can be reversed<\/li>\n\n\n\n<li>Cannot alter Acts or Constitutional provisions<\/li>\n\n\n\n<li>Can be withdrawn \/ cancelled easily<\/li>\n\n\n\n<li>Administrative circular CANNOT change a person\u2019s legal sex or alter rights related to birth sex, marriage, divorce, penal offences, prisons, adoption, inheritance etc<\/li>\n<\/ul>\n\n\n\n<p>Yet the GRC attempts to do exactly that.<\/p>\n\n\n\n<ol start=\"3\" class=\"wp-block-list\">\n<li>Why the GRC Is Potentially\u00a0<em>Ultra Vires<\/em>(Beyond Legal Authority)<\/li>\n\n\n\n<li>The Ministry of Health has no legislative power to alter legal sex.<br>Only\u00a0Parliament\u00a0can do so.<\/li>\n\n\n\n<li>The Registrar General, Police, Prisons Department, and Judiciaryare bound by laws passed by Parliament \u2014 not by health circulars.<\/li>\n\n\n\n<li>The GRC therefore:<\/li>\n<\/ol>\n\n\n\n<p>Creates a de facto legal sex change without legal authority<\/p>\n\n\n\n<p>Directly conflicts with existing laws, especially:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Penal Code 365 \/ 365A<\/li>\n\n\n\n<li>Marriage Registration Ordinance<\/li>\n\n\n\n<li>Prison Ordinance<\/li>\n\n\n\n<li>Evidence Ordinance<\/li>\n\n\n\n<li>Birth and Death Registration Act<\/li>\n<\/ul>\n\n\n\n<ol start=\"4\" class=\"wp-block-list\">\n<li>Any GRC-based decision can be challenged and struck down in court.<\/li>\n<\/ol>\n\n\n\n<ol start=\"4\" class=\"wp-block-list\">\n<li>Criminal Justice, Public Safety &amp; Law Enforcement Risks<\/li>\n<\/ol>\n\n\n\n<p>Prisons &amp; Detention<\/p>\n\n\n\n<p>A GRC male holder claiming to identify as a woman may demand placement in female facilities.<br>This creates:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Safety risks<\/li>\n\n\n\n<li>Privacy violations<\/li>\n\n\n\n<li>Legal contradictions<\/li>\n\n\n\n<li>Internationally documented abuse cases.<\/li>\n<\/ul>\n\n\n\n<p>Identity Manipulation &amp; Evasion<\/p>\n\n\n\n<p>Because the GRC can be obtained administratively:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Offenders can exploit identity changes<\/li>\n\n\n\n<li>Cross-province evasion is possible \u2013 commit a crime \/ obtain GRC &amp; Administrative documents cannot change it.<\/strong><\/p>\n\n\n\n<p>This makes the Sri Lankan GRC \u2014 issued merely through a Ministry circular \u2014&nbsp;<strong>legally indefensible<\/strong>&nbsp;and&nbsp;<strong>constitutionally incompatible<\/strong>.<\/p>\n\n\n\n<p><strong>Marriage After Administrative GRC = Deception (Sri Lanka &amp; International Context)<\/strong><\/p>\n\n\n\n<p>Sri Lanka\u2019s Gender Recognition Certificate (GRC) is purely&nbsp;<strong>administrative<\/strong>, with&nbsp;<strong>no statutory force<\/strong>. Under the&nbsp;<strong>Marriage Registration Ordinance<\/strong>, legal marriage requires biological male and female partners.<\/p>\n\n\n\n<p>If a person uses a GRC to present themselves as the opposite sex and enters marriage:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>They<strong>misrepresent their legal sex<\/strong>,<\/li>\n\n\n\n<li><strong>Conceal a fundamental fact<\/strong>affecting consent, and<\/li>\n\n\n\n<li>Create grounds for the marriage to be<strong>annulled as voidable for deception<\/strong>.<\/li>\n<\/ul>\n\n\n\n<p><strong>International Examples:<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>UK (R v McNally, 2013):<\/strong>Non-disclosure of biological sex in sexual relationships can amount to\u00a0<strong>fraudulent deception<\/strong>.<\/li>\n\n\n\n<li><strong>Singapore (Lim Ying v Hiok Kian Ming, 1991):<\/strong>Marriage annulled when a spouse presented as the opposite sex.<\/li>\n\n\n\n<li><strong>Australia &amp; Ireland:<\/strong>Legal disputes arose over marriage and rights based on administrative gender recognition.<\/li>\n<\/ul>\n\n\n\n<p>Even if a GRC exists administratively, it&nbsp;<strong>cannot override birth certificates or statutory marriage law<\/strong>.
