Appeals Court dismisses petition against Gotabaya’s citizenship

The Court of Appeal has unanimously decided to dismiss the petitions filed challenging the citizenship of former Defence Secretary Gotabaya Rajapaksa, without taking it up for consideration.
The court today concluded the consideration of the petition while all parties were given time to present their written submissions before 3.15 p.m.
The decision of the Appeal Court regarding issuing an interim order on the petition was be announced at 6.00 p.m.
The petition, filed by two social activists Gamini Viyangoda and Prof. Chandraguptha Thenuwara on September 30, was taken up for consideration for a third straight day this morning before a three-judge bench comprising Justices Yasantha Kodagoda, Mahinda Samayawardena and Arjuna Obeysekara.
The Controller General of the Department of Immigration and Emigration, the Commissioner-General of the Department of Registration of Persons, Minister Vajira Abeywardena, Secretary to the Ministry of Internal & Home Affairs and Provincial Councils & Local Government, Opposition Leader Mahinda Rajapaksa, former Defence Secretary Gotabaya Rajapaksa, Acting Inspector General of Police (IGP), Director of the Criminal Investigation Department (CID), Senior Deputy IGP of CID and Officer in Charge of CID’s Special Branch have been cited as the respondents of the petition.
The petitioners had alleged that Gotabaya Rajapaksa has obtained a passport and a National Identity Card (NIC) claiming that he revoked his US citizenship.
The petitioners further stated that they have the necessary information to prove the former Defence Secretary did not submit proper documentation to verify the revocation of his US citizenship when obtaining a Sri Lankan passport and a NIC.
Hence, the petitioners had requested the Appeals Court to deliver an order suspending the issuance of a passport and a NIC to Gotabaya Rajapaksa. They also sought an interim order preventing the functioning of said passport and NIC until the court delivers the petition’s verdict.

This EASY PREDICTION was made in opposition to various contrary arguments advanced by both Dilrook and Randeniyage in their ongoing quest to UNDERMINE Gota’s CANDIDACY for the Presidency of Sri Lanka!!

GR’s SL citizenship was granted on November 21, 2005 by MR. Now that has been established, the next questions are,
1. how did he vote on November 18, 2005
2. has USA cancelled his US citizenship. If it is not cancelled by the day he is supposed to take oaths, he is in violation of the Constitution.
Since the court accepted his Sri Lankan citizenship, he will be fully under the Sri Lanka law (and also the US law as he is still a US citizen).
Chamal has already entered the fray as an Independent candidate! Why was that? He did so just a few hours before the court verdict. He could have waited. Nominations close on the 7th. There are 3 more days.

I never lost my citizenship, to be granted again.
Before I received the foreign citizenship , I made a declaration under section 19/(3) of the Citizenship Act (Chapter 349) that I retained the status of a citizenship of Sri Lanka. For that I had to submit various document and pay a large sum of money and took a one year or more.
If the president of Sri Lanka has the power to grant the citizenship to someone who lost it is 3 days, just because he/she was his close relative or a friend in 3 days, I think all there is a miscarriage of justice.
Laws need to be changed to STOP such powers rested on ONE MAN. If not it is dangerous. If Sajith becomes to president, he may give dual citizenship of thousands of LTTEers in 3 days, together with a new house.

Gunasinghe, do not be so stupid.
Dilrook is an eminent personality who practiced as a lawyer before leaving our shores. He is a gentleman who NEVER wrote disparagingly of his adversaries.
As for Lorenzo, he was a person who expressed his views openly and fearlessly. There was not a shade of bias, either ethnic or religious in his commentaries.

It is a well known fact that most contributors to Lankaweb are linen washers for the Rajapakses. That is not a reason for referring in a humiliating manner to those who see things differently. It is my experience that Rajapakse worshipers are as intolerant and arrogant as the idols they worship.
Coming to the judgment, no one expected it to be other than the one pronounced.
It is said the law is an ASS.
The law on the issue submitted to the Courts was nothing else than an ASS. It was a labyrinth, a tunnel wandering with no light in view. It was an amalgam of borrowed items haphazardly thrown together and left to be stitched all over again and as they wished by the interested parties.
Just read the arguments. It was always a question of this clause read with that clause and with that ‘other- other’ clause, jointly, conjointly, separately… It was such a hash. All it created were DOUBTS. The judgment only affirmed the saying: when in doubt do nothing…stick to the status quo. The judges interpreted the ‘status quo’ in favour of Rajapakse. There is nothing to cock-a-doodle-doo about.
Even the Rajapakses took this doubt seriously by presenting Chamal as a candidate in case the judgment turned wrong.
A word to the Rajapakse cocks-a doole-doo. Leopards do not change their sport. Gota is what he is whatever sugar coating they may cover him with. His record will follow him wherever he goes: a record of murder, abductions, death threats that sent even generals into exile. On the international scene he is a PARIAH with cases pending even as far as the USA and others in the offing.
If he wins, it will only intensify the gloom and the doom that this country is enveloped in.
Those shouting ‘motherland…motherland’ after assuming foreign nationality are only spitting with faces turned to the sky. Even this country sinks further into hell, they are SAFE. Their shouting cannot be considered as being any other but empty and hollow. It is those in the fog and the bog that have to battle it out. Not those who have fled to safe havens and are now pontificating unbashedly.

Dilrook is not LORENZO, their personalities and attitudes are quite different.
Lorenzo was an aggressive Tamil Diaspora LTTE operative who built his undercover sheepskin for many years as a patriotic blogger at LankaWeb (and elsewhere), and them emerged from cover inn2014-2015 to launch his propaganda against Mahinda Rajapaksa’s bid in 2015 to remain President. He is NOTABLY ABSENT because, in the light of the DISASTROUS record of Aiyo Sirisena and his Yamapalana Bedfellows, he is TOTALLY DISCREDITED!
Dilrook is not as OBVIOUS as Lorenzo, but nevertheless his objectives are aligned with those of the Yamapalanaya: to wit, NEVER to let a DESHAPREMI President and a DESHAPREMI Govt be elected to Power!
He assisted Lorenzo in 2015 to oust Mahinda, just as he is now doing to undermine Gota’s candidacy.
Dilrook’s technique is MORE SUBTLE than Lorenzo’s but the FINAL OBJECTIVE is the same: to PREVENT the election of an Effective Patriotic President in Sri Lanka by raising every minute meaningless issue to cast doubt on Gota IGNORING the OVERWHELMING TASK BEFORE US of RESCUING the Nation from the CURRENT EXISTENTIAL THREAT!
He KNOWS that people can be DISTRACTED by making them FOCUS on the individual trees in the forest and BEGUILED into MISSING the FOREST itself!
There are many others here who are assisting Dilrook in that quest, forming a club commenting on each other’s posts, pretending to be patriots but BUSILY HACKING AWAY at the PATRIOTIC CAUSE of electing Gota as President and a Patriotic Govt with 2/3 majority!
In Sri Lanka, the Yamapalanaya is PURSUING the SAME TACTIC of DIVERSION of VOTER ATTENTION filing LAWSUITS that are HILARIOUS.
The GOAL is to DISTRACT the attention of the people away from the VAST DISPARITY between Gota’s Vision, CAPAABILITIES, DEMONSTRATED EFFICIENCY, and Overall Suitability to be a President, and AWAY FROM any comparision against Sajith’s childlike BLEATS devoid of any reference to National Issues!.
In that quest, in close collaboration with NGO’s, they will CONTINUE to FILE CASES in court at the drop of a hat, until the last moment to DISTRACT the VOTERS, depending on folks like Dilrook and his fan club here to keep the spin program whirling endlessly.
But, they will FAIL DISASTROUSLY, because the voters are BEYOND that stage now;the record of their ASTOUNDING INEPTITUDE and CRIMINALITY is a yard long, and the LAST MINUTE SPINNING will not work, it is TOO LITTLE, TOO LATE.

සර්වජන ඡන්ද බලය (1931) ලබාදීමට පෙර කිසිදු දේශීය නායකයෙකු සිංහල ජනතා අභිමතාර්ථ කෙරෙහි කිසිදු තැක්මක් පල නොකළහ. රාජ්‍ය මන්ත්‍රණ සභා ධූරීන් බ්‍රිතාන්‍ය පාලනයට ආවඩනු මිස ජනීජනයා නොතැකූහ.
නිදහස් අධයාපනය සැමට ලබාදීමෙන් තම පොල් වත්තේ පොල් කඩන්නන් නැතිවන බව පැරණි තාලේ දේශපාලකයකු විසින් කීම කදිම උදාහරණයකි. එහෙත් සර්වජන චන්ද බලය (1931) සමඟ එය වෙනස්වන්නට විය. දේශපාලකයන් මහජනතාවට ඇහුම්කන්දෙන තත්වයට නිහතමානී වූහ.
එනමුත් යලි එය ටිකෙන්ටික වෙනස්වනට වූයේ කාටත් නොදැනෙන ලෙසය. අද දේශපාලකයන්ට මහජාතිය මතක් වන්නේ ඡන්දයක් ලං වූවිට පමණි.
2010 සිට 2015 දක්වා කාලය තුල රාජ්‍ය තන්ත්‍රය දෙමල දුක්ගැනවිලි සහ දෙමල අභිමතාර්ථ සඳහා අති විශාල කාලයක් සහ මුදලක් යට කළේය. සිංහල දුක්ගැනවිලි සහ අභිමතාර්ථ හමස් පෙට්ටි ගත විය. එක්සත් ජාතීන්ගේ මානව හිමිකම් කවුන්සිලය හරහා දෙමල අන්තවාදී ඉල්ලීම් සිය ගණනක් රජය වෙත එල්ල කල අතර ඉන් බොහෝමයක් දැනටමත් ලබා දී හමාරය.
මාර්තුවෙන් මාර්තුවට ජීවත් වන්නා වූ ආණ්ඩුවට එසේ වීම පුදුමයක් නොවේ. පුදුමය නම් විලි ලජ්ජා නැතිව ආණ්ඩුව සහ පොදු අපේක්ෂකයන් සිහලුන් හමස් පෙට්ටියෙන් ඇද තව වසර හයකට රජවීමට අකටයුතු කිරීමයි. ඡන්දයට මාසයක් තියා සිංහල ප්‍රමුඛ ජනතාවට නොයෙක් ආර්ථික වාසි දීමට දේශපාලකයෝ උත්සුක වෙති. තෙල් මිල, ගෑස්‌ මිල, හාල් මිල සහ කිරිපිටි මිල පහල දමන්නට ආණ්ඩුව කටයුතු කරන අතර, රැකි රක්ෂා, ශිෂ්‍යත්ව, යතුරු පැදි, සහන ණය, වැඩි පොළී ඉතිරුම් ගිණුම්, බස් රථ සහ නව දුම්රිය සේවා වැසි වස්සන්නට විය.
මාසයක් වැඩකර වසර හයක් රජකිරීම උන් සැමගේ උත්සාහයයි. සිහලුන් එක දෙයක් සිහි තබා ගතයුතු වන්නේය. එනම් ඡන්දයට පසු ඔවුන් යලිත් හමස් පෙට්ටි ගත වන බවයි. එමනිසා ඡන්දයට පෙර සියලු සිංහල අයිතිවාසිකම් සහ සිංහල ප්‍රශ්න වලට පිළිතුරු ලබා ගතයුතු වන්නේය. හිස් ඡන්ද පොරොන්දු වලින් තෘප්තිමත් නොවී, අයිතිවාසිකම් දිනා ගත යුතුය. නොඑසේ නම් බොරු පොරොන්දුකාරයින්ට ඡන්දය නොදිය යුතුය. ලොකුම බොරුව කියා දිනන දේශපාලකයා වෙනුවට හොඳම නායකයා පත්කර ගනිමු. රටට අවශ්‍ය කරන්නේ යුධ අපරාධ හමුවේ මළ මූත්‍ර පහවන නායකයෙකු නොව රටත් මහජාතියත් කරපින්නාගෙන උඩුගං බලා පිහිනන ජනහිතකාමියෙකි. එකී ජනහිතකාමියා පත් කර ගැනීමට මහජාතිය අසමත් වූ තැන සිංහලය තවත් වසර හයකටවත් හමස් පෙට්ටි ගතවනු නොඅනුමානය.

In 2014 I had no idea how really fearful some persons are (except Mahinda) to petty court cases let alone war crimes allegations. LTTE Diaspora will have a field day extorting everything they wished for using the war crimes stick. LTTE Diaspora used the carrot method to get things from the UNP and Sirisena. But the stick is mightier than the carrot.
At the 2019 presidential election, Tamil Eelam, Sufistan, Nazarstan and Malaya Nadu mythical kingdoms will come to life on the election map unless the choice of the majority and the minority are the same. From Day 1, the winner of most Sinhala votes (and rejected in all electorates with a Tamil or Muslim majority) will be trying hard to win hearts and minds of minorities. They will be further encouraged by the “international community” and the LTTE Diaspora.
