Commission of Inquiry on Indian War Crimes in Sri Lanka

India demands Sri Lanka holds a “credible investigation”. Sri Lanka must oblige India. That investigation must cover two important aspects. Firstly, it must cover India’s role in creating, training, financing and supporting the LTTE as a terrorist movement and India’s war crimes committed on Sri Lankan citizens by the IPKF. Accountability for these massacres by the Indian IPKF needs to be included to the Presidential Commission of Inquiry. If US says the Resolution is an expression of support then the international community must support Sri Lanka to ensure India does not obstruct investigations into crimes by India. This is the conditionality with which the COI should commence under a clearly articulated mandate. RAW head said to Rajiv Gandhi “Don’t worry about the LTTE, they are our boys, they will not fight us(IPKF)” “”…” LTTE fought back because IPKF were killing and raping Tamils in North Sri Lanka while a former Maj. Gen. of the Indian army declares Indian soldiers killed over 20,000 Tamil civilians in Northern Sri Lanka! IPKF prohibited the entry of international human rights organizations like Amnesty, ICRC from entering the North

 IPKF came to be called the Innocent People Killing Force because they killed civilians! IPKF was sent to Sri Lanka without the consent of the Indian Parliament.

 The scale of crimes committed by Indian troops in Sri Lanka has gone unnoticed. Prabakaran himself said that it was the atrocities committed by the IPKF that contributed towards his decision to kill Rajiv Gandhi in 1991. This corroborates with Former LTTE military commander turned Minister V. Muralitharan or Karuna Amman who claims that the LTTE female cadre who killed Rajiv had been raped by the IPKF. While even the Supreme Court of India in its verdict claimed that the Rajiv assassination was a retaliation for the IPKF atrocities against Tamils in Sri Lanka.

 The background to the arrival of the IPKF is simple. On 26 May 1987, Prabakaran was cornered in Vadamarachchi and would have been caught by the Sri Lankan troops had India not intervened to threaten military intervention if Prabakaran was not released. Thereafter, Prabakaran was flown by Indian plane to India and to show India meant business, India violated Sri Lanka’s airspace dropping 25 tons of food in the North. The irony is that while no Sri Lankan has ever to date died of hunger hundreds die in India without food.

 The international community has yet to speak on India’s role in birthing and nursing the LTTE. Part of that blames falls upon Sri Lanka’s Government and its failure to set the story straight. The root cause of the conflict is India and unless the Sri Lankan Government is brave enough to say so all these accountability and reconciliation is useless. Reconciliation cannot conceal India’s treacherous role to destabilizing and take over Sri Lanka. Sri Lanka must not shy from telling the world the truth. Indian media pointing fingers from Delhi certainly needs to wake up to this reality and an apology to Sri Lanka is certainly forthcoming.

29 July 1987 §  Indo-Lanka Accord signed (J N Dixit a main architect to draft Accord)

An accord thrust on Sri Lanka with India threatening to land its forces unless Prabakaran was set free from capture. India forced Sri Lanka to amend its Constitution and introduce the Provincial Council system merging the North and East through the 13th amendment. Legality of the amendment is questioned because it does not have the mandate of the people. India promised 5million monthly payment to Prabakaran for his consent.

30 July 1987 Arrival of Indian Peace Keeping Force (IPKF) “”…” numbers went upto 100,000

IPKF had not been briefed, they did not know what to do nor were they given maps.

October 1987 Just 2 months after IPKF arrival, orders were given from India to eliminate the LTTE and capture Prabakaran alive
Mar 1990 IPKF unceremoniously asked to leave by President Premadasa.

§  J N Dixit in a 2000 interview says “we were in a foreign country, the president of that country says “go away”, and you come back”. VP Singh Government and Foreign Minister I K Gujral were concerned about the legality of India’s presence in India. Fortunate for Sri Lanka VP Singh’s policy was “do the exact opposite of what Rajiv did” “”…” thus agreeing to remove IPKF from India. Had Sonia been where VP Singh was the IPKF may never have left!

The Indian High Commissioner J N Dixit claims that India had been training and financing the LTTE. If so how can he excuse IPKF failure as “underestimating the capabilities of the LTTE?”. If we accept this argument, we can then presume that RAW’s friendship with the LTTE ended up with RAW misinforming the Indian Government. This explains why RAW told the Indian Government “these are our boys, we know them very well, they owe so much to us, so once they say yes, they will not fight us, they won’t.” “”…” it looks like the RAW has been taking the Indians for a good ride!

In the same interview Dixit claimed that Ranil Wickremasinghe in 1995/1996 had told then Indian Premier Narasimha Rao that he would like Indian troops to come back!

IPKF memorial Serves as a reminder of India’s war crimes.

The 480 Indian soldiers (Sikh Light Infantry) who took part in the helicopter attack on the Jaffna university and the 30 Indian soldiers who lost their lives were awarded “Vir Chakra” posthumously. The airdrop has different versions and revisiting the past will set things right.

 Indian War Crimes in Sri Lanka

  • Training, arming, financing and functioning as a state sponsor of terrorism in view of its training LTTE on Indian soil using former Indian army personnel and RAW.
  • These Indian trained LTTE and other Tamil militant groups have killed scores of Sinhalese, Tamils and Muslims. For every murder, assassination and destruction of property LTTE has committed over 30 years India stands equally culpable. If LTTE stands trial so must India.
  • IPKF Indian forces not only killed scores of Sri Lankan Tamils but raped, looted, tortured and took part in indiscriminate shootings. This “killing field” is forgotten and ignored given that the main perpetrator is India. LTTE would not have become what it became if not for India.
  • The allegations of civilian killings by IPKF on Sri Lankan Tamils is said to range from 6000 to 20,000 (Maj.Gen.   • Indian IPKF role in displacing thousands of Sri Lankan Tamils also need to be investigated. Ironically no foreign Government, UN, Tamil Nadu, TNA nor any humanitarian organization challenged India or the IPKF. 50,000 is said to have been displaced at the height of IPKF artillery shelling. Is this why India has promised to build 50,000 houses as a resettlement offer?
  • Allegations of rape of Sri Lankan women by Indian forces was brushed aside as “the Indian army are not angels”¦.rape happens even in the West” – Brig Kahlon. Some of these very officers in the IPKF are today championing human rights!

Details of Indian IPKF war crimes/genocide

14 August 1989
  • Velvettiturai, 64 Sri Lankan Tamil civilians including children killed by IPKF.
10th Oct 1987
  • IPKF entered Jaffna town, arrested journalists of “Eezha Murasu” and “Murasoli” and destroys printing machinery and blasts office building. IPKF also enters LTTE television service “Nidharsanam” in Kokkuvil and takes transmission equipment. The building is also destroyed.

 

12 October 1987
  • IPKF attacks village of Kokuvil killing over 40 civilians’ in retaliation for loosing 29 Indian commandoes at the Jaffna University raid.

 

21 October 1987
  • Deepavali Day, 68 innocent Tamils shot and killed by IPKF inside Jaffna Hospital including hospital doctors, nurses, staff and patients. Bodies are burnt. Dr. Sivapathasuntharan who entered the hospital the next day was also killed by the IPKF. Orders and executions said to be under supervision by Capt Bisht from Jaffna Fort military camp. These allegations need to be investigated as post mortems were not held. Cutting off the electrical supply meant the deaths of many including a child under a ventilator in the ICU. 3 days of mayhem by IPKF who also forced shut a government run hospital in Nellippallai and a private hospital “Green Meermorian” in Manippai. Isnt shelling of hospitals a war crime?

  • 4 civilians injured by IPKF shelling in Sandilippai taken to Jaffna with a white flag but Indian army shot the car near Navallai and 2 inside car were killed. A letter had been sent to UN Secretary General regarding this in Nov 1987.
21 Nov 1987
  • Trincomalee, a IPKF soldier kills 7 civilians and injures 4 by indiscriminate firing.
  • Trincomalee, Naik Baldev Singh of 270 Engines, rank berserk and killed 7 civilians and injured 4 by indiscriminate firing in revenge for his brother in laws death the previous day.

 

 
  • More than a 100 Tamil civilian bodies were found in Chunnakam, Mallakam, Uduvil, Manipay, Maruthanamadam and Inuvil

  • Indian court-martial sentenced four Indian soldiers to one year in prison for raping Tamil women

  • an Indian newspaper reported in July 1988 that 2500 people were being detained by the IPKF in the northern and eastern provinces, and a writ of habeas corpus has gone unanswered.
August 2-3 1989
  • Valvettiturai massacre -. 64 Sri Lankan Tamil civilians killed by IPKF retaliation for LTTE killing 6 Indian soldiers including an officer. Indian authorities claimed 24 civilians died in cross fire.
  • Approximately 300 Tamil civilians were seeking shelter in houses of Mr. Subramaniam and Mr. Sivaganesh. At 1.30 p.m IPKF entered and killed Mr. Subramaniam and 8 others.
  • At 4 p.m. Indian soldiers entered the house of Sivaganesh, took 8 men to a cowshed and shot them but 4 survived.
  • VVT Citizens` Committee reported that 52 dead persons had been identified.
  • Witness counts available with journalists – Rita Sebastian of the Indian Express, David Husego of the Financial Times and local Human Rights groups such as the University Teachers for Human Rights
  • George Fernandes, who later served as defense minister of India (1998 2004), called the massacre India`s My Lai.

 It needs to be reiterated that whilst India continuously insists on safety, dignity and integrity of the Tamil people while Indian troops were running amok killing and raping Sri Lankan Tamils, India prohibited external players –  no journalists were allowed and no humanitarian organizations were permitted to the North.

Amnesty International has also documented, up to August of 1988, ten cases of people who have disappeared after arrest by the IPKF

 Sri Lanka’s Presidential Commission of Inquiry must investigate on all the training camps set up by the Indian Government, assisted by RAW and the former Indian army personnel that trained LTTE and numerous other Tamil militant groups from Sri Lanka.

 The Inquiry must cover the Tamil Nadu links with the LTTE inclusive of its politicians. It must also look into the international organizations that also had links with LTTE and their local stooges. Every area that prolonged the conflict from ending in view of their links to LTTE must now come into the open. This is what accountability is and only this will pave way towards genuine reconciliation. Indian Penal Code does provide for extradition and Sri Lanka can open trial according to Sri Lanka’s laws.  

 

India deserves no seat in the UN Security Council if its atrocities of state sponsored terrorism is proved on Sri Lanka and upon all of India’s neighbors. Indian Government continuously has been preventing war crimes investigations of India’s war crimes in South Asia region.

 Some words of advice to Sri Lanka’s present leaders who seem to be naƒÆ’†’¯ve to think we can expect better of India no matter how many times India ends up “disappointing us”.

    I’ve been begging for this. SL MUST do it. IPKF commander Hariharan is the BIGGEST anti-SL statement maker. And BRA-MAN (B Raman) the IPKF spy.

    With all these attacks on terrorists, SL should have KEPT IPKF for longer for 5 more years.

    1 Then we would have MORE war crimes to GRILL Endia.
    2 MORE hatred will be between Tamilians and Endia (MOST important)
    3 POSSIBLY a north south war in Endia.
    4 Ranjan, Denzil, Lalith, Wijaya Wimalaratne, Gamini would have survived. They were our GREATEST patriots.
    5 VP would have killed not only Rajiv but other Ghands too!!!
    6 By 1994 Tamilians would be BEGGING SL army to come and save them.

    When our enemies kill each other, what should we do? FUEL it! Just like Lalith A said.

    Now we should grill Endia for war crimes by IPKF. That will open Tamil mouths AGAINST Endia for the FIRST TIME after IPKF left SL.

    If still our leaders think that India is our friend it’s bullshit. There are certain individuals who sincerly loves Sri Lanka but not these political dynasties who only rule for power and glory. 3 Ghandians were assasinated. They were the sponsors of terrorism. They who created the monsters died from the hands of monsters. India should take the responsiblity for every single citizen of Sri Lanka who died due to L.T.T.E terrorism. They created,They financed,They gave the training and sanctuary. Nobody can deny that nor we will forget.

    We got our freedom after sacrificing so many valuable lives of our citizens and we will never ever allow any evil force to take back that freedom again. We will die for our country and keep our lion flag up under the brave leadership of the present government and the leader His Excellency President Mahinda Rajapaksa.     No need for the word reconcelliation. Revange instead. Rajive Gandhi is a war criminal similar to VP. He got the punishment but there are plenty of others already alive. This new LLRC report should be done openly using internet !

    Our stupid politicians sometimes think that they have a special personal relationship with the powers that be in India – mostly members of the Gandhi family. This is a false belief for India is not swayed by personal loyalties. When Sirimavo was in power she thought that the Bandaranaike family had a special relationship with the Nehru family – which later became the Gandhi family. Nothing could be further from the truth. India’s policies are always dictated by their Foreign Policy moguls and follow what they perceive as what is best for India’s geopolitical interests.

    Therefore it will be foolish for the current Sri Lankan leaders to believe that they can sway India’s stance by the strength of any existing personal relations if any.

    Thankyou Shenali -just the words all Sri Lankans should hear! As I have said on a previous comment “Say No to Unilateral accountability”. This is the line we should take – ‘accountability’ for all. The GoSL may have been quite ubderstandably reluctant to take this line in the first instance to avoid being seen as confrontational, but there is no room for such ‘politeness’ any more. Pandering to India’s sensitivities should end now. And there now remains a long list of modificatiobs on Indo-SL relations as a result, and I shall list out wmy thoughts on what they should be in due course….. S de Silva – London

    A report that calls for boycotting West Bank settlement products and states that Israel could be brought before the International Criminal Court for Jewish building over the pre-1967 lines was approved Friday by the United Nations Human Rights Council in Geneva.

    Only the United States voted against the report, which was penned by a three-member fact-finding mission.

    Speaking before the vote the US said that it was troubled by the council’s biased and disproportionate focus on Israel.

    Although the status quo is not sustainable and the US is committed to resolving the Israeli Palestinian conflict, it does not believe that reports such as the one completed by the fact-finding mission can help achieve that objective, the US said.

    Israel cut its ties with the council when it formed the fact-finding mission last year.

    The report stated that Israel had an obligation under international law not to transfer its population into the Palestinian territories, as it had done by constructing West Bank settlements.

    “The Rome Statute establishes the ICC’s jurisdiction over the deportation or transfer, directly or indirectly, by the occupying power of parts of its own population into the territory it occupies, or the deportation or transfer of all or parts of the population of the occupied territory within or outside this territory,” the report stated.

    The report explained that settlements violate international human rights laws and International Humanitarian Law.

    Private companies that do business with the settlements also bear responsibility not to violate those laws, the report said. It asked them to take “all necessary steps” to ensure that they were respecting human rights, “including by terminating their business interests in the settlements.”

    The council also passed another five resolutions against Israeli actions over the pre-1967 lines. These resolutions were filed under Agenda Item 7, which mandates that the council debate Israeli actions in the West Bank, east Jerusalem and the Golan Heights.

    The United States, which alongside Israel opposes Agenda Item 7, voted against all the resolutions.

    Other resolutions dealt with Israel’s military incursion into Gaza in December 2008 and January 2009, Israeli settlement building and Palestinian human rights including the right to self-determination. All the resolutions had near unanimous support in the council.

    The resolution that members appeared to take issue with was one that called on Israel to withdraw from the Golan Heights. It passed by 29 votes, but there were 17 abstentions. Only USA voting against it.

    Although the council dealt with human rights issues in Syria, Iran and Myanmar, it adopted more resolutions against Israel than any of those specified countries.

    An excellent and a very timely article proclaiming from the hill tops what India is trying to shove under the carpet. ‘The broken palmyrah’, book by a group of Jaffna intellectuals is also an authoritative reference in this regard. I remember what Kumar Ponnambalam wrote in the Newspaper about the IPKF uncivilized and brutal conduct in the Jaffna peninsula. He pleaded with the Sri Lanka government to send Sri Lankan troops to Jaffna whom he said were ‘gods’ compared to the Indian animals in army uniform.

    I cannot really understand why our foreign policy experts and others don’t realize how India manipulated us at the end of the Ealam War in 2009. They wanted to get rid of the LTTE, for they knew although it was them who initially bank rolled, trained and created the LTTE, in the end it was the Christian West that was controlling the LTTE. It was the Christian West through the Catholic Church who made the LTTE take up arms against the IPKF and thereafter through the ‘good offices’ of the ‘Peace Facilitator Norway’ almost became another state.

    India does not want to see the Eelam established in Sri Lanka but are adamant to see Sri Lanka remains destabilized. This is what they are up to and this is what they do with all their neighboring countries – Pakistan, Bangladesh, Nepal etc. India is happy to see Sri Lanka as its own satellite and under their control. Their ploy is to see Sri Lanka charged for war crimes through mechanisms of the UNHCR in the hope that they can manipulate Sri Lanka to do their bidding.

    It is timely that Shenali brought out India’s own war crimes in Sri Lanka. Sri Lanka’s only future lies in being assertive and making an independent path for its future with all weather friends and not those who back-stab everytime we look forward to get on with life.
