{"id":119414,"date":"2021-10-20T16:26:14","date_gmt":"2021-10-20T23:26:14","guid":{"rendered":"http:\/\/www.lankaweb.com\/news\/items\/?p=119414"},"modified":"2021-10-20T16:26:14","modified_gmt":"2021-10-20T23:26:14","slug":"erasing-the-eelam-victory-part-19d","status":"publish","type":"post","link":"https:\/\/www.lankaweb.com\/news\/items\/2021\/10\/20\/erasing-the-eelam-victory-part-19d\/","title":{"rendered":"ERASING THE EELAM VICTORY   Part 19D"},"content":{"rendered":"<h2><span style=\"color: #0000ff;\"><em>KAMALIKA PIERIS<\/em><\/span><\/h2>\n\n\n<p>The government of Sri Lanka&nbsp;&nbsp;&nbsp;&nbsp;\ndefeated the LTTE and declared victory on 19. May 2009.&nbsp; The military victory in the final war was total,\nsaid analysts. However, Sri Lanka did not follow through after the victory. The\ngovernment did not declare the Eelam war as a civil war and it did not take\nsteps to bring the north and east firmly into the mainstream. Instead it\nbacktracked.<\/p>\n\n\n\n<p>Mahinda Rajapaksa,&nbsp;&nbsp;\nPresident of Sri Lanka made three mistakes, one after the other, soon\nafter winning the war. Firstly he allowed Ban Ki-Moon, UN\nSecretary-General&nbsp; &nbsp;to come into Sri Lanka to inspect the Eelam\nvictory. Ban Ki Moon had no business coming here and inspecting the Eelam war. He\ndid not have the authority to do so. The UN Secretary-General cannot interfere\nin internal matters of member states.<\/p>\n\n\n\n<p>The UN Charter describes the\nSecretary-General as chief administrative officer of the Organization, who\nshall act in that capacity and perform such other functions as are entrusted to\nthem by the Security Council, General Assembly, Economic and Social Council and\nother United Nations organs. The Charter also empowers the Secretary-General to\nbring to the attention of the Security Council any matter which in his opinion\nmay threaten the maintenance of international peace and security. <\/p>\n\n\n\n<p>That is not all. &nbsp;Article 100 of the UN Charter &nbsp;&nbsp;&nbsp;says that\nin the performance of their duties the Secretary-General shall not seek or\nreceive instructions from any government or from any other authority external\nto the Organization. They shall refrain from any action which might reflect on\ntheir position as international officials responsible only to the Organization.<\/p>\n\n\n\n<p>Ban Ki-moon, ignored all this and came to Sri Lanka to inspect the\nEelam victory. He had come, it appears, at the invitation of the President. He arrived\nin Sri Lanka on 23 May: Critics said he came for the sole purpose of holding\nSri Lanka accountable for the military strategies used during the final phase\nof the armed conflict, &nbsp;to kick start the\n\u2018war crimes\u2019 charge. &nbsp;<\/p>\n\n\n\n<p>He held talks with the President, Foreign Minister as well as\nother senior leaders of Sri Lanka. &nbsp;He also consulted \u2018other relevant\nstakeholders\u2019, members of international humanitarian agencies and civil\nsociety.&nbsp; He visited the internally displaced persons (IDP) sites at\nVavuniya and flew over the site of the final conflict at Mullaitivu. <\/p>\n\n\n\n<p>A joint statement was issued by the\nGovernment of Sri Lanka and the United Nations at the conclusion of the visit.\nThis is a very peculiar joint statement. It did not affirm the unity of Sri Lanka\nand the end of a secessionist &nbsp;action. Instead,\nit supported Tamil separatism and even used Tamil separatist jargon. <\/p>\n\n\n\n<p>The statement said that Sri Lanka had entered a new post-conflict\nbeginning. This \u2018new situation\u2019 should be used for the long-term development of\nthe north. The government must ensure relief, rehabilitation, resettlement and\nreconciliation in the north. <\/p>\n\n\n\n<p>Also the government must now start addressing the aspirations and\ngrievances of all communities and working towards a lasting political solution.\nThe government must begin a broader dialogue with all parties, including the\nTamil parties in these \u2018new circumstances \u2018. There must be a national solution\nacceptable to all sections of people, concluded the statement.<\/p>\n\n\n\n<p>The second mistake made by&nbsp;&nbsp;\nPresident Mahinda Rajapaksa , was to set up a&nbsp; commission to inquire into the &nbsp;Eelam victory. This implied that the\ngovernment was at fault in fighting Eelam. Mahinda Rajapaksa&nbsp;&nbsp; set up in May 2010,&nbsp; a commission called &nbsp;Commission of Inquiry on Lessons Learnt and\nReconciliation.&nbsp;&nbsp; <\/p>\n\n\n\n<p>The terms of inquiry&nbsp; of\nthis LLRC&nbsp; were also very&nbsp; peculiar. &nbsp;They were slanted towards &nbsp;Tamil separatism. They&nbsp; actually &nbsp;&nbsp;recognized the illegal Ceasefire Agreement,\nwhich &nbsp;had created an unofficial Eelam .\nThe Commission was asked to see what went wrong after that. The Commission was\nalso asked to see how&nbsp; a repeat\nperformance of war could be avoided.<\/p>\n\n\n\n<p>The terms of reference further &nbsp;&nbsp;indicated that the government was prepared to\nmake restitution to those affected by the war. Reconciliation was also included.\n&nbsp;The terms of reference &nbsp;are given below.<\/p>\n\n\n\n<p>The Commission was asked &nbsp;&nbsp;&#8220;To inquire and report on the following\nmatters that may have taken place during the period between 21 February 2002\nand 19 May 2009, namely: <\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>The facts and circumstances which led to\n     the failure of the ceasefire agreement operationalized on 21 February 2002\n     and the sequence of events that followed thereafter up to the 19th of May,\n     2009.<\/li><li>The lessons we would learn from those\n     events and their attendant concern, in order to ensure that there will be\n     no recurrence;<\/li><li>The methodology whereby restitution to\n     any person affected by those events or their dependants or their heirs,\n     can be affected;<\/li><li>The institutional administrative and\n     legislative measured which need to be taken in order or prevent any\n     recurrence of such concerns in the future, and to promote further national\n     unity and the reconciliation among all communities, <\/li><\/ul>\n\n\n\n<p>The LLRC rose\nto the occasion and &nbsp;said that Tamils had\nto be provided with a political solution. The LLRC recommended,&nbsp; power sharing at center, devolution&nbsp; and Reconciliation. In the north it recommended\ndemilitarization and&nbsp; vacation of all\nprivate and public land occupied by the security forces. <\/p>\n\n\n\n<p>The LLRC said, &#8220;The process of reconciliation requires a full\nacknowledgement of the tragedy of the conflict and a collective act of\ncontrition by the political leaders and civil society, of both Sinhala and\nTamil communities. The conflict could have been avoided had the southern\npolitical leaders of the two main political parties acted in the national\ninterest and &nbsp;offered an acceptable\nsolution to the Tamil people &nbsp;Tamil\nSeparatist Movement welcomed the LLRC report.<\/p>\n\n\n\n<p>Mahinda\nRajapaksa\u2019s third mistake was that instead of taking&nbsp; strong action in the north, the government\nbent over backwards to appease the Tamils &nbsp;there. President Mahinda Rajapaksa went\nto Kilinochchi, spoke in Tamil and told the people there that his government\nwill rebuild all that was destroyed, and will strive to provide everything they\nneed. (Daily News 17.6.13 p 1) The government &nbsp;, it appears, took the position that &nbsp;the government &nbsp;was to blame for all the damage.<\/p>\n\n\n\n<p>There will be\na special census on human and property damage cause by terrorism through the\npast three decades,&nbsp; President &nbsp;said.&nbsp;\nThis survey will cover the scale and circumstance of death and injury to\ncivilians and also to property during the period 1982-2009, that means the &nbsp;full period of conflict. <\/p>\n\n\n\n<p>The media\nreported in 2013 that the government had set aside the colossal sum of USD 1350\nmillion for infrastructure development in Northern Province, for &nbsp;railways, electricity, highways, bridges,\nwater supply and sanitation.&nbsp; &nbsp;&nbsp;85% of\nthe foreign&nbsp;&nbsp; loans are&nbsp; to be spent on developing the north. <\/p>\n\n\n\n<p>The main\nemphasis was on roads and bridges. The government has spent 10 billion on\ndevelopment of infrastructure in north to replace the damage done by the LTTE, reported the\nmedia in 2013.&nbsp; In Vavuniya\nall disconnected, damaged and dilapidated highways and roads including rural\nroads have been renovated and rehabilitated. <\/p>\n\n\n\n<p>11 large\nbridges were completed. The &nbsp;A9 highway,\nBatticaloa-Trincomalee highway, Vavuniya&nbsp;\nHorowopotana, Mannar and Medawachchiya were improved. A bridge connecting&nbsp; Sangupiddy in <a href=\"https:\/\/en.wikipedia.org\/wiki\/Kilinochchi_District\">Kilinochchi District<\/a> to Karaitivu\nin Jaffna District was built. Before this bridge the only land route to Jaffna\nwas&nbsp; on A9 via Elephant Pass causeway.\nThe bridge is part of the <a href=\"https:\/\/en.wikipedia.org\/wiki\/A32_highway_(Sri_Lanka)\">A32 Jaffna-Mannar highway<\/a>. <\/p>\n\n\n\n<p>Kilinochchi\nwas developed.&nbsp;&nbsp; The media announced in\n2013 that over 8 million has been allocated to Kilinochchi. This allocation was\ndescribed as a \u2018staggering allocation, unprecedented at district level.\u2019 <\/p>\n\n\n\n<p>The\ngovernment said that 26,730 new houses were planned &nbsp;for Kilinochchi. The\ngovernment will provide 18,699 of them.&nbsp;\nAlso, the government would repair 4119 of the 6349 houses that need to\nbe repaired.&nbsp; The balance will be done\nlater. Nearly 15,000 wells were cleaned or renovated. <\/p>\n\n\n\n<p>A substantial\nsum of money was spent on restoring the health services that had been\nparalyzed. Major hospitals were renovated and provided with additional\nfacilities. &nbsp;Tellippalai\nbase hospital was renovated to the cost of Rs 10 million. Kilinochchi roads\nwere improved. <\/p>\n\n\n\n<p>Thanks to\nthis weak, apologistic approach of the government, &nbsp;the Tamil Separatist Movement &nbsp;revived and&nbsp;\nstarted&nbsp; the story that the Tamil\npopulation in north was an innocent group battered&nbsp; by the government for no reason. They started\nto speak of the northern population as \u2018victims.\u2019 &nbsp;These \u2018victims\u2019 were not victims at all, they\nwere complicit. They had helped the war, they supported the LTTE .<\/p>\n\n\n\n<p>The work done\nin the north by the government&nbsp; was\nheavily criticized. Some of it was not welcome at all. The new&nbsp; roads and bridges broke the isolation of the\nnorth. It was now easier and quicker&nbsp; to\nenter the north.<\/p>\n\n\n\n<p>&nbsp;Center for Policy Alternatives, headed by\nPakiasothy Saravanamuttu, criticized the 2013 census on human and property\ndamages &nbsp;due to the Eelam war. They said\nthat the census caused a lot of distress \u2018to northern victims of the conflict\u2019.\n&nbsp;&nbsp;<\/p>\n\n\n\n<p>The CPA &nbsp;said that this census was not correctly done. The\nmethodology was deficient. &nbsp;How could\nthey record the entire families that died or went missing, who is to speak for\nthem, there is no guarantee of completeness. It was a census which relied\nheavily on collective and subjective memory, from traumatized persons. Also the\ntime period was too small. <\/p>\n\n\n\n<p>The\nintimidation faced in the north today , the militarization,&nbsp; the harassment and violence faced by families\nof ex-combatants could have prevented them from giving accurate information.\nOne option given in the Census &nbsp;is death\nby the military. They will not want to admit this. Households fear reprisals by\nthe military if they say that the killing were due to the military.&nbsp; So they say \u2018don\u2019t know\u2019, continued CPA.<\/p>\n\n\n\n<p>Also air\nstrikes are not included in the questionnaire. The respondents should have been\nasked to state whether the deaths were by army, navy or air force. Air strikes\nare one of the ways in which the public was killed. The &nbsp;government is trying to cover this up. There\nwas an air strike on&nbsp; 9.7.1995 where 65\npeople were killed and 150 wounded &nbsp;while\ntaking refuge in St Peters church, Navaly, Jaffna, said CPA.
