Haul TNA to court for links with LTTE terrorists & separatist demands

TNA the party created by LTTE is making a lot of sound of late. It’s a pity that there is no political party or leaders with spine to commence investigation into LTTE-TNA links, afterall LTTE remains banned and TNA was created by LTTE. There is much that TNA must answer and there are many that TNA must account for before TNA goes blowing any trumpets. Therefore, any future government must ensure that TNA as well as a plethora of other individuals and organizations be investigated for their covert/overt links to LTTE. If Sumanthiran wants a judicial mechanism we can most certainly give him one by starting off with investigating LTTE-TNA links first and by all means we would love to invite some foreign judges as OBSERVERS.

On 22 March 2019 TNA MP Sumanthiran at the committee stage debate in Parliament issued a warning I want to make one thing very clear. The GOSL has made these commitments 3 times in writing. But if they do not adhere to this commitment of including ‘independent’ foreign judges in the judicial mechanism, then we the Tamil people will be left with no alternative but to move towards an entirely international judicial mechanism. That is possible and our people have been asking for this, asking that Sri Lanka be referred to the International Criminal Court (ICC). We prefer a hybrid judicial mechanism, but if the government, despite all of these written commitments, and the fact that it is possible under the constitution to do so, doesn’t do it, then I think it is important that I today announce to the government and to the country, that we will take steps to move Sri Lanka to the ICC or some other entirely international judicial mechanism”.

 

Sumanthiran – Sri Lanka has NOT signed nor acceded the Rome Statute and only when a treaty is ratified does it become binding on all states and accession has same legal effect as ratification. ICC is not applicable to Sri Lanka.

Who started the quest for separatism first – the LTTE or the Tamil parties? Good question and the answer clearly establishes that it was the Tamil politicians that began the quest to seek a separate Tamil nation and not the LTTE. LTTE only hijacked the quest & turned it into an armed movement that bumped off any Tamil that went against it. So in the eyes of the LTTE – their Tamil only Nation meant ONLY TAMILS that agreed to abide by LTTE rule of law. All other Tamils were not welcome.

LTTE demands were officially made public during the Thimpu talks in 1985

  1. Recognizing Tamils of Ceylon as a nation
  2. Recognizing existence of an identified homeland for the Tamils of Ceylon
  3. Recognizing right of self-determination of the Tamil Nation
  4. Recognizing right of citizenship & fundamental rights of all Tamils of Ceylon

The term ‘Tamils of Ceylon’ or ‘Ceylon Tamils’ is how long?

It was only in 1911 that the term Ceylon Tamils was coined. Prior to that Tamils were referred to as Malabars by all 3 Western European colonial rulers. Malabars came from India and India is and has always been a separate territory to Sri Lanka Therefore, the simple question is how can Malabars from India seek self-determination in Sri Lanka.

Ceylon Tamils earlier known as Malabars have no legal claim to self-determination from Sri Lanka.

The TNA an unregistered alliance was created by LTTE in October 2001 immediately following 9/11 realizing that the West’s ‘War on Terror’ may impact LTTE.

TNA comprised ACTC (All Ceylon Tamil Congress), the EPRLF (Eelam People’s Revolutionary Liberation Front), TELO (Tamil Eelam Liberation Organization), TULF (Tamil United Liberation Front).

What is noteworthy are the election manifesto demands placed by LTTE’s political wing the TNA for the 2001 elections.

2001 TNA election manifesto demands are virtually identical to LTTE Thimpu demands in 1985.

a) Recognition of Tamils as a distinct nationality

b) Recognition of a Tamil Homeland with guaranteed territorial integrity

c) Recognition of the inalienable right of self-determination of the Tamil nation.

d) Recognition of the right to full citizenship and fundamental democratic rights of all Tamils.

Separatism did not start with LTTE.

The first salvo for separatism” was attempted during British reign by creating Tamil ethnic political party (All Ceylon Tamil Congress 1944).

Chelvanayagam founded both ITAK (Federal Party) in 1949 and Tamil United Liberation Front in 1972. SJV Chelvanayagam is known as the father of the Tamil Nation

In 1976 TULF and ITAK demanded an independent state as the ‘secular, socialist state of Tamil Eelam’ (Vaddukoddai Resolution)

5 demands at Vaddukoddai Resolution

  1. State of Tamil Eelam to consist of North & Eastern provinces to all Tamil speaking people
  2. Constitution of Tamil Eelam based on principles of decentralization. No foremost place to any religion or territorial community.
  3. Tamil Eelam will assure equal status to all
  4. Tamil Eelam will be a secular state with equal protection to all religions
  5. Tamil will be language of the State but Sinhala speaking minority can educate and transact in Sinhala subject to reciprocity of Tamil speaking minority in Sinhala state.

ITAK’s 1949 demands were

‘autonomous rule in the North East based on the principles of self-determination and shared sovereignty within a united, undivided Sri Lanka’ (2014)

ITAK is the leader of the TNA alliance

‘Tamil United Liberation Front, of which our party was a member took the historical decision to establish the separate government of Tamil Eelam in 1976’ (Sambanthan in 2014 at ITAK convention)

TULF manifesto of 1977 stated that Eelam would be ultimately established either by peaceful means or by direct action or struggle.”

Prabakaran formed Tamil New Tigers in 1972 the same year TULF was formed

Prabakaran rechristened TNT as LTTE in May 1976 the same month/year TULF called for the creation of an independent Tamil Eelam (Vaddukoddai Resolution)

As you can see both political and military objectives not only were aligned by time but the demands too were virtually the same.

Election manifestos of TNA establishes LTTE links

  • TNA 2001 manifesto virtually the same as LTTE Thimpu demands. TNA claimed LTTE was the sole Tamil National Entity” claiming that as SOLE REPRESENTATIVE of the Tamil people in Sri Lanka LTTE had a right to negotiate on behalf of the Tamil people.
  • TNA 2004 manifesto sought to accept LTTE’s leadership as the national leadership of ‘Tamil Eelam’ and LTTE as the sole & authentic representative of the Tamil people.

TNA was placed in Parliament with help of LTTE

EU Election Observation Mission Chief John Cushnahan EU report on 17, June 2004 clearly establishes beyond doubt LTTE-TNA alliance. LTTE ensured no rival Tamil party/candidate contested other than TNA (UNP and EPDP candidates were killed) LTTE allowed only TNA to campaign freely in N E districts.

TNA MPs openly attend overseas events of LTTE fronts

They even speak on top of these stages. TNA held meetings with Global Tamil Forum head Father Emmanuel in South Africa on 8th January 2012.

At no point in time did the TNA admonish LTTE for their crimes against even the Tamils.

At no point in time did the TNA demand LTTE not to recruit Tamil children by force to turn into child soldiers.

At no point in time did TNA demand LTTE to stop killings, TNA only demanded for the GOSL to stop the offensive.

When 8000 students who sat the O/L were taken for compulsory training by LTTE, TNA did not utter a word. Where were the children/grandchildren of the TNA?

‘Our expectation for a solution to the ethnic problem of the sovereignty of the Tamil people is based on a political structure OUTSIDE that of a UNITARY GOVERNMENT, in a UNITED SRI LANKA in which Tamil people have all the powers of government needed to live with self-respect and self sufficiency’. (Sambanthan ITAK convention 2014)

Even former Supreme court Judge CV Wigneswaran started singing the Pulippaattu” (Tiger song) after being nominated as TNA chief ministerial candidate for the Northern provincial council

Both TNA & LTTE must share ‘collective guilt’ for every crime committed since the call for separatism converged with the gun.

    Shenali I just wrote an article in which I highlited this. I thought of following up with another directly accusing the TNA.

    I porpose a Presidential Commission of investigation. I hope these may shut Sumanthiran’s mouth. I posted part of my aticle in Sumandirans facebook as well.

    If we initiate war crimes, terrorism and separatism investigations and trials against them, the West, India and Tamils will be forced to drop war crimes nonsense against us. Otherwise they will keep hounding us.

    I have been saying this since 2010 but the then government had vested interests. KP, Karuna, Pilleyan, etc. are also war criminals.

    There are reconciliation fools who would say hatred doesn’t cease by hatred or love thy enemies. This country is cursed as long as they live.

    Hatred is won by not hating ( Akkodhena Jine Kodham). It is Buddha’s words, and all who have a bit of wisdom will accept it ( as true).
    It means just that, one has to get rid of hatred by non-hating (if there is such a word.)
    Buddha did not say when some one slapped you, offer your other cheek for another slap. That is pure stupidity and also selfishness , because one is not doing anything good for the offender by offering other cheek. He will thus harm himself more.
    By offering the other cheek one will harm himself ( physically) and others.
    Buddha’s words were always follow his claim that helping oneself one help the others and by helping others one help oneself and same with harming.

    However there is no need to hate anyone here, not even Prabhakaran ( even when he lived). What the Government has to do is apply the law to wrong doers.
    For example there is no need to hate Ranil or Mahinda or Sirisena for their wrong doings. Simply apply the law. By not applying law, they are harmed as well as millions of people.

    After KP is caught, he should have been tried immediately. That is what Malaysia expected after doing there duty.
    Instead, politicians negotiated with him for personal monetary gains. Similarly Karuna was used for political gains. Only people punished was our Sinhala soldiers.

    @Dilrook Indeed. This should have been done from 2010! The country should have raised at every possible level the crimes of terrorists, their financiers (here and abroad) and frankly the people who armed and trained them in the first place (India).

    Instead of “India is my brother” etc and maintaining the Indo Lanka Accord, Sri Lanka should have gone to the highest levels and fought its case that another country attempted to destroy us through the most repulsive of means. But this requires leaders who genuinely want to change the country and not play politics, or who aren’t part of the very vested interests who use all this bogus speak as a means to benefit themselves through the various structures in place around the country (primarily Provincial Councils).

    A completely non partisan approach is required in the interest and in the name of the country. As you very rightly say, it isn’t right for anyone from any political party to conspire and work with the bad guys.

    @Charles see my proposal to restore our country. I have highlighted measures to eradicate all this nonsense by racist parties and frankly the inept handling of this situation by successive governments.

    It will be very difficult for an ordinary citizen to do it because the required evidence sufficient for the court to give a verdict is difficult to obtain. Besides, the executive president throws various obstacles to such a case indirectly saving TNA, etc. Our court system is not totally independent.

    Few tried it but failed.

    The executive presidency must be removed or the EP must support it. After JR and Premadasa, no one was interested in really implementing any of the laws against Tamil politicians. No EP after them has implemented Constitutional national safeguards against Tamil politicians.

    13th Amendment was not implemented democratically. Now it is the time to remove it democratically. All EP’s have been undemocratic and we cannot expect EP to be democratic because it is the very idea of having an EP.
    Therefore EP shall be removed. Then only application of law to criminals, those who supported terrorism can be done.
    Agree with Dilrook. EP is there to do injustice. Without EP, war could have won long log time ago.

    Dilrook that’s the trouble. Anyone who is a genuine patriot and who cares about country over party, or fixed ideology, would do the right thing. The Provincial Council system could have been abolished at any point by any President yet none thus far have done it. There is no excuse for them not to have made moves to do so, or calling for a referendum to expel it from our already messy constitution.

    We had a situation where Chief Ministers were swearing before the President instead of the Governor and situations where goons in these ridiculous councils were openly making racist statements and nothing was done about it.

    The entire link between India and the terrorists should be taken to the highest levels at international fora regarding their crimes against all the people of this country from the early 1970s. If you note back in 1987, more countries were on our side, including foreign media, with regards to India arming/training all these groups, and the blatant interference in our affairs. Yet all of the current political class act as if they are servants to India, and not the people of this country who elect them!

    As for the Constitution, whether we have a Presidency, or a Prime Minister as the Executive, the key thing is to get rid of this utterly useless 13th amendment and frankly even adopt a clean constitution. We are not unitary at all as you have rightly pointed out. In no unitary country can provincial councils overrule the Parliament of the country! This is all about vested interests and sycophants maintaining “jobs for the boys,” continuing corruption and continuing India’s stranglehold on our people and development.

    Turkeys however will never vote for Christmas as the saying goes, so unless you get new candidates in (and thankfully it appears people are emerging for the next election), it seems dubious that any of the current lot will do what is morally right in the interests of the country. 10 years since the war ended, and we have not achieved anywhere near our true potential.

    Frankly the Soulsbury Constitution maintained our territorial integrity, national security, national interest, communal harmony and cracked down on unruly racist elements like the TNA etc far better than what we have now. And we were not an Indian lackey either. I suggested adopting a constitution similar to that in my recent article. The trouble is far too many people take a partisan approach, or support personalities and are more concerned with symbols over real substance. The Sinhalese have been ruined by idiotic policies since 1956. Best thing is to revert to the systems we had before and adopt Singaporean style (they actually implemented what we had) governance and demographic integration policies to rid the country of all these selfish politicians from the modern day UNP, SLFP, SLPP, TNA, SLMC etc. None of them even state on their manifestos that they will fight ethnic parties (which should be banned) and the whole lot have a sing and dance in the Parliamentary mess together. Every party for instance has participated in car permits etc.

    I personally feel a non partisan Presidency elected like in Singapore (and similar to our Governor General from before in terms of power) with a Prime Ministerial system in conjunction with ethnic integration policy is the way to go. Long piece, but worth a read – I tried to highlight what can be done. But we have people who completely lack vision at the top. This was my suggestion, but I have noted at least two new people who have said they will contest with some decent ideas.

    “Chief Ministers”, “Governors” are parasites of the nation, so is the President himself.

    We have to start cleaning from LG (pradeshiya sabha in other words, RAPE SABHA) level. All these are security threat to people ( including some armed forces and police goons )

    I CONCUR. I think we are both in agreement. I would most sincerely direct you to my proposal to restore paradise (the link is above, or you can scroll down the main page) where I highlighted EXACTLY THAT!

    The people of this country are sovereign. Not politicians. Loyalty should be non partisan to the country and not to one ideology, one family, or blindly following people over the abyss. We could have achieved so so so much after 2010 and undone the utter mess that the likes of the Bandaranaikes, Jayawardenes etc did to our country. Time to stop electing Indian bootlickers.

    The 13th amendment should not only be expunged from the constitution, it should be taught to every child in every school for years to come so they see how worthless the politicians who lie to the people truly are.

    The Provincial Council system, Chief Ministers, Indian style politicians who have infected every level of the country, from Presidency to local government should be kicked out. The old system/a new clean system pre 1972 should be installed and a clean set of honest honourable people nominated to run the country FOR THE PEOPLE.

    Right now all we have are Indian bootlicking rogues. Government of the corrupt, for the corrupt and by the corrupt.

    I would urge you to read my suggestions to develop this country in my article, the highlights of which include:
    1. 13A is torn up, burned into pieces and blasted into space
    2. India is told where to stick its nose (up its backside) and Indo-Lanka Accord is scrapped
    3. Indian fisherman are caned
    4. Corrupt if found guilty are caned
    5. Either a Presidential model with separation of powers (Cabinet separate from legislature), or Prime Ministerial Soulsbury style system with elected ceremonial President (that rotates as in Singapore)
    6. Qualifications to be elected a member of Parliament (certain university degree, possible national service (males), business experience in a listed company, cannot contest beyond age 70)
    7. Cabinet limited to 15 (whether majority, or coalition government)
    8. Clear language policy. Sinhala the only “National” language and Sinhala, Tamil and English all “Official” languages. English the working language of administration
    9. Defence Treaty similar to Anglo-Ceylon treaty signed with someone like China
    10. Country has no bureaucracy and cuts all jobs for boys – All red tape to be cut
    11. Technocratic management to encourage local entrepreneurs and encourage MAJOR real foreign investment by companies from China, the US, Europe, Japan, Australia, SE Asia and only top tier Indian business, not crappy corrupt ones in bed with politicians BASED ON MERIT ONLY
    12. Indian lorry buses to be scrapped. One is to remain in Colombo with the sign “Never again” on top.
    13. Indian trains to be scrapped
    14. Indian boot licking politicians who ordered said buses and lorries to be held accountable and caned.
    15. Modern high speed electrified train network for the people to be build and operated by Chinese, Japanese, Hong Kong MTR, German companies etc
    16. Brand new airport to replace woeful Katunayake, build it next to Port City. Let Chinese help us with open arms, no more appeasing India
    17. Strict laws and punishments for offenses
    18. No cronyism. A principle of meritocracy only
    19. GAL OYA schemes to settle millions of people (Sinhalese, Tamil, Moor, Burgher, Malay) in the North and East to ensure the NATIONAL DEMOGRAPHICS are in place throughout the island – like Singapore, this will be our Ethnic Integration Policy
    20. Abolish the Central Bank and have a Monetary Authority so no government can print money for stupid irresponsible election gimmicks.

    Just my suggestions, but I’d encourage you to read the suggestions in full in my piece. Far better than reading about stupid political clan’s weddings and so on. The fact that RW is a main guest at a certain MR wedding says a lot.

    I am not particularly encouraged by the likes of GR who failed to remove 13A pre 2015. Two Brand new candidates not associated to the bloated inefficient and corrupt mainstream parties have both announced they will remove the 13A. They are therefore worthy of our vote. And their other policies sound far better than what these utter buffoons (the whole 226 from all sides) are proposing. This country should develop in 10-15 years max. with the right policies, but we are lions led by idiots who have made us an Indian lackey.

    It starts at the top and people voting with their brain in 2020. Don’t let us waste even another second on the wrong path. We must aspire to be like South East Asia.

    We foolishly celebrated becoming a “republic” in 1972 and for having our own Constitution without realizing the Indian threat that awaited. India replaced Sri Lanka and Britain’s Privy Council since 1972.

    A new Constitution can be easily passed by 50% people voting for it. There is no need for 2/3 in parliament and to check with the Supreme Court. Sovereignty rests with the people and the legislative part is exercised by parliament and judicial element is exercised by the court. People can take them back anytime. However, this process needs the president to declare a referendum and present a new constitution.
