UPFA MP Namal Rajapaksa said the Supreme Court’s interim order on the dissolution of parliament was not the Court’s final decision.

In a tweet he said he had never seen politicians get ‘so excited’ over postponing of elections.

The UNP has a history of postponing polls but eventually voters will decide,” he said.

This Supreme Court Decision by (ONLY) THREE Supreme Court Judges is an INTERIM (TEMPORARY) INJUNCTION to halt ALL POLITICAL ACTIVITY related to the DISSOLUTION of Parliament and the HOLDING of NEW Parliamentary ELECTIONS.

Here are my thoughts on the IMPACT of this ORDER, and the REMEDIES available to the New Govt.

The TEMPORARY INJUNCTION APPLIES TO ALL PARTIES to the DISPUTE; not only the Govt.

THEREFORE, the Govt cannot PROCEED with the NEW ELECTIONS, the Parliament is TEMPORARILY NOT-DISSOLVED, and it CANNOT RESUME SESSIONS either!

RESUMING SESSIONS would be TANTAMOUNT to VIOLATING the TEMPORARY INJUNCTION issued by the Supreme Court!

In particular, as he has threatened to do, the Speaker Karu Jayasuriya cannot organize a VOTE COUNT to show who has the Parliamentary majority, without FLOUTING the TEMPORARY INJUNCTION himself. Besides, only the President can CONVENE and CLOSE the Parliament; NOT the Speaker!

Also, the Govt will APPEAL the Supreme Court Decision, in particular the LIFTING of the TEMPORARY INJUNCTION issued by the 3 judges.

Furthermore, they are likely to also ask for a decision by the FULL Supreme Court comprising 11 judges in case they suspect that the 3 judge panel is BIASED!

Finally, as Neville points out, in our Presidential Democracy, the FINAL EXECUTIVE Power lies with the President, NOT the Supreme Court. While no President likes to IGNORE an order of the Supreme Court, he CAN & DOES SO in certain National Emergencies like the PRESENT ONE.

These talks and comments are good for us to cheat ourselves and be happy for the moment. Reality is MR made a big mistake by joining with the puppet / joker. Otherwise he could have won the next general election by a 2/3 majority. No doubt, he will win the next election, but with a narrow margin.

Agree with Lionel. This must be another Indian job.
Mahinda lost credibility immensely by this foolish act. Surely he lost 1/2 million votes ! Except his enslaved supporters, people in the middle will never vote him again.

You can’t govern a country by upsetting the whole world in 2018. There is a truth to what whole world is saying.
Sirisena sacking of Ranil is alright, but he could have asked the house to select a new leader and by doing so he could have done a great service to the country.

Mahinda could have easily won by waiting till end of UNP term, which was getting unpopular day by day.
Instead, advised probably by India ( and his surrounding goons), he has eaten the Lanuwa big time.
Even the LTTEer who joined him fled back to Ranil’s lap where he belongs!
Even Wije-Dasa ( the man who siad Sir Lanka is not a Sinhala Buddhist country) is now waiting for Ranil’s invitation.
I won’t be surprised if Sirisena too marry Ranil again !
