{"id":98216,"date":"2020-01-24T16:24:43","date_gmt":"2020-01-24T23:24:43","guid":{"rendered":"http:\/\/www.lankaweb.com\/news\/items\/?p=98216"},"modified":"2020-01-24T16:24:43","modified_gmt":"2020-01-24T23:24:43","slug":"allahabad-hc-upholds-ban-on-loudspeakers-in-mosques","status":"publish","type":"post","link":"https:\/\/www.lankaweb.com\/news\/items\/2020\/01\/24\/allahabad-hc-upholds-ban-on-loudspeakers-in-mosques\/","title":{"rendered":"Allahabad HC upholds ban on loudspeakers in mosques"},"content":{"rendered":"<h2><span style=\"color: #0000ff;\"><em><strong data-rich-text-format-boundary=\"true\">Courtesy: Outlook India<\/strong><\/em><\/span><\/h2>\n\n\n<p><strong>23 JANUARY 2020<\/strong>&nbsp;<\/p>\n\n\n\n<p><a href=\"https:\/\/www.outlookindia.com\/newsscroll\/allahabad-hc-upholds-ban-on-loudspeakers-in-mosques\/1715334\">https:\/\/www.outlookindia.com\/newsscroll\/allahabad-hc-upholds-ban-on-loudspeakers-in-mosques\/1715334<\/a><\/p>\n\n\n\n<p><strong>Prayagraj, Jan 23 (IANS) The Allahabad\nHigh Court has refused to quash an administrative order that banned the use of\nloudspeakers for &#8221;azaan&#8221; at two mosques in Baddopur and Shahganj villages of\nJaunpur district in Uttara Pradesh.<\/strong><\/p>\n\n\n\n<p><strong>The court in its order on Wednesday\nstated that no religion advocates the use of loudspeakers for worship.<\/strong><\/p>\n\n\n\n<p><strong>&#8220;No religion prescribes that\nprayers are required to be performed through voice amplifiers or by beating of\ndrums&#8230; If there is such a practice, it should not adversely affect rights of\nthe others, including that of not being disturbed,&#8221; said the division\nbench of Justice Pankaj Mittal and Justice V.C. Dixit.<\/strong><\/p>\n\n\n\n<p><strong>The court dismissed the petition filed\nby one Masroor Ahmad and a fellow resident of Jaunpur.<\/strong><\/p>\n\n\n\n<p><strong>The court cited a similar 2000 Supreme\nCourt judgment &#8212; Church of God (Full Gospel) vs KKR Majestic Colony Welfare\nAssociation &#8212; where the apex court said that freedom to practice religion was\nsubject to public order, morality and health.<\/strong><\/p>\n\n\n\n<p><strong>The division bench also dismissed the\npetitioners&#8221; argument that using loudspeakers to call people to join in the\n&#8221;namaaz&#8221; at specific times was an essential part of their religion.<\/strong><\/p>\n\n\n\n<p><strong>&#8220;The fundamental right to religious\nfreedom under Article 25(1) of the Constitution is not absolute.
