(Part 1)"},"content":{"rendered":"<h2><span style=\"color: #0000ff;\"><em>(A Paper Published by the Sri Lanka Geo-Political Study Circle)<\/em><\/span><\/h2>\n\n\n<figure class=\"wp-block-image\"><img loading=\"lazy\" decoding=\"async\" width=\"450\" height=\"235\" src=\"https:\/\/www.lankaweb.com\/news\/items\/wp-content\/uploads\/2020\/01\/threewisemen.jpg\" alt=\"\" class=\"wp-image-98497\" srcset=\"https:\/\/www.lankaweb.com\/news\/items\/wp-content\/uploads\/2020\/01\/threewisemen.jpg 450w, https:\/\/www.lankaweb.com\/news\/items\/wp-content\/uploads\/2020\/01\/threewisemen-300x157.jpg 300w\" sizes=\"auto, (max-width: 450px) 100vw, 450px\" \/><\/figure>\n\n\n\n<p>You can delegate authority, but you cannot delegate responsibility\u201d.\u00a0\u00a0 Byron Dorgan.<\/p>\n\n\n\n<p><em>Given hereunder is\njust one of the many instances, in the<\/em><em> <\/em><em>draft MCC\nAgreement, which poses a major threat to the Sovereign State of Sri Lanka.<\/em><\/p>\n\n\n\n<p><em>In Annex 1,&nbsp;\nfound on page 34 of the draft MCC Agreement, <strong>the Sovereign rights of the\npeople, over Land Policy,&nbsp; over all monies \u2018gifted\u2019 by the MCC and, over\nManagement of Sri Lanka\u2019s Land coming under the scope &nbsp;of the MCC project,\nwould be handed over to a Private Company called MCA (Millennium Challenge\nAccount); this surrender of our sovereignty to the Americans had been pledged\nby the ousted Sirisena-Wickramasinghe Regime. <\/strong><\/em><\/p>\n\n\n\n<p><strong><em>It was based\non this secret pledge that the MCC drew up the draft MCC Agreement, after\nmonths of crafting same on the drawing boards.<\/em><\/strong><\/p>\n\n\n\n<p><strong><em>The MCA is\ndescribed in the draft MCC Agreement as an \u2018Independent and Autonomous body\u2019.<\/em><\/strong><\/p>\n\n\n\n<p><em>Reproduced here below\nis the pertinent section in Annex 1 (page 34). Quote:<\/em><\/p>\n\n\n\n<p><em>&nbsp;The Government\nshall appoint an accountable entity, MCA -Sri Lanka, as a company limited by\nguarantee that shall be created under the Companies Act No. 7 of 2007.\u201d<\/em><\/p>\n\n\n\n<p><strong><em>MCA \u2013 Sri\nLanka shall be the Government\u2019s primary agent<\/em><\/strong><em> responsible for exercising the Government\u2019s rights and\nobligations to oversee, manage and implement the Program and Projects.\u201d&nbsp; <\/em><\/p>\n\n\n\n<p><strong><em>MCA-Sri Lanka\nshall have<\/em><\/strong><em> operational and legal\nindependence and <strong>full decision making autonomy, <\/strong>including, inter alia<strong>,\nthe ability, without consultation with, or the consent or approval of any\nother party to<\/strong> (1) enter into contracts in its own name, (11) sue and\nbe sued, (111) establish an account with a financial institution in its own\nname and <strong>hold MCC funding, in that account,<\/strong> (1v) <strong>expend MCC funding<\/strong>,\n(v) engage contractors, consultants and\/ or grantees, including without\nlimitation, procurement and fiscal agents and (vi) competitively <strong>engage one\nor more auditors to conduct audits of its accounts.\u201d <\/strong><\/em><\/p>\n\n\n\n<p><strong><em>The\ngovernance of MCA- Sri Lanka shall be set forth in more detail in the\nProgram Implementation Agreement and the constitutive documents and internal\nregulations of MCA Sri Lanka (or as otherwise agreed in writing by the\nParties).<\/em><\/strong><em>\u201d <\/em><\/p>\n\n\n\n<p><em>Unquote<\/em><\/p>\n\n\n\n<p>Readers, see for\nyourself the disgraceful level to which the Sirisena- Wickramasinghe duo have\ndragged this country to. Without batting an eyelid, they have secretly pledged,\nto surrender this country\u2019s autonomy to the Americans.<\/p>\n\n\n\n<p>The\nSirisena-Wickramasinghe Government had pledged to the Americans that it would\nappoint the Company, MCA (Millennium Challenge Account), to be in charge of the\nentire MCC operation in Sri Lanka.<\/p>\n\n\n\n<p>It is oxymoronic that\nthe Primary Agent of the Government of Sri Lanka is, as per the draft MCC\nAgreement, an \u2018Independent and Autonomous body\u2019.<\/p>\n\n\n\n<p>This Company, as the\nPrimary agent of the Government would be performing the functions of the\nGovernment of Sri Lanka; in short, the GOSL would be replaced by the MCA for\nall matters pertaining to the MCC project, particularly Land and Transport.<\/p>\n\n\n\n<p>The special focus of\nMCC interest is the TCO-CBO Corridor; at one end of the Corridor is the\nTrincomalee Port and at the other end is the Colombo Port. The\nSirisena-Wickramasinghe duo had pledged to cede control of our two major\nstrategic Ports, to the Americans.<\/p>\n\n\n\n<p>It is interesting to\nnote that Gotabaya has appointed Daya Ratnayake to be in charge of Sri Lanka&#8217;s\nPorts. Ratnayake is a Director of \u2018Pathfinders\u2019, an ultra-Conservative American\nOrganisation, set up by Gambol, that receives direct funds from the American\nGovernment.<\/p>\n\n\n\n<p>The proposed MCC\nelectrified railway line between the Port of Trincomalee and the Port of\nColombo is planned to be done by Japan, the cornerstone&nbsp; of the US\nMilitary alliance in the Indo Pacific; Japan, being also involved in the\nestablishment of the Mono-rail system in CBO will be firmly entrenched in the\nPorts at TCO and CBO. &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp;\n&nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp;\n&nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp;\n&nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp;\n&nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp;\n&nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp;\n&nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp;\n&nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp;\n&nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp;\n&nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp;\n&nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp;\n&nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp;\n&nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp;\n&nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp;\n&nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp;\n&nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp;\n&nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp;\n&nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp;\n&nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp;\n&nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp;\n&nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp;\n&nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp;\n&nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp;\n&nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp;\n&nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp;\n&nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; &nbsp; If the draft MCC\nAgreement is allowed to be &nbsp;inked, the MCA, would be assigned to represent\nthe Government and would be granted operational and legal independence with\nfull decision-making autonomy.<\/p>\n\n\n\n<p>The\nSirisena-Wickramasinghe duo had pledged to the Americans that the MCA would not\nrequire to consult or obtain the consent or approval of the GOSL or the people;\nthey had pledged that the MCA would be empowered to bind the Country and the\npeople to their decisions.<\/p>\n\n\n\n<p>And what of the much\nhyped 480 Million USD? When tranches of money, from the pledged whole, are\ndoled out by the MCC, the monies are put into the bank account of the MCA and\nNOT, to the coffers of the Government of Sri Lanka!!<\/p>\n\n\n\n<p>The\nSirisena-Wickramasinghe duo had also pledged to the Americans that the MCA\ncould spend the money received as they deem fit, without consulting or seeking\napproval of the Government; furthermore, that &nbsp;Sri Lanka Government would\nhonour all &nbsp;the contracts the MCA enters into and allow herself to\n&nbsp;be sued for the actions of her Primary Agent.<\/p>\n\n\n\n<p>Could the Auditor\nGeneral, audit the MCA Accounts? No, the accounts would be audited by Companies\nselected by the MCA and the rules of audit would be American rules. <\/p>\n\n\n\n<p>The Program\nImplementation Agreement (PIA), the constitutive documents and the internal\nregulations of MCA which would define in detail how the MCA should be governed\nare not included in the draft MCC Agreement circulated by the MCC.<\/p>\n\n\n\n<p>In short, for\ndiscussion\u2019s sake, if Sri Lanka had the misfortune to sign the draft MCC\n\u2018Agreement\u2019 she would be accepting terms and conditions unknown to her on how\nthe MCA should be run. It would be akin to signing a document in blank. <\/p>\n\n\n\n<p>Perhaps these\ndocuments have been deliberately omitted because whatever that is agreed upon\ncan be readily changed, as per the draft MCC Agreement, if the parties, amongst\nthemselves, make changes and record these changes in writing. <\/p>\n\n\n\n<p>It is pertinent that\nthe Sirisena-Wickramasinghe duo have pledged the above to the Americans, when\nArticle 148 of the Constitution which they are required to uphold says, loud\nand clear, Parliament shall have full control over public finance.\u201d<\/p>\n\n\n\n<p>There is also\nviolation of Article 154 of the Constitution, relating to the functions of the\nAuditor General<\/p>\n\n\n\n<p>This is only just one\ninstance, in the draft MCC Agreement, where a pledge has been made that Sri\nLanka is willing to surrender her sovereignty; this Study Circle will identify\nand expose the other areas of treachery in the coming weeks running up to the\nGeneral Election. The Study Circle will analyse the ramifications of each of\nthese instances of treachery, <\/p>\n\n\n\n<p>The draft MCC\nAgreement, if signed and implemented, would derail the Constitution, subvert\nDemocracy, physically divide the Country and surrender Sri Lanka and her people\nto a Foreign Power.<\/p>\n\n\n\n<p>&nbsp;\/ <em>to be\ncontinued<\/em><\/p>\n","protected":false},"excerpt":{"rendered":"<p>(A Paper Published by the Sri Lanka Geo-Political Study Circle) You can delegate authority, but you cannot delegate responsibility\u201d.\u00a0\u00a0 Byron Dorgan.
