Why Yoshitha ? Why not Ravi Karunanayake, Arjun Mahendran and Ranil Wickramasinghe?

Law does not differentiate a Prime Minister or a common man. If any one commits a verbal or physical act which is against the law then he could be arrested and brought, before the law. In law there should be sufficient legally acceptable evidence a probable cause for reasonable suspicion to arrest a person and brought him before a judge. It is the judge who decide on the existence of a probable cause for arrest.
Otherwise any person could be accused on very flimsy evidence and brought before a court of law causing detriment to his character and abuse of law to satisfy personal grievances against a person. This is exactly what has happened in the case of Yoshitha Rajapakse.
In Sri Lanka today under the guise of good governance there is an absence of law. The Government manipulates the law to punish those they fear would turn against their political mismanagement. The Government which is Ranil Wickramasinghe and Maithripla Sirisena gets rid of Attorney Generals or require judges to retire not because they are inefficient but because they cannot be made to do what Ranil and Sirisena want them to do. There is a Committee under 19A for appointment of Judges but the Commistttee has to agree on the President’s choice. There ends the independence of Constitutional Committees.
Since the coming into power of Sirisena –Ranil duo nothing happens according to accepted norms of law and order. Persons continue to be arrested by the sinister FCID of the Prime Minister, and arrests are made without giving reasonable cause or reasonable suspicions.
The graves are dug and bodies exhumed, without evidence of reasonable suspicions. Swimming pools which have been covered are uncovered to look for hidden treasures. The grounds are dug up to search gold supposed to have been stolen by the former President Mahinda Rajapakse. There is a deputy Minister whose duty, it appears is to accuse the persons of previous government for hidden money in banks, shares in hotels, or constructing Buddhist meditation centres.
Is it not time that Maithripala Sirisena and Ranil Wickramasinghe stop this paranoia and begin to do some work for the country and ameliorate the condition of living of the people ?
It does not help the country, people, or the government to make, catching thieves , bribe-takers, and arresting money launders, their whole occupation. Enough is enough , it is time to get down to do some work and seriously think of taking action to help the country and the people instead of selling the Sovereignty of Sri Lanka to the West, building bridges between south India and north of Sri Lanka, signing agreements with India that are detrimental to Sri Lanka and its people.
Yahapalanaya should take serious steps to separate the legislative, executive and the Judiciary. As it is the Judiciary has become a Yahapalanaya family affair. The Judges are frightened to antagonize the Ranil -Sirisena duo and make judgements to satisfy them. The Police takes orders from the Prime Minister and a Committee set up by him.
We see this Judicial fear in the Ravi Karuynanayake’s money laundering case involving 390 million rupees received from Raja Rajaratnam the American Tamil Millionaire who financed the Tamil terrorists. The case was settled unders suspicious circumstances in a very short time by the High Court Judge Iranganee Perera who acquitted Ravi Karunanayake. Strangely, the Judge Iranganie Perera retired immediately after the case. She was later appointed as the High Court Commissioner. Ravi Karunanayake was acquitted on technical grounds. The court hearing of the case left much to be desired.
In the case of Yoshitha Rajapakse there is no evidence as to money laundering as in the case of Ravi Karunanayake. Yoshitha had proposed the setting up of a TV station reserved for sports. Some persons and agencies had contributed by providing loans for its setting up. The agreements for the loans taken had been refused to be accepted by the FCID, which considers the loans as black money.”
In the case of Ravi Karunanayake there was certitude that the money in question had come from Raja Rajaratnam. But the case took a different turn since the government had changed and Ravi Karunanayake was appointed the Minister of Finance.
Incidentally, talking about money laundering, the Government has not divulged to the public the Belgian who parked one billion dollars, and another who parked a similar amount in the Sri Lanka Central Banka . In the absence of information, it is normal that one have doubts.
One also begins to questions why Sri Lanka Yahapalanaya leaders have suddenly taken a great interest in Singapore.
They go to hospitals in Singapore, even Ranil Wickramasinghe visits Singapore unofficially quite often . Yahapalanaya is even getting down specialists from Singapore to re-organise the Sri Lanka Foreign Service. The Governor of the Sri Lanka Central Bank is a citizen of Singapore. Has this great interest in Singapore on the part of the Yahapalanaya Government has anything to do with the billions of rupees involved in the Sri Lanka Central Bank Bond scam ?
There is no information as to what happened to the two billion rupees involved in the Sri Lanka Bond Scam. The whole Bond Scam issue has been conveniently covered up. The COPE report was never allowed to see the light of day. Will the new COPE President Handunetti of JVP take it up ?
- 3 million dollars said to have been received by the CSN from a questionable foreign source and the failure to give details of how Rs.234 million was obtained were the reasons on which Yoshitha Rajapakse has been arrested and refused bail . These amounts are just peanuts compared to the money involved in the Central Bank Bond Scam. Yet Ranil Wickramasinghe’s FCID has not bothered to look for these bond scam rogues who are free while Yoshitha Rajapakse has been arrested and refused bail.
Is their law and order under Yahapalanaya Government which controls every thing ? Accusations on which persons are arrested by the FCID are questionable, and no body in Sri Lanka is safe-today, as blame and guilt could easily be fabricated by the FCID established by the establishment to arrest any one it wants.
The thieves and bribe takers , and money launders in Sri Lanka, according to the Yahapalanaya government of Maithripala and Ranil, are those who are in some way connected to the former President Mahinda Rajapakse.
In a recent Rupawahini TV Debate Kauda Atta Kiyanne”, Attorney Mr. Thishara Dissanayake said, quoting a news paper that at a special committee meeting where the action against those arrested by FCID is discussed, Minister Rajita Seanaratna had told the IGP who was present that even though there are accusations against the members of the family of the former President Mahinda Rajapakse , no body has still been arrested, and he had pointed his finger at the IGP and told him that he should get the FCID to arrest Yoshita Rajapakse.
If that is how Yoshitha Rajapakse came to be arrested then this government has become a police state- a dictatorship of Yahapalanaya . The TV debate was on whether the CSN where Yoshitha Rajapakse was the Organiser, was set up for the purpose of money laundering and not because of the necessity for a TV Station exclusively for Sport.
Yoshitha Rajapakse had been arrested for political purposes and to get credit to the Yahapalanaya Government’s principle activity of accusation and arrestation of persons of the family of the former President Mahinda Rajapakse.
The Yahapalanaya is an extreme rightist political party of Ranil Wickramasinghe a member of the Mount Pelerin Society. He is very keen in abolishing the Executive Presidency, as then he as the Prime Minsiter will have power making the President a political decoration. In fact Maithripala Sirisena has little power as it is the UNP led by Rani Wickramasinghe which takes political decisions.
Recently Ranil Wickramasinghe’s Foreign Minister in a question and answer session after he made a speech to the US Institute of Peace in Washington DC on 25 February, 2016, phoo-poohed the President Maithripala Sirisena’s statement that he would not allow foreign judges in a court established in Sri Lanka to try the war heroes, as a personal opinion of the President.
…..Samaraweera responding to a question from the audience said that Sri Lanka is still open for international actors including judges, forensic experts and other relevant professionals, as he thinks it is only fair that the victims of the war would want some form of guarantee.
He also said that the government is looking into all options and come up with a Special Court that is not only credible but also acceptable to all victims of the war, within the next five to six months.
However, when the person who posed a question raised the point that President Sirisena has clearly ruled out foreign involvement Samaraweera responded:
“What the President has expressed is his own opinion, and in Sri Lanka there are various thoughts on how this matter should be handled. Frankly, we too admit the need of international participation in the process, and even some nationalist parties in Parliament agree. There is general agreement across the board that a Special Court will have to be set up in Sri Lanka if the process is to have any credibility, as the Judiciary has lost its credibility over the past 10 years due to the politicization of the judicial process by the previous government.”

This is the Yahapalanaya that exists in Sri Lanka under Ranil Wickramasinghe. The President Maithripala Sirisena is only a decoration, without a voice in Sri Lanka’s Foreign Policy which has been exclusively taken over by Ranil Wickramasinghe and his Foreign Minster Mangala Samaraweera.
This is the Yahapalanaya Government that says it got rid of the white van culture. Yahapalanaya has instead set up the FCID creating a Culture of fear of arrest by FCID where any one may be arrested at any time without reasonable cause merely for political reasons.

UNpeers do not prosecute UNPeers and their families.
SLFPeers will not prosecute SLFPeers and their families.
UNPeers do not prosecute those who cross over to their side
SLFpeers do not prosecute those who cross over to their side
This is common Rogue Law of Sri Lanka. It doesn’t mean that some are saints and others are evil. All are evil.
“Culture of fear” was not exercised only by Sira/Ranil/CBK only, but it is VERY BAD and gives our country a BAD reputation.
If you lived from 1970 onwards and you speak the truth you don’t write blaming only on party.
You have forgotten
How Fonseka was treated
How his son in law was treated
How hundreds of others ( sons of mothers and fathers and fathers themselves – human beings) were treated
Please open your eyes and write properly pointing wrongdoings of all politicians.
Note that,
Mahendran cannot be jailed because Kabraal cannot be jailed.
A lot people cannot be hanged because Ranil cannot hang himself, not because they are not killers.
If we cannot break this cycle we cannot escape from evil of Tamils and Muslims.

Empire wants to get hold of Gotabaya Rajapaksa and is testing waters with Yoshita.
Gotabaya was instrumental in wiping out the Indian terrorist arm trained, financed, managed and named Tamil Tigers by the Indian Empire.
We have been colonized by Indian colonial parasites since their arrival since 1792. That is when the British took over the Dutch possessions of Ceylon, after the Dutch became week from the Franco-Dutch wars.
Indian colonial parasites have been running Ceylon for the absentee British Land Lord. So in fact the so called British Empire was British-Indian Empire.
Since the British-Indian Empire ended and Indians took over it has been directly involved in the internal affairs of the colonies from Fiji to Guyana.

Look at what Hon Champika say about the law.
The vehicle he was travelling met with an accident and he did not stop.
It is human nature and a human obligation to help an injured who ever caused it and how it was caused.
In almost in all countries it is punishable by law if the occupants did not stop and assist the injured. (Note it is not the case in India and it depends on the caste of the victim).
The Hon. Minister calls a media circus and accuses all motorcyclists.

When the LTTE suicide bomber got the Gen Fonseka, Gota flew him down to Singapore for treatment. Fortunately, he recovered.
It was during the Pres Elections of 2010 that Gen Fonseka appeared to behave in an erratic manner. He said that he would take the Rajapakses to Bogambara. He and hundreds of ex-Army people holed up at a hotel during and after teh elections. This was similar to an Army maneuver – during civiian life. He also said that he would raise an Army and go for India. Only the psychiatrists can confirm that he was suffering from some form of PTSD. He was put into a special prison for VIPs. We guess the rest was good for him.
Any other Democratic country may have done the same moves to help him.
Lanka has to refurbish Laws on Army personnel taking part in elections straight after a war. In USA, Army folk have to wait till after 7 yrs after a war they participated in for them to participate in Presiidential elections in the country. Gen Eisenhower did just that and became the President of USA.
There are many Laws of Lanka that have to be reviewed and re-written.
There are some Laws that are illegal (imposed under Duress by India) such as the 13-A. A Law that was never acted on is the 6-A.
The current Yahap govt is a great law breaker ! See how the Central Bank bond scam was handled by Yahap.
Is the Law ‘an ass’ in Lanka ?
We will not get perfection in any govt in Lanka, but the last MR govt did much better by the masses of Lanka and re SECURITY issues in Lanka.

Fran,
“Gota flew him down to Singapore for treatment ..”
Gota did not send him down. It was MR’s government who sent him with Sri Lanka’s funds, not his own wealth.
Even Ranil’s government would surely have done it! It is a MUST do responsibility, not a favour.

SRILANKA IS NOW GOVERNED BY A SET OF BRIGANDS, USING THE PASS WORD, **YAHA PAALA NAYAA **
THE MYSTERY MAN WHO BROUGHT ONE BILLION IS THE SAME BRIGAND WHO STOLE THE MONEY FROM THE CENTRAL BANK. LOVEY SYSTEM. FIRST STEAL AND THEN INVEST THE MONEY STOLEN, INTO THE SAME PLACE ON INTEREST. THIS IS WHY THE NAME CANNOT BE DIVULGED. IF THIS IS NOT MONEY LAUNDERING, THEN WHAT IS IT ? HOW IS IT CALLED.
THIS IS THE UN HRC SYSTEM OF **REFRIGIRATION ** OF NAMES. PERFECTLY LEGAL EH ???? IF UN CAN DO IT, WHY CANT THE BRIGANDS OF SRILANKA ????
CHRISTIE !! IN USA, IF ONE VANISHES FROM THE SCENE OF ACCIDENT, LIKE WHAT CHAMPIKA HAS DONE, STRAIGHT AWAY TO JAIL, FOR ATLEAST THREE YEARS. IT IS A VERY SERIOUS OFFENCE.

I agree with Fran Diaz. Yes, MR govt did a great service to the nation by eliminating tiger terrorism from our soil.
But unfortunately many people have forgotten it in such a short span of time.

It was Kulatunga who plotted to kill Fonseka. What about Wijedasa Rajapakse? The biggest rouge after GL Peera. Peera demanded 10% from the World Bank. Battaramulla is full of rouges. All the politicos with Rajapakse regime were given massive bank loans. Never to repay bank loans. Rambukwella told me his bank loan was Koti hetak I hate Battaramulla bank robbers. Gamini Lokuge took five million rupees from me. He said it was his brother-in-law’s brother who took the money. Those Battaramulla buggers are high way robbers.

The writer must understand and admit that a “Corrupted Elite” class converged on MR’s Regime and the poor man succumbed to the disgraceful behaviour of that class. MR has to be blamed too, because he did not display the correct leadership and failed miserably to identify the “Danger Net” that was laid under his feet. At least he did not have his “Family” to get him out of the clutches of that “Corrupted Elite” class. Instead they too contributed to the mess created. All those “VULTURES” knew well to exploit a “massive weakness” in MR i.e his EGO and “crowned” him a “KING” for their own “economic gains”. Now the task of this Government is not so much to go after MR; but to ROUND up all those “Corrupted Elite” class who ruined MR, and make them to PAY BACK the LOOT. MR knows this very well; but unfortunately he is not allowed to be FREE; that too to protect the future of those VULTURES but not the interests of MR. The sooner MR realizes this TRUTH, it is better for him.

Dham,
We are aware that it was done with govt funds. Nevertheless, it was done, and done promptly.
—————
PTSD was not even spoken about in those times.
It was Dr Ruwan Jayatunge writing to these columns who made us aware of such illnesses in the psyche after a long war lasting nearly 30 yrs with terrorism.
Who can possibly compensate for lost mental health in Army personnel ? Such events must never again happen in Lanka. Breakaway state Tamil Nadu leaders and Tamil leaders of Lanka (V’koddai Resolution 1976 – still not officially revoked), brought about the Eelam wars in Lanka. The 6-A was never activated !
————-
Re incarceration of Yoshitha on false charges :
Pres Sirisena must think how he might feel if Dhaham was incarcerated on false charges ….. one hopes such times as now are never repeated. Lanka’s period of shame re governance is on now.
March 4th, 2016 at 6:02 am
Fran,
I don’t like this government for a second, but I don’t want to be parroting what media says or believe only what WW’s media says and MR’s propaganda says. We cannot win ANYTHING like this. You must agree that this politics should come to an end.
As for the “false charges” I can’t behave like a fool.
1. Why should Mr’s kid be sent to UK for luxury treatment when other naval officers die for the country?
2. Keeping is Navl position, misusing it he has owned this TV channel. How on this earth a fair man allow such thing ?
3. Whole building is prime land owned, where that money come from that young age ?
4. Further, using father’s position World Cup telecast awarded. Is that fair ?
Look, I say all these are crimes and need punishment. But I agree it is not the kid’s fault. His farther did all these.
This is why I say MR must admit all these frauds if he wants to work for the country. Otherwise he is working for himself. Not only that he is not allowing Gota to come forward. he is running the whole of it.
March 4th, 2016 at 8:32 am
Dham,
I am not in a position to pass judgment on any VIP of the past govt. They were a better group than the present top leaders.
MR, GR etc. did what they had to do to win the war – for that we are grateful. If MR used some govt funds for Yoshitha’s training as a Naval Officer, I do not see anything wrong with that. Yoshitha would make a good Officer for the Navy. Re funds for the TV station – probably many ways to raise funds for such a enterprise. Nothing proven here. There is jealousy and envy here re Yoshitha – not good. Does not reflect well on the present leadership, to say the least. Is jealousy and envy the reason for closure of business Avante Garde ?
A lot of the troubles in Lanka with govt & private sector employees is over pay and retirement pay. Lower salaries and not in keeping with rising prices, worldwide. That is why ALL leaders must get together in post-war Lanka and address the REAL problems without causing more problems for each other.
What we are saying is that the Capitalist/Fascist approach of RW/CBK will never work. It has to be a Socalist Sri Lanka – that is how Lanka is described : Demoractic Socialist Republic of Sri Lanka. Stay with the definition. Co-operatives really work even in USA. Over 15% of all businesses are co-operatives in USA. This is ideal of Lanka, being a small country. It ensures better distribution of resources and money.
When Lankan leaders fight each other, the ‘enemy’ wins !
I am closing this thread. Very busy right now.
March 5th, 2016 at 2:56 am
Christie, why do you call this moron Hon minister? Does he have any honourable qualities after what he did to those two humans? Not only he had a duty of care to stop and inquire the well being of the injured, but to stop and exchange the details of his driver’s licence with the other party involved. He also did the most dishonourable thing by sending one of his goons to take the responsibility for the accident which is also illegal. So how can you call this low life scum the Hon minister?
March 5th, 2016 at 3:04 am
Dham, Mr was punished by the voters not once, but twice for all his sins and he and his family have paid dearly for them. The present lot of crooks and traitors came to power blaming Rajapaksas for a lot of things, promising Yahapalanaya, but in a short time they have proven they are worst then the previous lot. At the same time you have to remember most of the allegations against Rajapaksas are not proven, and if you honour the law of the land, you have to accept they are not guilty.
