These are times when the world at large is pointing fingers at Sri Lanka ƒÆ’-¡ƒ”š‚ over Human Rights Violations and Sri Lanka’s Law Enforcement Agencies areƒÆ’-¡ƒ”š‚ said to be theƒÆ’-¡ƒ”š‚ main culprits.

The following item which is not only ofƒÆ’-¡ƒ”š‚ similarƒÆ’-¡ƒ”š‚ vein but also a rank disregard for law abiding gainfully employed citizens of Sri LankaƒÆ’-¡ƒ”š‚ whereƒÆ’-¡ƒ”š‚ the only crime of this victim seems to haveƒÆ’-¡ƒ”š‚ been the reality that he is not SinhaleseƒÆ’-¡ƒ”š‚ does not help Sri Lanka’s cause towards maintaining a good image with particular reference to world opinionƒÆ’-¡ƒ”š‚ and most importantlyƒÆ’-¡ƒ”š‚ when there is such a dependency on tourism towards replenishing the Nations coffers where personal safeties of individuals need to be etched in stone!ƒÆ’-¡ƒ”š‚ but overall a matter of integrityƒÆ’-¡ƒ”š‚  towards justice and in fact there are reports from many other parts of the country, of high handed acts by the Police specifically and perhaps the time isƒÆ’-¡ƒ”š‚ at hand for the GOSL to take the matter by theƒÆ’-¡ƒ”š‚ “scruff of its neckƒÆ’-¡ƒ”š‚ ” and resolve it lest the Nation is once again subjected to ignominious scrutiny and a means forƒÆ’-¡ƒ”š‚ those without the entitlement to take up armsƒÆ’-¡ƒ”š‚  even figuratively towards the cause whoƒÆ’-¡ƒ”š‚ just might resort to it as the international community seems hell bent towards at the present!.

There was a time in the recentƒÆ’-¡ƒ”š‚ history of the Nation that excesses in the name of Law and Order were indeed purported to have been committed and a blind eye turned by the authorities. Sadly in this day and age there is no room or proviso for this to continue with impunity. Law Enforcement Agencies such as the Police have a bounden responsibility to serve and protect, not attempt to stamp their authority in ignorant and apathetic perspective and at times in intimidatory manner with objectives to extract from their victims whatever material gains mostly related to money.These typesƒÆ’-¡ƒ”š‚ surely need to be lined up and whipped with a ”cat ‘o’ nine tails” to use the age old form of punishment. In this instance those culpable should in all probabilities be kicked out of the Police Force without compensation! It is an abuse of the oaths they have taken on appointmentƒÆ’-¡ƒ”š‚ as well as the uniform they wear!

When on one hand the Police resorts to such shameful actions on law abiding citizens who haveƒÆ’-¡ƒ”š‚  clear and established credentialsƒÆ’-¡ƒ”š‚  it becomes a cause for concern for all Sri Lankans particularly when there areƒÆ’-¡ƒ”š‚  disgusting racial intonations that go beyond the metaphor and looms as large as life through the words and actions reported! And on the otherƒÆ’-¡ƒ”š‚ as in this case somewhat consequently,ƒÆ’-¡ƒ”š‚ it is invariably picked up by errant politicians with thuggery in their veins and lawlesness on their minds who sometimes carry this even into Parliamentary sessions. There are a few of these typesƒÆ’-¡ƒ”š‚ as we know well enough who continue to get out of hand on the basis that they have clout with the Rajapaksa Administration. So would it be surprising given the inspirations they seem to get from an equally irreponsible Police Force or at least a part thereof who bring to disrepute the good of many who man Sri Lanka’s Police Force which had a reputation for the highest reliability in the not too distant past?

As a former resident of Nugegoda who lived there in times of tranquility and peace with a well co-ordinatedƒÆ’-¡ƒ”š‚ , organised and disciplinedƒÆ’-¡ƒ”š‚ Police Force in the vicinity incorporating Kohuwela, Mirihana and Nugegoda where the police officers were always helpful, kind, courteousƒÆ’-¡ƒ”š‚ and non-intimidatory to law abiding citizensƒÆ’-¡ƒ”š‚ it is apalling to be made aware that such incidents ever take place.

The stamp of authority by the Government seems to be a felt need towards addessing the excesses of Law Enforcement as is portrayed by this incident if this indeed be the case.

“So I wanted to share what happened to me Friday night and Sri Lankan Police Brutality at the Kohuwala Police Station.

I got home around 2 AM and standing outside my gate I was smoking a cigarette texting on my phone when a three wheeler showed up. Both the driver and passenger on my side were dressed in street clothes( tshirts, jeans, trousers and Bata slippers). At first I presumed that the three wheeler stopped thinking I was waiting for one.

I was asked by the driver what I was doing which I ignored the question. Then the guy behind asked me the same thing. I thought I was about to get jumped. Then I noticed the third passenger was policeman in uniform. They exited the vehicle and demanded me to give an explanation as to what I was doing claiming they were the police and one of them being the “OIC Crime”.

I informed them that I was standing outside my gate and that it was my house. They said they suspected me as a burglar. By this time my mother came out and they demanded for my ID. I pulled out my wallet and the one saying he was the “OIC” grabbed it from my hand. At this point I pulled my wallet back which was followed by him shoving me into my mother who fell back into the gate.

The “OIC” demanded again for my ID which I produced. He told me he was confiscating it and for me to come to the police station the next day. In his words “thamuse varen heta polisiyata,umbata parippuwak thennan”. I told him if he was taking my ID I wanted him to issue me a summons with his PC number and name. He refused saying he didnt have to.

They then got into the three wheeler and drove off. I immediately went to the Kohuwala Police station to log an entry saying three persons claiming to be Police took off with my ID. When I got to the station, the same three wheeler pulled up behind me. TheƒÆ’‚¢ƒ¢-¡‚¬ƒ”š‚OICƒÆ’‚¢ƒ¢-¡‚¬ƒ”š‚ grabbed me by my neck yelling that I wasnƒÆ’‚¢ƒ¢-¡‚¬ƒ¢-¾‚¢t home no more and that I was in his house.

There were around 8 Policemen during this time. He dragged me to the back room slammed my head into the wall and hit me three times on the left side of my face while insulting me in profanity. He further went onto say in Sinhalese, that he would tie me and my father to a chair while he raped my mother. After continuing his assault and profanity laced tirade he hit me on the back of my head while throwing me in the cell saying, ƒÆ’‚¢ƒ¢-¡‚¬ƒ…-you better not mention what happened here as I know where you liveƒÆ’‚¢ƒ¢-¡‚¬ƒ”š‚.

This was followed by profanity and insults about my race, I am Burgher, and that we were nothing but ƒÆ’‚¢ƒ¢-¡‚¬ƒ…-goo kariyoƒÆ’‚¢ƒ¢-¡‚¬ƒ”š‚ as had a race in a whole. I decided to let this lunatic know that while he was enjoying his little moment that I would have my day in the morning. I was allowed out at 6:30AM after my mother spoke to the Chief Inspector of Kohuwala Roshan Rajapakse.

After instructions to release me and my statements and fingerprints taken, the lunatic ƒÆ’‚¢ƒ¢-¡‚¬ƒ…-OICƒÆ’‚¢ƒ¢-¡‚¬ƒ”š‚ who was back on duty put me back in the cell for another hour which according to him was to give me further ƒÆ’‚¢ƒ¢-¡‚¬ƒ…-parippuƒÆ’‚¢ƒ¢-¡‚¬ƒ”š‚. Having found out that I was still not released things got heated and I was then taken to the Judicial Medical Officer at Kalubowila at the instruction of the C.I. Having completed my examination I was met by my boss who took me back to the Kohuwala Police demanding for an apology.

I must say that the C.I. of Kohuwala Police was very professional, apologetic and disturbed over the incident and extended his help and service to maximum. He promised a full investigation as well as protection for my family in case of any retaliation.

However I donƒÆ’‚¢ƒ¢-¡‚¬ƒ¢-¾‚¢t plan on letting this matter stop here. This lunatic thinks he is above the law because he wears a uniform, which in this case he was not. I think it should be known to everyone that seeking help from the Police can sometimes come with unexpected problems and harassment like in my case. I would appreciate your thoughts on how to continue this matter further as his threat against my family and home is of utmost importance.”

    First yellow robed thugs violated Article 18 which says Everyone has the right to freedom of thought, conscience and religion; this right includes freedom to change his religion or belief, and freedom, either alone or in community with others and in public or private, to manifest his religion or belief in teaching, practice, worship and observance.
    Now Sri Lanka’s Law Enforcement Agencies are responsible for violating Article 5. Which says No one shall be subjected to torture or to cruel, inhuman or degrading treatment or punishment.
    Where are we heading for??? Could it be possible that an unseen power is instigating a western sponsored regime change behind the scene??.

It appears very much like a politically motivated “set-up” to discredit the government by rousing Sinhala Buddhists against minorities, and sadly some people are falling straight into the trap. What motive do these police have to behave like this towards someone apparently minding his own business and not engaging in any suspicious behaviour? And then to become violent and for extra measure throw in some racial/communal slurs as well? Interesting how they targetted a person who was obviously articulate enough and motivated enough to publicise the incident widely. Stupid police or? It doesnt make sense – other than as a publicity stunt. This sort of incident should be investigated at the highest level and the offenders punished severely. It wouldnt surprise me in the least, if money was exchanged between members of the LTTE diaspora/INGO and these “police” whoever or whatever they actually are. Lets not forget how LTTE cadres used to often successfully masquerade as Sinhalese during the war when they massacred civilians, and they spoke Sinhala fluently also.

    Please file a petition for FR violation at the court.

    That is the RIGHT thing to do.

    If you are not going to do that for whatever reason, that casts serious doubts about your story which I believe may be true.

    Do the right thing. Don’t let these b* get away with this. You may be just one victim.

    Remember how a police officer drowned and killed a madman in Bambalapitiya? He died in prison.

    Take the matter to court. That is the right thing to do.

    Lorenzo, even if it goes to court and even if the government punishes those “police” morons, the anti-Sri Lanka lobby has achieved what they want – bad publicity and dissatisfaction abroad. They will then go onto make political capital out of the fact that “not enough was done” or the punishment was “not right” or even the punishment was “too harsh” and the “human rights” of these “police” was infringed by the “bad government”. Next thing you know these “police” will be claiming political assylum in Australia or some other western country and sitting beside all manner of people pointing fingers at the bad Sri Lanka government and find ways to feel superior to ordinary Sri Lankans – and achieving nothing but more destruction! In the meantime, the terrorist diaspora might pay some other golayas to dress up as army or police or grease yakkas or whatever to go and harass some other innocent person who happens to be well connected internationally! You wait and see. Follow the money trail from these golayas and more than likely leads to the terrorist diaspora or the INGOs or some other anti-Sri Lanka group with an axe to grind.     Who is Citizen Perera? What is his agenda? Is it a attempt to create a Burger version of Premakumaraya? I came to live in Nugegoda in 1962 as a toddler. There were thousands of burgers in Pagoda and Nugegoda. Many migrated. Others intermarried. I have many Burger friends. No one ever told me of any racism towards them let alone police brutality. I smell a rat. A very smelly cat.

    When heard tsunami in SI, I never trusted it. I right away suspected American, Issaelis\wstern Jews. Also, at the time I had idea that somebody should go to investigate the ocean floor from Indonesia to Sri lanka to see if somebody did set dynamite in the ocean floor. And I felt asking Russian and Chinese navies to investigate ocean floor, but I gave up because I thought nobody will do the exact job the way I want unless I am there.

    Regardless of Citizen Perera’s identity Aravinda seems to be a bit confused about the presentation which is not only plausible but also well documented towards authenticity. The point being driven across is the peace and tranquility of the bygone years where Pagoda, Nugegoda, Kotte and Sri lanka per se were safe and secure localities for anyone and the breakdown of Law and order today as a result of strong arm tactics resorted to by some who believe they can get away with it!! The only smelly rat or cat once Aravinda decides to make his mind up seems to be his feeble sense of interpretation relative to the theme which seems to favour the perpetrators.Where has he been all these years when there is such a lament by the Burghers globally about why they quit Sri Lanka in hordes and a mere handful like the victim in this item chose to remain!

What you say is partially, but not entirely true. You have only mentioned the push factors that drove the Burghers out but there are also the pull factors. Without mincing words, the push factors included the stupid educational and linguistic policies of the Banda duo. BAD. Then there was the self-defeating nationalisation and anti-development socialist policies of the leftist parties that shrunk the economy and opportunities for almost everyone, particularly English-fluent minorities in (then) Ceylon and to add insult to injury were treated as aliens in their own country. VERY BAD. The pull factors include, for those Burghers who identify only with their European side and look down or deny any Asian heritage, going to a western country was automatically like a step upwards for them. PATHETIC! Not all went to western countries though. A handful migrated to Asian countries with more moderate policies, like Singapore.

Mr. Bunkensingham called a Rickshaw and went to see Sir Oliver Gunathilake, Sir Oliver called on the telephone to IGP Sir Richard Aluvihare. Sir Richard told Sir Oliver that there is no Police brutality in Nugagoda. He knew Citizen Perera who is a liar. He also told that citizen Perera tried to sell Ganja to Ananda College students but the police arrested him but he bribed the Police man and got away. Sir Richrad also told that this Alex Van Culenburg family is from Kandy and he did not know what was Alex doing in rural Nugagoda? So I went Tramview tea shop where Tramview Mudalali gave me free meal he too told me that Citizen Perera was working as tram fair collector and he picks pokets of people who come to Colombo from Thunpane etc. Since I had time before Mr. TIP TOP Perera came back from the Queens house, I went across street to Beechm Dispancary, where Dr. Beecham gave illegal priscriptions. Dr. Beechm is an Englishman and his wife ia a Tamil Woman from Kandy, who is 60 years ypunger than him. At same time Cooray wedha has started an argument about a deal that he made with Dr. Beecham. Cooray Wedha says that Dr. Beecham cannot prescribe KASAYA to his clients because he will loose all his clients. He can only sell DASHAMUL ARISTAY. To get rid of Cooray Wedha, Dr. Beechem had to call Chandradase across the street. He took a pole and chased Cooray Wedha away. Then we went to Boa tree and met the Jewish Doctor became a Buddhist, who wrote priscriptions to the very poor. most of his paients are prostituts asking him how to prevent getting sexually transmitted diseases. He gives them good advice. I said good by to Mr. TIP TOP Perera. and went to see Mr. Bunkemsingham. He told me the same story. There was no trouble in Nughagoda, it was cooked up by citizen Perera. I said good by to Mr. Bunkensingham. He said when you come next time there will not have any Tramcars but Trolly buses.

    The issue here is not baffling with bullshit of a very transparent nature when unable to dazzle with brilliance in the manner attempted by Lorenzo, Kit Atul and Jayt but a real issue of a minority Burgher being intimidated by goonda type police thugs or some who pretended to be part of the police force where the details are crystal clear although apparently invisible to the myopic moronic types who ridicule the issue. Done perhaps deliberately to suit their own agendas!! Bringing on a slew of bellyaching about the Burghers with the load of codswallop thrown in to portray a false justification of Burgher propriety simply indicates the kind of Sinhala chauvinisn that has clogged the brains of a section of Sri Lankan society that has caused more distress and harm than any collective good towards national image and the more this continues the longer it will take for the recovery process Sri Lanka so desperately needs today!Furthermore it is a stumbling block to any reconciliation process the world is awaiting towards a return to normalcy of the nation which was torn apart as a direct result of the very same mentality of these arrogant and at times ignorant types .

    Without making guesswork, the right thing to do is to file a FR case.

    Let the court decide (not us) on the matter.

    If for some reason he cannot do it (there is no reason actually) that shows there is someone lying here. Don’t take anything at face value!

    If the case is genuine, Perera can well go and file a FR case. If it is NOT genuine, he will not because that will land him in trouble. With a FR petition, we can punish the wrongdoer before he strikes again.

    Though I sympathise with Mr Joachim’s horrendous experience, isn’t it rather dangerous to stand outside one’s gate at around 2 AM at night ? Lanka has yet to settle down to real peace. Also, let us be aware that there are many hired hands around to cause DESTABILISATION of the country.

    The last time a Citizen filed a FR petition in the Supreme Court for unlawful arrest and detention. (Feb 2012)

    Ramasamy Prabaharan, a Tamil businessman married to a Sinhalese (owner of “Panama Traders” an electronics store cum showroom within the Majestic City Complex in Bambalapitiya) who brought a case against Sri Lankan police for torture, unlawful arrest and detention was abducted on 11 February at his home in Colombo, by armed men.
    He was due to appear in court on 13 February. There are fears for his safety.

    On 11 February a group of around seven armed men in plain clothes took Ramasamy Prabaharan into their custody at his house in Colombo. The men grabbed him by the neck and dragged him into a white van parked nearby before speeding away. Ramasamy Prabaharan’s family members shouted for help but no-one came to their aid. Later that day, the family received a ransom demand via his mobile phone but they have not heard anything since. Ramasamy Prabaharan’s whereabouts and fate are unknown.
    The family registered the incident at Wellawatte Police station (incident number 224/222/GCIB). It is the responsibility of the authorities to establish his whereabouts, ensure his safety and reveal the truth of what has happened to him.

    At the time of the abduction, Ramasamy Prabaharan had filed a fundamental rights application with the Supreme Court of Sri Lanka (application no S/C FR 963/2009) against senior police officers, the Attorney-General, and eight others, alleging torture and unlawful arrest and detention.
    The Supreme Court had granted leave to proceed and the hearing had been scheduled for 13 February. Ramasamy Prabaharan was abducted two days before the fundamental rights petition was to be heard in the courts.

    Once again you folks fail to interpret the realities of this case.Citizen Perera was merely presenting a grievance~ a legitimate sounding one given all the facts to the general viewers of this page and had every right to do so without being name called by a few apathetic and ignorant sounding commentators. In doing so there were legitimate points brought forward in the C Perera presentation relative to the safety of ordinary people. It is not for him rather than the victim to take up the issue legally which aparently he is doing. Granted as Fran points out “isn’t it rather dangerous to stand outside one’s gate at around 2 AM at night ?” this is not a done thing in the climate of Sri Lanka today but also an issue that needs to be addressed by the authorities towards public safety and to infer whether or not Sri Lanka today is a Police State which it has every right tp be after 24 years of an armed insurrection by the LTTE !
    It is also recommended that the crap posted by Kit Atul does nor merit posting on Lankaweb as it sounds imbecillic! and deranged !

    Good point Fran. I wouldnt recommend standing outside one’s house even in Canada or the States. If you dont freeze to death, you could be mugged, shot or even raped.

    It is normal practice (even in Sri Lanka) for the law enforcement officer to ask for an ID and/or obtain confirmation from the household as to when loitering outside ones house/gate or “your lane” (neighbourhood) even at some unearthly hour.
    I can think of many occasions servants/maids/drivers are questioned for ID or confirmation of residence when they are innocently chatting with neighbours servants etc at the gate or over the wall. (admittedly not at 2am!).

    Marco, Sri Lanka has faced the most well planned and horrendous terrorist problem possibly in the recent history of the world. It is the duty of the law enforcement authorities to use the most draconian methods to prevent terrorists and other thugs harming the public. If there is an issue of abuse of power by the authorities themselves there are legitimate channels to take ones grievance up with the authorities who should investigate the issue and take appropriate action. That is how a democracy should work. If there is continuing dissAtisfaction voters make informed choices to vote a government that will correct this. Informed decisions are not to be based on rumours, unsubstantiated facts, innuendo, your ethnicity or religion, the ethnicity or religion of the law enforcement personnel or government officials or whether you are conned by westerners into thinking Sri Lankans are inherently inferior in self governance and have to be told by how to run our own country by white westerners. Because so many Sri Lankans still have this clannish communal/class-superior mentality coupled with a slavish view that everything to come out of the west (including politicians) are superior to our own kind we are vulnerable to these sorts of situations. Contrary to the thinking of some our mentally enslaved Sri lankan “mentally enslaved colonial subjects” There are plenty of unethical and corrupt white western politicians and officials. They routinely deflect any focus on their shortcomings onto onto third world countries! If “Perera” is a Sri Lankans as opposed to a mere “citizen of Sri Lanka”, He ought to be aware of the fate of brown and black people in the west who are often the target of hate crimes and random attacks simply because of their skin colour. These attacks are vastly underreprted, justified, downplayed or covered up and they are low priority for the police in the west because often the police themselves are accused of racism. These are things that “Citizen Perera” and the masses should by informed about. The point is, we should be able to investigate and stop these problems ourselves with some autonomy, self-confidence and self-respect. Otherwise we should stop complaining, admit that we are a race incapable of self-governance and hand the country back to the British or someone people most of us will respect or fear! No more “human rights” issues then. Don’t drag out this agony. Problem solved?

    He tried to MISUSE it to avoid getting arrested for his crimes. Good thing he failed. BTW he has REAPPEARED AND LIVING HAPPILY WITH HIS FAMILY NOW!

    That is the first thing to do without BS-ing.

    That also proves his HONESTY and stops this police officer from attacking more people.

    Otherwise nothing happens. This saga continues. Let him do the right thing. We are not the judge, the jury or the UNHRC!

    Perera “smoking a cigarette” at 2 am on a main road, cannot be a ususal “citizen”. Smokers have a problem always.
    I have been to this place numerous times and beating up is the old police method of asking questions, not brutality.
    Anyway, SriLanka is a democracy and as Lorenzo said FR petition is the best.

Real people are: TIP TOP Perera, Cooray Wedha, Dr.Beechem, his wife, Chandradase, his elder brother Romel Singho, Oriental Press owner Mr. Wijayasinha. and Owner of Tram view tea shop. Also owner of Atlas Hall Mr. Soysa.
    My question why use a Fictitious name? Why couldn’t Sefan Andre Joachim publish under his real name? Why is he not filing a FR petition? As suggested by Dham and Lorenzo. Marco, the man with an electronic shop! Lorenzo explaned to you who he is and where he is now. David Appuhamy got agtated for what? This article ia all about deviating the attention away from the real issue. Nullifying the 13A. Right now MR is reallly seared any one mentioning 13A, so activate some one to focus on a different subject, may be. I do not know. This is like Sinhala Jathika Urumaya filied a case against TNA? Two weeks passed NO CASE Filed!

    Voice123 look at this carefully, like the way you analysed. “This Citizen Perera” was a carcter created by Sunday Times or Sunday Observer in the 1950ties. I cannnot remember. All these news papers belong to Rainls family. My problem is the way the story was told. Why didn’t Citizen Perera go and complain to the IGP? Why could’t the mother vist Temple Trees and ask to see the president? Lets say the story is true. posting on the Lankaweb what effect did it have other than people commenting about the stary. So far Citizen Perera has not answered any of our comments.

    Aravinda, I am the same I have many Burger friends when I lived in SL 1960s. even now a second generation Burger person, I contacted told me the same story. Many do not know the difference between Sinhala and Burgers.

    At a guess all these recommendations about filing complaints, protests etc etc. probably come fron people who live away from Sri Lanka without realising that today a person who goes to a Police precinct could get intimidated, assaulted and even locked up depending on how powerful the perpetrators of attrocities against him are. For instance take the Kelaniya Police and try complaining there about Mervyn Silva! No rocket science needed to guess the outcome!
    These are the aberrations of the system that needs to be sorted out and no police officer has to be above the law.Their main task is to serve and protect the public. The arguments for and against smoking a cigaretted outside your property should be a privilege of any law abidinfg citizen even at 2.a.m. where the Police or the Governor General himself needs to be courteous and treat people in a civilised manner not behave as though they own the country! That is the issure here not the cockamanie blabberings that Kit Atul has presented here.His analogy to a Citizen Perra( note the spelling of last name ) of some years gone by is refering to either a cartoon character or someone who posted a satirical column in the newsmedia. The citizen perera here (once again note the spelling ) seems to be a concerned private resident of Nugegoda who has spoken out and stayed anonymous probably for hiw own safety!The bottom line is the Law Enforcement methods and procedures in Post Insurgent Sri lanka cannot accommodate thuggery or intimidation, there are Rules and Regulation which need to be respected and something the Administration needs to view objectively towards resolution!!!

Well, DAILY MIRROR is owned by Ranil Wickramasinghe’s uncle Ranjith Wijayawardena. Dosn’t ring the bell? I agree with Sunil 100% about Mervyn Silva. What I understand is that some one sent a copy of this with comments to the defense secretary.

    If this chap is a Burgher, it s more likely citizen PEREIRA (or even FEREIRA), not the common spelling of Perera. To Burgher purists, spellings, surnames and genealogy is very important. Sri Lankans should be sensitive to cultural differences among us.
