The 20th amendment

These clear and distinct provisions illustrate that the sovereignty of the People were to be exercised by separate and distinct organs of government namely, the Legislature and the Executive, both elected by the People. What the 20th Amendment hopes to achieve is to eliminate one of the distinct and separate organs of government elected by them to exercise their executive powers. What this amounts to is an assault on the sovereignty of the People and this has nothing to do with whether Article 4 is included in the list of Article 83 as an entrenched Article.

The JVP has presented to Parliament the 20th Amendment to the Constitution under provisions of a Private Member’s Bill. The primary objective of the 20th Amendment is to abolish the Office of an Executive President being elected by the People as stated in Article 4(b) of the 1978 Constitution. It is reported that several petitions have already being filed in the Supreme Court.

The ongoing debate is whether the 20th Amendment would require ONLY a 2/3 majority in Parliament for the amendment to become law, or whether it would require a 2/3 majority in Parliament as well as approval by the People at a referendum for it to become law. Another angle to the debate is whether some provisions in the 20th Amendment would require a 2/3 approval by Parliament as well as an approval by the People at a referendum, while other provisions would require ONLY a 2/3 approval by Parliament. The pertinent question in such an eventuality is whether the Constitution permits provisions in a Bill to be subjected to different standards, or whether the entire amendment should be subjected to one standard as in Article 120 wherein the ONLY determination for the Court is whether a Referendum is needed or not. .

Article 120 (a) states:

“In the case of a Bill described in its long title as being for the amendment of any provision of the Constitution, or for the repeal and replacement of the Constitution, the only question which the Supreme Court may determine is whether such Bill requires approval by the People at a referendum by virtue of the provisions of Article 83”.

The fact that the ONLY question that needs to be determined by the Supreme Court is whether a Bill to amend any provision in the Constitution requires approval by the People at a referendum was made crystal clear by Ranasinghe. J, during the petition filed against the 13th Amendment to the Constitution. Having stated that “The provisions of Clauses 154 G (2) (b) and (3) (b) of the Bill to amend the Constitution of Sri Lanka…require approval by the People at a Referendum by virtue of the provisions of Article 83” he went on to state:

“There is just one other matter to be referred to. Article 123 (2) of the Constitution provides that, where this Court ‘determines that a Bill or any provision thereof is inconsistent with the Constitution’, this Court ‘may’ also ‘specify the nature of the amendments which would make the Bill or such provision cease to be inconsistent’. I have considered whether such a statement should be made. In view, however, of the fact that the Reference requires the Court only to state whether a Referendum is required, the fact that it was also submitted at the hearing that the only jurisdiction the Court exercises in these proceedings is to determine, in terms of Proviso (a) of Article 120 of the Constitution, whether the Bill referred to requires the approval by the people at a Referendum…”

Having stated that in the case of an amendment to the Constitution, the ONLY determination for the Court is to determine whether a referendum is needed or not, Ranasinghe. J goes on to identify the particular provisions that require a referendum. Whether such incursions into constitution making amount to judicial transgressions into the domain of the Legislature as called for under separation of powers or not, the fact remains that the provisions of Article 120 have been violated. The hope is that petitions against the 20th Amendment would be addressed by the Court in strict conformance of the provisions of Article 120 and not compromised by provisions of Article 123.

ABOLISHING the EXECUTIVE PRESIDENCY

Perhaps, the expectation of the JVP when they presented the 20th Amendment was that Court would rule that a referendum would not be needed. Such assurances would obviously be based on expert legal opinion. Such opinions rely on the fact that Article 4 is not listed in Article 83 as an entrenched Article requiring a special majority of 2/3 approval of Parliament and an approval by the People at a referendum. This is a simplistic and mechanical approach which ignores the very foundations of the separation of powers on which the Constitution is based.

When the sovereign People of Sri Lanka accepted the 1978 Constitution they accepted the principle of separation of Legislative, Executive and Judicial powers. This concept is embodied in Article 3 that state:

“In the Republic of Sri Lanka sovereignty is in the People and is inalienable. Sovereignty includes the powers of government, fundamental rights and the franchise”.

Article 4 starts by stating: “The sovereignty of the People shall be exercised and enjoyed in the following manner”:

And 4 (a) states: “the legislative powers of the People shall be exercised by Parliament…” and 4(b) states: “the executive power of the People …shall be exercised by the President of the Republic elected by the People”.

What the 20th Amendment hopes to achieve is to eliminate one of the distinct and separate organs of government elected by them to exercise their executive powers. What this amounts to is an assault on the sovereignty of the People and this has nothing to do with whether Article 4 is included in the list of Article 83 as an entrenched Article.

As a matter of historical interest, the former Chief Justice, Sharvananda, C.J. in his determination during the hearing of the 13th Amendment stated:

“The Bill for the repeal and replacement of the 1972 Constitution included Article 4in the category of entrenched Articles. However when the Bill was passed, Parliament omitted Article 4 from the list of entrenched provisions”. This statement is incorrect because a reference to the Hansard of the day reveals that it was included with the rest in Article 83. What we see today is a sleight of hand by those responsible for the edited version.

Be that as it may, the issue at hand is that what is being attempted by the 20th Amendment is that it impacts on the sovereignty of the People because their expectation was that an Executive directly elected by them would be responsible for exercising their executive powers while their elected representatives in Parliament would exercise their Legislative powers. What is being attempted by the 20th Amendment is to transfer such powers to an individual to be elected by Parliament thereby impinging on the sovereignty of the People to elect their President.

Continuing, the former C.J. stated:

“Similarly, an amendment to Article 4 (b) can be enacted by providing for the exercise of the executive powers of the People by a President and a Vice President elected by the People. However, to the extent that a principle contained in Article 4 is contained or is a necessary corollary or concomitant of Article 3, a constitutional amendment inconsistent with such principle will require a Referendum in terms of Article 83, not because Article 4 is entrenched, but because it may impinge on Article 3. In our view, Article 4 is not independently entrenched but can be amended by a two third majority, since it is complementary to Article 3, provided such amendment does not impinge on Article 3”.

The fact that Article 4 is complementary to Article 3 was recognized by Court during the 19th Amendment to the Constitution when it stated:

“…the Court in the Nineteenth Amendment Determination came to the conclusion that the transfer, relinquishment or removal of power attributed to one organ of government to another organ or body would be inconsistent with Article 3 read with Article 4…Though Article 4 provides the form and manner of exercise of the sovereignty of the people the ultimate act of decision of his executive functions must be retained by the President”.

CONCLUSION

The 20th Amendment is an attempt for a President to exercise executive powers of the People together with “…the Cabinet of Ministers as provided for in the Constitution” as per Article 4 (i) in the amendment. This provision impacts on the sovereignty of the People because as stated in the determination relating to the 19th Amendment “So long as the President remains the Head of the Executive, the exercise of his powers remain supreme or sovereign in the executive field…”. The attempt by the amendment for the President to share executive powers with the Cabinet of Ministers would be to dilute the exclusive executive powers the People expected the President to exercise on their behalf. Such an amendment has to require the approval of the People at a referendum.

The 20th Amendment also attempts for Parliament to elect the President as per Article 30 (ii) of the amendment instead of by the People as in Article 30 (2) of the 19th Amendment. This amendment too impacts on the sovereignty of the People because it denies the opportunity for the People to elect a President of their choice. This would be a serious dilution of the sovereignty of the People for which the consent of the People would be required through a referendum.

These two amendments alone would require the approval by the People at a referendum because they both impact on the sovereignty of the People and the Courts have ruled (cited above) that whenever such instances occur it is imperative that a referendum is held. There may be other amendments in the 20th Amendment Bill that may not meet the threshold to require a referendum. This means that they could be passed by a 2/3 majority. However, Article 120 very specifically does not make such distinctions. What it states instead is “whether such Bill requires approval by the people at a Referendum”, meaning that if only certain amendments require a referendum the entire Bill should be subjected to a referendum.

This principle was violated by Ranasinghe. J. when he identified which provisions required a referendum, and which did not. A similar approach was adopted during the determinations relating to the 19th Amendment. Such practices amount to the Judiciary participating in constitution making; a task the Judiciary is not expected to undertake under separation of powers. Instead it is the responsibility of the Attorney General’s Dept. to advise the government which provisions in a Bill require a referendum and which do not. Expecting the Judiciary to fulfill such a function is a dereliction of duty. The expectation of the People is that the Courts would abide strictly by the provisions of the Constitution, particularly in respect of compliance with Article 120, and not drift into fields assigned to ordinary Bills that come under provisions of Article 123.

The material presented above addresses the constitutional aspects of the 20th Amendment. However, the political implications of abolishing the Executive Presidency would inevitably lead to political instability because both Legislative and Executive aspects of the sovereignty of the People would be addressed by elected Members of Parliament. Since electoral practices both current and what is proposed are not likely to return stable majority governments, it would be foolhardy to abolish the Executive branch which by its very nature of being elected by the People has the potential to be stable.

House calls for arrest of DIG Alleged plot to kill Prez, Gota:

UPFA MPs, yesterday, demanded that DIG Nalaka Silva be arrested over an alleged plot to assassinate President Maithripala Sirisena and former Defence Secretary Gotabhaya Rajapaksa.

Provincial Councils and Local Government Deputy Minister Sriyani Wijewickrama called for the arrest of DIG Silva, sacking of incumbent IGP and conducting investigations into the alleged plot under a new IGP.

MEP leader Dinesh Gunawardena said that the entire country was shocked by the recent revelation of a plot to assassinated the President and the former Defence Secretary. “There is a serious allegation that the DIG was planning to secure the support of the underworld to kill the President and the former defence secretary. There are audio tapes of the conspiracy being circulated. The security authorities are very slow in conducting investigations into the conspiracy. Other countries must have been shocked to hear that police of this country were working hand in glove with underworld to carry out political assassinations. The President had promised media that there would be an investigation. We want to know whether the government will take action against the senior police officers concerned. If the president was assassinated, then the Prime Minister would the President as per the constitutional provisions. This is a serious situation.

Leader of the House Public Enterprise Development Minister Lakshman Kiriella: This statement is inimical to the investigations in progress. This is an attempt to interfere in the investigation. I am a lawyer. I understand the danger this statement can inflict on the investigations.

Law and Order Minister Ranjith Maddumabandara:  Namal Kumara, addressing a press conference, alleged that he had audio tapes of DIG Nalaka Silva speaking of killing the President. The matter was reported to the Fort Magistrate. Court orders have been obtained to secure the video and audio records from media organisations of the event Namal Kumara making those allegations. The CID has obtained the mobile phone Namal Kumara had used to record the alleged conversations. DIG Nalaka Silva has been transferred from the Terrorist Investigations Division to the Information Technology Division of the police to facilitate investigations.

NFF leader Wimal Weerawansa: This issue raises many questions. Namal Kumara has stated that there was a link between police and the underworld in perpetuating crimes during the Sinhala-Muslim riots in Digana and Kandy. There are many other accusations of serious nature. The DIG should be arrested. We cannot believe that these investigations will be impartial.

Minister Madduma Bandara: We are conducting investigations. We have to consider the evidence. There will be actions on the basis of findings of investigations.

MP Dullas Alhapperuma: This plot has been hatched by the head of the Terrorist Investigations Division. The Government media does not publish anything of this incident. This is the worst ever accusation against the Police Department in its 152 year history.

Minister Madduma Bandara: The President is the first citizen of this country. We have provided necessary security to him. The other person alleged to have been under threat is not a citizen of this country, but we are ready to provide security to him.

MP Vasudeva Nanayakkara: We cannot ensure an impartial investigation under the incumbent IGP. The IGP has taken DIG Nalaka Silva to the Kelaniya temple for a Bodhi pooja to invoke blessings on the latter several minutes ago. That has been reported on news websites.

The Speaker: The Minister could look into that.

Minister Madduma Bandara: I do not know of Bodhi poojas. You can ask the Buddha Sasana minister about  that.

UPFA MP Shehan Semasinghe: The DIG concerned has been transferred to the Information Technology Division. The IT Division plays a vital role in providing evidence to this investigation. Now the DIG could meddle with evidence.

UPFA MP Kanaka Herath: One of the sniper guns of the TID went missing last week. We have serious doubts about what happened to that gun and for what purpose it would be used.

Minister Madduma Bandara: If you submit that question in writing to me, I can ask for an investigation.

MP Mahindananda Aluthgamage: Namal Kumara should be given police protection. There are plans to send him abroad. We think that he will be sent abroad so that there will be no investigation.

Minister Madduma Bandara: If he asks for security we are ready to give him security.

MP Kanchana Wijesekera: The DIG should be produced before courts and his passport should be impounded.

Minister Madduma Bandara: We will inform the relevant authorities to do so.

UPFA MP Sisira Jayakody: MP Dinesh Gunawardena directed this question to the Prime Minister. The Prime Minister is there in the chamber. He will always find time to answer other questions. But he is silent today.

Prime Minister Ranil Wickremesinghe: When there is an investigation in progress, we cannot reveal everything jeopardising it. We are happy that you are very concerned of the safety and wellbeing of the President. But it was you who removed his security when he was the presidential candidate. Did you have the same concerns then?  Our security forces are ready to provide security to Gotabhaya Rajapaksa if he has any threats. I know that there are crises in that party. Under such situation he may need security. You started this issue from the President and now you are talking of IGP. If the IGP is not suitable for the post, you can raise that issue.

Provincial Councils and Local Government Deputy Minister Sriyani Wijewickrama: This is a serious issue. The DIG should be interdicted and arrested if the investigations are to continue without his influence. The IGP should be removed and a new one should be appointed to ensure impartial investigations.

Speaker Jayasuriya:  As soon as this was reported to me I discussed the matter with relevant authorities. I summoned the IGP yesterday and discussed the issue with him. I, too, have a responsibility to ensure the security, safety and wellbeing of the President and Gotabhaya Rajapaksa.

State Minister Sriyani Abeywickrame said yesterday TID’s DIG Nalaka Silva should be interdicted and arrested immediately over the alleged plot to kill President Maithripala Sirisena and former Defense Secretary Gotabhaya Rajapaksa.

She told parliament that it was a serious matter and added that when there was an allegation involving criminal activity, what was done first was to interdict and arrest the person.

She said they as government members, were not satisfied with the conduct of IGP Pujith Jayasundara.

“We request that the IGP be removed and investigations initiated under a new IGP,” she said.

ඒ වගේම ආණ්ඩුව මුහුණ දෙන ගැටලුවලට හේතු වෙනවා මහින්ද මහත්තයා මේ රටේ ඊළඟ නායකයා ලෙස ඉන්දියාව පිළිගැනීම. ඒ දේ චීනය නම් අනියම් ලෙස හැමදාම පිළිගෙනයි තිබුණේ.

ඉන්දියාවේදී ඔහුට ලැබුණු ගරු සත්කාර, සැලකිලි රාජ්‍ය නායකයකුට ලැබෙන තත්ත්වයෙනුයි ලැබුණේ. මේ තත්ත්වය යටතේ අද වන විට මහින්ද මහත්තයා නිල නොලත් රාජ්‍ය නායකයාගේ තත්ත්වයට පත්වෙලා ඉවරයි.
දේශපාලන මතභේද පැවතීම, ආණ්ඩුවට පැහැදිලි ගමනක් නොතිබීම වැනි හේතුන් නිසා ආණ්ඩුවේ අර්බුදය ඉහළ යනවා. ඒ වගේම ආර්ථිකයේ පහළ වැටීමත් සිද්ධ වෙනවා.

සිරිසේන ජනාධිපති සහ ගෝඨාභය මහතාගේ අතර පවතින හිතවත්කමත් ප්‍රසිද්ධ රහසක්. ඒ හිතවත්කම ගැන කවුරුත් දන්නවා. ජනාධිපතිවරයාට මතුවී ඇති ගැටලුවලට යම් උපදෙස් දීමක් සිදු කළ හැකි පුද්ගලෙයක් තමයි ඔහු. උපදෙස් දෙනවද නැද්ද මම දන්නේ නැහැ.

හමුදාවේ ඉහළ නිලධාරීන් අතර පවතින ගැටලු සහ එවැනි තත්ත්වයක් තුළ කළ යුතු දේ ගැන සිරිසේන මහතාට උදව්වක් විය හැකි කෙනෙක් තමයි ගෝඨාභය මහතා.
අද දේශපාලනයේ ලොකු ඉල්ලුමක් තියෙනවා මහින්ද මහතාව අගමැති කරන්න කියන එක. මේ පාර්ශ්ව දෙකක් අතර ඇති කරගෙන ඇති ආණ්ඩුව සෑදීමේ ගිවිසුම අයින් කළොත් ආණ්ඩුවත් ඉවරයි. එවිට ආණ්ඩුව හදන්න කාවහරි අගමැති ලෙස පත් කළ යුතුයි.

කාගේත් බලාපොරොත්තුවත් ඉල්ලීමත් දැනටමත් නිල නොලත් රාජ්‍ය නායකයා ලෙස ලොවම පිළිගත් මහින්ද මහතා අගමැති ධුරයට පත් කරන්න කියන එකයි.

මේ ගැන භීතියට, කෝපයට හා විරෝධයට පත්වනවා නම් පත්වෙන්නේ එ.ජා.ප.යට. රනිල් වික්‍රමසිංහ මහතාට. ඒ නිසා ඔහුට වුවමනාවක් සහ උනන්දුවක් තියෙනවා එවැනි තත්ත්වයක් ඇතිවීම වළක්වන්න.
අනිත් අතට ජනාධිපතිවරයා ඝාතනය කරනු ලැබුවහොත් වෙන්නේ පාර්ලිමේන්තුවේ වැඩ බලන ජනාධිපති ලෙස අගමැතියි කටයුතු කරන්නේ.

මේවායින් පැහැදිලි වන්නේ මොන දේවල් වුණත් මේ ඝාතන සැලැස්මට හේතු පාදක වන පසුබිමක් නම් තියෙන බවයි. මේ ඝාතන සැලසුම පිළිබඳ හරියාකාර පරීක්‍ෂණ කරගෙන යන්න නොහැකි වී ඇත්තේ පොලිස්පති මේ ගැන සිය උනන්දුව සහ අනුග්‍රහය නොදැක්වීම සහ අවශ්‍ය ආකාරයට කටයුතු කිරීමට ඔහු සූදානම් නැතිකම.

මේ හරහා ආණ්ඩුව උත්සාහ කරන්නේ එම ආයතන අඩපණ කිරීමට නොව ත්‍රස්තවාදය වැළැක්වීමේ පනත සහමුලින්ම නැති කර ඒ වෙනුවට ලිහිල් පනතක් ආදේශ කිරීමට බවද ඒ මහතා අවධාරණය කළේය.

ඊයේ (17දා) බත්තරමුල්ල නෙලුම් මාවතේ පැවැති ශ්‍රී ලංකා පොදුජන පෙරමුණේ මාධ්‍ය හමුවට එක්වෙමින් ඒ මහතා වැඩිදුරටත් මෙසේද කීය.
මහින්ද රාජපක්‍ෂ මහතාගේ ඉන්දීය සංචාරයෙන් පැහැදිලි වුණු එක කරුණක් තමයි මේ රටේ පමණක් නොවෙයි සම්පූර්ණ සාක් කලාපය තුළ මහින්ද රාජපක්‍ෂ මහතාට විශාල පිළිගැනීමක් තිබෙන බව. සාක් කලාපයේ ජේ‍යෂ්ඨතම නායකයා හැටියට නවදිල්ලියේ මහින්ද රාජපක්‍ෂ මහතාගේ දේශනය ගැන පෝස්ටර් හැම තැනම තිබුණා. ඒ සඳහා තමිල්නාඩුවේ මන්ත්‍රිවරුන් පවා සහභාගි වුණා.

මහින්ද රාජපක්‍ෂ මහතා සමඟ සම්මුඛ සාකච්ඡා කිරීමට ඉන්දියාවේ විද්‍යුත් හා මුද්‍රිත මාධ්‍ය අවසර ඉල්ලා සිටියා. එක දෙයක් ඉතාම පැහැදිලියි. ඔහුට නැවත නායකත්වය ලබා ගැනීමට හැකි බවට ඉන්දීය මාධ්‍ය තුළ පැහැදිලි මතයක් තිබෙනවා. මහින්ද රාජපක්‍ෂ මහතා සිය දේශනයේදී කියා සිටියා උතුරු පළාත් සභා මැතිවරණය පවත්වන විට නමුත් වර්තමාන ආණ්ඩුවට තිබෙන ලොකු ප්‍රශ්නයක් තමයි මැතිවරණ චේතනාන්විතව නොපැවැත්වීම. ඔක්තෝබර් 23 වනවිට උතුරු පළාත් සභාවත් අහෝසියි. ලංකාවේ මැතිවරණ නැහැ. මැතිවරණ තියෙනදිනයක් මැතිවරණ කොමිසම පවා දන්නේ නැහැ. ඔවුන් මැච් එකයි පිච් එකයි ගැන තමයි දිගින් දිගටම කතා කරන්නේ.

ටී.අයි.ඩී. වැනි ආයතන පිහිටුවලා තිබෙන්නේ ත්‍රස්තවාදීන් මර්දනය කිරීමට. ඒ ආයතනවල නිලධාරීන් භාවිත කරන්නේ දේශපාලන එදිරිවාදිකම්වලට. විරුද්ධ පක්‍ෂයේ දේශපාලනඥයන් මර්දනය කිරීමටයි. මේ රජය කරන්නේ ත්‍රස්තවාදයට සම්බන්ධ ආයතන අඩපණ කිරීම, පටු දේශපාලන අරමුණු සඳහා භාවිත කිරීම පමණක් නොවෙයි, ත්‍රස්තවාදය වැළැක්වීමේ පනත සහමුලින්ම නැති කිරීමයි. ඒ වෙනුවට ඉතාමත් ලිහිල් පනතක් ආදේශ කිරීමටයි.

පාර්ලිමේන්තු මන්ත්‍රි රෝහිත අබේගුණවර්ධන,මේ නියෝජ්‍ය පොලිස්පතිවරයා නොවේ නම් මේ සිදුවීම කළේ, ගමේ පොලිසියේ සාජන්ට් මහත්මයෙක් නම්, එහෙමත් නැත්නම් ඒකාබද්ධ විපක්‍ෂය නියෝජනය කරන ප්‍රාදේශීය සභා මන්ත්‍රිවරයෙක් නම් මොකක්ද අද ඇති වන තත්ත්වය.

‘බලා ඉන්නැද්දි රට පිරිහෙන කාලේ ඒ වගේම තැන තැන මිනීමරන කාලේ නීතිය වල් වැදිලා කියන කතන්දර අපිට ඇහෙනවා. ඒ වගේම උතුරට එක නීතියක්, විග්නේෂ්වරන්ට එක නීතියක්, ඒ වගේම දකුණේ ආගමිකයන්ට තව නීතියක්. සිංහල අපි බලා ඉද්දි අපේ ජීවිත දිහා අනතුරක් දැක දැක අපි ගොළුවෝ වගේ අන්ධයෝ වගේ ඉන්නා ඕනි කාලෙක තවත් භයානක අනතුරක් ගැන අපිට ඇහෙනවා. විධායක ජනාධිපති ක්‍රමය අහෝසි කරලා මේ රට කෑලිවලට කඩන්න උත්සාහ කරන වෙලාවේ ජනාධිපතිතුමාව ඝාතනය කරන්න කුමන්ත්‍රණයක් ගැන ආරංචි වෙනවා. ඒ අතර රාජපක්‍ෂ පවුලෙන් ගෝඨාභය රාජපක්‍ෂ මහත්තයා ගැන මේ රටේ ජනතාව බලාපොරොත්තුවකින් ඉන්නවා. මේ රට රකී, මේ රට ආරක්‍ෂා කරයි, කියලා ජනතාව බලාපොරොත්තු වෙනවා. ඒ වාසනාවන්ත සිතිවිල්ල නැතිවේගෙන යන අවස්ථාවකට පත් වෙලා තියෙනවා කියලා අපිට පේනවා.

මේ රටේ නායකත්වය දෙන ජනාධිපතිතුමා, ඒ වගේම මේ රටට අනාගත බලාපොරොත්තු තියන්න පුළුවන් මහින්ද රාජපක්‍ෂ මහතා ඇතුළු ඒ පරපුරේ යම් කෙනෙක්. මේ රටේ රට, ජාතිය, සංස්කෘතිය රකින තැනක ඉන්නවා නම් රටේ ඔක්කොම නිදහස බලාපොරොත්තු වෙනවා නම් මේ වගේ නායකයන්ව මරන්න හදනවා කියන්නේ මෛත්‍රිපාල සිරිසේන මහතාට දැන් වටිනාකමක් තියෙනවා. ඒ වගේම ගෝඨාභය මහත්තයාටත් දැන් වටිනාකමක් තියෙනවා. මේ දෙන්නා එකතු වුණොත් එහෙම මේ රට නැවත සශ්‍රීක කරයි කියන බලාපොරොත්තුව නැති කරන්නද මේ වෙඩි තියලා මරන්න කුමන්ත්‍රණය කරන්නේ කියලා අපි අහනවා.
අද වෙනකොට බල්ලා විසින් නගුට වනන ස්වභාවය නගුªට විසින් බල්ලා වන ස්වභාවයට ඇවිල්ලා. ඒ යුගයෙන් නිදහස් කර ගන්න මහ සංඝරත්නය අපි බලාපොරොත්තු වෙනවා.
සෙනඟ දකින්න දකින්න කිරි පැකැට් එකකට හරි වහ ටිකක් දාලා දෙන්න කටයුතු කරනවා. බල්ලෙකුටවත් අපි විස දෙන්නේ නැහැ. ඒ වගේ අවාසනාවන්ත තත්ත්වයකට රට පත් වෙලා. අපි ජනතාවගෙන් ඉල්ලන්නේ මිනිසුනේ දැන් හිත හිතා හිටියා ඇති. අපේ අදහස් රජ කරවන්න අවශ්‍ය කාලේ ඇවිල්ලා.

ඒ වගේම ජනාධිපතිතුමෝ, ගෝඨාභය මහත්තයෝ යමක් හිතලා වැඩ කරන්න ඕනි කාලේ. ජීවිත පරිස්සම් කරගන්න ඕන කාලේ.
එගොඩ උයන ශ්‍රී බෝධිරාජාරාම විහාරාධිකාරි එගොඩ උයනේ ඥානවිමල හිමි,

‘මේ ආණ්ඩුව ජනතාවගේ අභිමතයන් විනාශ කරමින්, පවතින තත්ත්වයකට පත් වෙලා.

රටේ නීතිය රකින්න ඉන්න ප්‍රධානීන් භික්ෂුන් වහන්සේට මේ චෝදනාවන් එල්ල කරන්නේ ඇයිද කියන එක පැහැදිලි කළොත්, භික්ෂුන් සහ ජනතාව තුළ තිබෙන ඒකාබද්ධතාව කැඩුවාට පස්සේ මේ රට ඇතුළේ ඕනෑම දෙයක් කරන්න පහසුයි.

වෑබඩ රජමහ විහාරයේ විහාරාධිපති වෑබඩ පියරතන හිමි,

‘පොලිසියේ ජෝකර්පතිට අපි කියනවා ඔබතුමාට අයිති කාර්යය ජෝකර්පතිකම නෙවෙයි. නීතිය සාමය ආරක්‍ෂා කරලා වැදගත් විදියට තමන්ගේ නිලය ආරක්‍ෂා කර ගන්න කියලා අපි කියනවා. ඔබතුමා විශේෂඥ වෛද්‍යවරයෙක් හම්බ වෙලා ඔබතුමාගේ මොළේ පරීක්‍ෂා කරගෙන ඉක්මනින් බෙහෙත් ගත්තේ නැත්නම් මේ රට වල් වදිනවා කියලා අපි මතක් කරලා දෙන්න කැමැතියි.’
වටිනාපහ සෝමානන්ද හිමි,

ශ්‍රී ලංකාව තුළ එදා සිංහල, දෙමළ, මුස්ලිම් ජනතාව සමඟියෙන් ජීවත් වුණා. අද සිංහල ජනතාවට උතුර තහනම් වෙලා තියෙනවා. භික්ෂුන්ට වගේම මේ බුද්ධ ශාසනයටත් පෙර නොවූ විරූ ආකාරයට බැරෑරුම් තත්ත්වයක් මේ ආණ්ඩුව යටතේ සිදුවෙලා තියෙනවා.

US soldiers fought for democracy and the freedom of other nations. Yet in the course of military operations, they too committed war crimes. Most of them never followed up on, let alone punished.

In the wake of the Allies’ advance against Hitler’s tyranny, there were numerous atrocities committed by the victors, not only in the East. Apart from their medals, some American soldiers also kept a dark secret. GIs killed German prisoners of war and raped thousands of German women.

Estimates of the number of German victims vary widely, and are highly disputed among experts. Not least because they touch on a taboo, since for decades in Germany the subject had been considered as a potential strain on the relation between the Federal Republic of Germany and its Western Allies.

According to some historians there were several thousand sexual assaults by American soldiers in Bavaria alone when US forces liberated the region in April 1945. At some invasion beaches in Normandy, only every second Germnn POW survived. Often, the liberators – shocked by the sight of German atrocities – would fall into a spiral of violence. Very few of these crimes came under investigation by US military courts. Studies by the US War Department hinting at a comparatively high number of transgressions were classified secret.

WAR CRIMES OF THE LIBERATORS follows the deficiencies of discipline and military justice in the US Army using unpublished documents and moving statements by US soldiers as well as their victims.

Citizen Silva shivers

President Maithripala Sirisena is in the attack mode. He has recalled Ambassador to Austria Priyani Wijesekera and several other embassy officials for not answering his calls. This has come close on the heels of his diatribe against the national carrier over the poor quality of cashew nuts he was served. Is he asserting himself to show that he is the boss? If only he had taken such stern action when the lid was blown off the first bond scam in 2015! He should have sacked the then Central Bank Governor Arjuna Mahendran promptly!

There are serious problems which warrant President Sirisena’s attention and time, on the economic front, where the yahapalana government is bungling big time. It is hoped that he will stop tilting at windmills and concentrate on what needs to be done urgently.

President Sirisena made a solemn pledge in the run-up to the last local government polls to take over economic management as the UNP had, he said, failed to handle the economy properly. But nothing of the sort happened and he apparently has no say in economic affairs at present. He cannot even have fuel price increases suspended. He is left with no alternative but to comply and complain.

It has been reported that the government is planning to relieve the Central Bank (CB) of the task of raising funds for the state coffers and entrust it to the Finance Ministry. What are the yahapalana worthies, who think they are the bee’s knees, up to?

But for the intrepid CB officials who had the courage to stand up to the corrupt politicians of the current regime, the bond scams would not have come to light. Unfortunately, some bad eggs in the garb of CB professionals brought their institution into disrepute; they sided with some yahapalana politicians who lined their pockets at the expense of the state banks and the Employee’s Provident Fund.

The CB professionals who stood on the side of the truth have incurred the wrath of the yahapalana politicians involved in the bond rackets. Are government politicians trying to remove such officials from their path so that they could put some crooked deals through again?

The government is running around like a headless chicken, unable to tackle economic problems which are legion; it must not be allowed to take over the functions that are best left to the CB professionals.

Meanwhile, the yahapalana government came to power, promising the people that they would have a lot of money in their pockets. That pledge is likely to be fulfilled in the near future. Money printing is said to continue apace with the rupee tumbling rapidly. At this rate, the day may not be far off when the people will have to use wheelbarrows to bring their salaries home. Or, they will have to spend all the money, on the way, to buy a loaf of bread each.

It is feared that another huge fuel price hike is in the pipeline thanks to the government’s secret pricing formula. The general price level is bound to increase again in such an eventuality and Citizen Silva will suffer another body blow.

President Sirisena told a group of media heads, the other day, that he also had misgivings about the pricing mechanism, which only caused fuel prices to soar. He, too, has not seen it. He ought to demand that he be at least shown the secret formula. Unless the Finance Ministry panjandrums carry out his order, he should give them marching orders.

One of the main reasons for the current economic mess is the huge election bribe the yahapalana leaders granted the state workers, in the form of a pay hike, in 2015, to capture power. The government has started throwing money around again in a bid to impress the electorate and, thereby, shore up its crumbling image, unable to face elections. This election-oriented spending spree will further aggravate the country’s economic woes

The Joint Opposition: People expect IGP to behave better than MPS

UPFA Kalutara District MP Rohitha Abeygunawardena, yesterday, said that people expected the IGP to behave better than MPs.

Abeygunawardena, flanked by Sri Lanka Podujana Peramuna (SLPP) Chairman Prof. G.L.Peiris and former JVP MP Siripala Amarasinghe, said so in response to The Island query at media briefing at the Nelum Mawatha Office of former President Mahinda Rajapaksa.

The Island raised the issue after Abeygunawardena alleged that IGP Pujith Jayasundera wasn’t suitable to continue in office following a spate of incidents involving him and recent derogatory statements directed at the Maha Sangha at a recent event in a government school. Abeygunawardena said that the Sirisena-Wickremesinghe administration couldn’t retain Jayasundera as the IGP in the wake of recent misconduct. The MP asserted that the IGP might have been under the influence of liquor as shown by private television stations recently. The MP insisted that the conduct of elected and appointed lawmakers and that of officials could not be compared.

Asked by The Island whether he as a lawmaker could compare the conduct of the IGP and members of parliament in the chamber where they behaved in most unruly manner, exchanged blows and in one instance harassed an MP Buddhist monk in a horrendous way when his party (UPFA) was in power, Abeygunawardena said that people’s representatives and law enforcement officers couldn’t be compared under any circumstances. According to Abeygunawardena, people’s representatives could be sent home by the electorate whereas the IGP should be dealt differently.

The Joint Opposition MP said that the uncivilized conduct on the part of the IGP could influence the entire police department. The Island sought an explanation from the MP whether he expected lawmakers to receive privileged status and be above law especially against the backdrop of his accusation made at the same media briefing that two members of the Sirisena-Wickremesinghe government sought a staggering USD 30 mn bribe from a foreign party.

Abeygunawardena insisted that law breaking lawmakers could be dealt only at elections. The IGP could not be expected to get away with such boorish behavior.

At the onset of his briefing, Abeygunawardena flayed the government for not promptly taking action against DIG Nalaka de Silva, in charge of the Terrorist Investigation Division (TID) now under probe for allegedly conspiring to assassinate President Maithripala Sirisena and former Defence Secretary Gotabhaya Rajapaksa. The revelation made by a civil society activist regarding the DIG’s project couldn’t be taken lightly and the government needed to take tangible measures in respect of the accusation.

Abeygunawardena asked what would have happened if such an allegation was directed against some other person.

The MP ridiculed the CID for requesting the IGP whose conduct, too, couldn’t be accepted under any circumstances, to transfer DIG Nalaka de Silva out of the TID. Later police headquarters announced the DIG under investigation was moved out to Information Technology unit.

Prof. Peiris said that the government was paying the price for utilizing specialized units meant to curb terrorism to harass rivals.

Prof. Peiris pointed out how the government jeopardized national security by doing away with the Prevention of Terrorism Act (PTA) to appease a section of the international community and their local agents. The so-called anti-terrorism law proposed in place of the PTA was meant to protect the interests of those taken into custody on terrorism charges. The government sought to ensure the well-being of suspects by the inclusion of a line to place the responsibility of the safety and security of suspects on Magistrate.

The former External Affairs Minister also frowned on President Maithripala Sirisena’s recent declaration that he would propose suggestions in respect of Oct 2015 Geneva Resolution. The former Law Professor said that President Sirisena’s move was certainly not practical therefore nothing could be expected out of it. It would be the responsibility of relevant officials to advice the President, the former Minister said.

Maneka Gandhi requests President to free elephant ‘Bandula’

Indian Minister and animal rights activist Maneka Gandhi has written to Sri Lankan President Maithripala Sirisena requesting him to free elephant ‘Bandula’ from Dehiwala Zoo, the NDTV reported on Monday.

In her letter, Ms.Gandhi said many in Sri Lanka have reached out to her about the “plight of Bandula” who is in chains for last 67 years.

There were reports about bleeding wounds on Bandula’s limbs, due to heavy chains for years.

Sri Lanka is such a gentle and beautiful island. It seems out of character to treat the elephant this way. Send the elephant to the Ridiyagama National Park to live free,” Ms.Gandhi said.

The minister cited examples in India about how elephants are banned in zoos and the elephants look stressed when chained as they have the same sensitivities as humans.

Sri Lanka’s president on Monday justified his decision to sack six diplomats — including an ambassador — for not answering his phone calls, saying more would follow if the foreign service did not shape up.

Maithripala Sirisena was criticised for the shock dismissal last week of his top envoy to Austria and five other Vienna-based staff after his office tried unsuccessfully for hours to reach them by phone.

“I am being attacked ferociously over social media for recalling the entire embassy staff. Yes, I did that to send a powerful message to other embassies,” Sirisena told a public meeting in Colombo.

He said he ordered the sacking of ambassador Priyanee Wijesekera and five other staff to set an example.

The Sri Lankan embassy in Austria is accredited to UN bodies in Vienna, as well as Bosnia and Herzegovina, the Czech Republic, Serbia, Slovakia and Slovenia.

It was the second time in days that Sirisena has raised eyebrows.

Last week, he flew into a rage over nuts served aboard SriLankan Airlines, the island’s national carrier, saying they were unfit for animals.

“Returning from Kathmandu, I was served some cashews on board a SriLankan flight, but it was so bad even a dog wouldn’t eat it,” he said.

An airline spokesman said it had cleared its stock of cashews — only served in business class — and would change its Dubai-based supplier.

Afghanistan knock Sri Lanka out of Asia Cup after upset win

Afghanistan continued their rise in international cricket with an upset 91-run win over Sri Lanka in Abu Dhabi on Monday, knocking the former champions out of the Asia Cup.

Sri Lanka needed to win the Group B match to stay in the tournament but were outwitted by smart batting from Afghanistan who put up a fighting total of 249 all out at Sheikh Zayed Stadium.

The fighters then laid into Sri Lankan batting with spinner Rashid Khan (2-26), Mohammad Nabi (2-30) and Mujeeb Ur Rahman (2-32) sharing wickets as the five-time former winners were bowled out for 158 in 41.2 overs.

Sri Lanka did not help their cause with two run outs while skipper Angelo Mathews played a reckless shot off Nabi and was caught near the boundary for 22.

This becomes Afghanistan’s first-ever victory against Sri Lanka in three one-day internationals after losing in the Asia Cup 2014 and World Cup a year later.

Sri Lanka, who now have lost 30 of their 40 matches since January 2017, had lost to Bangladesh by 137 runs in Dubai on Saturday.

Bowled out for a paltry 124 against Bangladesh, Sri Lankan batting again failed miserably with only Upul Tharanga (36) and Thisara Perera (28) offering some fight.

Afghanistan were helped to 249 all out in their 50 overs with Rahmat Shah scoring 72 and Ihsanullah Janat shipping in with 45.

Shah struck five boundaries during his 90-ball knock and added 50 for the second wicket with Janat (45) after Afghanistan won the toss and opted to bat on a flat pitch.

Janat hit six boundaries in his 65-ball innings while his opening partner Mohammad Shahzad batted in his aggressive style, hitting a six and four boundaries in his 47-ball 34.

Rahmat then added another 80 runs for the fourth wicket with Hashmatullah Shahidi who made a sedate 52-ball 37.

For Sri Lanka seamer Thisara Perera took five for 55 and spinner Akila Dananjaya finished with two for 39.

Defending champions India, Pakistan and qualifier Hong Kong are placed in Group A.

Pakistan beat Hong Kong by eight wickets in Dubai on Sunday.

Top two teams from each group will qualify for the Super Four stages from where top two teams will play the final in Dubai on September 28.

India face Hong Kong in Dubai on Tuesday before their high profile match against Pakistan a day later at the same venue.

Treat Indian fishers humanely: India to Sri Lankan

Tamil Nadu has communicated a list of 1215 boats for the fitment of transponders to Isro.

Chennai: The Union government has informed the Madras high court that through various mechanism, the government of Sri Lanka was impressed upon to treat Indian fishermen humanely when in detention and not to resort to violence under any circumstances while intercepting or apprehending Indian fishermen who have strayed into Sri Lankan waters.

Binoy George, deputy secretary (Sri Lanka) in the ministry of external affairs, stated this in his report filed in response to the petition filed by Fisherman Care, represented by its president LTA Peter Rayan.

A division bench comprising Justices S. Manikumar and Subramonium Prasad before whom the report was filed, directed the commander, Coast Guard or any other competent authority to be present in the court on September 19 to explain as to whether there could be any coast guard ship or navy ship providing communication for signal to the fishermen by way of transponders and to have a two way communication for the said boats to the coast guard or navy ship as the case may be.

The judge also directed Mohana Sundaram, additional director of animal husbandry, dairies and fishers, Tamil Nadu Government to submit a detailed technical knowhow as to how the transponders of boats and towers operate. He is also directed to submit a report as to whether fishermen of Nagapattinam to Rameswaran region for the present could be given transponders and VHF handsets, the judge added.

In his report, Binoy submitted that due to the close proximity of the territorial waters of India and Sri Lanka and presence of high density of fishing boats in the Palk bay area and the Gulf of Mannar, incidents of straying and crossing of the International Maritime Boundary Line (IMBL) by Indian fishermen occur frequently. These fishermen were apprehended and arrested by Sri Lankan navy under their Fisheries Acts for allegedly fishing in Sri Lankan waters following the ecologically unsustainable practice of bottom trawling. This has also been a long pending issue of conflict between fishermen of both the countries and a matter of concern for both the governments.

Government of India has taken steps for finding a sustainable solution for the issue through joint efforts from the countries and taking the state governments as well as fishermen into confidence to ensure effective implementation of the suggested measures, he added.

He said the Isro was requested to develop transponders for tracking movements of fishing vessels. ISRO and Indian Navy have installed a few transponders on fishing vessels on trial basis for tracking their movements. On successful implementation, it was proposed to install transponders on large scale mainly in fishing boats of states having close proximity of neighbouring countries, including Tamil Nadu so as to locate their movements and prevent cross border fishing activities.

Tamil Nadu has communicated a list of 1215 boats for the fitment of transponders to Isro. Further 245 upgraded units of transponders have been installed in the fishing boats from various coastal districts of TN, he added.

Sri Lanka to tell United Nations We will do it our way

Sri Lanka is gradually asserting itself to tell the international community that solving the internal issues of the country and its citizens is our duty and responsibility, and although we expect and welcome the support of the world, we would find our own solutions at our own pace.

At the 73rd Session of the United Nations General Assembly on 25 September, President Maithripala Sirisena will announce a set of new proposals for consideration at the March 2019 Session of the United Nations Human Rights Council (UNHRC). He will also submit these proposals to UN Secretary-General António Guterres, as well as UN High Commissioner for Human Rights, Michelle Bachelet. The President expects to meet both of them in New York, in two weeks time.

Addressing Media Heads at the President’s House in Colombo last Friday, President Sirisena said that he would discuss his new proposals with Bachelet.

After assuming duties, Bachelet, in her first address in Geneva said, “Good governance is based on identifying and amending gaps in access to justice, dignity, and equality, so that all can live in more respectful and harmonious societies, and enjoy development that is more dynamic and sustainable.”
President Sirisena, in his media briefing last week, said the UN Human Rights High Commissioner’s recent statement on Sri Lanka was a balanced one.

Bachelet, a Chilian human rights activist, who was imprisoned during the dictatorial regime of President Pinochet, told the UNHRC about her deep commitment to human rights. In her speech, she briefly talked about Sri Lanka. “In Sri Lanka, although the authorities have moved too slowly towards meaningful implementation of the transitional justice agenda, the Office of Missing Persons has now begun consultations and institutional capacity-building to fulfil its mandate. We look to that Office to work quickly, to begin to provide answers to the families of the disappeared. Legislation establishing an Office for Reparations is also underway. More progress in advancing accountability and truth-seeking could have great weight in the long-term stability and prosperity of the Nation. Recurrent incidents of racist and inter-communal violence are disturbing, as are announced plans to resume use of the death penalty,” she said.

When a journalist pointed out that the new High Commissioner said the progress was slow in Sri Lanka, the President was quick to admit the process was slow, but steady. He pointed out that such vexed issues cannot be tackled quickly, as many sensitivities have to be balanced. In any country that faced prolonged conflicts, the solutions took a very long time, and Sri Lanka is no exception.

Pro-LTTE NGOs

President Sirisena further said that certain pro-LTTE non-governmental organizations (NGOs) are making various allegations regarding human rights violations. He stated that the Government was able to avoid Sri Lanka’s isolation in the UN Human Rights Council, which had prevailed before it came to power, and succeeded in fostering friendship.

The President said the proposals he will submit to the UN are aimed at solving issues and provide relief without causing harm to the pride of the security forces and safeguard independence, sovereignty, and national security. Furthermore, these proposals will facilitate harmonious solutions for remaining issues, with regard to alleged acts of both sides during the conflict.

There is positive recognition for the Sri Lankan armed forces internationally, as a disciplined Army, and that is evident from the fact that United Nations Peacekeeping Forces recruit increased number of Army personnel from Sri Lanka,” he pointed out.

The President will lead Sri Lanka’s delegation to the 73rd United Nations General Assembly (UNGA) in New York. The 73rd UNGA will begin on 18 September at UN Headquarters, New York, while the General Debate will be held from 25 September to 1 October. The President will address the 73rd Session of the high-level General Debate of the UN General Assembly at UN Headquarters in New York on 25 September.

Sri Lanka’s decision to submit a fresh set of proposals this year is indeed a fulfilment of a long felt need. Last September, addressing the 72nd Session of the United Nations General Assembly in New York, President Sirisena emphasized the Government was tackling issues, while we protect our independence and sovereignty.” He urged the international community to support the slow, but steady forward march to achieve our targets in order to find sustainable solutions for the allegations levelled against us.” It was a very clear message to the West, that we will not implement any of the clauses that could infringe on our sovereignty. “Some extremist groups are expecting a high speed. Some extremist groups want radical solutions.

However, as a country that has faced a three decade long war, where deep divisions have existed, I request the support of all of you to promote peace and fraternity, so that my beloved country and its people can rise from the current situation. That is why I emphasize that it is for a slow and a successful journey that we need the support,” he said.

At the same time, he pointed out that, “as a government, we are paying serious attention to the aforementioned allegations, and to find solutions to them as a matter of priority. Mainly, my government has performed well in terms of strengthening democracy and protecting human rights. I must mention here that the Government will continue to ensure their progress in the future.”

Domestic issues

The 73rd UNGA is an important occasion for the President to brief the international community about Sri Lanka’s domestic issues, and the imperative need for local solutions for them. This time, he will be able to explain his proposals to the international community and gain its support.

Sri Lanka has been a member of the United Nations for 63 years. Sri Lanka has always been a country that has respected its treaties and conventions, agreements and rules and regulations, while acting to improve these relations further. Now, all that Sri Lanka is asking for is the support of the international community to continue on a slow, but steady path to find a lasting solution that will ensure communal harmony, as well as the unity, independence, sovereignty, and territorial integrity of the country.

Today law is enforced only on one group – Mahinda

Former President Mahinda Rajapaksa says that the current government is implements the law targeting only one group.

While addressing a ceremony held in Rajanganaya yesterday (16), he said that the law in the Northern Province has fallen to ruins and that the police cannot enforce the law as required.

He points out that the high ranking officials of the police are behaving in a manner that ridicules monks and graduates.

Speaking further, Rajapaksa said that the present government is attacking his family members and supporters by establishing special courts and creating new laws and regulations.

Vishwakarma, the celestial architect who built Sri Lanka

The Vishwakarma puja, which was observed on September 17, is not restricted to India but is observed in Sri Lanka, Bangladesh, Nepal and Bhutan. The puja closely follows the celebration of the Ganapati festival. In some places, it is performed the day after Diwali in October or November.

Vishwakarma puja or Kanya Sankranti is celebrated in the Indian states of Uttar Pradesh, Bihar and Jharkhand in North India; Karnataka in the south; and Assam, West Bengal Odisha and Tripura in the east, in honour of Vishwakarma – the celestial architect.

In Nepal, the Vishwakarma puja is celebrated on the first of the month of Ashoj according to the Nepali Bikram Sambat calendar.

A remarkable thing is that the Vishwakarma puja is performed invariably on September 17 while most traditional festivals across the Indian sub-continent follow a lunar calendar and the system of tithi or auspicious period, which change annually.

The date of the Vishwakarma puja is based on the movement of the sun. It is  observed  when the sun transits from Singha (Leo) to Kanya (Virgo). September 17 is the last day of the traditional month of Bhadon (Bhadro in Bengali). However, this transit is not always fixed. It might vary by a day or two, at times.

The association with solar transit is not echoed in all oral traditions in other parts of India.  Mention may be made here of the dialogue between Muni (sage) Kalhasti (an incarnation of Shiva), and a certain King Suvrata in a small Up Purana in South India. This does not mention any solar transit but places the community of Vishwakarma, and the various trades associated with him, in the higher echelons of traditional society.

This is echoed in the Vishwakarma Upanishad, and a few other works in praise of Vishwakarma. None of them associates the celebration with the solar transit to Virgo.

In India, Bhutan, Nepal and Bangladesh too, the Vishwakarma puja is observed as a celebration of creation. In all of these countries, Vishwakarma is worshipped in factories,  by artisans, architects and engineers.

Over the years, the puja is associated with flying kites. Kite flying is seen as a harbinger of a festive season.

The Vishwakarma puja connects the India with its neighbours through various traditions. Similar celebrations, rites and rituals reverberate across India, Bangladesh, Sri Lanka, Nepal and Bhutan.

The Vishwakarma caste has mythological stories connecting the community to the deity. The community calls itself Vishwabrahmin. The community comprises five sub-groups: carpenter, blacksmithsbronze smiths, goldsmiths and stonemasons.

In Nepal the Kami/Bishwakarma have a similar lore. This is an ethno-linguistic group. They are essentially blacksmiths and are credited for being the original makers of the famous Nepali drum, the Madol and the Nepali Kukri (knife). The Kukri which is a short curved knife used by the Gurkha troops. The community’s traditional dance, Maruni Nritya is  also famous. The Kami/Biswakarmas are found  in the mountainous regions of Sikkim and Darjeeling District of West Bengal also.

In Sri Lanka, oral traditions connect the origin of the Navandanna caste to Vishwakarma. Artisans, known locally as Vishwakarma, comprise Kannar (brass-workers), Kollar (blacksmiths), Tattar (goldsmiths), Tatchar (carpenters) and Kartatchar (sculptor).

Oral traditions across South Asia also trace the connection with Vishwakarma. He finds mention in the Rig Veda as the creator, having eyes, faces, arms, feet and wings on every side.The description brings him close to Brahma. The world is said to have come out of Vishwakarma’s navel, which mirrors the story of Brahma giving birth to the universe.

The Yajur Veda portrayed him as the Prajapati. And the Atharva Veda mentions him as Pashupati. Later Puranas identify him as the Vedic Tvastar (artisan god or heavenly builder). As a creator, Shilpi Vishwakarma, is an architect who is credited to have built flying chariots and weapons for the Gods. He is regarded as the very essence of quality craftsmanship.

He is also credited with the creation  of heaven (swarg) in the Satya Yuga, Lanka (the city of gold) in Tretayuga, the city of Dwarka in Dwapar Yuga and Hastinapur and Indraprastha in the Kali yuga. In Sri Lankathe Mahavamsa of Theravada Buddhism mentions him as an architect.

Builder of Lanka

Oral traditions explain the association of Vishwakarma with the creation of Lanka. The story of Lanka is described in the Uttarakanda of Valmiki’s Ramayana, which says that Lanka was created by the celestial architect Vishwakarma for the Gods in heaven.

However, Lanka was seized by the Rakshasha brothers, Malyavan, Sumali and Mali. These three had obtained a boon of invincibility from Lord Brahma and had instructed the celestial architect to erect a mansion for us- resembling the mansion of Maheshwara (Shiva)”.

Accordingly, on the mountain Suvela, Vishwakarma constructed the city of Lanka with the fortress being between three mountain peaks known as the Trikuta mountains.This has been described as- having an area of thirty yojanas, and measuring a hundred in length, surrounded by a golden wall and furnished with golden gateways … having a strong wall and a moat, abounding in hundreds of golden edifices”.

The centre of the complex (which was finally occupied by Ravana) has been mentioned as a collection of several edifices that reached over one yojana (8 miles or 12.88 kms) in height, one yojana in length and half a yojana in breadth.

The three brothers, Malyavan, Sumali and Mali, ruled Lanka for many years. But  when they invaded the heavens, the they were defeated by Lord Vishnu. Mali was killed and Sumali and Malyavan, along with their Rakshasha comrades, were driven out of Lanka.

After this, upon instructions from the sage Vishrava, Kubera, who was also the God of wealth, moved into Lanka and established the Yaksha kingdom. His capital was guarded by Rakshashas. However, it was not long before Kubera’s half-brother Ravana (son of Vishrava and Sumali’s daughter Kaikesi), fought with Kubera and took Lanka from him.

Though  Ravana had usurped Lanka he was a benevolent ruler and Lanka flourished under him. He was a devout worshipper of Shiva, a great scholar and a maestro of a kind of Veena referred to as the Ravanhatta. In order to expand his kingdom- Ravana had proceeded on a series of campaigns conquering humans, celestials and demons.

Another oral tradition tells of a different beginning of Lanka. After Lord Shiva married Parvati,  he instructed Vishwakarma to construct Lanka so that they might reside there. Vishwakarma constructed a palace made of gold. Ravana, who was a devout worshipper of Shiva, was invited for the Gihapravesh puja (housewarming ceremony).

After the completion of the rituals, Ravana was asked by Shiva to seek anything as a Dakshina,  Ravana asked for the golden palace and the city itself, since he was overwhelmed by the grandeur of the place. Shiva was obliged to accede to Ravana’s wish, and Golden Lanka became Ravana’s palace.

පිවිතුරු හෙළ උරුමය ප්‍රචාරක ලේකම් නීතිඥ තුෂාර දිසානායක මහතා අදහස් දක්වමින්

පොලිස්පති සිය තනතුරේ වගකීම් නියමිත පරිදි ඉටු කර නැහැ

අප අද ජාතික පොලිස් කොමිෂන් සභාවට පැමිණිල්ලක් ගොනුකළා ජනාධිපති මෛත්‍රීපාල සිරිසේන මැතිතුමන් සහ හිටපු ආරක්ෂක ලේකම් ගෝඨාභය රාජපක්ෂ මැතිතුමන් ඝාතනය කිරීමේ තැත සම්බන්ධයෙන් පොලිස්පතිවරයා සහ ශ්‍රී ලංකා පොලීසිය කටයුතු කරන ඇල්මැරුණු ස්වභාවය සම්බන්ධයෙන්.

විශේෂයෙන් මෙවැනි සාපරාධී ක්‍රියාවක්, දණ්ඩ නීති සංග්‍රහයේ 114 සහ 115 වගන්තීන් යටතේ වන රාජ්‍ය විරෝධී වරදක්. ඒසම්බන්ධයෙන් චෝදනා ලැබ සිටින්නේ ශ්‍රී ලංකා පොලීසියේ නියෝජ්‍ය පොලිස්පතිවරයෙකු වන නාලක ද සිල්වා මහතායි. එතුමා සක්‍රීය පොලිස් සේවයේ නියුක්ත ව සිටිය දී එතුමන්ට මෙවැනි චෝදනාවක් එල්ල වී තිබෙනවා. එතුමන්ව අත්අඩංගුවට ගැනීමක් අද මේ වනතුරුත් සිදු වී නැහැ. සක්‍රීය පොලිස් සේවයේ නියුක්තව සිටින නියෝජ්‍ය පොලිස්පතිවරයෙක් සාක්ෂිකරුවන්ට බලපෑම් කරන්න විමර්ශන කටයුතුවලට අතපොවන්නට හැකියාව තිබෙනවා. එබැවින් මෙවැනි දරුණු චෝදනාවක් හමුවේ පොලීසිය විසින් කටයුතු කරනු ලබන ආකාරය පිළිබඳ විවේචනය තමයි අපි ජාතික පොලිස් කොමිෂන් සභාව වෙත ඉදිරිපත් කරනු ලැබුවේ.

විශේෂයෙන්ම තමන්ගේ ධුරයේ රාජකාරි කටයුතු නිසි පරිදි ඉටු නොකිරීම සම්බන්ධයෙන් පොලිස්පති පූජිත ජයසුන්දර ද අද වගඋත්තරකරුවෙක් වෙනවා. ඒ නිසා පොලිස්පති පූජිත ජයසුන්දර මහතා තම ධූරයේ කර්තව්‍යයන් නියමිත පරිදි ඉටු නොකිරීම සහ පැහැර හැරීම සම්බන්ධයෙන් 2002 අංක 5 දරන නිලධාරීන් ඉවත් කිරීමේ කාර්ය පටිපාටි පනත යටතේ නිර්දේශයක් කරන්න කියන ඉල්ලීම කොමිසමේ සභාපති වරයා වෙත ඉදිරිපත් කළා.

මේ රටේ ප්‍රධානතම පුරවැසියා මේ රටේ රාජ්‍ය නායකයා වන ජනාධිපතිවරයා ඝාතනය කිරීමේ තැතක් ඒවාගේම හිටපු ආරක්ෂක ලේකම් ගෝඨාභය රාජපක්ෂ මහතා ඝාතනය කිරීමේ තැතක් ශ්‍රී ලංකා පොලීසිය ඉතාමත්ම  ලුහුඩු ආකාරයෙන් කල්පනාවට ගැනීම පිළිබඳව සහ විමර්ශන කටයුතු ඉබිගමනින් සිද්ධ වීම පිළිබඳව පුරවැසියන් විදිහට අපට විශාල ගැටලුවක් තිබෙනවා. රටේ ප්‍රධානතම පුරවැසියා වන රාජ්‍ය නායකයාටත් පොලිසිය දක්වන්නේ මෙවැනි සැලකිල්ලක් නම් ජනතාව කෙරෙහි පවතින්නේ කුමන තත්ත්වයක් ද යන යෝධ ප්‍රශ්නාර්ථය අපිට තියෙනවා.  ඒ නිසා මේ සම්බන්ධයෙන් සක්‍රීයව මැදිහත් වෙන්න කියන ඉල්ලීම තමයි ජාතික පොලිස් කොමිෂන් සභාවෙන් අප ඉල්ලා සිටින්නේ.

ත්‍රස්ත විමර්ශන කොට්ඨාසය භාර නියෝජ්‍ය පොලිස්පති නාලක සිල්වාට එරෙහිව චෝදනා පිළිබඳව සිදු කෙරෙන පරීක්ෂණ අපක්ෂපාතී වීමට නම් පොලිස්පති පූජිත් ජයසුන්දර සිය ධුරයෙන් ඉල්ලා අස් විය යුතු බව පිවිතුරු හෙළ උරුමයේ නායක පාර්ලිමේන්තු මන්ත්‍රි උදය ගම්මන්පිල පසුගියදා කෑගල්ලේදී පැවැසීය.

හිටපු අමාත්‍ය රක්ෂිත බන්ධනාගාරගත වී සිටින ජොන්ස්ටන් ප්‍රනාන්දු මහතා බැලීමට කෑගල්ල බන්ධනාගාරයට පැමිණ කෑගල්ල කුරුලු කැලේ හෝටලයේ විශේෂ මාධ්‍ය සාකච්ඡාවක් පවත්වමින් වැඩිදුරටත් අදහස් දක්වමින් මෙසේ පැවැසීය.

නියෝජ්‍ය පොලිස්පති නාලක ද සිල්වා ජනාධිපති මෛත්‍රිපාල සිරිසේන මැතිතුමාත්, ගෝඨාභය රාජපක්ෂ මැතිතුමාත් ඝාතනය කිරීමේ කුමන්ත්‍රණයක යෙදී සිටින බවට සාක්ෂි හෙළි වෙලා මේ වන විට පැය 48කට වැඩියි. නමුත් ඒ සම්බන්ධයෙන් මේ දක්වා කිසිම පියවරක් අරන් නැහැ

. ඔහු අත්අඩංගුවට ගන්න පොලිසිය කටයුතු කරලත් නැහැ. නමුත් පුංචි චෝදනාවක් භික්ෂුන් වහන්සේ නමකට එහෙමත් නැත්නම් රණවිරුවකුට, විපක්ෂයේ දේශපාලනඥයකුට එල්ල වුණොත්, ක්ෂණිකව පුද්ගලයා කුදලාගෙන ගිහින් කූඩුවේ දාන පොලිසිය මේ අවස්ථාවේ නිහඬව සිටින්නේ ඇයි කියන එක සමස්ත ජාතියටම ප්‍රශ්නයක්.


පොලිසියේ ඉහළ නිලධාරියෙක් අතින් වරදක් වුණාම ක්ෂණිකව ක්‍රියාත්මක වීමේ කොන්දේසියක් තිබෙනවා. පොලිසියේ ඉහළ නිලධාරියකුට සාක්ෂිකරුවන්ට බලපෑම් කරන්න පුළුවන්. සාක්ෂි විනාශ කරන්න පුළුවන්. මේ සියල්ලටම වඩා පරීක්ෂණය පවත්වන පරීක්ෂකයාටත් බලපෑම් කරන්න පුළුවන්.

ඒ නිසා මුලින්ම සිදුවිය යුත්තේ නාලක ද සිල්වා අත්අඩංගුවට ගෙන රක්ෂිත බන්ධනාගාරගත කිරීමයි. ඒ විතරක් නෙවෙයි මේ පුද්ගලයා කවට පොලිස්පතිවරයාගේ සමීපයෙක්. ඒ නිසා මොහුට විරුද්ධව මීට පෙර පැමිණි සෑම චෝදනාවෙන්ම ඔහු බේරා ගන්න පොලිස්පතිවරයා කටයුතු කළා.

අපිට මතකයි මේ නාලක ද සිල්වා තමයි දිගන සිද්ධිය පිළිබඳව මහ සොහොන් බළකාය ගැන බොරු කතාවක් හදලා මේකට පටලවලා බොරු සාක්ෂි ගොනු කරලා මහ සොහොන් බළකාය ඇතුළු කිසි දේකට නැති අහිංසක සිංහල අය දෙසිය ගණනක් රක්ෂිත බන්ධනාගාරගත කෙළේ. ඒ වගේම මේ නාලක ද සිල්වා තමයි කිරිබත්කුඹුරේ සෝභිත හිමියන්ට උදරයට පා පාරක් එල්ල කෙළේ.

ඒ වගේම මහ සොහොන් බළකායේ නායක අමිත් වීරසිංහ බැලීමට අනුරාධපුර බන්ධනාගාරයට ගිය වේලාවේ ඔහු මට අපූරු කතාවක් කීවා. අමිත් වීරසිංහට නියෝජ්‍ය පොලිස්පති නාලක සිල්වා මහතා පවසනවා මේ දිගන සිදුවීම පිටුපස ඉන්නේ ගෝඨාභය රාජපක්ෂ මහතා යැයි කියලායි ප්‍රකාශයක් දුන්නොත් ඔබ නිදහස් වෙනවා පමණක් නෙවෙයි ඔබට පවුල පිටින් විදේශ රටක පදිංචි වීමේ පසුබිමත් මම සකස් කරලා දෙනවා කියලා.

මේ කාරණයෙන් ඉතා පැහැදිලියි නාලක ද සිල්වා කියලා කියන්නේ ගෝඨාභය රාජපක්ෂ විරෝධයෙක් බව එවැනි පුද්ගලයෙක් මෙවැනි කුමන්ත්‍රණයක යෙදුණු බවට සාක්ෂි මතු වුණොත් එය සාධාරණව විශ්වාස කිරීමේ පසුබිම අපිට ලැබෙනවා. මේ සෑම අවස්ථාවකම මේ නාලක ද සිල්වා මහතා බේරා ගැනීම කටයුතු කළේ ඔහුගේ පොලිස් ගුරුවරයා හා සමීපතමයා වන පොලිස්පති පූජිත් ජයසුන්දර. ඒ නිසා පූජිත් ජයසුන්දර මහත්මා පොලිස්පති සේවයේ සිටින තෙක් මේ පරීක්ෂණය අපක්ෂපාතීව ස්වාධීනව සිදු වේවි සාධාරණය ඉටු වේවි කියලා බලාපොරොත්තුවක් අපිටද තබන්න බැහැ.

ජනාධිපතිවරයා ඝාතනය වුණොත් එහි අනියම් වාසිය ලැබෙන්නේ අගමැතිවරයාට. ඒ නිසා මේ කුමන්ත්‍රණය නිසා අගමැතිවරයාටත් ඇඟිල්ල දිගු වන්නට ඉඩ තිබෙනවා. ඒ නිසා අගමැතිවරයා කළ යුත්තේ පොලිස්පතිවරයාට ඉල්ලා අස් වෙන්න දැනුම් දීලා තමන්ගේ පක්ෂයේ අමාත්‍යවරයෙක් අතේ තියෙන පොලිසියෙන් මේ පිළිබඳ ස්වාධීන අපක්ෂපාතී පරීක්ෂණයක් සිදු වෙනවා දැයි සොයා බැලීම තහවුරු කරගෙන ඒ හරහා තමන්ගේ නමත් පිරිසුදු කර ගැනීමයි.

ජනාධිපති මෛත්‍රිපාල සිරිසේන මහතාගේ ජීවිත ආරක්ෂාව ඇතුළුව රටේම ආරක්ෂාව බරපතළ ලෙස අවදානමකට ලක්ව තිබෙන නිසා පොලිසිය භාර අමාත්‍යාංශය වහාම ජනාධිපතිවරයා යටතට ගතයුතු බවට යෝජනාවක් ජනාධිපතිතුමා වෙත ඉදිරිපත් කිරීමට ශ්‍රී ලනිපයේ කණ්ඩායමක් තීරණය කර ඇති බව පාර්ලිමේන්තු මන්ත්‍රි එස්.බී. දිසානායක ප්‍රකාශ කරයි.

ජනාධිපතිවරයාගේ ජීවිතයට තර්ජනයක් වන ආකාරයෙන් නියෝජ්‍ය පොලිස්පතිවරයකු කර තිබෙන ප්‍රකාශය ඉතා බරපතළ බවත් අග්‍රාමාත්‍යවරයාගේ උපදෙස් අනුව ක්‍රියාකළ යුතු බව පවසමින් එම නියෝජ්‍ය පොලිස්පතිවරයා ප්‍රකාශ කිරීම ඉතා බරපතළ තත්ත්වයක් බවත් ඔහු පෙන්වා දුන්නේය.

මීට අමතරව ආරක්ෂක මාණ්ඩලික ප්‍රධානියාගෙන් පොලිසිය ප්‍රශ්න කිරීමට සූදානම් වීම, සරත් ෆොන්සේකා අමාත්‍යවරයා යුද හමුදාපතිවරයාට ‍ෙදාස් පැවරීම යන කාරණා මඟින් ආණ්ඩුව තුළ බරපතළ බෙදීමක් දක්නට තිබෙන බවත් මෙය ආණ්ඩුවේ ඉදිරි ගමනට ඉතා අහිතකර තත්ත්වයක් බවත් දිසානායක හිටපු ඇමැතිවරයා සඳහන් කළේය.

පවතින මේ අර්බුදය තවදුරටත් ඉදිරියට යන නිසා ශ්‍රී ලංකා නිදහස් පක්ෂයට ජාතික අණ්ඩුවෙන් ඉවත් වීමට කාලය එළැඹී තිබෙන බවත් එම තීරණය ගන්නා තෙක් අමාත්‍යාංශ කිහිපයක් ජනාධිපති වෙත පවරා ගැනීම ඇතුළු කරුණු කිහිපයක් දෙස ජනාධිපතිවරයාගේ අවධානය යොමු කිරීමට බලාපොරොත්තු වන බවත් ඔහු සඳහන් කළේය.

1989 වසරෙන් පසුව රටේ අග්‍රාමාත්‍යවරයා නොමැති අවස්ථාවක හදිසි අමාත්‍ය මණ්ඩල රැස්වීමක් කැඳවීමට ජනාධිපතිවරයා පියවර ගැනීමෙන්ම ආණ්ඩුවේ වර්තමාන අර්බුදය ඉතා හොඳින් පෙන්නුම් කෙරෙන බවද දිසානායක මහතා ප්‍රකාශ කළේය.

මේ මස 19 වැනිදා පක්ෂයේ නායක ජනාධිපතිගේ ප්‍රධානත්වයෙන් පැවැත්වෙන ශ්‍රී ලංකා නිදහස් පක්ෂයේ මධ්‍යම කාරක සභා රැස්වීමේදී මෙම කරුණු ගැන සාකච්ඡා කිරීමට කණ්ඩායමක් සූදානමින් සිටින බවද දිසානායක මහතා ප්‍රකාශ කළේය.

 

ආණ්ඩුක්‍රම ව්‍යවස්ථාව වෙනස් කර බලය බෙදන්න යෝජනා කරන්නේ ඇමෙරිකාවයි

දෙනගම ධම්මික රණවීර  උපුටාගැණීම  මව්බිම

ආණ්ඩුක්‍රම ව්‍යවස්ථාව වෙනස් කොට ශ්‍රී ලංකාවේ බලය බෙදන්න යෝජනා කරන ඇමෙරිකා එක්සත් ජනපදය තම රටේ ව්‍යවස්ථාවට පිටින් ජාත්‍යන්තරයෙන් එන කිසිදු නියෝගයක් භාර නොගන්නා බව ප්‍රකාශ කරනවා යැයි ආචාර්ය නාලක ගොඩහේවා ප්‍රකාශ කෙළේය.

හෙතෙම එම අදහස් පළ කළේ ජගත් ශ්‍රී ලාංකික එකමුතුව ඕමානයේ මස්කට් නුවරදී පසුගියදා සංවිධාන කොට තිබු සම්මන්ත්‍රණයකට සහභාගි වෙමින්ය.
ආචාර්ය නාලක ගොඩහේවා වැඩිදුරටත් මෙසේද පැවැසීය.

මේ වන විටත් ස්විස්ටර්ලන්තයේ ජිනීවා නුවරදී එක්සත් ජාතීන්ගේ මානව හිමිකම් සමුළුවේ 39 වැනි සැසිවාරය පැවැත්වෙනවා. එම සභා වාරයට සමාන්තරව ජර්මනිය, බි්‍රතාන්‍ය, මැසිඩෝනියාව සහ මොන්ටි්‍රයෝ යන රටවල් හතර විසින් ශ්‍රී ලංකාව සම්බන්ධයෙන් ඒකාබද්ධ නිවේදනයක් නිකුත් කොට තිබෙනවා. ශ්‍රී ලංකාවේ නව ආණ්ඩුව 2015 සිට ජාතික සංහිඳියාව හා සාමය වෙනුවෙන් ප්‍රමුඛතා සැලැස්මකට අදාළ තීරණ ගැනීමේදී එක්සත් ජාතීන්ගේ සංවිධානය සමඟ නිරන්තරයෙන් සම්බන්ධ වී කටයුතු කිරීම ගැන තමන් සතුටු වන බවත් එහි සඳහන් වෙනවා. අතුරුදන් වූවන් පිළිබඳ කාර්යාලයක් පිහිටුවීම ගැන ප්‍රශංසා කරන අතර හමුදාවන්ට අයත් තව තවත් ඉඩම් සිවිල් වැසියන්ට ලබා දීම වේගවත් කිරීමට නව ආණ්ඩුවේ ඇති කැපවීම අගය කරන බවත් කියැවෙනවා.

කෙසේ වෙතත් හවුල් ආණ්ඩුව විසින් යුද්ධය සමයේ හානි වූවන්ට වන්දි ගෙවීම් කාර්යාලයක් වහාම පිහිටුවිය යුතු බවත් එහි වැඩිදුරටත් දැක්වෙනවා. එසේම 2015 සම්මත වූ 1/30 ජිනීවා යෝජනාවට අනුව සුළු ජාතීන් අතර විශ්වාසය තහවුරු කිරීම සඳහා වගවීමේ ක්‍රියාවලිය තහවුරු කිරීමටත් ත්‍රස්තවාදය වැළැක්වීමේ පනත අවලංගු කිරීමටත් නව ආණ්ඩුව පොරොන්දු වූ බව මතක් කරන මේ රටවල් ශ්‍රී ලංකාව තුළ ව්‍යවස්ථා වෙනසක් හරහා බලය විමධ්‍යගත කිරීම කඩිනම් කළ යුතු බවත් අවධාරණය කර තිබෙනවා. මේ රටවල් මේ ආකාරයට ශ්‍රී ලංකාවේ ස්වෛරීත්වයට ඇඟිලි ගැසුවද වෙනත් රටවල ස්වෛරීත්වයට අභියෝග කරන්න හැකියාවක් නැහැ.

ශ්‍රී ලංකාව සම අනුග්‍රාහකත්වය දුන් 1/30 ජිනීවා යෝජනාව ඇමෙරිකාව මූලිකව ඉදිරිපත් කරන ලද්දක්. ඒත් ඇමෙරිකාව ඔවුන්ගේ රණවිරුවන් සම්බන්ධයෙන් නම් අනුගමනය කරන්නේ මීට හාත්පසින්ම වෙනස් පිළිවෙතක්. උදාහරණයක් ලෙස දැනට දින කිහිපයකට පෙර ඇමෙරිකා ජනාධිපති ඩොනල්ඩ් ට්‍රම්ප්ගේ ආරක්ෂක උපදේශකවරයකු වන ජෝන් බෝල්ටන් ප්‍රකාශයක් කරමින්, තමන්ගේ රටේ රණවිරුවන් ගැන ප්‍රශ්න කරන්නට ආවොත් එක්සත් ජාතීන්ගේ සංවිධානයේ අනුග්‍රහයෙන් පවත්වාගෙන යන ජාත්‍යන්තර අධිකරණවලට හොඳ පාඩමක් උගන්වන බවට තර්ජන කළා. ඒ වගේම එම අධිකරණ පවත්වාගෙන යෑමට මුදල් ආධාර දීම නවතා දමන බවත් ඒවායේ විනිසුරුවරුන්ට ඇමෙරිකාවට ඇතුළුවීම තහනම් කරන බවත් ප්‍රකාශ කළා.

යම් විනිසුරුවරයකුගේ වත්කම් ඇමෙරිකාවේ ඇත්නම් ඒවා රාජසන්තක කරන බවටත් තර්ජනය කළා. එමෙන්ම ඇමෙරිකාව අන්තර්ජාතික අධිකරණය පිළිනොගන්නා බවද තමන් ක්‍රියා කරන්නේ ඇමෙරිකාවේ නීතිය අනුව බවද තම රටේ ව්‍යවස්ථාවට උඩින් එන කිසිදු උපදෙසක් භාර ගැනීමට ඇමෙරිකාව සූදානම් නැති බවද ඔහු ප්‍රකාශ කළා.
ඇමෙරිකාව ගැන ඒ විධියටම හිතන ඇමෙරිකාව 2015 සැප්තැම්බර් මාසයේ ජිනීවා මානව හිමිකම් කවුන්සිලයට ඉදිරිපත් කළ ‘ලංකාවේ නීති පද්ධතිය වෙනස් කරන ලෙසත් රණවිරුවන් ගැන පරීක්ෂණ පවත්වන ලෙසත් බල කරනවා.

එමෙන්ම යුද සමයට අදාළ නඩු ඇසීමට ජාත්‍යන්තර විනිසුරුවරුන් පත් කරන ලෙසත් ලංකාවේ බලය ව්‍යවස්ථාව හරහා බෙදන ලෙසත් කියනවා. අද උතුරේ සම්පන්දන්ලා, විග්නේශ්වරන්ලා බල කරන්නේ එම යෝජනා ක්‍රියාත්මක කිරීමටයි. ජාත්‍යන්තරය යැයි කියා ගන්නා බටහිර රටවල් කිහිපයක උපදෙස් මත රට පාලනය කරන්නට උත්සාහ කරන ශ්‍රී ලංකාවේ වත්මන් ආණ්ඩුවේ නිවට නියාලු හැසිරීම වටහාගන්න එවැනි උදාහරණ ප්‍රමාණවත්.

 

YAHAPALANA AND TRANSPORT

Yahapalana is meddling with the transport sector, from expressways to trishaws. Yahapalana said it plans to have a network of expressways. Twenty-four Road Development Authority trade unions, including the UNP-allied Jathika Sevaka Sangamaya and the SLFP-allied Sri Lanka Nidahas Sevaka Sangamaya, had sent a petition to Highways Minister in 2017, opposing the proposal to develop an expressway network. The development of the expressway network will lead to a steep increase in the number of users. If privatized, the income will go to private parties, not the government, they said.

In September 2017 the Road Development Authority Engineers’ Association (RDAEA) strongly criticized the Yahapalana plan to give the management of existing and future expressways to an international company. These expressways generates income and do not warrant privatization, the Association said. Yahapalana was going to use the advance payment received from the international company to complete three other expressways. The RDAEA had come to know of this, only through a draft newspaper advertisement that they happened to see. Using the Right to Information Act the Association has asked for copies of all documents, including Cabinet papers, for scrutiny.

The RDA has a deposit of five billion rupees with the Expressway Operation, Maintenance and Management Division, which is intended for use in periodic maintenance of expressways, said the RDAEU. Yahapalana government wishes to use around Rs 4 billion of this to settle contractor bills of other divisions. These were projects where the tenders and work orders had been issued, beyond budget allocations. The union has, once again, invoked the RTI Act to obtain information, inter alia, on tenders and work orders; works issued/attended by Construction Division and EOMM Division; and any other special works including estimate amounts and tendered amounts; and money availability according to the approved programme for 2017, including non-RDA roadworks.

However, Yahapalana intends to proceed with its expressway. They include an expressway to the North Western Province, and a road and rail network in the North Central Province leading to Trincomalee port. 2017 Budget said Highway lanes would be reduced from six to four.

There would also be a Ratnapura expressway from Kahatuduwa to Pelmadulla via Horana for 73.9km.  This would start with Chinese assistance in 2016. In March 2017, media reported; ‘The Highways Ministry is proceeding with plans for the Ruwanpura Expressway amidst serious concerns regarding its feasibility and environmental impact. As far as I know, there is no design, no completed feasibility study, no approval by the National Physical Planning Department, no approved EIA, no modeling, and nothing done,” said one senior official, reported the media.

The National Physical Planning Department (NPPD) of the Ministry of Megapolis and Western Development had also voiced strong concerns about the proposed Ruwanpura Expressway.   The trace cuts through the central fragile areas” that are identified as crucial to conservation of the country’s water sources concluded the media report.

Yahapalana inherited the Northern expressway, started by former President Mahinda Rajapaksa. Yahapalana   converted it into a Central Expressway from Colombo to Kandy, to be completed in four phases. Phase 1, Kadawatha to Mirigama, Phase 2, Mirigama and Kurunegala, Phase 3, Potuhara to Galagedara and Phase 4 Kurunegala to Dambulla.   Yahapalana decided to avoid Phase 1 Kadawatha to Mirigama and Phase 4 Kurunegala to Dambulla and start on Phase 2 Mirigama to Kurunegala, with a link road joining from Ambepussa and phase 3 Potuhara to Galagedara of the Central Expressway Project

The Central Expressway, from Colombo to Kandy had met with much opposition and criticism. No one seems to like this Expressway and there were many objections. The NPPD  called for a detailed study regarding the traffic impact on Galagedara town as  Phase 3 was likely to discharge all Kandy-bound traffic in that area.

The Mechanical Engineering Sectional Committee of the Institution of Engineers in association with the Sri Lanka Society of Transport & Logistics held a panel discussion in November 2017, on the subject.

The Panel questioned the need for an expensive four lane expressway with interchanges for Kandy. This will create new problems of congestion in the Kandy area. It will not connect Kandy in one hour because the traffic will increase. Railway access plus a two-lane highway can be built for what is being proposed to be spent on a four-lane expressway and the travel time would be at the most 115 minutes. It was better to drop the idea and implement Phase 3. An 80 kmph two-lane highway from Potuhera to Galagedera would reduce the projected cost by at least 60 percent and the travel time difference will only be 5 minutes,” a four lane highway from Kurunegala to Galagedera would also have been less expensive.

The panel said that an intercity express railway network to Kandy which can be extended to other cities would provide superior mobility to the hill capital at a fraction of the cost. It will cost less and is the path followed by many countries today. The availability of different access modes to railway stations will make door to door travel not only fast, but comfortable and economically sustainable.” The panel showed studies of four different railway traces from Rambukkana to Kandy for a new line capable of connecting Kandy from Colombo within 90 minutes.

Critics said that Central Environmental Authority (CEA) approved implementation of the complex project without waiting for the outcome of a series of vital geological surveys and tests. The project is being implemented without due consideration for the National Physical Plan which expressly sought to discourage urbanization of hill areas to prevent natural disasters, critics added.  The Government said it has commissioned Nippon Export and Investment Insurance (NEXI) to carry out an environmental and social due diligence for phase III.

The financing of Phase 3 came under question. Japan offered to finance it. The tenderers were Taisei Corporation, Penta Ocean Construction   and Wakachiku Construction. Taisei did not submit the bid security and other two companies did not participate in the bidding process. The Government of Japan introduced a fourth bidder M/s Fujita Corporation. Taisei and Fujita were to form a Consortium for the project.  Cabinet agreed. It was then observed that the officers of Taisei Company were in prison in Japan.

Television news of 19/10/17 showed those losing their lands to phase 3 demonstrating violently   as   land acquisition has started. Land acquisition of 107,975 perches or 674.8 acres was to be done under Section 38(a) of the Land Acquisition Act. This allows for immediate possession of such land on the ground of urgency” Land is vested with the State within 48 hours with compensation to be paid at a later date. Such urgent acquisition absolves the acquiring agency from hearing objections to the project.It is not clear why Section 38(a) is being employed for CEP III when the project has been in the pipeline for years.

There would be a huge human cost, said critics. From a people’s point of view, we are heading for disaster” said resettlement experts. The Road Development Authority’s (RDA) resettlement action plan” (RAP) to minimize effects of massive displacement from phase  iii is riddled with holes and spells disaster for the affected parties, experts said.

Thousands of people will be impacted     According to available data, 6,432 people from 1,742 families will be affected. There are 624 people living in the road corridor; 2,098 agricultural landowners; and 25 entrepreneurs. The majority of them will be permanently affected.  There are a large number of vulnerable households with no clear statement of support, No resettlement sites are identified.

Land owners, unaware of the need to state replacement cost have given relatively low estimates for their structures,” analysts said. Among the residential houses, the majority of them (160) believe that they need Rs. 5-10 million to replace their housing structures. Many others have given lower amounts as the replacement cost for their houses.”

There will  also be a major impact  on coconut cultivation with around 25,351 trees expected to be affected. 28,962 perches or 162 acres of paddy will also be affected. The second category of crop will be paddy in 28,962 perches or 162 acres. About 463 government properties will be hit, it says, in addition to 35 facilities like community centers, common wells and cemeteries.

Phase 4 is  also causing much concern. .It is common practice in Sri Lanka to build expressways on embankments built with soil brought from elsewhere. This filling up process requires 120,000 cubic meters of soil for a km. The gargantuan volumes of soil and boulders needed for the building of highways are supplied through razing of hillocks and excavating large pits in the interior of the country, observed Prasanna Coorey.

Structurally, this model, while fragmenting the land along the course of the expressway, that includes the ecologically sensitive areas like the wetlands and forests, has also given rise to a number of environmental (and social) problems by directly contributing to the flood debacle that we have come to experience lately.  Some of the areas affected are Idulgoda kanda, Kaduruk Kanda, Tampana, Konpola, Rokke Kanda.

Ven. Wekadawela Rahula  of Centre for Environmental and Nature Studies (CENS), who is also in the forefront of the campaign to protect the Kurunegala environment said, “This mountain range is situated three to four km from Henamulla. All these belong to the western boundary of the central hills of the country. Tampana, in particular, is a great water store. It is always soaked with water. All the water that falls down these mountains during the rains, then collect into the Venru wewa. In future, when Venru wewa reaches its spill level the water will again collect like in a tank, formed by the raised earth embankment of the expressway, worsening the floods situation in Kurunegala”.

During the last couple of weeks, the outskirts of Kurunegala town has been a hotbed of agitation against the Central Expressway Project  said the media in  October 2017. The process of acquiring land for the Phase 4  Kurunegala – Dambulla stretch of the proposed Central Expressway had caused great inconvenience to the respective land owners in Dambulla, said Athuparayaya Bodhirukkarama Viharadhipati Ven. Aluthgama Upananda ,  Patron of the Union of landowners surrendering properties for the Expressway.

Ven. Aluthgama Upananda  also  said that   problems had arisen regarding the payment of compensation to the acquired land which they discovered after discussions with officers of the Dambulla Divisional Secretariat and higher officials. Compensation payments relevant to the Dambulla Vihara’s rajakariya land was being paid to the Buddhist Affairs Commissioners Department  and not to tenant residents in the lands.

There had been no response as to the procedure adopted regarding the takeover of state lands where people were residing, either.  Since the majority of people resident in lands to be taken over were living under deep mental distress, authorities should either resolve this problem in a fair and just manner and inform them in writing about the procedure adopted in this connection.

“The lands for the construction of the expressway were identified and surveyed in 2014 during the tenure of the last government. We had meetings with the authorities then and we were told that the expressway will be built on pillars. They then categorically said it won’t be built on ground fill. They said that for land lost we will be paid compensation for 20 years ahead, and for a coconut palm, depending on the pluck, for five years ahead. Likewise, compensation was determined for paddy lands and other plantations. They were the very same officials as now. Now they deny that they ever said these. There has been ax sudden change in the stance of the authorities.

“On June 27 . 2017 the RDA told us the road will be built on a ground fill and not on pillars as we were told before. The height of the ground fill will be 20 feet, and 26 feet in some places.”We sent a petition to the President, with copies to the Prime Minister, Minister of Highways, Central Environment Authority (CEA), Agrarian Services Commissioner and 10 other institutions.. Then we had a meeting with a representative of the PM’s office. He told us the project is now planned to be built on ground fill. Any consequences, like floods, could be seen only after the completion of the project. And he tells us that’s development.

It is not practical to operate buses according to the timetables given by the National Transport Commission, said Kandy-Colombo Luxury Bus Services Association in October 2017. The time tables were impractical and both bus owners and commuters will fall into difficulties if buses are operated according to them. They  had been prepared by persons who had no knowledge of bus operations.

Buses could not be operated according to such impractical timetables, according to the new timetable, a luxury bus leaving Colombo at 5.15 am should reach Kandy at 8.30 am and it should be parked in the bus terminal at 9 am to start the return journey to Colombo at 9.20 am. Accordingly, a bus should cover the Colombo-Kandy trip in 3 hours and 13 minutes and only half an hour is available for the bus crew to have breakfast and morning ablutions. This was quite impractical.

Although an appointment was sought from the Chairman through Higher Education and Highways Minister to discuss matters, there had been no response from him on two such occasions, bus representatives said. Even though finally an opportunity for a discussion was given last week, the Chairman ended up avoiding it too saying he had no time. Chairman should take responsibility if commuters faced any accident when drivers operated under pressure according to the present timetable,  said the Association .

Yahapalana  has also  made an impact on the purchase of cars. In its 2016 Budget, Yahapalana  gave concessions for cars running on helium and nitrogen. No one was interested. Under the pretense of being environment conscious they are hitting at petrol and diesel vehicles, said critics.

In the 2018 budget, this became a reality. The ad-valorem rate was removed and  a tax based on engine capacity was introduced for cars.  There is no sense in a taxation formula based on engine capacity, said critics . A vehicle is usually assessed for tax on its power and the cost of production and not the cubic capacity of the  engine.. This decision  reduced the purchase of small cars while encouraging the purchase of luxury cars.

With the tax based on engine capacity, the duty on small cars promptly went up. The average citizen now cannot   purchase a car, it is too expensive, observed critics. Yahapalana explanation was that vehicle import duty reductions had led to increased imports of small cars which resulted in massive foreign exchange outflows and worsened traffic congestion in cities.

However, the removal of the ad-valorum calculation made the super luxury category cheaper. It practically subsidized the duty on super luxury cars. There  was an influx of luxury cars into the country, of the brands such as Ferrari, Lamborghini, Porsche, Bentley, Range Rover, Mercedes, BMW and Audi. Most of the luxury cars and SUVs were brought in using duty concession permits which are openly sold by permit holders, said critics.

Many super luxury vehicles imported hurriedly after the relaxation of tax on them have already been cleared from the port and there are many more on the way, some by air said observers. Over 100 super luxury cars had been cleared from the port causing losses of billions of rupees to the government and over 400 units are in shipments that will arrive in the country in the next few weeks   analysts said in January 2018.

A European made model X with a CIF value of Rs.5 million (taxed at 130 per cent) will be charged with the same duty of a Japanese made model X with a CIF value of Rs.2 million (taxed at 300 per cent) thus depriving the government of a duty income of around Rs.7-10 million per vehicle. The country is  losing around Rs 25-40 million from each of these vehicles. The loss projected for the next 12 months based on 5,000 vehicles at an average of Rs 20 million per vehicle would be in excess of Rs100 billion, said analysts in January 2018.

Further, the new system creates opportunities for siphoning out money from the country as the CIF value is now not considered for duty calculations, thus aiding money launderers and anyone who wish to send money out of the country.

The increase in duty on motor vehicles less than 1000cc has been necessary in the short run to arrest the deteriorating trade deficit,  said Central Bank Governor.  The deterioration in the trade deficit was about USD 716 million over the first five months of this year. Of the amount, USD 350 million can be attributed to the increase in vehicle imports. From January to May, vehicle imports as a percentage of total imports was 6.9 percent and as a percentage of non-oil imports it was 8.5 percent,” he said.

The Rajapaksa government had encouraged the use of electric vehicles by offering a concessionary duty rate. The number of registrations of electric motor cars in 2015 was  3238. But  Yahapalana raised the duty,  and  the figure plummeted to 983 in 2016 and 161 at July 2017. Yahapalana then reduced duty but  buyers were wary and did not buy. Not a single high quality electric vehicle has been imported to the country, said analysts in February 2018. Vehicle importers cannot afford the high price. A company which had specialized in electric vehicles crashed.

Yahapalana  first said it would  be reducing taxes on electric cars by 25 percent. The duty reduction was first  given only to brand new electric cars. Later this was extended to electric vehicles ‘used up to one year’. This was not sufficient, said Vehicle importers Association. Yahapalana also proposed  bank loans to buy 1,000 electric cars in the Colombo district and  said that  50 percent of the cost will be borne by the government. This was not done either. 2018 Budget  had a proposal to increase the leasing facility for electric and hybrid vehicles,  from 50% to 70% and up to 90% for electric vehicles,  but as at February 2018, the concession has not been enforced.

The needs  of electric cars have not been attended to either. Vital technical data relating to the car, is not included in the registration papers. Electric car batteries are heavily taxed. Used electric car batteries  cannot be imported  and there are no battery disposal schemes.

Charging points must first be installed before urging people to buy electric vehicles said critics. If  there is no charging station after 100 miles, you have to leave the car there. That is why nobody brings these in. they said. The Ceylon Electricity Board has just one electric vehicle charging station in Kelaniya ,  and that is a pilot project. Petrol  filling stations  were expected to provide chagrining services ,but only a few private operators offer such facilities.

Yahapalana  also promised a loan scheme for electric three wheelers. The tri-shaw drivers were not interested. We  can’t use  electric trishaws  they need charging points ,”  they said. Also, we cannot drive for just 100 miles, we need to drive 300- 400 miles to survive.

Yahapalana  decided to  reduce the growing trishaw service. There are 1.2 million trishaw drivers in Sri Lanka , far more than is needed for a small island of 21 million, said Yahapalana. Out of the 7.8 million employed populations, 1.2 million are estimated to be three– wheeler drivers. This is a staggering 15.4 percent of the working population.

But analysts pointed out that   less than         500,00 engage in full time  tri shaw driving , Many do it  part time to supplement their income.   the average income ranges from Rs 20,000 to Rs 40,000 per month. There is no regulatory framework for this informal transport system. What you need is just a driving license and a tuk-tuk only. However, tuk tuk drivers have organized themselves into associations and trade unions, so that they can create and enforce their own regulations to defend their rights and privileges.

Immediately after leaving school or dropping out of school, they get a three-wheeler on lease and drive it to earn an income. School leavers only need 50,000 rupees for a down payment on a three-wheeler, money they can raise easily in loans from family, he added. Priyantha” was attracted to the profession after growing tired of the low pay and long hours at his regular job in a photo studio.”I saved some money and bought a three wheeler and now I am my own boss,” . I have more freedom and I earn twice as much.  They make money, and thanks to our sub-standard public transport system, there is a growing demand for tuk-tuk transportation. They spend more time idling on roads and junctions irrespective of how it blocks others’ way, complained Yahapalana .

Unless the young adults driving tuk-tuks do not realize it themselves, they have made a choice to be tuk-tuk drivers” or just drivers” for their entire life. By their own choice, they have decided to shut down any opportunity that they can have to continue with their education or to acquire skills in any vocational area. also they don’t receive any exposure to a formal world of work. Consequently, they hardly acquire discipline and soft-skills they require to progress in the working world. They haven’t worked under authority; as a result, they hardly have a sense of the importance of working under authority with respect and honor, said analysts.

The Professional Three Wheel Drivers’ Association blames Sri Lanka’s lack of vocational training for young graduates getting behind the wheel instead of taking up better paying jobs in under filled sectors.”Unless there are radical changes to prepare school leavers for gainful employment, they will take a short cut and start driving three wheelers,” the association said.

This glut of tuk-tuk drivers on Sri Lanka’s roads,  is  underutilized labor, said Yahapalana . There are 1.4 million 3 wheeler drivers. also school transport  divers are idling, from 7.30 when the children are dropped and 2.30 when they are picked up. This is waste of potential. If we continue like this we will not have young people to do any other job in the country., ” The tourist and construction industries are crying out for labor.

.The construction industry has been pushing for the national policy on the age limit for three-wheeler drivers to be implemented so that more people will join the industry. The construction industry, undergoing an unprecedented post-war boom, has been forced to turn to India, Bangladesh and Nepal for the 400,000 workers it needs to build the hotels and condominiums springing up in Sri Lanka’s cities.

In 2015 Yahapalana increased the duty on trishaws. Annually there were around 100,000 new three-wheelers registered in Sri Lanka until 2015, but  with the new import duty, In 2017 there were only 29,000 new three wheelers registered. it is no longer affordable to the lower middle class families as the average unit price has increased from around Rs. 500,000 to Rs. 750,000.

In 2017, Yahapalana  gazetted Motor Traffic Act Regulation No.01 of 2017 permitting only those over 35 years of age to be issued with driving licences for trishaws. But there were protests saying the law would hit the livelihood of millions of people who depended on trishaw driving. We suggested that the age limit should be 25 said  the Three Wheel Drivers’ Association So the youth cannot just stay at home. They will have to find some means of earning a living. Those who cannot find any other job will choose to drive three-wheelers. By 27, they would be ready to begin passenger transportation.  Yahapalana withdrew the order in August 2018.

Although three wheelers have become an irritation to road discipline and traffic order in the urban setting, their service is invaluable in urban suburbs and rural areas, especially from main roads to the interiors. The three wheel transport system is an informal” transport system for which demand has increased largely due to the sluggish performance in the formal public transport system.. There is no doubt that the three wheel fleet in the country provides a convenient mode of transportation in both urban and rural sectors agreed analysts.

We help people, said the trishaw drivers. The government is not providing any good form of transportation for the public. When there is a train or bus strike, it is we three-wheeler drivers who help people. During the last Railway strike, we dropped students sitting the A/L exam at school. We are in every junction to help people out.

Dhananath Fernando spoke up on behalf of the trishaw. I  live in Moratuwa, down Diggala road, a 2 km by-road from Keselwatta Junction on the Old Galle road,  he said. In my little hamlet, there are only two mini Lanka Ashok Leyland buses that operate in synchronization with the train time table from the Moratuwa Railway station to Diggala Road. Regardless of this inefficient bus operation, my saviors are an efficient and unique operation of tuk-tuks that cover a 2km radius from the railway station, enabling the commuting needs of the neighborhood.

In terms of the cost, the three wheelers engaged in this operation on this route only charge a ‘per passenger’ rate instead of a ‘per Km’ rate or a standard hire fare like almost all other tuk-tuks in the country. This means that each person has to only pay a fare of Rs.20 (despite the distance) and they take 3 passengers at a time in a single tuk.  In simple words, it is a three-passenger bus system operating at every 10-minutes intervals, continued Dhananath.

Their services are available until about 11.00 pm and I am very grateful to all the drivers operating their three-wheelers in the route and for providing us daily commuters with such an honorable and sustainable service. This is one, of the many services rendered by tuk-tuks that fail to reach mainstream newspaper headlines.

Hence why it worries me of the adverse impacts that would overcome the industry when strict regulations are imposed by the “National Council for Road Safety” where they plan to regulate three-wheelers to have a meter with printed bills starting from the 1st of August, 2018. On the surface it looks like a step right direction as it seems to protect a consumer using this service, but in a practical world there would be many unintended consequences said Dhananath.

Let’s analyze how these regulations would affect the tuk-tuk service in my area. If the tuks in my area were to adhere to new regulations and introduce a meter and a printed bill, they will no longer be able to charge a per passenger rate. Instead they have to charge a fare as per the standard meter rate. This results in someone like me, who initially only paid a Rs.20 for a one-way fare from the railway station to my house, now paying up to Rs.60 a ride, a price hike of 300%.

Personally, I don’t think that I should bear this extra cost for the sake of receiving a standard fare rate and a printed bill. Eventually, this will result in me limiting my usage of tuk-tuks as a consumer. I know that the demand for tuks in my neighborhood would reduce and this isn’t a phenomena only limited to my area, observed Dhananath.

Three-wheelers are not just merely a mode of transport. It means different things to those from different walks of life. For a rural commoner, it is an ambulance in a time of emergency. It is equivalent to a VIP Defender for an office worker, in a rush for his afternoon meeting. It is wedding car for a poor household. For entrepreneurs in urban and rural parts of the country, it is their mini lorry and companion. More than everything, it is an aspiration and product of pride for more than 1 million households in Sri Lanka.

A poor man has to shoulder a tax of Rs. LKR 420,000 on a tuk-tuk. This tax, is then used to fund loss making state-owned enterprises; provide for the excess of government sector employee’s salaries and pensions; and a continuing list of unnecessary provisions. It is not rare to find tuk-tuks with logos of European cars pasted on its body. You’d see “Audi” to “BMW” stickers galore in some tuk-tuks. This sends a strong message to the rest of society. To a poor man, it is his BMW and his Audi. In other words, it is his aspiration and it is his world, concluded Dhananath.

The so-called investigation into the abduction of Keith Noyahr

On the 17th of August 2018, the CID obtained a statement from former President Mahinda Rajapaksa about the 2008 abduction, assault and release of  Keith Noyahr. In the days that followed, there was an attempt on the part of government politicians, the state media, websites connected to the government and by some NGO activists, to allege or insinuate that the former President was involved in the Keith Noyahr incident. A few weeks after that, on 12 September, the CID obtained a statement from former Defence Secretary Gotabaya Rajapsksa as well, about the Noyahr incident. Thus we see that there is a surreptitious attempt to create the public perception that the Rajapaksas were responsible for this assault on a journalist. It is now ten years since this incident took place and it is important to remind the public of certain facts relating to this case.

The abduction of Keith Noyahr took place on 22 May 2008. This was followed by attacks on two more media personnel, Namal Perera and Mahendra Ratnaweera on 30 June 2008. On 8 July 2008, the then Chief Opposition Whip UNP Parliamentarian Joseph Michael Perera made a special statement in Parliament about these incidents under the title Threats to journalists” where he emphatically stated that these attacks on media persons are being carried out by a special team under the then army commander and that they had obtained this information from a person directly involved with this special team. The Army commander at the time these incidents took place was Lt. Gen. Sarath Fonseka. If a journalist faces a threat, we have to assume that it is connected to something he may have written.

In this regard, the article titled An army is not its commander’s private fiefdom” which appeared as the ‘Military Matters’ column written by Keith Noyahr on 11 May 2008 i.e. ten days before he was abducted and assaulted; is a vital clue as to who would have had a motive to attack Noyahr. However we see that the CID is deliberately trying to avoid taking into consideration Keith Noyahr’s article of 11 May 2008 and Chief Opposition Whip Joseph Michael Perera’s special statement in Parliament on 8 July 2008. We believe that the reason for this reluctance is because the person responsible for the abduction of  Keith Noyhar is a prominent member of the yahapalana government.

Instead of following the clues which may indicate who would have abducted and assaulted Noyahr, the police are engaged in a dishonest attempt to mislead the public by investigating the phone calls that are said to have been exchanged between various individuals to have Noyahr rescued. Since we cannot simply stand by and allow the CID to ignore vital clues in the purported investigation they are making, we will make a request to the police to follow up on the line inquiry that reveals itself through the article that Noyahr wrote on 11 May 2008, and the special statement that Chief Opposition Whip Joseph Michael Perera made in Parliament on 8 July 2008. If we do not receive a satisfactory response from the police to this request, we will present the relevant facts to the Courts.

පසුගිය අගෝස්තු 17 වනදා පොලිස් අපරාධ විමර්ශන අංශය විසින් 2008 දී මාධ්‍යවේදී කීත් නොයාර් පැහැරගෙන ගොස් පහර දී නිදහස් කිරීමේ සිද්ධිය පිළිබඳව හිටපු ජනාධිපති මහින්ද රාජපක්‍ෂ මහතාගෙන් එතුමාගේ නිල නිවසේදී ප්‍රකාශයක් සටහන් කරගන්නා ලදී. ඉන් පසුව ගතවූ කාළය තුළදී හිටපු ජනාධිපතිතුමා කීත් නොයාර් සිද්ධියට සම්බන්ධ බවට හැඟවෙන ආකාරයට ප්‍රකාශ නිකුත් කිරීමට ආණ්ඩුවේ දේශපාලඥයින්, ආණ්ඩුවේ ජන මාධ්‍ය, ආණ්ඩුවට පක්‍ෂපාත වෙබ් අඩවි හා රාජ්‍ය නොවන සංවිධාන කටයුතු  කරන ආකාරය අපට පෙනුනි. එයින් සති දෙක තුනකට පසුව සැප්තැම්බර් 12 වනදා පොලිස් අපරාධ විමර්ශන අංශය ගෝඨාභය රාජපක්‍ෂ මහතාගෙන්ද කීත් නොයාර් සිද්ධිය ගැන ප්‍රකාශයක් ලබා ගත්තේය.  කීත් නොයාර් සිද්ධිය කිසිවෙකුගෙත් ඇඟට නොදැනීම රාජපක්‍ෂවරුන්ගේ ගිණුමට බැර කිරීමේ උත්සාහයක් මෙයින් විද්‍යාමාන වේ. කීත් නොයාර් මහතාට පහරදීමේ සිද්ධිය මීට අවුරුදු 10කට කලින් සිදුවූවක් නිසා මෙම සිද්ධිය සම්බන්ධ වැදගත් කාරණා කීපයක් මහජනතාවට මේ අවස්ථාවේ මතක් කර දිය යුතුය.

කීත් නොයාර් මහතා පැහැරගෙන ගොස් පහරදීම සිදුකරනු ලැබුවේ 2008 මැයි 22 වනදාය. ඊට පසු 2008 ජුනි 30 වන දා නාමල් පෙරේරා සහ මහේන්ද්‍ර රත්නවීර යන මාධ්‍යවේදීන්ට ද මහමඟ පහර දෙන ලදී. 2008 ජුලි 8 වන දා මෙම සිද්ධීන්  දෙකම පාදක කරගනිමින් එකල විපක්‍ෂයේ ප්‍රධාන සංවිධායක වූ එජාප පාර්ලිමේන්තු මන්ත්‍රී ජෝසප් මයිකල් පෙරේරා මහතා ‘මාධ්‍යවේදීන්ට එල්ලවෙන තර්ජන’ යන මැයෙන් පාර්ලිමේන්තුවේ විශේෂ ප්‍රකාශයක් කලේය. මෙකී විශේෂ ප්‍රකාශයේදී ඔහු ඉතා පැහැදිලිව කියා සිටියේ මේ පහරදීමේ සිද්ධීන් දෙකම සිදුකර ඇත්තේ හමුදාපතිවරයා යටතේ සිටි විශේෂ කණ්ඩායමකින් බවත් තමන්ට ඒ සම්බන්ධ තොරතුරු එම විශේෂ කණ්ඩායමේ සාමාජිකයෙකු විසින්ම ලබාදී ඇති බවත්ය. මේ සිද්ධීන් සිදුවූ අවස්ථාවේදී යුද හමුදාපතිවරයා වූයේ ලුතිනන් ජෙනරාල් සරත් ෆොන්සේකාය. මාධ්‍යෙවේදියෙකුට යම් තර්ජනයක් එල්ල වන්නේ නම් එය ඔහු විසින් ප්‍රසිද්ධියට පත්කරන ලද යම් කිසිවක් හේතුකොට ගෙන සිදු වූවක් බව අප උපකල්පනය කළ යුතුය.

මේ සම්බන්ධයෙන් ගත්කල, කීත් නොයාර් මහතාට පහරදීමට දින 10 කට කලින් එනම් 2008 මැයි 11 වන දා ‘ද නේෂන්’ පුවත්පතේ ‘මිලිටරි මැටස්ර්’ තීරුවේ යුද හමුදාවක් යනු එහි හමුදාපතිවරයාගේ පුද්ගලික බූදලයක් නොවේ” යන මැයෙන් පලවූ ලිපියෙන් නොයාර් මහතාට පහරදීමට පෙළඹවීමක් තිබිය හැක්කේ කාටද යන්න ගැන යම් කිසි අවබෝධයක් අපට ලබාගත හැක. නමුත් මේ සම්බන්ධයෙන් විමර්ශනය කරන පොලීසිය කීත් නොයාර් 2008 මැයි 11 වන දා ලියූ ලිපියත්, 2008 ජුලි 8 වනදා විපක්‍ෂයේ ප්‍රධාන සංවිධායක ජෝසප් මයිකල් පෙරේරා මහතා පාර්ලිමේන්තුවේ කළ විශේෂ ප්‍රකාශයත් සැලකිල්ලට ගැනීම සිතා මතාම පැහැර හිරන බවක් පැහැදිලිවම පෙනෙන්නට තිබේ. එයට හේතුව අන් කිසිවක් නොව කීත් නොයාර් මහතා                පැහැරගෙන ගොස් පහර දීම සම්බන්ධයෙන් වගකිවයුත්තා වත්මන් යහපාලන ආණ්ඩුව තුළ ප්‍රබලයෙකු වන නිසාය. 

කීත් නොයාර් මහතාව පැහැරගෙන ගොස් පහරදීමට සම්බන්ධ අය පෙන්නුම් කරන සාක්ෂි සියල්ල මඟහරිමින්, නොයාර් මහතාව බේරා ගැනීමට විවිධ පුද්ගලයන් අතර හුවමාරු වූවා යැයි කියන දුරකථන ඇමතුම් ගැන විමර්ශනය කරමින්,  ඉතා වංක ආකාරයට අවධානය වෙනතකට යොමු කිරීමට පොලීසිය උත්සාහ දරමින් සිටින බව අපට පෙනේ. ඇස් පනාපිට තිබෙන සාක්ෂි මඟහැර මේ විමර්ශනය සිදු කිරීමට ඉඩ දී නිකම් සිටිය නොහැකි නිසා,  කීත් නොයාර් මහතා 2008 මැයි 11 වදා ලියූ ලිපියත්, එකල විපක්‍ෂයේ ප්‍රධාන සංවිධායක ජෝසප් මයිකල් පෙරේරා මහතා 2008 ජුලි 8 වන දා පාර්ලිමේන්තුවේ කළ විශේෂ ප්‍රකාශයත් ඔස්සේ විමර්ශනය කරන මෙන් අපි පොලීසියෙන් ඉල්ලා සිටීමට බලාපොරොත්තු වෙමු. මේ ඉල්ලීමට සතුටුදායක ප්‍රතිචාරයක් පොලීසියෙන් නොලැබුනොත්, අදාල කරුණු උසාවියේ අවධානයට යොමු කිරීමට අපි කටයුතු කරන්නෙමු.

HOW TO DESIGN A FIRE ALARM SYSTEM TO REAP BENEFITS TO THE COMMUNITY

When designing a fire alarm system to protect your building, there are many factors which you should take into consideration. Unfortunately, if you want a reliable and safe system, mere compliance with the legal requirements may not be enough. To make sure your building is protected, you should determine the primary purpose of the fire alarm while considering all the features of your building. How many people are working in it simultaneously? Is it a listed building or a modern office block or a Warehouse or an Industrial Facility? And, finally, what do you want to achieve? High cost-effectiveness or convenience in monitoring the building? Depending on your needs, there are different types of fire alarm systems that you can select.

Conventional Fire Alarm System

This traditional system is the most common choice, especially among residential clients and small business owners. It’s suitable to cover small areas such as private homes, restaurants and shops. Unfortunately, the conventional system is unable to show you the exact location of fire. That’s why it’s suitable to cover mostly small areas such as private homes, restaurants and shops. Bigger buildings can be divided into zones (for example, the first floor could be one zone, etc.) giving you a general idea of the fire location. Keep in mind, though, that a device covering each area requires a separate wire, which can increase installation costs in bigger buildings.

Despite its simplicity, conventional fire alarm systems are highly reliable. They are also affordable and cost effective, especially in small buildings, in which one or two zones are enough to cover the whole area.

Addressable System

This fire alarm system is more sophisticated compared to its conventional counterpart. Instead of a separate wire for each device, all of them are connected to the main control panel using a loop. This lowers the installation cost down, especially in large buildings. Additionally, it’s easy to find the exact location of fire as each device has its unique address in the system.

Addressable systems are quite easy to maintain because both technical condition of the system and all the alarms can be monitored using a convenient management panel. The system is also fully programmable what together with a loop wiring makes it easy to connect a new device, what’s especially important if you plan on redesigning the building in the future.

Although the initial cost of this system is higher than that of a conventional one, it’s much easier to install and is a perfect choice for large, multi-storey buildings.

Wireless fire alarm system

In this system, all devices are communicating wirelessly; no wiring in the building is required. This makes it an excellent choice for listed buildings, in which installing wires may require special permission. Similarly, those who value flexibility (location of each device can be changed easily) or simply do not want to make extensive installations will find this system a perfect fire protection.

Their high initial cost quickly offsets as there’s no need to run the cables, what allows saving on labour, time and potential damage to the building during the installation. Even though the system is battery-powered, it is highly reliable, and there’s no risk of signal collisions as it is designed to eliminate any signal interference.

What else is important?

Apart from technical specifications unique to each system, there are a few factors which are similarly important regardless of your selection. The first important factor is the speed in which the system reacts to fire outbreak. In the case of fire, every second counts and allows for evacuation of people. The earlier a fire is detected, the easier it will be to extinguish it, minimizing the damage.

Another problem that affects many fire alarm systems are false alarms. Check if the devices in the system of your choice are reliable enough to distinguish between dirt, steam, and the actual smoke easily. The fines imposed for each false alarm may exceed the initial savings on the chosen system; that’s why you should make sure that you select quality devices only and most importantly Listed and Approved by the Third Party Certification bodies for the purpose. Moreover, each false alarm forces people to stop working and leave the building.

Similarly, it is extremely important to consider the detection devices suitable to the particular environmental conditions prevailing in the building and the ceiling or roof height where those are going to be installed to prevent false alarms as well as faulty” conditions in the panel connected therewith and ineffectiveness respectively.

Last but not least – make sure that all of the occupants in the building can hear the alarm. If there are many people inside it, it’s a good idea to choose a fire alarm system which allows you to communicate with those leaving the building, to keep the evacuation process as smooth as possible.

Further, the effectiveness of a fire detection system specifically by large facilities or spread out operations can be enhanced by monitoring the central fire alarm panels within the facility and connecting it to a remote monitoring station manage by General Headquarters of Fire Prevention on 24 hour basis for quick attendance by Public Fire Brigade.

Designing a fire alarm system that perfectly suits your building is not an easy task and can be quite costly. Despite the initial expense, you should never try to save money on your safety and the safety of others. The installation and maintenance costs of a quality system are very low compared to potential losses caused by the actual fire, and the cost can be highly optimized if you design the system with your building and its occupants in mind.

In Sri Lanka, the authorities may have asked to install the fire alarm systems in buildings, facilities, infra-structure etc, but sadly lacking the required administrative coordination to pick up distress signals very early for immediate attendance by organizing Fire Command Center” within the facilities and Remote Monitoring Station” on operation 24 hour basis. Therefore, the purpose of having such a system is defeated specifically for large and spread out operations where many buildings involved. Besides, it is also understood that the authorities lacking in ensuring the systems are not faulty” by not enforcing any deterrent actions.

President assassination plot Arrest of TID DIG imminent

Head of the Terrorist Investigation Division (TID) DIG Nalaka de Silva would be arrested soon, as the Criminal Investigation Department (CID) has gathered evidence against him over the plot to kill President Maithripala Sirisena, a top official of the Police Department told Ceylon Today yesterday.

The CID had questioned Anti-Corruption Front member Namal Kumara for over three hours on Friday.

A voice tape with a conversation Namal Kumara had with the head of the TID has been released to the media.

Several high ranking Police officers confirmed that it was the voice of DIG Nalakade Silva on the tape.  Although we attempted thrice to contact the head of the TID he had disconnected his phone.

On Friday evening, the President had requested IGP PujithJayasundera to hand over the investigation to the CID and complete it as soon as possible. Defence Secretary KapilaWaidyaratne, Senior DIG of the CID Ravi Seneviratneand its Director SSP ShaniAbeysekera had participated in this meeting.  The National Police Commission (NPC) too had ordered theIGP to hand over the investigation to the CID.

“We ordered the IGP on Friday to expedite this investigation. We cannot spend several weeks on this since this is a very serious matter,” Chairman of the NPC, P. H. Manatunga told this newspaper.

He also said that the CID would be completing this investigation very soon.
He added that, Secretary to the President Udaya R. Seneviratne, Commandant of the Special Task Force, Senior DIG M. R. Latheef and Secretary to the Ministry of the Law and Order PadmasiriJayamanna had also requested that this investigation be handed over to the CID.

Meanwhile, Prime Minister RanilWickremesinghe too has requested the IGP for a report on this matter.  Meanwhile, a high ranking Police official told this newspaper that the special Police Unit, which was maintained at a house in Epitamulla Roadin Kotte, somemonths ago, had been engaged in tapping the phones of Politicians, Journalists and heads of the Police Department.It had been set up by the TID.

We were told that during this illegal activity, which was carried out under the leadership of DIG Nalakade Silva of the TID, the phone of former Director of the CID DIG SudathNagahamulla too had been tapped.

Police protection would be provided to Namal Kumara of Dushana Virodi Balakaya, who has alleged a plot to kill President Maithripala Sirisena and former Defence Secretary Gotabhaya Rajapaksa, a senior police officer told The Island.

Kumara told media last week that DIG in charge of the Terrorist Investigation Division (TID) Nalaka de Silva had been plotting to assassinate Sirisena and Rajapaksa with the help of notorious drug kingpin, Makandure Madush. De Silva is said to have cultivated Madush when the drug dealer was in the custody of the TID sometime ago. Kumara played an audio recording of his alleged conversations with de Silva, claiming that the latter who had supported Prime Minister Ranil Wickremesinghe, was worried that Sirisena and Rajapaksa would join forces.

The officer said: “Kumara gave a statement to the CID, on Friday. We have given it to experts to examine, but from the investigations we carried out, we are 100% sure that the voice is indeed that of DIG Silva.”

He added that an investigation was being carried out to determine whether the educational certificates furnished by Silva were authentic.

“Silva will be questioned today or tomorrow. We have to first do a thorough background check before questioning him. We are also investigating the alleged connections some senior policemen have with Madush,” he said.

IGP Pujith Jayasundara said that an impartial and transparent investigation into the matter would be carried out. Those in charge of Gotabhaya Rajapaksa’s security are to request the Ministry of Defence to provide him with additional security, The Island learns.
