I am impressed by the geo-judicial representation of the Tribunal.ƒÆ’-¡ƒ”š‚  You have covered the gamut at least to pretend that you are thoroughly international and that there was no room for partiality.

I can only say ƒÆ’‚¢ƒ¢-¡‚¬ƒ…-Wow!ƒÆ’‚¢ƒ¢-¡‚¬ƒ”š‚ and that you were sitting down to some serious business to formulate a judgment on a puny island nation which was orphaned militarily by the western countries to fight a lethal and the most ruthless terrorist group in the world, the ƒÆ’‚¢ƒ¢-¡‚¬ƒ”¹…”Made in India & NorwayƒÆ’‚¢ƒ¢-¡‚¬ƒ¢-¾‚¢ Tamil Tigers which most of the western countries funded, who haemorrhaged that island nation for 27 long years while challenging its sovereignty.ƒÆ’-¡ƒ”š‚  That was a tall order.

And then I just read in the BBC Sandeshaya edition that your Tribunal had found ƒÆ’‚¢ƒ¢-¡‚¬ƒ…-that Sri Lanka was ƒÆ’‚¢ƒ¢-¡‚¬ƒ”¹…”guiltyƒÆ’‚¢ƒ¢-¡‚¬ƒ¢-¾‚¢ of war crimes.ƒÆ’‚¢ƒ¢-¡‚¬ƒ”š‚ƒÆ’-¡ƒ”š‚  WoƒÆ’‚¢ƒ¢-¡‚¬ƒ”š‚¦woƒÆ’‚¢ƒ¢-¡‚¬ƒ”š‚¦woƒÆ’‚¢ƒ¢-¡‚¬ƒ”š‚¦ ladies and gentleman, hold it right there. ƒÆ’-¡ƒ”š‚ How did you come to that conclusion in two days?ƒÆ’-¡ƒ”š‚  You make the serious business look like a childƒÆ’‚¢ƒ¢-¡‚¬ƒ¢-¾‚¢s game of tiddly-winks.ƒÆ’-¡ƒ”š‚  Are you really serious with your conclusion?ƒÆ’-¡ƒ”š‚  I am flabbergasted, really! I am dumbfounded.ƒÆ’-¡ƒ”š‚  I am bewildered.

Some have admonished you judges as being Justices of a ƒÆ’‚¢ƒ¢-¡‚¬ƒ”¹…”Kangaroo CourtƒÆ’‚¢ƒ¢-¡‚¬ƒ¢-¾‚¢.ƒÆ’-¡ƒ”š‚  And you better not second guess me as I shall not spare my cane if I find out that you are partial for the want to support the Sri Lanka War Crimes hunters, as Sri Lanka obviously stands guilty in their eyes for not cowing down to the western Big Brothers demands for a ƒÆ’‚¢ƒ¢-¡‚¬ƒ…-CeasefireƒÆ’‚¢ƒ¢-¡‚¬ƒ”š‚ during the latter stages of the war, to save the Tamil Tiger leaders. Well, what they expected Sri Lanka was to drop to the ground and roll over pretending that she is dead.ƒÆ’-¡ƒ”š‚ ƒÆ’-¡ƒ”š‚  ƒÆ’-¡ƒ”š‚ Well, that didnƒÆ’‚¢ƒ¢-¡‚¬ƒ¢-¾‚¢t happen and of course their vanities were bruised and shattered.ƒÆ’-¡ƒ”š‚  And there lies the problem and they have hired you lot to do their hatchet job.ƒÆ’-¡ƒ”š‚  Own up, isnƒÆ’‚¢ƒ¢-¡‚¬ƒ¢-¾‚¢t that so?

If you believed those who told you that this Eelam War IV was supposed to have been fought shootingƒÆ’-¡ƒ”š‚  jasmines, roses and scented water at each other from barrels of AK47s, then they lied to you lot and you believed them.ƒÆ’-¡ƒ”š‚  DidnƒÆ’‚¢ƒ¢-¡‚¬ƒ¢-¾‚¢t anyone tell you that this Eelam War IV was a conventional war fought with guns, bullets and bombs, like what was fought in Iraq recently, and in Afghanistan right now? ƒÆ’-¡ƒ”š‚ DidnƒÆ’‚¢ƒ¢-¡‚¬ƒ¢-¾‚¢t you all know that when two parties play war games with live guns and bulletsƒÆ’‚¢ƒ¢-¡‚¬ƒ¢-¾‚¢, the players eventually get hit and die?ƒÆ’-¡ƒ”š‚  That Sri Lanka had no UN Manual to be guided like ƒÆ’‚¢ƒ¢-¡‚¬ƒ…-Fighting a War for Dummies so that no one gets killedƒÆ’‚¢ƒ¢-¡‚¬ƒ”š‚.ƒÆ’-¡ƒ”š‚  Even if there was one, the nasties hid it from them.

ƒÆ’‚¢ƒ¢-¡‚¬ƒ…-In its preliminary findings, the PeopleƒÆ’‚¢ƒ¢-¡‚¬ƒ¢-¾‚¢s Tribunal on Sri Lanka (PTSL) that conducted hearings from 14 to 16 January in Dublin has also concluded that the Sri Lanka government is also guilty of crimes against humanity.ƒÆ’‚¢ƒ¢-¡‚¬ƒ”š‚ƒÆ’-¡ƒ”š‚  You must be joking!ƒÆ’-¡ƒ”š‚  How the hell did you all come to that conclusion?ƒÆ’-¡ƒ”š‚  DidnƒÆ’‚¢ƒ¢-¡‚¬ƒ¢-¾‚¢t someone sensible among you lot try to find out what your hosts were making you drink each morning at breakfast?

Something tells me that you all were hallucinating during those couple of days to concludeƒÆ’-¡ƒ”š‚  that Sri Lanka is guilty of crimes against humanity for giving back the right-to-life to all of the people in that little island.ƒÆ’-¡ƒ”š‚  Little wonder why I asked you what you drank from January 14 to 16 mornings or even smoked in hiding to come up with such a negative judgment for such a positive enactment to humanity.ƒÆ’-¡ƒ”š‚  Strange!

You say it has been a crime on humanity, to give back to every Sri Lankan their independence and the right for them to get on a bus, a train, or a three-wheeler each morning without putting their palms together in prayer or making a sign of the cross praying to God that they arrive at their destination in one piece without being blown to smithereens by a Tamil Tiger bomb or a claymore mine planted in a bus, train or a street corner,

Holy Moses! This is so damn stupid isnƒÆ’‚¢ƒ¢-¡‚¬ƒ¢-¾‚¢t it?ƒÆ’-¡ƒ”š‚  DonƒÆ’‚¢ƒ¢-¡‚¬ƒ¢-¾‚¢t you see it?ƒÆ’-¡ƒ”š‚  This is insane.

To accept the challenge of the Tamil Tigers during the Mavil Aru incident in July 2006 by the Sri Lankan Armed Forces was for the Sri Lankan government to give back the right-to-life ƒÆ’-¡ƒ”š‚ to its citizenry andƒÆ’-¡ƒ”š‚  get rid of the Tamil Tigers who were stalking these innocent people with guns, bullets, RPGs, claymore mines and bombs. ƒÆ’-¡ƒ”š‚ Did you all find out why these Tamil Tigers were doing it?ƒÆ’-¡ƒ”š‚  Obviously not, as your assignment was to do a hatchet job for your employers. These Tamil Tigers were killing innocent people, mainly the majority Sinhalese to have a piece ofƒÆ’-¡ƒ”š‚  the rich and productive real-estate in the North and East of the island which belonged to all Sri Lankans, Sinhalese, Tamils, Muslims, Burgher and every other mini-minority group, to call it their mono-ethnic, racist, Tamil state Eelam for their Tamil people.ƒÆ’-¡ƒ”š‚  But do you know what?ƒÆ’-¡ƒ”š‚  These rascals wanted to have the cake and eat it too. While they wanted their own piece of territory carved out of Sri Lanka solely for their Tamil people, they also wanted to enjoy life in the rest of the country ƒÆ’‚¢ƒ¢-¡‚¬ƒ¢¢”š¬…” education, jobs, businesses,ƒÆ’-¡ƒ”š‚  property owners, you name it and they wanted it. ƒÆ’-¡ƒ”š‚ That is how selfish these Tamil Tigers and their separatist supporters were.ƒÆ’-¡ƒ”š‚  Did you know there are 390,000 Tamils enjoying life in the capital Colombo ƒÆ’-¡ƒ”š‚ living in harmony with the rest of the ethnic communities who would say to anyone of you ƒÆ’‚¢ƒ¢-¡‚¬ƒ¢¢”š¬…” ƒÆ’‚¢ƒ¢-¡‚¬ƒ…-Thank goodnessƒÆ’-¡ƒ”š‚  these Tamil Tiger terrorists were got ridden of as we can now live peacefully in our Motherland.ƒÆ’-¡ƒ”š‚  How they were wiped out doesnƒÆ’‚¢ƒ¢-¡‚¬ƒ¢-¾‚¢t really matter.ƒÆ’-¡ƒ”š‚  That they are no longer being a canker and a menace killing innocent people is what matters to us most right now.ƒÆ’‚¢ƒ¢-¡‚¬ƒ”š‚ƒÆ’-¡ƒ”š‚  You bet, this is what every Tamil in the capital will tell you.

ƒÆ’‚¢ƒ¢-¡‚¬ƒ…-However, the pro-Tamil Tiger groupsƒÆ’‚¢ƒ¢-¡‚¬ƒ¢-¾‚¢ accusation that the government carried out Tamil genocide at the last phase of war between the security forces and the LTTE needs to be investigatedƒÆ’‚¢ƒ¢-¡‚¬ƒ”š‚, the BBC report said.ƒÆ’-¡ƒ”š‚ 

I donƒÆ’‚¢ƒ¢-¡‚¬ƒ¢-¾‚¢t think I have to give you a lesson on Genocide 101.ƒÆ’-¡ƒ”š‚  To tell you that according to the Polish-lawyer Raphael Lemkin who sought to describe in 1944 the Nazi policies of systemic murder, including the destruction of the European Jews, he formed the word ƒÆ’‚¢ƒ¢-¡‚¬ƒ…-genocideƒÆ’‚¢ƒ¢-¡‚¬ƒ”š‚ by combining geno- from the Greek word for race or tribe, with ƒÆ’‚¢ƒ¢-¡‚¬ƒ¢¢”š¬…”cide, from the Latin word for killing.ƒÆ’-¡ƒ”š‚  In proposing this term, Lemkin had in mind ƒÆ’‚¢ƒ¢-¡‚¬ƒ…-a coordinated plan of different actions aiming at the destruction of essential foundations of the life of national groups, with the aim of annihilating the groups themselves.ƒÆ’-¡ƒ”š‚  In the following years, the International Military Tribunal held in Nuremberg, Germany, charged top Nazis with genocide, ƒÆ’‚¢ƒ¢-¡‚¬ƒ…-crimes against humanityƒÆ’‚¢ƒ¢-¡‚¬ƒ”š‚.

Well, your exercise seems futile in the Sri Lankan context as there was no annihilation of the Tamil community of the North in May 2009, but 288,000 Tamils were saved from the clutches of the Tamil Tigers who were holding them in a small sliver of beach land as a human shield and shooting at anyone who wanted to get away.ƒÆ’-¡ƒ”š‚  And that is a fact.

Further, my dear Judges, what is paramount to be noticed is that the Sri Lankan government noticing that one whole generation of young Tamils got killed as girl and boy child soldiers, they encouraged pro-creation of their clan by not promoting birth control to the young and married and didnƒÆ’‚¢ƒ¢-¡‚¬ƒ¢-¾‚¢t even entertain providing condoms or birth control pills to the males and females in the welfare village camps whose hormones were kicking in and they had enough spare time to hold hands and walk in search of dark private corners.

I suppose all these factors are weakening your hatchet job, doesnƒÆ’‚¢ƒ¢-¡‚¬ƒ¢-¾‚¢t it?ƒÆ’-¡ƒ”š‚  It certainly makes you all look like the fraternity of the League of the Mafia against Sri Lanka.

So where the heck is this business of ƒÆ’‚¢ƒ¢-¡‚¬ƒ…-genocideƒÆ’‚¢ƒ¢-¡‚¬ƒ”š‚ of the Tamils come into play?ƒÆ’-¡ƒ”š‚  You tell me.

ƒÆ’‚¢ƒ¢-¡‚¬ƒ…-Harrowing evidence, including video footage, was submitted by eye-witnesses of the use of heavy artillery and phosphorous munitions, and of the continuous violations of human rights by military activity to a panel of ten international jurors over two daysƒÆ’‚¢ƒ¢-¡‚¬ƒ”š‚, the PTSL has said in a statement and reported by BBC.

This is what you jurors have to contend with and in fact deal with.ƒÆ’-¡ƒ”š‚  As Sri Lanka goes, they are into a phase of ƒÆ’‚¢ƒ¢-¡‚¬ƒ…-WhatƒÆ’‚¢ƒ¢-¡‚¬ƒ¢-¾‚¢s in it for meƒÆ’‚¢ƒ¢-¡‚¬ƒ”š‚ culture.ƒÆ’-¡ƒ”š‚  Bribing is rampant and what has been commonly said for decades is that, ƒÆ’‚¢ƒ¢-¡‚¬ƒ…-A Sri Lankan is capable of selling his or her mother for a thousand rupeesƒÆ’‚¢ƒ¢-¡‚¬ƒ”š‚.ƒÆ’-¡ƒ”š‚  In other words bribing someone to get things done or to corroborate with someoneƒÆ’‚¢ƒ¢-¡‚¬ƒ¢-¾‚¢s ill favoured statement is a common practice.ƒÆ’-¡ƒ”š‚  So what you have to find out from these witnesses is ƒÆ’‚¢ƒ¢-¡‚¬ƒ¢¢”š¬…” ƒÆ’‚¢ƒ¢-¡‚¬ƒ…-how much is your harrowing evidence worth for you?ƒÆ’‚¢ƒ¢-¡‚¬ƒ”š‚ƒÆ’-¡ƒ”š‚  And I certainly wouldnƒÆ’‚¢ƒ¢-¡‚¬ƒ¢-¾‚¢t trust anyƒÆ’-¡ƒ”š‚ ƒÆ’-¡ƒ”š‚  ƒÆ’‚¢ƒ¢-¡‚¬ƒ…-whatƒÆ’‚¢ƒ¢-¡‚¬ƒ¢-¾‚¢s in it for meƒÆ’‚¢ƒ¢-¡‚¬ƒ”š‚ witnesses with any ƒÆ’‚¢ƒ¢-¡‚¬ƒ…-harrowing evidenceƒÆ’‚¢ƒ¢-¡‚¬ƒ”š‚, as it would be a case of what can I get out of it.ƒÆ’-¡ƒ”š‚  ƒÆ’-¡ƒ”š‚ ƒÆ’-¡ƒ”š‚ And mind you Jurors, forking out money has never nor will ever be a question as long as an angry and vilified western ƒÆ’‚¢ƒ¢-¡‚¬ƒ…-We are holier than thouƒÆ’‚¢ƒ¢-¡‚¬ƒ”š‚ foreign country knows that such evidence bought with thousands of rupees will tighten the noose on Sri Lanka.

So I want you all to deal with this issue honestly, or is the question that goes begging is will this be possible when you all are hatchet people.

But let me tell you one thing about your ƒÆ’‚¢ƒ¢-¡‚¬ƒ”¹…”Goody-two-shoesƒÆ’‚¢ƒ¢-¡‚¬ƒ¢-¾‚¢ pious TribunalƒÆ’‚¢ƒ¢-¡‚¬ƒ¢-¾‚¢s getting together and your untowardly strange conclusion in two days ƒÆ’‚¢ƒ¢-¡‚¬ƒ¢¢”š¬…” all this would do nothing to further permanent peace efforts and harmony in Sri Lanka.ƒÆ’-¡ƒ”š‚  Your quasi-legal, unaccountable organizationƒÆ’‚¢ƒ¢-¡‚¬ƒ¢-¾‚¢s shenanigans will pose serious threats to the stability of that beautiful island nation that the western nations orphaned and supported the most ruthless terrorist outfit in the world, the Tamil Tigers, to tear it asunder.

ƒÆ’-¡ƒ”š‚ And finally let me deal with one more question that your juror Justice Rajinder Sachar from India had posed.ƒÆ’-¡ƒ”š‚  He said to The Indian Express, ƒÆ’‚¢ƒ¢-¡‚¬ƒ…-We have to find out the actual matter, including why the Norwegian Peace initiative failed.ƒÆ’‚¢ƒ¢-¡‚¬ƒ”š‚

Here are some facts for you Justice Sachar on your curiosity which I doubt your witnesses will ƒÆ’-¡ƒ”š‚ reveal as it might not help to tighten the noose around Sri Lanka.

1. The ƒÆ’‚¢ƒ¢-¡‚¬ƒ”¹…”CeasefireƒÆ’‚¢ƒ¢-¡‚¬ƒ”š‚ between the Sri Lankan Government and the non-state terrorist organization the Liberation Tigers of Tamil Eelam (LTTE aka Tamil Tigers) initiated by the Norwegian Government was signed on February 22, 2002 and was rescinded by the Sri Lankan Government on January 16, 2008;

1. The ƒÆ’‚¢ƒ¢-¡‚¬ƒ”¹…”Ceasefire was monitored by the Scandinavians headed by a retired army Major General from Norway.ƒÆ’-¡ƒ”š‚  These Monitors were a lark and they were caught with their pants down on many occasions not being neutral and supporting the Tamil Tigers.ƒÆ’-¡ƒ”š‚ ƒÆ’-¡ƒ”š‚ ƒÆ’-¡ƒ”š‚  On one such incident was when the no good Lutefisk eating Viking, Retired Major General Tryge Tellefsen, the Head of the Scandinavian Monitors tipped the Tamil Tiger warehouse armoury ship to get away as the Sri Lankan Navy was coming to get it. And so it took off.ƒÆ’-¡ƒ”š‚  And thus the ruddy retired Major General was sacked from his job by NorwayƒÆ’‚¢ƒ¢-¡‚¬ƒ¢-¾‚¢s Prime Minister Kjell Magne Bonde having received a complaint from then President of Sri Lanka, Chandrika Kumaratunga.

During the famous ƒÆ’‚¢ƒ¢-¡‚¬ƒ”¹…”CeasefireƒÆ’‚¢ƒ¢-¡‚¬ƒ¢-¾‚¢, the Tamil Tigers brought in 11 ship loads of sophisticated weapons and the Scandinavian Monitors true to their collaborative vows with the Tamil Tigers had their fingers stuck in their ears an eyes blinkered as if ƒÆ’‚¢ƒ¢-¡‚¬ƒ…-We hear no evil and we see no evilƒÆ’‚¢ƒ¢-¡‚¬ƒ”š‚, saying ƒÆ’‚¢ƒ¢-¡‚¬ƒ…-sneak them in chapsƒÆ’‚¢ƒ¢-¡‚¬ƒ”š‚.ƒÆ’-¡ƒ”š‚  ThatƒÆ’‚¢ƒ¢-¡‚¬ƒ¢-¾‚¢s how sordid the ƒÆ’‚¢ƒ¢-¡‚¬ƒ”¹…”CeasefireƒÆ’‚¢ƒ¢-¡‚¬ƒ¢-¾‚¢ was.

By July 14, 2006, according to the Norwegian led Scandinavian Ceasefire Monitors, Tamil Tigers had violated the ƒÆ’-¡ƒ”š‚ Ceasefire agreement 7,308 times, in the form of child recruitment for their Baby Brigade and suicide bomber squad; murdering political opponents, Sinhalese as well as their own Tamils; engaged in suicide bombings; mass massacres of innocent civilians; and abducted civilians for ransom.ƒÆ’-¡ƒ”š‚ ƒÆ’-¡ƒ”š‚  By that time the much disciplined Sri Lankan army had violated the ƒÆ’‚¢ƒ¢-¡‚¬ƒ”¹…”CeasefireƒÆ’‚¢ƒ¢-¡‚¬ƒ¢-¾‚¢ just over 200 times. ThatƒÆ’‚¢ƒ¢-¡‚¬ƒ¢-¾‚¢s how provocative the ƒÆ’‚¢ƒ¢-¡‚¬ƒ”¹…”CeasefireƒÆ’‚¢ƒ¢-¡‚¬ƒ¢-¾‚¢ was.

ƒÆ’-¡ƒ”š‚

During the ƒÆ’‚¢ƒ¢-¡‚¬ƒ”¹…”CeasefireƒÆ’‚¢ƒ¢-¡‚¬ƒ¢-¾‚¢ the Tamil Tigers brought in four Czech-built Zlin-143 planes dismantled in containers which were turned into night bombers graduating themselves to be the first terrorist outfit in the world with an Air Wing.ƒÆ’-¡ƒ”š‚  They used these planes to bomb the Katunayake International Airport as well as the Airbase at Anuradhapura.ƒÆ’-¡ƒ”š‚ ƒÆ’-¡ƒ”š‚ ƒÆ’-¡ƒ”š‚ 

Well, the Scandinavian Monitors saw to it that the planes took off at night for the raids.ƒÆ’-¡ƒ”š‚  That is how cantankerous this sordid and provocative ƒÆ’‚¢ƒ¢-¡‚¬ƒ”¹…”CeasefireƒÆ’‚¢ƒ¢-¡‚¬ƒ¢-¾‚¢ was.
