While Part 1 exposed the linguistic and literary distortions behind the modern separatist claim, this second part dismantles the political fraud using the tools of&nbsp;constitutional law, legal maxims, and international jurisprudence. The truth is clear: Sri Lanka is a unitary, sovereign nation \u2014 and&nbsp;the Sinhalese have defended that unity for centuries, often with their lives. To twist Eelam\u201d into a separatist slogan is not only a lie \u2014 it is a violation of truth, law, and justice. Even peaceful advocacy for a separate state is unconstitutional.<\/li>\n\n\n\n<li>No clause provides for ethnic secession or a mono-ethnic federal state.<\/li>\n\n\n\n<li>The Sinhalese are not a settler community\u2014they are the\u00a0native custodians.<\/li>\n<\/ul>\n\n\n\n<p><strong>Lex est quod populus constituit\u201d<\/strong>&nbsp;\u2013&nbsp;<em>The law is what the people have established.\u201d<\/em><\/p>\n\n\n\n<p>The Constitution is the will of Sri Lanka\u2019s people, who overwhelmingly rejected separatism in Parliament and by vote.<\/p>\n\n\n\n<p><strong>Supreme Court of Sri Lanka<\/strong>&nbsp;\u2013&nbsp;<em>2006 ruling on the de-merger of the North and East<\/em>:<\/p>\n\n\n\n<p>There is no legal basis for a merged Tamil homeland. The merger was never constitutionally valid.\u201d<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">4.&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <strong>International Law and the abuse of Self-Determination<\/strong><\/h3>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Article 1(2) \u2013 UN Charter: Self-determination must not interfere with territorial integrity of sovereign nations.<\/li>\n\n\n\n<li>Declaration on Friendly Relations (UNGA Res 2625):<\/li>\n<\/ul>\n\n\n\n<p><em>\u2026Nothing in the principle of equal rights and self-determination shall be construed as authorizing any action which would dismember or impair\u2026 the territorial integrity of sovereign and independent States.\u201d<\/em><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>UNGA Res. 2625 (1970): Self-determination cannot disrupt existing sovereign states or be used for ethnic separatism.<\/li>\n\n\n\n<li><strong>ICJ ruling (Wall Opinion, 2004)<\/strong>:<\/li>\n<\/ul>\n\n\n\n<p><em>Self-determination cannot be invoked to violate the territorial integrity of an existing state unless a people is under colonial domination.\u201d<\/em><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Legal Maxim:<em>Falsus in uno, falsus in omnibus<\/em><\/li>\n<\/ul>\n\n\n\n<p><em>False in one thing, false in everything.\u201d<\/em><\/p>\n\n\n\n<p>Tamil separatist narrative rests on false history \u2014 it discredits the entire claim.<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Nemo plus juris ad alium transferre potest quam ipse habet\u201d<\/strong><br>\u2013<em>No one can transfer more rights than they themselves possess.\u201d<\/em><\/li>\n<\/ul>\n\n\n\n<p>Tamil separatists cannot demand secession on lands they never historically owned or ruled.<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>ICJ Advisory Opinion (Kosovo, 2010): Only permitted when a people are under oppression or colonization \u2014 not applicable to Sri Lankan Tamils. In fact the National Armed Forces carried out the world\u2019s biggest &amp; first humanitarian rescue operation to save some 300,000 Tamils held hostage by banned terrorists LTTE.<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\">5.&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <strong>The Vaddukoddai Resolution: &nbsp;&nbsp;<\/strong><\/h3>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Declared in 1976 by elites (TULF), falsely claiming historical Tamil sovereignty.<\/li>\n\n\n\n<li>It had\u00a0no legal foundationand was never recognized by any international body.<\/li>\n\n\n\n<li>Led directly to the\u00a0terrorist LTTE campaign, which killed Sinhalese, Tamils, and Muslims alike.<\/li>\n\n\n\n<li>Legal Maxim:<em>Constructive Fraud<\/em>\u00a0\u2014 deception without a direct lie, used to influence international sympathy.<\/li>\n\n\n\n<li><strong>Legal Maxim<\/strong>:<\/li>\n<\/ul>\n\n\n\n<p><strong>Ex turpi causa non oritur actio\u201d<\/strong>&nbsp;\u2013&nbsp;<em>No right of action arises from a base cause.\u201d<\/em><\/p>\n\n\n\n<p>A political resolution based on fabricated history, false racial oppression claims, and leading to terrorism, cannot give rise to any lawful demand.<\/p>\n\n\n\n<p><strong>International Principle Violated<\/strong>:<\/p>\n\n\n\n<p>The&nbsp;<strong>Montevideo Convention (1933)<\/strong>&nbsp;defines a state as requiring a&nbsp;<strong>permanent population, defined territory, government, and capacity to enter into relations<\/strong>.<br><strong>Tamil Eelam meets none of these.<\/strong><\/p>\n\n\n\n<h3 class=\"wp-block-heading\">6.&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <strong>Sinhalese Sacrifice &amp; the Defense of the Island<\/strong><\/h3>\n\n\n\n<p><strong>UN Charter Article 2(4)<\/strong>:<\/p>\n\n\n\n<p>Prohibits use of force against the territorial integrity of a member state.<br><strong>LTTE violated this<\/strong>, not only against Sri Lanka but also international law.<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>From ancient invasions to colonial resistance to LTTE terror \u2014 it has been the\u00a0Sinhalesewho have defended the island with their lives.<\/li>\n\n\n\n<li>Legal Maxim:<em>Ubi jus ibi remedium<\/em>\u00a0\u2014\u00a0<em>Where there is a right, there is a remedy.\u201d<\/em><br>The Sinhalese, as historical custodians of the island, have both the\u00a0right\u00a0and the\u00a0moral claim\u00a0to protect its unity.<\/li>\n<\/ul>\n\n\n\n<p>Later day arrivals cannot stake claim to any part or whole of island that had been nurtured &amp; defended by the original custodians.<\/p>\n\n\n\n<p><strong>World\u2019s Largest Hostage Rescue Operation (May 2009)<\/strong>&nbsp;by Sri Lankan Armed Forces saved&nbsp;<strong>300,000 Tamil civilians<\/strong>, exposing the&nbsp;<strong>fraudulent oppression\u201d narrative<\/strong>.<\/p>\n\n\n\n<p><strong>Legal Maxim<\/strong>:<\/p>\n\n\n\n<p><strong>&nbsp;Justitia nemini neganda est\u201d<\/strong>&nbsp;\u2013&nbsp;<em>Justice is to be denied to no one.\u201d<\/em><\/p>\n\n\n\n<p>The Sinhalese, who have given their lives to protect all communities, deserve international justice and recognition \u2014 not false accusations.<\/p>\n\n\n\n<p><strong>Legal Maxim<\/strong>:<\/p>\n\n\n\n<p><strong>Fiat justitia ruat caelum\u201d<\/strong>&nbsp;\u2013&nbsp;<em>Let justice be done though the heavens fall.\u201d<\/em><\/p>\n\n\n\n<p>The truth must prevail \u2014 even if it shatters decades of separatist propaganda backed by billions in foreign funding.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">7.&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <strong>Conclusion: Restore the Truth, Reject the Lie<\/strong><\/h3>\n\n\n\n<p><strong>The next time you hear Tamil Eelam,\u201d ask not just what it means \u2014 but who it belonged to.<\/strong><\/p>\n\n\n\n<p>And ask how many billions were wasted on an internationally illegal, historically false, and constitutionally prohibited campaign to carve out a homeland from a land that was never theirs.<\/p>\n\n\n\n<p><strong>Sri Lanka is one nation, one people, one history \u2014 and the Sinhalese, by blood and by birthright, remain its rightful defenders.&nbsp;<\/strong>That is why it is a national betrayal to remove History from the school curriculum (Grades 1\u20135).<\/p>\n\n\n\n<p>On what legal, educational, or cultural grounds \u2014 and to appease whom \u2014 is this being done?<\/p>\n\n\n\n<p>A nation without its history is a nation waiting to be hijacked and turned into a vassal state again.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Shenali D Waduge The name Eelam\u201d was never Tamil in origin, nor did it denote a separate ethnic homeland.
