The North Central Provincial High Court of Civil Appeal today ordered the North Central Province Governor, Chief Minister and provincial ministers among others who were accused of alleged misuse of state funds, to appear before the court on October 17.

North Central Provincial High Court of Civil Appeal Judge Adithya Patabendige made the order on a petition filed by National Construction Association – North Central Branch Chairman – G. B. Lohitharatne, against the aforementioned, alleging they had offering contracts to acquaintances on political favouritism.

The respondents include NCP Governor Reginald Cooray, Chief Minister C. V. Wigneswaran, Provincial Ministers, the Provincial Chief Secretary and two other officials.

Secular tab is another western slogan flogged to take away, denigrate and dilute countries that have historical past and are trying their best to protect that past. The very countries preaching secularism take oaths holding the Bible and sing national anthem ‘God Save the Queen’ while their politicians make no bones about protecting Christianity. Islamic countries do not come into the equation because none of the 50 majority Muslim countries will budge from giving any place other than to Islam in their countries which leaves India with the majority Hindus who have got a raw deal as India’s political leaders have foolishly agreed to undermine Hinduism for Secularism and this is a mistake that the remaining majority Buddhist nations should not do.

Where is the logic of changing a constitution to give it a ‘secular’ flavour when at the other end both minorities are seeking separate states and living in self-segregation?

Asian countries are hypnotized into accepting terminologies without understanding the context or questioning the insistence of using these western invented terms. Probably those parroting the secular slogan are themselves clueless and do so only because they are paid to promote the notion.

Let us first understand that that the terminologies, the systems and all the mechanisms have a historical legacy. They are all derived from colonial rule where after invasion and occupation native systems were thrown into the dustbin and replaced by Western White Christian Systems that used education to mentally shape non-whites to accept all that the whites were delivering as what was in ‘their’ best interest which was invariably to suit the West. Western education system is intertwined in Christianity. Therefore the separation of Church & State omits to mention Education! Realization of this is a must.

Until and unless people’s minds are decolonized, we will continue to worship all that has been passed down since colonial rule as being the best solution to all problems when in reality these are neither solutions nor options in our best interest.

Therefore we need to at all times put things in correct historical context. The countries before the Age of Discovery were living following their own indigenous systems – they had no prisons, they had no thieves, there was no need for lawyers or police, their doors did not have locks, there were no need for cctvs, surveillance or even counter terrorist mechanisms. Everything changed when the Western Christian Explorers came with a mission to ‘civilize’ these uncivilized people and their effort to Christianize and Civilize natives became the white man’s burden. Lets also not forget that systematic brutality and murder was invented by colonial Christian/Catholic explorers – the Inquisitions, the murders, the plunder, setting fire to crops and livelihoods were all on orders and constitute what these very nations call ‘war crimes’ today. The crimes they committed are never taken to equation for accountability though and these were beyond those that they define as war crimes.

There were certainly wars but the wars were on policy, the two sides honoured each other and there was chivalry. Both Christian and Islamic invasions had none of these ingredients. Jews sought and continues to get compensation why are countries victims of both Islam and Christianity not doing the same and instead accommodating their demands over and above those that built the nations?

Secularism is being used to downgrade non-Christian/Islam so that Christians/Islam are brought in par making it easier to influence the decision making through a network of external influencers under their control (NGOs, media, civil society, UN etc)

The separation of State from Church is what secularism in reality means. However, how far it is practiced as it is preached is questionable. The West has all the mechanisms in place that guarantees the superiority of the Church – German constitution guarantees Christian doctrine is taught in government schools, look at the questions in the British citizenship test, mandatory church tax to citizens prevails in Germany, Austria, Croatia, Denmark, Finland, Switzerland, Italy, Sweden & Iceland.

Roman Catholic faith is the only religion to be in the UN and has diplomatic status as a nation. Roman Catholic faith is the only religion to have a separate state carved out – how secular is this?

Most appointees by US Presidents are staunch Catholics. Therefore, secularism is but in name only however when Third World countries agree to accept it what happens is that all its historical past gets annihilated to be overtaken by either Islam or Christianity.

The West offers a secular model – but what is that in terms of virtues – it is capitalism overdrive. People are depressed, unhappy, dissatisfied, angry, violent, on drugs, on alcohol, in a rat-race, in debt but they have no solace. The East though made to follow and copy the Western living model can when they do realize these are valueless turn to the dharmic compassion that the civilizations of the East was built on. The secular promoters cannot stand this eventuality which is why they wish to destroy the history and heritage using the bogus ‘secular’ mantra. The aim is to remove the historical identity of the nation and to plug a modern identity in keeping with external aims and objectives.

India’s Hindus have become victims – inspite of 82% Hindus there is nothing to protect Hindu rights, safety of Hindu temples, Hindu pilgrimages and traditional Hindu way of life. Secularism in India has meant appeasing or tolerating others while there is little reciprocity. Bihar has even banned yoga day while Sri Lanka’s Port Minister on the excuse of reconciliation has planted a Christmas Tree in the middle of the Galle Face Green which is a public area for all to play and enjoy the evening. Why only a Christmas Tree for reconciliation? Bangladeshi writer Taslima Nazreen questioned the double standards of writers protesting against ‘growing intolerance’ in India says that said most secular people are anti-Hindu isnt this the same of the secular people in Sri Lanka – all are anti-Sinhala Buddhists!

They protest against the acts of Hindu fundamentalists and defend the heinous acts of Muslim fundamentalists. Politicians appease Muslims for votes. This annoys many Hindus. In Canning, a Hindu village in West Bengal, was burnt down by Muslim fanatics in 2013. If Muslims were brutally persecuted in India, they would have left India for neighbouring Muslim countries like Hindu minorities have been leaving Bangladesh and Pakistan since Partition,”

Just replace the Hindus with Sinhala Buddhists and insert a village in Sri Lanka to understand the gist of the message!

In seeing secularism in action in a country as large as India, it automatically should caution Sri Lanka where pseudo-secularism is being promoted where everything is blamed on the majority and a false projection of the minorities being weak is promoted. As a result of the hype and propaganda gone into a bogus impression that the minorities are weak the government is forced to appease to the minority will to the extent of even joining to publicly fault the majority. This divisiveness does not bring out any of the other norms being simultaneously promoted by the same parties that are fanning the majority-rules minority-weak slogans. It does not help to form any national identity either especially when steps are afoot to change Sri Lanka’s national anthem, flag and even map!  All these are well-funded efforts to denationalize people (devaluing both nation and nationality).

What a lot of people tend to forget is that there is no Sri Lankan identity since the name Sri Lanka came in 1972. What we also forget is that the nation was called Sinhale from ancient times upto ceding powers to the British. Sinhale is the identity that we need to identify ourselves with. Historical facts cannot be constitutionally droned just because it is unpalatable for a handful! Well-funded indoctrination through history and social science in efforts to de-root people of its cultural past is underway. First open salvo has come a series of free history courses now been publicised targeting Buddhism! Quite a number of pseudo secular academic historians have been coopted for this exercise. Why should a country’s history be written by people who are not proud of their country! The secular and multicultural slogans have even ended up with State banks in Sri Lanka and private banks promoting Sharia banking (Islamic banking) if so why are they not promoting Buddhist Economics? There are madrassas springing everywhere, look at the number of evangelical churches also mushrooming, Arabic has entered when Muslims speak Tamil, there are Muslim universities, Islamic montesooris – how secular are these and the Sinhala Buddhist schools end up having to be open to multiculturalism only!

Why are educational texts written by those who do not have a sense of pride and respect for the cultural heritage and national heroes? Isn’t this why the curriculum has failed to produce youth proud of their past?

Much of the trouble stems from politicians vying for cheap votes giving unfair political mileage to minority demands. If citizens are treated equally before the law why should there be any special rights for minorities? No minorities can demand or be given separate minority laws above the state law using the ‘secular’ mantra.

Secular will seal the fate of the majority who will be castigated as communalists with every move to safeguard their historical past. The Pope in his capacity as a foreign head can land on any country and openly declare that his mission is to convert people!

The history of a country is its evolution. This is why it kills the created countries who have nothing to boast of its evolution and wishes to destroy the historical evolution of countries that have a solid past. Precision bombing of Iraq’s ancient sites is a case in point during all Gulf Wars.

We are at a critical juncture. Suddenly we see open chants for separatism using virtually the same demands as those of terrorists. Why are secularists in denial and refusing to accept that terrorism is leading to secession? This is a key point relevant to the broad changes being taken to introduce one word which has dangerous ramifications.

If minorities have the right to practice their faith what else do they want? Religious freedom does not afford the right to have their religion rule the nation! Religious freedom does not constitute demanding the removal of Buddhist sites that have been located for thousands of years! Religious freedom doesn’t mean that the voice of the Sinhala Buddhists have to be shut up.

Secular Sri Lanka will end up with minorities become worst racists than they are and the torch bearers of the racism will helped by external influence contribute to great social calamities. Probably this is what is being intended with the sweeping changes to the constitution.

It is very clear that the minorities have exploited their rights and external sources for their own agendas are using the minority as a smokescreen. Things in Sri Lanka are turning into a social apartheid-like situation that prevailed in Africa when the white ‘minority’ enjoyed all state privileges and discriminated against the majority blacks – the same is happening to the Sinhala Buddhists even before Secular has been inserted into the new constitution so these examples should suffice to refuse to include Secular into the new constitution.

The demands to remove the Prevention of Terrorism Act is identical to when the Sonia-Government removed the PTA as soon as it came into power in 2004 citing it was ‘communal’ – Yahapalana will sing same song.

The Jihadists increased attacks during UPA rule knowing they would not take action – the same is happening with the revival of the LTTE and the open separatist racism by Tamil politicians. UPA government did nothing about the missionaries increasing conversions and the same appears to be happening with evangelical ministers appointed to government in Sri Lanka. Not understanding the mathematics of demography the present government enjoys rallying round the minorities and openly ridiculing the majority while getting funds to divide the majority.

Every time the majority rallies nationalism it is immediate shot down as communal and media is used to denigrate them. There are churches even depicting false history and paying artwork to uphold lies.

The current proposed changes to Sri Lanka’s constitution is certainly not coming from demands by the public. It is the work of people who are working to agendas (local and foreign). NGOs are today drafting what should and should not be included. These players are on payroll and dictated to do what their paymasters demand of them. They have no love or concern for the country, its people or its past. They are only carrying out orders. These orders come from nations who have no historical past, the only past they have is of confiscating other people’s lands, murdering their natives and then expanding their empires. Nothing they can be proud of.

However, it is time that people realize that all these changes are also linked with other countries who have also experienced regime change and in turn have had their internal structures raped and replace with what suits parties waiting to devour those nations.

Should we sit silent and watch a 2600 history be annihilated?

FM Mangala Samaraweera in L.A. says no separation but leaves door open to federalism

About 200 expats present at dinner meeting with the visiting minister

A federal state is not a separate state.  I assure you Sri Lanka will remain a united, undivided country,” he said addressing a gathering of about 200 invitees at the upscale residence of Consul General Swarna Gunaratne.

The minister was responding to my question as to whether the government would continue to uphold a unitary constitution “and avoid a federal state.”

“Unitary constitution” and “federalism” are just terms being thrown around.  “Don’t go by what’s on social media,” he said.
Minister Samaraweera was in Los Angeles after attending the 71st Session of the UN General Assembly in New York.
About 200 residents from Southern California were present at the September 25 event which was the first featuring a visiting government dignitary organized by Mrs. Gunaratne who took office earlier this year.  Notably absent were Buddhist monks from the local Sri Lankan temples.
Minister Samaraweera, dressed in open shirt while the invitation called for formal attire, said he was surprised at the large turnout, quipping that as he walked in to the meeting he thought for a moment he was in Matara (his hometown).

 In contrast to other Sri Lankan leaders who from time to time have addressed the expatriate community here, Mr. Samaraweera, speaking for about 20 minutes, solely in English, did not have one good thing to say about Sri Lanka from independence to present.  None of the warm nostalgia for the homeland usually evoked by leaders from all sides of the political divide.
Quoting extensively from the late Lee Kuan Yew, founder and prime minister of Singapore,  he painted a grim picture of a country that couldn’t evolve,” a nation, contrary to the promise shown when it became independent, is still struggling to move forward.”
When Ceylon gained independence in 1948, it was the classic model of gradual evolution to independence. Alas it did not work out….  It is sad that the country whose ancient name Serendip has given the English language the word “serendipity” is now the epitome of conflict, pain, sorrow and hopelessness,” he quoted the late Singaporean leader as saying.
Now, after sliding for almost 70 years, Sri Lanka has finally caught a break according to the minister.  There’s hope in the horizon with a new vision for democratization and development” being pursued by his government which came to power in 2015. All the countries are coming forward to help us,” he declared. emphasizing that the island will be a strategic military hub in the Indian Ocean and a gateway to Asia.
Touching on Sri Lanka’s economic future, he said the government will take measures to make it easier for foreign investors to do business in the island as well as for foreign nationals to buy land.
In pursuit of promoting reconciliation, there was a new political trajectory” aimed at breaking down walls and building bridges” and putting away past baggage.”
Reconciliation was key to coming to terms with the tragedies of the past” which was why, he said, the government felt it important to show the world” its commitment by cosponsoring the Geneva Resolution (Human Rights Council Resolution 30/1).
Minister Samaraweera’s visit was billed as the curtain-raiser for the proposed 2018 “Year of the Overseas Sri Lankan” event, a year-long celebration to be held in Los Angeles and other cities to coincide with the nation’s 70th Independence Day.   He mentioned plans to hold festivals  highlighting Sri Lanka’s achievements and to promote the island as a wonderful destination” but only a smidgen of his speech touched on the 2018 celebration.
Regardless,  the minister was apparently expecting audience comments and questions to be apolitical.  “This is not the forum for politics,” he scolded after I had my brief say.  In addition to the references to a unitary constitution and federalism, I said the  Sri Lankan government’s talk about reconciliation was the sound of one hand clapping.”
The diaspora is not one entity geographically or ideologically,” I pointed out, adding   there’s the diaspora that carried out a campaign for separatism by funding a terrorist group and that according to State Department reports this fundraising is still going on.  Referring to the government’s efforts to reach out to diaspora groups like the Global Tamil Forum I asked if similar efforts had been made towards groups at the other end of the spectrum.”
Mr. Samaraweera did give a long response but the question went unanswered.
Despite the minister’s admonishment, Los Angeles resident Roma de Zoysa stood up to ask if after 30 years of war [with the LTTE] the new government was in the end going to give them what they have been asking.”  To which, Mr. Samaraweera answered there will be no separation.”
Mr. Faisal Buharie of the Sri Lanka Muslim Association brought up the question of the resettlement of Muslims evicted from their homes in 1990 by the LTTE.   The minister responded that there were 909 of them left and that they will be resettled shortly.
There were a few more questions, this time on topics such as education, the teaching of English, and if the government would bankroll the 2018 Independence Day celebrations in LA.  And then there was some unabashed praise for the visiting dignitary — good news” that might have helped to jolly things up towards the end, when the minister was ready to call it an evening, with the declaration that it was time for a drink.”

PEACE COMES FROM WITHIN

The late Aggamahapanditha Balangoda Ananda Maithriya Thera was in London, in 1997, observing Vassa (rainy season) at the Sri Saddhatissa International Buddhist Centre, Kingsbury. The thero’s, 99th birthday was on 23 August, and a dual-purpose ceremony had been organized by the Incumbent Monk at the International Buddhist Centre, Ven Galayaye Piyadassi Thero MBE.

The writer had the rare opportunity to meet up with the Venerable Monk and have an interesting pow-wow. Expressing his thoughts about the celebration of his 99- year long life’s experiences, the Venerable Monk said: “99 years mean my life span is fast coming to an end”, which for the Venerable Thera was, that, he was moving towards a new birth where the Thera would be more influential to propagate Buddhism in its pristine purity in the next life, which the ecclesiastic could not complete.

Born on 23 August 1898 to Heenmenike and Matthias Appuhamy, the young baby was named ‘Punchi Mahattaya’. The infant’s mother expired within two weeks of his birth, and the distressed father left the village; leaving the responsibility of bringing up the child to Dingirihamy Mudalali (child’s uncle) and his wife Yasohamine.

At the age of nine, young Punchi Mahattaya was exposed to an orientation by Brahmacharya Walisinghe Harischandra, member of the Maha Bodhi Society, at Kumara Vidyalaya on the subject Buddhist way of life. Instantaneously the celestial fire within the young boy began to expand, and seemingly managed to persuade his guardians to give their consent to his wishes – to take up robes at the age of 15! Finally Punchi Mahattaya was ordained as a ‘Samanera’ (young priest) at Nandaramaya, the Udumulla Temple in Balangoda.

Experience

With ninety nine years of worldly experience, and added to that, being one of the erudite Buddhist monks in the country, the Venerable Thera explained how Sri Lankans happily upheld spiritual, cultural and religious values towards the latter part of the Colonial rule. The Venerable Monk’s point of view was that ‘ Sri Lankan national leaders, who had not understood the very rationale of achieving freedom continued to act in the same manner as before, allowing the country to degenerate’.

“During the British rule, at least the Europeans listened to peoples’ claims and their agitation, but our leaders turned a deaf ear to any public outcry which caused a steep decline in our cultural and religious values that led to a division of people into various political groups! During the Colonial era, unity among the Sri Lankans was at its best, which helped to preserve Buddhism and cultural values, but looking at the society today, moral, cultural, economic and spiritual values of the entire nation have debauched,” the Venerable Thera continued.

Speaking on cosmology and Buddhist point of view, the Venerable Thera explained how Buddhists don’t believe in any omnipotent God, but ‘every man has the opportunity to be born in one of six deva worlds (heavens) if one lives a morally good and clean life’. ‘There are some earth bound devas (Gods) too, who are very near to us and humans can transfer merit to some devas, but not to every deva. Merely by repeating gathas (stanzas) in parrot form or offering alms for the sake of name and fame the object of transference of merit would be a waste,” the Venerable Thera asserted.

Buddhism

Interpreting three types of Buddhism practised in the world as Hinayana, Mahayana and Vajrayana, the Venerable Thera referred to different schools of thought and diverse rituals and rites among various sects, but the underlying factor he said would be that “Buddhists are all united in the Buddha’s Attangika Magga (8 fold path) and the most vital issue would be the unblemished qualitative life that leads towards one’s spiritual progress.

On the question of soul and ‘athma’ interpreted by other religions, the most Venerable Thera gave a definitive example taking the solar system and the sun as an example, “A teacher, the venerable explained, who takes a class of young children, may use the conventional language and say to the students, that ‘Sun is rising and setting’, although there is no such thing, except the phenomenon takes place due to the rotation of the earth! However, when the same teacher takes an advanced class of pupils, he has to use his ‘profound knowledge’ and speak a different language altogether, that is palatable, using scientific examples; perhaps in a more philosophical approach”!

Likewise, the Venerable Thera explained how the Buddha’s teachings varied according to the level of intelligence of the seekers of the truth. He used the words such as soul and athma as appropriate. But to those aspirants who had opened up their intelligence, the Buddha taught Vipassana Meditation – dealing with topics such as “what is life? What is man (matter + mind).

“Mind is a series of impermanent occurrences to be taken as unchanging in essence or ‘soul’ the monk elucidated; physical body is also a stream of material state subject to momentary change, and there is nothing to be taken as ego, entity or soul”. This practice of understanding, one’s own nature was not practicable to use in the ordinary world, the Buddha said, he emphasised.

Mystic World

Balangoda Ananda Maithriya Thera was a believer in paranormal phenomena; when enquired about the monk’s personal outlook on ghosts (boothayas) he became very eloquent.

“When a man dies, he is born in a different world at times with a subtle body due to his attachment to his worldly affection. In that astral body form, the dead person can live for a limited spell till he ascends to a higher world with the help of transference of merit by his relatives/friends in the corporeal world. An astral body can travel faster than light because it moves with the mind. Some dead persons in that state can make their astral bodies become solid so that others may see it. Others are not able to do it and, therefore, they cannot show themselves”.

Are Buddhists in Sri Lanka average, deep or just ritualistic? I bluntly put the question to the Most Venerable Thera. His reply was: “People in every village and town are now becoming more and more interested in the practice of meditation; it is especially encouraging to see it is mostly youth who are interested in Vipassana meditation. The uneducated are getting caught up in ritualistic practices that were not found some 50 years ago. But on the whole, Buddhism is now improving among the educated classes and it is a very good sign“.

Looking back at the Venerable Monk’s past long experience in life for nearly ten decades, the writer requested the venerable to comment on the ‘laxity in discipline in some of the modern day monks’ in our society.

Some years ago Bhikkus were much engrossed in conforming to Vinaya (discipline). Even now in most temples there are many closely controlled monks. If there was a lax in discipline I can only think of the new university education, followed by monks and taking up teaching careers. Even among them, I am aware, quite a few who are trying to maintain highly disciplined order”.

“Here and there, of course, you will always find black sheep, you can’t avoid it. Even during the Buddha’s time there were 250 Bhikkus who were living in a monastery misbehaving. They were dancing with women and sleeping with women. Women were singing and playing the harp and were entertaining the monks. Ultimately the Buddha had to send Ven. Sariputta to chase the undisciplined monks away. (Laughter…) My advice is, if you come across an undisciplined monk try and explain to him the purpose of becoming a Bhikku, in a loving and caring manner, otherwise if you condemn him, he will become incorrigible”, the Monk asserted.

“At the age of 99 what future plans have you, most Venerable Sir?” I posed the final question. The answer was swift:

To do some service to the Dhamma; whenever I get an opportunity. But the problem is that I never get a free moment whether I am in Sri Lanka, England or in the USA, and people gather to see me and seek advice”.

“My main aim is to attain a higher level of mind development. My conscience says I am going to do it. I do not want to be born in heavenly worlds. When I am dead, I would like to be born in Sri Lanka as a human being to develop Buddhism further and propagate the Buddha’s philosophy throughout the world in its pristine purity. I have this strong feeling and urge within me. Apart from that, as many people are aware, my aspiration is to attain Buddhahood in the distant future

No tax aroused a controversy as complex and deep as the present VAT increase – Bandula

“VAT was introduced in 2002 by the then United National Front government. At that time the income from this tax was Rs. 66 billion. When Mahinda Rajapaksa was voted out of power after the end of 2014, the revenue generated from VAT was Rs. 275 billion – a fourfold increase. However that was achieved without hartals and demonstrations.”

Opposition parliamentarian Bandula Gunawardena recently published a book on the Value Added Tax. In this interview, The Island staffer C. A. Chandraprema speaks to Gunawardena about the current controversy surrounding the VAT increase on the cards.

Q. Do you remember any other instance where a tax aroused as much controversy as the VAT increase that is on the cards now?

A. In my experience, no single tax aroused a controversy as complex and deep as the dispute over the present VAT increase. VAT was introduced in 2002 by the then United National Front government. At that time the income from this tax was Rs. 66 billion. When Mahinda Rajapaksa was voted out of power after early last year, the revenue generated from VAT was Rs. 275 billion – a fourfold increase.

However that was achieved without hartals and demonstrations. It is true that at times the VAT rate had gone up to 20%. But that VAT rate was charged only on luxury goods. There were several VAT rates below that which were applied to other goods and services. Those days it was not just one rate for everything. This time the VAT on the telecommunications industry has been imposed on top of the existing telecommunications levy. Even during the Rajapaksa era, there was a VAT on the wholesale and retail trade but only applicable to the largest establishments with a turnover exceeding Rs. one billion a year. As soon as the present government came into power, this threshold for the wholesale and retail trade was reduced to 400 million a year. Then in the budget for 2016, the VAT on the wholesale and retail trade was abolished. However, in July, the VAT on the wholesale and retail trade was re-imposed at 15% with the threshold brought down to just 12 million a year. After mass protests and hartals by the wholesale and retail trade they have increased the threshold to Rs. 50 million. This is plain insanity.

Q. In a way the present government has acknowledged that imposing VAT on the wholesale and retail trade is not advisable which is why they abolished it in the original budget for 2016 …

A. Yes, because they acknowledged that point they abolished the VAT on the wholesale and retail trade altogether. In fact, the revenue estimates for the 2016 budget had stated that the income from VAT in the year 2016 would be reduced by Rs. 25 billion. That was what Parliament was told. Now they are trying to do something else.

Q. If you take VAT as a way of earning revenue for the government, how does it compare with the old Goods and Services Tax and the Business Turnover Tax?

A. We introduced the VAT in 2002 in a context where there was a general consensus in the world that the previous taxes had a cascading effect with taxes being imposed on taxes. If the turnover of a business is 500 million and the cost of the inputs was 450 million, VAT will have to be paid only on Rs. 50 million. But, the Business Turnover Tax would have to be paid on the 500 as well as the 450 that went to produce it. That was why the GST was introduced. The GST is similar to VAT. In 2002 it was after combining the defence levy and the GST that VAT was introduced.

Q. Though the VAT may be imposed on other sectors, many people think that it should not be imposed on the wholesale and retail trade. What are your views on this?

A. One of the main reasons for that is because we don’t have a proper system of accounting. The invoices that are necessary to be able to deduct input VAT paid are often not available. Besides, the retailers will have to maintain two sets of books, one for goods which are subject to VAT and another for goods that are not subject to VAT. Another person will have to be employed for this purpose. The basic principle in taxation is that it should be simple.

In developed countries like Canada and Singapore the entire tax system has been computerised. The reason why there was that great VAT fraud in Sri Lanka some time ago was because of our inability to keep track of things due to the lack of a proper accounting system. That is why in countries like ours, the better policy would be to retain VAT at the level of the formal economy with it being imposed on the importer or manufacturer and leaving it at that without going further down the chain.

Q. I have been told by a retailer that due to the structure of the trade in this country, when the VAT is imposed on the wholesale and retail trade, VAT is paid by everybody down the line and each time the goods change hands, the VAT paid by the level above is passed on to the level below resulting in a VAT burden which will have to be borne by the consumer well above the original 15% intended. He told me that what often happened was that when an importer brings goods into the country, he sold it to Pettah merchants after paying the 15% VAT. Then the Pettah merchant keeps a small profit and sold it to the van and lorry delivery service. He claimed the 15% input VAT he paid to the importer and paid VAT only on his profit. But the VAT he paid on his profit was also passed on to the delivery service. When the delivery service sold the goods to the retailer, once again VAT was paid by the delivery service on their profits and this too was passed on to the retailer who in turn paid VAT on his profit and passed on the whole thing to the consumer and by the time the goods reach the end user, due to the number of times the goods had changed hands, the 15% VAT may have caused a rise in the price of the goods by much more than the original 15%. What do you think?

A. That may happen in certain instances. It is because of these complexities that certain items like rice, milk powder and sugar have a different kind of tax called the special commodities levy. It should be noted that even though the government says that such essential items have been exempted from VAT, there is a different tax on such goods. The special commodity levy is charged also from produce like potatoes, onions, sprats, dhal etcetera. These essential items which have been taxed under a separate scheme will have to be separated from the goods on which VAT is payable. Then the VAT paid on the inputs should be deducted from the VAT paid by the retailer and to keep track of all this, a bookkeeper will have to be employed. When we were in power, we discontinued about 15,000 small scale VAT files because the cost of administering those VAT files was greater than the revenue generated by them.

Q. Now that the VAT liable threshold has been increased to Rs. 138,000 a day, most retailers have dropped out of the VAT net. However the problem is that a shop that goes just above that threshold will get caught in the VAT net whereas a shop that is just below will escape. One trader who had got caught to the VAT net when the threshold was brought down to Rs. 400 million a year told a gathering of traders that his neighbour who did about 380 million worth of business a year did not have to pay VAT because he fell below the threshold. The same problem will apply to the traders who are just above and just below the threshold of Rs. 138,000 a day. People will be tempted to scale down their operations or to split up existing businesses so as to escape the net. Don’t you think so?

A. That again is why VAT should be charged only on the topmost levels of the wholesale and retail trade. The government should let it remain at the present 100 million a quarter (400 million a year) level. Further, they should not charge VAT on the health services and on telecommunication services.

යහපාලනය හෙවත් GOOD GOVERNENCE යනු වෙනකක් නොව මූලික වශයෙන් සරලව සලකතොත් නීතියේ පාලනයයි. නීතියේ පාලනය යනු සෑම පුරවැසියෙකුටම සමාන ලෙස නීතිය ක‍්‍රියාත්මක කිරීමයි එහිදී අධිකරණයේ ස්වාධිනත්වය ප‍්‍රථමස්ථානයෙහිලා සැලකිය හැකිය.

නමුත් 2015 ජනවාරි 09 වෙනිදා යහපාලනයක් ඇති කරනවායැයි කියා බලයට පත්වූ මෛත‍්‍රීපාල සිරිසේන තම පත්වීමෙන් පසු ප‍්‍රථම වරට කලේ අධිකරණයට පා පහරක් එල්ල කිරීමයි. අගවිනිසුරු මොහාන් පීරිස් බලයෙන් පහ කලේ කිසිදු වග විභාගයකින් තොරවයි. ස්වාභාවික යුක්තිය ද උල්ලංඝනය කරමින්ය ආණ්ඩුක‍්‍රම ව්‍යවස්තාව අමු අමුවේ උල්ලංඝනය කරමිනි. ජනාධිපතිවරයෙකුට විරුද්දව චෝදනා ගෙන ආ හැකි එක් කාර්යයක් වනුයේ ආණ්ඩුක‍්‍රම ව්‍යවස්තාව උල්ලංඝනය කිරීමයි. එය මෛත‍්‍රිපාල ජනාධිපතිවරයා විසින් සිදුකර හමාරය.

අග‍්‍රවිනිශ්චකාර මෙහාන් පීරිස් ඉවත් කිරීමට අනුගමනය කලයුතු කි‍්‍රයා පටිපාටිය ආණ්ඩුක‍්‍රම ව්‍යවස්තාවේ පැහැදිලිව දක්වා ඇත . බලයෙන් මත්වූ හුටං කාගේ හෝ කීමට ආණ්ඩුක‍්‍රම ව්‍යවස්තාව උල්ලංඝනය කලේය. මහින්ද රාජපක්ෂ විසින් හිටපු අගවිනුසුරු වරියක් වන ශ‍්‍රිරාණි බණ්ඩාරනායකව ඉවත් කලේ ආණ්ඩුක‍්‍රම ව්‍යාවස්තාවට අනුකූලව කටයුතු කරමින් පාර්ලිමේන්තුවේ අනුමැතිය ලබා ගනිමින්ය. මේ නිසා මහින්දට වඩා අධිකරණයට බලපෑම් කරපු අයෙකු ලෙස සිරිසේන ඉතිහාසයට එක්වේ ඔහුගේ නොදන්නා කමට මෝඩ කමට බෙහෙත් නැත සිරිසේන විශ‍්‍රාම ගිය දිනෙක නීතියානුකූලව ඔහු වරදකරුවෙකු කිරිමට මෙම කරුණ ප‍්‍රමාණවත්ය.

නීතිය ක‍්‍රියාත්මක කරන ඊලග වැදගත් ආයතනය වන්නේ නීතිපති දෙපාර්තමේන්තුවයි එයටද හුටං ප‍්‍රමුඛ ජහපාලන නඩය ප‍්‍රහාරයක් එල්ල කලේය. ඒ නව නීතිපතිවරයා පත් කිරීමේදී ජේ්‍යෂ්ඨත්වය නොසලකා හරිමින් නීතිපතිවරයාට එම දෙපාර්තමේන්තුවේ සිටි ජේ්‍යෂ්ඨතමයා වූ වර්තමානයේද ජේ්‍යෂ්ඨ අතිරේක සොලිස්ටර් ජනරාල් වූ සුහද ගම්ලත් එම තනතුරට පත් නොකර ඊට පහලින් සිටි අතිරේක සොලිස්ටර් ජනරාල් වූ ජයන්ත ජයසූරිය මහතා පත් කිරීමයි ජයන්ත ජයසූරිය වනාහි ඉතා හොද මහත්මයෙකි. එතුමාට නීතිපති තනතුර පිරිනැමීම පිලිබද පෞද්ගලිකව සතුටු වන අතර යහපාලනය ජේ්‍යෂ්ඨත්වය නෙසලකා හැරීම ගැටලූවකි. අනෙක් අතට සුහද ගම්ලත් වනාහි මහින්ද රාජපක්ෂට නීතිපති දෙපාර්තමේතුව තුලදීම අසභ්‍ය වචනයෙන් බැනවැදුනු ජනාධිපති මෛත‍්‍රීපාල ප‍්‍රසිද්ධියේම සහාය පලකල අයෙකි .

අනෙක් අතට වත්මන් ජනාධිපති මෛත‍්‍රීපාල සෞඛ්‍ය අමාත්‍යවරයාව සිටියදී දුම්කොළ හා දුම්වැටි භාවිතය පිලිබද පහත අමාත්‍යවරයාගේ උපදෙස් පරිදි සක්‍ය කලේද අතිරේක පොලිස් ජනරාල් වරයෙකු වූ විජිත් මලල්ගොඩය ඔහු නීතීඥවරයෙකු ලෙස දිවුරුම් දෙන්නේ 1981දීය නීතිපති දෙපාර්තමේන්තුවට බැදුනේ 1982දීය එදා මෙදා කාලය තුල ඔහු නීතිය අකුරටම ක‍්‍රියාත්මක කල නිළධාරියෙකු ලෙස ප‍්‍රකටය පැවති රාජපක්ෂ පාලනයට කඬේ ගියේද නැත . දැන් යහපාලනයට කඬේ යන්නේද නැත මේ නිසාදෝ ඔහුට පහලින් සිටින විනිසුරුවන් ඔහු පසුකරගෙන ශ්‍රේෂ්ඨාධිකරණයට යති. එපමණක් නොව 1989 වර්ෂයේ නීතීඥයෙකු ලෙස දිවුරුම් දුන් මහින්ද රාජපක්ෂ මහතාව හියපු නීතිපති C R ද සිල්වා සමග ගොස් හමුවී වැදවැටී ජනාධිපති නීතීඥ තනතුරක් 2013 දී ලබාගත් ප‍්‍රසන්න ජයවර්ධන ද ශ්‍රේෂ්ඨාධිකරණයේ විනිසුරුවරයෙකු ලෙස පත්වූයේ යහපාලනය අධිකරණයට අතපොවන ආකාරය ලොවට පෙන්වමිනි.

1989 දී නීතීඥයෙකු ලෙස දිවුරුම් දුන් ප‍්‍රසන්න ජයවර්ධන පත් කිරීම නිසා අභායාචනාධිකරණයේ සභාපති විනිසුරු විජිත් මලල්ගොඩට පමණක් නොව ඊට පහලින් සිටින සියලූ විනිසුරු තනතුරු වලට සිදුවූයේ අගතියකි. එසේ අගතියට පත්වූ එක් අයෙකි විනිසුරු දීපානි විජේසුන්දර මහත්මිය ඇයද නීතීඥවරියක ලෙස දිවුරුම් දී ඇත්තේ 1980 වර්ෂයේය අධිකරණ සේවයේ විනිසුරුවරියක ලෙස දැනට වසර 36 ක සේවා කාලයක් අවසන් කර ඇත විනුසුරුවරියක ලෙස ඇය යහපාලනයේ වෛරයට පාත‍්‍රවී ඇත්තේ සරත් ෆෙන්සේකාට එරෙහි නඩුව ඇසීම නිසාය. එය පුදුමයකි විනිශ්චකාරවරයෙකුට හෝ වරියකට තමා ඉදිරියට එන නඩුවක් යම් දැන හැදුනුම් කමක් නොමැති නම් විසදීමට හැකිය එසේම අදාල චූදිත පාර්ශවයේ විරෝධයක් නොමැතිනම් එය කල හැකිය විනිසුරුවරුන් තීන්දු දෙන්නේ නීතියට අනුව කරනු ලබන සමාජ මෙහෙවරක් ඉටු කරමිනි එව චූදිත සමග ඇති අමනාපයක් නිසා කරන්නක් නොවන බව මේ යහපාලන නඬේ උගත යුතුය. නැතිනම් වින්සුරුවරුන්ට සිදුවන්නේ ඔවුන්ට පන්දම් ඇල්ලීමටය එවිට නීතිය වල් වැදී අධිකරණය ස්වාධින නොවේ නීතියේ පාලනය කඩා වැටේ එය පොඩි දරුවකුටද තේරුම් යනු ඇත .

අගවිනුසුරු ශ‍්‍රී පවන් මහතා ද ශ්‍රේෂ්ඨාධිකරණයට පත්කිරීමට නිර්දේශ කලේ අභියාචනාධිකරන සභාපති විජිත් මොල්ලිගොඩ සහ අභියාචනාධිකරන විනිසුරු දීපානි විජේසුන්දරගේ නම්ය ඔවුන් දෙදෙනාම නීති සහ අධිකරණය කේ‍්‍රෂත‍්‍රයේ මහජනයා හා රජය වෙනුවෙන් වසර 35කා අධික සේවා කාලයක් ඇති නිලධාරීන්ය ඔවුන් දෙදෙනාම තම සේවා රාජකාරි ඉටු කිරීම සම්බන්ධයෙන් කිසිදු ගැටලූවක් අපවාදයක් එල්ලවී නැත .

එහෙත් 2016 ජූනි මස ශ්‍රේෂ්ඨාධිකරණයට පත්වූ ප‍්‍රසන්න ජයවර්ධනගේ පැටිකිරිය නම් ඔහු 1989 වර්ෂයේ නීතීඥ වෘර්තියට පිවිස 2013 දී හිටපු නීතිපති C R ද සිල්වා සමග මහින්ද රාජපක්ෂ හමුවී ජනාධිපති නීතීඥ කමක් ලබා ගත්තේය පසුව 2014 නොවැම්බර් මාසයෙන් පසුව රනිල් වික‍්‍රමසිංහ මහතාගේ සිරිකොත නීති අංශයට බැදී මහින්දට විරුද්ධව කටයුතු කිරීමයි මේ අනුව වර්තමාන යහපාලන ආණ්ඩුව ශ්‍රේෂ්ඨාධිකරණයට විනිසුරුවන් පත් කරන්නේ සිරිකොත එක්සත් ජාතික පක්ෂ මූලස්තානයෙන් බව පැහැදිලිය.

යහපාලන රජය අධිකරණයට අත තැබූ තවත් අවස්තාවක් වන්නේ කෙළෙඹ අතිරේක මහේස්ත‍්‍රාත් තිලිණ ගමගේ මහතාට එරෙහිව අලිපැටවෙකු පිලිබද චෝදනා එල්ල කර ඔහුව අනිවාර්ය නිවාඩු යැවීමයි එයට හේතුව වූයේ වත්මන් ජනාධිපති මෛත‍්‍රීපාල මහතාට දාව පොළොන්නරුව හිගුරක්ගොඩ කිඹුලා ඇලෙහි පදිංචි  චමිලා කුමාරි දිසානායක මහත්මියට ඉපදීසිටින දැනට 17 හැවිරිදි වියේ පසුවන ශහසුක කුලසේකර දරුවාගේ පීතෘත්වය සම්බන්ධයෙන් නීතීඥ පින්සිත් පෙරේරා මහතා විසින් DNA පරීක්ෂණයක් කර පීතෘත්වය කරගැනීමට කරන ලද ඉල්ලීමට අවසර ලබාදීමයි.

අල්ලනවානම් අලි හොරෙකු ලෙස ඇල්ලිය යුත්තේ තිළින ගමගේ නොව විඝනකාධිපති වරයා විසින් පිටු 1058ක සිය වාර්ථාව පාර්ලිමේන්තුවට ඉදිරිපත් කරමින් රුපියල් කෝටි දාහතරදහස් පන්සීයක අලාභයක් මෙරට මහජනයාට සහ රජයට බැදුම්කර සිද්ධියෙන් අලාභ සිදුකර තම බෑනාගේ සමාගමට ඒ සා විශාල මුදලක් ලබා ගැනීමට සලස්වා එම මුදල් අග‍්‍රාමාත්‍යවරයාට ලබාදුන් මහබැංකු අධිපති අර්ජුන් මහේන්ද්‍රන් සහ ඔහු රකින අගමැති මිනීමරු රනිල් වික‍්‍රමසිංහ බව බත්කන කාටත් තේරෙන කරුණකි.

මෙසේ බලන විට 2015 ජනවාරි 09 යහපාලනයයැයි බොඞ් ලෑල්ලට මුවාවී බලයට පත්වූ හොර නඩය කරන්නේ අධිකරණයට තම හිතවතුන් පත් කිරීමයි. නීතිපති දෙපාර්තමේන්තුව විනාශ කිරීමයි එහි ඊලග පියවර ලෙස කරන්නට යන්නේ 2017 පෙබරවාරියේ දැනට සිටින අගවිනිසුරු ශ‍්‍රීපවන් මහතා විශ‍්‍රාම ගිය පසුව දැනට නීතිපතිව සිටින ජයන්ත ජයසූරිය මහතා අගවිනිසුරු කිරීමයි ඉන් පසුව නීතිපති ලෙස හියපු එක්සත් ජාතික පක්ෂ පාර්ලිමේන්තු මන්ත‍්‍රී සහ කාරක සභා සභාපති වූ නෝමන් වෛද්‍යරත්න මහතාගේ පුත් නීතිපති දෙපාර්තමේන්තුවේ අතිරේක සොලිස්ටර් ජනරාල් කපිල වෛද්‍යරත්න මහතා එක්සත් ජාතික පාර්ශව කරුවෙකු ලෙස සලකා නීතිපති තනතුරට පත්කර එළබෙන ජන්ද සටනට පෙර ඒකාබද්ධ විපක්ෂයේ සියලූ දෙනා කූඩු කිරීමයි.

එළාර ,සෙන, ගුත්තික,දාඨිය, පීඨිය ආදීහුද රාජරාජ,,රාජේන්ද්රමෙන්ම කාලිංගමාඝ හා චන්ද්රභානුද අපි එළවාදම්මෙමු. ප්රුතුගීසි, ලන්දේසි හා වඩුගයාගෙන්ද ගැලවුනෙමු.. එහෙත් 1948දී ඉංග්රීසිකාරයාගෙන් ගැලවුනේ නාමිකවශයෙන් පැමි අපේරටනැවත අපට ඕනෑ විදිහට සකසාගැනීමඅර්බුදයක් වනපරිදි ඉංග්රීසි කාරයාවිසින්කටයුතු කරනලදී 1948ආසන්නවනවිට ඉංග්රීසින්ගේ ආධිපත්යය දියවෙමින් පැවතුනඅතර ඉන්දියානු නිදහස්අරගලයට මුහුණදෙන අතරතුරේදීම ලංකාවටද නිදහසදීමේ අදහස ඉංග්රීසින්තුල විය.. ඉන්දියාවේ වැනිඉංග්රීසිවිරෝධී ප්රභූ දේශපාලකයන් ලංකාවේඇති නොවනපරිදි කල් තියාම ඉංග්රීසින්විසින් කටයුතුකර තිබු හෙයින් තමන්ගේ සුවචකීකරු අතවැසියන්වෙත ලංකාවේ පාලනයභාරදීම ඔවුන්ට ප්රශ්නයක්ද නොවීය..සුදු ජාතිකයන් අතින් කළු ජාතිකයන් අතට පාලනය පත්වෙනවාමිස පාලනරටාවේ වෙනසක් නොවනබව ඉංග්රීසීහු දන සිටියහ.

මේ වනවිට සිංහලේවිනාශකිරීමසඳහා ඉංග්රීසින්විසින් ගෙන තිබු . පළාත්බෙදීම්, ඉඩම්පවරාගැනීම්,, වාරිමාර්ගනොසලකාහැරීම,මගින් රටේකෘෂිශිෂ්ටාචාරය බිඳදැමීම,, වතුවගාමගින් කඳුකරයවිනාශකිරීම සහ විදේශීය කම්කරුවන් දහස් ගණනින් මෙරටට ගෙන්වා පදිචි කිරීමාදී විවිධ පියවර නිසා සිදුවෙමින්පවතින විනාශය ඇසින් දුටු කනින් ඇසු එකල ලාංකික ප්රභූහු මෙය ව්යසනයක් නොව ආශීර්වාදයක් සේ පෙන්වමින් මුළුරටම

ඉහතකී සියලු ව්යසනයන්ගෙන් අතිශයින්ම භයානකවුයේත් අද භයානක වී ඇත්තෙත් අනාගතයේදී මහාපිළිකාවක් වන්නේත් ඉංග්රීසින් විසින් මෙරටටගෙන්වා පදිංචිකරවූ දකුණු ඉන්දීය කම් කරුවන්ය, සිංහලයන්ගේඉඩම් බලහත්කාරයෙන් හා ප්රයෝගයෙන් ලබාගත් ඉංග්රීසීහු 1883වනවිට අක්කර 1, 085, 653 බ්රතාන්ය ධනපතියන්ට පවරා තිබුණි. මෙනිසාඅසරණ වූ සිංහලයන් විශාලපිරිසක් සාගින්නෙන් මියගියහ. සමහරු වෙනත්පළාත්වලට විසිර ගියහ. මේ වතුවල කෝපි හා තේ වැවීමෙදී. ශ්රමිකයන් අවශ්යබව ඔවුහු දැන සිටිඅතර මේසඳහා සිංහලයන් යෙදවීමට ඉංග්රීසින්තුල එතරම්කැමැත්තක් නොවීය. සිංහලයන්නැවත මේ ප්රදේශයේ පදිංචිවීමවැලක්වීමට ඉන්ගීසින්ට අවශ්යවූනිසා අවශ්යශ්රමය චීනයෙන් ලබාගැනීමට පළමුවෙන් උත්සාහගන්නා ලදී. එහෙත්ඉංග්රීසින්විසින් පසුවප්රචාරය කරන ලද්දේ සිංහලයන්ස්වභාවයෙන්කම්මැලි ජාතියක්නිසා වතු වල වැඩට නොකැමැති වූ බවය් .. සිංහලයන් බොහොමයක්ම ඉංග්රීසි හතුරන්ගේ කුලී කාරයන් වීමට කැමති නොවූ බව නම් සත්යයකි චීනෙන් කම්කරුවන් ගෙන ඒමටයන අධික වියදම නිසා පුව ඔවුහු දකුණු ඉන්දියාව දෙසට හැරුන බව පෙනේ

– අනුරුද්ධ බණ්ඩාර රණවාරණ ලංකා සී නිවුස්

එදා ‘පුහුල් හොරො’ ‘කරෙන්’ දැනුණ සේ අද ‘බැඳුම්කර හොරා ‘පර්පචුවල් ටේ‍රෂරීස් සමාගම’ ලැබූ අධික ලාභයෙන් හෙළිදරව් වී ඇති බව ජාතික නිදහස් පෙරමුණේ නායක, පාර්ලි්මේන්තු මන්ත්‍රී විමල් වීරවංශ මහතා පෙන්වා දෙයි.

මහ බැංකුව විසින් සිදුකර අවසන්කර ඇති එහෙත් එහි ඉහළ නිලධාරියකු විසින් මුදල් මණ්ඩලය වෙත ඉදිරිපත් නොකර සිය ලාච්චුවේ සඟවා ගෙන සිටින පරීක්‍ෂණ වාර්තාවක් මාධ්‍ය වෙත අනාවරණය කරමින් විමල් වීරවංශ මහතා මෙසේ පෙන්වා දුන්නේය.

බොරැල්ල එන්.එම් පෙරේරා මධ්‍යස්ථානයේ පැවැති මාධ්‍ය හමුවකදී මෙම හෙළිදරව්ව සිදුකළ විමල් වීරවංශ මහතා එහිදී මෙසේ ද පැවසීය.

2015 ජනවාරි 08 වැනිදා බලයට පත් වුණු සිරිසේන-වික්‍රමසිංහ ජෝඩුව ඡන්දයට කලින් හදපු මතය තමයි ‘අපි මේ රටේ ආර්ථිකය ශක්තිමත් කරනවා’ කියන එක. නමුත් වික්‍රමසිංහ මහත්තයලා අදහන බටහිර රටවල් විසින් පළ කරන FORBS සඟරාවේ පසුගිය කලාපයේ පළ වූ ලිපියකින් පෙන්වා දී ඇත්තේ කුමක්ද? ‘2015 ජනවාරි 08 වැනිදායින් පසුව ශ්‍රී ලංකාවේ දේශීය ණය බර 12%කිනුත් විදේශීය ණය බර 25%කිනුත් ඉහළ ගොස් ඇත’ කියලයි. ඒ වගේම එම ලිපියේ සඳහන් වෙනවා ‘එසේ ණය බර ඉහළ ගොස් ඇත්තේ මේ වන විට ශ්‍රී ලංකාව තුළ මහා පරිමාණ යටිතල පහසුකම් ව්‍යාපෘතියක් ක්‍රියාත්මක නොවන තත්වයක් තුළය’ කියලා. වසරක කාලයක් තුළ ණය බර ඉහත ආකාරයට ඉහළ යාම අසාමාන්‍ය තත්වයක්. ශ්‍රී ලංකා ඉතිහාසය තුළ මේ තරම් ප්‍රතිශතයකින් වසරක් තුළ ණය බර ඉහළගොස් නැහැ.

‘ණය බර ඉහළ යාමට බලපෑ ප්‍රධාන කරුණු

මේ විදියට වසරක් තුළ ශ්‍රී ලංකාවේ ණය බර ඉහළ යාමට බලපෑ ප්‍රධාන කරුණු මොනවාද? එකක් තමයි රුපියල දිගින් දිගටම අවප්‍රමාණය වීම. අනෙක් හේතුව තමයි ඉතාම ඉහළ පොලී අනුපාතිකයන්ට රට තුළින් හා රටට පිටතින් ණය ලබා ගැනීම. ‘රට ණය උගුලෙන් බේරා ගන්නවා’ කියූ සිරිසේන- වික්‍රමසිංහ ජෝඩුව ආර්ථික වර්ධන වේගය 3%ක අගයකට පහත හෙළමින් මේ කර ඇති ජංජාලයෙන් පෙනෙනවා, ‘මේක අසමත්, අකර්යක්‍ෂම පාලනයක්’ කියලා. මේ අය රට ගැන කිසිම දෙයක් නොසිතා, කඩා වඩා ගැනීම සඳහා පමණක් පාලනයක් ගෙන යන කණ්ඩායමක් බව අද ඔප්පු වෙලා ඉවරයි.

මේ අසමත් පාලනය ගිය අවුරුද්දේ ‘අය-වැය’ කීයක් ගෙනාවාද? මුලින්ම විශේෂ ආර්ථික ප්‍රකාශයක් අගමැති වික්‍රමසිංහ මහත්තයා සිදු කළා. ඊළඟට රවී කරුණානායක මහත්තයා අය – වැයක්. ගෙනවා ඊට පසුව අගමැතිවරයා තවත් ප්‍රකාශයක් සිදු කරලා තවත් අය – වැයක් ගෙනාවා. ඒ අනුව තුන්වතාවක් 2016 අය – වැයෙන් නොගත්තු තීරණයක් විදියට තමයි වැට් බද්ද 15% දක්වා ඉහළ දැම්මේ. ඒ විදියට පනත් සංශෝධනයකින් තොරව වැඞ් බද්ද ඉහළ දැම්මා. ඒක අප උසාවි ගිහින් නැවත්තුවා. ඊට පසුව කැබ්නට් අනුමැතියකින් තොරව නව පනත් කෙටුම්පත ගෙනාවා. ඒක ඒ නිසා ශුන්‍ය වුණා. වැට් බද්ද වැඩි කිරිමේ තෙවැනි උත්සාහය ලෙස තවත් පනත් කෙටුම්පතක් ඊයේ (04) විවාදයක් සඳහා පාර්ලිමේන්තුවට ඉදිරිපත් කර තිබෙනවා. එම පනත් කෙටුම්පතේ සඳහන්ව තිබෙනවා ‘2016 සැප්තැම්බර් 09 වැනි දින දෙවන කොටස අතිරේකය, 2016 සැප්තැම්බර් 13 දින නිකතු් කරක ලදී කියා. එකම පනත් කෙටුම්පත සඳහා දින දෙකක් යොදා තිබෙනවා. දැන් අහපුවාම කියනවා ‘ඒකට ප්‍රශ්නයක් නැහැ’ කියා.

මෙහෙම දින දෙකක් අවේ කොහොමද? ජාත්‍යන්තර මූල්‍ය අරමුදලේ ශ්‍රී ලංකාව භාර නිලධාරීන් මේ පිළිබඳව සාකච්ඡා කිරීමට පසුගියදා පැමිණියා. ඒ අය එන්න කලින් මේ පනත් කෙටුම්පත මුද්‍රණයකර ගන්න ඕනේ වුණා. ‘පාර්ලිමේන්තුවේ රීති යකාට ගියාfවි’ කියලා, මූල්‍ය අරමුදලේ ‘දෙවි දේවතාවුන්’ පිනවන්න තමයි මේ පනත් කෙටුම්පත කලින් ගෙන ආවේ. මේ පනත් කෙටුම්පතට අනුමැතිය ගැනීම සඳහා කැබිනට් මණ්ඩලය රැස් වුණේ පසුගිය සැප්තැම්බර් 12 වැනිදා. ඒ නිසා ‘සැප්තැම්බර් 13 වැනිදා නිකුත් කරන ලදී’ කියා ම්‍රද්‍රණය කරන්න වෙනවා. ඒ අනුව පෙනෙනවා මේ පනත් කෙටුම්පත මුල්‍ය අරමුදලේ නියෝජිතයන්ට ඉදිරිපත්කර ඇත්තේ කැබිනට් මණ්ඩලයේ අනුමැතිය නොමැතිව බව. පැවැති සම්ප්‍රදායන් අද ‘යකාට ගිහිල්ලා’ තිබෙන්නේ. මෙහෙම ගියොත් අය-වැය විවාදය නත්තල් දක්වා ඇදෙන තත්වයක් ඇති වෙනවා. ඒ වගේම අය-වැය ලේඛනය ඉදිරිපත් කිරීමත් නොවැම්බර් අග සතිය දක්වා කල් යාවි, එවිට අය-වැය විවාදය සඳහා ඉතිරි වන්නේ මාස එකහමාරකටත් වඩා අඩු කාලයක්.

‘පෝට් සිටියට අත දාලා කරගත් දේ’

මේ ආණ්ඩුවට අය-වැය හදා ගන්න තේරෙන්නේ නැහැ, අය-වැය ගෙන එන්නෙ ඕනේ ‘කාලය’ තේරෙන්නේ නැහැ. පනත් කෙටුම්පතක් හදා ගන්න තේරෙන්නේ නැහැ. මහ ලොකුවට ජාත්‍යන්තර සබඳතා ගැන කිව්වා නමුත් ‘පෝට් සිටියට’ අත දමලා චීනය තරහා කර ගත්තා. අවසානයේදී වන්දිත් දීලා තිබුණටත්වඩා වැඩි භූ ප්‍රමාණයක් ඒ විදිහටම පෝට් සිටිය හදන්න ඉඩ දුන්නා. ඒ වගේම යුදමය වාතාවරණය නිසා කල් දැමීමට නියමිතව තිබූ පකිස්ථානයේ පැවැත්වීමට නියමිතව තිබූ සාක් සමුළුව ‘වර්ජනයා කරනවා’ කියා මංගල සමරවීරගේ උපදෙස් මත විදේශ අමාත්‍යාංශය නිවේදන නිකුත් කළා. අවසානයේදී මේ අය ඔප්පු කළා තමන් ඉන්දියාවේ විදේශ ප්‍රතිපත්තියේ ‘වහළෙක්’ කියලා. මේ සියල්ල නොදන්නා මේ ආණ්ඩුව එක දෙයක් නම් හොඳට දන්නවා. ඒ තමයි ‘අනෙක් පාර්ශ්වයට හොරා හොරා කියමින්, උදේ ඉදන් හැන්දෑ වෙනකම් හොඳ හැටියට හොරා කෑම.

‘පර්පචුවල් ටේ‍රෂරීස් ගනුදෙනුව පිළිබඳ වාර්තාව’

හිටපු මහ බංකු අධිපතිවරයාගේ බෑණාගේ සමාගම මහ බැංකුව සමඟ සිදු කළ බැඳුම්කර ගනුදෙනුව පිළිබඳව පරික්‍ෂණයක් සිදු කිරීමට එවැනි සමාගම් පිළිබඳ පරික්‍ෂණ සිදුකරන මහ බැංකුවේ දෙපාර්තමේන්තුවට භාර දී තිබුණා. එම දෙපාර්තමේන්තුව විසින් ඉහත පරීක්‍ෂණය සිදුකර වාර්තාවක් නිකුත්කර තිබෙනවා. එම වාර්තාව මෙතෙක් මුදල් මණ්ඩලයට (Monetary Board) සලකා බැලීම සහ අනුමැතිය සඳහා ඉදිරිපත් නොකර, එම බැඳුම්කර ගනුදෙනුව සම්බන්ධ නිලධාරියකු තමන්ගේ ලාච්චුවේ ඇතුළේ තබා ගෙන සිටිනවා. වාර්තාව පසකස් කර ඇත්තේ 2016 සැප්තැම්බර් වලදීයි. මෙම මාධ්‍ය හමුවෙන් අනතුරුව මා එම වාර්තාව මාධ්‍යවේදී ඔබ වෙත ලබා දෙනවා.

‘Perpetual Treasaries Limited – Find slip of the On-site Examination’ නමින් හඳුන්වා ඇති එම පරීක්‍ෂණ වාර්තාව මුදල් මණ්ඩලයට ඉදිරිපත් කිරීමට ප්‍රථම අත්සන් කළ යුතු එම මහ බැංකු දෙපාර්තමේන්තුවේ නිලධාරීන් 04 දෙනෙකු සිටිනවා. ඒ අතරින් මෙම වාර්තාවේ සඳහන් DG(SM) යන තනතුරු නාමය දරන නිලධාරියා තමයි මේ වාර්තාව ලාච්චුවේ දමා ගෙන සිටින්නේ. මේ වාර්තාව මගින් ඉතාමත් නිවැරදි කරුණු පෙන්වා දී තිබෙනවා, ‘මහ බැංකු හොරකම කොහොමද සිදු වුණේ?’ කියලා.
මේ බැඳුම්කර ගනුදෙනුවලින් පසුව පර්පචුවල් ටේ‍රෂරීස් සමාගම ගෙවි ගීය වසර තුළ බිලියන 05කටත් වැඩි ලාභයක් උපයා තිබෙනවා. ඊට පෙර වසරවල එම සමාගමේ ලාභය මිලියන දෙක තුනක්. සේවකයන් 20ක් පමණයි සිටින්නේ. මේ කුඩා සමාගම ඩයලොග් සමාගමටත් වඩා වැඩි ලාභයක් මෙවර උපයාගෙන තිබෙනවා. මේ ලාභය මේ රටේ සියලුම බැංකු ලබා ඇති ලාභයටත් වඩා වැඩි ලාභයක්.

‘පත්තරයට නමක් : බැඳුම්කරේ’

මේක අර්ජුන මහේන්ද්‍රන්ගේ තනි කොල්ලයක් නොවෙයි. මේක එකතු වෙලා කරලු කොල්ලයක්. මේ අයුතු ලාභයෙන් ‘පුහුල් හොරා’ කරෙන් දැනෙන්නේ නැද්ද?’ මේ පරික්‍ෂණ වාර්තාවෙන් හෙළිදරව් කර තිබෙනවා. ‘මෙම ගනුදෙනුවේ වැරුද්ද, එම දෝෂ නිවැරදි කිරීමට ගත යුතු පියවර’ ආදිය. අද ඒ වාර්තාව හංගලා. එය ඉහළට යවන්නේ නැහැ.

ඒ නිසා කාරණාව ඉතා පැහැදිලියි. කෝප් වාර්තාවත් බාලගිරි දෝෂය වගේ ‘අද නොවෙයි හෙට’ කියලා කල් යමින් තිබෙනවා. මේ බැඳුම්කර වංචාවෙන් කොල්ල කාපු මුදල් වලින් අර්ජුන ඇලෝෂියස් ළඟදී හෙලිකොප්ටරයක් මිලදී ගත්තා. එහි වටිනාකම ඇමෙරිකන් ඩොලර් මිලියන 2.5ක්. ඒත් රතු අලි පැටියා ‘මේ සල්ලි එයා හොරා කාපු සල්ලිද? කියලා අහන්නේ නැහැ. දැන් මේ හොරාකපු සල්ලිවලින් පත්තරයකුත් පටන් ගන්න හදනවා. මුද්‍රණ යන්ත්‍ර එහෙම රටින් ගෙනවිල්ලා සවිකර අවසන්. අපි අර්ජුන ඇලෝෂියස්ට සහ එතුමාගේ දේශපාලන නායකයන්ට යෝජනා කරනවා ඒ පත්තරේ නම දාන්න ‘බැඳුම්කරේ’ කියලා. ඒ බැඳුම්කර වංචාවෙන් ‘මාටියා ගහපු’ මුදලින් කොටසක් යොදවලා තමයි මේ පත්තරය පටන් ගන්නේ. රනිල් වික්‍රමසිංහගේ නැති ප්‍රතිරූපය ගොඩනංවන්නයි මේ පත්තරය පටන් ගන්නේ. අපි මේ රටේ පත්තර පාඨකයන්ටත් කියනවා ‘ඔය පත්තරය අච්චු ගහලා එන දවසට ඒකට අතවත් තියන්න හපාෟ’ කියලා. දැන් ඉතාමත් පැහැදිලිව පෙනෙනවා, ‘මේ ආණ්ඩුව ඇලෝෂියස් ලවා හොරකම් කරගත් මුදල් තමන්ගේ ප්‍රතිරූපය ගොඩනංවා ගැනීමට සහ තමන්ගේ සුඛ විහරණයට යොදා ගන්න බව. මේවට FCID,CID නැහැ. අර අල්ලස් කොමිසමේ ඉන්න ‘ලලනාව’ නැහැ. ඒ අයගේ සංවේදී ඉන්ද්‍රියන් මේ කෙරෙහි යොමු වන්නේ නැහැ. මේක ආණ්ඩුවක් මහ දවල් කළ ලොකුම සොරකම. පුහුල් හොරු දැනුණේ කරෙන් නමුත් බැඳුම්කර හොරකම පෙනෙනවා පර්පචුවල් ටේ‍රෂරීස් සමාගම ලැබූ අධික ලාභයෙන්. මේ පිළිබඳව අපි ඒකාබද්ධ විපක්‍ෂය ලෙස ඉදිරියේදී තවත් පියවර කිහිපයක් ගැනීමට බලාපොරොත්තු වෙනවා.”

”රණමඟ ඔස්සේ නන්දිකඩාල්” යන කෘතිය  එලි දක්වා ඇත.වර්ෂ 2009යේ මැයි මස 19 වෙනිදායින් පසුව මෙරට කලාකරුවන් සාහිත්‍යදරයින්  හා ලේඛකයින් විසින් ඉටුකලයුතුව තිබු, නමුත් ඒ කිසිවෙක් අත නොතැබූ  කාර්යයක් මේ මහා ග්‍රන්ථය එලිදැක්වීමත් සමග සම්පුර්නව  ඇත ”රණමඟ ඔස්සේ නන්දිකඩාල්” හි කතුවරයා ලේඛන කලාවේ කෙලපැමිණි ප්‍රවීනයෙක් නොවුණද,  ඔහු, ග්‍රන්ථ  නිර්මාණ ලේඛනකලාව නවතම තලයකට  ඔසවා තබා ඇති බව විශේෂයෙන්ම  සදහන් කල යුතු කරුණකි.

මහා සැඩ පරුෂ  කුරිරු යුද්දය තුලද, සුමට  කලාවක් ඇත. ඒ කලාවේ කෙල පැමිණි යුධ ශිල්පියා සිය රණබිමේ කාර්යය නිමවා, සිය  අත රැදී ආයුදය පසෙකලා, පෑනෙන් ශිල්ප දැක්වීම ආරම්භකර  ඇත. යුද ආයුදයට වඩා පෑන බලවත් යයි පාරම්බාන සමාජයක, පෑන නිසි ලෙස හැසිරවීමට එරෙහිව  බලපෑම් ඇති සමාජයක, පෑන ඉතා සුමටව හැසිරවීමේ කර්තව්‍යට මේ රණවිරුවා විශිස්ට ලෙස අත ගසා ඇත. ඒ වෙනුවෙන් රටෙත් ජාතියේත් ප්‍රණාමය මේ කෘතියට හා ලේඛකයාට හිමිවිය යුතුය.

මෛත්‍රීගේ මහා හෙලිදරවුව දවසින් බොරු වෙයි.. චන්ද්‍රිකාගේ ඵලකය නෙළුම් පොකුණේ අදත් නිරුපද්‍රිතයි..

Swiss being a  neutral country with people who are quite calm always go for something quite unique and now WIGGY wants something Swiss !

We have good governance alias Yahapalanaya which sounds musical to so called democratic countries who watch our country.

UN keeps praising us and human right groups love this musical word .That is because, yahapalanaya gives you a comfortable feeling sans white vans, extrajudicial killings etc . ( we may have doctors not playing Swiss Rules” ,and Customs officers using Swiss Knives-type strategy to stab the heart of the economy )

For investors who wants to earn money by deriving many ways to get a state owned property or enterprise to re-invest are now having an additional musical word” under Yahapalanaya  .”Swiss Challenge

Swiss challenge is a form of public procurement in some jurisdictions which requires a public authority (usually an agency of government) which has received an unsolicited bid for a public project (such as a port, road or railway) or services to be provided to government, to publish the bid and invite third parties to match or exceed it.

Some Swiss challenges also allow the entity which submitted the unsolicited bid itself then to match or better the best bid which comes out of the Swiss challenge process. I myself who believe in good governance and fair play fell in love with this word Swiss Challenge being used in some project procurement processes  ,when I met the officials  of SLLRDC ,which I ran under Premadasa ,  was quite intrigued by listening to young professionals guided by the Yahapalana rules and an aggressive minister . They have been told to use Swiss Challenge to speed up investments.

All Government institutions should be educated to apply Swiss Challenge to shortcut long procedures, and invite JVO.LOC  and all political forces who tend to criticize every move by the state to develop the country using Private Public Partnership ( PPP) .

We have to  educate all treasury officials who represent the state in Boards of many corporations

The word unsolicited proposal is not very musical ,but Swiss Challenge may be only way out to get private entrepreneurs to develop the country tying to avoid tedious process of tenders ,evaluations etc .

Only qualification we should have is, you have to know someone somewhere to initiate the challenge”

A royal battle over a commode

President Maithripala Sirisena may pardon the terrorists who once made abortive attempts on his life while he was a minister, but he does not seem willing to forgive his former bosses, the Rajapaksas, who, while in power, shortchanged him, deprived him of the post of Prime Minister and are currently posting a formidable political challenge to him. Rarely does he miss an opportunity to vent his spleen on the former ruling clan. Power politics is a gladiatorial combat where no quarter is asked or given.

President Sirisena, while making a public speech the other day, sought to dispute claims being made in some quarters that no development had taken place on his watch and his government was busy opening the projects completed by the Rajapaksa administration. The President must be really hurt.

At a time his propagandists are all out to rebrand President Sirisena as the modern-day Vijayabahu the Great of Polonnaruwa–– Rajapaksa was once described as the reincarnation of great warrior king Dutugemunu from Ruhuna––an attempt is being made to liken him to King Nissanka Malla, another king who ruled from Polonnaruwa, believed to have claimed the credit for the works of his predecessors and even put up stone inscriptions with his name carved thereon for that purpose. Who can bring himself to stomach such indignities?

President Sirisena, in a bid to drive a point home, claimed it was his predecessor who had sought to get the credit for others’ work. Citing the Nelum Pokuna Theatre as an example, the President said Rajapaksa had got a plaque erected by President Chandrika Kumaratunga, who laid the foundation stone for the project, demolished and a new one put up bearing his name. Denying this allegation, Rajapaksa has said through his media secretary that the plaque containing Kumaratunga’s name remains intact.

Now, the question is who is telling the public the truth. Those who visit the Nelum Pokuna Theatre can see whether both plaques are there or the one with CBK’s name has been obliterated.

One can understand why President Sirisena is so bitterly antipathetic to the Rajapaksas; it must be really irritating for him to see his bête noire, Rajapaksa in the rearview mirror all the time. If the latter forms a new party to contest the local government polls, the government will be forced to conduct sooner or later, the support base of the SLFP, which the former leads, is bound to suffer a severe erosion. This is a worrisome proposition for the anti-Rajapaksa camp controlling the SLFP.

There is a way President Sirisena can remove the Rajapaksas from his path once and for all; he and his allies should prove the very serious charges they levelled against the Rajapaksas before the last presidential and parliamentary elections. They said the Rajapaksas had stashed away as much as USD 18 bn in offshore accounts. President Sirisena himself said the Rajapaksa family lived off the fat of the land at the expense of the hapless public and even possessed a ‘golden horse’ besides a fleet of super luxury vehicles. The political enemies of the Rajapaksas are now ensconced in power with Gestapo style police units at their disposal to conduct probes, and they should go the whole hog and have the Rajapaksas and their backers arraigned on charges of the plunder of public assets. Mere diatribe won’t do.

Meanwhile, one may recall that President Kumaratunga some moons ago said that her gorge rose at the sight of the Nelum Pokuna Theatre, which, she said, had the same look as a commode. So, one may argue, she would have considered it a favour if the Rajapaksas had demolished the plaque carrying her name. Who wants to have his or her name associated with a commode?

JO alleges VAT Bill presented for second time in irregular manner

The Value Added Tax (Amendment) Bill was presented to Parliament yesterday by Leader of the House Minister Lakshman Kiriella amidst concerns from Opposition lawmakers that for the second time the Bill had been presented in an irregular manner

Soon after the Bill was presented, UPFA (Joint Opposition Group) MP Bandula Gunawardena pointed out that the Bill had been published in the gazette before it got Cabinet approval.

He said the proper procedure was to get Cabinet approval before it was published in the gazette.  “The Bill received Cabinet approval on September 12 but the gazette was issued on September 9,” he said.

State Minister of Finance Lakshman Yapa Abeywardena said the Ministry had got an opinion from the Attorney General on the matter and the report would be given to Parliament tomorrow.

Speaker Karu Jayasuriya said if there was a dispute, the Bill could be challenged in Court. “I will accept the State Minister’s position,” he said.

This is the second time the Bill is being presented to the House. The Supreme Court ruled in early August that the previous Bill presented by the Minister to the House lacked Cabinet approval and, therefore, it was not consistent with the Constitution.

The new Bill, approved by the Cabinet on September 12, includes several amendments to the Bill previously presented to the House.   In terms of the new bill, VAT will be charged at 15 percent.

The imposition of VAT applies, among others, to wholesale and retail trade if the threshold is more than Rs. 50 million a year or Rs. 12.5 million a quarter. The new rate will also be imposed on private health services other than diagnostic tests, dialysis, and OPD services. It will also apply to channeling consultation, telecommunication services, tobacco products and powdered milk which contain added sugar or other sweetening matter.

Indian author bats for free mingling of people

Guwahati: Prominent Assamese writer, who is an Arunachali by native, Yeshe Dorjee Thongchi opposes the idea of inner line permit (ILP) arrangement, which is presently applied to three northeastern States namely Mizoram, Nagaland and Arunachal Pradesh.

Attending the ‘Guest of the Month’ program of Guwahati Press Club  on

4 October 2016, the Sahitya Academi awardee author argued that free movements of native citizens inside a country should not be opposed.

Thongchi strongly batted for mingling of the people of different origins.

Answering queries from the scribes in the interactive session, Thongchi clarified that he would not comment on the present movements going on in Manipur and Meghalaya for the ILP, but he is convinced that the present laws in his home State are effective enough to safeguard the interest of the indigenous people.

The prolific author argued that the initial idea of imposing ILP was to prevent criminal & anti-locals entering into a particular State, but today the concept is changed. Now the threat is no longer from the outsiders, but the alternate media which poses real danger to the indigenous cultures across the globe.

A retired top-ranked bureaucrat, Thongchi started his literary pursuit since his school days. Although his mother tongue is a dialect called Sherdukpen spoken by few thousand families in Arunachal, Thongchi started practicing his writings in Assamese language as it was the medium of instruction in NEFA schools those days.

The soft spoken gentleman, while speaking about the replacement of Assamese language in Arunachal’s medium of instruction, Thongchi clarified that it was not because of any conspiracy hatched by the Hindi lobby. The widely recognized author disclosed that actually the English replaced it as the medium. Hindi is taught in Arunachal schools as a subject only.

Born in 1952 in west Kameng, Thongchi completed his schooling in Arunachal Pradesh and later sfifted to Assam for higher education in Cotton College and Gauhati University. After graduation,  Thongchi was  appointed as an Arunachal Pradesh Civil Service officer and later inducted to the Indian Administrative Service in 1992.

Immensely popular with Assamese readers through his literary works like  ‘Mauna Oath Mukhar Hriday’, ‘Sonam’, ‘Beeh Konyar Deshat’, ‘Shaw Kota Manuh’, ‘Moi Akou Janam Lom’, ‘Papor Pukhuri’, ‘Banh Foolar Gondha’ etc, Thongchi has received a number of awards including Bhasha Bharati, Phulchand Khandelwal Sanghati, Basudev Jalan besides Sahitya Akademi.

Thongchi was honored with a traditional Assamese Zapi and Gamocha at the beginning of the interactive session, which witnessed the presence of many senior journalists like Rupam Barua, Ranen Kumar Goswami, Girindra Karjee, Nava Thakuria along with writer  Jagadindra Raichoudhury, Surya Das, Ahsan Majid, Archana Bhattacharya etc.

Sri Lanka accedes to the Marrakesh Treaty to increase access to books, magazines and other printed materials for persons with print disabilities

Sri Lanka on Wednesday ( 5 October 2016) became the 24th country to accede to the Marrakesh Treaty to Facilitate Access to Published Works for Persons Who Are Blind, Visually Impaired or Otherwise Print Disabled.  Sri Lanka’s Permanent Representative to the UN in Geneva Ambassador Ravinatha Aryasinha, handed over the instrument of accession to the Director General of the World Intellectual Property Organization (WIPO) Dr. Francis Gurry, during the ongoing 56th Series of Meetings of Assemblies of the Member States of WIPO, 3-11 October 2016 in Geneva.

More than 75 WIPO member states have signed the Treaty, which entered into force on 30 September 2016, 3 months following the ratification of the 20th country. The Marrakesh Treaty is envisaged to facilitate the availability of published works in accessible formats for the people who are blind, visually impaired, and print disabled. – such as Braille – through limitations and exceptions to the rights of copyright right holders. The Treaty is also designed to provide assurances to authors and publishers that their published works will not be misused or distribution to anyone other than the intended beneficiaries.

Earlier delivering Sri Lanka’s country statement at the Meeting of Assemblies on Tuesday, Ambassador Aryasinha said, enabling legislation will soon be introduced in Sri Lanka’s Parliament to amend the National Copyright Laws to facilitate access to published work for persons who are blind, visually impaired or print disabled. He also provided an update on Sri Lanka – WIPO cooperation in implementing a 10 Point Action Plan, which was embarked upon in November 2013 during the visit of Director General of the World Intellectual Property Organization (WIPO) Dr. Francis Gurry, to Sri Lanka.

Ambassador Aryasinha said a Steering Committee on Intellectual Property (SCIP) chaired by the Secretary of the Ministry of Industry and Commerce  established last year, continued to have an exchange of views with WIPO officials in Geneva every two months through a video conference, to assess progress in the implementation of the 10 Point Action Plan.

He said, among the projects being operationalized – Sri Lanka was selected as one of the four pilot countries to participate in the CDIP Project titled Intellectual Property, Tourism and Culture”, coordinated by the Sri Lanka Tourism Development Authority (SLTDA) and a WIPO Mission undertaken in May 2016 brought together the main stakeholders to create a National Steering Committee for the implementation of this Project. WIPO Missions had also been undertaken to Sri Lanka in June to support the creation of Intellectual Property Hubs (IP Hubs) bringing together a group of stakeholders from public and private sectors. A Mission in June also provided technical assistance in the development of a National Innovation Index. An IP Office Diagnostics Mission was undertaken in August to make an assessment of the capacity and resources of the National Intellectual Property Office (NIPO) and to enhance the IP registration system in Sri Lanka. The Government expects to complete accession to the Madrid Agreement and Protocol for the International Registration of Marks by end of 2017/early 2018 and a Madrid awareness raising session is scheduled for November 2016. An inter-Ministerial Working Group is also to be set up, supported by WIPO, in order to achieve the objectives of formulating a national policy for the protection of Traditional Knowledge, Genetic Resources, and Traditional Cultural expressions.

 I am in searching of such a Holy Book and will read it in full – remarks Dr. Hemakumara Nanayakara, Governor of Southern Province.

 A four member delegation from the Ahmadiyya Muslim Jama’at Sri Lanka (AMJSL) comprising Mr.A. Abdul Aziz, Press Secretary and National Director Faith Outreach – AMJSL, Moulavi A.B. Musthaq Ahmad – Chief Missionary (AMJSL), Moulavi K.M. Munir Ahmad (Missionary – Pasyala) and Murabbi Javid Raheem, visited Galle and Mathara of Souhern Province of Sri Lanka recently,

The delegation visited Richmond College and met Royal de Silva, Deputy Principal. While accepting the copy of Holy Qur’an Sinhala Translation he said: A necessary one and added these days people are quarrelling each other for unnecessary issues and he will be pleased to have such a valuable book.

The delegation visited Galle Municipal Council and met Mr. Ranil Wickramasekara – Commissioner. He accepted Holy Qur’an Sinhala Translation with due respect.

While accepting the copy of Holy Qur’an Sinhala Translation, Mr. U.L. Nanayakara, Deputy Principal of Vidyaloka College said: Our children should know what religions teach – not only their on religion, but also they should know what other religion say. He went on to say that this is the foundation for the religious harmony.

While accepting the copy of Holy Qur’an Sinhala Translation, Mrs Swarnalatha Annasiwathe, Deputy Principal, Sangamitha Balika Maha Viyalaya informed that she did not find any source to have such a holy book even though she contacted Muslim friends.

The delegation visited Governor’s Office at Galle and met Honorable Dr. Hemakumara Nanyakara. While accepting the copy of Holy Qur’an Sinhala Translation, he remarked: I am in searching of such a Holy Book and will read it in full and hailed the task of Ahmadiyya Community in translating Holy Qur’an in sinhala language. He accepted with due respect.

The delegation proceeded to Chief Minister’s Office and had the opportunity to meet Honorable Shan Wijeyalal de Slve to present the copy of Holy Qur’an Sinhala Translation. He accepted with due respect.

Ahmadiyya delegation visited Open University, Galle Region and Vice Chancellor Office Ruhunu University, Mathara. In both places, Holy Qur’an Sinhala Translation presented.

The delegation met Mr. I.D.K.L. Fernando, Senior Asst. Librarian of Ruhunu University, Mathara. He showed interest on current situation of the world and the lack of peace. He was explained in detail about the tireless efforts being made by the Khalifa and the Ahmadiyya worldwide leader, Hazrat Mirza Masroor Ahmad, by spreading the true teachings of Islam through various means, particularly addressing lawmakers at Capitol Hill, EU Parliament, in Ireland Parliament, and recently the Dutch Parliament. He was informed about the gist of His Holiness’ address during the recent Dutch Parliament visit.

Further pointed out about the unique feature of the Ahmadiyya Muslim Community and said that this is the only Community which has Spiritual Leadership and termed as ONE COMMUNITY – ONE LEADER’. He added that the Community’s motto is ’LOVE FOR ALL; HATRED FOR NONE’.

In the end, the delegation visited RUHUNU SERVICE (A FM Radio Station and met Radio Presenter. He was very much pleased to get the copy of  Holy Qur’an Sinhala Translation.

During the visit, Ahmadiyya delegation visited number of schools namely Sudhrama Maha Vidyalaya, Thomas Galle school, St. Aloysius’ College and Kumarathunga Munidasa Public Lbrary.

To all of them, along copy of the Sinhala Translation of the Holy Qur’an with some other literatures including Peace Messages in Sinhala were presented.

People should read and understand this Holy Book – that is our prayers and wish.

If Pentagon paid $540m to PR firms for false videos – Who is behind the C4 videos against Sri Lanka?

They say, the first to be killed at wars is the truth. The discovery of the US Government paying foreign firms to produce lies that have justified illegal wars and occupations leading to the suffering and displacement of so many is certainly of concern. Tragically, the mainstream media are silent and the big mouths wailing about human rights and freedoms are also silent as are many others. This now raises the question of how credible the C4 videos on Sri Lanka are timed perfectly before Geneva Resolutions and now gone into silent mode! US tax dollars are being used to make false films and videos. Manufactured news is not ethical. Playing with people’s minds is unfair. It has justified false wars and illegal occupations and even regime change. People have every right to be questioning – nothing is as it is or is shown to be.

A joint investigation by the Sunday Times and the Bureau of Investigative Journalism claims that the US White House tasked Bell Pontinger to make fake terrorist videos in Iraq as part of an enormous propaganda campaign between 2007 and 2011. Bell Pontinger took $540m to fabricate short TV segments inside the US camp in Iraq with 300 British and Iraqi staff. Bell Pontinger staff reported to the CIA, the National Security Council and the Pentagon on the project with a mandate to portray Al-Qaeda in a negative light and track suspected sympathizers. Bell Pontinger was used because US law prohibits the government from using propaganda on its population.

Colour labels distinguished the type of operation – Grey ops – television commercials showing Al Qaeda negatively shown as designed by Arabic TV. In 2009, it was reported that the Pentagon had hired controversial PR firm, The Rendon Group, to monitor the reporting of journalists embedded with the U.S. military, to assess whether they were giving positive” coverage to its missions. Talk about media freedom!

Some views of people around the world

We have every right to question the C4 footage against Sri Lanka. C4 has won awards though not one footage was shot by C4 and none of the eyewitness accounts comes from journalists. What is the authenticity of bits and pieces put together and declare it a documentary. How do we know whether these were not filmed by LTTE tv crew who had a habit of doing the same. In fact Shyam Tekwani an expert in terrorism and media working for Asia Pacific Centre for Security Studies compared the ‘tone and tenor’ of the documentary to LTTE’s propaganda production wing saying it was ‘clearly an effort to sensationalize and shock with carefully selected and edited footage, the documentary weakens its case and invites and investigation into its own credibility and accountability to journalistic norms. The volume of the testimony it uses as evidence is not enormous and most of its derived from leading questions’.

Incidentally, C4’s star witness Vany K was a LTTE cadre.

A A Gill described the footage as ‘unattributed and uncorroborated’ saying ‘not a second of this has been shot by Channel 4 – none of the witness accounts comes from journalists’. He also said Jon Snow’s narration was ‘intemperate and partisan’ and ‘was all held together by assumptions’.

Put all this in the context of money being paid for false videos we can only demand to know who was behind the production of the C4 videos, who paid for it and who wrote the scripts?

Yfantis, a professor of computer science at University of Nevada-Las Vegas specialising in computer graphics and image processing, stated that “based on mathematical analysis, blood in the 3GP videos is not real blood. It is not clear if the blood in the 3GP scenes is water with red dye or digitally constructed or edited video blood” and that “video graphic and mathematical analysis of the two 3GP videos show that the videos either were edited, or staged, or both”.

Inspite of these ASSUMPTIONS C4 ends up getting international awards!

C4 cannot get away if they have committed lies. We are all in shock over the millions spent for fooling the masses by the Pentagon. We certainly have every right to question the C4 killing fields video as well and hopefully the investigative journalists that uncovered the Bell Potinger fake videos should also investigate the Killing Fields videos as well.

NO to ETCA: Sri Lanka’s Business Community put Nation before Profit

Without a doubt the private sector plays a crucial role in steering the economy of Sri Lanka. Even in adverse times Sri Lanka managed to keep afloat. The capitalist system however is failing globally. Once rich and flourishing nations are all in decline. There is imbalances everywhere. Even the US is trillions in debt. Elsewhere in Europe there is a migrant crisis as a result of the bogus military interventions taking place, again these interventions will only benefit the companies and banks that funded the war coffers. Sri Lanka’s corporate world cannot overlook ground political realities. In such a climate all investments and agreements must necessitate a broader understanding of the ramifications to the country both mid-term and long term inspite of short term profit. The business community of Sri Lanka must put Country First.

Lets’ first look at the global economic structure.

Countries are made to open markets and grow cash crops where all that is grown ends up exported and the people end up paying for imported goods. The businessmen of course reaps the profits. This is not sustainable development. A nation’s victims of the cash crop end up facing economic hardships and eventually the nation too suffers. A good look at the trade deals over the years proves this.

Free-market neoliberal dogma increases competition through deregulation and opening domestic markets to foreign competitors. The victims are social welfare systems, health, domestic labor laws and environmental laws. We see that now happening. Foreigners eventually end up taking back more than they have put in. Politicians are easily influenced because they are pressed for investment and money to sustain their own political existence.

The current government has not understood the magnitude of the situation they have created for themselves. They have been euthanized by wanting to please the so-called international community and fallen prey to pats of their back thereby foolishly abdicating the powers of the State to external forces aligned to NGOs on foreign payroll.

Privatizing initiatives now being ironed out through public private partnership programs (another proven failure) will further limit and diminish the role of the State.

In privatizing state assets and liberalizing economic policies to foreign transnational companies (virtually on par with world governments) Sri Lanka will come under foreign rule. We are drafting a scenario where UN and IMF-WB will end up running Sri Lanka!

When will people wake up to the fact that IMF-WB and the WTO have created a framework to suit elite politician-corporate nexus across the world. GDP growth and per capita consumption model has only promoted debt, ravaged environments and left people in squalor.

IMF and WB advocate neoliberal economics which in other words is maximum market freedom and minimum state intervention. In such a scenario the presence of Indian businesses and Indian people in Sri Lanka is going to drastically affect all of the people including the local business community since the state monopoly will also be reduced and they will not be able to come to their assistance in their own country (govt functions will soon be taken over by private enterprises)

These changes have come slyly. Unknown to third world governments the IMF and World Bank have spent on training to tap opinion-makers and decision makers (state legislators, civil society, bureaucrats, media etc) and who have been spoon fed on the proposed economic framework hypnotizing them to accept the structural adjustments and then tasked to coerce the public.

For those who boast of open market economic success – let them show examples of where IMF-WB structural adjustments in the form of currency devaluation, liberalizing of economy, privatizing public assets, relaxing environmental laws, removing safeguards for employees in labor laws, removing subsidies have benefitted the masses?

Statistics show the economic gap between 1% haves and 99% have-nots increasing resulting in further tensions and future calamities.

What we have is the elitism of the 1% not realizing that they are sitting on a virtual volcano even though they do not wish to surrender their profit.

The IMF and WB as a result of their neoliberal policies stand guilty of

  • Causing severe environmental degradation
  • Crashing Third World economies
  • Reducing public welfare systems – health, education etc
  • Create rising unemployment (with ETCA Sri Lankans unemployment will rise)
  • Increase in food prices / fuel prices

What we now see is that at the one hand the IMF-WB is pushing for these very harsh changes from a bankrupt Sri Lankan Government which cannot dictate terms while India is demanding the Sri Lankan Government sign the ETCA entailing Indians to virtually take over Sri Lanka with time. Is the Sri Lankan business community bothered about this scenario or have they not even thought of this scenario?

Can a handful of Sri Lankan business community compete with over 1.3million active private companies in India?

What the Sri Lankan Government and Sri Lankan business community must also be aware of is that India’s economic policy is currently dictated by the IMF-WB and WTO combination which are controlled by the US. Incidentally Manmohan Singh the former Indian PM was a WB employee and when he became PM he made Montek Ahluwahlia the Deputy Chairman of the Planning Commission and Ahluwahlia was from IMF while the RBI Governor R Rajan was also at IMF. Connect the dots and connect the people!

Of course Indian billionaires have increased but the poor have become poorer too. There are 111 billionaires in India – http://www.thehindu.com/business/Economy/india-adds-27-new-billionaires/article8276674.ece According to WB 276 million people, lived below $1.25 per day.

Before India comes to help Sri Lanka, shouldn’t India help its own people?

We know that India is not the India pre-1994 – it is a country where neoliberalism influences all 3 pillars of governance including the judicial functions (Essar/Ambani tapes).

 

There are also accusations that governments end up tweaking statistics just to attract investments. Contrary to what is being projected privatization has not delivered the goods and the scenario will worsen if privatization is handed to foreigners. Have we forgotten the many foreign investors who jumped the ship during President Premadasa’s reign. How many factories were abandoned with these foreigners scooting off with the profits? In opening up the entirety of the country are we not committing hara kiri once more?

Sri Lanka is a small island nation. We are just 20million people. Our immediate neighbour has a population of 1.3billion. Let’s admit – we have never had good relations even diplomatically. We are dealing with a country that even Prabakaran the LTTE leader did not trust. We are dealing with a country that introduced terrorism and Tamil militancy including separatist ideology. That same country is fanning the separatism once more. All these are with intent to continue to destabalize Sri Lanka while economically enveloping Sri Lanka into its fold in an effort that reaps irreversible results. Why are we knowingly walking into traps?

As a small nation Sri Lanka can easily flourish. All we need is a country-centric plan. We have all the wherewithal to develop.

CEPA proposed in 2008 initially resurfaced in 2013 – Comprehensive Economic Partnership Agreement involves service sector enabling Indians to enter into Sri Lanka. Knowing the opposition the government would probably agree to phase out the clauses. Whether it happens today, tomorrow or a few years’ time, this single agreement is detrimental to the demography of Sri Lanka and if it affects the demography it will certainly affect every citizen of the country as well.

Business people can vouch that dealings with India is no piece of cake. Inspite of existing agreements Indian officials give a hard time to Sri Lanka’s business community – letters are not honoured, undue taxes and demurrage are just a handful of issues they face. Instead of addressing fallacies in them why are we walking into another bigger more dangerous agreement? These are questions that every businessmen in Sri Lanka must be asking. They should not leave it only to the business organizations, many of these entities are compromised and heavily influenced.

Let’s look at some statistics and then think of the ramifications.

  • There are 422,446 unemployed in Sri Lanka majority of whom are women – why cannot they be employed by local companies?
  • India’s unemployment is 44.79 Million in 2012. The difference is shocking. Open service sector, these people will arrive and companies will jump to give them jobs at lower salaries but years later what will happen when they settle down and refuse to go given that all labor laws would have changed to suit the foreigners?
  • India produces 50,000 doctors annually. According to WHO report 57% of the doctors in India, are not doctors at all, just quakes – imagine even half of this number coming to work in Sri Lanka’s hospitals just because they agree to a lesser rate from the private hospitals. The hospitals will profit but what is the outcome for the patients being treated by quakes?
  • 1.5million engineering students pass out annually in India – however over 80% of them are unemployable as per study by Aspiring Minds National Employability Report –imagine these engineers being employed for half of the salaries demanded by Sri Lankan qualified engineers and companies employ them looking only at the low cost!
  • 1 in 5 primary teachers do not possess the requisite qualifications to teach in India. There are 17,100 unqualified teachers are working in publicly funded schools across England – do we want to build an illiterate generation of youth by bringing in Indian teachers for cheap?do not have the requisite qualifications to teach young children.do not have the requisite qualifications to teach young children.do not have the requisite qualifications to teach young children
  • Just look how many Indian foreign BPOs have laid off Indian staff – https://www.wsws.org/en/articles/2015/02/27/indi-f27.html all these are now searching employment together with the 45million unemployed in India. They will agree to do any job for any salary because they know how hard it is to get a job in India.

Nevertheless, Sri Lankans and in particular the Sri Lankan business community must while placing the Country First also think about giving preference to the Sri Lankan employees first as well. As it has to be a win-win situation it is good for some programs to be organized for people themselves to realize that they too need to change their attitudes and improve their employability and realize that their jobs can be easily taken over by foreigners in particular Indians who if the ETCA is signed can not only open shops in Sri Lanka but bring their families and have them work in these companies as well. We know that already many Indians arrive as tourists and work in Sri Lanka and return to India before their visa is over, renew their visa and return to Sri Lanka and their earnings are taken with them!

Small, medium or large businesses in Sri Lanka cannot live in isolation without understanding the global economic fundamentals most of which are aligned to politics. Look at how UN is plugging human rights into considerations for various loans/grants to governments. All these are wicked means to further stifle development of developing nations. In such a scenario it is only if a country and its people in particular the business community are united and protect the nation and its people that we can build a wall against the multiple influences and plots taking place.

Therefore the Sri Lankan Business Community is requested to seriously think and assess the situation not from the lens of making self-profit but from the need to protect the nation and its people first.

Sri Lanka’s Debt Crisis Is So Bad The Government Doesn’t Even Know How Much Money It Owes

Trying to develop its infrastructure to increase its economic potential has plunged Sri Lanka deep into a pit of debt, pushing the country to the brink of bankruptcy and prompting an IMF bailout.

The official estimate of what Sri Lanka currently owes its financiers is $64.9 billion — $8 billion of which is owned by China. The country’s debt-to-GDP currently stands around 75% and 95.4% of all government revenue is currently going towards debt repayment.

This debt situation is clearly not sustainable, but there’s more:

In addition to racking up large amounts of government debt via the usual channels, it’s now becoming evident that the previous government also utilized state-owned enterprises to take out additional loans on its behalf. While the full extent of this extracurricular lending seems unknown, current estimates peg it at a minimum of $9.5 billion — which is all off the books of the finance ministry.

We still don’t know the exact total debt number,” Sri Lanka’s prime minister admitted to parliament earlier this month.

Much of Sri Lanka’s pile of debt accrued in the process of initiating an entire buffet of large-scale and extremely expensive infrastructure projects under the direction of former president Mahinda Rajapaksa.

Between 2009 and 2014 Sri Lanka’s total government debt tripled and external debt doubled, as the country engaged in a number of costly undertakings — such as attempting to build a new, multi-billion dollar city in the middle of a jungle (which includes the world’s emptiest international airport), constructing one of the most expensive highways ever made, as well as other pricey endeavors, such as spending $42 million just to remove a rock from the harbor at Hambantota.

But this doesn’t necessarily mean that Sri Lanka’s current administration is doing much better. Under President Maithripala Sirisena and Prime Minister Ranil Wickremesinghe, who came to office at the beginning of 2015, domestic debt grew by 12% and external debt by 25% without starting any new large-scale infrastructure projects.

 This fact has not gone unnoticed by former president Mahinda Rajapaksa, who recently issued a series of public taunts, claiming that with the money the current administration has so far borrowed he could have built two Mattala Airports, one Hambantota Port, one Norochcholai Coal Power Plant, one Colombo-Matara Highway, one Colombo-Katunayake Highway, not one, but two Colombo Port cities and one 500 MW Sampur Coal Power Plant…”

Sri Lanka may be in a debt trap that it can’t get out of. This year alone $4.5 billion is due to foreign lenders and next year $4 billion is owed — bills which the country has not yet figured out a way to pay.

Various interim solutions to the debt crisis have been proposed, such as offering debt-for-equity swaps to countries, such as China, that Sri Lanka owes big and privatizing and outright selling loss-incurring SOEs, which have yet to receive much interest.

The IMF did agree to provide Sri Lanka with a $1.5 billion bailout in the form of a loan in April after the country agreed to a set of criteria to attempt to right the course of its wavering economy. However, as reported by East Asia Forum, Sri Lanka’s Central Bank has stated that it is their intention to secure an additional $5 billion in loans after receiving these funds — and corresponding seal of approval — from the IMF as the debt trap continues getting deeper.

In my opinion the Sri Lankan public should be informed about the  the danger of signing Trade Pacts with western countries. In Europe where, I live, there is pressure against such pacts because of the Investor-State Dispute Settlement (ISDS) mechanism that is embedded in them. This is a new form of colonialism, a trap, which weak countries like Sri Lanka could fall into. The following Transcription of an interview will give you more information on the subject.

Brian Becker (Interviewer): EU trade ministers met in Slovakia yesterday to discuss trade liberalization including the TTIP but if President Obama used his UN speech earlier this week as a rallying cry for free trade, does the agreement really have any chance of passing as world wide opposition is growing against the corporate take over of the world. Large protests have taken place last week end in Germany other protests are taking place in Brussels against TTIP.

Mark Turner (War on Want in the UK): Those protests are both about on the one hand about TTIP and also the EU Canada deal which is called CETA, the comprehensive economic and Trade Agreement. Both of those are very much tied to what is happening in Bratislava and what we have seen happening over the past few weeks around TTIP. We have had many outspoken comments about TTIP from Germany, France and from Austria and from other countries besides these and right now the TTIP talks are really in turmoil and this meeting in Bratislava is trying to deal with that on the one hand but at the same time its going to push through the ongoing talks in Canada on the CETA deal. From our perspective these things are very closely linked because while right at the moment the EU knows deep down that it cant get TTIP through anytime in the near future they are trying to push CETA through because a lot of the things that companies want in TTIP they can actually get through CETA. The core of these deals are very much about the same agenda and the way we see that is that there has been deregulation so this is giving corporations greater control over the setting of rules around the protection of society, the protection of public health and the environment and as a second pillar privatization, about guaranteeing access to services market and thirdly investor rights, so this is the very controversial Investor-State Dispute Settlement (ISDS) system which gives big business the power to sue Governments through its own private justice system. And the real crux of how these two deals link together is that under CETA’s ISDS mechanism, if you are a US corporation and has an office both in Europe and a subsidiary in Canada you can access that mechanism through CETA and the statistics for this is that some 80% of US corporations operating in Europe also have a subsidiary in Canada. That in bold figures is more than 40,000 US corporations. So once CETA goes through you get the same controversial powers that are in TTIP through the deal with Canada. 4:15

Brian: Investor State Dispute Settlement Mechanism – Corporate courts where corporations can actually sue governments if Government policies, either because they are for labour or for environment or to protect of indigenous industry or agriculture, do something, take on policies that do not allow corporations to maximize their profit. How do these corporate courts function ?

Mark: The whole crux of ISDS is dated back to the era when companies had a fear that dictators perhaps in developing countries would seize their assets. What it has become today is where policies made by Governments, if they affect the company’s profits – and the really critical thing here is that not the profits right now, it is profits to be made in the future, if Government policy impinges on that you can then sue the state. Now the way this works is that it is embedded in trade deals and the power is given to the company from the foreign country. So if you are looking at the US and the EU and TTIP what that would mean is that US companies would have the ability to sue European countries and in Europe, European countries would get the same power in America under the trade deal. However, you couldn’t have an American company suing America through that trade deal. With regard to future profits there is a very prominent case in the USA which brings this to light. So when Barak Obama vetoed the Keystone XL pipeline – a decision he took based on his commitment to climate change in the midst of vast opposition, civil disobedience – TransCanada, a Canadian company, immediately sued under these powers through the NAFTA (North American Free Trade Agreement) trade deal with Canada and Mexico. TransCanada had invested some $ 2b in this pipeline and it sued for $ 15b. Now as you can see there is a $ 13 b difference and that is because they say that these are the profits that we would make in the future. For us this is completely untenable which is essentially a form of tax payer funded risk insurance for corporations. And this same pattern is repeated in other cases where there has been public demonstrations and Governments responding to public pressure as in the case of Germany banning Nuclear Power they also were sued for EUR 4.7 b. So this is the distinct pattern repeating again and again.

Brian Becker: There is another case of a US company, Lone Time, is suing Canada for the ban on fracking in Quebec, which is a complete negation of democracy. You have in Canada a federal system where the French speaking part is keen not only in defending the environment they are also aware of their own capacity for self determination but now you have a US company suing Canada, the federal Government, for the ban on fracking in the province of Quebec – this is amazing!

Mark: Exacly, this is another great example because this company has never done any fracking, yet they are suing $ 250 m because they cant frack. The basis of that claim is that “this is the money we would have made and because we essentially have a right to compel fracking under this trade agreement if you are going to stop us from doing it you have to pay us the money we would have made”. It is a very salient point on fracking because a particular sector we see that this is taking place is energy. So on the one hand you see Governments in Europe, the Canadian Government, the US Government saying we want to fight climate change – and a couple of weeks ago Barak Obama said that we help save the world at the Paris Climate Change Summit – and now bringing in these powers vastly extending the range of them which corporations have used time and again to stop progressive legislation around climate change, The two casees are only the tip of the iceberg and we really fear that opening this up through the EU US Trade deal, the EU Canada trade deal you are going to see a whole litany of these cases year after year.

Brian Becker: Another example is that the corporate entity Violia is suing the Egyptian Government for the loss of profits as a result of the country’s decision to raise the minimum wage. Of course we know that 40% of the people in Egypt live below poverty level – less than $2 a day. Now this corporation can sue the Egyptian Government against its actions of trying to remedy the problem of poverty by increasing the minimum wage.

Mark: This is something that happened in the immediate aftermath of what is commonly known as the Arab Spring so what we saw was in direct response to the people saying “we need this and the Government responding to the people’s wishes” but Corporate power stepping in and saying we don’t want that to happen. We see this across all sectors. For example in Slovakia, the Government was sued after winning election on the promise to re-nationalize health care, getting elected on that promise and in acting on that promise being sued for some $ 20m for taking that decision. The Government refused to pay that fine and their assets were seized in Luxenberg by another court and handed over to the company. So when you package all these together, what we are seeing here is a huge shift in power away from the state and towards companies. Yet at the same time we are seeing that the state hiding this from their citizens saying that this is just the normal aspect of the law making things fair for companies. But we can see quite patently from these examples that it is far from that. Through the retaliatory methods countries pay one way or another. In that sense we can see the real danger that not only are we seeing these outrageous rulings but more often than not they have to be followed. Bigdog countries can wither the storm than smaller and emerging countries which leads to a new kind of economic colonization because when we look at colonization what it is in essence is its absolute negation of democracy, that some other foreign entity can make the decisions on what is going to happen to the people in a particular country because that foreign country has taken over control. Here we have the end of the classical formal colonial period – annexation of territory – being replaced by a new kind of colonialism through more informal mechanisms annexation of legal systems, political systems . This is about protecting investments. In the UK the response from the Government to TTIP is that the UK has some 90 treaties with different countries and we have not been sued successfully under them. For a start that is not true, the UK has been sued but when the UK commission researched from the London School of Economics as to what would happen to the UK if we signed up the TTIP, the research found that we would be likely be sued more times than Canada. Canada is the most sued Country in the northern hemisphere under these powers (about 35 times largely through NAFTA). The reason that they found that the UK would be sued more times than Canada is very simple because the US has more capital stock invested in UK than it does in Canada. And correspondingly the richest countries in the world have a lot of their activities in the poorest countries where they ensure that they get access to services markets raw materials all kinds of things. So because of that what we are going to see is that the poorer countries facing these law suits from corporations which come from rich countries and that would entrench further the situation that we already have on global inequality and the poorest people are getting poorer and this will just add to that.

The US wants the EU to remove its agriculture tariffs to remove bans on things like the use of growth hormones the use of antibiotics in animals and to give access to its public services. In return the EU wants access to Buy America where the Buy America Act requires the local states to purchase from within the country. Suddenly, now we see the French and the German Governments coming and decrying this. The reason for this is very simple and that is they both have elections next year. Right now there is a huge opposition in society that the French and German governments cannot win a new election if they support TTIP. There is no sign that TTIP is going to be signed anytime in the next year.

People are beginning to understand that trade is quite simply – under these leaders – is a proxy for corporate greed and it is done in secret and they are opposed to that and will continue to be.

23)  බටහිර ප්‍රජාතන්ත්‍රවාදය ලෝකය පාලනය කිරීමට යොදාගත් කුමන්ත්‍රනයක් අප ඒ ගැන විමසිල්ලෙන් සිටිමු.

24)  අප අපේ ජාතික මව් රටේ අසරණවී සිටින අතර පදිංචිකාර ජනවරිගයන් කුනු රටකරුවන්ගේ වැඩි සැලකීමෙන් හා සිංහෙලයන් අතරමං කිරීම නිසා සිංහෙල රටට තර්ජනය කරති. පදින්චිකාර වතු කම්කරුවන්ද වියලි කලාපයේ අපේ ඇත්තන්ට වඩා හොඳින් ජීවත්වේ. අප දැන් අපේ දියුණුව සඳහා පමනක් ගතයුතු කාලයයි.

31)  අන් සතුන් මරා මලකුනු කෑමෙන් වැළකීම. මිනිස් සතා මස් කන සතෙකු නොව. මස් කන සතුන් කටින් නියෙන් සතා මරා අමුවේ කෑවත් මිනිසාට එය බැරිය. මස් මිනිසාට විසය. අප මරා අපේ මස් කනවාට අප කැමතිද?

32)  මත්පැන් කුඩු වරිග කය තුලට දැමීමෙන් තම හිත කය බල හීනකර රෝගී අකල් මරණයට මගය. හිත කයේ සතුට සඳහා හිත කය වඩාගැනීමේ වියායාම් කිරීමෙන් මත්පැන් කුඩුවලට වඩා දීගකාලීන සතුට ගෙනදේ.

33)  පලමුව හෙල තුනුරුවන් දෙස රැස බස සරන යමු, දෙවෙනුව තෙරුවන් සරන යමු. මන්ද? දෙස, රැස, බස නැතුව තෙරුවන් කෙසේද?  

34)  අනුන්ගේ දොස් හොයන්ට පෙර තමන්තුල දොස් හොයා නිදොස් කරගැනීමෙන් තමන්ට යහපතක් වේ.

Tackling Terrorism

Is a society that endorses torture, civilized? Democratic? Respects the rule of law? Protects women? Upholds human rights?
On the other hand, what should a civilized, democratic society that respects the rule of law and upholds the rights of women and humans as a whole do, when held hostage by terrorists?
Terrorists are not lone wolves. They belong to an organization, which makes their crimes, organized crimes. They aim for maximum impact and so are not engaged in petty crime, but carnage that often amounts to crimes against humans and humanity. Often, they have the support of powerful nations. Taliban, Al Qaeda, ISIS are said to be created by the CIA. The Liberation of Tamil Tigers amongst other terrorist groups, said to be numbering over 80, were sponsored and trained by RAW. A North Korean link was suspected behind the 1971 Janatha Vimukthi Peramuna insurgency.
The world, particularly the Human Rights champions, takes cudgels against terrorism only if it becomes a problem to them. Al Qaeda became a real issue to U.S. after 9/11. The LTTE lost the Indian support only after they assassinated Rajiv Gandhi. Even when terrorism is in larger proportions than a mere group’s hit and run strategy, as when a State against its own citizens or another State, the world does not always react as it should. It is pertinent to remember that even Hitler was allowed by the European powers, until he started biting his neighbors.
Jews were systematically persecuted by the Nazi regime. Those who tried to escape found they had no where to run. Scores of ships carrying Jew refugees to America were turned away by the authorities. Hundreds, if not thousands of men, women and children just perished at sea. Their plight was never the cause for the World War II fight. It was only when Hitler starting invading his neighboring countries, the world recognized his evil. Until the Japanese bombed the Pearl Harbor, the U.S. was their chief supplier. This despite the atrocities and genocidal acts the Japanese were committing in their own East Asian neighborhood.
Even when the world powers are supporting States to combat terrorism, whether enough or the needful is done is questionable. For instance, when Indian sponsored terrorists asserted themselves, the Reagan regime did not want to antagonize the growing Indian markets. Kudus to America however for not abandoning Sri Lanka altogether either. It was the U.S. that established the Israel link that stood in our support during our long protracted war against terrorism. The Bush regime was openly supportive however and helped us greatly to defeat terrorism.
Though the civilized world proscribed the LTTE and froze their assets, restricted their freedom, and assisted the Sri Lankan government with armaments, information and many other vital supports, the LTTE not only survived, but continued to grow in strength.
Almost with each passing day, they became more atrocious. They continued to spurn every value and virtue beholden by the civilized world. They categorically rejected democracy. Anyone who refused them as his sole representative was vaporized. Rivals brutally annihilated. Thousands of children as young as eight or younger were forced into the front lines. The once God worshipping women, even pregnant women, were turned into killer machines. Indiscriminate mass killings and attacks on civilians continued. Captives were gruesomely tortured to death.
All the powers the world reckons – U.S., Russia, China, India, Pakistan, the Arab world backed Sri Lanka. Of course the European and the Scandinavian countries had their reservations, but not all that openly. Thus, with all these support, how did the LTTE continue to grow in strength as they did? With time, the LTTE morphed into such a force that they created their own administration and they became the law.
Even so, the LTTE became only more aggressive and depraved. Like all terrorist movements  before them, they achieved only utter destruction. There is not a single right or freedom the LTTE or anyone else won through terrorism.
However, unless well and truly cornered and without options, no terrorist organization on its own accord will sit at a negotiating table much less renounce violence. All Indian sponsored terrorist groups, except the LTTE, agreed to enter mainstream politics when they realized the Indian Government, having coerced the Sri Lankan Government into a made-in-India political package, was pausing their sponsorship to terrorism. The LTTE however found a strange bedfellow in the Sri Lankan politicians who were utterly opposed to the Indo-Lanka Accord.
Since 1989, the JVP has returned and remained in mainstream politics only after it’s murderous top leadership was taken out. Therefore, unless that life-supporting  plug is removed from the group, there is no negotiating with the terrorists.
However, terrorism is not a straight game between good guys and the bad. This issue is deeply confusing as the face does not always belongs to the brains. More often than not, it is the so-called ‘good’ guys who surreptitiously create or sponsor terrorism in other countries. Facts may prove that terrorism is organized crime engaged in crimes against humans and humanity, but it is marketed as a fight for some rights or minorities that somehow justifies their evil.
The West sponsored democracy in Libya is a case in point. The Libyan intervention was marketed as a humanitarian response and as Obama declared, “people in Libya must be saved.” Renowned business consultant Gerald Celente however asks whether U.S. would have been equally concerned about Libya if its main export was broccoli.
A documentary by RT, highlights Gaddafi’s plans to move away from the American dollar to gold Dinar as the more realistic motive. This would have distributed wealth in the gold and oil rich African and Middle East countries. Gaddafi organized two conferences, in 1986 and 2000 and most African countries were keen.
“In the months leading up to the military intervention,” reports RT, “he called on African and Muslim nations to join together to create this new currency that would rival the dollar and euro. It is an idea that would shift the economic balance of the world. A country’s wealth would depend on how much gold it had and not how many dollars it traded.”
Such a move, says Anthony Wile, founder and chief editor of the Daily Bell, “would certainly not be welcomed by the power elite today, who are responsible for controlling the world’s central banks. So yes, that would certainly be something that would cause his immediate dismissal.”
The documentary states that it happened before when “in 2000, Saddam Hussein announced Iraqi oil would be traded in euros, not dollars. Sanctions and an invasion followed because the Americans were desperate to prevent OPEC from transferring oil trading in all its member countries to the euro.
“A gold dinar would have had serious consequences for the world financial system, but may also have empowered the people of Africa.”
“The U.S. have denied self-determination to Africans inside the U.S.,” exclaims Cynthia McKinney, former U.S. Congresswoman. “So, we are not surprised by anything the U.S. would do to hinder the self-determination of Africans on the continent.”
 The Obama regime certainly stands exposed when Libya disintegrated because in Obama’s own words, they not have a plan for day after. He claims it to be his greatest mistake. However, the world did not see any tangible effort on his part to rectify his mistake either.
The world too continued to pretend it was a mission of goodwill gone astray. Though the problems of Libya has exacerbated beyond measure, many intellectuals agree that getting rid of Gaddafi was a good move and the situation can only improve from now on. Of course, the situation can only improve after hitting rock bottom.
What the intellectuals and other humanitarians do not question – at least loudly enough – is, if this was indeed a humanitarian mission, then why did the NATO forces deliberately destroy the Great Man-Made River?
Humanrightsinvestigations.org notes, “95 percent of Libya is desert and 70 percent of Libyans depend on water which is piped in from the Nubian Sandstone Aquifer System under the southern desert. The water pipe infrastructure is probably the most essential civilian structure in Libya. Key to its continued function, particularly in time of war, is the Brega pipe factory which enables leaks and breaks in the system to be repaired.
“NATO has admitted that it’s jets attacked the poor factory on 22 July, claiming in justification that it was used as a military storage facility and rockets were launched from there,” though they had so far been unable to prove their accusation.
This action amounts to a war crime.
According to Major General Kamal Gunaratne, airstrikes by the Obama regime against the Sri Lankan military in support of the LTTE was a very realistic threat. Thus, defeating the LTTE became a race against time to avoid such a development.
Thus, terrorism is a much larger issue that what meets the causal eye. The world cannot be depended on to protect civilians from terrorism and thus the responsibility that falls squarely on the respective government.
However, how can a government fight terrorism while within the framework of normal law and democracy? How can the government uphold human rights when the entire State structure is challenged by marauding murderers, often with powerful friends? Whose human rights weighs more – that of the suspect in custody or his potential victims? In the process of fighting terrorism, how can the government ensure that its security forces do not act with impunity, nor become a terrorist as well? How can the security establishment ensure that the law will not haunt them afterwards for doing the needful?
“Any government, anywhere in the world,” explains Presidential Counsel Manohara de Silva, “resorts to extrajudicial killings when confronted with an insurgency. It’s not correct and no one should resort to such actions. Judicial means, you have to connect the evidence, lead the evidence and cross examine the subject. When governments have the soldiers, ammunition and intelligence,they resort to the easier way.
“What the section 15 of the Constitution states is that the freedom of others can be limited to protect the rights of another. So, my freedom ends when your rights begins. I can’t exercise my rights in violation of yours. Human Rights should be drawn from this distinction in the interest of national security and the rights of others to maintain a democratic society.
“However, only a judiciary can decide the rights and wrongs of a person and no other body. To deal with terrorism, we need to have a comprehensive National Security Act. Soon after 9/11, America passed its Patriotic Act. However, the Prevention of Terrorist Act we have is very limited in scope. There are other laws that we have passed like the terrorism financing act, money laundering that also have some connection to the PTA. However, it is not as comprehensive as it should be. The NSA must have checks and balanced inbuilt so that it’s power is not abused.
“To ensue that NSA protects small nations from larger powers, the law must be amended so the legislature must approve the contracts the executive signs with other States. This will protect the country from covenants that are inimical to national interests of the country like the Indo-Lanka Accord and the Geneva Resolution. This way, no matter who is in power, there will be a safeguard for the national security of the country.”

Open letter to Minister Faizer Musthafa

Recent news says the minister has asked the people to sort out their garbage and unless they do that, it will not be collected. He had failed dot inform the public what good it does to sort out the garbage since the dumping ground is still a question mark.

Dear Minister, it would have been much more practical if only you could have  informed the public to use the perishables to create compost. The rest can, of course, be recycled; the greatest portion of the garbage collected from homes are the perishables from the kitchen and the garden refuse.  This is considered to be black gold in some countries where they see and recognize a good thing, which is not the trait of Srilankans anyway.

Mr. Minister, To overcome the garbage disposal all you have to do is to provide a compost bin to each household and ask them to dump the perishables in to them. Is that a big deal? But then we Srilankans, never follow  the obviously simple means , do we? The cost of the compost bins, which can be made from recycled plastic, will cost only a fraction of the salary and the transport of tons and tons of garbage, which has no place to go.  On the other hand the compost is selling at 200 rupees a bag of 10 kilos – either the householder can use it or can sell it.

This obviously is not a novel invention – it is a well known, well tried profitable way of disposing garbage by garden lovers. All it needs is a little dedication and education of the public.

Why not try  this at least in one area, as a pilot project. I am sure you are in for a huge surprise.

Why British TV chefs prefer under cooked red meat, are they healthy?

There are plenty of cookery shows in British TV showing cooking so many different varieties of nutritious dishes but sometimes the chefs finish red meats virtually uncooked. They sometimes touch the piece or the lump of meat with finger tips while cooking and to me this is not quite acceptable way to cook. They do not let the piece of meat to cook long enough, sometimes toss it around in the air a few times then say it’s cooked” but when cut to eat, it shows the red in the centre that means uncooked meat.

Under cooked or medium cooked red beef

When green vegetables, fish or meat are properly cooked it changes colour, the appearance and the texture. If for example a lump of beef is cooked, it loses the red colour, any fish the same but to my surprise in some British TV cooking demonstrations, I have witnessed, when the so called cooked beef is cut to eat, sometimes it is still red or even blood dripping red meat. They call them medium cooked beef. Any kind of meat or even fish should be properly cooked because there could be germs and bacteria in them. When it is cooked it should have the same colour throughout otherwise theoretically it is not properly cooked or under cooked. Their excuse was, it’s medium red cooked beef taste better, actually virtually under cooked beef is not safe for human consumption. Who would not agree with me that uncooked beef or chicken may have contaminated with harmful germs and bacteria such as campylobacter, listeria, salmonella and E-coil. The infected beef cannot be easily found just by smell. Back home in Sri Lanka when we cook beef, often we cut into small pieces than cooking as a lump but in some British TV cooking demonstrations, they use it as a little log or lump form. If they prefer to keep them as a large piece then it must be properly cooked for a considerable time. These must be cooked for a fairly long time in a uniform high temperature not just toss up and down on a cooking pan for a couple minutes then say, it’s cooked”.

Red meat is one of the most nutritious foods you can eat. It is loaded with vitamins, minerals, antioxidants and various other nutrients that can have profound effects on health. A 100 gram (3.5 ounces) portion of raw ground beef (10% fat) contains (3): Vitamin B3 (Niacin): 25% of the RDA. Despite the fact that humans have been eating it throughout evolution, many people believe that it can cause harm.

Humans have been eating meat throughout evolution and our digestive systems are well equipped to handle it. Traditional populations like the Inuit and Masai have eaten lots of meat, much more than the average Westerner, but remained in excellent health.

However, the meat we eat today is vastly different from the meat our ancestors ate. Back in the day, animals roamed free and ate grass, insects or whatever was natural to them. Picture a wild cow on a field 10.000 years ago, roaming free and chewing on grass and various other edible plants.

The meat from this animal is completely different from the meat derived from a cow that was born and raised in a factory and fed grain-based feed. It may also have received growth-promoting hormones and antibiotics.

Today, some of our meat products go through even more processing after the animals are slaughtered, they are smoked, cured, then treated with nitrates, preservatives and various chemicals.

Therefore, it is very important to distinguish between the different types of meat: Processed Meat: These products are usually from conventionally raised cows, then go through various processing methods. Examples include sausages and bacon.

Conventional Red Meat

Conventional red meats are fairly unprocessed, but the cows are usually factory farmed. Meats that are red when raw are defined as red” meats. Includes lamb, beef, pork and some others. White Meat: Meats that are white when cooked are defined as white” meats. Includes meat from poultry like chicken and turkey. Grass fed, Organic Meat: This meat comes from animals that have been naturally fed and raised organically, without drugs and hormones. They also don’t have any artificial chemicals added to them. When examining the health effects of meat, it’s important to realize that not all meat is created equal.

 Red meat is very notorious

A 100 gram (3.5 ounces) portion of raw ground beef (10% fat) contains, Vitamin B3 (Niacin): 25% of the RDA. Vitamin B12 (Cobalamin): 37% of the RDA (this vitamin is unattainable from plant foods). Vitamin B6 (Pyridoxine): 18% of the RDA. Iron: 12% of the RDA (This is high quality heme-iron, which is absorbed much better than iron from plants). Zinc: 32% of the RDA. Selenium: 24% of the RDA. Then there are plenty of other vitamins and minerals in there too, in smaller amounts. This comes with a calorie count of 176, with 20 grams of quality animal protein and 10 grams of fat.

Red meat is also rich in important nutrients like Creatine and Carnosine. Non-meat eaters are often deficient in these nutrients, which can have negative effects on various aspects of health, including muscle and brain function. Grass-fed beef is even more nutritious than grain-fed, containing plenty of heart healthy Omega-3s, the fatty acid CLA, along with more Vitamins A and E.

Cardiovascular Disease, Diabetes and Death

The effects of red meat on health have been intensively studied. However, most of these studies are so-called observational studies, which cannot prove causation, just that some things are correlated. There are some observational studies out there saying that red meat is associated with a greater risk of cardiovascular disease, diabetes and death. However, if you look at larger studies that are of higher quality, you find that the effect of red meat diminishes.

In a massive review of 20 studies that included a total of 1,218,380 individuals, processed meat was associated with an increased risk of cardiovascular disease and diabetes. However, no association was found for unprocessed red meat. In the EPIC study, a very large observational study that includes 448,568 individuals, processed meat increased the risk of death while no effect was seen for unprocessed red meat.

When it comes to an increased risk of cardiovascular disease, diabetes and death it is crucial to distinguish between processed and unprocessed meat, because the two can have vastly different effects.

The observational studies seem to agree that processed meat (not unprocessed red meat) is associated with an increased risk of an early death and many diseases.

But even so, it’s important to keep in mind the limitations of these studies. Conclusions drawn from observational studies tend to be wrong. The only way to establish cause and effect is to perform randomized controlled trials.

Does Red Meat Increase Your Risk of Cancer?

There are many observational studies showing that red meat consumption is associated with an increased risk of cancer. The main type of cancer that red meat is believed to cause is colorectal cancer, the third most commonly diagnosed cancer in the world. A recurrent problem in these studies is that they seem to pool together processed meat and unprocessed red meat, which is unacceptable.

Meta-analyses where researchers analyse data from many studies show that the increased risk of colorectal cancer is very low. One meta-analysis found a weak effect for men, but no effect for women other studies show that it may not be the meat itself that is contributing to the increased risk, but harmful compounds that form when the meat is cooked.

Therefore, the cooking method may be a major determinant of the ultimate health effects of meat.

Here are some tips to make sure your meat doesn’t form these harmful compounds. Use gentler cooking methods like stewing and steaming instead of grilling and frying. Minimize cooking at high heats and never expose your meat to a flame. Do not eat charred and/or smoked food. If your meat is burnt, then cut away the charred pieces. If you marinate your meat in garlic, red wine, lemon juice or olive oil, it can reduce HCAs significantly. If you must cook at a high heat, flip your meat frequently to prevent it from getting burned.

Now I will admit that fried and grilled meat tastes awesome. I personally prefer the taste and texture of well-done meat. But if you want to enjoy meat and receive the full benefits without any of the potential harmful consequences, then use the gentler cooking methods and avoid burnt meat.

Where are those energy saving experts?

I have demonstrated how to cook rice and chicken curry by saving energy to a few TV shows and the one I done with Sirasa TV lasted nearly 45 minutes. One must see the actual video to believe me how I saved nearly 60% energy. This method has been practising for years and I look forward to help the general public in Great Britain as well.
