MR, CBK eligible to contest again ?

Some legal experts are of the opinion that former President Mahinda Rajapaksa is not debarred from contesting the Presidential Election for the third time, it is learnt.

These legal experts believe though the 19th Amendment barred anyone from seeking the Presidency for the third time, it did not have retrospective effect.

That they believed, it did not apply to the past Presidents, who served two terms.

Therefore, they opine that Mr Rajapaksa had the legal eligibility to contest the Presidential polls if he is interested.

However, the Supreme Court has to give its opinion in this regard. For that purpose, it is likely that a voter will make a Fundamental Rights application to the Supreme Court in the future.

    How did a President who led a regime that :
    Saw a winning end to a three decade long existential terrorist threat,
    infra structure improvements, roads, national electricity grid penetrating to 100% of country,
    urban development pinnacled with development of Colombo,
    new developments hambantota harbour, air port, colombio port development and colombo port city, which after rediculing initially now conceeded by even the present regime as the bedrock of SL’s economy going forward.

    Those who failed us are those who have nothing to show for three and a half years in office except nebupous umproven allegations of ” corruption and debt traps”.

    Article 31(2)
    No person who has been twice elected to the office of President by the People, shall be qualified thereafter to be elected to such office by the People.

    There is no need to specify retrospective application. “Who has been twice elected” seals the fate of MR and CBK. They cannot. Besides the court must consider the intention of the parliament when it made the 19A. It was passed to restrict Mahinda.
