AN APPLICATION UNDER THE SIXTH AMENDMENT TO THE CONSTITUTION

SINHALA JATHIKA PERAMUNA

The Sixth Amendment to the Constitution of Sri Lanka was enacted in August 1983.ƒÆ’-¡ƒ”š‚  The Article 157A(2) states the following;

157A (2). No political party or other association or organization shall have as one of its aims or objectives the establishment of a separate state within the territories of Sri Lanka.

Many Sinhala Nationalists have asked the question why nobody takes any legal action against the TNA for carrying out freely a separatist agenda even after the defeat of the separatist terrorism?

We the, Sinhala Jathika Peramuna, the Political wing of the Sinhala Nation held the same view for a long time and finally have taken the initiative to do something about it.

We have filed an application under the Sixth Amendment in the Supreme Court today (27.04.2012) for a declaration under Article 157 A (4) against four Eelam Tamil political parties, namely ITAK, TELO. EPRLF and the TULF naming their Secretaries and leaders as Respondents.

Further, the TNA is going round the world collaborating with certain foreign governments and with anti Sinhala elements to file a Hunan Rights Violation case in the International Court of Criminal Justice against our Sinhala Armored forces for defeating the LTTE in the battle field with the political leadership it received after 30 years of waiting.

The threat of that legal action against the Armored forces will continue to drag if the local separatists are allowed to continue with their separatist politics unhindered locally.

Therefore, we believe that the best action at this hour is to go on the legal offensive against the TNA & the TULF and to seek remedies through the only legal provision available to us, the sixth Amendment, which has not been made use until now.

The General Secretary of the Sinhala Jathika Peramuna is the Petitioner for the application filed.

    Well done! You have the support of the entire patriotic community of Sri Lanka. These political parties must be banned and they should be ordered to repay the taxpayer benefits they received.

    I am also looking for the answers you have raised. We are supportive of Sinhala Jathika Peramuna and its actin against the racist pigs. We also can chip in few bucks towards the legal expences.

    This news item appears in The Island and Asian Tribune as well. So it cannot be false.

    This is not the first time. In 2009 they filed a petition in SC to ban all racist parties. But the bloody idiots didn’t give the CORRECT verdict.

    We must push on.

    We need MORE AND MORE petitions to SC to ban Tamil racist parties and punish them under the 6th amendment.

    We must follow the GANG BANG approach to ALL Tamil racists. MORE AND MORE petitions, MORE court cases, MORE harassments, etc. against them will SINK them in defeat one day.

    Rome was not built in a day!

    Wait till the SC gives the verdict. I bet it is going to be a wrong verdict because the govt tells SC NOT to do anything to TNA, etc. because that hurts India.

    After the verdict, file your petition.

    It will come to a point when SC will no longer be able to LIE.

    Remember how the SC and the court of appeal wasted time since 2002 to 2008 (bloody 6 years) to declare that bloody CFA invalid?

    It will be a good idea to create SINGLE point of contact in each country to raise funding and we will be happy to contribute… We have done this before when war is on and raised funds for defence.

    Bigger countries like Australia, Canada and US may need to raise funding from each State. Politicians are playing politics with the nation’s sovereignty and anti Lanka groups are heavily funded from foreign sources and we need to create funding for local patriots.
    Hope some one take a note on this and formulate a proper funding structure.

    @Sirih, way back in the 1980s, the Australian government banned fund raising by Sinhalese and other Non-Tamils for assisting the Sri Lankan military. To the best of my knowledge, the LTTE is not banned in Australia and continues to raise funds for their cause. Can you see the double standard? These are the sort of issues we should be taking up with the Australian authorities. They should have been addressed a long time ago.

    It is a good move to enforce the law through the Supreme Court and ban any talk of creating a separate state. Wish you all the best of luck for a quick result.
    Also, I wish you could push the Government of Sri Lanka to take action against those individuals and organisations, both in SriLanka and overseas, who were guilty of aiding and abetting the Tamil LTTE terrorists to commit crimes against humanity in SriLanka. Recently in a similar situation, the former Liberian President CharlesTaylor had been found guilty of war crimes by the world court for aiding and abetting rebels in neighbouring Sierra Leone. This could net all those racists such as Rudrakumaran, Father Emanual, Solheim, Vaiko, Karunanidhi etc

    We wish the Sinhale would unite and solve the all issues facing the Nation.

    We hope that all underlying causes of minority ‘unrest’ are also addressed. If Root Causes are also addressed, then we can surely hope for a lasting peace. Most of the problem lies with the lack of guarding of the coastlines and also other means illegal migrants (especially from Tamil Nadu) have used to gain entry into Sri Lanka. It is mostly Tamil Nadu low caste/Dalit origin people who use Sri Lanka as a spring board for conversions/labour needs in plantations/fisheries etc. to come and settle down in Lanka. Are these people loyal to Lanka or do they want their own ‘states’ and so divide Lanka ? Exposing the Root Causes of the problem is half the problem solved. There are some genuine complaints from the so called estate sector Tamils who work particularly in the tea plantations. They still live in line rooms and pick tea by hand. Moving the line rooms out and providing better accommodation outside in new dwellings, and also mechanization of tea plucking through machines to enable others too to work in tea plucking will surely ease the problems.

    Another Root Cause of our problems: Family Planning & Birth Control a must in Sri Lanka.

    Outsiders interfere because we have not yet put our home island matters in order after some 500 yrs of Colonial rule.

    I contacted an attorney friend working in Hulsdof. He said that no such case has been filed in the supremcourt on April 27th 2012. SJP has been there for a long time are they a registered political party? If it is so, who is the leader and who are the office bears”? Is there a office in Colombo for SJP? Presentation by Ella Gunarathana thero is par excellence. No religous or ethnic association. He call Tamil, Sinhala, Burger, Muslim brothers. Some miss this Video, because it on the right hand end of the web page. One needs to click on it. It is in Sinhala and audio is not good. Neth TV has not done a good job.

    I made inquiries from a very patriotic, sincere politician. He says all these are news to him. He has neither heard of this secretary nor the existance of this peramuna. He also says 13A cannot be repealed in the parliament . In 1987 5-4 supreme court order is that 13A is constitutional and even Trincomalee oil Tanks cannot be leased out to America without India’s approval under Sri Lanka India accord. Therefore Sri Lanka is not a sovereign country. GoSL is not telling the the truth to its people. Sri Lanka cannot be used as a base by America without Indian approval.

    President Rakapakse can use his “powers” to repeal and/or introduce legislation to counter the 13th.
    very much like the undemocratic 18th.
    Ofcourse he will face the “wrath” of the Injuns and now possibly the IC following the UN Resolution “spot light”.
