It was days after Easter Sunday mass murder. The controversy of this\nbilateral-corporation agreement should worry all Sri Lankans.<\/p>\n\n\n\n<figure class=\"wp-block-image\"><img loading=\"lazy\" decoding=\"async\" width=\"729\" height=\"442\" src=\"https:\/\/www.lankaweb.com\/news\/items\/wp-content\/uploads\/2020\/06\/shenali1206201R.jpg\" alt=\"\" class=\"wp-image-103425\" srcset=\"https:\/\/www.lankaweb.com\/news\/items\/wp-content\/uploads\/2020\/06\/shenali1206201R.jpg 729w, https:\/\/www.lankaweb.com\/news\/items\/wp-content\/uploads\/2020\/06\/shenali1206201R-300x182.jpg 300w\" sizes=\"auto, (max-width: 729px) 100vw, 729px\" \/><\/figure>\n\n\n\n<ol class=\"wp-block-list\"><li><strong>MCC has to be signed &amp; passed by Parliament of Sri Lanka<\/strong>making MCCa domestic law similar to 13<sup>th<\/sup>amendment (Section 6.4) &amp; impossible to remove.If Compact is\nonly for 5 years why pass it in Parliament?<\/li><\/ol>\n\n\n\n<ul class=\"wp-block-list\"><li><strong>Foreign\nPersonnel &amp; Service Firms given entry\/work visas<\/strong>(Section 8.3) \u2013 how many for how long &amp; who is paying them &amp;\nwhat component of funding will go to them not given<\/li><\/ul>\n\n\n\n<ul class=\"wp-block-list\"><li><strong>MCC\ngranted FULL IMMUNITY<\/strong>(Section 6.8)<\/li><\/ul>\n\n\n\n<figure class=\"wp-block-image\"><img decoding=\"async\" src=\"https:\/\/www.shenaliwaduge.com\/wp-content\/uploads\/2020\/06\/MCC-6.8.png\" alt=\"\"\/><\/figure>\n\n\n\n<ul class=\"wp-block-list\"><li><strong>GoSL\ndelegates all of MCC Compact activity administration to a Private Company<\/strong>(Section 2.6) \u2013 its board comprises GoSL Secretaries (can public\nsector senior officials be employed in a private sector capacity WHILE working\nfor the public?<\/li><\/ul>\n\n\n\n<ul class=\"wp-block-list\"><li><strong>But,\nGoSL undertakes responsibility &amp; accountability for all that this Private\nCompany\u2013 MCA Sri Lanka does<\/strong>(Section\n3.2)<\/li><\/ul>\n\n\n\n<ul class=\"wp-block-list\"><li><strong>MCA-Sri Lanka is a private company<\/strong>set up in Sri Lanka to function as&nbsp;<strong>GoSL\u2019s PRIMARY AGENT<\/strong>\u201dresponsible\nfor&nbsp;<strong>exercising the Govt\u2019s rights &amp; obligations to oversee, manage\n&amp; implement the Program and Projects\u201d.&nbsp;Is this legally\/constitutionally allowed?<\/strong><\/li><\/ul>\n\n\n\n<ul class=\"wp-block-list\"><li><strong>MCA-Sri Lanka \u2018shall have operational and\nlegal independence and full decision-making autonomy\u2019<\/strong><strong>including \u2018the ability,&nbsp;WITHOUT consultationwith, or the&nbsp;CONSENT or\nAPPROVALof,&nbsp;ANY OTHER PARTY,\nto (how can Public servants be given full autonomy to take decisions as they\nlike. Isnt this major conflict of interest)<\/strong><\/li><\/ul>\n\n\n\n<ol class=\"wp-block-list\"><li><strong>Enter into contracts in its own name (MCA-Sri Lanka)<\/strong><\/li><li><strong>Sue &amp; be sued<\/strong><\/li><\/ol>\n\n\n\n<p><strong>Establish an account with a\nfinancial in its own name (MCA-Sri Lanka) and hold MCC Funding in that account<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\"><li><strong>Expend MCC Funding<\/strong><\/li><li><strong>Engage contractors, consultants and\/or grantees, including without\nlimitation, procurement &amp; fiscal agents<\/strong><\/li><li><strong>Competitively engage one or more auditors to conduct audits of its\naccounts<\/strong><\/li><\/ul>\n\n\n\n<p>Program Implementation Agreement will provide further details of scope of MCA-Sri Lanka<\/p>\n\n\n\n<figure class=\"wp-block-image\"><img loading=\"lazy\" decoding=\"async\" width=\"741\" height=\"420\" src=\"https:\/\/www.lankaweb.com\/news\/items\/wp-content\/uploads\/2020\/06\/shenali1206202R.jpg\" alt=\"\" class=\"wp-image-103426\" srcset=\"https:\/\/www.lankaweb.com\/news\/items\/wp-content\/uploads\/2020\/06\/shenali1206202R.jpg 741w, https:\/\/www.lankaweb.com\/news\/items\/wp-content\/uploads\/2020\/06\/shenali1206202R-300x170.jpg 300w\" sizes=\"auto, (max-width: 741px) 100vw, 741px\" \/><\/figure>\n\n\n\n<p><strong>MCA-Sri Lanka Board of\nDirectors &amp; Management Unit\u201d<\/strong><\/p>\n\n\n\n<p>Board\nof Directors (11 voting members 2 non-voting observers) \u2013 each Board Member can\nbe represented by an alternate\u201d but be an \u2018Additional-Secretary\u201d or\nequivalent.<\/p>\n\n\n\n<p>2\nnon-voting observers are CEO of MCA-Sri Lanka &amp; MCC Resident Country\nDirector.<\/p>\n\n\n\n<ol class=\"wp-block-list\"><li>Representative from President\u2019s Office<\/li><li>Representative from Prime Minister\u2019s Office<\/li><li>Secretary to the Ministry of Finance<\/li><li>Secretary to the Ministry of Transport &amp; Civil Aviation<\/li><li>Secretary to the Ministry of Lands &amp; Parliamentary Reforms<\/li><li>Secretary to the Ministry of Megapolis &amp; Western Development<\/li><li>Secretary to the Ministry of Highways &amp; Road Development &amp;\nPetroleum Development<\/li><li>Secretary to the Ministry of Women &amp; Children\u2019s Affairs &amp;\nDevelopment of Dry Zone<\/li><li>One Private Sector Representative<\/li><li>Two Civil Society Representatives<\/li><\/ol>\n\n\n\n<p>Management\nUnit \u2013 comprises CEO &amp; comprise \u2018directors and officers as agreed upon\u2019 and\nsupported by appropriate additional staff \u2013 number not given<\/p>\n\n\n\n<p><strong>Any additional staff must have\nMCC approval (the GoSL ends up taking orders from a foreign corporation)<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>MCA-Sri Lanka has to\nprepare Stake Holder Engagement Plan consistent with International Finance\nCorporation Performance Standard for the Assessment and Management of\nEnvironmental and Social Risks and Impacts and satisfy stakeholder committee\nstructures by MCC\u2019s Guidelines for Accountable Entities &amp; Implementation\nStructures.<\/li><\/ul>\n\n\n\n<p><a href=\"https:\/\/www.mcc.gov\/content\/uploads\/2017\/05\/mcc-oceo-guidelinesforae.pdf\">https:\/\/www.mcc.gov\/content\/uploads\/2017\/05\/mcc-oceo-guidelinesforae.pdf<\/a><\/p>\n\n\n\n<ul class=\"wp-block-list\"><li><strong>MCA-Sri\nLanka private company is given access to all of Sri Lanka\u2019s state records (how\ncan a country\u2019s information be given to a foreign corporation?)<\/strong><\/li><\/ul>\n\n\n\n<p><strong>10.MCA-Sri Lanka&nbsp;<\/strong>though\ncomprising board of Govt Secretaries must take permission from MCC to engage\nany entity of the GoSL Implementing Entity Agreement\u201d. Fiscal Agent\u201d\nProcurement Agent\u201d all appointed meeting criteria of MCC.(Annex 1 \u2013 37)<\/p>\n\n\n\n<p>11.<strong>MCC funding dependent on GoSL\nimplementing Bim Saviya&nbsp;<\/strong>(transferring deeds to title\nregistration) &amp; Land Special Provisions Act (converting State land permits\n&amp; grans to absolute freehold rights-ALL land in Sri Lanka to be privatized)\nParcel Fabric Map base for GoSL to complete inventory of State Lands in the\nsame district to help GoSL to determine which State Lands are underutilized\nand available for investment\u201d (Annex 1 \u2013 28-29)<\/p>\n\n\n\n<p><strong>12.<\/strong>Parliament\npasses MCC Compact but&nbsp;<strong>MCC funds to do Parcel Fabriic\nMap of only 28% of land (7 targeted districts<\/strong>\u2013&nbsp;<strong>Anuradhapura \/ Kandy\/ Kegalle\/ Kurunegala\/ Matale\/ Polonnaruwa\/\nTrincomalee\/<\/strong>) (10 land registries out of 35 land registries) MCC will also\nfund the scanning &amp; digitizing of valuation of property files in these 7\ndistricts. Valuation will be linked to property registration system and digital\nfabric map using a unique parcel identification number<strong>. This is a violation of the fundamental rights of the citizens as\nthe Parliament is passing an Act that is spending for only 7 districts (28% of\nland)&nbsp;<\/strong><\/p>\n\n\n\n<p><strong>13.<\/strong>GoSL\nhas to undertake transfer of remaining 35 land registries via bim-saviya from\ndeed to title registration at its cost.&nbsp;<strong>Has the GoSL costed this \u2013 where do they get money for this when\nthey will have no land to tax after privatization?<\/strong><\/p>\n\n\n\n<p>14.<strong>MCC will fund&nbsp;State Land Inventory \u2013\nmapping and inventory of State Lands vested in State institutions in those 7\ndistricts<\/strong><strong>(eSlims \u2013 Electronic State Land\nInventory Management System)&nbsp;<em>a basis for the State to determine the\nrights of citizens who are occupying State Lands and gather available\ndocumentation for the citizens claim to the land for future adjudication\u201d<\/em>(Annex\n1-29)<\/strong><\/p>\n\n\n\n<p>15.GoSL undertakes to provide MCA-Sri Lanka all data by\nCommissioner General of Land, as custodian of State Lands in Sri Lanka for entry\ninto eSlims&nbsp;<strong>(Annex 1-29)<\/strong><\/p>\n\n\n\n<p><strong>16.<\/strong>GoSL\ntook a loan &amp; paid US firm $154m to cadastral mapping of Sri Lanka in 2017\n(1 of 5 activities under MCC Land Project)&nbsp; \u2013 Is this part of MCC or is it\nfalling under GoSL cost.&nbsp;<strong>Exactly\nhow much is GoSL incurring against this $480m to be given in chunks across 5\nyears? How much as GoSL spent so far given $154m has been paid to this US firm?<\/strong><\/p>\n\n\n\n<p><a href=\"http:\/\/17.US\" target=\"_blank\" rel=\"noreferrer noopener\">17.US<\/a> embassy advertised for company to\ndo e-Land Registry (1 of 5 activities of MCC Land Project)<\/p>\n\n\n\n<p><strong>18.<\/strong>GoSL\nundertakes to do<\/p>\n\n\n\n<ol class=\"wp-block-list\"><li>Bim Saviya (private deeds to title transfer) \u2013 only 600,000 out\nof 8million private properties has been transferred since 2006 under 1998 Title\nRegistration Act (Bim Saviya)<\/li><li>converting permits &amp; grants of State Land to \u2018absolute land\ngrants\u2019 registered as freehold rights through Land Special Provisions Act (the\nprevious Govt failed to pass this Act)<\/li><\/ol>\n\n\n\n<p><strong>MCC Funding is condition to\nenacting Registration of Titles Act 1998 &amp; passing LSPA<\/strong><\/p>\n\n\n\n<p><strong>19.MCC Land Project allocated\nfunding is $67,<\/strong><\/p>\n\n\n\n<p><strong>Parcel Fabric Map &amp; State\nLand\nInventory&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;\n$23,400,000.00<\/strong><\/p>\n\n\n\n<p><strong>Deeds Registry\nImprovement&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;\n$11,400,000.00<\/strong><\/p>\n\n\n\n<p><strong>Land Valuation System\nImprovement&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;\n$6,500,000.00<\/strong><\/p>\n\n\n\n<p><strong>Land Grants Registration\/Deed\nConversion&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;\n$19,300,000.00<\/strong><\/p>\n\n\n\n<p><strong>Land Policy &amp; Legal\nGovernance Improvement Activity (5<sup>th<\/sup>Land Project Activity of MCC) GoSL to provide location for LPLG\nGroup in State location \u2013 Annex 1-31&nbsp;<strong>(does hiring staff include paying salaries &amp; does GoSL have to\nfoot maintenance cost of location)<\/strong><\/p>\n\n\n\n<p><strong>Note: MCC funding is dependent\non&nbsp;<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\"><li><strong>implementation of Bim Saviya program transferring deed system to\ntitle registration.<\/strong><\/li><li><strong>State Land Privatization Act (Privatizing all State Land)&nbsp;<\/strong><\/li><\/ul>\n\n\n\n<p><strong>21.<\/strong>MCC\nrequires GoSL to&nbsp;<strong>maintain\u201d the land information technology\n(IT\u201d) systems and provide budget funding for the maintenance &amp; updating of\nsoftware &amp; hardware of each year during Compact Term (5years)<\/strong><\/p>\n\n\n\n<p>22.MCC requires GoSL to&nbsp;<strong>maintain in place all\nlegislation\u201d<\/strong>required to implement the Land Project<\/p>\n\n\n\n<p>23.MCC requires GoSL to&nbsp;<strong>\u2018make sufficient resources\navailable to ensure that registration of land parcels\u2019<\/strong>occurs\nin timely manner<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>MCC requires GoSL to\nprovide all data necessary to MCC for monitoring and evaluations of the outcomes\nof the Land Project.<\/li><\/ul>\n\n\n\n<p><em>25.<\/em>Though\nthere is a Monitoring &amp; Evaluation Plan\u201d which must follow MCC\u2019s&nbsp;<em>Policy for Monitoring &amp; Evaluation of Compacts &amp; Threshold\nPrograms\u201d (MCC M&amp;E Policy)&nbsp;<\/em>M&amp;E Plan can be modified\nwithout requiring amendments via MCC website (which means 24\u00d77 someone will\nneed to be monitoring MCC website for changes)<\/p>\n\n\n\n<p><em>26.<\/em>A 2\na) Program Description says MCC will offer \u2018greater economic growth &amp;\npoverty reduction\u201d but Land Project Constraints Analysis says \u2018private sectors\nfinds difficulty in accessing land for investment purposes\u2019 \u2018the OBJECTIVE of\nthe land project is to increase the availability of information on private land\nand under-utilized State Lands in order to increase land market activity\u201d. The\n5 land activities aim to address this problem. This is again highlighted in<\/p>\n\n\n\n<figure class=\"wp-block-image\"><img decoding=\"async\" src=\"https:\/\/www.shenaliwaduge.com\/wp-content\/uploads\/2020\/06\/MCC-Land-Project-Annex-111-45.jpg\" alt=\"\"\/><\/figure>\n\n\n\n<p><strong>27.If State land is to be\nprivatized \u2013 does the State land have land to tax?<\/strong><\/p>\n\n\n\n<figure class=\"wp-block-image\"><img decoding=\"async\" src=\"https:\/\/www.shenaliwaduge.com\/wp-content\/uploads\/2020\/06\/MCC-Land-Valuation-Improvement.jpg\" alt=\"\"\/><\/figure>\n\n\n\n<p><strong>28.When Land Ministry and\nCentral Bank units are already in place for Research Activity \u2013 why is a group\nof external parties allowed access to State confidential records?<\/strong><\/p>\n\n\n\n<figure class=\"wp-block-image\"><img decoding=\"async\" src=\"https:\/\/www.shenaliwaduge.com\/wp-content\/uploads\/2020\/06\/MCC-land-policy-research.jpg\" alt=\"\"\/><\/figure>\n\n\n\n<p>29.Has\nGoSL factored in the danger of giving US all our intellectual property rights\nfor past-present &amp; future?
