The Paradox Involving Plea Bargaining With A Dangerous Criminal and A Second Chance For An Ambitious General Who Chose To Engage The Administration In Poor Vision And Bad Company

Lankaweb Weekly Editorial

July 30th 2010There  is a curious paradox in Sri Lanka today at administrative level which probably tugs at the heartstrings of every patriotic Sinhalese and perhaps even angers the more righteous and just minded.

It rests upon why  Retd. Army Commander  Sarath Fonseka is being truly put through the screws of incarceration based  on the run off in the aftermath of the war which pointed to his ambition for political power over incumbent President Mahinda Rajapaksha and the futile attempts made through tough talk and anticipated national upheaval, attempts to incite the population to rebellion and  a planned Coup d’etat towards unseating the President which never transpired. One which was also fuelled and urged on by a disgruntled opposition which held a similar viewpoint that Fonseka could topple the Government  on his tough talk , ex military status and fabricated innuendo against the Government for which he is now languishing in a jail cell but when one considers the freedoms of more dangerous  opponent adversaries of the Government  like KP alias Kumar Pathmanathan who has now found a new favour with the Rajapaksha Administration because he has chosen to sing like a canary and dance to the tunes played to him in return for leniency one wonders whether Fonseka has somehow missed the bus by not being contrite and relenting his aggressive stance  towards a similar one taken by Pathmanathan where it might have stood in his favour and perhaps also towards the concerted relief of his loved ones whose griefs and anguishes are now a national awareness!

All he had to do was distance himself from the Opposition and re-consider his options as a supportive of Mahinda Rajapaksha and his woes might have been over given the compassionate nature of the President who might have welcomed him with open arms into his camp had Fonseka made the right overtures. Instead  of this approach he chose to be defiant, justify his approach towards how he chose to confront the President, portray the Nation as a corrupt and bigoted one to mislead  the world and even attempt to consort with western powers towards his ambitions  which backfired on him and today he is a pathetic and broken man who stll might have a chance of redemption if he took the same approach as the likes of Pathmanathan, Douglas Devananda, Karuna and Pillayan amongst others who exercised their wisdoms over folly and perhaps end up being a happy camper where his pride and arrogance has not served him well and merely caused his downfall and a thought towards his future moves and motivations and survival something he probably needs to view objectively.!

In the case of Pathmanathan however, there is a dubious lilt to his being granted freedom!

There is a long drawn, melancholy laced and whistful sounding new bulletin issued by Fonseka from prison where he has pleaded his love for and emphasized his sense of patriotism for the Nation and outlined several directions of his reckoning towards the re- structuring of Sri Lanka all the while making the Rajapaksha Administration sound like a bunch of directionless criminals which once again is a bad move on his part, a folly and will definitely not serve him well as the Nation today under the Rajapaksha Administration is visibly making remarkable progress towards re-building and the growth rate in many areas of development phenomenal considering the fragmented state the Nation was in during three decades of terrorism and a clean bill of safety issued by many international sources today which is not the picture Fonseka is painting from his jail cell to invite world attention.

The story on Pathmanathan on the other hand is a curious one where the Administrative representation dodges questions on KP being pardoned and even considered for a post of Governor in the North which of course goes from the sublime to the ridiculous!  and despite committing serious offenses and  being a very dangerous and conniving terrorist hub with a proven track record of attempts to devastate the Nation of Sri Lanka,  the Fonseka excesses seem mild by comparison leaving many discerning wondering what in the name of justice and national security is the Government playing at and whether or not it is in fact a dangerous game which could have dire reprisals for Sri Lanka and perhaps even provide the LTTE an opportunity  to  raise its ugly head all over again!?

There surely must be many patriotic Sinhalese in sympathy with Retd. Gen. Fonseka who has made all the wrong moves which has got him in hot water with the Administration where the question needs to be asked ” at least for the collective rather the unilateral role he played in defeating the terrorists, does he not deserve a second chance towards redemption, a pardon and an opportunity to serve his country which he talks about so much from his bulletins from prison, the case in point however being would the man consider this an option based on how defiant and arrogant he has been thus far to denigrate the Government albeit perhaps his only chance of surviving the heavy charges being levelled at him through very tangible evidence rather than concocted hearsay.

A positive approach towards resolving the dilemma of a paradoxical situation involving a dangerous international criminal  whose future moves in the event of his acquiring freedom which could put the Nation at risk and a respected former Army Commander whose only fault was ambition and the resulting falling out of grace with his Administrative peers may be as follows. If tbe  latter can convinced of his usefulness to the nation through rehabilitation and conditioning towards acceptance of the Administration and its policies which could better serve his country it would be the better option linked to an ensuing favourable result which could benefit the Nation and all concerned which seems a meritworthy one and a chance for Retd. Gen. Sarath Fonseka to prove his claim as a true son of Lanka without  the Administration having to plea bargain with dangerous criminals!

An interesting article on a pertinent issue. It will be interesting to watch how people will respond to these events in time to come. I wonder SF will be amenable to change as it is a matter of principles than choices. I believe that they would not reconcile given the nature of their clash. SF may be going through the current saga for his hand in contributing to many deaths of Sinhala youth (a natural event proven many times in the history) that he sacrificed in order to accomplish some personal ambitions. I came across two interesting but opposing comments on the topic of pardoning KP that appeared in the local web pasted for the Lankaweb readers.

    Original comment:
“Hey idiots! War is a combination of military, economical, diplomatic, and political effort. Yes we accomplish military achievement thanks to Gota, the master minder, but the threat is prevalent. Diaspora Tamils along with western hypocrites give dahm shit until we bow down them and lick their asses. Most idiots who commented here are uneducated easily manipulable jokers. You idiots don´t have brains to see ground realities, just like your masters prabha, Ranil, and SF. There are two ways to deal with KP, hang him and fight with diaspora or use KP to minimize overseas threat. First is one popularly elected by idiots. Second is the hard approach and doable only by a smart person. Because hanging him only leave his dead body. Changing him will deliver good things to society. SF, the most stupid, didn´t change yet to to be pardoned. SF is just like prabha in personality. So, he has to be restrained for the betterment of entire country. Otherwise, US will only need to spend dollars (recall how millions of dollars came to him while he was crying for gov servants salary) to manipulate him to make this country a debacle. “

    Response:
“Lasi your comment sounds exactly like your doggy name. I would agree with you if these Tamil Terrorists have any principles that hold them in high esteem. Have you forgotten what they did during the last 30 years? You are like the other fools including many leaders of the country who made this terror a mega issue by not understanding their culture. During CFA with your kind of political leaders, they did the quite opposite of what they promised, a necessity of survival for them as they got only the leaders of VP type. Your silly assertion has made you blind to the fact that the war of separation is not even over. Only the battle with the die-hard terrorists came to an end as they ran out of puff. How on earth could you tell that it is over just because of this event? Get a good look at the other possibility by giving them freedom to do whatever they wish under all pretensions. These are not those who surrendered. It would be worse than CFA. Look at what those ex-ltters who came to the other side doing now. Tamils tow the line in the west because they do not have a room to manoeuvre against the very people who give them accommodation. As long as we give them leg room, they will clamour for anything and everything. We forget the grand plan VP had for the world. Hanging a bloodthirsty murderer or an accessory to such crime is our law. So why do we need such laws if we are afraid to implement them? Obviously, we are a country that does not carry out death penalty. If his death brings more harm than good, why not use him as the equaliser. Holding KP as a LTTE terrorist is thousand times better than becoming a government stooge as the other terrorists would not cast him away. On the other hand, those of you who think that it will be hunky dory after pardoning KP, you are seeing day dreams. KP will become the loner just like the other influential ltte terror masters who live on government protection. Tamils are Tamils you stupid if you are not one of them. What you encourage to do is to dig the grave for MR and clan. If it is good for you, I feel better as he is one of those local English gentlemen who want Sinhala kids to become English boot lickers.”

  2. Kit Athul Says:

What the lankaweb editorial witer forgot was: “general Fonseka was the only person who openly called TAMIL NADU Poilticians JOKERS” We need to give credit for that. Editorial writes of print media and web sites never challenge the statements of Tamil Nadu Poilticiams. Every week they insult the SL government and hence the SINHALA. Last week was Chidambaram called Prabhakaran “Mudisooda Mannan” (http:news.outlookindia.com?item.aspx?687850) Now compare what you have written about Rajapakse administration and General Fonseka. Why are you Mr. Editor silent about TAMIL NADU TAMILS?

  3. . Says:

To the reader who asked why the current LankaWeb Editorial has not touched on Tamil Nadu Politicians it needs to be said~ the Editorial does not contest petty bickerings of entities such as Tamil Nadu politicians whose rhetoric needs no publicity as they are irrelevant, illogical and of no consequence towards the functioning of the Sri Lankan Administration nor are they a threat anymore from any perspective as there are more disagreements and infighting between the Tamil Nadu politicians than there is unequivocal consensus. Furthermore the Indian Government has a quickfire response to Tamil Nadu excesses by way of overstepping metes and bounds and any attempts to ursurp Sri Lankan with strict and prompt deterrent action when necessary so much so that it is hardly worth overriding what the Indian Administration too views as contentious relative to the bickerings of the TN politicos by a unilateral Sri Lankan response. which is also bad for protocol !
It must however be said, there was a time when Tamil Nadu did get in the way of the smootth functioning of Sri Lanka by way of interferences which were condoned by the respective administratiions of Indira and Rajiv Gandhi for obvious reasons but not a prevalent scenario today due to the pragmatism of President Rajapakshe the collaborations between the two countries and the cordial relations he has fortified with India. Consequently the Tamil Nadu politicos are comparable to dogs barking at the moon and hardly worth paying any attention to!

  4. Ramanie Says:

The SL Govt has a sacred duty by its people to bring the culprits who masterminded and enacted the unprecedented violence and mayhem of last thirty years before the law! It is not an OPTION- its a DUTY! Karuna, Pillayan, George and Daya Masters, the five doctors from the war zone and specifically KP (who has now become respectable Mr Pathmanathan) and all LTTE cadres should have had their day in court! That would illustrate to anyone thinking of a career in crime in future that Crime does not pay! Just because these hardened criminals who collectively formed the “most ruthless terrorist organisation in the world” now sing the right tune and lick the correct posterior they should not be treated with kid gloves or even worse, they should not ever be made into the top public servants that they have now become! What sort of message is the Govt giving the younger generation? What sort of morals do we want in this country? Can the rest of the population get a top job in the public arena with a criminal record? Why are criminals enjoying more rights than law abiding citizens in SL? Very true, the likes of Karuna, Dayananda Pilliayan, KP et al are “adaptable”; adaptability is just a respectable adjective for cunning, two timing, manipulating, two faced, conniving crims. That is their game- they change colours to suit the environment to survive. People with principles do not play that game- they are not good at deception- they say what they think and get sent to jail!

GR and MR are making a huge mistake with KP which will to spoil all their victories- my gut feeling tells me. KP is not only free and appraising his top “political” career- he is now operating his own NGO called “Nerdo” and collecting money from the Tamil diaspora under the guise of “developing” the North and East!!!!!!!!!!! Watch this space on this “development”. Fine, all qudos to the Govt for capturing this rabid dog- that was smart! To think that the Govt is now calling the tune and KP is dancing to it is just plain stupid! We are now pushing our luck! Do we really want to take this risk! Are we so cocksure that we are the ones calling the TUNE? What if it is KP who is calling the TUNE here and we are the morons dancing to it? Why don’t we leave crafty maneouring to the criminals and do what we are good at? Things that we have always done well- such as upholding the law according to the letter? Put the criminals in jail and iron out our diferrences with honourable citizens? Crack the whip on real crims rather than coming down like a ton of bricks on trumped up accusations against good law abiding people? If KP had any real intention to give the Govt all that juicy wealth they were expecting he would would have done so by now! Either he does not command any wealth or “contacts” or he has other ideas about the LTTE ill gotten money! It will be in the interest of the country to lock up this conner who is stringing the Govt along to his own tune! The Govt has no mandate to consort with criminals who destroyed lives and property of the country for 3 decades- its mandate was to defeat the terrorist scum and put them in jail and throw away the key- not the army commander!

  5. Chintha Says:

Changed terrorists who seems to have no threat to national security NOW and a changed war hero who seems to be still with all anti Sri lankan forces who have interest in deviding SL. Hmmmm. The question should be who is a big threat to national security NOW?

  6. Ramanie Says:

Really? Have these terrorists “changed” now? They are no threat to national security anymore, either? Did we get this assurance after putting the crims through the due legal process? Or just guessing! Oh how smart we can be sometimes?!

Coming to think of it- when you look at the calibre of people on the loose, being in jail seems to be the honourable thing to do!

  7. Siri Says:

We have to remember that KP is more useful alive than dead. He can help to get the Tamil diaspora abroad to help in the rebuilding effort. he also knows where the money is, who the foreign politicians were who tried to help the LTTE to fight the war. He is a useful witness at any international court of inquiry. keeping him alive and using him is a very wise decision. SF is a fool who was manupulated by the foreign forces to get control over Sri Lanka. He was prepared to sell our country for a US green card. Sri Lankans should undestand that there is a global game being played, where the LTTE was only a pawn in the hands of the Westerners who were using them to gain control of Sri Lanka. Ranil and party are the same as SF. They are all traitors to the motherland. We have also to remember that the JVP stalwarts like Weerawansa and others are on both sides as politicians. They were also killers at one time. We cannot go on a bloodthirsty killing spree and hang all our opponents in a civilized world. The Tamil Nadu jokers will always be jokers and are not worth taking notice of. They will try their tricks every time an Indian Election comes around to gain milage out of it. It costs nothing for them to make impractical idiotic statements and only a fool like SF will take notice of same and respond. We have to remember that there are 60 million Tamilians in Tamil Nadu and have to handle them in a diplomatic way so as to not cause us any problems. SF will have to go through all the trials and Court Mashalls and if found guilty, should be punished according to the prevailing law of the land.

  8. Chintha Says:

Oh Ramanie the great, the smartest person on earth are you a paid Western agent like SF ?

  9. Raju Says:

What is the big deal being made about KP? This is being peddled by the UNP/JVP and the West (who govern the 3) to have him released/whatever value there is in him to be destroyed/depleted. It is no different to their behaviour during the war trying their best to assist the LTTE to scuttle the war effort.

Seeing the “issue” being made out of KP is careful manipulation to try and prevent the Government from hunting down the LTTEs international network as well as the diaspora wealth, to essentially keep the LTTE still alive hopefully. As we all know the UNP/JVPs political fortunes lay heavily with the Wests & LTTE successes (i.e. destruction, defamations, isolation and damages to Sri Lanka).

You also have Fonseka loyalists, apologists and gushers who are blind to the obvious reality behind their idol which ironically the idol had made clear to all by himself.

KP/Karuna/Pilliyan and others are skilfully being used to further Sri Lanka’s interests; i see no harm in it. I do not like them or forgive them but if they can be squeezed to benefit the nation (they are under lock and key with a gun to their heads to dance) i see nothing wrong in it. If it means letting them have some occasionally cake too so be it.

Fonseka on the other hand is working actively and clearly against the nations interests driven by his burning ego and lust for power. His foul mouth repeatedly proves this.

As has his interactions with the West in attacking Sri Lanka and defaming the nation working with Blake peddling bogus tales of “war crimes” to settle his revenge against the WHOLE nation (not just Rajapakses) for rejecting him twice at elections and to rub his ugly ego and selfish self serving desires. All in all it shows what an ungrateful man he is spitting so wilfully and vilely on the Army to which he boasts about his career being built on and the Rajapakses who truly made him from a nobody into a somebody, pampering his ego and pocket with perks. He has proven without a doubt to not be the great nation loving general on a pedestal he projected himself as but a ruthless, egotistical ungrateful selfish little man who only thinks about himself first, his self aggrandisement and accumulation of wealth, even if it means the country burning in the process. This is the man who after all sold the country out for a green card and teamed up with Channel 4 and the nations enemies to further himself and get his fraudulent revenge.

  10. Raju Says:

Those who are protesting against KP are not genuine and driven by their cheap political desires and hopes to destroy whatever benefit (and there are MANY benefits) can be ascertained by KP.

How come this kind of fuss was not made during his time with the LTTE? How come those peddling against KP did nothing to apprehend him, in fact they spent more time assisting him?
Is it not strange that those in the Opposition political parties (including the ones who sold out the LRRP at the Millennium City Safe house in 2002) making this fuss about KPs presence the same ones who since August 2009 have tried to prevent our intelligence units from grabbing LTTE assets overseas by trying to compromise those teams risking their lives? Now they do it to score “political points” but as then and now the noise they make about KP is also a covert attempt to assist the LTTEs international networks to run and hide, function as a warning to them.

All this done with the despicable aim of undermining the intelligence teams working in foreign countries by trying to get them arrested or fail in their missions, ensure the acitivites of the LTTE is not hampered while also paving the way for the Opposition to accuse the Government of failure and getting our people arrested.

Thus far the Opposition has been unsuccessful in this endeavour (as we saw with the capture of an LTTE ship back in December 2009) so they started dishing out the same stale propaganda claiming: “the wealth was going to one family” to try and demoralise those units and anger the nation, just as they did during the war once again trying to demoralise the people and undermine the Army by talking about non-existent secret deals and corruption –what happened to all that talk?

The Opposition continues with its “game plan” of trying to engineer hardships then blame the Government for those hardships and come quickly as people with the “solution”. We see this best in their collusion with the West and the UN to bring economic sanctions onto the country (using the “war crimes” rubbish), create isolation and misery for the people to try and make the Government unpopular then try and ride into power on the hardships they have created. This is why they HATE to see the economy doing well and Sri Lanka strengthening ties with friendly countries and always pour scorn on such activities.

Now the simple question for those against the use of KP: Would you prefer it if he was still working AGAINST Sri Lanka, rather than being forced to work FOR Sri Lanka? Would you prefer it if he was running the LTTE as such a role he assumed in May 2009 and free to roam the world?

  11. Raju Says:

@Chintha don’t mind Ramanie she is a Fonseka loyalist and apologists perhaps due to a personal acquaintance and friendship. She tries hard to mask Fonseka’s ugliness by pretending its not their or apologising for it with some silly statements and reasoning that have been undermined by non other than Fonseka himself.

  12. cassandra Says:

Perhaps in making a comparison between the treatment given by the government to those from the LTTE, KP, Karuna and others and to Sarath Fonseka, the discussion was always going to get a little confused. It would be interesting if we only considered the treatment accorded to the former.

Now, KP and Karuna were leading lights of the LTTE, who were complicit in the killing of hundreds of servicemen and civilians. They were ‘wanted’ men. KP is even wanted by India for alleged complicity in the assassination of Rajiv Gandhi and took on the mantle of Prabhakaran when the latter was killed. So, it is staggering to say the least to see that people who were once considered criminals should be given the kind of positions they have; one is even a minister of state. How is it possible to have great confidence in the system of justice in the country when this happens? This certainly undermines the credibility of the law enforcement agencies and the machinery of the administration to bring those who have broken the law to justice.

The government presumably knows what it is doing. But there is no doubt what it is engaged in is a very high risk strategy. One cannot forget that President Premadasa also undertook a high risk strategy in dealing with Prabhakaran, and we all know how sadly it ended for the former President. Admittedly, the present circumstances are vastly different to what they were when Premadasa was dealing with Prabhakaran but has the nature of the people the two governments dealt/are dealing with, changed? Let us pray and hope that history will not repeat itself.
