Order to be refixed on July 15th&#8230;!"},"content":{"rendered":"<h2><span style=\"color: #0000ff;\"><em>Media Unit, Dr Thilaka Padma Subasinghe Memorial Law Education Programme,<\/em><\/span><\/h2>\n\n\n<figure class=\"wp-block-image\"><img decoding=\"async\" src=\"https:\/\/1.bp.blogspot.com\/-euDsKw8SNtk\/Xu29wUiWwtI\/AAAAAAAAAg0\/0cztk5NqANIFBKjteqiPcg3mIRYcEBcSACLcBGAsYHQ\/s1600\/IMG_20200618_104256.png\" alt=\"\"\/><\/figure>\n\n\n\n<p>A preliminary objection has been taken\nunder Section 39 of the Judicature Act that a rent case filed in the District\nCourt of Colombo has no jurisdiction for the case to proceed.<\/p>\n\n\n\n<p>The inquiry regarding the preliminary\nobjection was held by way of written submissions and the plaintiff&#8217;s lawyer had\nsubmitted the written submissions along with judgments and several letters in\nEnglish language.<\/p>\n\n\n\n<p>The district court rejected the\npreliminary objection raised regarding that there was no jurisdiction to\nproceed the case after considering the written submissions and ordered to file\nthe answer.<\/p>\n\n\n\n<p>Accordingly, the defendant had filed the\nanswer with a cross claim and request for the translations of the judgements\nand other documents in Sinhala language which were filed with written\nsubmissions on behalf of the plaintiff under Article 24.3 of the Constitution\nand procedural procedure of the District court&nbsp; before commencing the pre\ntrial.<\/p>\n\n\n\n<p>Article 24.3 of the Constitution is as\nfollows;<\/p>\n\n\n\n<p><strong><em>Any judge, juror, party or applicant or\nany person&nbsp;legally entitled to represent such party or applicant, who is\nnot conversant with the language used in a court, shall be entitled&nbsp;to\ninterpretation and to translation into Sinhala or Tamil provided by the State,\nto enable him to understand and participate&nbsp;in the proceedings before such\ncourt and shall also be entitled&nbsp;to obtain in such language any such part\nof the record or a translation thereof, as the case may be, as he may be\nentitled to obtain according to law.<\/em><\/strong><\/p>\n\n\n\n<p>The order regading the translations to be\nobtained in Sinhala language was to be delivered on&nbsp;April 2nd, but due to\nthe curfew imposed by the Covid-19 situation, the cases which were reserved for\ncalling on 2nd of April were called on 15th of June and the above mentioned\norder was again reseved on&nbsp;July 15th.<\/p>\n\n\n\n<p>This legal issue is considered in Court\nnumber 03 of the District Court of Colombo.<\/p>\n\n\n\n<p>This\nis an English translation of the article:<br>\n&#8216;\u0daf\u0dd2\u0dc3\u0dcf\n\u0d85\u0db0\u0dd2\u0d9a\u0dbb\u0dab\u0dba\u0da7 \u0d89\u0d82\u0d9c\u0dca\u200d\u0dbb\u0dd3\u0dc3\u0dd2 \u0db7\u0dcf\u0dc2\u0dcf\u0dc0\u0dd9\u0db1\u0dca \u0d89\u0daf\u0dd2\u0dbb\u0dd2\u0db4\u0dad\u0dca \u0d9a\u0dbb\u0db1 \u0db1\u0da9\u0dd4 \u0dad\u0dd3\u0db1\u0dca\u0daf\u0dd4 \u0dc3\u0dc4 \u0dbd\u0dda\u0d9b\u0db1\u0dc0\u0dbd \u0db4\u0dbb\u0dd2\u0dc0\u0dbb\u0dca\u0dad\u0db1 \u0dc3\u0dd2\u0d82\u0dc4\u0dbd\n\u0db7\u0dcf\u0dc2\u0dcf\u0dc0\u0dd9\u0db1\u0dca \u0dbd\u0db6\u0dcf \u0daf\u0dd2\u0dba \u0dba\u0dd4\u0dad\u0dd4\u0daf?\n\u0db1\u0dd2\u0dba\u0ddd\u0d9c\u0dba\n\u0da2\u0dd6\u0dbd\u0dd2 15 \u0da7 \u0d9a\u0dbd\u0dca \u0dba\u0dba\u0dd2&#8230;!&#8217;\n\nMedia Unit,<br>\nDr Thilaka Padma Subasinghe Memorial Law Education Programme,<br><br><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Media Unit, Dr Thilaka Padma Subasinghe Memorial Law Education Programme, A preliminary objection has been taken under Section 39 of the Judicature Act that a rent case filed in the District Court of Colombo has no jurisdiction for the case to proceed.
