What’s next after the Supreme Court decision?

Last Thursday, just before the courts closed for Christmas holidays, the Supreme Court, sticking strictly to a legalistic path, put an end to the controversial issue of defining the powers of President Maithripala Sirisena, leaving the nation to wrestle with the bigger problems still awaiting solutions to stabilise the nation.  In fact, the grim reality is that the decision of the Supreme has thrown the nation back to square one. If the President agrees to work with Ranil, the nation will be back to another stint of Ranil Wickremesinghe’s rule with all his catchers” returning to lap the cream.

In the meantime, he can now claim Temple Trees” as his legitimate political base. But that was a non-issue in any case, except for him. The nagging overarching question is more serious: what is he going to do with his powers to stay on, thanks to the Supreme Court, during the remaining period of his stewardship? He feels vindicated and strengthened by the Supreme Court decision. But, as things stand now, it is clear, that the more he consolidates his position the more he is likely to take the nation towards confrontation, tensions, uncertainties and instability.

Soon the issues of constitutionality will be forgotten and the usual blame game of party politics will take centre stage. UNP cabinet ministers will trek back to their seats claiming that democracy has being restored. NGOs and the Western embassies will be happy that their apparatchiks are back in the saddle. Paki Saravanamuttu and Prof. Ratnajeevan Hoole, two of the petitioners in the case, too will preen smugly broadcasting that their citizenship rights” have been restored. (More about them later.) In short, will the return of Ranil take us out of the mess or drag us deeper into the depths that began with his regime staging biggest bank heist in the history of the nation in 2015 ?

One can also expect the cockiness of the UNPers to rise to a new level. There is no doubt that the UNP’s arrogance and prime minister’s unilateral policy-making” (International Crisis Group  report –16/5/2017) will generate more problems than solving the issues that cropped up in the post-Yahapalanaya regime. Besides, the political passions surrounding court case have polarised the nation. Ranil will resume his authoritarian role with a vengeance, tolerating no dissent. As usual he will misread the new situation and act as if he has got a new mandate to do what he wants. This is where he will slip and fall. He did not get a mandate from the Supreme Court to override the President nor to bulldoze his way through. Nor is it a personal victory for him, or an endorsement of his leadership. The Supreme Court decision was a mere legal clarification of the Presidential powers within the Constitution which is expected to return the political conditions to the status that existed before Parliament was dissolved. The final judgement is yet to made by the people.  That will come when the election postponed by the Supreme Court will be held in 2020, or whenever.

In essence, what the Supreme Court did was to postpone the election that was gazetted to be held on January 5, 2019. In making its decision Supreme Court did what Ranil has done previously: postpone elections for another date. Postponing elections, under whatever pretext, does not make those evading elections ideal defenders or champions of democracy. His lap dogs in the NGOs, however, want us to believe that democracy is best served by postponing elections. Paki, for instance, asserts that his citizenship rights” have been restored by the Supreme Court postponing the election gazetted by the President. Their latest political theory is tantamount to saying that denying, or postponing, the right to vote is a positive sign of the triumph of democracy.  They argued in Court that holding an election before the scheduled time is a denial of their citizenship rights. You begin to wonder whether Paki is just letting off high-pressure hot air from his mouth, hissing like a leaking car tyre, or delirious that the vast majority has been denied their right to express their will through the exercise of universal franchise. He is bound to claim that the postponing elections by the Supreme Court is a great victory for democracy and for his NGO.. Example: Provincial Council elections have been postponed with no dated fixed for it. Has he gone to courts saying that his citizenship rights have been denied by Ranil Wickremesinghe not holding PC elections?

Of course, it is the duty of every citizen to safeguard the rights that come with citizenship. I am glad that two Tamils could go before an all-Sinhala judiciary and win their citizenship rights in the Sinhala Only” state. But what worries me is why these two Tamils, posing as defenders of human rights (Blah! Blah! Blah!)  didn’t fight for the citizenship of his fellow-Tamils in the high court of Velupillai Prabhakaran who ran his one-man state with all the legal paraphernalia of courts, police, lawyers, judges, etc. The TNA bigwigs, who are lawyers, also trooped into a Sinhala-Only Court, draped in their black gowns, demanding their rights as citizens of Sri Lanka. But when did the TNA lawyers ever step into one of Prabhakaran’s court challenging the Tamil Pol Pot’s fascist regime that denied the Tamil people their inalienable right to protect their children being forcibly abducted to kill more Tamils than all other forces put together, as stated by S. Chandrahasan, son of S. J. V. Chelvanayakam?

An incorrigible tendency of the Tamil leadership has been to fight for democratic rights in the Sinhala South and defend with their lives the fascist tyranny of Tamil Pol Pots in the North. Democracy in the South and Tamil tyranny in North could never co-exist. One or the other had to go. And all peace-loving democrats should pay homage on their knees to our heroic soldiers who restored democracy for the oppressed, war-ravaged Tamils to enjoy the blessings of peace and freedom once again.  The Tamils of the North are able to walk with dignity and respect because 29,000 Sinhala soldiers sacrificed their lives to liberate Jaffna from the Tamil Pol Pot.

I am digressing. Let’s get back Ranil in the post-Supreme Court decision period. Assuming that he has won a great personal  victory he will now parade as the new champion of democracy. Just the other day he portrayed himself as the great discoverer of the fact that the Sri Lankan parliament has been governed by the Westminster tradition since 1948. As everyone knows, one of the sacred tenets of the Westminster tradition is for a prime minister, minister, or an MP, caught red handed with corruption, deceit, lying to Parliament, or obstructing or misleading Parliament etc., to resign immediately without even an inquiry. When has Ranil ever followed that exemplary principle? A British Member of Parliament caught with the evidence revealed in the Bond Commission would have been hounded out of Parliament by the unbearable weight of public opinion alone. But his skin is more tough and leathery than that of a buffalo. He has sailed through the rough and tumble of politics by not talking through his mouth but through an aperture in his anatomy  which is somewhere below his belt, as stated by his childhood friend. Ms. Chandrika Kumaratunga.

Looming large in the days ahead will be his relationship with the President. He will front up as if he has got a legal warrant to extract as much power as he can from the President to push his anti-national agenda. Reconciliation between the two seems unlikely in the immediate future. Plagued by the strained relations both are likely to snipe at each other. Ranil will insist on having his way. At every opportunity his parliamentary manoeuvres will be to fortify and expand his powers. He will pose as a pious pupil of Parliamentary procedure enshrined in the Westminster tradition. His fake commitment to Westminster traditions is exhibited unashamedly in appointing the TNA leader as the Leader of the Opposition who has only 16 MPs in a House of 225. His attempt to get away with lies claiming to be devotee of the Westminster model is childish and stupid.

His main tactic will be to put the blame from now on to the President and Mahinda Rajapakse.  But Anura Kumara Dissanayake has nailed this canard in Parliament. In blunt terms he accused Ranil of being responsible for the recent kerfuffle. The newspaper report captures the full extent of Ranil’s responsibility in causing the crisis. It said: The JVP yesterday (12/ 12/ 2018), criticized UNP Leader Ranil Wickremesinghe, saying that it was he who created the platform for the political coup by President Maithripala Sirisena and Former President Mahinda Rajapaksa.

Participating in the debate, on the confidence motion in support of Wickremesinghe as the Prime Minister of Sri Lanka, JVP Leader Anura Kumara Dissanayake said that the current political turmoil was triggered as a result of Wickremesinghe and his Government shifting away from the mandate the public granted them in 2015.

When a new Government was formed in 2015, there was a specialty in it. Several factions contributed to it. But unfortunately, one faction and a group of persons and a single authority started to claim the power. It is the Governing party which holds the responsibility for doing the correct thing.

They are also responsible for not refraining from any wrong doing. But Wickremesinghe did not care about it. He allowed things, which were not supposed to take place, to happen.”

Dissanayake has also blamed the President and Mahinda Rajapakse. But Ranil will be disappointed that he has not being exempted from blame. Also, being the skilled master of cover-ups, he will not accept his share of responsibility. He will come out swinging to confront the President, the opposition and any dissident that would dare to cross his path.  He thinks he has risen from the ashes like Phoenix.

One drama of Ranil is over.

What’s the next one?

Will the Western dip-low-mutts be invited by the Speaker to clap for the enactment of Ranil’s next theatrical performance in Parliament?

    It was a good read during a dull time. There is however a serious thing happening in Sri Lanka which was high lighted by the absurdity of the judicial decision, the Dictatorship of the Judiciary-

    The Judiciary has gone against the democratic system, by taking a decision that stole the sovereign right of the people to decide on a way out of the present political predicament.

    There are a few lessons from the recent episode. One is the unity of the UNP. We can attribute various reasons for it but the reality is the UNP is as thick as thieves. Well they are! The bond fraud has unified the UNP. This is not the case with the anti-UNP camp. It is divided.

    If a Rajapaksa contests the next presidential election, he is assured not to win more than 10% of minority votes. In 2015, Mahinda won 15% of minority votes despite wasting billions on minorities during the election time as well. The Rajapaksa candidate will be relying on Sinhala voters alone. However, Sinhala voters are divided for good reasons – no candidate champions Sinhala interests. No one promises to abrogate 13A and make Sri Lanka unitary again, no one sees the threat of Wahabism, all candidates promise further federal (devolution), etc.

    A Sinhala candidate must contest the election independently and promise to abrogate 13A, ETCA, Singapore FTA, take back Hambantota, various economic benefits, severe punishment for traitors, Buddhist governance, etc. This will force the anti-UNP camp not to take Buddhists for doormats. 50,000 rupees is not a huge sum of money today. Anyone can dish it out and put his name as a candidate. Preferably the candidate should be from the forces.

    This was done in 2005. JHU threatened to field General Janaka Perera unless Mahinda agreed to its terms which he agreed at the Sri Dalada Maligawa. Had he disagreed, he would have lost the election.

    Rajapaksas know this. That is why they fear a presidential election but demand a parliamentary election. It will be very difficult for Gotabaya to defeat Sajith at a presidential election unless Gotabaya promises nationalist policies. He doesn’t deserve to win without nationalist policies clearly stated. Tamils and Muslims can vote for any dirt but Sinhala people must be choosy and demanding. Protection of this nation depends on the demanding power of the Sinhalese. If they don’t demand, they are doormats. Hakeem, Bathurdeen, Sampanthan, Thonda, etc. to walk over them, again.

    Agree with you Dilrook. What delays the publishing of the Bond Commission Report. This is what makes the UNP and other Perpetual beneficiaries remain thick as thieves. There are wheels within wheels and the more one looks at it Rajapakse too is afraid of the Bond Commission thieves being punished.

    True. Both those Catholic families were introduced to the Central Bank by Rajapaksas in 2005 and 2010 respectively. It is even more interesting. The two families had their own dealings with each other with the sister of one becoming a director of the other’s family company.

    If very senior and important positions are not within the hands of Buddhists for a long time, there is something very wrong. The Central Bank and the Supreme Court have been under non-Buddhists for 13 and 5 years respectively. And there is no sign of change. And it is not merit that appointed them. If merit was followed, Buddhists would be in charge.

    In the long term we must question our holy cow assumptions. What is the best arrangement to protect Sinhala and Buddhist interests in the island? If Sri Lanka failed Sinhalese and Buddhists, a new nation for them must be created. That nation must serve Sinhala interests and not the other way around.

    3. If 1. and 2. are true, Mahinda will be safe.
    4. Let bygones remain there , I hope Mahinda will change to become a True Nationalist ( he has only acted like one ) and make promises to give Sinhalese due place.

    The PRIMARY BENEFIT of this FIASCO of MIS-GOVERNANCE is that ABSENT DEFECTIONS by SLFP MPs to the UNP, the UNP has LOST the 2/3 Majority in Parliament REQUIRED to FIDDLE with the CONSTITUTION, SPECIFICALLY to PASS the 20th AMENDMENT!     HLDM thanks for the exceptionally evaluated current situation in your article. Charles, thanks for the link of the thesis as well.
    There are few things and I think they are very important for us to scrutinize.
    Now we can understand that the meaning and purpose of all the demands of the UNP, JVP and the so-called civil society before the 2015 election had a specific goal. It was not to create a “sadhaarana samaajaya” ‘just society’ but the division of the country. The purpose was to remove all the obstacles for the said purpose, that was to create a divided nation on ethnic line. Now we know these demands of independent institutions had been pre-planned to handle any eventuality in the process of achieving those purposes. They demanded for independent institutions, mainly to unleash them from their burden of being accountable to the people of SL, and created a void so others could come and manipulate them freely. In practice, now these institutions are not accountable to the people anymore.

    So now, the money power and other influences can reign all corners.

    1. They demanded for an independent judiciary. What they meant by being ‘independent’ means, being independent form the sovereign rights of the people of Sri Lanka. According to 1978 constitution, the CJ was appointed by the president. In theory, the judiciary was under people’s jurisdiction because the executive president was appointed by the people in 1978 constitution. Now in post 19th, judiciary is independent from people, but it is still a mootpoint, as to whether they are truly independent from other factors as well. Because we do not know, and it is still to be proven, how much they can maintain their independence in front of the juggernaut of the global players and all other manipulative tools of the internal and external players. One thing is very clear, judiciary is independent from the people of Sri Lanka now!

    2. Above argument is valid for independent police commission and election commission as well.

    3. The new foreign currency controlling laws allowing free reign of foreign money. Now anyone can bring tons of cash and throw left and right to do anything in Sri Lanka. Does that tell you something?

    4. Weakening the firepower of the military waning their ability to defend the country in any event of foreign intervention. Such interventions would be invited to suppress the people’s uprising and political turmoil anticipated by UNP leadership in the event of dividing the nation.

    5. Rising money through bond scam, to cover the cost of bribery and campaign cost through bringing a Ranil’s friend, another tiger into central bank.

    6. Removing all capable leadership who is capable of challenging this entire project from the political arena, to have their free reign until finishing the job.

    These are only few things. There are many more. However, by connecting all these dots, we can create the large picture now. They had planned everything to every possible scenario. Since they were very busy planning this grandiose plot, they had forgotten simple and main things, the population and the development of the country!

    This judgement is based on 19A alone. What if the 19A is flowed and has been passed without taking the previos supreme courts interpretation without going for a referendum?. I think it is time for a powerful group to take up this matter to the supreme court again and try to get a fresh interpretation. If not let a new entity take up this matter in the next parliamentary or prez election to change the whole scenario and limit the power of supreme court to override the wishes of the people.

    I watched the speech of the president.
    It was a great speech. I saw his firm determination to put the entire UNP into a real political quagmire they had never ever experienced in its history. Guys, no other president ever had the guts to humiliate this pathetic Colombians like he did in his speech. The bunch of thieves were just sitting there without having any other option to react.

    This is the end of Ranil’s political career, completely, with no return, as the biggest traitor we have ever seen since Don Juan of Kotte kingdom. That is the greatest outcome of this entire thing. The other thing is that the system devises that Ranil created for the big event, that is the division of the country, especially the true intentions of the legal organs he created to handle his separatist agenda has been exposed to the nation prematurely; before the big event! He wanted to keep it secret until he brings the new constitution to divide the country, but this so called ‘independent’ judiciary exposed its true colors before the anticipated big event.

    The crude hand grenade that Ranil was busily wrapping to kill mother Lanka has been exploded while it was still in his hand- still wrapping it. Didn’t you see it in his face? He was like a pathetic son of .. …! Sirisena had guts to lambast the entire Colombian class reducing it into its atomic dust, not to its back but in its damn face.

    Man…this is thrilling! This is thrilling!! This is awesome!!!

    Now people would go to Temple trees and encircle it from Galle road and Duplication side, like UNPers did, and stay there forcing Ranil to bring the next constitutional change to abolish the 19th amendment.

    In a way, the new situation is better than before. Because it has exposed the criminal nature of the entire separatist agenda and criminality of the front running charlatans of the entire criminal agenda of separatism. And above all, it has exposed the biggest criminal, Ranil Wickramasinghe!

    I wish if he had mentioned that in 2015 presidential election, people never voted for him to divide the country, or to rob the country. In the pres. election, people voted for Mithreepala Sirisena, but not for Ranil Wickramasinghe. Therefore, don’t forget, I am the president.

    2015 පෙබරවාරි මාසයේදී උද්ධමනය අඩුවෙමින් තිබුණත් මේ බැඳුම්කර මගඩිය නිසා පොලී අනුපාත ඉහළ ගිය බව ද ඔහු කීවේය. මේ අනුව රජයට දේශීය ණය තොගය සඳහා සියයට 3 ත් 4 ත් අතර ප්‍රමාණයක්‌ වැඩියෙන් පොලී ගෙවීමට සිදුව ඇති බව ද ඔහු කියයි.

    මේ අනුව 2014 දෙසැම්බර් 31 දින වන විට පැවැති මාස තුනේ භාණ්‌ඩාගාර බිල්පත් පොලී අනුපාතය 2018.11.30 දින වනවිට සියයට 9.87 දක්‌වාද මැයි මාසේ භාණ්‌ඩාගාර බිල්පත් පොලී අනුපාතය සියයට 5.86 සිට සියයට 10.37 දක්‌වා ද එසේම මාස දොළහේ භාණ්‌ඩාගාර බිල්පත් පොලී අනුපාතය සියයට 6.04 සිට සියයට 11.11 දක්‌වාද ඉහළ ගොස්‌ ඇතැයි ඔහු සඳහන් කරයි.

    එසේම වර්ෂ 2 සිට වර්ෂ 30 දක්‌වා නිකුත් කර ඇති සෑම භාණ්‌ඩාගාර බැඳුම්කර පොලී අනුපාතයක්‌ම 2014.12.31 දින සිට පසුගිය 2018.11.31 දින වන විට සැලකිය යුතු ලෙස ඉහළ ගොස්‌ ඇත. මේ අනුව එම කාලයේදී වර්ෂ දෙකේ භාණ්‌ඩාගාර බැඳුම්කර පොලිය සියයට 6.22 සිට සියයට 11.35 දක්‌වාද, වර්ෂ පහේ බැඳුම්කර පොලිය සියයට 7.26 සිට සියයයට 11.75 දක්‌වා ද, වර්ෂ හයේ භාණ්‌ඩාගාර බැඳුම්කර පොළිය 7.57 සිට සියයට 11.87 දක්‌වාද වර්ෂ අටේ භාණ්‌ඩාගාර බැඳුම්කර පොලිය සියයට 7.91 සිට සියයට 11.98 දක්‌වාද වර්ෂ 10 භාණ්‌ඩාගාර බැඳුම්කර පොලිය සියයට 7.99 සිට සියයට 12.13 දක්‌වාද වර්ෂ 15 භාණ්‌ඩාගාර බැඳුම්කර පොලිය සියයට 8.58 සිට සියයට 12. 30 දක්‌වාද වර්ෂ 20 භාණ්‌ඩාගාර බැඳුම්කර පොලිය සියයට 9.15 සිට සියයට 12.45 දක්‌වා සහ වර්ෂ 30 භාණ්‌ඩාගාර බැඳුම්කර පොලිය සියයට 9.27 සිට සියයට 12.30 දක්‌වාද ඉහළ ගොස්‌ ඇතැයි හිටපු බැංකු අධිපති අජිත් නිවාඩ් කබ්රාල් මහතා තවදුරටත් පවසයි.

    I cannot understand people like Sajith Premadasa saying that “if MR confesses his crimes against the people they may forgive him”. What crimes? Was rescuing Sri Lanka from the grip of a ruthless terrorist organization, what is the crime that he committed? The UNP is really pathetic. They depend so much on foreign groups for their own survival. When the President dissolved the Parliament on Oct 26 this year, Ranil went crying to the foreign diplomats from the West who in turn lectured to the President to restore the Parliament. Ranil has no power with the people only with the Parliament which is mostly bought. The TNA stands by Ranil because they think he is their only hope to perhaps divide the country even further. The JVP is a peculiar party. They claim to be for the people and to prevent capitalism. Yet they have been with Ranil who appears as a pure capitalist and never criticized Ranil when Ranil was importing luxury cars tax-free for the MPs at the expense of the people, never criticized Ranil when the Bond scam was done. Once in a way, they were getting up in Parliament and speaking against the Bond scam but never took any active steps to ensure that the people involved were brought to justice. When dissolving the Parliament, the President declared his intention to do so is to have elections. Yet all these champions of democracies in the Western embassies, the JVP, TNA, did not want elections because they know that after 3-1/2 years of corruption and inactivity they had no chance of winning the elections by going in front of the people.

    I am not a lawyer, but is there some way to quote the appointment of RW in Jan’15 as a precedent and make an Appeal to reinstate MR? Even the prevention of MR winning the General Election of Aug’15 by Maithri, which I presume was done at the request of RW, created the whole series of events that has now brought us to the point where we may lose the country completely. Most of these UNP group are Colombians or are bought people, and have no love for Sinhala Buddhists or the country. All of Ranil’s actions at every turn has been to destroy the country. CBK is the same. Her case one can understand as her father and husband were both killed by due to politics. Both of them are foreign agents !. The TNA is using the foreign powers to achieve a separate state for themselves which is also what some of the Western powers want to do in Sri Lanka. It appears that these powers ignore the huge majority community and keep pandering to the minority groups in the hope that if they get a separate state they can then break up the country and re-colonize as was done in the past. Why else suppress the Rights of the majority community of Lanka?

    Sri Lanka has given much to the Tamil community, rights that the others have PLUS additionally the Tamil Language Rights & the Social Disabilities Act. Where is the gratitude? Instead of gratitude, Lanka keeps receiving Tamil leaders push for Separatism, over and over again.

    But now some of the earlier power blocs are collapsing since the Pure Capitalist model seems to be collapsing.
    Sri Lanka fought the terror war and managed to do all the development work with help from mainly the Chinese Govt who give help with no strings attached. Yet while some in the West and some in India do not like Sri Lanka moving too closely with the East, they do not and cannot give Lanka much help at all. As they say in Sinhala “බල්ලා පිදුරු කන්නෙත් නැ කන ගොනාට කන්න දෙන්නෙත් නැ”.
    Instead of the totally Western-style democracy (RW goes for the Westminster model) which does not seem to work well even in the USA or the UK, we might, with some alterations, adopt the Chinese model which appears to work well.
