He also,\nper requirement, made stipulation of the dates of the following resulting\ngeneral election and convening of the new parliament.<\/p>\n\n\n\n<p>However, subsequent intervening of unforeseen circumstances\nin Sri Lanka (Covid 19) made meeting the aforesaid dates not possible.<\/p>\n\n\n\n<p>These circumstances were beyond the control of the president\nand it is, therefore, apparent that he would be absolved of the necessity of\nadhering to these dates, as it is not possible to do so.<\/p>\n\n\n\n<p>&nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp;\n&nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp;\n&nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp;***<\/p>\n\n\n\n<p>The general election and convening of the new parliament are\ndependent on the dissolution and <em>not<\/em>&nbsp;vice-versa. The election and\nconvening are secondary and functionally different to the dissolution.<\/p>\n\n\n\n<p>Again, if one conceives dissolution, election and convening\nas three parts of a hierarchical structure and in that order of precedence, a\nchange in the latter two will leave the first part intact.<\/p>\n\n\n\n<p>The validity of the proclamation and consequent dissolution\nderives from constitutional authority in the president and, assuming the proper\nprocedure had been followed, these will remain unimpaired due to necessary\npostponement of dates.<\/p>\n\n\n\n<p>Devoid of \u2018stories\u2019 that may cloud basic principles, the\nessential position seems as above.<\/p>\n\n\n\n<p>It appears that, in the circumstances, the commission of\nelections would need to hold elections when conducive to do so, relying on Sections\n24(3) and 129 of the Parliament Elections Act (No. 1 of 1981).<\/p>\n\n\n\n<p>Covid 19 and the related circumstances are extra-ordinary\noccurrence. It cannot be reasonably expected that provision had been made for\nthem in the law.
