Ottawa Faculty of Law, CA Courtesy Jurist News<\/a><\/em><\/span><\/h2>\n\n\n<p><img decoding=\"async\" src=\"https:\/\/www.jurist.org\/news\/wp-content\/uploads\/sites\/4\/2022\/07\/Anti-government_protest_in_Sri_Lanka_2022.jpg\" alt=\"Rights groups reports Sri Lanka counterterrorism bill risks abuses\">New<\/p>\n\n\n\n<p>Human Rights Watch (HRW) on Sunday&nbsp;<a href=\"https:\/\/www.hrw.org\/news\/2026\/01\/18\/sri-lanka-proposed-counterterrorism-law-risks-more-abuses\" target=\"_blank\" rel=\"noreferrer noopener\">stated<\/a>&nbsp;that the Sri Lankan government\u2019s proposed counterterrorism legislation risks a similar oppression to its current abusive law. The bill fails to meet&nbsp;<a href=\"https:\/\/spcommreports.ohchr.org\/TMResultsBase\/DownLoadPublicCommunicationFile?gId=26863\" target=\"_blank\" rel=\"noreferrer noopener\">benchmarks<\/a>&nbsp;set by the UN. According to the rights group, the bill also does not comply with Sri Lanka\u2019s rights&nbsp;<a href=\"https:\/\/www.jurist.org\/news\/2022\/02\/hrw-eu-must-step-up-pressure-on-sri-lanka-to-reform-its-controversial-counter-terrorism-laws\/\">obligations<\/a>&nbsp;made to the&nbsp;<a href=\"https:\/\/gsphub.eu\/country-info\/Sri%20Lanka#:~:text=Sri%20Lanka%20was%20granted%20GSP+,imported%20benefitting%20from%20GSP+%20preferences.\" target=\"_blank\" rel=\"noreferrer noopener\">European Union<\/a>&nbsp;to benefit from trade arrangements under the&nbsp;<a href=\"https:\/\/trade.ec.europa.eu\/access-to-markets\/en\/content\/generalised-scheme-preferences-plus-gsp\" target=\"_blank\" rel=\"noreferrer noopener\">Generalised Scheme of Preferences Plus<\/a><\/p>\n\n\n\n<p>The proposed law shows Sri Lankan authorities still cling to the belief that counterterrorism legislation grants sweeping, repressive powers unrelated to combating terrorism,\u201d Meenakshi Ganguly,&nbsp;deputy Asia director at HRW, said. The EU and other international partners should urge President Dissanayake to honor his commitment to abolish the PTA, rather than repackage its disastrous provisions in a new law.\u201d<\/p>\n\n\n\n<p>The Sri Lankan government published the&nbsp;<a href=\"https:\/\/moj.gov.lk\/images\/Careers\/2025\/Bills\/12-12\/Terrorsim-BillE.pdf.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">Protection of the State from Terrorism Act<\/a>&nbsp;(PSTA) in December 2025. The PSTA would effectively replace the current legislative scheme, the&nbsp;<a href=\"https:\/\/www.vertic.org\/media\/National%20Legislation\/Sri%20Lanka\/LK_Prevention_of_Terrorism_(Temp_Provisions).pdf\" target=\"_blank\" rel=\"noreferrer noopener\">Prevention of Terrorism Act<\/a>&nbsp;(PTA). The PSTA draft includes provisions similar to the PTA, such as extraordinary arrest powers, arbitrary detention, and search and seizure powers. The PSTA also includes the ability to defer or suspend\u201d prosecution. However, critics&nbsp;<a href=\"https:\/\/groundviews.org\/2025\/12\/18\/initial-reactions-to-the-governments-protection-of-the-state-from-terrorism-act-psta\/\" target=\"_blank\" rel=\"noreferrer noopener\">argue<\/a>&nbsp;that PSTA fails to provide redress for arbitrary arrest, detention and torture.&nbsp;<\/p>\n\n\n\n<p>For years, Sri Lanka has been in the spotlight for the contentious PTA. Calls to repeal the legislation have been consistent since its enactment.&nbsp;<a href=\"https:\/\/www.ohchr.org\/en\/press-releases\/2023\/10\/un-experts-say-sri-lankas-counter-terrorism-bill-fails-heed-their\" target=\"_blank\" rel=\"noreferrer noopener\">International bodies<\/a>&nbsp;have called on the country to repeal or reform this act. With the mounting&nbsp;<a href=\"https:\/\/www.jurist.org\/features\/2023\/05\/16\/understanding-sri-lankas-controversial-anti-terrorism-bill-2023-why-calls-to-repeal-the-pta-persist\/\">international pressure&nbsp;<\/a>to repeal the PTA, its removal was regarded as inevitable.&nbsp;<\/p>\n\n\n\n<p>In the National People\u2019s Party\u2019s 2024&nbsp;<a href=\"https:\/\/muragala.lk\/wp-content\/uploads\/2024\/10\/NPP_manifesto_English_2024.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">election manifesto<\/a>, President Anura Kumara Dissanayake campaigned for the elimination of oppressive legislation. The English version of the manifesto states, abolition of all oppressive acts, including the Prevention of Terrorism Act (PTA) and ensuring civil rights of people in all parts of the country.\u201d This specific commitment, however,&nbsp;<a href=\"https:\/\/www.colombotelegraph.com\/index.php\/the-protection-of-the-state-from-terrorism-act-psta-has-the-npp-lost-its-way\/\" target=\"_blank\" rel=\"noreferrer noopener\">cannot be found<\/a>&nbsp;in the Sinhala version of the manifesto, a discrepancy which critics argue requires clarification from the Sri Lankan legal team.<\/p>\n\n\n\n<p>For decades, the PTA has traumatically impacted the lives of Sri Lankans. The proposed counterterrorism legislation continues to fail to meet the Sri Lankan government\u2019s pledge.<\/p>\n\n\n\n<p><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Annelies Nie | U.
