Open letter to President Mahinda Rajapakse

Your Excellency,

 

We convey our deepest sadness at our failure to have mustered enough votes to retain you as the President of Sri Lanka for another fruitful period of development.  We miss you very much Your Excellency, we know that today we  breath as a free people without fear or constrain because of the  determination you had to eliminate terrorism despite  great risk to yourself.

 We are  therefore ever grateful to you for having unified Sri Lanka, part of which had been given to be kept under terrorist control under a CFA signed with the terrorists  by a former Prime Minister  Ranil Wickramasinghe, and for providing security with the a heroic  Armed Forces  strategically stationed from North to South and East to West of  Sri Lanka for us  to live without fear of another  resurgence of terrorism.

Your unexpected  defeat at the Presidential election, Your Excellency,  is a great loss to Mother Lanka which was making remarkable progress in development, and  stabilising the place it had carved under your leadership with the developing Nations of Asia, Africa, Latin America and Middle East and close friendship it had built with China, Russia, Iran,  Vietnam.  But now we begin to doubt the  sincerity of the relation India had with Sri Lanka under your leadership.  India perhaps on the advice of USA  wants to distance from us due to our very close friendship with China.

Your Excellency now it is quite evident that there was an unseen hand behind  the move to get the Tamils of the North, the Muslims of the East, and the Catholics to vote en mass to the common candidate of the opposition against you to assure your defeat at the election.

Nevertheless, various reasons are being adduced  by your antagonists with a view to create displeasure amoung the people against you, thus assuring their victory at the General elections.  They besides levelling accusations of corruption,  put your defeat at the elections to your  failure to have paid more attention to bring down the cost of living and neglected the poor. Your Excellency, in Sri Lanka there had never been a death by starvation during the 30 years of terrorism or ten years after that.

But this argument Your Excellency does not hold water, it is the result of an unintelligent perception of the situation.  Sri Lanka under your leadership was a fast developing country.  The standard of living  of the people was  improving. The poor were able to have electricity, pipe water, education facilities to their children.  They could improve their houses  cementing the floors  instead of  applying  mud and cow dung. 

Development always brings with it financial constraints as some facilities have to be sacrificed  to enjoy others. Water, electricity, transport etc. have to be paid for  which reduce the monthly family budget, forcing  reduction in food bills, and other every day needs. 

Of course the critics  refuse to understand that Sri Lanka was a poor country suffering under 30 years of terrorism, but being taken fast forward by a visionary leader ambitious to take Sri Lanka  further on the path of  development.  Given one more term Your Excellency, we are sure  you would have been able to  considerably reduce poverty and given the people more facilities to  improve further their standard of living, while reduing the cost of living.

Alas that was not to be, today the people of Sri Lanka are orphaned, except of course the Tamil people of the North.  Sampanthan, Sumanthiran, the TamilNadu and the Tamil Diaspora are gleeful.  They are getting everything they want beginning  with  the full  implementation of the 13th Amendment  as announced by the 100 day Prime Minister  Ranil Wickramasinghe,  while in the south there is still no Yahapalanay  but a  Vibhishanaya.

When you were there Your Excellency, every day we, the people get up to hear good news of  a new building or a School being opened ,  beginning the construction of high ways, opening a bridge  or a Mahindodaya building, or some such news of embellishment of Mother Lanka taking  her gradually to a future of hope and prosperity.

But today with the new Maitri Palanaya we open the news paper to see  some one of the previous government-that is your Government Your Excellency,  accused for some thing or another and  JVP marching up to the Bribery Commission  making allegations against  you Your Excellency, your children and now even  Ms. Rajapakse. 

Finance Minister Ravi Karunanayake , with a questionable back ground summoned to attend Courts for an alleged money laundering just on the day he is to present a Mini-budget to the Parliament, and  other questionable financial transactions, accused Gotabhaya Rajapakse for having kept  8 billion Rupee account in the BOC.  It was immediately proved wrong. But nevertheless he accuses him of irregularities.

Then there was another  accusation  against him for  running a floating armoury.  Then they raided Rakna Lanka Armoury at BMICH to pin it as well on your brother Gotabhaya Rajapakse .  The Maitri Palanaya is making  desperate attempts to find some fraud or criminal activity to  accuse Gotabhaya Rajapakse.  But to their chagrin they have found none.  Gotabhay Rajapakse Your Excellency is an excellent military officer, a man who selected Sarath Fonceka as the Army Commander when he organised the Armed Forces to begin their war against terrorism.  He would not have stooped to theft and misappropriation or engage in any activity that would  bring disrepute to himself and the Armed Forces. This some of these persons with tainted  hands would not understand.

The Maitri Palanaya has not given up, they  are still going on with an imagined  allegation that you were planning a military take over  of the government  to deny Maitripala Sirisena his presidency in a plan for you to stay in power.   They are involving every one including the Chief Justice, and G.L.Peiris as plotters of a military coup.   Unfortunately they have no proof, but that does not deter them.   All they want is News paper headlines and a media circus to bring disrepute to you, without allowing  you  media time to defend yourself or others around you.  Where is democracy ? Where is Yahapalanaya ?

They are doing that as it is the only way they can think of to make you unpopular amoung the people  and get them to vote against you,  and for  Ranil Wickramasinghe and the crowd at the coming general election. 

But none of these allegations have been proved, the UNP is only capable of this type of  mudslinging and character assassination.  In a resent interview the Sunday Leader (27.1.2015) had with M. Ganesh R.Dharmawardhane,  the Director General of the  Commission to Investigate  Bribery or Corruption, he was asked Why our country witness so much of corruption and bribery ? Mr. Dharmawardhane  had said ” I cannot provide an answer to that issue. According to international reports  in this field  Sri Lanka is better than others” 

In reality this temporary government of 100 day Prime Minister Ranil Wickramasinghe has done nothing for the benefit of the people and the country since its inception  on the 9th January, other than raking garbage in search of material to accuse some one or other of the previous government.

Your Excellency, we have nothing against the President Maitripala Sirisena, even though we do not appreciate how he worked his way to become the President of Sri Lanka.  Nevertheless, he was elected by a majority of the people and we salute that decision. 

However ,  the people of Sri Lanka the patriots  who sacrificed their children to save the country from being mutilated by a ruthless group of Tamil terrorists, are saddened that it was the vote of the Tamils  that tipped the scale in favour of   the President Maitripala Sirisena. It was the pre-arranged contribution of the Tamil National Alliance  for  the victory of the common candidate of the opposition. 

The  anti Rajapakse  Western hand that had been at work  is clearly seen now that a “regime  change” has taken place.  UE that imposed sanctions on grant of quotas for the apparel industry  is  now removing those  sanctions in favour of the changed pro western regime.

To-day the Tamil National Alliance which is the off shoot of Prabhakaran’s  terrorism  plays the tune  to which the temporary  Government of 100 day Prime Minister Ranil Wickramasinghe has begun to dance.  Though the President Maitripala Sirisena was sworn as the President  his voice has been muted by his Prime Minister Ranil Wickramasinghe and his Cabinet of Ministers-Mangala Samaraweera, Rajitha Senaratne.

Though much publicity is being given to Yahapalanaya and Maitri Palanaya, this  temporary100 day government has a super government  a Politburo called the NEC above it with a  “Gestapo” style investigating branch led by Anura Kumara Dissanayake of the JVP.

The Gestapo of Hitler’s Germany most often acted on information from “denouncers” to round up Jews and investigate their activities. Once the Gestapos get you they will go all out to condemn  you to Concentration camps , no amount of  evidence in your favour will be taken into consideration.  Anural Kumara Dissanayake’s JVP is not different-but he is a Gestapo who  alsoacts   like a bull in a China Shop. 

No wonder Anura Kumara Dissanayake of JVP is like that because cruelty is in his blood since  his JVP beginning they killed people in cold blood. They cut off heads  of  innocent people and stuck them on poles and planted them in front of the homes of the victims.  They  killed  any one without questioning .  Only crime  their victims had  committed more often was to have belonged either to the UNP or the SLFP.

Can we now expect any thing better from this uncouth individuals. JVP is now  going after the family members of the President  Mahinda Rajapakse.  Has JVP under the cover of Yahapalanaya  started their bloody revolution ?   It is strange that it is people with an unclean past that seek to accuse others

Some thought better of Champika Ranawaka but he  seems to be of the same mould as JVP Gestapo. Atureliye Ratana has gone a step forward.  He now says Your Excellency, that the credit for the elimination of terrorism does  not go to you alone , but to him as well.

Your Excellency  we will always remember you as  a dedicated patriot strong and determined not only to fearlessly hold yourself  against  your  local opponents,  but also against the  powerful Foreign forces  to protect your  country and your people.

But to-day  every thing you did to Mother Lanka to save her from the terrorists and lift her onto a higher pedestal of respect and global importance, with a strong armed force, to protect the country is being reversed. 

The UNP Ministers of the 100 day Government  even take credit   to vast development that has taken place in Sri Lanka.  Harsha de Sila a Deputy Minister says that the infrastructure projects were identified for implementation by Ranil Wickramasinghe.  But identifying  and taking the bold step to construct are two different   things.  Therefore the credit goes to the one who takes the bold step to construct and not to the one who identifies.

Your Excellency, your brother Gotabhaya Rajapakse  will be remembered for generations to come, for after the  heroic defeat of the terrorists freeing the country  and its people, he  used the heroic  soldiers of  our Armed Forces to make of them  the builders of the Nation. They were in the process of  changing the  landscape of Sri Lanka completely different from what it had been  before, to give it a scenic beauty in the midst of  economically prosperous cities in which the people are  united as a Nation. 

To make safe the country for generations to come even the young generation was in the process of being  trained in leadership  providing them with the ability to take up the role of protectors of the country in case of  dangers that would come to her from within and outside. In the process professions that were considered low were  re- evaluated and Armed Forces  were trained to take up the profession of builders and cleaners giving labour a respect hitherto unfound.  .

Even this great concepts are now in the process of change under Maitri Palanaya.  There is still a fundamental question which has not been broached in the calamitous situation we are faced with today.  The question is whether the Government which has been set up temporarily to fill the gap between the election of a new President  and the Parliamentary elections has the legal authority to make dramatic changes in  the administration of the country ? 

For instance Ranil  Wickramasinghe who has been named the Prime Minister by the President is not a Prime Minister of the people. Therefore he has no authority to announce that all parties have agreed to implement the 13th Amendement.  It is a very controversial issue and therefore the people have to be consulted  to have their consent.  It is true that you  Your Excellency had  announced once that you will implement  the 13th Amendment plus.   But you had left it at that without taking a decision surely as it  needs reflection, as it is not an Amendment prepared by Sri Lankans, but one written and presented by India to be introduced into our Constitution  in exchange for disarming the terrorists.

Hence it is not some thing that should be implemented in a hurry by a temporary government set up in exigence. This government also proposes to reduce its economic relations with China.

The Maithri Planaya or Yahapalanaya which is highly publicised is a  Dictatorsip, where they accuse persons without allowing them to defend themselves.  This Maitri Palanaya Government controls the media and no body is able to make any view contrary to that of the Government.  They take every possible occasion to accuse and ridicule every one connected with the Previous government. 

They accuse Gotabhaya Rajapakse for various  imagined activities. They want  the Chief Justice to step down.  They demand  the resignation of  the Chairperson of the UGC Kshanika Hirimburegama.  They complain against the Top Management of Titro Gaz . They have complained  against Wimal Weerawansa and Mrs.Weerawansa.  They have even raided the house of  Jackson Anthony as they say that he was connected to RajapakseThey have complaints against Yourself Your Excellency and your children.  Where is this going to end ?  

The people are given only the Maithjri Palanaya  version of news and there is absolutely no way of hearing the other side .  Their  news are mostly based on  vendetta,  on jealousy, hatred , anger and revenge.

The policy of this 100 day Yahapalanaya is to stop  all media access to the former President , his family and any one connected to them.  They should not be seen in the television, not heard in the radio, or should not be allowed to be read in the press.  If this is not a Dictatorship what is ?

Your Excellency people have enough of the Maitri Palanaya, please come back Mother Lanka needs you.

    We want Your Excellency back without your family – Catholic wife and baptised children. After all people don’t vote for family members. They have been the bane of many more would have been people’s heroes – think of Marcos, Suharto, Gadaffi, Mubarak and the list goes on. Family was your undoing and major distraction for good governance. You will see what a difference it will make if you decide to comeback to politics – yet again to serve this ungrateful nation.

    Your four visits to the den of thieves and the sanctuary of pedophiles – also called the Vatican was a big mistake. In the end they wall voted en-block to oust you. Look at the map and you will see how the “ungrateful” voted!

    Country needs you and Gotabhaya back soon to finish off what you started in the development of the country.

    There is absolutely no way to bring back Mahinda and Gotabhaya, unfortunately. The 18A removed term limits for president and Chandrika is now eligible. She will not allow any Rajapaksa to contest from any SLFP led alliance. It was the fault of Mahinda who changed the SLFP constitution to make any president with memberships of SLFP should become the president of the party and the 18A. So they have only themselves to blame. Namal is incapable of making inroads to power unlike his father.

    However, I agree Gotabhaya would make a fine leader. Once again, he has come to the end of the road. The three massive hurdles are Ranil, Sirisena and Chandrika standing in their way.

    You are not defeated or thrown away out of Sri Lanka, the country that belongs to Sinhala Bodhdhists.

    See the map of votes at the last Presidential Election. You have been accepted by all the Sinhala Budhdhist People especially the people live in villages who love peace and harmoney than anything else.

    We expect you to come back and lead the country but you need to follow what the grateful people say and not the way how your ungrateful advisors and suporteders say. Wish you a long life.

    MR became an authoritarian leader in the second term thereby even his cabinet became frustrated. This is the main reason for his down fall. The other reason was the corruption of the cabinet ministers, prime ministers and the ministers son’s dealing with the drugs and the PC members mafia tactics for which the president turned the blind eye.

    We thank you for the role in winning the war and other good things. But your second term was useless. Only Tamils benefitted and they didn’t allow Sinhalese and Muslims to share the massive improvement in the north.

    You shot Sinhala protestors but NEVER harmed Tamil protestors after 2010.
    You gave pipe water to Jaffna but when Weliweriya people begged for it you shot them.
    You gave gold stolen by LTTE from Sinhala and Muslim people to Tamil people only.
    Your LLRC was ALL about Tamils. How about others?
    You forgot who stood by you from 2005 to 2010. Why?
    Casinos only in Sinhala areas and NOTHING in Tamil majority areas.

    Tamil Nationalism has Never Accepted that a Lasting Solution Could be Arrived at Through Full Devolution Within a Unitary State.

    PRE-INDEPENDENCE DAY THOUGHTS 2015: THE FUTURE STATE OF THE NATION

    In the run-up to Independence Day 2015, we must thank God for Mr. Sumanthiran. He is indubitably a moderate and an intellectual. Let us give thanks also for the Sunday Observer, which is a state-run newspaper not given to running stories or distorting them in a manner inimical or embarrassing to the government of the day. Therefore, when Mr. Sumanthiran says something to the Sunday Observer, I take it seriously because I know I am on safe ground. Mr. Sumanthiran tells the newspaper that the TNA doesn’t expect much movement on addressing the Tamil political question during the Hundred Day program. That is realistic –and anyway, who’d want to affect the UNP’s chances at the General election by pressing home Tamil political demands? He also says that the full implementation of the 13th amendment would be a good first step. Then comes the bottom-line: “The PM said that devolution will now be given under the 13th Amendment which the previous government was blocking.     There’s always that ‘but’ isn’t there? There’s always that ‘but’ even for a moderate Tamil nationalist intellectual. The truth as disclosed or rather, reiterated by the cosmopolitan, Colombo based Mr. Sumanthiran is that the proposed removal of the roadblocks to the full implementation of the 13th amendment just isn’t enough. This is because “full implementation of the 13th amendment is no lasting solution”.

    Some readers may think I am making something of a mountain out of a molehill, but interestingly and appropriately the caption of the interview when reproduced on the website of veteran (expatriate) journalist DBS Jeyaraj reflected what was most newsworthy about the story: “Full Implementation of the 13th Amendment is No Lasting Solution- MA Sumanthiran, MP”.

    Now this also goes some way in explaining why the 13th amendment was never fully implemented. That’s because successive Southern leaders understood that if it was fully implemented, matters would not stop there. That would not put a cap on it. The full implementation of the 13th amendment would be but a stepping stone for more. Why? Because “we have clearly said that the full implementation of the 13th amendment is no lasting solution” and therefore “we” would strive to push beyond it. Worse still, that “we” would not try our very best to make the 13th amendment work because if it did, “we” would not be able to prove “our” dogmatic, politically fundamentalist point that “the full implementation of the 13th amendment is no lasting solution”.

    This shows that even on the morning after a democratic renovation, the most moderate of Tamil nationalists isn’t willing to settle for what the most moderate Sinhalese political leader is willing to implement. The deficit or gap still exists as far as the desirable goal; the final status agreement goes. Why so? What is at the root of this?

    To answer this we have to ask ourselves what Sri Lanka would be if the 13th amendment were fully implemented under the existing system. To my mind it would be a unitary system with full devolution or, to put it slightly differently, it would amount to the maximum devolution possible within a unitary system at full stretch. Why then does the moderate Mr. Sumanthiran reiterate the consistent stand of democratic Tamil nationalism, namely that even “the full implementation of the 13th amendment is no lasting solution?”

    This is simply because Tamil nationalism has never accepted that a lasting solution could be arrived at through full devolution within a unitary state. It has always held that a lasting solution is not possible within a state that remains basically unitary. Even moderate Tamil nationalism holds the view that a lasting solution lies somewhere beyond the unitary state; even one endowed with the most generous devolution.

    Mr. Sumanthiran’s answer may be that Mahinda Rajapaksa agreed to consider going beyond the 13th amendment. He did, but the distance he was willing to go even in theory was a quantitative, not a qualitative one; it was for a Second Chamber and another look at the concurrent list for the purpose of redistribution of powers between center and periphery. It would not have entailed a referendum. In any event, going quantitatively and incrementally beyond the 13th amendment within a strong Presidential system and explicitly unitary framework is drastically different from going qualitatively beyond the 13th amendment within a system divested of a strong executive Presidency.

    Quite apart from the debate on desirability, there is one of feasibility. Any such “lasting solution”, indeed anything beyond the 13th amendment, would require an island-wide referendum. How does the TNA propose to win a referendum for a qualitative shift beyond the 13th amendment? Not even the help of its current political partners in the South would be able to secure such an outcome.

    So far, so bad– but it is about to get worse. There is a brand new element in the mix. While the old element remains, namely that the TNA envisages the full implementation of the 13th amendment only as a first step which it intends to push beyond in its striving for a lasting settlement, the new element that arises is the proposed downsizing and downshifting of the executive Presidency. So, while the Tamil nationalists hope to stretch the relationship between center and periphery by means of a settlement beyond the full implementation of 13A, the center itself is about to diminish.

    The TNA is not unaware of this. Indeed the TNA presented this as the main reason for its support for the common candidate of the Opposition. Now we have the hitherto un-contradicted Tamilnet report that the abolition of the executive Presidency and its replacement by a parliamentary system of government was agreed upon in 2013 at a meeting in Singapore, organized by a South African peace NGO and attended by, among others, Messrs. Mangala Samaraweera and MA Sumanthiran. The abolition of the executive Presidency was, according to the report, point 4 of the agreement. (‘Singapore Principles of 2013’, TamilNet, January 22, 2015).

    The story is prefaced in DBS Jeyaraj.com in the following manner:

    ‘The “Tamilnet” website long regarded as the mouthpiece of the Liberation Tigers of Tamil Eelam (LTTE) organization has in a news report revealed details of an alleged “understanding” involving among others the current Foreign Affairs minister Mangala Samaraweera and Tamil National Alliance (TNA) national list parliamentarian MA Sumanthiran that was arrived at in Singapore in the year 2013. The “Tamilnet” website claims that the understanding reached in 2013 formulated a conceptual framework on abolishing the executive presidency based on ten basic principles described as the “Singapore principles”.

    The news report further states that current Presidential adviser Dr. Jayampathy Wickramaratne, Colombo University Law professor VT Thamilmaran and unnamed representatives of the Global Tamil Forum (GTF) along with a lawyer from the Sri Lanka Muslim Congress also participated in the conclave. The conference was organized by South Africa and funded by two European countries alleges the “Tamilnet”. Quoting an unnamed participant in the meeting the “TamilNet” says “Mangala Samaraweera came as a ‘beggar’ urging Tamil support for regime change and abolition of the executive presidency. It was 2013.

    The Tamilnet report also outlines the ten ‘Singapore principles’ described as “hitherto unrevealed Singapore Principles of 2013” ’.     Mr. Sumanthiran is fully conscious of the relationship between the Executive Presidency and the issue of devolution. In his Sunday Observer interview he states as follows:

    “…the Governor is a chief executive officer possessing executive powers. This means that there is no power devolution. The governor is appointed by the President and holds powers during his tenure. The President in the centre nominates him and gives powers and says I have devolved powers. That is no devolution. Practically it is the President who is exercising power through the governor. We want that radically changed so that power is actually given to a body or people who have been elected by the people. So that is the arrangement that we will seek to go beyond the 13 th Amendment and make it meaningful.” (Ibid.)

    This brings us to the question–what is the TNA’s real problem with the 13th amendment? Is it the less than full implementation? No, because if that were the case, it would not take the view that full implementation is not a lasting solution. Is it perhaps that the concurrent list is too thick and that the provincial unit should have some of the powers listed therein? Not really because that is not mentioned. The real problem the TNA has is elsewhere—with the role and powers of the Governor, and inter alia, those of the executive president.

    What does the existing arrangement as critically described by TNA moderate Sumanthiran mean? It means that the executive Presidency, as that office which rests on the elected consent of a majority of voters on the island taken as a single unit, is the repository of the sovereign power of the citizenry and is the fount from which from which power is devolved to the periphery.

    Thus the TNA’s objection is to the fundamental principle that power is devolved to the periphery from a strong center resting upon the broadest possible basis; a presidency that represents the nation as a whole. The TNA’s problem is with the mediatory role of the Governor, who acts as the elevator between the devolved peripheral unit and the presidential apex of the system. The TNA objects to a strong presidency representing the totality of the nation, which is raised above the peripheral unit. The Tamil moderate, Mr. Sumanthiran’s underlying objection is to the very principle that the institution that represents the totality, the whole, should be raised above the part; that the center should be above the periphery and that power should be devolved, i.e. flow downward.

    In the TNA’s vision, power should flow from a center outward to the periphery, but not from an apex, downward to the unit. No wonder then that the TNA wants the Executive Presidency abolished. This means that the system is transformed—I would say debauched—from a pyramid to a flat circle, with the parliament at its center. This means the minority parties are able to influence government formation at the center, through coalitions in parliament, as well as push beyond the unitary framework which would have been weakened by the decapitation of the executive presidency and the severance of the “neck” that links the executive head with the devolved peripheral unit, i.e. the Governor.

    Who will appoint the Governor under the arrangement the TNA seeks: the Parliament, the Cabinet, the PM, or the enfeebled essentially non-executive President? Or will there be no Governor at all? Or will there only be a ceremonial Governor, representing a largely nominal presidency?

    With the TNA intent on moving beyond the full implementation of the 13th amendment, and pushing together with its Southern allies (now in power) for the abolition or radical weakening of the Executive Presidency, what will be the future power relations within Sri Lanka be like, especially between the weaker center and a stronger periphery historically and currently subject to the ideological and politico-strategic pulls and emotional-psychological osmosis from their 70 million co-ethnics across a narrow strip of water, in neighboring Tamil Nadu?

    The TNA is strategically very lucid about what it is about. It is pushing for something beyond even the full implementation of the 13th amendment while it has simultaneously advocated and agreed upon the abolition of the Executive Presidency and thereby the radical diminution of the strong center.

    The division of labor is clear: the governing Sinhala elite (fronted by a non-elite political leader) weakens the center by dismantling or eroding the centripetal executive Presidency, thereby loosening the systemic ties between center and periphery, while the Tamil elite for its part, presses on far beyond the parameters of the unitary state.

    Sri Lanka’s government coalition reaches agreement on constitutional proposals

    Jan 28, Colombo: The National Executive Council of Sri Lanka has reached an agreement on proposed constitutional amendments to be introduced during the 100 day programme.

    The proposed amendment will look at introducing a dual executive system of governance and re-establishment of the independent commissions.

    The proposals have been prepared by a special committee appointed by the National Executive Committee comprising President Maithripala Sirisena, Prime Minister Ranil Wickremesinghe and representatives of other parties including the Tamil National Alliance (TNA), the Jathika Hela Urumaya (JHU) and the Janatha Vimukthi Peramuna (JVP).

    The proposals are expected to be presented in Parliament early next month.

    According to reports, the proposed reforms state that President Sirisena will remain as the Head of State with reduced powers while retaining the defence portfolio and the power to appointment provincial governors and on several other subjects including that of appointing the heads of Sri Lanka’s diplomatic missions abroad.

    The Prime Minister according to the latest proposals will be the Head of the Cabinet. Therefore the proposed system will be a dual executive system of governance.

    Chief Justice of Sri Lanka informed that his position is illegal

    Jan 28, Colombo: The Chief Justice of Sri Lanka Mohan Peiris has been informed that his appointment as Chief Justice is illegal.

    The Office of President Maithripala Sirisena has informed Chief Justice Peiris that his appointment by the previous President is illegal.

    Sources say that the President’s Office had dispatched a letter to the Chief Justice’s residence last evening informing him of the illegality of his appointment.

    This morning Peiris had made a complaint to the police that several individuals including Central Provincial Councilor, Azath Salley, threatened him in his residence last evening demanding that he resign.

    Salley has denied the charges saying that he was invited over to the Chief Justice’s residence by the Chief Justice as they were old friends. He went on to explain that the Chief Justice and he discussed the conditions which would allow him to hand in his resignation.

    Meanwhile, the National Movement for Social Justice (NMSJ) yesterday urged the Peiris to step down from the post of Chief Justice “willingly and in a dignified manner.”

    Convener of the NMSJ, Ven. Maduluwawe Sobhitha Thera said the current Chief Justice was appointed following an unfair impeachment of the 43rd Chief Justice, Shirani Bandaranayake.

    “CJ Mohan Peiris’ appointment was a political appointment made by the previous regime. Therefore it is his responsibility to step down from his post willingly in a dignified manner,” the Thera said.

    In the run-up to Independence Day 2015, we must thank God for Mr. Sumanthiran. He is indubitably a moderate and an intellectual. Let us give thanks also for the Sunday Observer, which is a state-run newspaper not given to running stories or distorting them in a manner inimical or embarrassing to the government of the day. Therefore, when Mr. Sumanthiran says something to the Sunday Observer, I take it seriously because I know I am on safe ground. Mr. Sumanthiran tells the newspaper that the TNA doesn’t expect much movement on addressing the Tamil political question during the Hundred Day program. That is realistic –and anyway, who’d want to affect the UNP’s chances at the General election by pressing home Tamil political demands? He also says that the full implementation of the 13th amendment would be a good first step. Then comes the bottom-line: “The PM said that devolution will now be given under the 13th Amendment which the previous government was blocking.     There’s always that ‘but’ isn’t there? There’s always that ‘but’ even for a moderate Tamil nationalist intellectual. The truth as disclosed or rather, reiterated by the cosmopolitan, Colombo based Mr. Sumanthiran is that the proposed removal of the roadblocks to the full implementation of the 13th amendment just isn’t enough. This is because “full implementation of the 13th amendment is no lasting solution”.

    Some readers may think I am making something of a mountain out of a molehill, but interestingly and appropriately the caption of the interview when reproduced on the website of veteran (expatriate) journalist DBS Jeyaraj reflected what was most newsworthy about the story: “Full Implementation of the 13th Amendment is No Lasting Solution- MA Sumanthiran, MP”.

    Now this also goes some way in explaining why the 13th amendment was never fully implemented. That’s because successive Southern leaders understood that if it was fully implemented, matters would not stop there. That would not put a cap on it. The full implementation of the 13th amendment would be but a stepping stone for more. Why? Because “we have clearly said that the full implementation of the 13th amendment is no lasting solution” and therefore “we” would strive to push beyond it. Worse still, that “we” would not try our very best to make the 13th amendment work because if it did, “we” would not be able to prove “our” dogmatic, politically fundamentalist point that “the full implementation of the 13th amendment is no lasting solution”.

    This shows that even on the morning after a democratic renovation, the most moderate of Tamil nationalists isn’t willing to settle for what the most moderate Sinhalese political leader is willing to implement. The deficit or gap still exists as far as the desirable goal; the final status agreement goes. Why so? What is at the root of this?

    To answer this we have to ask ourselves what Sri Lanka would be if the 13th amendment were fully implemented under the existing system. To my mind it would be a unitary system with full devolution or, to put it slightly differently, it would amount to the maximum devolution possible within a unitary system at full stretch. Why then does the moderate Mr. Sumanthiran reiterate the consistent stand of democratic Tamil nationalism, namely that even “the full implementation of the 13th amendment is no lasting solution?”

    This is simply because Tamil nationalism has never accepted that a lasting solution could be arrived at through full devolution within a unitary state. It has always held that a lasting solution is not possible within a state that remains basically unitary. Even moderate Tamil nationalism holds the view that a lasting solution lies somewhere beyond the unitary state; even one endowed with the most generous devolution.

    Mr. Sumanthiran’s answer may be that Mahinda Rajapaksa agreed to consider going beyond the 13th amendment. He did, but the distance he was willing to go even in theory was a quantitative, not a qualitative one; it was for a Second Chamber and another look at the concurrent list for the purpose of redistribution of powers between center and periphery. It would not have entailed a referendum. In any event, going quantitatively and incrementally beyond the 13th amendment within a strong Presidential system and explicitly unitary framework is drastically different from going qualitatively beyond the 13th amendment within a system divested of a strong executive Presidency.

    Quite apart from the debate on desirability, there is one of feasibility. Any such “lasting solution”, indeed anything beyond the 13th amendment, would require an island-wide referendum. How does the TNA propose to win a referendum for a qualitative shift beyond the 13th amendment? Not even the help of its current political partners in the South would be able to secure such an outcome.

    So far, so bad– but it is about to get worse. There is a brand new element in the mix. While the old element remains, namely that the TNA envisages the full implementation of the 13th amendment only as a first step which it intends to push beyond in its striving for a lasting settlement, the new element that arises is the proposed downsizing and downshifting of the executive Presidency. So, while the Tamil nationalists hope to stretch the relationship between center and periphery by means of a settlement beyond the full implementation of 13A, the center itself is about to diminish.

    The TNA is not unaware of this. Indeed the TNA presented this as the main reason for its support for the common candidate of the Opposition. Now we have the hitherto un-contradicted Tamilnet report that the abolition of the executive Presidency and its replacement by a parliamentary system of government was agreed upon in 2013 at a meeting in Singapore, organized by a South African peace NGO and attended by, among others, Messrs. Mangala Samaraweera and MA Sumanthiran. The abolition of the executive Presidency was, according to the report, point 4 of the agreement.     The story is prefaced in DBS Jeyaraj.com in the following manner:

    ‘The “Tamilnet” website long regarded as the mouthpiece of the Liberation Tigers of Tamil Eelam (LTTE) organization has in a news report revealed details of an alleged “understanding” involving among others the current Foreign Affairs minister Mangala Samaraweera and Tamil National Alliance (TNA) national list parliamentarian MA Sumanthiran that was arrived at in Singapore in the year 2013.     Rajapakse do not have to contest from SLFP, or any other party for that matter, to win a presidential election. It is the votes of the people that matter. Sirisena did not contest from SLFP or any “party”, by won due to total votes of the people.

    Ranil, Sirisena and Chandrika standing together or alone is no hurdle for the people, if they decide.

    If Sirisena contested independent, even with the support of JVP and JHU and UNP fielded a candidate, UNP would have won 37% votes, Maha Raja 40 % and Sirisena 22%., so no result.

    Just imagine if Greedy Raja + Sirisena + JHU . HE could still win at least 60%. Excessive greed killed him.

    He can never come back, don’t be silly.

    Irrespective of the fact that Shirani B was illegally impeached and MP was illegally appointed, I was expecting a better course of action that follows the laws of the land.

    Interesting I note the politicians have distance themselves and allowed the Legal fraternity to initiate the process.

    The BASL is behaving like a bunch of thugs and have used trade union strength to oust Chief Justice 44. If the lawyers are unhappy with the CJ, there is a procedure laid out in the Constitution which is still a viable document on how to remove an unacceptable Justice of the High Court. If these are the lawyers who are expected to uphold the law, what can we expected of ordinary folks? These lawyers have lowered standards to an all time low.

    Even Justice Shirani B. should not have accepted the BASL call to return to Court until procedures were properly followed. There seems to be a clear double standard here…for if it is good enough for the present lot to flout the law, they should not complain about any previous lack to compliance with procedure. It looks as the whole legal profession has gone out of control.
    Isn’t it about time that President Sirisena called for Order and got existing Constitutional procedures to be adhered to in bringing about whatever changes are planned? This has happened without stricture in so many matters that the new president has acted on, like for example the appointment of the PM itself, which went unchallenged. Are there no lawyers with the character to stand up and say it like it is…that everything is being done topsy turvy?
    It is instead pure and simple anarchy where anything goes!
    And this after all the complaints about the previous regime? Come on, People!

    Sri Lanka’s NGOs test limits of new freedoms

    Jan 28 2015 (IRIN) MANNAR- Less than three weeks since Sri Lanka voted in a new president, rights activists and other NGOs say there are already encouraging signs that they may have more freedom to work under the new administration, including in the former conflict zone in the north.

    Six days after the 8 January election, around 300 families of those still missing as a result of Sri Lanka’s two and half decade long civil war attended a prayer service led by Pope Francis at the Madhu Shrine in the northwestern district of Mannar. Some held pictures of missing relatives; others held small signs calling for justice. But in a marked departure from the pattern of recent years, security forces prevented no one from protesting or entering the shrine compound.

    Uthayachandra Manuel, a community activist in Mannar who heads the Association of Families Searching for their Disappeared Relatives, recalls quite a different reaction from the authorities during visits by former UN High Commissioner for Human Rights Navi Pillay and British Prime Minister David Cameron in August and November 2013.

    “There was a lot of harassment then. People were stopped from coming out; police would interview them and ask them to come to the station; one or two have been detained as well,” Manuel told IRIN. Her own activism began in 2008 when her eldest son was arrested. He has not been heard of since.

    “The Criminal Investigation Department kept close tabs on me to find out what I was doing. They will visit families after each protest. That has been usual in the last five years,” she said.

    When Pope Francis visited Sri Lanka earlier this month, Manuel and others in her group were able to hand him a letter containing the details of more than 3,300 missing persons and asking for his assistance in investigating their disappearance.

    “This time no one came to look for me; no one blocked us from getting into the church compound, or holding up pictures of the missing family members,” she said.

    Change in the air?

    NGOs faced extreme scrutiny under the previous long-term President Mahinda Rajapaksa, particularly those working on human rights or issues related to the legacy of the conflict in the north. But optimists within the humanitarian community in Sri Lanka believe the early signs auger well for improvements under the new government of Maithripala Sirisena, who promised during the election campaign to arrest the nation’s drift towards dictatorship.

    “There has been a marked change since the elections. Activists are more free to express themselves and talk in public,” Keerthi Teenakoon, the executive director of the national advocacy body Centre for Human Rights and Research (CHR), said.

    CHR felt sufficiently confident in the apparent easing of restrictions to launch a public campaign to reopen an investigation into a 2012 prison riot in the capital Colombo that left 27 people dead. In the past, lawyers who spoke out in public about the incident received death threats.

    But others remain cautious. Ruki Fernando, a prominent human rights activist who works in the north, believes it is too early to judge the intentions of the new political leadership.

    “There are signs that the changes visible in the capital are yet to manifest themselves in the north,” he told IRIN. Fernando said he knew of two activists in the north who were still in hiding for fear of state sponsored reprisals. Another young man, released in November after seven years in detention, was questioned by police soon after the recent election for no discernable reason.

    But Fernando acknowledged that, in time, restrictions on advocacy work in the north could be eased if activists engage the new administration early. “I think we should push the boundaries of what we have been doing and seek answers to issues like the missing.”

    Thorny issues remain

    The issue of those still missing after the end of the war in 2009 has been vexed. A presidential commission set up under the previous government has so far received details of more than 20,000 cases, including at least 5,000 members of the Sri Lankan defence forces.

    The International Committee of the Red Cross has more than 16,000 cases reported by relatives of people missing since 1990. Meanwhile a report by the UN Secretary-General’s Advisory Panel on Sri Lanka said the figure could be as high as 40,000.

    Sri Lanka’s impeached Chief Justice returns to Supreme Court to resume duties

    Jan 28, Colombo: Sri Lanka’s former Chief Justice Dr. Shirani Bandaranayake returned to the Supreme Court complex today two years after she was unjustly impeached by the previous government.

    The 43rd Chief Justice arrived at the court complex in Hultsdorf this morning amid a grand welcome from the President of Bar Association of Sri Lanka (BASL) Upul Jayasuriya.

    Dr. Bandaranayke who was unceremoniously removed from the Supreme Court in 2013 says she was still the “legal” Chief Justice of the country.

    The President and the Cabinet have reportedly acknowledged that her removal was “illegal” and “flawed.”

    Sri Lankan President Maithripala Sirisena and the Prime Minister meanwhile have informed the 44th Chief Justice Mohan Peiris as the top judge to the apex court by the previous government was illegal and asked him to resign gracefully to pave the way for an independent judiciary, Convener of the Lawyers’ Collective attorney-at-law J.C. Weliamuna said.

    The Bar Association of Sri Lanka maintains that Dr. Bandaranayake does not need to take oaths before President Maithripala Sirisena as she was removed from office through a flawed impeachment process.

    It has been reported that Peiris has agreed to step down. However, he has still not handed over his resignation from the post of Chief Justice as yet.

    Highly placed legal sources said that Dr. Bandaranayke will sit in courts tomorrow and resign paving the way for the appointment of a new Chief Justice. Senior Supreme Court Justice K. Sripavan is expected to be appointed as the next Chief Justice.

    Indian spy expelled, accused of helping oust Sri Lankan president Mahinda Rajapaksa

    Colombo/New Delhi: Sri Lanka expelled the Colombo station chief of India’s spy agency in the run-up to this month’s presidential election, political and intelligence sources said, accusing him of helping the opposition oust Sri Lankan president Mahinda Rajapaksa.
    An Indian foreign ministry spokesman denied any expulsion and said transfers were routine decisions. Mr Rajapaksa, voted out of office in the January 8 election, said he did not know all the facts, and the new government in Colombo has said it is aware of the reports but cannot confirm them.

    But several sources in both Colombo and Delhi said India was asked to recall the agent in December for helping gather support for joint opposition candidate Maithripala Sirisena after persuading him to ditch Mr Rajapaksa’s cabinet.

    A sketchy report in Sri Lanka’s Sunday Times newspaper on December 28 said “links with the common opposition” had cost India’s Research and Analysis Wing (RAW) station chief his job in Colombo.

    India has often been involved in the internal politics of the small island nation off its southern coast – it sent troops there in 1987 in a botched effort to broker peace between the government and Tamil Tiger rebels.

    Mr Rajapaksa’s unexpected defeat after two terms in office coincided with growing concern in India that it was losing influence in Sri Lanka because of the former president’s tilt toward regional rival China.

    The concern turned to alarm late last year when Mr Rajapaksa allowed two Chinese submarines to dock in Sri Lanka without warning New Delhi as he should have under a standing agreement, the sources said.

    Mr Sirisena, the new president, has said he will visit Delhi on his first foreign trip next month and has said India is the “first, main concern” of his foreign policy.

    An Indian official said the RAW agent was recalled after complaints he had worked with Sri Lanka’s usually fractious opposition parties to agree on a joint contender for the election. Then, he was accused of facilitating meetings to encourage several lawmakers, among them Mr Sirisena, to defect from Mr Rajapaksa’s party, the official said.

    The agent was accused of playing a role in convincing the main leader of the opposition and former prime minister Ranil Wickremasinghe not to contest against Mr Rajapaksa in the election, and stand aside for someone who could be sure of winning, said the officer and a Sri Lankan lawmaker who also maintains close contacts with India.

    The agent was also in touch with former president Chandrika Kumaratunga, who was a key player in convincing Mr Sirisena to stand, said the officer and the lawmaker, who also confirmed the agent had been asked to leave.

    “They actively were involved, talking to Ranil, getting those things organised, talking to Chandrika,” the lawmaker said.

    Mr Wickremasinghe, who is now Prime Minister again in Mr Sirisena’s government, met “two or three times” with the man identified as the agent in the months before the vote, as well as with the Indian high commissioner, or ambassador, the prime minister’s spokesman said.

    “They discussed the current political situation,” Mr Wickremasinghe’s spokesman said, but he denied that the Indians had advised him. “He does not know if he advised other politicians.”

    It was not clear if Mr Wickremasinghe was aware at the time that he was meeting with an intelligence official. India’s RAW officers are usually given diplomatic posts when assigned to foreign missions.

    Former president Mr Kumaratunga did not respond to requests for comment. Mr Rajapaksa declined to confirm the involvement of India in the campaign against him.

    “I don’t know, I won’t suspect anybody until I get my real facts,” he said at his party headquarters.

    “There are certain things you don’t talk about,” a close associate of the Rajapaksa family said, but added that “there were clear signs of a deep campaign by foreign elements.”

    Sri Lanka’s then defence secretary Gotabaya Rajapaksa – a brother of the former president – complained about the agent’s activities to Indian National Security Adviser Ajit Doval in November when Doval was visiting the island nation for a defence seminar, the Indian official said.

    Another Indian official, who monitors the region for security threats, said Delhi had been watching Beijing’s growing influence and heavy investments in Sri Lanka under Rajapaksa, who visited China seven times since becoming president in 2005.

    But India was stunned and angry last year when the Chinese submarines docked in Sri Lanka on two separate occasions, a step Delhi saw as part of Beijing’s “string of pearls” strategy to secure a foothold in South Asia and maritime access through the Indian Ocean.

    “The turning point in the relationship was the submarines. There was real anger,” the Indian security official said.

    Indian military officials said Delhi reminded Sri Lanka it was obliged to inform its neighbours about such port calls under a maritime pact, and Indian Prime Minister Narendra Modi raised the issue with Mr Rajapaksa at a meeting in New York.

    In a possible sign of shifting allegiances, India’s top envoy in Colombo, High Commissioner Y.K. Sinha, presented Mr Sirisena with a large bouquet of flowers just hours after the results were announced on January 9. China’s ambassador was only able to meet the new president six days later.

    Again, may I remind you, that it was you who fell hook line and sinker to Lorenzo. To this date I have never responded nor will I give credence to any comments made by him and i dont intend to start now.
    I think I was the only one who has never responded to any of his comments. Colombo Telegraph quickly identified him with his aliases. Fathima Fukshima & Tamodaya. I was quite happy (and smiling) to read you and many others to sing high praises of Lorenzo. I knew exactly what he was up to.

    Ananda- Did I ask for your name? Why should I? I know it. I merely inquired of your interest in Lankan affairs whilst living in US and you are in a better position to protect the interest of Sri Lanka in the US from scandalous stories in US newspapers and the the propaganda from LTTE diaspora.

    It’s laughable that Mahinda Rajapakse is now complaining that he and his family are being hounded by the press and Govt politicians on various allegations.
    Think we all know how he treated the last PE losing candidate- Sarath Fonseka and spurious charges and even dragged in his son-laws mother. Incidentally didn’t Danuka with the help of Hashan give himself up? What happened thereafter?

    His brother Basil could’nt take the heat and ran away to the US (returning on 22 Feb). His other US citizen brother Gota is hesitant to visit US – why? Because of the 3 private suits filed are still outstanding?

    Mahinda is lucky that Maithripala is not vindictive as him.
    If the roles were reversed I’m fairly certain that Maithripala Sirisena will be in jail on some spurious charge.
    Evidence of Mahinda Rajapakse past behaviour has proved that.

    I have a friend by the name Anopheles Walkeri who does NOT comment here. Anopheles Walkeri has forgotten that ALL those who HELPED MR ended up SACKED, DEMOTED OR KILLED!

    1. Mangala was MR’s campaign manager in 2005. SACKED after a few months later!

    2. SF was MR’s army commander. SACKED and DEMOTED!

    3. Lasantha was MR’s confidente during CBK’s time. Ended up DEAD (no one knows WHO killed him but he DIED.)

    4. Shitrani B and Sarath Silva helped him SO MUCH. Ended up getting sacked.

    5. The navy commander and General Nanda Mallawarachchi (savior of the east) ended up just ministry secretaries.

    Some have very SHORT memories, etc.

EVERYONE who has taken this oath has either “absolutely and entirely renounced and abjured all allegiance and fidelity to Sri Lanka” or is a dishonest person who has not “absolutely and entirely renounced and abjured all allegiance and fidelity to Sri Lanka” despite the oath!

    I refused to take this oath because I CANNOT “absolutely and entirely renounce and abjure all allegiance and fidelity to Sri Lanka my Motherland”. How can I?

    But how many SLs will REFUSE? Some called me a JINOISTIC MODAYA when I refused!

    “I hereby declare, on oath, that I absolutely and entirely renounce and abjure all allegiance and fidelity to any foreign prince, potentate, state, or sovereignty, of whom or which I have heretofore been a subject or citizen; that I will support and defend the Constitution and laws of the United States of America against all enemies, foreign and domestic; that I will bear true faith and allegiance to the same; that I will bear arms on behalf of the United States when required by the law; that I will perform noncombatant service in the Armed Forces of the United States when required by the law; that I will perform work of national importance under civilian direction when required by the law; and that I take this obligation freely, without any mental reservation or purpose of evasion; so help me God.”

    IF a US citizen legally and officially with notice to the US government declares, on oath, that he or she absolutely and entirely renounce and abjure all allegiance and fidelity to USA and become a SL citizen, then it is OK. IF GR does this, we accept him for presidency.

    Dear Patriots, don’t be fooled by TALK from people who have absolutely and entirely renounce and abjure all allegiance and fidelity to Sri Lanka.

    The manner in which Mohan Pieris the Chief Justice was removed is most disgusting. He was threatened physically, then threatened with corruption charges and even the president demanded him to resign. When none worked, the government played a game of checkers. There is no legal issue invalidating his appointment. That is total hogwash. The government wants a Yes man Chief Justice so that it can bypass the parliament and enact laws detrimental to the country without the people knowing them (Article 122(1)).

    All these smoke and mirror tactics just to fulfil the Singapore Principles of 2013 of division and secularisation of Sri Lanka into the Balkan of the East.

    I stood up against the impeachment of Bandaranayaka which ha no basis. Her judgement which triggered the impeachment was perfect. Instead of removing 13A, the then government took it on her which is wrong.

    However, the Sirisena government is far worse. Now Sri Lanka is under a complete despotic dictatorship.

    I will write an article on this extremely important matter of which most are not aware.

    Thank you for your response. Of the many things I have observed about Mahinda Rajapakse is that he is a strategist.

    I believe he may have left without questioning the coalition is because sooner or later the military, the Sinhalese nationalists or the Buddhist Sanga will not put up with Sirisena

    THE BIGGEST WEAKNESS OF SIRISENA IS THAT HE HAS TO WORK WITH A MULTI PARTY COALITION WITH DIVERGING INTERESTS.

    Sooner or later they will clash (as in the DMK with the Congress party in India). It would be easier to destabilize his government than that of Rajapakse.. only if he works in the interest of New Delhi and NOT in the interest of the Sinhalese…which BTW he already seems to be doing.
    He has put on hold major Chinese investments
    Immediately opened up dialogue with the Hindu Nationalist party BJP and Modi
    willing to resurrect amendment 13 for the next step to a federal system which then will lead to Elam.

    If the above takes root then Rajapakse knew the “nature of his opponent” and the “nature of his strength within Sri Lanka” India, the Tamils and the Muslims may have just bitten more than they can chew.

    For this reason, I agree with your second conclusion also: MS will be STABBED in the back in the same way he stabbed MR in the BACK … it is only a matter of time.

    I also have TRUST DEFICIT in MS who has shown himself to be a man without HONOR and therefore UNTRUSTWORTHY.

    How can I TRUST someone with the KEYS to the Motherland, who has connived against his leader for MONTHS, prayed at the Dalada Maligawa and ate hoppers with him, and then STABBED him in the back the next day? Yuk!

    WOW … it is for the RICH only! Rs 500,000 payment for a former Sri Lankan to get Dual Citizenship is VERY HIGH!

    On the other hand, people not of Sri Lankan origin should not get citizenship for ANY PRICE, unless they are SPOUSES of former Sri Lankans who apply for Dual Citizenship for whom the payment should be the same as for the spouse!

    Finance Minister Ravi Karunanayake presenting the interim budget 2015 today said that the option of dual citizenship would be available to all persons of Sri Lankan origin and granted after due evaluation. A payment of Rs. 500,000 will have to precede each individual request.

    Furthermore, provision will be made for foreigners seeking resident status in Sri Lanka who are in a position to invest US$ 10 million in the country. All such applications would be subject to the approval of Defence Ministry, and would need to be renewed every 5 years. The visa fee for such persons will be Rs. 2.5 million.
