C V Wigneswaran is ONLY a Chief Minister and NOT President of Sri Lanka

‚ C V Wigneswaran and the TNA need to realize some hard facts. Firstly, C V Wigneswaran is just ONE of 9 Chief Ministers elected to office for a term. He should not think or behave as if‚ he has been elected as the country-â„¢s President. The TNA itself known publicly as the proxy of the LTTE is also just one political party of many in Sri Lanka. The President should not fall for the ruses been thrown on some bogey olive branch being offered for the country-â„¢s President to go to Jaffna and hand over the letter of appointment to just one of the country-â„¢s 9 Chief Ministers when the customary practice is for the Governor to hand over the appointment letters.

The 2nd Northern Provincial Council election was held after a period of over 2 decades. The 1st Northern Province (under a merged North-East) was annulled when its first Chief Minister declared a unilateral declaration of independence in 1990.

Our doubts that the people of the Northern people would have given more than the 82,838 that voted for the ruling party reconfirmed what many had been saying that the Tamil people are ungrateful and will always be ungrateful even if it meant saving their lives, developing the north giving them the freedom that they never enjoyed under the LTTE because they are programmed to always vote for a Tamil (even the low castes would end up voting for a high caste because the Tamils were never ones to challenge or change the status quo). With this realism being brought home what can be said is that the results have only shown the Tamil voters for who they are and has not diminished the efforts by the armed forces who toil day and night to build homes for Tamils who had never been living in a brick home but in huts throughout their stay under LTTE defacto rule and the Government who has been spending on developing the North at the cost of the South in an all-out effort to please foreign nosy parkers breathing fire down the Government-â„¢s throat. The Government must realize that doing things to please nations and foreign leaders functioning to an agenda is of little use to the country especially to the taxpayers footing the bills.

The TNA who fielded Wigneswaran as its Chief Ministerial candidate and submitted its controversial manifesto at the last minute needs to also realize that under the 13th amendment to the Constitution which introduced the provincial council system, it is the Governor appointed by the President of Sri Lanka and not the Chief Minister who has executive power in a province on behalf of the President.

The TNA for its part needs to also note that it should not think that the people voted for the contents of its manifesto. How many read a party-â„¢s manifesto and decides to vote based on its contents anyway? Therefore, the TNA need not presume that the votes received were the people-â„¢s concurrence for its self-determination drive. The Tamil people voted for the TNA simply because the part was Tamil. Only 82,838 Tamil voters had been thinking outside the Tamil-Only mentality.

However, the TNA and its Chief Minister issuing some high-handed statements pre and post-election seem to think that its victory was equated to that of a Presidential election. Unfortunately, both TNA and Wigneswaran need to wake up from day dreaming.

Thus, executive powers of a Province are exercised not by the Chief Minister but by the Governor. It is the Provincial Governor who controls the provincial public service and not the Chief Minister. It is the Governor who shall provide for and determine all matters relating to the terms and conditions of employment of officers of the provincial public service. The Governor is also empowered to alter, vary or rescind any order of the Provincial Public Commission.

It is the Governor who appoints the Chief Minister so who does Wigneswaran think he is to request the President of Sri Lanka to come to Jaffna and hand over the appointment letter and why should for just one Chief Minister, the President degrade the role of his own Governor?

The TNA and Wigneswaran needs to wake up to the fact that the Chief Minister and Board of Ministers are simply there to -Ëœaid and advice-â„¢ the Provincial Governor and what Wigneswaran and the TNA needs to take note of is that the Governor is NOT bound to act on the advice of the Chief Minister. Therefore, these realities need to be accepted before they presume they can function differently to what is legally sanctioned and then create issues for themselves and the entire province. What TNA and Wigneswaran need to realize is that the decision of the Governor shall be final and the -Ëœvalidity of anything done by the Governor shall not be called in question in any court-â„¢. Moreover, no moneys can be withdrawn from the provincial fund except with the sanction of the Governor and a Provincial Council may not pass any statute imposing, abolishing or altering provincial taxes, or authorizing the receipt of money without the recommendation of the Governor.

Given that the TNA and its Chief Minister had been making a fuss over land and police it is best that both come to terms with the fact that police and public order in a province is effectively retained in the hands of the President and the land too lies with the state and not the province. “All police officers will be appointed by the Inspector General of Police who is directly under the control of the President.” (Sri Lanka Sun: 30th October 1987) -¦-¦-¦while “State land in the provinces will be vested in the President and will not be given over to the Provincial Councils. The principle of central rule will not be affected in the distribution of land. Under the Land policy as envisaged in the Amendment, no state land will be vested in a Provincial Council – in other words no giving away of state land to the provinces…” (Sri Lanka Sun: 30th October 1987 -” H W. Jayawardena)

What the TNA and Wigneswaran needs to also wake up to is the fact that national policy comes under the explicit purview of the State parliament and not the province. Thus law making powers of the provincial councils do not include national policy. Thus the provincial councils are not beyond the executive powers of the President and the Provincial Councils shall not make any statutes on any matter affecting national policy while the finances of the province is also under the control of the Governor in concurrence with the State Government.

We can empathize with the TNA having had to stomach their class / caste pride for a great length of time under the LTTE for fear and patiently wait until they were able to reach this juncture of finally winning an election in what they feel is their domain.
Nevertheless, it is no better a time for the TNA not to have too high a hope that winning a provincial council election and securing its candidate was voted as the chief minister is nothing to be overtly jumping for joy -” the reality is that the Chief Minister is nowhere near the executive control that the Governor yields on behalf of the President. It is good that both TNA and Wigneswaran realizes these shortcomings before they start dreaming too much ending up disappointing themselves and then creating conflicts because they thought beyond their boots.

Therefore, without thinking beyond their noses the TNA and its Chief Minister should look at stopping Tamil people from raping their children, Tamil people getting drunk and abusing their wives, Tamil fishermen being robbed of their livelihood by South Indian fishermen and to uplift the lives of the Tamil people while also ensuring the Sinhalese and Muslims who were driven out of their homes by the LTTE are also welcomed just as Tamils who live in the South are treated. We hope too that the ancient historical sites most of which are Buddhist heritage sites and monuments and other artefacts remain preserved and protected and various underhand initiatives are not taken to distort history as was seen happening during LTTE rule helped by supposed Tamil academics too. There is certainly much that the TNA and its Chief Minister can do and a good way to start is to stop creating situations because it is the only way they know to cover their shortcomings. The TNA will find that there is a big difference in bellowing from the opposition ranks and being handed the leadership mantle within the limitations that first require them to pledge allegiance to the unitary state of Sri Lanka and to ensure separatism does not become a hallmark of their election victory -“because that was not what they were voted in to do.

    Actually they WERE VOTED to do just that – DISRUPT the unitary status and PROMOTE SEPARATISM!!

    You have to listen to what TNA screamed from platforms, what Tamil newspapers said TNA will do, what Tamil teachers, lawyers, priests spread as TNA would do – FAR WORSE THAN THE MANIFESTO!! They promised Tamil Elam if TNA wins. That cannot be put into the manifesto.

    Tamil people voted for Tamil Elam!

    Thank you Shenali……..YES as the chief minister said in the last few days, that THEY will not do anything to avert the law of the land & abide by the laws of Sri Lanka.

    As Shenali quite eloquently pointed out, the Gov. appointed by the President has that authority adminsiter the Province within his powers.

    Even if we considered some conciliatory means of accomodating Tamil peoples grievencies in the past, FROM NOW on North must realize, past is past & we will NOT grant any favours whatsoever, because there are other provinces who might demand same concessions if we were to make any favours to NP.

    I have said that Northern Chief elect has threatened our Govt: & its people in his remarks only few weeks ago. At that time I responded strongly to him never to use that type threateing language to mass population of Sri Lanka, which is a FREE DEMOCRATIC COUNTRY.

    That type of threatening language in itself is a travesty to the people who elected him. Tamils will always VOTE for tamils. Running to India or finding countries in Int. Community will not help you. It is an internal matter & should be settled within OUR LAWS in Sri Lanka. Not laws in the UK, USA or any other country.

    If this is the way Tamils & their leaders start to reconcile, IT IS AN EXTREMELY UNWISE way to open dialogue with the Lankan Central Govt. & their faithful citizens who love this UNITARY STATE dearly.

    OUR President should NOT grart any favours to NP, and MUST BE VERY FIIRM in dealing with this power hungry population amounting 4- 5% of the Sri Lankan TOTAL POPULATION. Your status is diminished NOW, as the MUSLIMS are the majority after Sinhalese & it is high time NP realizes this. As a SUB GROUP you may have to depend on Muslim leaders to present your case to the President on all issues of governance.

    It is even worse. Almost half the votes were received by EPDP (Eelam Peoples Democratic Party) which has separatist tendancies though a little less than TNA. A vote for a EPDP candidate is not a vote away from Tamil-Only mentality.

    Out of the 7 elected from UPFA, 2 are Sinhalese (voted by the Sinhalese), 2 are Muslims (voted by the Muslims) and only 1 Tamil (voted by Tamils). The other 2 are EPDP candidates.

    In other words, Tamils in the north only elected one (1) candidate who is against Tamil-Only mentality.

    Had more Sinhalese and Muslims been resettled in the north, UPFA could have won a few more seats though it is not sufficient to turn the tide.

    Now the EPDP has demanded its candidate be made the Opposition Leader of the Northern Provincial Council. In other words, both the Chief Minister and the Opposition Leader will be separatists.

    Lorenzo is right. The TNA is wanting Separatism. The South is naive to think otherwise. As far as Tamil people are concerned, the majority of them voted for the TNA along with its Separatists Agenda. The TNA leaders did not remove its Separatist Manifesto for the simple reason that it attracts Tamil voters, even though illegal.

    Some important points :

    * The TNA went against the Law of the country with its illegal Manifesto, yet not removed.

    * Tamil illegal migrants were allowed to vote with temporary ID cards. They formed a vote bank for the TNA. The speak only Tamil. All illegal migrants ought to be Deported.

    * Why is Sri Lanka being penalised to placate Tamil Caste problems via Separatism, especially Caste problems in Tamil Nadu, where there are some 11 Million Tamils still under Scheduled Caste category, with some 95,000 ‘night soil carriers’ working according to Caste base ? Separatism in Sri Lanka will never solve Tamil Caste problems. In fact, if Eelam is formed, Caste will be reimposed on the North, as in Tamil Nadu.

    For the above reasons and more, IN SRI LANKA, SEPARATISTS POLITICAL PARTIES OUGHT TO BE BANNED. The Laws of the country must be implemented without fear or favor. Otherwise, Sri Lanka will be kicked around like a wet rag by Separatist Tamil politicos on either side of the Palk Sts.

    That said, we wish all true bornTamils of Lanka real happiness by truly belonging to the country that nurtures them, Sri Lanka.

    Tamilnadu politicians show Hindi is enemy of Tamil.
    TNA shows (Northern Provice) Sinhala is enemy of Tamils.

    Tamilnadu politicians and TNA profiting by

    Both of them never helpful to their own community or guide them.
    Mullivaikkal (Deaths of Tamils) shows us the mentality of some Tamil politicians from Tamilnadu and Sri Lanka.

    Sri Lanka should never lose the hard earned peace dividends for both Sinhela and Tamil people.

    We are all for business all over the island, but keep to the sane “People first, Profits next”. Schumacher style “Small is Beautiful”
    is ideal for a small country such as Sri Lanka. Also, copy some methods re Laws & Economy from Denmark & Germany – they are both doing remarkably well. Even though Sri Lanka is not mono-ethnic like Denmark, we can make it peaceful & successful for all. Recently the Head of the European Commission (Mr Barrosso) said he would always try to invest in a stable country only.

    Sri Lanka has passed the litmus test of providing a good elections and successfully convincing the world that the Democratic practice is alive and well in Sri Lanka. Colombo has not rushed to do away with the 13th amendment and that has worked to the benefit of Colombo as more nations praise a pragmatic government.

    Now that the TNA has been elected they are doing everything that they should not. They made the issue of autonomy the first issue and demilitarization the second issue with the full support of her Tamil electorate. Give them enough of rope and they will hang themselves with it for now Colombo who has earned enough of foreign support can go forward to deal with the separatist aspects of the TNA and what must be done to avoid such issues in the future. The time for the nullification of the 13th amendment will have the excuse to do that and the need to move Sinhalese into these Tamil dominated areas now has a reason since if not done the Tamils will vote in another party whose values are that of the TNA

    We would far prefer for Parliament to do away with any political party that advocates Separatism, right at the outset, without waiting for any kudos from anyone re HR matters. The Sri Lanka HR case was spoilt right at the outset at the last two UNHRC sessions. Was this done quite deliberately or out of naivety ? The former fits in, we think.

    There is a quaint and odd belief among some theoreticians that they ought to constantly ‘level the playing field’. Such beliefs are always for the $$ benefit of a few people. The survival points for the multitudes of the rest of society are near zero when such crazy theories are applied to Separatists/terrorists. If we recall, such was the theory during the ltte rule of the N&E under ‘peacekeeper’ Norway.

    “Panina relawunta innimung ona nae’ and ‘better late than never’ must be applied re Separatist political parties, for the sake of Security for all.

    He should be reminded he is only a PETTY officer in the govt.

    Reminds me the story of the JVP activist caught from home. He willingly comes to the police jeep. But when told to get in the back he refuses and demands he be seated at the FRONT. Then the police officer reminds him who he is and pushes the bastradd to the back of the jeep.

    Viki needs to be given a similar lesson.

    Is the GOSL resurrecting the District System as an Alternative to Provincial Councils, if and when the PCs are DISSOLVED?

    I FERVENTLY hope so! I have always advocated the Districts administered by the equivalent of a Government Agent as an alternative to the Provincial Council System.

    The Provinces are TOO LARGE and pose a threat to National Stability & Integrity in the hands of Anti-National Elements. DISTRICTS …. on the other hand…. are small enough to not pose a threat to the rule of the National Government, and diminishes the ability of Sri Lanka’s enemies from posing a credible threat to the GOSL and to National Unity.

    This could presage the future direction of local governance in Sri Lanka.

    Sri Lanka to appoint District Ministers soon

    Oct 01, Colombo: The Sri Lankan government will soon appoint a district minister to each of the 25 districts in the nine provinces of the country to oversee the development in the districts, sources said.

    According to sources, government MPs elected from each district with highest preferential votes and not received any cabinet portfolios will be appointed as District Ministers.

    The government has come to this decision to deal with the powers of the Northern Provincial Council under the administration of the Tamil National Alliance (TNA) which is in opposition to the government, sources said.

    The government expects to appoint five of its MPs to the five districts of the Northern Province. These Ministers are expected to be vested with wide powers.

    Sri Lanka appointed District Ministers in early 1980s during the reign of President J.R. Jayawardana but the positions were abolished later after the introduction of the Provincial Council system in the late 1980s.

    The petitioners claim that the TNA manifesto violates the sixth amendment of Sri Lanka’s Constitution which says that no political party or other association or organization shall have as one of its aims or objects the establishment of a separate State within the territory of Sri Lanka.

    They say the TNA manifesto will pave way for setting up of a separate state in Sri Lanka.

    President’s Counsel K. Kanageswaran stated that his client was compiling the objections. The Supreme Court informed him to submit the objections in writing.

    The hearing was postponed to October 23.

    The petition was taken up by a three member panel of judges comprising Chief Justice Mohan Peiris, and justices Chandra Ekanayake and Rohini Marasinghe.

    If the TNA Election Manifesto is found to violate the Sri Lanka’s Constitution, then THREE things must be done:

    1. Declare NULL & VOID the results of the PC Election & the election of all TNA members elected to office, for they will have been elected under ILLEGAL representations to the public.

    2. ARREST, PROSECUTE, CONVICT and PUNISH at Hard Labor in prison for that violation amounting to TREASON.

    3. Use that the THREAT POSED BY THAT TREASON to form the basis of a National Referendum to REVOKE the 13th Amendment … forced by India down Sri Lanka’s unwilling throat … and DISSOLVE the Provincial Council System of local governance.

    Tamil coalition partner asks Sri Lankan government to allocate powers meant for the Northern PC

    Oct 02, Colombo: A Tamil ally of Sri Lanka’s governing party has called on the government to allocate powers meant for the Northern Provincial Council.

    Member of the Eelam People’s Democratic Party (EPDP) has said the government should assign powers meant for the Northern Provincial Council without heeding to racial and religious extremists.

    EPDP organizer for Vadamarachchi, A. Sri Rangeswaran has warned that the people in the North would commence a protest campaign if the government fails to vest the rightful powers of the Northern Provincial Council with the Council.

    He has said at a public event in Vadamarachchi that there have been many sacrifices and losses on the part of the people in the North to finally achieve the power in the Northern Provincial Council.

    According to Rangeswaran, separatists in the South are propagating communal and religious disharmony through various forms of propaganda to achieve their political agenda.

    Oct 01, Thalaimannar: Sri Lanka Navy has arrested four individuals who had reached the northwestern shores in an attempt to enter the country illegally from the seas.

    Naval troops attached to SLNS Thammanna of the North Central Naval Command arrested a group of four men in the 07th Sand Bank Area on Monday (September 30).

    They were handed over to Thalaimannar Police for further investigations.

    Wimal Weerawansa will be Colombo district minister. Oh! Colombians will have to come to WW to for any development work.

    Sarath Weerasinghe will be Ampara district minister.

    Aloocate NOTHING to the province. Channel ALL money through the DISTRICT MINISTER.

    Sri Lanka is a tiny tiny country. Sri Lanka is the only country Sinhalese have. We don’t have two mother countries like our 2 main guests.
    From one end to the other end you can travel in a few hours. So you still need ministers, deputy ministers, chielf ministers mayors, mps, etc. etc. Who is going to do any work? Who is going to pay for these free loaders? While they own Colombo, they want east and north for themselves as well. Sinhalese, being very accommodative, they take full advantage. They said they had eelam kingdoms. But no one ever seen a brick of their ‘kingdoms’ buildings. So they stopped that mantra.

    Them and the mossies are simply migrants. They can live all over the world without any complains. But in Sri Lanka they want special treatments. Separate states, top jobs, etc. So they keep chanting national question, national question. We have to say to these selfish, greedy lot only one thing. If you don’t like it here, just go to your real homelands. ONe is only 16 miles across the waters!

    It’s a good wake up alarm to dreaming TNA and Wignesh. All Sri Lankans like TNA & Wignesh to spend their energy to get rid off their blindness and develop north. Do not drag innocent northern people to another dark era.
