The truth is quite the opposite. <\/strong>It took a magistrate\u2019s\norder to finally get the Swiss embassy to produce its local staffer to make a\nformal complaint to the CID on Sunday 8<sup>th<\/sup> December 2019, exactly 13\ndays after the alleged incident and keeping the supposed victim inside embassy\ncompound with her family. What is the Swiss reputation for keeping an alleged\nvictim inside an embassy compound for almost 2 weeks without even offering medical\nattention inspite of them claiming she was suffering \u2018deteriorating health\u2019? It\nis now clear that all those who made statements on behalf of this local recruit\nprior to 8<sup>th<\/sup> December 2019 were all incorrect. It has also been\nproven that the allegations made by the local recruit are also incorrect &amp;\ncontradictory and that was the reason for her arrest<strong>. Sri Lanka has wasted time on a bogus abduction case that did not take\nplace when Sri Lanka should have been questioning Switzerland over giving instant\npolitical asylum to Switzerland to a Sri Lankan police officer wanted for\nmurder. &nbsp;<\/strong>Is this Swiss \u2018due process\u2019\ngiving asylum to a man and his family fleeing a crime? <strong>If the woman is arrested for false allegations, what is the crime the\nSwiss have committed in for aiding and abetting the false allegations?<\/strong> Sri\nLanka please continue to follow due process and question Switzerland for harboring\na murderer wanted in Sri Lanka! <\/p>\n\n\n\n<p>The response of the Swiss\nfollowing the arrest has been to issue a press release. <\/p>\n\n\n\n<p><a href=\"https:\/\/www.fdfa.admin.ch\/eda\/en\/fdfa\/fdfa\/aktuell\/news.html\/content\/eda\/en\/meta\/news\/2019\/12\/16\/77584?pk_campaign=communique&amp;pk_kwd=@swissmfa&amp;fbclid=IwAR2aoF7BJJqHnw0L5JMabFrV-SUrAlYdVO6iFMr-yq9zk5DN8uMypkPm5i4\">https:\/\/www.fdfa.admin.ch\/eda\/en\/fdfa\/fdfa\/aktuell\/news.html\/content\/eda\/en\/meta\/news\/2019\/12\/16\/77584?pk_campaign=communique&amp;pk_kwd=@swissmfa&amp;fbclid=IwAR2aoF7BJJqHnw0L5JMabFrV-SUrAlYdVO6iFMr-yq9zk5DN8uMypkPm5i4<\/a><\/p>\n\n\n\n<p>Sri Lanka was using national laws\nand international standards to arrest Sriyalatha following the Swiss embassy wasting\neveryone\u2019s time for over 2 weeks. <\/p>\n\n\n\n<p>It is good for the Sri Lankan\nauthorities to check whether the Swiss have been paying EPF\/ETF of this woman to\nsee how far Swiss has held their end of responsibilities as an employer. As per\nSwiss press release, the Swiss is continuing version that she was \u2018abducted\u2019 on\n25<sup>th<\/sup> Nov 2019 but where is the evidence to prove it?<\/p>\n\n\n\n<p>The Swiss press release errs as\nthe Swiss did not disclose the name of the victim or bring the victim to make a\nformal statement of complaint as an international standard procedure required.\nThe embassy only produced the victim\u201d before the deadline given by the\nMagistrate ended. If the embassy and the supposed victim had given statements immediately\nafter the incident \u2013 there would have been no requirement for so much of\ncross-examinations and cross-questioning. <\/p>\n\n\n\n<p>The Swiss embassy must take total\nresponsibility for not following protocols and international standards without\ntrying to pin blame on Sri Lanka. &nbsp;<\/p>\n\n\n\n<p>Has the Swiss embassy produced\nthe video-conferencing virtual medical examination report for this is a crucial\nevidence to establish her health condition and match it against actual medical examination.\n<\/p>\n\n\n\n<p>We question Swiss \u2018due process\u2019\nand \u2018rule of law\u2019 in the case of Sriyaltatha Perera\/Garnier Barrister Francis<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>She was not abducted<\/li><li>There was no white van <\/li><li>There were no \u2018unidentified abductors\u2019<\/li><li>She was not questioned for 2 hours <\/li><li>She was not \u2018threatened\u2019 or \u2018detained\u2019 on the\nstreet<\/li><li>She was not asked \u2018embassy-related information\u2019<\/li><li>There was no incident as sensationalized by the\nNew York Times article<\/li><li>There was certainly no \u2018deteriorating health\u2019\nthat required an air ambulance that the Swiss embassy requested to fly her and\nher entire family to Switzerland <\/li><li>Whatever the Swiss embassy said, whatever the\nSwiss government said have all been proved as incorrect and not corresponding\nwith the contradictory statements issued by the woman who was never abducted. <\/li><\/ul>\n\n\n\n<p>Swiss must explain<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>Why Swiss envoy would need to visit Sri Lanka\u2019s\nPM at his residence when it was clear her story did not make sense<\/li><li>Their incompetency to cross examine its own\nstaff member to collaborate her story given that Swiss are screening people\nbefore visas are given.<\/li><li>Requesting air ambulance to fly Sriyalatha to\nSwitzerland with her family when the embassy knew she was not the least sick. The\nSri Lankan General public are shocked at the shallowness of a diplomatic\nmission to have lied as they did after seeing the woman appear for the first\ntime showing no signs of deteriorating health. Is this the due process Swiss is\nbragging about?<\/li><\/ul>\n\n\n\n<figure class=\"wp-block-image\"><img loading=\"lazy\" decoding=\"async\" width=\"630\" height=\"571\" src=\"https:\/\/www.lankaweb.com\/news\/items\/wp-content\/uploads\/2019\/12\/79696494_2471092946437197_5330763805494345728_n.jpg\" alt=\"\" class=\"wp-image-96483\" srcset=\"https:\/\/www.lankaweb.com\/news\/items\/wp-content\/uploads\/2019\/12\/79696494_2471092946437197_5330763805494345728_n.jpg 630w, https:\/\/www.lankaweb.com\/news\/items\/wp-content\/uploads\/2019\/12\/79696494_2471092946437197_5330763805494345728_n-300x272.jpg 300w\" sizes=\"auto, (max-width: 630px) 100vw, 630px\" \/><\/figure>\n\n\n\n<p>What was equally shocking and\nnoted by the general public was the excessive hugging and embracing of the woman\nby Swiss embassy female staff and on the day of the arrest by a foreign male. It\nmakes a mockery of her refusal to be examined by a male doctor! This was quite\na weird looking scenario in the light of the daily statements that revealed she\nwas obviously not telling the truth and it now makes us wonder whether all this\nwas part of a set up to defame the government but getting badly backfired\nduring the process. <\/p>\n\n\n\n<p>While Sriyalatha\u2019s lies are getting\nexposed. What Swiss cannot hide: <\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>Swiss-LTTE network is very much continuing &#8211; <a href=\"https:\/\/www.mfa.gov.lk\/tam\/the-ltte-swiss-network\/\">https:\/\/www.mfa.gov.lk\/tam\/the-ltte-swiss-network\/<\/a>\n(2014) <a href=\"http:\/\/dbsjeyaraj.com\/dbsj\/archives\/66748\">http:\/\/dbsjeyaraj.com\/dbsj\/archives\/66748<\/a>\n(2019) <\/li><li>Over 640 political asylums given by Swiss\nembassy in past 2 years <\/li><li>Swiss gave over the desk visa to a wanted\nmurderer and family CID CI Nishantha Silva and other officers who had given\nevidence against senior military officials probably on the assurance of being\ngiven asylum to Switzerland. <\/li><\/ul>\n\n\n\n<p>These are no proper \u2018due process\u2019\nfor which Switzerland\u2019s reputation is marred.<\/p>\n\n\n\n<p>Sri Lanka doesn\u2019t have stolen\nwealth. Sri Lanka didn\u2019t relax bank regulations to store wealth during Wars and\nuse bank confidentiality clauses to continue to bank stolen wealth. Therefore,\nSri Lanka is no rich country. Sri Lanka is no home to terrorist runaways or Sri\nLanka does not bank terrorist funds and Sri Lanka also does not provide safe\nhaven for bogus asylum seekers or facilitate political asylum for people wanted\nfor murder in another country. <\/p>\n\n\n\n<p>So, what is the Swiss now\nblabbering about? To answer that we have to go back over 12 days to November 25<sup>th<\/sup>\nthe day originally mentioned as the \u2018Temporary Abduction\u2019 of a local recruit of\nthe Swiss embassy.<\/p>\n\n\n\n<p>The Government must now issue the\nexact sequence of events against the lies and fake news spread.<\/p>\n\n\n\n<p>The Government must officially\nand publicly request apology from all who were promoting a distorted version\nand request them to make a disclaimer correction to their news releases. <\/p>\n\n\n\n<p>The Government IT team must carry\na short description in all of its news giving an account of what really\nhappened to nullify the promotion of lies to discredit Sri Lanka. <\/p>\n\n\n\n<p>The GoSL must apply the same due\nprocess and the Swiss are preaching and question Swiss on aiding and abetting\npeople wanted for murder as political asylum seekers.<\/p>\n\n\n\n<p>GoSL must not be deterred by the fancy press releases issued but go by rule of law that Sri Lanka has upheld and which could have concluded investigations if only the Swiss did not hide an alleged \u2018victim\u2019 in its embassy compound from 25<sup>th<\/sup> Nov to 7<sup>th<\/sup> December without producing them before the police to make formal complaint. <\/p>\n\n\n\n<p><\/p>\n\n\n\n<p><strong>Shenali D Waduge<\/strong><\/p>\n","protected":false},"excerpt":{"rendered":"<p>The Swiss has issued a strange statement criticizing Sri Lanka for the lack of due process.
