UNP MP Dr. Jayalath Jayawardena was granted Rs. 50,000 cash bail, with two sureties by the High Court Judge of Colombo. Dr. Jayawardene is charged under section 386 of the Penal Code for misappropriation of 104,300 rupees as salaries while being attached to the General Hospital Colombo without performing duties between November 1, 1992 and October 31, 1993.
D. Jayawickrema, High Court Judge of Colombo, on Wednesday granted 50,000 rupees ( US $ 877.19) cash bail, with two sureties, to United National Party National List Member of Parliament Dr. Jayalath Jayawardena.
At the outset Dr. Jayawardena was served with the indictment. According to the indictment, Dr. Jayawardene is charged under section 386 of the Penal Code for misappropriation of 104,300 rupees as salaries while being attached to the General Hospital Colombo without performing duties between November 1, 1992 and October 31, 1993.
The rest of the charges included, the drawing of 21,300 rupees being salaries for the months of November and December in 1992, without informing the Director of the General Hospital, that he was not performing any duties and allegedly defrauding the state.
The court allowed bail for Dr. Jayawardena, after considering the application of his counsel. Defence Counsel submitted that when a suspect on similar charges was produced in court, it is required that an officer holding the rank of a Superintendent of Police had to certify that the amount involved in the fraud was above 5,000 rupees.
Since such procedure had not been followed in this case when the `B' report was filed before magistrate, the accused was entitled to bail.
The Attorney General's Department made no objection and the court made order allowing bail. State Counsel Haripriya Jayasundara appeared for the prosecution.
President's Counsel Tilak Marapana with Dulinda Weerasuriya, Nalin Ladduwahetty, Jayantha Fernando and Shanil Kularatne instructed by Jayantha Yapa appeared for Dr. Jayawardena.
