{"id":50178,"date":"2015-12-14T22:53:17","date_gmt":"2015-12-15T04:53:17","guid":{"rendered":"http:\/\/www.lankaweb.com\/news\/items\/?p=50178"},"modified":"2015-12-14T15:32:12","modified_gmt":"2015-12-14T22:32:12","slug":"transparency-blurred-in-integrity-awards","status":"publish","type":"post","link":"https:\/\/www.lankaweb.com\/news\/items\/2015\/12\/14\/transparency-blurred-in-integrity-awards\/","title":{"rendered":"Transparency blurred in \u2018Integrity\u2019 Awards"},"content":{"rendered":"<h2><span style=\"color: #0000ff;\"><em>BY MALINDA SENEVIRATNE<\/em><\/span><\/h2>\n<p>As Vithanage documents, the two women are raped by a judge presiding over cases involving their husbands as accused parties.\u00a0 There\u2019s no one to entertain their grievances.\u00a0 Those institutions which shut the door on them include the Judiciary Services Commission and the Bar Association of Sri Lanka.\u00a0 It is in desperation that one of the women comes to Victor Ivan. \u00a0Those who do not know Victor Ivan, former Editor of the \u2018Ravaya\u2019 newspaper would learn from Prasanna Vithanage\u2019s documentary \u2018Silence in the Courts\u2019 that Ivan is an exceptional journalist.\u00a0 His efforts to go the proverbial extra mile to obtain justice are legendary, one would conclude, after digesting the story of two citizens who clearly belong to what Fyodor Dostoyevsky might have called \u2018The Insulted and Humiliated\u2019.<\/p>\n<p>Ivan not only publishes her story, but goes on to write a series of articles exposing the judge.\u00a0 The then Attorney General refuses to take action.\u00a0 Undeterred, Ivan exposes the cover up forcing the Judicial Services Commission to appoint a tribunal to investigate.\u00a0 The judge is found guilty but gets off with the light \u2018punishment\u2019 of \u2018compulsory leave with pay\u2019.\u00a0 Later, when moves to make the Attorney-General the Chief Justice came to be known, Ivan wrote a book about the failure of the justice system.\u00a0 He insisted then that it was wrong and unethical to appoint as Chief Justice a man who was accused of wrongdoing, was being investigated and as at that point yet to be cleared.<\/p>\n<table>\n<tbody>\n<tr>\n<td>\u00a0<a href=\"https:\/\/www.lankaweb.com\/news\/items\/wp-content\/uploads\/2015\/12\/Ivan-1.jpg\"><img loading=\"lazy\" decoding=\"async\" class=\"aligncenter size-full wp-image-50179\" src=\"https:\/\/www.lankaweb.com\/news\/items\/wp-content\/uploads\/2015\/12\/Ivan-1.jpg\" alt=\"Ivan 1\" width=\"228\" height=\"320\" srcset=\"https:\/\/www.lankaweb.com\/news\/items\/wp-content\/uploads\/2015\/12\/Ivan-1.jpg 228w, https:\/\/www.lankaweb.com\/news\/items\/wp-content\/uploads\/2015\/12\/Ivan-1-214x300.jpg 214w\" sizes=\"auto, (max-width: 228px) 100vw, 228px\" \/><\/a><\/td>\n<\/tr>\n<tr>\n<td>Victor played a brilliant role in this case<\/td>\n<\/tr>\n<\/tbody>\n<\/table>\n<p>One doesn\u2019t need to watch this documentary to know of Victor Ivan\u2019s efforts to champion the cause of justice.\u00a0 There have been occasions when he got it all wrong, once even leading to the suicide of a police officer falsely accused.\u00a0 The intention, however, was not malicious.\u00a0 By and large Victor has been the voice for the voiceless, he has given space for those denied proper representation and has consistently argued for transformation of structures and procedures to ensure justice, accountability and transparency.<\/p>\n<p>Perhaps it is all this that prompted Transparency International Sri Lanka (TISL) to give Victor Ivan an \u2018Integrity Award\u2019 as part of the celebrations to mark the World Anti-Corruption Day.\u00a0\u00a0 The other recipient, posthumously of course, was ardent good governance advocate the late Ven Maduluwawe Sobitha Thero.<\/p>\n<p>Now TISL has its own \u2018transparency\u2019 issues, particularly with respect to donor funds requested, obtained and used for \u2018election monitoring\u2019.<\/p>\n<p>&#8220;The CPA, NPC and TI received Rs. 272.31 million, Rs. 171.23 million and 174.79 million respectively, it was reported in \u2018The Island\u2019 of March 5, 2011.\u00a0 This is peace-time bucks, folks.\u00a0 If they got Rs. 618.33 million in three peace-years or roughly over Rs 200 million a year, one can only imagine how much money they wallowed in during the height of the war! &#8221; For more details, read <a href=\"http:\/\/malindawords.blogspot.com\/2014\/02\/cpa-npc-and-ti-is-about-bucks-big-ones.html\">&#8220;CPA, NPC and TISL are about bucks (BIG bucks)&#8221;<\/a><\/p>\n<table>\n<tbody>\n<tr>\n<td>\u00a0<a href=\"https:\/\/www.lankaweb.com\/news\/items\/wp-content\/uploads\/2015\/12\/Ivan-2.jpg\"><img loading=\"lazy\" decoding=\"async\" class=\"aligncenter size-full wp-image-50180\" src=\"https:\/\/www.lankaweb.com\/news\/items\/wp-content\/uploads\/2015\/12\/Ivan-2.jpg\" alt=\"Ivan 2\" width=\"320\" height=\"277\" srcset=\"https:\/\/www.lankaweb.com\/news\/items\/wp-content\/uploads\/2015\/12\/Ivan-2.jpg 320w, https:\/\/www.lankaweb.com\/news\/items\/wp-content\/uploads\/2015\/12\/Ivan-2-300x260.jpg 300w\" sizes=\"auto, (max-width: 320px) 100vw, 320px\" \/><\/a><\/td>\n<\/tr>\n<tr>\n<td>&#8216;Integrity&#8217; and these two don&#8217;t go together<\/td>\n<\/tr>\n<\/tbody>\n<\/table>\n<p>There\u2019s also an issue about the \u2018giver\u2019 of the award.\u00a0 If anyone still believes that President Maithripala Sirisena and the word \u2018integrity\u2019 can legitimately go together, then a quick look-back at how he fiddled with \u2018democracy\u2019, championed nepotism and wrecked corporate good governance, not to mention the abuse of presidential powers, would set the record straight.\u00a0 Let\u2019s leave all that aside.<\/p>\n<p>Does Victor Ivan deserve this award?\u00a0 If we knew only what has been mentioned above, the answer is a clear \u2018yes\u2019.\u00a0 However, there is damning evidence to impeach Ivan on questionable (we are being generous here) financial transactions.<\/p>\n<p>There is the issue of his involvement in Ravaya\u2019s non-payment of taxes where the former President nudged state agencies to advertise in that paper so that monies owed the Department of Inland Revenue could be paid.\u00a0 More seriously is the issue of Ivan demanding (and being given) millions of rupees from a fund made of donations solicited and obtained from the general public by Ravaya Solidarity.\u00a0 The would-be donors were not informed that the money collected would be used to purchase shares from Ivan. Indeed, as a Limited Guarantee company, there can be no \u2018shares\u2019, although the word has been used (loosely) by those defending the transaction.<\/p>\n<p>What is most damning is that Ivan has agreed to pay back the money clearly indicating that what was done was wrong.
