{"id":83455,"date":"2018-11-18T13:05:39","date_gmt":"2018-11-18T20:05:39","guid":{"rendered":"http:\/\/www.lankaweb.com\/news\/items\/?p=83455"},"modified":"2018-11-18T13:05:39","modified_gmt":"2018-11-18T20:05:39","slug":"the-stay-order-by-the-supreme-court","status":"publish","type":"post","link":"https:\/\/www.lankaweb.com\/news\/items\/2018\/11\/18\/the-stay-order-by-the-supreme-court\/","title":{"rendered":"The &#8220;Stay Order&#8221; by the Supreme Court"},"content":{"rendered":"<h2><span style=\"color: #0000ff;\"><em>NEVILLE LADDUWAHETTY\u00a0<\/em><em>Courtesy The Island<\/em><\/span><\/h2>\n<p><span class=\"article_date\">November 18, 2018, 10:07 pm<\/span><br \/>\nThe actual words used by the Supreme Court in the Stay Order re Dissolving Parliament were: &#8220;\u2026 interim order staying the operation of \u2026.&#8221;<\/p>\n<p>This SC ruling relates to the Proclamation by the President dated November<\/p>\n<p>9, 2018, Dissolving Parliament by Gazette notification 2096\/70, which states:<\/p>\n<p>&#8220;KNOW YE that by virtue of the powers vested in me by paragraph (5) of<\/p>\n<p>Article 70 of the Constitution of the Democratic Socialist Republic of Sri Lanka to be read with paragraph (2) (c) of Article 33 of the Constitution of the Democratic Socialist Republic of Sri Lanka and paragraph (2) of Article 62 of the Constitution\u2026and in pursuance of the provisions of Section 10 of the Parliamentary Elections Act. No. 01 of 1981\u2026&#8221;<\/p>\n<p>(a) &#8220;Dissolve Parliament with effect from midnight today and summon the new Parliament to meet on the Seventeenth day of January Two Thousand and<\/p>\n<p>Nineteen&#8221;<\/p>\n<p>The Supreme Court then issued &#8220;an interim order staying the operation of Gazette Extraordinary No. 2096\/70 of 9th Nov. 2018, on November 13, 2018. Thus,<\/p>\n<p>Parliament was dissolved on November 9th and the SC ruling was issued on<\/p>\n<p>November 13th 2018.<\/p>\n<p>Quoted below is the interpretation given by Indian Courts in regard to an &#8220;order staying the operation of&#8221; as appeared in the citation:<\/p>\n<p>&#8220;B.P.L. Ltd. And Ors vs R. Sudhakar And Ors on 6 May, 2004<\/p>\n<p>Showing the contexts in which \u2018operation of order a stay order\u2019 appears in the document:<\/p>\n<p>&#8220;This Court held that the said \u2018stay\u2019 \u2018order\u2019 could not have the effect of reviving the proceedings, which had been disposed of by the appellate authority by its \u2018order\u2019 dated 7.1.1991 observing that &#8220;While considering the effect of an interim \u2018order\u2019 staying\u2019 the \u2018operation of the order\u2019 under challenge, a distinction has to be made between quashing of an \u2018order\u2019 and \u2018stay\u2019 of \u2018operation\u2019 of an \u2018order\u2019. Quashing of an \u2018order\u2019 results in restoration of the position as it stood on the date of passing of the \u2018order\u2019 which has been quashed. The \u2018stay\u2019 of \u2018operation\u2019 of an \u2018order\u2019 does not, however, lead to such a result. It only means that the \u2018order\u2019 which has been \u2018stayed\u2019 would not be \u2018operative\u2019 from the date of passing of the \u2018stay\u2019 \u2018order\u2019 and it does not mean that the said \u2018order\u2019 has been wiped out from existence&#8221;.<\/p>\n<p>Clearly, if the interpretation given by the Indian Courts serves as a guide, it must follow that the reconvening of Parliament by the Speaker amounted to a continuation of operations. This amounts to a violation of the Order Dissolving Parliament. Furthermore, for the Elections Commissioner to proceed with preparations to conduct a General Election also amounts to continuing operations. This too amounts to a violation of the Order Dissolving Parliament.
