Response to Dr Dayan Jayatilleka’s articles (2) about the 13th Amendment

1.Reference to Dr Dayan JayathillakeƒÆ’‚¢ƒ¢-¡‚¬ƒ¢-¾‚¢s article on ƒÆ’‚¢ƒ¢-¡‚¬ƒ…-Provincial Devolution Through 13th Amendment is a Political Solution Grudgingly Acceptable to both Sinhala and Tamil CommunitiesƒÆ’‚¢ƒ¢-¡‚¬ƒ”š‚ that appeared in ƒÆ’‚¢ƒ¢-¡‚¬ƒ”¹…”dbsjeyaraj.comƒÆ’‚¢ƒ¢-¡‚¬ƒ¢-¾‚¢ on 24 May 2013;ƒÆ’-¡ƒ”š‚  Dr Jayathillake makes a desperate attempt to justify the preservation of the 13th amendment.ƒÆ’-¡ƒ”š‚  Therein, he makes a number of arguments.

One argument by Dr Jayathillake is that we should keep the 13th amendment because IndiaƒÆ’‚¢ƒ¢-¡‚¬ƒ¢-¾‚¢s External Affairs Ministry had indicated to Sri Lanka that if we abolish 13, the Government of Sri Lanka would be ƒÆ’‚¢ƒ¢-¡‚¬ƒ…-at its own riskƒÆ’‚¢ƒ¢-¡‚¬ƒ”š‚ and would force the New Delhi Government to react with ƒÆ’‚¢ƒ¢-¡‚¬ƒ…-firm measures.ƒÆ’‚¢ƒ¢-¡‚¬ƒ”š‚ They have also cautioned that Sri Lanka would be isolating itself in the international community.ƒÆ’‚¢ƒ¢-¡‚¬ƒ”š‚ Mr Jayathillake seems to agree with IndiaƒÆ’‚¢ƒ¢-¡‚¬ƒ¢-¾‚¢s position.

India has to be more specific as to what these ƒÆ’‚¢ƒ¢-¡‚¬ƒ”¹…”firm measuresƒÆ’‚¢ƒ¢-¡‚¬ƒ¢-¾‚¢ would be.ƒÆ’-¡ƒ”š‚  Whether or not Sri Lanka would be isolated from the international community, it is an internal matter for Sri Lanka, unless India says it as a threat. By twice voting against Sri Lanka in Geneva, India has already tried to internationally isolate Sri Lanka.

It is the role of Sri LankaƒÆ’‚¢ƒ¢-¡‚¬ƒ¢-¾‚¢s External Affairs Ministry to articulate to India the dangers of the 13th amendment, and how it can lead to formation of the Tamil Eelam (see our Media Releases/Petition to His Excellency the President); in any case the issue whether the 13th amendmentƒÆ’-¡ƒ”š‚  should be abolished or not is an entirely internal matter that should be decided by the people ofƒÆ’-¡ƒ”š‚  Sri Lanka. Sri Lanka did not put India under undue pressure when its citizens mostly Sri Lankan senior citizens including elderly women on pilgrimage and the countryƒÆ’‚¢ƒ¢-¡‚¬ƒ¢-¾‚¢s venerated Buddhist monks were publicly humiliated and severely assaulted on the streets of Thamilnadu, for the sole reason of being Sri Lankan. The countryƒÆ’‚¢ƒ¢-¡‚¬ƒ¢-¾‚¢s top sportsmen and women are still denied entry into Thamilnadu (India as a Great Country should be ashamed of having such a discriminatory policy on Sri Lanka). India may argue it is a condition in the Indo-Lanka Agreement of 1987 that Sri Lanka creates 9 provincial governments ƒÆ’‚¢ƒ¢-¡‚¬ƒ¢¢”š¬…” this does not ƒÆ’-¡ƒ”š‚ mean Sri Lanka should stick with them forever. International treaties between countries are not necessarily permanent. Countries can vary/revoke them by agreement or of their own. ƒÆ’-¡ƒ”š‚ India will agree under the Accord, it did not fulfill its side of the bargain; the IPKF failed to disarm the LTTE (IPKF committed many atrocities on Tamil civilians also); LTTE was defeated by the Sri Lankan forces, more than 20 years after the IPKF left the country. These are valid reasons for Sri Lanka to get out of the Agreement if it is still valid (doubtful). I hope Dr Jayatilleka would agree India has not shown proper leadership in relation to Sri Lanka. Her foreign policy on Sri Lanka had been largely dictated by anti-Sri Lanka events in Thamilnadu (an ex-Indian Foreign Affairs chief, Mr Kanwal Sibal, criticised India for this). India is the only Asian country with South Korea that voted against Sri Lanka in Geneva in 2013 ƒÆ’‚¢ƒ¢-¡‚¬ƒ¢¢”š¬…” even the pro-western Japan abstained from voting (India ƒÆ’-¡ƒ”š‚ did the same in 2012); in 2013 India first advocated a softer Resolution being implemented against Sri Lanka, within weeks her position dramatically changed (due to Thamilnadu factor), India wanted stringent Resolutions made against Sri Lanka (US objected to this). In a situation like this, it is prudent for Sri Lanka to adopt its own measures of safeguarding its sovereignty and territorial integrity, the number 1 priority for any country.

Dr Jayatilleka tries to compare Sri Lanka with former Yugoslavia. Like India (prior to British colonisation, India was not One Country ƒÆ’‚¢ƒ¢-¡‚¬ƒ¢¢”š¬…” Thamilnadu itself was an independent entity), prior to World War 2, the former Yugoslavian states were independent entities (eg. Yugoslavia, Croatia, Bosnia etc). But, Sri Lanka has always been One Country. There has never been an Eelam in Sri Lanka. Pandya, Chola, Elara were South Indian invaders who were chased away by brave Sinhalese armies. Where an independent nation is consisted of a number of former sovereign states, it is possible for that nation to disintegrate at some point of time (like the former USSR); this theory will not apply to Sri Lanka.

Dr Jayathiallke talks about R2P (ƒÆ’‚¢ƒ¢-¡‚¬ƒ”¹…”Responsibility to Protect). He is wrong to say this doctrine existed in 1987. R2P is a recent development of customoary international law; ƒÆ’-¡ƒ”š‚ the main proponent being Gareth Evans, former Australian Foreign Minister. He emphasised that the world should have intervened in Rwanda to save hundreds and thousands of people (R2P has only been somewhat successfully applied in Libya, to overthrow Gadhafi. The 2nd invasion of Iraq was not UN sanctioned).ƒÆ’-¡ƒ”š‚  In Sri Lanka the Tamils do not face a Rwanda/Libya situation. The UN has failed to apply R2P to Syria (Russia has repeatedly blocked the move in the Security Council).

Dr Jayatilleka, the Great Proponent of the 13th Amendment, ƒÆ’-¡ƒ”š‚ ƒÆ’-¡ƒ”š‚ himself admits that there is a danger in holdingƒÆ’-¡ƒ”š‚  the Northern Provincial Council election! HisƒÆ’-¡ƒ”š‚  argument is twofold: (i) there is a higher danger to the country if the provincial council election is not held, (ii)ƒÆ’-¡ƒ”š‚  to safeguard democracy the election must be held. Advantages of holding of the September election

People in the South who are non-racist have articulated they do not mind having a Northern Provincial Council (of course governed by Tamils), provided that it will not discriminate against them, and it will operate in consistent with the Constitution. Like the other 8 provincial councils, the Southerners want the Northern Provincial Council not to do anything that is detrimental to the countryƒÆ’‚¢ƒ¢-¡‚¬ƒ¢-¾‚¢s sovereignty and territorial integrity.

Disadvantage of holding of the election in September

They have not given up the demand for a separate state. In Geneva in February 2013 they lobbied for the TamilsƒÆ’‚¢ƒ¢-¡‚¬ƒ¢-¾‚¢ right for self-determination (ie, a separate state). Last April in London, they lobbied against CHOGM being held in Sri Lanka. It was only 2 days ago (2 June 2013) where the TNA General Secretary, Mavai Senathirajah MP stated in Jaffna (presumably in Tamil) that ƒÆ’‚¢ƒ¢-¡‚¬ƒ…-the TNA does not believe in a power sharing arrangement under a unitary state.ƒÆ’‚¢ƒ¢-¡‚¬ƒ”š‚ (3 June 2013: Daily Mirror). There are other TNA MPs who have made similar remarks. In such an environment how can the Nation agree to give the administration of the Northern Provincial Council to a group that is actively advocating secession?
  2. ƒÆ’-¡ƒ”š‚ ƒÆ’-¡ƒ”š‚  II.ƒÆ’-¡ƒ”š‚ ƒÆ’-¡ƒ”š‚ ƒÆ’-¡ƒ”š‚ ƒÆ’-¡ƒ”š‚ ƒÆ’-¡ƒ”š‚ ƒÆ’-¡ƒ”š‚ ƒÆ’-¡ƒ”š‚ ƒÆ’-¡ƒ”š‚ ƒÆ’-¡ƒ”š‚ ƒÆ’-¡ƒ”š‚ ƒÆ’-¡ƒ”š‚  The chances of another Eelam war being erupted in the North are much higher if the administration in the North is in the hands of the TNA or a similar separatist group.ƒÆ’-¡ƒ”š‚  Especially if the TNA led provincial government holds Police powers (Varthrajah Permual used it as the provincial ƒÆ’‚¢ƒ¢-¡‚¬ƒ”¹…”ArmyƒÆ’‚¢ƒ¢-¡‚¬ƒ¢-¾‚¢), the consequences could be devastating. Inevitably, there will be clashes between the weapons bearing TNA Police and the Sri Lanka Army. No decent Sri Lankan wants to go back to war.
  3. A TNA led provincial government with Land Power, will never allow the displaced Sinhalese (abut 25,000) to return to the North. According to an eye witness, the TNA MP Mr Suresh Premachandran had recently threatened the Sinhalese who are resettled in Navatkuli Village near Jaffna that they must return to ƒÆ’-¡ƒ”š‚ the South. These Sinhalese families who speak fluent Tamil have lived in the North for several generations. They now live in utmost fear not knowing what will happen to them after the Northern Provincial Council election. There are similar Sinhalese colonies in the North ƒÆ’‚¢ƒ¢-¡‚¬ƒ¢¢”š¬…” Mamaduwa, Welioya, Janakapura, Sinahapura to name a few. ƒÆ’-¡ƒ”š‚ Like what the LTE did to them, would the TNA with Land Power, force them out of North after the election? Would India or the US speak on behalf of them? Any reasonable person would provide the answers ƒÆ’‚¢ƒ¢-¡‚¬ƒ”¹…”YesƒÆ’‚¢ƒ¢-¡‚¬ƒ¢-¾‚¢ and ƒÆ’‚¢ƒ¢-¡‚¬ƒ”¹…”NoƒÆ’‚¢ƒ¢-¡‚¬ƒ¢-¾‚¢ to them respectively.

Once formed, the TNA Northern Provincial Government will cunningly team up with the west and India (they will hoodwink them also) and will achieve their ultimate objective – the Tamil Eelam. It is foolish to think just because the Government conducted the Northern election or did other good deeds for Northern/Eastern Tamils (the Government has done many good deeds), the west and India will take the side of the Government or praise the Government.ƒÆ’-¡ƒ”š‚  Like in the past, the good deeds will soon be forgotten (the country has not been given due credit for the prompt resettlement of the IDPS (300,000), release of 10,000 LTTE cadres back into society, allowing/facilitating more than 200,000 Northern Tamils to migrate to the South in the past decade and the massive development work undertaken in the North and East). Like how the US will always protect Israel, the west and India will always take the side of the Tamils. In their eyes (mainly due to Tamil Diaspora lies and for India ƒÆ’‚¢ƒ¢-¡‚¬ƒ¢¢”š¬…” pressureƒÆ’-¡ƒ”š‚  from Thamilnadu), it will be protection of the underdog for them ƒÆ’‚¢ƒ¢-¡‚¬ƒ¢¢”š¬…” ƒÆ’‚¢ƒ¢-¡‚¬ƒ”¹…”the most discriminated people on earthƒÆ’‚¢ƒ¢-¡‚¬ƒ¢-¾‚¢. ƒÆ’-¡ƒ”š‚ Dr Jayatilleka had been a vehement critique of the LTTE in the past, his current stand of vigorously promoting the Northern Provincial Council Election, which will lead to the end of One Lanka, is unfortunate.

So far no country or international body has threatened Sri Lanka with invasion or sanctions if the Northern provincial council election is not held. No doubt, a strong reaction will come from India and the west, the full extent of it is unknown. ƒÆ’-¡ƒ”š‚ Our External Affairs Ministry has a major task ahead of it – it should be in a position to explain our adversaries why we had to take steps to abolish the 13th amendment and our diplomats must be capable of calming down the tension that will arise ƒÆ’‚¢ƒ¢-¡‚¬ƒ¢¢”š¬…” otherwise they are not good diplomats (Senathirajah and PremachandranƒÆ’‚¢ƒ¢-¡‚¬ƒ¢-¾‚¢s above statements alone are sufficient to convince the entire world what sort of people the TNA are, and we shouldƒÆ’-¡ƒ”š‚  educate the world thatƒÆ’-¡ƒ”š‚  handing the Northern Province to such a group of separatists is akin to ƒÆ’‚¢ƒ¢-¡‚¬ƒ”¹…”leaving the blood bank in charge of DraculaƒÆ’‚¢ƒ¢-¡‚¬ƒ¢-¾‚¢). We can learn from the US, UK, Australia, Israel in this regard (how cleverly they manipulate situations in unison to their advantage). We have strong international friends too, letƒÆ’‚¢ƒ¢-¡‚¬ƒ¢-¾‚¢s use them to our maximum advantage. The writer does not believe India will ƒÆ’‚¢ƒ¢-¡‚¬ƒ”¹…”invadeƒÆ’‚¢ƒ¢-¡‚¬ƒ¢-¾‚¢ Sri Lanka over this issue. The west will not be able to send UN forces (like in East Timor) because China and/or Russia will block the proposal in the UN Security Council (hopefully, we have by now obtained these assurances from them).ƒÆ’-¡ƒ”š‚  If the 13th amendment is abolished by way of a Referendum, Sri Lanka, from a strong position, will be able to argue that both India and the west (like rest of the international world) have to respect the franchise exercised by the Sri Lankan people. I do not know why Dr Jayatilleka states we should knowingly promote something we know of that is ƒÆ’-¡ƒ”š‚ dangerous (nobody behaves like that in real life).ƒÆ’-¡ƒ”š‚  Why cannot he see that the Referendum provides us somewhat a safe passage (the 3rd path)? Would Dr Jayatilleka send his child to school if he knows that something dangerous will happen to the school that day?ƒÆ’-¡ƒ”š‚  No. Then, why does he knowingly advocate such a dangerous proposition to the Nation?ƒÆ’-¡ƒ”š‚  The standard of care expected from Dr Jayatilleka (a former senior diplomat) is higher than that of an ordinary political commentator.ƒÆ’-¡ƒ”š‚ 

Dr JayatillekaƒÆ’‚¢ƒ¢-¡‚¬ƒ¢-¾‚¢s second argument thatƒÆ’-¡ƒ”š‚  the Northern Provincial Council must be held for the sake of ƒÆ’‚¢ƒ¢-¡‚¬ƒ”¹…”democracyƒÆ’‚¢ƒ¢-¡‚¬ƒ¢-¾‚¢ is not an argument even worth of debating ƒÆ’‚¢ƒ¢-¡‚¬ƒ¢¢”š¬…” the countryƒÆ’‚¢ƒ¢-¡‚¬ƒ¢-¾‚¢s sovereignty which is at stake is more important than anything else. Holding of the Referendum is also a part of the democratic process.

Dr JayatillekaƒÆ’‚¢ƒ¢-¡‚¬ƒ¢-¾‚¢s comparison of the 2001 general election that brought Mr Ranil Wickarmasinghe into power with the proposed 2013 Northern Provincial Council election (that is going to bring TNA into power) is not a good example; basically he mixes apples with oranges.

    Sri Lanka government to submit a proposal to amend powers of Provincial Councils

    Jun 03, Colombo: The Sri Lankan government plan to submit a proposal to the cabinet this week regarding the amendment of several powers of the Provincial Councils, government sources say.

    The amendment will withdraw the provisions that enable the Provincial Councils to merge.

    It will also withdraw the provisions that the nationally important bills needed to be passed in all Provincial Councils. Instead, the amendments will be brought so that such a bill will be sufficient to be passed in majority of Provincial Councils.

    However, the proposals of certain government coalition parties to take back the land and police powers of the Provincial Councils have not been included in the government’s proposals, government sources said.

    Sources further said that the government has planned to appeal for a definition of the land powers from the Provincial Councils.

    Tamil alliance of Sri Lanka accuses government of attempting to reduce Tamil votes

    Jun 02, Colombo: The major Tamil party of Sri Lanka Tamil National Alliance (TNA) accuses the government of attempting to reduce the number of Tamil votes in the Province before the elections to Northern provincial Council scheduled for September this year.

    TNA parliamentarian Mavai Senathirajah has said that the government is establishing new villages in the province and settling Sinhala and Muslim people while eliminating the voting rights of 180,000 Tamil people who are still not being resettled and living in other areas with relatives or in camps.

    At a central committee meeting of the TNA’s main party Ilankai Thamil Arasu Kachchi (ITAK) held in Kilinochchi recently the MP told BBC that about 100,000 displaced Tamils are living with the relatives and another 80,000 are living in India and those Tamils will not have the opportunity to vote at the elections.

    Sri Lanka’s Justice Minister recently received approval from the cabinet to bring in draft legislation to amend the Election law to allow displaced people from the Northern Province now temporarily residing in other parts of Sri Lanka to get them registered as voters on submission of satisfactory proof.

    The central committee has decided to discuss this issue with the governments of Sri Lanka and India and the Election Commissioner before the elections, the MP further told BBC.

    The party has postponed taking a decision on nominating a candidate for the chief minister post and how to make the nomination until the elections are announced for the Province.

    Sri Lanka Muslim Congress to protest any attempt to weaken power devolution

    Jun 03, Colombo: The Muslim ally of the Sri Lankan government, Sri Lanka Muslim Congress (SLMC) has registered strong protest against any attempts to abolish the 13th Amendment to the Constitution which was brought to devolve power.

    SLMC Supreme Council met yesterday to discuss the issue. SLMC national organizer Rafeek Rajabdeen said that the party would not extend any support to the government to weaken the power devolution.

    He said that the SLMC would again discuss if the government would bring an 18th amendment to the constitution.

    He also highlighted that the SLMC was a powerful party in the Eastern Province and a coalition party in the central government and the Eastern Provincial Council.

    Jathika Hela Urumaya, a government coalition party has brought a proposal in the parliament to amend the Constitution so that the powers devolve under 13th Amendment to the Constitution be taken back to the center.

    Trincomalee Urban Council in Sri Lanka suspends MoU with US Embassy – report

    Jun 02, Colombo: The Trincomalee Urban Council in Sri Lanka’s Eastern Province has decided to suspend the Memorandum of Understanding (MOU) it signed recently with the US Embassy in Colombo to establish a public information and activity center known as a American Corner in Trincomalee, a local newspaper reported.

    The Sri Lankan Government expressed concern over the signing of the MoU between the US Embassy and the Trincomalee Urban Council on May 22 to jointly establish the American Corner without the knowledge of the External Affairs Ministry.

    A local government entering into an agreement with a foreign mission without the approval of the External Affairs Ministry is a clear breach of protocol, according to the Ministry.

    According to a report in the local English weekly Sunday Leader, the Secretary of the Urban Council Abdul Latif Mohammad Nafeel has said that the External Affairs Ministry had informed the Council that the deal was unacceptable and the Council needs to obtain clearance to continue with the MOU.

    The US Embassy has said that it had signed similar agreements when it opened American corners in Kandy and Jaffna.

    However, the Secretary of the External Affairs Ministry Karunatilaka Amunugama said that a special investigation has been launched into the MOU and the investigation will also cover the American corners opened in Kandy and Jaffna.

    “The Ministry will seek information from the local Council about the deals they had signed with the US Embassy. We have not sought information from the US Embassy as yet,” Amunugama was quoted as saying.

    The Secretary has said that an official from the Ministry has been appointed to investigate the MOU signed with the local councils and a report will be submitted on the findings.

    US embassy spokesman and Director of Press Cultural and Educational Affairs Christopher Teal has said that the purpose of setting up of the information center is to provide vital information to the people particularly, the student population in the East.

    ‘TNA victory will lead to separatism’

    Sri Lanka’s powerful defence secretary Gotabaya Rajapaksa has warned that a Tamil National Alliance (TNA) victory in the proposed elections to the Northern Provincial Council (NPC) under the 13th Amendment of the Constitution, will rekindle the movement for an independent Tamil Eelam.

    The Island daily of Friday quoted Gotabaya as saying: ‘If a political party with a separatist agenda like the TNA were to take control of the provincial administration vested with powers over land and the police as envisaged by the 13th Amendment, the security of the country would be gravely threatened.’ He feared that the country might get back to war.

    Gotabaya, said, if the Liberation Tigers of Tamil Eelam (LTTE) had accepted the Indo-Lanka Accord under which the 13th Amendment was enacted, Eelam could have been created long ago.

    As an official, he could only warn Lanka’s political establishment of the security threat inherent in holding elections to the NPC with land and police powers devolved to the province, Gotabaya said.

    On Thursday, the President’s other sibling, economic development minister Basil Rajapaksa, told Express that no “serious discussions” had taken place in the Cabinet on pruning the 13th Amendment. Cabinet spokesman, Anura Priydarshana Yapa, said any decision on constitutional changes could be made only on the recommendation of the proposed Parliamentary Select Committee.

    What we see now is the second phase of the impeachment saga. The real reason for impeachment was Shirani interpreting the Constitution (which contains 13A) correctly when the Divi Neguma Bill was challenged in Supreme Court. Instead of abolishing 13A, the government impeached her. 13A remains and cause worse troubles.

    The government is not keen on abolishing 13A due to Indian pressure and UNHRC resolutions. What happens now is a pressure tactic only and the actors (JHU, Weerawansa) are playing their parts very well. The plan is to fear TNA into acceptance of 13A as a solution which it has rejected in the past. India, USA and UNHRC also put pressure on TNA to accept 13A as the solution in the interim.

    With every passing year 13A brings new troubles as intended by its architects. Total submission and fear of Indian leaders (including Tamil Nadu leaders) is the hallmark of the present Sri Lankan government.

    The defence secretary is the only top official of this government who has retained healthy judgement and even body weight. A down to earth and highly intelligent professional who has no political clout. The president is going against his promise on the Independence Day and Victory Day not to give to anyone what he refused to give to the LTTE leader.

    Great minds think alike. But there is a twist. “He feared that the country might get back to war.” IF TNA wins north, the country MUST GO TO WAR to disrupt the TNA and north PC.

    * Chased away 1,000,000 Tamilians OUT. If they stayed back SL is now like TN.
    * Reduced Tamilians’ percentage from 18% to 15% (this needs to be reduced further)
    * Killed all moderate Tamilians (otherwise now the coutnry is divided into 8 parts)
    * Rejected all poltiical solutions (otherwise now the coutnry is divided into 8 parts)
    * Chased away IPKF from occupying our country
    * Got rid of Tamil National Army
    * Got rid of Premadasa, Rajiv, Ranjan (useless war criminals)
    * Dismantled the TULF (WORST enemy of SL at that time)
    * Killed many TNA MPs who were becoming a pain in the neck to us
    * Terrorised Jeyalalitha and shut her big gap up
    * Made the world support us in war on terror
    * Kept Jihadists silent (now they are everywhere)
    * Kept blooody Endia out

    Of course they did MANY MORE bad things. The point is we should have been ready for the fallout. When a BIG thug is killed, many small thugs emerge. When snakes are killed, more rats come.

    This gives us some pre-election hope. “LTTE” will once again REJECT 13A and WARN TNA not to contest the election. If they do…………….. (It need not be the LTTE but the scapegoat should be LTTE.)

    I know GR is ONLY making statements (NO ACTION will follow). But his PRE and POST election situations have 2 creative solutions. If we are serious about national security nothing is off the table!!!

    unwarranted attention has been given by most people to dj. the best thing is to ignore the man and his works. he has a job – he is a dj at a club – the Colombon murderous English spleaking club. they emulate the anglo saxon ungulates and ponder on many things arguing about this and that. they sit in chairs cross legged having a scotch in hand and talk of the wisdom of dj and the 13th amendment. we expats along with 20 others challenged the 13 amendment, but to no avail as the wise old fool jr influenced the judgment of 1 judge. now the challenge is back. again it might or might not fail.
    dj is a self glorifying man who now has nothing to contribute to the country but to destroy the very institutions which brought his popularity. he had some substance then but now has lost credibility. so the solution – ignore him.

    Great summary of the UNINTENDED GOOD done by the LTTE!

    However, I don’t think that the 1,000,000 Tamils were “chased away” from Sri Lanka by the LTTE. On the contrary, the LTTE created a “heaven sent opportunity” and the “human smuggling network” that enabled most Tamils to be dumped as”fake refugees” in rich Western countries with greater economic opportunities. Ordinary Tamils collaborated closely with the LTTE to avail themselves of this bounty, and the LTTE, in return, acquired a captive tax base fto fund its war effort in the Tamil Diaspora. This opportunity was NOT AVAILABLE to other Sri Lankans (Sinhalese in particular).

    That is why, the Tamil Diaspora are STRONG LTTE supporters: the LTTE was the greatest thing that happened to them in their lives … it helped them become RICHER than they could ever dream of.

    For Sri Lanka, the LTTE also did some good in enabling these fake refugees to emigrate illegally: it reduced the population of this SEPARATIST community by nearly half! I am sure that that reduction is something the LTTE hoped to REVERSE once Eelam was achieved, perhaps through immigration from Tamil Nadu, because Diaspora Tamils … wedded to their new found wealth … would never want to return to Sri Lanka. By DEFEATING the LTTE, we CLOSED that door … for a while at least. The best laid plans of mice and men often go astray!

    I support the GOSL giving every assistance to those TERMINALLY UNHAPPY Eelamists in Sri Lanka to EMIGRATE LEGALLY to other countries. This will further REDUCE the population of Anti-National TROUBLEMAKERS. Prabhakaran saved us the BURDEN of having to PAY THOSE who have already departed Sri Lanka at THEIR OWN COST! Hallelujah!

    Urgent bill in Sri Lanka parliament tomorrow on Northern Provincial Council election

    Jun 04, Colombo: Chief Government Whip of Sri Lanka Dinesh Gunawardena announced today that an urgent bill will be tabled in parliament for approval tomorrow regarding the the Northern Provincial Council election.

    He said the opposition has also been made aware of the bill and the time is allocated for the bill.

    The Minister said the bill is related to the registration of voters and the time will be allocated for the debate.

    The bill is to amend the election law to allow displaced people from the Northern Province now temporarily residing in other parts of Sri Lanka to register as voters on submission of satisfactory proof.

    The Press Council (Amendment) Act is also to be debated in the parliament tomorrow. The registration fees of the newspapers are to be increased under this act.

    Mr.Chanaka Bandarage…..it is very important for us to write, debate, and show our support to what is going on in Sri Lanka, with regards to NPC elections & abolition of 13, 13 A or any other form of ammendment.

    NOBODY has so far have asked INDIA to state sepecifically, what action they would take if we Sri Lankans, abolish it after a referundum. This is like a BULLY trying to threaten a Sovereign Independent country, which had a legsilative council & managed our affairs, before India got independence. LET THEM state categorically what they are going to do.

    JRJ was so scared & has asked if his life will be spared. This is not the way to reply to India. We must organize & make sure that India understands what a small country like our has done in the past in League of nations, & many other commonwealth forums.

    We stood alone & let the world know what our policies are, & not to take any drastic action even in FIJI, Pakistan or in African countries if they are in line with majority of nations. It is very easy to pass judgemnet on others, as long as you are NOT the recepient of such laws & punishement. Japan still remembers how sri Lanka, helped her at the leauge of nations( before UN came into being).

    We managed when US cut of aid, and the list goes on. SO why worry about India & her threats?. We have our Asian naighbours, as well as China & Russia.

    Tamilians living in Colombo, etc. from the north will also claim they are “displaced”. Their number is HIGHER than REALLY displaced Sinhalese and Muslims.

    Not resettling Sinhalese and Muslims in the north is SHAMEFUL.

    Suspects of LTTE bomb attack in Sri Lanka train 17 years ago get prison sentences

    Jun 04, Colombo: A Sri Lankan court today sentenced three cadres of Liberation Tigers of Tamil Eelam (LTTE) suspected of blowing up a train in Sri Lanka 17 years ago killing 66 people.

    When the case was heard today the Colombo High Court Judge Kumudini Wickremasinghe sentenced two of the suspects – Saverimuttu Loganathan and Robert Maxillan to 10 years of rigorous imprisonment while the female suspect, Siththirasenam Thirumagal alias Ramani to five years of rigorous imprisonment.

    The suspects were accused of placing two bombs in two carriages of a highly crowded train and detonating it while stopped at the Dehiwala station on July 24, 1996. The attack killed 66 people and injured over 400 people.

    The accused have pleaded guilty to the charges of conspiring, aiding and abetting to cause the loss of life and irreparable damage to the Sri Lanka Railway by blasting a bomb.

    Since the suspects have been in remand for nearly 17 years, the counsels for the accused have asked the court for a lenient sentence. The prosecution has not objected to the request.

    Two more suspects Sinnappu Suharajah and Suppiah Sudarshanan have pleaded not guilty to the charges and the judge has fixed their trial for September 11.

    Sri Lanka nationalist party to meet other political parties about motion to abolish PC system

    Jun 04, Colombo: Ally of Sri Lanka’s governing party, the Jathika Hela Urumaya (JHU) will meet government and opposition political parties within this week to discuss a private member’s motion presented by the party to parliament on abolishing the provincial council system in the country.

    JHU Spokesperson Nishantha Sri Warnasinghe said that the JHU had informed the President in writing about the bill and the party now intends to meet every party in the coalition and discuss the issues cited in the Bill.

    “Then we plan to meet the representatives of the main opposition party the UNP and the Tamil and Muslim parties within the next week. We have informed all these parties regarding our desire to hold discussions and have also sent them copies of the Bill for them to go through it,” Warnasinghe said.

    The JHU motion aims primarily to repeal the 13th Amendment to the Constitution which paved way for the power devolving Provincial Council system in the island.

    Warnasinghe added that the JHU also intends to hold discussions with the chief prelates of the country, and other religious leaders as well regarding the bill presented by the JHU.

    The party is also hopeful of holding discussions on the motion with the business sectors and Chambers.

    Jayasiri, about your comment, I think we should not be scared to tell the whole world including India that we do not want 13A and it is a recepie for disaster. We should say this through proper diplomatic channel.

    By not abolishing 13A, but trying to tinker it – 13A, will continue to cause us misery. The country cannot sustain this monstrous White Elephant . Now it is going to deny us a part of our country.

    A Constitution is not a Dog’s Act; it is not something to be meddled with so frequently (any good lawyer will agree with this). After JRJ meddled with the Constitution in 1978, there had been 18 amendments within 35 years! – must be a world record. And more amendments are being planned! That is why Australia, though they do not like the Queen, did not want to Change its Constitution at the Referendum, I think held in 1996. A wise move!

    Ex-CJ Shirani Banadaranaike was impeached on many counts. She came under the spot light (her motives examined) when she opposed the Divineguma Bill (DB). Opposing the DB drew attention on her and her doings in other spheres. Unfortunately, she stands guilty on many counts, it seems.

    The DB, in our view, was a good thing. A sort of safe (partial) replacement of the 13-A.

    ISSUE INTERNATIONAL REPORTS recommending DEVOLUTION OF MORE POWER to EACH of these groups, in the interest of “human rights” and “greater democracy”, of course.

    India’s opposition party delegation arrives in Sri Lanka to discuss 13th Amendment

    Jun 05, Colombo: A six-member Indian delegation led by the deputy leader of Indian opposition Bharatha Janatha Party (BJP) in the Rajya Sabha Ravi Shankar Prasad arrived in Sri Lanka yesterday for a five-day visit.

    During the visit organized by the New Delhi-based India Foundation and Bandaranaike Centre for International Studies in Colombo, the delegation will hold discussions with the Sri Lankan President Mahinda Rajapaksa and Defense Secretary Gotabhaya Rajapaksa on power devolution.

    The delegates intend to discuss the issue of granting police and land powers to the provinces under the 13th Amendment to the Constitution and Northern Provincial Council election with the President and Defense Secretary.

    The Indian delegates will also meet senior leaders of other political parties in Sri Lanka.

    In addition to the leader Ravi Shankar Prasad, Indian delegation will include Shiv Sena leader Suresh Prabhu, senior Indian journalist Swapan Dasgupta, retired IFS officer Vivek Katju, RSS representative Ram Madhav and human right activist Monika Arora.

    The delegation today left for Jaffna in northern Sri Lanka to hold discussions with the leaders of Tamil parties including the Tamil National Alliance (TNA). They will also meet the Governor of the Northern Province to discuss the Northern Provincial Council elections planned o be held in September.

    The delegation includes Suresh Prabhu (Shiv Sena), Ram Madhav (RSS), journalist and political commentator Swapan Dasgupta, former IFS officer Vivek Katju and human rights activist Monika Arora.

    According to The Hindu the delegation’s visit, although not government sponsored, is being watched keenly by the Indian government since the opposition-led team will be meeting all the top leaders of Sri Lanka.

    This is the first discussion BJP will have with the Sri Lankan government prior to India’s general election in 2014.

    2. The de-facto VETO power of Provincial Councils over NATIONAL BILLS which requires UNANIMOUS CONSENT of ALL PCs for passage of National Bills. Under this law, the GOSL would be UNABLE to act against SEPARATIST Provincial Councils in any way.

    3. The Provision for the MERGER of the Northern and Eastern Provincial Councils, that would resurrect the long held dream of Eelamists to impose their majority in the Northern Province on the Eastern Province, and capture it as well. What the SunGod sought to Win by MURDEROUS WAR would be gifted to the TNA in ABJECT PEACE!

    It would be an ABSOLUTE FOLLY to hand over the North and East to UNREPENTANT SEPARATISTS ENABLING them to SECEDE and join Tamil Nadu!

    The LIVES of UNTOLD GENERATIONS OF Sri Lankan Citizens would be placed at RISK by opening this DOOR TO HELL!

    Sri Lanka cabinet approval sought for amendments on power devolution

    Jun 06, Colombo: The Sri Lankan government will submit a proposal to the cabinet of ministers today seeking approval to re-amend the 13th Amendment to the Constitution , government sources said.

    The proposed amendment reportedly aims to remove the provisions provided for a merger of the adjoining provincial councils which allows bills and acts to get passed by all provincial councils before they are passed in parliament.

    The draft bill in this regard has been approved by the party leaders of the ruling United People’s Freedom Alliance (UPFA) that met on June 04 evening under the patronage of President Mahinda Rajapaksa.

    Sri Lanka government sources say that more amendments to the Provincial Council system are to come in the future.

    Meanwhile Minister Wimal Weerawansa said that the President promised to seek a definition from the Supreme Court regarding the police and land powers of the provincial councils.

    Minister’s party, National Freedom Front is campaigning against giving police and land powers of the Provincial Councils.
