“Corruption” was the pillar on which President Maithripala Sirisena’s government was built with the collaboration of UNP.

The keyword on which President Maithripala Sirisena’s government came in to being is “corruption”, therefore  that has to be kept on going for the Government to exist.  There is however no lack of it as the UNP Ministers of SLFP President Maitripala Siriesena’s government  keep on finding new instances of “corruption” on hearsay, without any proof what ever.

It is like a game where you are asked to relate an  acceptable story about corruption  regarding  any one connected  in someway to the Rajapakse regimes, the one whose story is the most acceptable get the prize.

Strangely now,  the winning side attracts like a magnet hoodlums, nincompoops, thugs, noise makers, also police officers, the state and local media, and  even a former President’s foot worshipping Minister.

However, the word “corruption” is beginning to ware off.  They may soon have to find  some thing else to keep the heat on vilifications and accusations.  The Government has still not got down to work as the principle issue is to take revenge from Rajapakse family-characgter assassination, smearing  him with mud, and obliterating him with black tar.  That is the principle pre-occupation for the moment.

After all according to Rajitha Senaratne  it had all begun way back in 2012- the process to hang the Rajapakses.  But one does not know who really is the boss of the government of President Maitripala Sirisena.  As far as Ranil Wickramasinghe the Prime Minister is concerned  he cared less the President or even the Parliament  we remember when he signed the CFA with the terrorist leader Prabhakaran behind the back of the President Chandrika Kumaratunga. To his mind,  Ranil Wickramasinghe is  what he could never have been through an election-the President.

President Maitripala Sirisena’s government for all intents and purposes is a UNP Government with the majority of the Ministers  from the UNP. It has all the insignias of the old UNP even the goons or thugs who manifest. They were called during  old days “bath gottayas”.  They manifest and run riot   just for a word from their UNP patrons.   They do not want proof of any thing, the word of the patron is sacrosanct.  Those days it suffice a packet of rice  and a swig of arrack to become a UNP devoted “bath gottaya”

There are no lack of them to-day. Even without the packet of rice and a swig one can still be a ” bath gottaya” .  The BASL just paying lip service to Law and Order behave like the rude common  men with no idea of law and justice, manifesting against  the CJ in front of the Law Courts like the “Bath Gottayas” of the old. Their disrespectful attitude  is a grievous fault  towards  the Chief Justice,  which make them not men of Law, but small morons ignorant of niceties dressed as lawyers in black coats, black trousers, black ties and white shirt.

It was  grossly impolite and showed complete lack of respect to Justice itself for the Attorney General to have d-invited the Chief Justice of Sri Lanka for the Conference of Attorney Generals  held in Colombo on the 19 January,2015, because a set of lunatics of the BASL had forced him to do so.

“…Sri Lanka’s Attorney General barred the countries Chief Justice from attending a regional conference on Monday after allegations he tried to help the former retain power illegally. …..The Sri Lanka’s Bar Association had threatened to boycott the Conference of Attorney Generals , held in Colombo on Monday, if he (Mohan Pieris) attended. ” We have written confirmation from AG(attorney general) that the chief justice (Pieris)was de-invited,” said the head of the bar association Upul Jayasuriya. ” We said we will walk out if  Mohan Pieries is present, and that would have been a big embarrassment”

The big embarrassment would have certainly been there; considering that the Attorney Generals of the region are intelligent men and women who may have been surprised that the so called Bar Association of Sri Lanka consists of lawyers who do not have respect to justice and knows not the axiom that, ”  in law, one is innocent unless proved otherwise”

We will not be short of surprises in this score as the President Maitripala Sirisena  has it seems vowed to restore the Impeached CJ Shriyani Bandaranayake to the role.

Is this government of President Maitripala Sirisena taking  Sri Lanka forward or backward ?

This in fact is a replay of the old UNP (in new bottles!)

The coming of UNP into, political power does not auger well, as it had never been so. The President Maitripala Sirisena  is just a nominal figure head,  it is  UNP which has formed a government. Therefore it is UNP  which is in  power. Champika and JVP  may squeak       to be heard but they really do not count in the new Ranil Wickramasinghe and UNP set up.

At the beginning in 1948 despite the treachery against Sir Baron J ayatilleke, D.S.Senayake who was a rough old Sinhala man with a good common sense , he did no have  the vision to make much of the Independent Sri Lanka   he inherited from his Colonial Masters, other than

living like them.

But he  looked  far  into the future having understood  the unreliability of the Tamils.  Therefore he  started Sinhala settlements in the north as buffer villages to safeguard the south.  He built the Yoda wewa  to provide irrigation facilities for the people of those settlements. He was satisfied doing small improvements to Sri Lanka where he did not see immediate economic or social problems.

SWRD Bandaranaike, the Western Educated brilliant speaker in the State Council may have respected the old DS, but he knew that Sri Lanka had to be swerved onto  a new path. He had a vision while his colleagues in the government had none.  Sri Lanka’s forward march for progress and development began with SWRD Bandaranaike.

To deviate a little to come back to UNP a paragraph or two later, the Tamils of Sri Lanka from the beginning were not patriots, in the sense of the patriotism of the Sinhala Buddhists which is in their blood( except some Sinhala Buddhists whose blood may have got mixed with those of the Tamils) . The Tamils  cannot  even be expected to be patriots of Sri Lanka as their beginnings are in the South Indian marauders who came to plunder, steal and ravage Sri Lanka, and some amoung them who settled down to make a living here as honest men.

So were the Muslims who came as traders and later sought protection from a Sinhala king who settled them in the East.  Therefore it is natural the Tamils and Muslims do not vote at elections for the love of this country, but for the best they can get out of it and live separately from the Sinhala Buddhists.

This period  under SWRD Bandaranaike  was a period of great  development making Sri Lanka truly independent taking her out of  the colonial influence.  He was even able to bring in the “leftist parties” into his fold  and begin a march towards progress adopting principles of  socialism.

The UNP government that came into power thereafter was that of JR Jayawardhane.  He did not want a rival political leader awaiting for a chance to recapture  power.  Therefore he took away the civic rights of her rival Mrs.Bandaranaike.

He mismanaged the riots of 1983 resulting in  Indian Intervention. He signed the notorious Lanka India  Pact where India forced his hand to include the 13th Amendment  written by Indians in India into the Constitution of Sri Lanka.  He allowed an Indian Peace Keeping Force into the country  and  merged the North and East to facilitate their surveillance by the IPKF. There was not much of a development  other than catastrophes which marked that period of UNP rule.

The second UNP Government to Succeed was that of Ranasinghe Premadasa.  Premadas’s period is  known for torture camps, where many Sinhala youth were assassinated .  It was also a period where the terrorists instead of being fought against were presented  with arms and ammunitions, and  the assassination of an Army General.  Finally Premadasa himself was assassinated by the terrorists. He started the garment factories, and  built villages under gam udawa. But yet the UNP under his rule as well did not contribute greatly for the development of Sri Lanka.

Then came another UNP Government led by  Ranil Wickramasinghe in 2000. It was a period of appeasement of the terrorists. The then  executive President Chandrika Kumaratunga was pushed behind stage.  Ranil Wickramasinghe the Prime Minister  acting as it pleased him. He signed  a CFA (prepared by Solheim and Praphakaran) ,  with Prabhakaran the terrorist leader.

Ranil Wickramasinghe  started negations with the terrorists and kept the Sri Lanka Armed Forces confined to the Barracks.   That was   a dark period of the parliamentary history of  Sri Lanka.  Finally the President Chandrika Kumaratunga  took courage to stop him by taking over his Ministry. If he would not have been stopped then, he would have surely consented to declare that North is a Tamil Eelam State for Prabhakaran.

Rauf Hakeem- the President  Chandrika   without a majority to function, thus forcing her to dissolve the Parliament. After Chandrika’s not too glorious rein Sri Lanka was fortunate to have a change in President Mahinda Rajapakse, who had to start afresh the unclean “stables” left behind by Chandrika and the Presidents before her.

Some of  the elite,  the educated , some of those who wants to brush with the rich and well to do  moving with the remnants of the pseudo capitalist, and lawyers, readily accept  false allegations against the Rajapakse family despite the fact that they are only hearsay allegations without truth or substance. It is the nouvelle vogue to be with the yahapalanaya, and condemn corruption and  call  for the return of stolen money.

Rajiva Wijesinghe the Minister of Higher Education has said, in his fluent English of which he is pretentious and down grades those who are not as fluent,  “…that government will introduce laws and create. norms that will strengthen the hand of public officials to act independently. “I am personally against witch hunts. While we must take stern action against the corrupt and try to get back the plundered money we should not be vindictive against the weak-minded, We will be spiteful against weak-minded persons.”

Under yahapalanaya,  the mostly suspected for corruption and theft is the former President Mahinda Rajapakse,  thanks to whom they are secure  having no fear of prowling terrorists, to even check at leisure  the containers consisting  his personal belongings….”However the police had today obtained a court order to further inspect the items and to see if anything belongs to Temple Trees and not the former President.  Accordingly the court had issued the order and the Presidential Secretariat is to inspect the items in the container tomorrow.”

How very efficient ?

In the meantime  the President Maitripala Sirisena  remains content  in the warmth of his victory , without seeing, without hearing and without speaking, while there is restlessness and dissatisfaction begining to be heard.

“JVP splinter Frontline Socialist Party has called upon the people to demand from the new government to deliver on the promises it made to the people before the presidential election………Addressing a press conference at the Centre for Society and Religion in Maradana on Saturday, FLSP Politburo member and presidential candidate Duminda Nagamuwa said that if people failed to exert social pressure to get the incumbent government to deliver on its election promises, the voters would soon realize that they had only been able to change the face of Mahinda Rajapaksa with that of Maithripala Sirisena, but there would be no actual change.”

Now beyond corruption they even accuse the Rajapakse family members  for keeping death squads.   They are not bothered with evidence any one can speak out against the Rajapakse family and there will be those goons,  and bath gottas of all sorts –the  legal and the illegal  to take the news to the streets.

And so survives new UNP Government under Maithri Palanaya.

Ranil Wickrmasinghe speaks of  giving autonomy to the Tamil speaking areas.  Is he planning something dangerous to put Sri Lanka once again in danger like the CFA he signed with Prabhakaran?

The Government of Sri Lanka today is like a ship without a Captain.  JVP is extremely active and they are now seen every where.  Vijitha Herath is raking up the mud in search of proof to nail those being accused by goons and “bath gottas”

There is nothing to worry we are today  under a UNP Government. Any thing could be expected whether it is in the interest of the country  or not.  If it is a replay of the Old UNP  one shudders to think  of what JR did to keep away his rival Mrs. Sirimawo Bandaranaike  by denying her civic rights.

But this time if that happens the prize the UNP may have to pay for it may well be different.

    Consider that already:

    1. There are WITCH HUNTS all over Sri Lanka against MR’s supporters in a TRUE REFLECTION of the Maithree Yahapalanaya coming home to ROOST!

    2. Tamil Eelamists are cock-a-hoop in SL and in Tamil Nadu, demanding devolution of land and police powers, and resettlement of fake refugees with land grants in SL.

    3. The US and the UK are already planning to RAMP UP War Crimes Charges against the leaders of the previous UPFA GOSL, and to FORCE the new Government to comply if they prove to be reluctant puppets. I posted a news article on this at LankaWeb.

    Avamangala Samaraweera is calling for War Crimes prosecutions against MR and others already. This is a DIRECT CONSEQUENCE of MS’s victory.

    4. Knowing that China will not offer loans as in the past, the new GOSL is looking for IMF loans. As in the past, IMF loans will come with ONEROUS STRINGS attached that will infringe on Sri Lanka’s sovereignty and territorial integrity! Neither the USA, nor other Western nations have the money to offer large loans (withput strings) like China did. They want to acquire compliant puppets on a shoestring. Sri Lanka will not get 3 billion USD in loans from the USA like Israel does to REPLACE the loans we got from China! No way, Jose’!

    5. India is jumping on the bandwagon, demanding early resolution of the “Tamil Question” to placate Indian Tamils at SL’s expense, while seeking restrictions against future visits by Chinese Naval ships and submarines, and military alliances with China. This is an INFRINGEMENT on Sri Lanka’s sovereignty, to which the MS GOSL will abjectly agree!

    It will take another DECADE for SL to get back on the TRACK OF RAPID PROGRESS that we were on under MR’s GOSL, after the newly elected government supported a consortium of diametrically-opposed anti-national political forces comes CRASHING DOWN under the weight of its own putrifying flesh.

    Remember the DEBACLE of Western engineered REGIME CHANGE in Egypt? Long tiime President Mubarak was toppled by West supported Facebook Democrats, only to REAP the Muslim Brotherhood Govt of Mohammed Morsi hated by the West, and that in turn was toppled in favor of an OUTRIGHT MILITARY DICTATORSHIP under Sisi!

    Western REGIME CHANGE SPONSORS know not what they do, toppling GULLIBLE 3rd world nations from the frying pan into the fire, and LOSING WHAT LITTLE LEVERAGE they had in the beginning!

    So it shall be in Sri Lanka as well: IT IS ONLY A MATTER OF TIME for that HISTORY WILL REPEAT itself in Sri Lanka, despite the best laid plans of Western REGIME CHANGE ARTISTES!

    This will DELAY, or ENTIRELY STOP, Sri Lanka’s EMERGENCE as the New Wonder of Asia!

    However, the OVERWHELMING SUPPORT for the Common Opposition of Minority Voters, Tamils, Muslims and Christians alike, in the recent Presidential Election DEMONSTRATES BEYOND ANY REASONABLE DOUBT that they do not share this unified vision of ONE Nation, and remain arrayed against the Sinhala Buddhist majority of Sri Lanka.

    Even with that OVERWHELMING MINORITY VOTE, the war-winning President Mahinda Rajapaksa, who reunified the nation and ushered in an era of enduring peace and astonishing economic progress to our Motherland, would not have been defeated had the Sinhala Buddhist majority not been MISLED by the SIREN SONG of Corruption and Abuse repeated like a mantra with the support of the Western Colonialists sponsoring a REGIME CHANGE to fit their WORLD HEGEMONIC China Containment Policy.

    That swing vote of the Sinhala Buddhists away from the UPFA GOSL was small, but it was ENOUGH to PRECIPITATE a disaster for the Nation.

    Not all who voted thus will come to grips with the MONUMENTAL STUPIDITY of their FLAWED decision, but they WILL SOON ENOUGH REALIZE THEIR ERROR, as our resplendent Motherland falls away from the path of PROGRESS and National REINTEGRATION it was on, into uncertainty, divisiveness, and economic stagnation.

    The Sinhala Buddhists of Sri Lanka MUST NOW RECOGNIZE that the 5 years that elapsed since the LIBERATION of our Motherland from terror was too little time to INCULCATE a Common Sri Lankan Identity free of Communal Divisions in the Social Fabric of the Nation.

    This is quite normal after an election ever since independance accusing the defeated government of bribery and corruption. Nothing has ever happened I have noticed in the past sixty years. When the bribery and corruption commissioner himself is a corrupt what can we expect from him. Mangala Samaraweera is not a clean politician. Under Rajapakse government this fellow demanded the ministry of Harbour and ports. We are fully aware of his wishy washy deals as the minister in charge. Ravi Karunanayake is not a saint or clean either. He and his mother embeselled the entire state of Lalith Ethulathmudali.When there is a court case pending on foreign exchange fraud, is it proper for Karunanayake to hold the position of Minister of finance. With the yaha palanaya can we see the justice is done. If the fellow does not appear before court on the 29th he must be arrested. Can we see that happen? Karu Jayasuriya is another corrupt up to his eye balls. Can we see this fellow selling the robes of the buddhist monks. Similarly all politicos are corrupt and straight as a scree. Ranil W is somewhat of an honest gentleman but has no backbone. Anura Priyadharshana yapa anothe crook. That down south other Yapa fellow is a bicycle thief. Every mother’s son in politics is a crook So can we expect a yahapalanay withi present regime. I can expect a sincere hard work from RW and MS. That rouge woman is behind the scene with Samaraweera fellow to take revenge from Rajapakses. If they are in the wrong, they should be punished. But I doubt it will ever happen in that soil.

    Stanley: You are absolutely correct. Yet can we allow this to go on and on? NO. There must be some meaningful solution, as otherwise our country will be a”failed state”. How do we do that? I strongly feel that there must be a totally different “CULTURE” introduced to the body politics in the country. First of all “Entry” to the Parliament must be restricted to by imposing minimum educational qualifications; election laws must be amended to “Restrict” expenses in election campaigns and all funds received and expended must be accounted for within a stipulated time frame; if funding and expenses are over the limits, sever penalties must be imposed; all candidates must be required to declare their assets and liabilities and must be available for public scrutiny and such filing must be done on a yearly basis; campaign posters must be restricted to be made to specifications and prohibited display in public places; State property must never, ever be allowed to be used for election campaign; the candidates must be compelled to file a “NO CONVICTION” report from the Police; if during the tenure of office as a member of the Parliament a plaint if filed that person must be made to “STEP DOWN” until the case is determined by courts; a “code of conduct” must be made law and it must be monitored and overseen by an “Independent Body” and for any breach sever penalties, including resignation from the Parliament must be imposed; retirement benefits must be restricted and a minimum of two consecutive entry to the Parliament must be made law; if a member change the party, he/she must be deemed to to be vacated and a fresh election must be held to fill the vacancy….. ; the list can go on and on…….. In short this “BUNCH” of “Peoples’ Representatives” must be in the strictest sense “DISCIPLINED” and made “ACCOUNTABLE”.

    To do all of the above, the FIST thing: the people must be well informed and educated, in which process the “Civil Society” and “Religious “Organizations must get involved in a Resolved manner without looking for “comforts” and “benefits” for such services.

    As a little child I read a book which illustrated the lives of prominent people( in Sinhala) . I remember reading the chapter of SWRD Bandaranaike. His famous quote was “මිනිසාගේ පරම යුතුකම මිනිසාට සේවය කිරීම යි ” ( Man’s utmost duty is to serve the mankind). Most politicians say they are our servants at elections but they arrange to kill those who are troublesome, nowadays. That is how politics has evolved.
    Even though Bandaranaike said that 50 years ago, foolish people treat them as kings and even more foolish worship them Aharants or Gods.

    Our younger generation is well informed already. They will be ready to kick out corrupt bastards regardless of what they did in the past.

    What you have written above is true and sensible. Our politicians are making a mess of our country since 1943 and getting worse. When the head of state associate with criminals and with murderers, where some politicians seems to attend council meeting in hand cuffs says volumes about the country.
    This makes the innocent people in the country un wanted in most counties where getting an visa to travel just a dream and an impossibility.
    I am truly sad for my people who are forever locked in the island as no developed country would accept them even for an emergency. This gives no incentive for the population to better oneself and associate with nations that are developing. This is one angle from which I am looking at the plight of our country.
    Those who are comfortably off in the west have all comforts and freedom but they are willing to deny it our unfortunate people.
    Taking country as a role model UK could be used as a good example for any country to follow,though comfortably off working class who are on the state benefits are the horrible pain in the country, price they pay for political correctness.So use UK as an example.

    Will implement 13th Amendment within a unitary state: Ranil

    Jan 21 (Hindu) The Sri Lankan government will implement the 13th Amendment to its Constitution within a unitary state, Prime Minister Ranil Wickramasinghe has said.

    Implementation of the 13th Amendment — born out of the Indo-Lanka Accord of 1987 — has remained a long-pending demand of the Tamil National Alliance (TNA), the main party representing the island’s Northern Tamils. The Amendment envisages substantive devolution of political powers to the provinces.

    In his first parliamentary address after assuming charge as Prime Minister — following the Sri Lanka’s January 8 presidential elections — Mr. Wickramasinghe said: “We will implement the 13th Amendment within a unitary state.”

    Given that the TNA backed President Sirisena in the elections, the Northern Tamils — who voted against President Rajapaksa in large numbers — would expect the new government to be sensitive to their demands.
    Civilian Governor

    In a gesture that sections perceive as President Maithripala Sirisena’s willingness to engage with the Tamils’ demands, he recently replaced the former Northern Province Governor, a military man, with a seasoned diplomat.

    It is also learnt that orders have been passed to transfer the Chief Secretary of the Province who was on a collision course with Chief Minister C.V. Wigneswaran.

    Mr. Wickramasinghe also outlined the newly-formed government’s plan for the first 100 days. The government would set up independent commissions to run the police, the public service, the judiciary and the elections department, he said.

    The new government had presented its 100-day plan ahead of the elections promising a host of measures, including the abolition of executive presidency, which former President Mahinda Rajapaksa’s critics saw as being a huge impediment to democracy during his two terms. Mr. Wickramasinghe, appointed Prime Minister by President Sirisena, said the new government would also pass a Right to Information Act.
    Rajapaksa’s home raided

    Meanwhile Sri Lanka’s former President Mahinda Rajapaksa on Tuesday asked the new government to stop “revenge”, a day after police raided his country-side home in the southern district of Hambantota.

    “Our family has been in politics since 1931. But never our homes came to be searched. I ask them to stop this political revenge,” local media quoted Mr. Rajapaksa as saying. The police were reportedly looking for a Lamborghini sports car and launched a raid following a court warrant, but the search drew a blank.

    Police withdraw accusations against floating armoury

    The floating armoury MV Mahanuwara detained on Sunday at the Galle Harbour was performing a bonafide operation with Ministry of Defence clearance, but they were trying to ascertain whether all the arms and ammunition found in the vessel were legal and if it contained arms exceeding the amount mentioned in the permit issued to the private company handling the operation, Police Spokesman Ajith Rohana said on Monday.

    At a hurriedly summoned press conference, SSP Ajith Rohana said that there were 3,154 automatic and semi-automatic weapons and 747,000 rounds of ammunition on the floating armoury according to the permit issued by the MoD.

    “This operation had been going for some time handled by the navy and since September 18, 2012 the job had been handed over to a private company with MoD approval, but yet the security for the operation is provided by the Navy,” he said.

    Jan 22, Colombo: The Sri Lankan government under the recommendation of the National Executive Council will appoint a committee to probe large scale corruptions occurred during the tenure of the previous government.

    Cabinet spokesman and Minister of Health and Indigenous Medicine Dr. Rajitha Senaratne told media at a press briefing Thursday that the cabinet approved the recommendation submitted to form the Anti-Corruption Committee.

    The Committee will be headed by Prime Minister Ranil Wickremasinghe and comprises Ministers Mangala Samaraweera, Patali Champika Ranawaka, and Rauff Hakeem, parliamentarians Anura Kumara Dissanayake, R. Sampanthan, M. A. Sumanthiran and Democratic Party Leader Sarath Fonseka along with President’s Counsel Dr. Jayampathy Wickramaratne, J. C. Weliamuna and Malik Samarawickrema.

    Cabinet approval has also been granted to set up an Urgent Response Committee with MP Anura Kumara Dissanayake as the Coordinator. This committee consists with public officials, police officers, lawyers, financial specialists and officials of the Criminal Investigation Department (CID).

    According to a report in national radio, Minister Rajitha Senaratne has disclosed that a decision was taken to appoint suitable officials at required times through the prevailing established institutional framework and to adopt the short term and long term actions that can be taken by those institutions.

    Proposed Short Term Actions include, looking into the items that have been brought for distribution during the Presidential Election period and now being kept in stores, illegal acquisition of lands, and movable and immovable properties, corruption and irregularities at the Employees Provident Fund, and Colombo Stock Exchange and divulge about them, the assets and liabilities of those involved in suspected large scale frauds and taking appropriate action against such acts.

    The long term actions are included of taking action to acquire funds relating to fraudulently carried out financial dealings outside the country and to punish those responsible for such dealings, introduction of a more powerful Bribery or Corruption Commission, establishment of a National Procurement Commission and obtaining approval for all projects through this Commission, Introduction of the National Audit Act and Implementation of the UN Anti-Corruption Covenant for which Sri Lanka is a signatory.

    The cabinet has been enlightened on the necessity to set up a specially qualified team to investigate into irregularities that are taking place in the financial sector.

    The Prime Minister informed the Cabinet that already experts of the Financial Intelligence Unit functioning under the Central Bank of India and experts in this field from the financial institutions including the World Bank and the International Monetary Fund have agreed to provide assistance in this connection.

    Cabinet has granted approval to appoint a committee to formulate draft legislation to expeditiously introduce an Act with wide allocations to make it compulsory to divulge the sources of hitherto undeclared wealth.

    Minister Wijedasa Rajapaksa has been named as the Chairman of this committee. Ministers Patali Champika Ranawaka, Mangala Samaraweera and Rauf Hakeem are the other members.

    The Ministers were also requested to submit reports on corruption and malpractices that had taken under each and every Ministry to the office of the Prime Minister as early as possible.

    “Tamilnet” Reveals Ten Point Accord for Regime Change and Executive Presidency abolition reached in 2013 at Meeting in Singapore Involving Mangala Samaraweera

    The “Tamilnet”website long regarded as the mouthpiece of the Liberation Tigers of Tamil Eelam(LTTE)organization has in a news report revealed details of an alleged “understanding”involving among others the current Foreign Affairs minister Mangala Samaraweera and Tamil National Alliance(TNA)national list parliamentarian MA Sumanthiran that was arrived at in Singapore in the year 2013.

    The “Tamilnet” website claims that the understanding reached in 2013 formulated a conceptual framework on abolishing the executive presidency based on ten basic principles described as the “Singapore principles”. The news report further states that current Presidential adviser Dr.Jayampathy Wickramaratne, Colombo University Law professor VT Thamilmaran and unnamed representatives of the Global Tamil Forum(GTF)along with a lawyer from the Sri Lanka Muslim Congress also participated in the conclave.

    The conference was organized by South Africa and funded by two European countries alleges the “Tamilnet”.

    Right from the Indo-Lanka agreement of 1987 to Oslo Declaration of 2002 and to hitherto unrevealed Singapore Principles of 2013 that brought the Sampanthan polity into a conceptual framework for the recent regime change in Colombo, the external forces seeking to influence the affairs of the island have taken the Eezham Tamils for a ride to confine the Tamil polity into the unitary State of genocidal Sri Lanka without securing any concrete and descriptive guarantee from the Sinhala polity. By its latest move, the ITAK has pushed the Tamils back into the past, Tamil political observers in Jaffna said citing the so-called Singapore Principles from 2013. TamilNet brings out the text of the so-called Singapore Principles for the edification of global Tamils.

    All the clauses of the so-called Singapore principles are non-descriptive with regards to a principled approach in resolving the national question.

    Mr M.A. Sumanthiran, the non-elected national list ITAK parliamentarian and Mr V.T. Thamilmaran, the dean of the Faculty of Law at the University of Colombo were the Tamil representatives from the island while representatives of the so-called Global Tamil Forum (GTF) were representing the Diaspora Tamils at a meeting in Singapore in 2013 when Dr Jayampathy Wickramaratne came with his proposal points to agree upon a conceptual framework aimed at regime change, the removal of Executive Presidency and other arrangements targeting good governance. Dr Jayampathy Wickramaratne was an adviser to Sri Lanka’s past two Presidents.

    “Mangala Samaraweera came as a ‘beggar’ urging Tamil support for regime change and abolition of the executive presidency. It was 2013,” said one of the participants, reflecting on the Singapore meeting.

    When Tamil aspirations came for discussion, M.A. Sumanthiran wanted to avoid the mentioning of terms such as Nation and Right to Self Determination in the document.

    Only the voice of a human rights defender, a Sinhalese, representing the civil society, was in favour of a formula based on the recognition of nationhood to Tamil people with their traditional homeland in the North-East.

    V.T. Thamilmaran, who was once respected for his principles on Tamil sovereignty, was silent and was talking only about good governance.

    Tamil aspirations went missing in the proposal. Instead, the document was drafted with the intention of being non-descript. But, a consensus was achieved on winning Tamil voters through the TNA for the regime change.

    A lawyer from Sri Lanka Muslim Congress was also represented at the meeting apart from several other representatives.

    The meeting was organised by South Africa and was funded by two European countries.

    The directors of South African ‘In Transformation Initiative’ Roelf Meyer, Ivor Jenkins and Mohammed Bhabha organised the meeting.

    Ironically, the ‘approach’ of the South African outfit, according to its website is “premised on the philosophy that any solution to differences or even conflict must be designed, must evolve, and must be developed and settled domestically; solutions cannot be prescribed from external actors.”

    The ‘Singapore principles’ was giving secondary status to religions other than the Buddhism.

    The 10-points agreed between the Sampanthan polity and the regime changers including the new SL Foreign Minister, Mangala Samaraweera, at Singapore in 2013 follow:

    Singapore Principles

    1. In describing the nature of the State what is important is the substance; the labels are secondary.

    2. The Constitution shall be based on basic constitutional principles and values including sovereignty of the people, participatory democracy and supremacy of the Constitution which shall form an unalterable basic structure.

    3. Power sharing shall be on the basis of self-rule and shared-rule within an undivided Sri Lanka.

    4. The Executive Presidency shall be abolished and the form of government shall be Parliamentary.

    5. The pluralist character of Sri Lankan society as well as identities and aspirations of the constituent peoples of Sri Lanka shall be constitutionally recognised.

    6. There shall be a strong and enforceable Bill of Rights consistent with universally accepted norms and standards.

    7. There shall be a separation of powers and an independence of judiciary which includes a Constitutional Court.

    8. Important institutions shall be independent and accountable. Appointments to these and High Posts shall be through a transparent mechanism that provides for a national consensus, example Constitutional Council.

    9. Institutions of the State shall reflect the pluralist character of Sri Lankan society.

    10. The Republic of Sri Lanka shall be a secular state. The Foremost place to Buddhism and equal status to other religions shall be assured.

    The controversial paragraph of the so-called Oslo Declaration of December 2002 follows:
    Responding to a proposal by the leadership of the LTTE, the parties agreed to explore a solution founded on the principle of internal self-determination in areas of historical habitation of the Tamil-speaking peoples, based on a federal structure within a united Sri Lanka. The parties acknowledged that the solution has to be acceptable to all communities. [Related story with full text]

    On 11 November 2011, Mr Erik Solheim was claiming that it was the UNP politician Mr Milinda Moragoda and himself, who were behind the drafting of what he termed as ‘Oslo Declaration’ in December 2002, which was signed by Mr Ranil Wickramasinge on behalf of the Government of Sri Lanka (GoSL) and by Mr Anton Balasingham on behalf of the Liberation Tigers of Tamil Eelam (LTTE).

    “It was Milinda and myself who wrote that document at the […] restaurant here in Oslo and Balasingham accepted it and he took it to Prabhakaran and Prabhakaran refused. It was not public at that time, but it was clear he was furious because he was reluctant to federalism,” Solheim said during the evaluation of the Norwegian Peace Process [Video evidence].

    Mr Balasingam has recorded his version of the narrative on the subject in his book, “War and Peace: Armed Struggle and Peace Efforts of Liberation Tigers”: “[I]t must be stated that there was not any specific proclamation titled ‘Oslo Declaration’. The decision to explore federalism was included in the record of decisions at the Oslo talks and signed by the chief negotiators of both delegations and the head of the Norwegian facilitating team.” (page 403)

    He further explains LTTE leader’s position that Tamils were prepared to consider favourably a political framework that offers substantial regional autonomy and self-government from the part of the Sinhala side.

    But, failing the delivery of regional self-rule, the position of the LTTE leadership was that the Tamils have no alternative other than evoking the external right to self-determination. In an implied sense, Balasingham explains the objection by the LTTE leader to the exact phrasing of the paragraph in the so-called Oslo Declaration.

    It was after the LTTE submitting the ISGA framework, which stressed the external dimension of the right to self-determination in its preamble and after the publishing of the War and Peace book questioning the ‘Olso Declaration,’ Mr Balasingham was brought back into the negotiations as chief negotiator by the LTTE leadership in 2006 during the Norway facilitated talks between Mahinda Rajapaksa’s GoSL and the LTTE.

    While there was a leadership committed to principled political foundations, the Tamil polity had internal mechanisms to address the external manoeuvrings that sought the Tamils to abandon their principles.

    But, now, the Tamil polity claiming to represent the Eezham Tamils in the homeland has no such fundamental principles or mechanisms.

    The Tamil polity could be course-corrected and brought back to track only through the edification of the masses.

    Lanka reaches consensus to implement 13A: Wickremesinghe

    Colombo: Sri Lankan Prime Minister Ranil Wickremesinghe on Saturday said political parties have agreed to implement the thirteenth amendment as a solution to end the country’s over three-decade-old ethnic conflict involving the Tamil minority.

    “All parties have agreed to solve the ethnic problem within the framework of the thirteenth amendment. We are continuing our talks,” Wickremesinghe said while addressing a gathering at Deniyaya in the south.

    He further said that all provincial councils will have equal powers now that the Tamil National Alliance has said that they are for a solution within an undivided Sri Lanka.

    Provincial Councils became part of the Sri Lankan statute as a direct result of the landmark 1987 Indo-Sri Lanka accord, popularly known as the Rajiv-Jayewardene Accord, after its architects ? Indian Prime Minister Rajiv Gandhi and Lankan President J R Jayewardene.

    He also blamed the former President Mahinda Rajapaksa for failing to resolve the thorny issues concerning the Tamil minority despite having ended the two-and-a-half decade-old civil war with the LTTE in 2009.

    On the UN’s human rights investigation on Sri Lanka, Wickremesinghe said it was the result of Rajapaksa’s mishandling of the issue.

    “They (the Rajapaksa government) agreed with the UN Secretary General to have an investigation after the war ended. Later confirmed it at the UN Human Rights Council. But the investigation did not happen, so came the appointment of an investigation panel,” Wickremesinghe said, referring to the March 2014 UNHRC resolution on Sri Lanka.

    Rajapaksa government had resisted to cooperate with the investigation meant to probe the human rights abuses by both the LTTE and the government during the final days of the battle in May 2009.

    Wickremesinghe said the new government’s policy on the investigation is that all criminal charges will be probed through a local mechanism.

    “Only Sri Lankan courts will have jurisdiction for criminal investigations,” Wickremesinghe said.

    The new Maithripala Sirisena government which succeeded Rajapaksa rule was urged by a section of the international community to cooperate with the UNHRC investigation and resolve the issues concerning the country’s minorities.

    Sri Lanka PM to decide whether to continue port city project with China

    Jan 24, Colombo: Sri Lanka’s Prime Minister Ranil Wickremesinghe said that a final decision will be taken within the next two weeks on whether to continue the Colombo Port City Project launched by the previous government in partnership with China.

    Mr. Wickremesinghe earlier said the government is reviewing the Colombo Port City project launched during Chinese President Xi Jinping’s visit to Sri Lanka last year.

    The government has not yet seen the reports of feasibility study and the environment impact assessment, he said.

    “We will have to look into the environmental and feasibility aspects,” Mr. Wickremasinghe said.

    The Prime Minister’s Office said that 3 reports called for by the PM have been received so far. The Ports Authority, Board of Investment (BOI) and Coast Conservation Department have submitted reports but the Central Environmental Authority has not submitted a report as their views were not obtained at the time the project was launched.

    During his visit to Sri Lanka in September 2014, President Xi and former President Mahinda Rajapaksa launched the US$ 1.5 billion Colombo Port City Project to build a modern city on land reclaimed from the sea.

    Construction of the port city was to be carried out by China Harbour Engineering Company under a Memorandum of Understanding signed by Sri Lanka Ports Authority with China Communication Construction Company (CCCC).

    Concerns have also been raised on the agreement since under the deal signed with the CCCC, the company is getting land on a freehold basis in a high security zone.

    The proposed city will be built on 233 hectares (583 acres) of land reclaimed from the sea between the Colombo South Port and the Galle Face Green and under the agreement 20 hectares of land will be given to the Chinese firm on an outright basis.

    Sri Lanka’s new Investment Promotion Minister Kabir Hashim said the land in a high security zone cannot be given to another country and project needs to be completely reviewed.

    Sri Lanka’s neighbor, India has also raised security concerns over the project as a large portion of cargoes bound for India are transshipped through Colombo port.

    CJ 44 won’t go; Govt and BASL losing patience

    Peiris’ security pruned, lawyers to hold special meeting Chief Justice 44 Mohan Peiris is refusing to relinquish office and now demanding a plum diplomatic posting in return for vacating his post despite a demand by the country’s lawyers that he step down.

    His choice is either as Ambassador to the UN in New York or as High Commissioner in London, but Prime Minister Ranil Wickremesinghe has offered him Brazil, a National Unity Government source said yesterday.

    “We are losing our patience. By deliberately delaying he is precipitating a serious situation that could hurt him the most”, the source added.

    The development over the week came as Public Order Minister John Amaratunga told the Sunday Times he had ordered the pruning of the Chief Justice’s security detail from ten police officers to two.

    “This is in accordance with his entitlement,” Minister Amaratunga said.

    On Friday, Mr. Peiris was questioned by detectives of the Criminal Investigation Department (CID) over his presence at Temple Trees around 4 a.m. on January 9 when Presidential election results were being released by the Elections Commissioner. The National Unity Government maintains that there was an attempt at suspending the count and that the Chief Justice was providing legal advice to the then President Mahinda Rajapaksa.

    The Bar Association of Sri Lanka (BASL) has called for the Chief Justice’s resignation on the grounds that he has failed to maintain his impartiality as required by the Constitution by his pre-dawn presence at ‘Temple Trees’.

    Justice Minister Wijeyadasa Rajapaskshe told the Sunday Times the Chief Justice had agreed to resign to three separate audiences. He was present at all three, he said.

    “He agreed three times, once in the presence of the President and myself, secondly when the Premier and I discussed the matter with him, and thirdly when all three of us were present. He was negotiating with us for a diplomatic posting, and we finally agreed on Rome,” Mr. Rajapakshe said.

    According to him, Mr. Peiris was expected to submit his resignation letter as Chief Justice and collect the appointment letter for his new posting last Wednesday evening. Although Mr. Peiris had come while the cabinet meeting was being held, no resignation was tendered or the appointment letter collected, Mr. Rajapakshe said.

    “He later called the Presidential Secretary for an appointment and was scheduled to meet the President on Thursday at 8.30 a.m. at the Presidential Secretariat. But he did not turn up. We were waiting till 9.45 a.m. No further communication has been received from the Chief Justice since then,” he said.

    During the week, Cabinet spokesman and Minister Rajitha Senaratne announced that the Chief Justice had told the Prime Minister he would resign but did not mention anything about being offered a diplomatic posting. The next day, a person claiming to be a spokesman for the Chief Justice, a Ratnapura lawyer, Wijeratne Kodippili denied that Mr. Peiris had offered his resignation.

    Commenting on that incident, Minister Rajapakshe said that the Chief Justice had never been allocated a spokesman, nor had the recruitment of such personnel been approved by anyone. According to the Minister, the Government knows nothing about the person who issued a statement on behalf of the Chief Justice.

    “We don’t even know if he is a Sri Lankan or not,” he said.

    The BASL’s Executive Committee met again last afternoon and decided to summon the association’s 500 strong council members for a special meeting next Saturday to discuss the deadlock. The BASL Ex Co, the governing body of the country’s lawyers, will also meet the Bar seniors today and request an appointment with the President and Prime Minister next week, BASL President Upul Jayasuriya said.

    He said the Chief Justice was contacting junior lawyers and seeking their support to sign a petition in support of him.

    “The questioning of the Chief Justice by the CID — in his chambers — is the worst insult the country’s judiciary has faced in its more than 200-year history. The CJ 44 has now resorted to canvassing, lobbying and applying pressure on junior lawyers. This is unheard of. We will discuss the possible courses of actions when the council meets,” Mr. Jayasuriya said.On Friday, when the Sunday Times contacted Mr. Kodippili and asked him what the Chief Justice had to say about his presence at ‘Temple Trees’ on the night the Presidential election results were being released, he said he was not authorised by the Chief Justice to speak on that matter.
