{"id":69881,"date":"2017-09-19T14:13:46","date_gmt":"2017-09-19T21:13:46","guid":{"rendered":"http:\/\/www.lankaweb.com\/news\/items\/?p=69881"},"modified":"2017-09-19T14:13:46","modified_gmt":"2017-09-19T21:13:46","slug":"20-a-needs-23-majority-approval-at-referendum-supreme-court","status":"publish","type":"post","link":"https:\/\/www.lankaweb.com\/news\/items\/2017\/09\/19\/20-a-needs-23-majority-approval-at-referendum-supreme-court\/","title":{"rendered":"20-A needs 2\/3 majority, approval at referendum-Supreme Court"},"content":{"rendered":"<h2><span style=\"color: #0000ff;\"><em>By Saman Indrajith\u00a0Courtesy The Island<\/em><\/span><\/h2>\n<p>Speaker Karu Jayasuriya informed Parliament yesterday that the Supreme Court by a majority vote had determined that the 20th Amendment to the Constitution was inconsistent with several Articles in the Constitution and would have to be passed by a two-thirds majority in Parliament and approved by people at a referendum.<\/p>\n<p>Speaker Jayasuriya said: &#8220;I wish to announce to the House that I have received the determination of the Supreme Court in respect of the bill titled \u2018Twentieth Amendment to the Constitution\u2019 which has been challenged in the Supreme Court in terms of Article 121(1) of the Constitution.<\/p>\n<p>&#8220;The majority of the court has determined that clauses 2, 3 and 4 of the Bill are inconsistent with the Articles 3, 4, 12(1) and 14(1) of the Constitution and under Article 83 the Bill shall become law if the number of votes cast in favour thereof amounts to not less than two-thirds of the whole number of Members (including those not present) approved by the People at a Referendum and a certificate is endorsed thereon by the President in accordance with Article 80.<\/p>\n<p>&#8220;I order that the determination of the Supreme Court be printed in the official report of today\u2019s proceedings.&#8221;<\/p>\n<p>Joint Opposition MPs thumped their desks welcoming the announcement of Supreme Court decision.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>By Saman Indrajith\u00a0Courtesy The Island Speaker Karu Jayasuriya informed Parliament yesterday that the Supreme Court by a majority vote had determined that the 20th Amendment to the Constitution was inconsistent with several Articles in the Constitution and would have to be passed by a two-thirds majority in Parliament and approved by people at a referendum.
