For over 40 years, the CEDAW Convention was the global standard protecting women \u2014 defined as biological females\u2014 from discrimination and ensuring equality in every sphere of life. Today, however, the Committee charged with safeguarding this treaty has overstepped its mandate, replacing sex\u201d with gender identity\u201d in its guidance. By doing so, it has redefined what it means to be a woman, undermining protections for billions of biological women worldwide, including 1.1 million in Sri Lanka.<\/p>\n\n\n\n

This ideological drift is not a minor policy change; it is a direct threat to female-only spaces, healthcare, maternity rights, sports, shelters, and the proud social status women have held since civilization. Silence is complicity, and the time has come for the world\u2019s women to reclaim their rights \u2014 grounded in biology, law, and reality. Women & Men must complement each other in the journey of life not be in competition or compete over identity. Men must respect women\u2019s space & rights just as women must respect men\u2019s space & rights.<\/p>\n\n\n\n

Convention on the Elimination of All Forms of Discrimination Against Women<\/p>\n\n\n\n

  1. CEDAW\u2019s Original Mandate is Sex-Based<\/li>\n<\/ol>\n\n\n\n
      \n
    • CEDAW 1979:Focused on\u00a0biological sex, not gender identity.<\/li>\n\n\n\n
    • Article 1:Defines discrimination as any distinction\u00a0on the basis of sex.<\/li>\n\n\n\n
    • Purpose:Protect women as a\u00a0biological class\u00a0(female).<\/li>\n\n\n\n
    • Fact:The Convention\u00a0does not mention gender identity.<\/li>\n\n\n\n
    • Number of State Parties:As of now,\u00a0189 countries\u00a0have ratified the CEDAW Convention.<\/li>\n\n\n\n
    • Sri Lanka:Ratified\u00a0CEDAW on 12 July 1981 with reservations on Article 29(1)<\/li>\n\n\n\n
    • Sri Lanka\u00a0did not accept binding dispute settlementunder Article 29(1).<\/li>\n\n\n\n
    • It retained the right to handle disputes on CEDAW obligations\u00a0within its national discretion, rather than through international arbitration (we had great officials then)<\/li>\n<\/ul>\n\n\n\n

      Implication:<\/p>\n\n\n\n

      Redefining woman\u201d to include males who self-identify as female exceeds the Committee\u2019s legal authority (ultra vires).<\/p>\n\n\n\n

      Soon men identifying as women will even be representing women internationally & locally. This is usurping the role & rights of women.<\/p>\n\n\n\n

      1. Committee Overreach via General Recommendations (GRs)<\/li>\n<\/ol>\n\n\n\n
          \n
        • GRs are interpretative guidance, not treaty amendments.<\/li>\n\n\n\n
        • From\u00a0GR No. 28 (2010)\u00a0onwards, the Committee shifted from sex to\u00a0gender identity, redefining woman.\u201d<\/li>\n\n\n\n
        • Legal problem:GRs cannot override the treaty text; only States Parties can amend CEDAW.<\/li>\n\n\n\n
        • Vienna Convention Articles 31\u201333:Treaties must be interpreted\u00a0in good faith according to text, context, purpose.<\/li>\n\n\n\n
        • Effect:Committee is effectively\u00a0legally rewriting a ratified treaty\u00a0without consent of States Parties.<\/li>\n\n\n\n
        • Question: Why are State Parties silent?<\/li>\n<\/ul>\n\n\n\n

          1. Breach of Object and Purpose<\/li>\n<\/ol>\n\n\n\n

            • CEDAW\u2019s object: Protect women from discrimination, ensure equality, safeguard female-specific rights (maternity, reproductive rights).<\/li>\n\n\n\n
            • Present Problem:Gender-inclusive reinterpretation:\n

              • Destroys the legal category of woman.\u201d \u2013 impacts world 4billion women.<\/li>\n\n\n\n
              • Undermines female-only protections (sports, shelters, prisons).<\/li>\n\n\n\n
              • Violates principle of\u00a0effet utile(treaty must effectively achieve purpose).<\/li>\n\n\n\n
              • Not only creating a new category of men identifying as women but giving them the same rights given to biological women.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n\n\n\n

                                    Purpose: Restore protections for biological women.<\/p>\n\n\n\n

                                    • Alliance for Female Rights (AFR)<\/li>\n<\/ul>\n\n\n\n

                                      Goals:<\/p>\n\n\n\n

                                      • Defend biological female-only spaces, protections, and data collection.<\/li>\n\n\n\n
                                      • Ensure policies are grounded in biological reality.<\/li>\n\n\n\n
                                      • Give women leadership in defining their biological rights.<\/li>\n<\/ul>\n\n\n\n

                                        Pillars of Action:<\/p>\n\n\n\n

                                          \n
                                        1. Awareness:Educate public and governments on sex vs. gender.<\/li>\n\n\n\n
                                        2. Advocacy:Lobby for sex-based protections and CEDAW reform.<\/li>\n\n\n\n
                                        3. Organization:Build global coalition of female-led NGOs, legal experts, activists.<\/li>\n<\/ol>\n\n\n\n

                                          Practical Steps for Global Women\u2019s Organizations: 4billion women should not be silent or be silenced.<\/p>\n\n\n\n

                                          • Draft a manifesto for biological women\u2019s rights.<\/li>\n\n\n\n
                                          • Build an online platform and campaigns.<\/li>\n\n\n\n
                                          • Form partnerships with female-led organizations.<\/li>\n\n\n\n
                                          • Present policy proposals to UN bodies and national governments.<\/li>\n\n\n\n
                                          • Launch awareness campaigns on harms caused by conflating sex and gender.<\/li>\n<\/ul>\n\n\n\n

                                            CEDAW has exceeded its legal mandate by redefining woman\u201d to include gender identity.<\/p>\n\n\n\n

                                            Global female rights are at risk if sex-based protections are ignored.<\/p>\n\n\n\n

                                            Women must act independently to create a legally and socially enforceable platform protecting biological women.<\/p>\n\n\n\n

                                            The Committee\u2019s reinterpretation of CEDAW is ultra vires, procedurally invalid, and in violation of the treaty\u2019s object and purpose<\/strong>.<\/p>\n\n\n\n

                                            If CEDAW refuses to return to ratified mandate & treaty clauses \u2013 the best option is to allow CEDAW to only cater to men who identify as females & for the biological females to set up an entity that will protect their rights & role.<\/p>\n\n\n\n

                                            Global women can no longer rely solely on an institution that ignores the legal distinction between sex and gender and is subtly replacing women with men who identify as women. This is a direct affront to the 4billion biological women on whose shoulders the future rests.<\/p>\n\n\n\n

                                            It is time for 4 billion biological women to rise<\/strong>:<\/p>\n\n\n\n

                                            It is time for the 1.1million biological women in Sri Lanka to rise.<\/p>\n\n\n\n

                                              \n
                                            • Educate<\/strong>their governments and communities on the difference between sex and gender.<\/li>\n\n\n\n
                                            • Advocate<\/strong>for the restoration of sex-based protections.<\/li>\n\n\n\n
                                            • Organize<\/strong>a global coalition to establish a new platform \u2014 whether\u00a0ICPBW<\/strong>\u00a0or\u00a0Alliance for Female Rights (AFR)<\/strong>\u2014 dedicated to safeguarding only biological female rights, spaces, and leadership.<\/li>\n<\/ul>\n\n\n\n

                                              The future of women\u2019s rights cannot be dictated by ideology or political correctness<\/strong>. It must be reclaimed by women themselves<\/strong>, for women themselves, for the billions of lives that depend on legal, social, and cultural recognition of biological womanhood<\/strong>.<\/p>\n\n\n\n

                                              The world needs both men & women to continue fulfilling their natural roles. That is how the world will continue \u2013 not to be replaced by those identifying themselves as the opposite sex.<\/p>\n\n\n\n

                                              It is time for women\u2019s movements globally to unite and stand against CEDAW\u2019s mandate violation, reclaiming protections for biological women and petition the 189 States party to CEDAW Convention to immediately address this breach.<\/p>\n\n\n\n
