailed from the two extremes — and Ms. Pillay can do nothing. Even if she sends her adverse reports condemning N. Korea to the Security Council urging the Secretary-General to take action, China is there to exercise its veto against Ms.Pillay. One may not agree with 99 % of N. Korean politics but it can be argued that of the remaining 1 % half of it is right in the description of Ms. Pillay as a factotum of the Western powers. And the other half too is equally valid in that it warns the big powers that small nations need not surrender to the cynical games of the West played to oppress other people by using human rights.

Overall, this means that the first serious signs of UNHRC facing a crisis of credibility among the nations are not likely to go away unless Ms. Pillay decides to chage directions and take into accountƒÆ’-¡ƒ”š‚ ƒÆ’-¡ƒ”š‚ alternative voices that areƒÆ’-¡ƒ”š‚ ƒÆ’-¡ƒ”š‚ pressing herƒÆ’-¡ƒ”š‚ to note that human rights is not theƒÆ’-¡ƒ”š‚ private enterpriseƒÆ’-¡ƒ”š‚ of the USƒÆ’-¡ƒ”š‚ with exclusiveƒÆ’-¡ƒ”š‚ ƒÆ’-¡ƒ”š‚ property rights to runƒÆ’-¡ƒ”š‚ itsƒÆ’-¡ƒ”š‚ self-servingƒÆ’-¡ƒ”š‚ agenda. When Israel and N. Korea — not to mention those in the middle like Sri Lanka — attack UNHRC then it means that there is something rotten in the state of Ms. Navy Pillai’s domain in Geneva. It questions the validity of UNHRC as a neutral and viable instrument to protect human rights, peace and stability.

At the heart of the crisis facing the UNHRC is the issue of credibility. And right in the center ofƒÆ’-¡ƒ”š‚ credibility stands Ms Navy Pillai looking dazed with the right, left and centre hitting her middle. Her handling of Sri Lanka exposes her partisan role which is dragging UNHRC intoƒÆ’-¡ƒ”š‚ aƒÆ’-¡ƒ”š‚ hole dug with her own hands. She has only to read theƒÆ’-¡ƒ”š‚ UNHRC’s votingƒÆ’-¡ƒ”š‚ record on Sri Lanka in the post-conflict periodƒÆ’-¡ƒ”š‚ to realizeƒÆ’-¡ƒ”š‚ the erratic and unprincipledƒÆ’-¡ƒ”š‚  politics,swingingƒÆ’-¡ƒ”š‚ irrationally from congratulations at first and then to condemnation next.ƒÆ’-¡ƒ”š‚ ƒÆ’-¡ƒ”š‚ Isn’t thisƒÆ’-¡ƒ”š‚ symptomatic ofƒÆ’-¡ƒ”š‚ aƒÆ’-¡ƒ”š‚ dysfunctional institution run byƒÆ’-¡ƒ”š‚ whims and fancies of ƒÆ’-¡ƒ”š‚ an inconsistent head who doesƒÆ’-¡ƒ”š‚ not know on which side of human rights she should beƒÆ’-¡ƒ”š‚ in ?ƒÆ’-¡ƒ”š‚ UNHRC is meant to operate on the highest principles of morality to monitor, protect and preserve human rights on a global scale.ƒÆ’-¡ƒ”š‚ Human rights cannot be sustained on immoral and partisan powerƒÆ’-¡ƒ”š‚ politics. Rightly or wrongly, UNHRC isƒÆ’-¡ƒ”š‚ cracking andƒÆ’-¡ƒ”š‚ going nowhereƒÆ’-¡ƒ”š‚ because it isƒÆ’-¡ƒ”š‚ head has lost her head.ƒÆ’-¡ƒ”š‚ 

The emergingƒÆ’-¡ƒ”š‚  cracks indicate thatƒÆ’-¡ƒ”š‚ Ms. Pillay cannot achieveƒÆ’-¡ƒ”š‚ the goals of UNHRC if she continues to go aboutƒÆ’-¡ƒ”š‚ itƒÆ’-¡ƒ”š‚ the way she isƒÆ’-¡ƒ”š‚ heading now. She is lurching from crisis to crisis within the UNHRC because she has abandoned morality for power politics. Sri Lanka is the best example. When the first voting on Sri Lanka took place in 2009 Sri Lanka won hands down. It won on merit. Power politics did not impact forcefully in that vote in 2009. Without America steering the anti-Sri Lankan resolution theƒÆ’-¡ƒ”š‚ just andƒÆ’-¡ƒ”š‚ popular will of the 47 countries represented in the UNHRC, including that of India, was expressed freelyƒÆ’-¡ƒ”š‚ and Sri Lanka was congratulated for defeating terrorism, the scourge of our time, andƒÆ’-¡ƒ”š‚  for restoring democracy, the highest political goal of our time.

TheƒÆ’-¡ƒ”š‚ declaredƒÆ’-¡ƒ”š‚ aim of American foreign policyƒÆ’-¡ƒ”š‚ too is also to achieve two objectives: 1. eradicate terrorism globally and 2. restore democracy. On both counts America should have been on the side of Sri Lanka.ƒÆ’-¡ƒ”š‚ It is against the declared objectives of American foreign policyƒÆ’-¡ƒ”š‚ to pursueƒÆ’-¡ƒ”š‚ Sri Lanka ruthlesslyƒÆ’-¡ƒ”š‚ for acheiving what it has failed to achieve, for instance, in Iraq. The first vote of congratulating Sri Lanka in 2009 was the most realistic and justifiable decision that any human rights organisation could have arrived at, particularly in the light of rescuing 300,000ƒÆ’-¡ƒ”š‚ victims of Tamil Tiger terror used as a human shield. But when power politics came into playƒÆ’-¡ƒ”š‚ UNHRC turned topsy-turvy. Morality had nothing to do with it. UNHRC turned against Sri Lanka only on cynical power politics.

Besides, the most commendableƒÆ’-¡ƒ”š‚ humanitarianƒÆ’-¡ƒ”š‚ achievement of the Sri Lankan victoryƒÆ’-¡ƒ”š‚ has been in the total cessation of mounting death toll.ƒÆ’-¡ƒ”š‚ Massive scale violations of human rights can beƒÆ’-¡ƒ”š‚ ƒÆ’-¡ƒ”š‚ avoided only by either not going to war or by endingƒÆ’-¡ƒ”š‚ a war. It was the Tamil leadership that decared war in the Vadukoddai Resolution of 1976 and decided to opt for a military solution whichƒÆ’-¡ƒ”š‚ ƒÆ’-¡ƒ”š‚ ran forƒÆ’-¡ƒ”š‚ 33 years — from 1976 to 2009ƒÆ’-¡ƒ”š‚  — making it the longest running in Asia. It is the Sri Lankan government thatƒÆ’-¡ƒ”š‚ ended the war.ƒÆ’-¡ƒ”š‚ Even India, with its superior forces, failed to end the war with its Indo-Sri Lankan Agreement and IPKF forces. When Sri Lanka achieved what India couldn’t — and even the international community couldn’tƒÆ’-¡ƒ”š‚ withƒÆ’-¡ƒ”š‚ its Oslo Agreement — why shouldƒÆ’-¡ƒ”š‚ they gang up against Sri Lanka for ending the warƒÆ’-¡ƒ”š‚  that ended the deaths of thousands?

Of course, theƒÆ’-¡ƒ”š‚ argument of India and US, as stated in the UNHRC Resolution,ƒÆ’-¡ƒ”š‚ is that Sri Lanka should haveƒÆ’-¡ƒ”š‚ “ensured that any measure taken to combat terrorism complied with their obligations under international law.” This argument is laudable. But can all those, pointing a finger at Sri Lanka on this countƒÆ’-¡ƒ”š‚ give an example of how anyone of themƒÆ’-¡ƒ”š‚ fought and ended their warsƒÆ’-¡ƒ”š‚ against enemies of their statesƒÆ’-¡ƒ”š‚ by complying unerringly with their obligations under international law? If they can’t what justification is there for them to accuse Sri Lanka of not doing what they have never done,ƒÆ’-¡ƒ”š‚ or can neverƒÆ’-¡ƒ”š‚ do,ƒÆ’-¡ƒ”š‚  with the best will in the world?

On what moral grounds can they accuse Sri Lanka in any forumƒÆ’-¡ƒ”š‚ ƒÆ’-¡ƒ”š‚ of not complying with internatiaonal obligationsƒÆ’-¡ƒ”š‚ when they cannotƒÆ’-¡ƒ”š‚  — and have notƒÆ’-¡ƒ”š‚  — complied with theƒÆ’-¡ƒ”š‚ international normsƒÆ’-¡ƒ”š‚ they have set for Sri Lanka? ThisƒÆ’-¡ƒ”š‚ charge of not complying with the international obligations is levelled against Sri Lanka by the two worst violators of this standard — India and US.ƒÆ’-¡ƒ”š‚ Not surprisignly, events took a nasty turn againt Sri Lanka only after US took charge ofƒÆ’-¡ƒ”š‚ ƒÆ’-¡ƒ”š‚ steering the resolutionsƒÆ’-¡ƒ”š‚ against Sri LankaƒÆ’-¡ƒ”š‚ after theƒÆ’-¡ƒ”š‚ shock of ƒÆ’-¡ƒ”š‚ UNHRCƒÆ’-¡ƒ”š‚ congratulating Sri Lanka. All those running behind US know that the dirtiest wars of the 20th century — from El Salvador to Vietnam — have been fought by US.

In fact, President Barrack Obama, whenƒÆ’-¡ƒ”š‚  he came into office changed his election promise and announced the new policy ofƒÆ’-¡ƒ”š‚  “looking forward to the future”ƒÆ’-¡ƒ”š‚  withoutƒÆ’-¡ƒ”š‚  going back the dirty past.ƒÆ’-¡ƒ”š‚ ƒÆ’-¡ƒ”š‚ He refused to even dismantle the notorious Guantanamo concentration camp. AfterƒÆ’-¡ƒ”š‚ toppling Saddam Hussein ten years ago America has failed to bring peace or reconciliation to thatƒÆ’-¡ƒ”š‚  ill-fated nation that has changed the local terrorists for foreignƒÆ’-¡ƒ”š‚  terrrorists. ThisƒÆ’-¡ƒ”š‚  is like changing pillows for a headache.

Instead of reconciliation Iraq continues to blow up in sectarian violence. The latest occurredƒÆ’-¡ƒ”š‚  last week when a part of Baghdad was blown up in an anti-American stirke. This proves that foreign formulas do not work according to their theories. On the contrary, Sir Lanka, operating on its home-grown formulas, is well on the way to recovery and reconciliation. Its achievements in peace time is as remarkable asƒÆ’-¡ƒ”š‚  its achievement in war time. So why isn’t that policyƒÆ’-¡ƒ”š‚ ƒÆ’-¡ƒ”š‚ “looking forward to the future” forgetting the pastƒÆ’-¡ƒ”š‚ applicable to Sri Lanka? If US wants to play the gameƒÆ’-¡ƒ”š‚ of finger-pointing then Sri Lanka too can play the same gameƒÆ’-¡ƒ”š‚ by throwing in the face Uncle Sam all the wrecks and remnants of its dirty wars in which children ran naked in the streets of VietnamƒÆ’-¡ƒ”š‚ burning from rainingƒÆ’-¡ƒ”š‚ napalm bombs.ƒÆ’-¡ƒ”š‚ Have the moralists pointing a finger at Sri Lanka forgottenƒÆ’-¡ƒ”š‚ those agonising images?

The most unacceptable and immoral turn came from India. India must take responsibility for aiding and and abetting the Tamil Tiger terror unleashed onƒÆ’-¡ƒ”š‚ Sri LankaƒÆ’-¡ƒ”š‚ that led to violations of human rights. But theƒÆ’-¡ƒ”š‚ Yin-dian amnesiacs take on theƒÆ’-¡ƒ”š‚  holier-than-thou pose of political sadhus andƒÆ’-¡ƒ”š‚ blame Sri Lanka forƒÆ’-¡ƒ”š‚ their short-sighted stupidity?ƒÆ’-¡ƒ”š‚ India must take responsibilityƒÆ’-¡ƒ”š‚ not only forƒÆ’-¡ƒ”š‚  the failed foreign policyƒÆ’-¡ƒ”š‚ of arming, training, financing, promoting and exporting terrorism to Sri Lanka and theƒÆ’-¡ƒ”š‚ subsequent military disaster of its IPKF forces sent to correct theƒÆ’-¡ƒ”š‚ foreign policy that boomeranged on Delhi but alsoƒÆ’-¡ƒ”š‚ for theƒÆ’-¡ƒ”š‚ current anti-Sri Lanka campaign wagedƒÆ’-¡ƒ”š‚ globally and at the UNHRC.ƒÆ’-¡ƒ”š‚ ƒÆ’-¡ƒ”š‚ 

India’s first memorable export to Sri Lanka was Buddha. But India will be remebered more forƒÆ’-¡ƒ”š‚  its next export:ƒÆ’-¡ƒ”š‚ Prabhkaran. Yin-diaƒÆ’-¡ƒ”š‚ isƒÆ’-¡ƒ”š‚ the only friend that hasƒÆ’-¡ƒ”š‚ stabbed Sri Lankans in the back each time theyƒÆ’-¡ƒ”š‚ try to stand up.ƒÆ’-¡ƒ”š‚ Under the Gandhi-Nehruvian morality,ƒÆ’-¡ƒ”š‚ when India stood tall in the middle of the Big power politics at the height of the Cold War and spearheaded the Non-aligned Movement,ƒÆ’-¡ƒ”š‚ she was aƒÆ’-¡ƒ”š‚ ƒÆ’-¡ƒ”š‚ beacon and aƒÆ’-¡ƒ”š‚ haven for smallerƒÆ’-¡ƒ”š‚ nationsƒÆ’-¡ƒ”š‚ seeking peace, justice and fairness. But this noble ideal has been destroyed by India’s misalignment with Big Power politics. It may serve India in the short term but in the long term India is taking a risk that is going to threaten her geo-political strategies. The ultimateƒÆ’-¡ƒ”š‚ guarantor of India’s security is not long distance shady allies but reliable and friendly neghbours.

ButƒÆ’-¡ƒ”š‚ IndiaƒÆ’-¡ƒ”š‚ has abandoned itsƒÆ’-¡ƒ”š‚ ƒÆ’-¡ƒ”š‚ principled roots and decided to be an integralƒÆ’-¡ƒ”š‚ part of theƒÆ’-¡ƒ”š‚ US bandwagonƒÆ’-¡ƒ”š‚ lending a hand toƒÆ’-¡ƒ”š‚ Western neo-imperialistƒÆ’-¡ƒ”š‚  agenda. It’s a risky gamble that threatens the security of not only India but the entire SAARC region. India must think twice before it gets entangled further in this risky gamble. The stature of Ms. Pillay too would have risen to the skies had she decided to take a moralƒÆ’-¡ƒ”š‚ standƒÆ’-¡ƒ”š‚ ƒÆ’-¡ƒ”š‚ which could be achieved only by her neutrality. The morality she quotes is only a fig leaf to coverƒÆ’-¡ƒ”š‚ her nakedness.ƒÆ’-¡ƒ”š‚ 

Mr. Yashushi Akashi summed up the newƒÆ’-¡ƒ”š‚ ground reality in Sri Lanka aptly when he said that “Japan was not ready to go with the human rights stands of other nations, ignoring the objective realities in Sri Lanka.

“Speaking to media in Tokyo on March 13, the former peace envoy to Sri Lanka said that, ƒÆ’‚¢ƒ¢-¡‚¬ƒ…-it is rather unfair for some developed countries, who have much more resources than Sri Lanka, to express impatience with Sri Lanka and its development; but this is not fair and this is not objective.ƒÆ’‚¢ƒ¢-¡‚¬ƒ”š‚ (Daily Mirror — March 15, 2009)

The doomsday scenario painted at the UNHRC is not the reality. Akashi’s assessment is a non-partisan eye witness account of the post-conflict developments in Sri Lanka which contradicts the doom and gloom picture painted by NGOs and the media.ƒÆ’-¡ƒ”š‚ ƒÆ’-¡ƒ”š‚ If, for instance,ƒÆ’-¡ƒ”š‚ Sri Lanka is heading for the doomƒÆ’-¡ƒ”š‚ predicted by the NGO pundits — they never saw anything butƒÆ’-¡ƒ”š‚ doom in Sri Lanka –ƒÆ’-¡ƒ”š‚ why isƒÆ’-¡ƒ”š‚ IndiaƒÆ’-¡ƒ”š‚ investingƒÆ’-¡ƒ”š‚ mega-millions in SriƒÆ’-¡ƒ”š‚  Lanka? India knowsƒÆ’-¡ƒ”š‚ the ground realityƒÆ’-¡ƒ”š‚ as well as Japan.ƒÆ’-¡ƒ”š‚ ƒÆ’-¡ƒ”š‚ And yetƒÆ’-¡ƒ”š‚ IndiaƒÆ’-¡ƒ”š‚ is deliberately pushing an anti-Sri Lankan line. Sure, India has to walk a fine line between its domestic and foreign demands. But does this mean thatƒÆ’-¡ƒ”š‚ India shouldƒÆ’-¡ƒ”š‚ sacrifice itsƒÆ’-¡ƒ”š‚ most strategic and indispensableƒÆ’-¡ƒ”š‚ neighbourƒÆ’-¡ƒ”š‚ needed to protect its exposed southern flank?ƒÆ’-¡ƒ”š‚ ƒÆ’-¡ƒ”š‚ ƒÆ’-¡ƒ”š‚ 

As forƒÆ’-¡ƒ”š‚ Ms. Pillay, she has nothing to lose except her reputationƒÆ’-¡ƒ”š‚ and credibility as the guardian of human rights if she insists on going down the current pathƒÆ’-¡ƒ”š‚ of rejecting the new realitiesƒÆ’-¡ƒ”š‚ rising constructivelyƒÆ’-¡ƒ”š‚ in Sri Lanka. Despite all the hostile propaganda demonizing Sri Lanka it is not going to end up like the Mayan calendar. Sri Lanka has fought and won bigger and mightier attacks than this. It is the future of UNHRC and its effectiveness as an instrument to protect human rights that is at stake.

So will Ms. Pillay stand up to save UNHRC and itsƒÆ’-¡ƒ”š‚ ideal objectives or will she obediently follow the other skirt worn by Ms. Eileen Chamberlain Donahoe, the American ambassador to UNHRC?

    UNHRC is not an independent body anymore.. its been influenced and approached with individual interests and biasness.

    Navi pillay is tamil so she will listen to the Indian Tamils those who wants to reestablish LTTE and fund raising campaigns for its activities and profits too.

    The UN was formed to prevent a Third World War. First two WWs happened in Europe, though Japan unwisely jumped on the German bandwagon thinking Germany was winning.

    Ms Navi Pillai’s agenda is to stop “Institutionalised Discrimination” (her own word). This type of Institutionalised Discrimination happens in Tamil Nadu (India) due to the Caste base of Indian society. It is illegal to discriminate on caste base according to the Indian Constitution (Indian Constitution written by Dalit Buddhist, Dr ‘Babasahib’ Ambedkar) But this practice still goes on, especially in states like Tamil Nadu, where Navi Pillai’s father comes from. Ms Pillai has a stake in eradicating Caste bases in TN.
    India wants to appear clean with regard to HR issues and will protect Tamil Nadu, always.

    Sri Lanka had the misfortune to have the British & Dutch import over One and a Half MILLION low caste/Dalit origin Tamil people as Indentured Labor from Tamil Nadu. Even though FREE education & FREE Health Care are given in Sri Lanka, and no discrimination, institutionalised or otherwise, is allowed in Sri Lanka, Tamil SEPARATISM took root in Sri Lanka. These SEPARATIST activities in Sri Lanka rode on the back of the Cold War (1946-1991). The 1983 Riots were orchestrated to aid a Human Rights issue and allow Tamil people to migrate to the west. The rest is history.

    Sri Lanka has to outlaw SEPARATISM with very strong new Laws. and removal of 13-A (imposed illegally under Duress during Cold War times). Lanka has to stop over dependence on Tamil Labor too with Modernisation & Mechanisation so that others too can enter the now solely held areas of work such as tea plucking etc. Sri Lanka should also stay on as NON-ALIGNED too. I cannot think of any other ways to truly protect Sri Lanka.

    N.B. : It is pertinent to note that USA, India & Sri Lanka were all British Colonies in the past.

    Navi Pillai is an Indian colonial parasite like all other Indian colonial parasites in the former British Indian Empire, now the Indian Empire. At last people are seeing the light, it is India and Indian colonial parasites who are putting down the locals of the Indian Empire. Be it Uganda, Kenya, Sri lanka, Malaysia, etc etc.

    I rand Navi Pillai’s Office and talked to two people. The first one who was an African put the call throuh to a person who knows about the issue. It was an Indian woman and she seenmed to got upset when I mentioned we should decolonse Indian colonies. It is time for us to get together and get rid of the Indian Cobra hold.

    Why should we be in this UNHRC anyway? We know it is managed by corrupt officials from the top to serve the geo-political interests of few Western countries, and to serve their personal interests.

    We should cease our membership on protest, and walk out.

    We deserve to be treated impartially, and we expect impartiality from UNHRC.

    Since we know the motives of this disgraced body, we should not take part in this comedy anymore.

    U.S. delegates would not speak during the debate, according to DPA, the German news agency, and in separate comments Eileen Donahoe, the U.S. ambassador to the body, said “the United States remains extremely troubled by this council’s continued biased and disproportionate focus on Israel.”

    Israel no longer associates with the Human Rights Council, in part because of last year’s fact-finding mission on Israeli settlements that culminated in the report. Israel did not cooperate with the council on the settlements report.

    The council repeatedly singles out Israel for criticism and has ignored major human rights abusers, some of which are members of the council.

    The Obama administration reversed its predecessor’s policy of not participating in the council and has noted some progress in having the body address abuses in countries such as Iran.

    B’nai B’rith International’s representative at the United Nations in Geneva, Klaus Netter, said in a statement to the council that the report was counterproductive.

    “Far from advancing the peace process between the two main parties, the fact-finding mission report has only reinforced Israel’s doubts about returning to active participation in this council and produced yet another source of conflict that may occupy this council’s attention for months or years to come,” he said.
