JO says Police behind plot to kill MR’s family members

The JO was of the opinion that the Police was behind the conspiracy to assassinate former President Mahinda Rajapaksa and his family members, JO member MP Shehan Semasinghe said today.

The CID informed Colombo Magistrate’s Court on Tuesday that the Indian national had claimed that there was a plot to assassinate President Maithripala Sirisena and former President Mahinda Rajapaksa and his family members.

Addressing a news briefing, MP Semasinghe said the Police were seemed to be unconcerned with regard to the spreading speculation on the plot on the lives of President Rajapaksa and his family members.

We saw on Wednesday as to how Police Spokesman SP Ruwan Gunasekera attempted to brush aside the widespread plot under the carpet, saying that nothing had yet been revealed in connection to such a plot,” the MP said.

In such backdrop, when several news reports are being published in this regard, we can’t fathom as to why the Police has turned a blind eye,” he added.

He insisted the Government to tighten the security of Mahinda Rajapaksa and look into the matter seriously.

Meanwhile, D. V. Chanaka said both Arjuna Ranatunga and Dayasiri Jayasekara were responsible to the downfall of the Sri Lanka cricket.

We recently heard both of them are accusing to each other on the pathetic state of the Sri Lanka cricket,” MP Chanaka.

It is evident that officials are unduly intervening into the affairs of cricket which has resulted in such a desperate state in Sri Lanka cricket,” he added.

People shaped by Buddhist civilization don’t violate HR: Cardinal

Archbishop of Colombo Cardinal Malcolm Ranjith yesterday said that people who had been shaped by Buddhist civilization do not violate human rights and added a society which attempts to make human rights a religion, could safeguard human rights effectively through Buddhist teaching.

Cardinal Ranjith expressed these views at the prize giving of Kanduboda Shri Saranankara Daham Pasala in Delgoda organized by the Ven. Parakaduwe Sri Saranankara Thera recently. Chancellor of the Kelaniya University Ven. Dr. Walamitiyawe Kusaladhamma Thera presided over the event.

He said there were threats posed on religions at present and added that Buddhism was the backbone of this country and it was a religion which had been followed by the people in this land for a long time.

Rights of all people in this country are safeguarded when Buddhist culture is safeguarded. Anti religious ideologies are being filtered into the society today. We have to put them aside and safeguard religions,” he said.

Since we have inherited a great culture over the years, there is no need to think about human rights in a special way. Religions are not followed in some countries. Human rights are safeguard in our country much more than what is prescribed by the UN in Sri Lanka because of the Buddhist environment,” he added.

He also said the efforts made by the Buddhist clergy to bring up children according to Buddhist principals were commendable. (Sudath Pubudu Keerthi)

Prez comment only valid if SL withdraws co-sponsorship: Sarath

Referring to the remark made by President Maithripala Sirisena at the UN General Assembly that Sri Lanka should be allowed to handle its own internal affairs, former MP Sarath Weerasekara said the President’s comment would only be valid if the government withdraws the co-sponsorship of 30/1.

Rear Admiral Weerasekara, who is in Geneva to counter the pro-LTTE propaganda, said Sri Lanka is legally bound to implement the recommendations in the resolutions unless it is withdrawn as per the President’s remarks.

He said, The technical assistance provided by the UN had already culminated in a resolution charging Sri Lanka of war crimes. This resolution 30/1 was adopted by this council without a debate or a vote because it was co-sponsored by a delegate and he did that without the approval of the President or the cabinet. Hence it has no legal base. The USA has withdrawn from this council accusing it as politically biased and hypocritical. Since the US was the main sponsor of 30/1 the co-sponsorship too should be nullified automatically.

Germany was occupied by UK and USA for years after world war 11. More Germans were killed as prisoners of war after the war than during the war.

Germany still pays reparations to Israel. We saved 300,000 during the war and rehabilitated 12,000 after the war. It’s a pity that Germany and UK of all the countries are now pushing us to implement 30/1.

The US has threatened sanctions against ICC if it persecutes American soldiers. PM Theresa May said she will change the Human Rights laws to protect her soldiers. Our President too thanked our soldiers who defeated terrorism. It implies he rejects the war crimes. Then why 30/1? Many things can be negotiated Mr. President, but sovereignty, never!”

Namal Kumara makes another startling revelation about DIG Nalaka de Silva

Director (Operations) of the Anti-Corruption Force Namal Kumara has made another revelation regarding DIG Nalaka de Silva of TID and a French national sending financial aid to carry out terrorist activities in the country with the knowledge of the DIG.

Namal Kumara had arrived at the CID yesterday (26) and recorded statements for several hours. Reportedly he has produced another CD containing the alleged telephone conversations with DIG Nalaka Silva.

A press conference was held today by Namal Kumara in order to provide explanations on the alleged conversations contained in the CD, which he had given the CID.

Accordingly, Namal Kumara disclosed a conversation to the media, pertaining to the threats made by DIG Nalaka de Silva to him.

He further presented several cheques and receipts to the media, relevant to the financial aid allegedly received from a French national, supposedly an associate of the diaspora, with the intention of causing a conflict between the Muslim and Tamil communities in the Eastern province.

Meanwhile, DIG Nalaka de Silva has been ordered by the court to produce himself before the Government Analyst’s Department tomorrow (28) to record his voice samples.

This essay records further US assistance to Yahapalana. Chief Operating Officer Jonathan Nash visited Sri Lanka in September 2018 to continue discussion on the proposed MCC Sri Lanka Compact, a large-scale five-year grant program, Lanka to promote economic growth in Sri Lanka . MCC is an innovative foreign assistance agency of the United States Government established in 2004. It has signed compacts with 29 countries around the world. In December 2016, MCC’s Board of Directors selected Sri Lanka for such a compact

This Compact is in its final stages and is expected to be negotiated with the Government of Sri Lanka soon. MCC will fund the compact entirely through grants which do not need to be repaid rather than loans. “It is designed to spur economic growth and investment by the private sector and increase economic opportunities for the people of Sri Lanka,

“Based on an analysis of Sri Lanka’s economy and the constraints that are holding back private investment and growth, MCC expects to invest in projects proposed by the Government of Sri Lanka in the transport and land sectors. The proposed compact would improve road networks and the bus system in the Colombo Metropolitan Region, and improve road connectivity between the central region and ports and markets in the Western Province. The compact would upgrade more than 300 kilometers of urban and interprovincial roads. In addition, the compact would improve land administration, and strengthen land rights and tenure security, said Nash. On 25th September, 2018, MCC informed that they were giving Sri Lanka a grant of USD 480 million as development aid.

USAID funded a project for more female representation in local government bodies. the Harvard Centre for International Development (HCID) is helping Sri Lanka in attracting foreign direct investments (FDIs) promoting emerging exports, targeting new non-existent industries, identifying and engaging with potential new investors, fixing the investment climate for new emerging industries and figuring out how to create new tourist destinations. Five teams of experts are working with Harvard, all focused on issues relating to exports and FDIs. BOI staff has also been receiving training programmes conducted by Harvard University’s Centre for International Development, McKinsey Consulting and the World Bank Group.

The U.S. embassy signed a Memorandum of Understanding with the Matara Chamber of Industry and Commerce in September 2018 to open an American Corner in Matara. The American Corner will offer free programs and training for the Southern Province’s residents. Programs will include English classes, coding and computer skills, leadership and public speaking training, and a range of film screenings and cultural opportunities.”

This American Corner represents the U.S. embassy’s desire to build a relationship with the people of the Southern Province.” Our free programs will expand economic opportunity in the region and build ties between the United States and Sri Lanka.”The American Corner follows the successful March 2018 launch of the U.S. Embassy’s Information Hub (‘iHub”), which has attracted audiences of different ages and diverse backgrounds. Current programs include public speaking and English.”

In February 2018   Yahapalana signed an agreement with the US to re-establish a US Peace Corps programme in Sri Lanka. The negotiations had started in 2016. The first 25 American Peace Corps Volunteers will arrive in Sri Lanka in late 2019 and undergo three months of comprehensive cultural, language and technical training before they are given their assignments to serve for two years.  Peace Corp volunteers in Sri Lanka will focus on English language education and supporting the Education Ministry, schools, and community groups in coordination with the Sri Lankan English Teachers’ Association. They will complement several other English teaching programs funded by the U.S. Embassy and the U.S. Agency for International Development, the press release stated.

They will be given diplomatic privileges The Diplomatic Privileges Act provisions have been invoked to accord equitable treatment to the Volunteers and persons performing functions under contract with the Peace Corps and their dependents.

the Government will provide to the Peace Corps the same exemptions with respect to taxes on payments that they receive to defray their living costs, on income derived from their officials duties, and on income from other sources outside Sri Lanka; customs duties or other charges on their personal property introduced into Sri Lanka for their own use; and all other taxes or other charges (including immigration/visa fees), except licence fees as provided to members of the administrative and technical staff of the Embassy of the United States in accordance with the Vienna Convention on Diplomatic Relations.

The Government will also exempt from all taxes (including value-added taxes) customs duties, and other charges all equipment, supplies, and other goods and services introduced into or acquired in Sri Lanka by the US Government or any contractor financed by it, for use to enable the US Government to discharge its responsibilities under this agreement.

The Government will also exempt such persons, and members of their families forming part of their households who are not citizens or permanent residents of Sri Lanka from all taxes or income derived from their Peace Corps work or other sources outside Sri Lanka, from all customs duties and other charges on their personal property introduced into Sri Lanka for their own use, and from all other taxes or other charges (including immigration/visa fees) except licence fees.

The question needs to be asked as to how teaching English to Sri Lankan children becomes such an urgent priority, said Kamal Wickremasinghe. This shows American interest in deploying so-called development volunteers at grass roots level in Sri Lankan villages close to a scheduled general election (2019). The return of the controversial US Peace Corps, in 2019 reflects Washington’s fears about the forthcoming General Elections and Presidential Elections, observed Tamara Kunanayagam.

The Peace Corps was returning to Sri Lanka after some 20 years. Peace Corps was in Sri Lanka 1962–1964, 1967–1970, 1983–1998. Prime Minister Sirima Bandaranaike kicked them out after she became Prime Minister in 1970. They came back in 1983 and were sent back in 1998. Their return to Sri Lanka has raised the hackles of many who know the deeply suspicious role played by the Peace Corp in the countries they were sent to.

The US Peace Corps evolved from a CIA front known as the International Voluntary Services Inc. (IVS), during preparations for the war against Vietnam. The US Peace Corps has been expelled from a number of countries for spying for the CIA and other covert activities, meddling in local politics, and running drugs. As recently as September 2017, Cambodia’s Prime Minister demanded the withdrawal of the US Peace Corps for conspiring with the opposition leader Kem Sokha to overthrow his government.

.In 1965, Indonesia ordered them out after 16 months. In 1966, Guinea asked PCs to leave. In 1967, Mauritania severed relations with the US, including the PCs. Pakistan and India also refused to renew approval of PC projects in their countries in the early 1970s. Burkina Faso Peace Corps programme was closed in 2017 In Bolivia, in 2008 Peace Corp volunteers was instructed to report on Cuban and Venezuelan nationals in Bolivia.

Now to military matters. United States will provide nearly $300 million in security assistance to improve security relationships across the Indo-Pacific region, including Sri Lanka, Secretary of State, Mike Pompeo announced at the ASEAN Regional Forum in August 2018.

The security assistance funding will cover projects in Bangladesh, Indonesia, Mongolia, Nepal, the Pacific Islands, the Philippines, Sri Lanka, Vietnam and others, in the areas of Maritime Security, Humanitarian Assistance and Disaster Relief (HA/DR), Peacekeeping Operations and Countering Transnational Crime.

As part of the maritime security theme, we launched the Bay of Bengal Initiative to help enhance the capacity of civilian and military maritime actors in this vital region, which is home to important sea lanes linking the Indian Ocean to East Asia. Under the Bay of Bengal Initiative, the United States will ‘work with other partners in the Bay of Bengal, including Bangladesh and Sri Lanka to enhance the capacity of civilian and military maritime actors in the Indian Ocean Region to improve the target areas of detection, information-sharing, and response to emerging threats.’

In August 2018 the U.S. Department of State announced that it would provide approximately $39 million in Foreign Military Financing for Sri Lanka, pending Congressional approval.”We look forward to discussing with the Government of Sri Lanka how this contribution can support our Bay of Bengal initiative and Sri Lanka’s humanitarian assistance and disaster response priorities”, it said in a statement.

The US Army’s Pacific Region Head Gen. Robert B. Brown made an official visit to the Island in July   2018. He met Chief of Defence Staff. Gen. Brown’s visit was aimed at strengthening military cooperation and mutual friendship and thus deepening the US-South Asia understanding. Lengthy discussions took place on how the US Army can assist the Sri Lankan Army on disaster management activities and as to whether the Sri Lankan Peace Keeping Mission can get international training. Gen Brown also admired the professional competency of the Sri Lankan Army on demining.

The U.S. Coast Guard handed over a high endurance cutter, formerly the USCGC Sherman, to the Sri Lankan Navy in August 2018 at Honolulu. The cutter, a gift from the people of the United States, will be the largest ship in the Sri Lankan fleet. It measures 115 meters long and when fully staffed carries a crew of 167 The ship will increase Sri Lanka’s ability to patrol its Exclusive Economic Zone, providing additional security for ships from all nations that transit the busy sea lanes of the Indian Ocean.

In May 2018, a delegation from the House Armed Services Committee of the U.S. Congress visited Sri Lanka. The House Armed Services Committee, a standing committee of the United States House of Representatives, is a powerful Committee, responsible for the supervision of armed forces and the Department of Defence. The delegation was led by its Chairman Mac Thornberry.

The visit was to find out ways of strengthening defence cooperation between Sri Lanka and USA.   President Sirisena told the delegation that he greatly appreciated the defense training provided by the US, such as the joint military exercises carried out by US and Sri Lanka. Such programmes should continue for security purposes.

The US embassy had arranged for the delegation to meet with civil society organizations and the TNA for private discussions. The US embassy said nothing about these meetings, but the TNA issued a detailed statement to the media.

The TNA statement said, that Sampanthan briefed the Thornberry delegation on the current political situation We are unhappy about the way the country is progressing,” the statement quoted Sampanthan as having told the delegation.

Sampanthan was also quoted as having said: “the majority of the people in this country are willing to address the national issue once and for all. What is lacking is that the courage from the Sinhala leaders to go out to the people and explicitly tell them on the need for a new Constitution and the benefits of framing a new Constitution.  Some Sinhala political leaders are trying to satisfy the hardliners than being just and equal to all people in this country, they cannot go on this path forever, it will only end up in history being repeated.

“Especially the President and the Prime Minister must go to the Sinhala people and genuinely explain the need for a new Constitution. Since 1988 every successive government and President have made several attempts to change the present Constitution, therefore, this should not be a difficult task for the majority of Sinhala people to understand. “We want a solution within a united undivided and indivisible country. The power-sharing arrangements should be in accordance with the international covenant on Civil and Political Rights, International Covenant on Economic Social and Cultural Rights and the Universal Declaration of Human Rights said Sampanthan to Thornberry.

Sampanthan told the US delegation that the legitimate demands of the Tamil people in finding a lasting solution to the national question could only be addressed through adopting a new Constitution. Sampanthan highlighted that his party was confident that if the Constitution was passed in Parliament with a two-thirds majority it would be approved by the people at a referendum, which was necessary for a new Constitution he said.”We may have to rethink and our people will be forced to rethink our position if things do not go well and if things are not achieved within a certain time frame, continued Sampanthan

Sampanthan reminded the delegation that the Government of Sri Lanka has given a commitment to fully implement the UNHRC resolution adopted in 2015 before March 2019. They must fast-track their process to achieve those commitments. Sampanthan urged the delegation that the role of the International community with regard to Sri Lanka must be defined in relation to the UNHRC recommendations. The International community must ensure that the promises and the commitments given by the Sri Lankan Government are adhered to and implemented. The International community cannot be a spectator anymore with regard to Sri Lanka, if the government of Sri Lanka continues to fail in their commitments the international community must clearly state their position on their follow up mechanisms to safeguard the victims and ensure the non-recurrence of the past said Sampanthan.

In September 2018, Sagala Ratnayaka    , Minister of Youth Affairs and Chief of Staff to the Prime Minister visited USA and on his return issued a statement. The statement said that Minster Ratnayaka had met Thornberry, also Ted Yoho, Chairman of the House Foreign Affairs Subcommittee on Asia and the Pacific, as well as senior officials of the National Security Council, the Department of State, the Department of Defence, the U.S. Agency for International Development (USAID) and the U.S. Millennium Challenge Corporation (MCC).  Ratnayaka had discussed with them the ongoing Sri Lanka–U.S. partnership and opportunities for further bilateral cooperation within USA’s Indo-Pacific Strategy. Minister Ratnayaka briefed them on current developments in Sri Lanka.

There were several joint navy exercises.  I will list them chronologically. The world’s largest international maritime warfare exercise (Rim of the Pacific – RIMPAC) took place in the Hawaiian Islands and Southern California in June/August 2018. After 47 years Sri Lanka Navy Marines got the opportunity attend RIMPAC. A Sri Lanka media team joined other international media in documenting the exercise. The many exercises conducted during RIMPAC included the training on the operations of an assault ship USS Bonhomme Richard. Participants gained firsthand knowledge on how rescue operation are conducted, how victims are brought to the ship and transferred to the ICU.

In July 2018 The Joint Combined Exchange Training (JCET) exercise between US Naval Special Warfare Forces personnel and Sri Lanka naval personnel from the 4th Fast Attack Flotilla (4FAF) and Special Boat Squadron (SBS) was inaugurated at the Special Boat Squadron Training School (SBSTS) in Trincomalee. The programme is held annually as part of a mutual understanding and agreements for the training and support requirements of both countries. The four – week course focused on developing professional skills and exchange of knowledge among naval personnel of US Naval Special Warfare Forces and Sri Lanka Navy

The third KDU-CNA Track 1.5 Dialogue on Naval cooperation was held in July 2018 at the Faculty of Graduate Studies, General Sir John Kotelawala Defence University (KDU).The two-day dialogue was a collaborative initiative between KDU and the Center for Naval Analysis (CNA), USA. The KDU-CNA Track 1.5 Dialogue is a one-of-a-kind discussion that we organize at KDU, facilitating interaction between the navies of Sri Lanka and the United States, along with the participation of relevant academics.”

This year’s Track 1.5 Dialogue focused on how bilateral relations between Sri Lanka and the USA could be further improved in a variety of spheres and how the global security concerns are influencing the relations between the two countries. Track 1.5 diplomacy is an initiative to bring together government and non-governmental actors to discuss on a variety of topics that could improve the bilateral relations of countries. As such, this two-day deliberation witnessed the participation of analysts and academics along with naval officials from the navies of both participating countries for a discussion. Held under the Chatham House Rule, this year’s Dialogue included four main sessions, with the 5th and final session being a wrap-up session with the speakers providing forward-looking, implementable suggestions for Sri Lanka and the United States.

In august 2018 a joint humanitarian assistance mission called Pacific Angel, sponsored by the US Pacific Command (USPACOM) concluded at the Alagalla School in Vavuniya, .The mission operated in Vavuniya, Anuradhapura and Sigiriya, The purpose was to provide humanitarian civic assistance and carry out civil-military operations in the Pacific region,

Medical treatment was provided by Pacific Air Forces doctors, including representatives from the Bangladesh Air Force, Maldivian Defence Force, Nepal Army, and Sri Lanka Air Force (SLAF) Medical/Dental officers and nurses. Medical teams treated 3,000 patients the services included primary health care, physical therapy, optometry and dentistry. Vavuniya Nursing School students and Red Cross officials participated. A forum highlighting topics such as modern engineering practices in disaster management and renovation was also held for SLAF civil engineers and technicians. School buildings were also renovated.

Amphibious transport dock USS Anchorage (LPD 23), and the 13th Marine Expeditionary Unit (MEU) arrived at Trincomalee Port in August 2018. Anchorage, is part of the Essex Amphibious Ready Group (ARG), and is deployed to the 7th fleet area of operations to support regional stability, reassure partners and allies and maintain a presence postured to respond to any crisis from humanitarian assistance to contingency operations.

The US  was interested in  trying out the air logistics hub concept which utilizes Sri Lanka’s strategic location in the Indian Ocean to ensure the quick availability of relief supplies, equipment and other material when needed by the US and partner militaries and humanitarian organizations. “The Sri Lankan navy, host nation support team and the U.S. Embassy have provided tremendous assistance and cooperation in developing the first temporary air logistics hub concept in Sri Lanka, said Anchorage officials.

Anchorage aims not only to enhance security cooperation, but to build understanding of the HADR (humanitarian assistance, disaster relief) capability that contributes to disaster, along with sharing of best practices and enabling more efficient joint relief efforts in the event of a future disaster.”

Additionally, sailors and marines will conduct training in visit, board, search and seizure, security force reaction techniques with the Sri Lankan Navy and Marines There will also be damage control training. The US Navy damage control program is the best. The visit is also an opportunity for US Seventh Fleet to explore local logistics support services for visiting naval forces operating throughout the Indo-Pacific region.

During the visit, sailors and marines will have opportunities to meet with their counterparts during exercises with the Sri Lankan Navy and marines. Approximately 300 Sri Lankan naval academy midshipmen and 40 distinguished visitors, will tour Anchorage to learn about the ship’s amphibious capabilities. .

The visit offers US sailors and marines the opportunity to explore the local area and meet their counterparts during exercises with the Sri Lankan Navy and Marines; the statement said “In addition to the professional exchanges, Sailors and Marines will take part in sporting events, including baseball, soccer, basketball and volleyball.

“Our Navy and Marine Corps team is deeply committed to continuing to strengthen our partnership with the Sri Lankan armed forces,” Sailors and Marines are focused on completing a successful mission and representing America in Sri Lanka. “These ship visits help demonstrate the value of the growing U.S.-Sri Lanka partnership,”

The USS Anchorage also joined the Sri Lankan naval ship Suranimila to conduct an exercise at sea.  The exercise allowed the ships to improve crews knowledge and strengthen a wide variety of seamanship skills critical to operating throughout a free and open Indo-Pacific region. During the exercise, multiple ships sailed information to practice communications and maneuvering procedures.  In addition to the Anchorage and Suranimila, two landing craft air cushions (LCACs), one AH-1Z Cobra helicopter, and one UH-1Y Huey helicopter participated. .”

Balu Theendu!

The difference between S. B. Dissanayaka and Albert Gore, who won the US Presidential election by popular vote, but denied it by the US Supreme Court is that Al Gore did not use the words Balu Theendu to express his resent to the court’s deliberate and politically bias decision. Subsequently, one of the conservative judges, Antonin Scalia, admitted the erroneous ruling made by the court in the name of maintaining the ‘sanity’ of the US system of governance (or to avoid a constitutional crisis wrongly perceived by the court).

Judges are human, and the judges and lawyers are a fraternity like the policemen, firefighters or trade unions with their own open and implied rules, customs and habits of scratching each other’s back. In America hundreds of court decisions must be unfair and unjust on a daily basis with the strange system prevailing in the country, to elect most judges by popular elections.  How can a judge resist the temptation to ignore favoring, even slightly, a party before him who voted for him at the last election, even if the judge is not going to contest again!

An elites’ club

One could get a glimpse of the Sri Lanka’s notorious history of misuse and abuse of power and influence by the judiciary and politicians as individuals and as an elite class from the book written by the late S. L. Gunasekara, a prominent lawyer of a Supreme Court judge (Lore of the law and other memories). Even foreign embassies take part in this game. The documentary, Court is Silent by Victor Ivan is a world record on the courage of a reporter to lay naked an entire branch of government aka, independence of the judiciary. No other country has the record of SC CJ’s opposed, ridiculed, punished or sued or disgraced as in Sri Lanka. The only CJ in recent times to save the dignity of the office was Victor Tennekoon who confronted that constitutional dictator JRJ.

Bad judges could manipulate the justice system, because decisions are taken on the basis of facts presented before them, and the potential that exist in each case to interpret the facts for or against a particular law (Thus, in America, the segregation of blacks and whites in public schools under an interpretation, separate but equal (in funds and resources), was overturned by a new interpretation in 1954, that a separation based on race under any circumstances was inherently harmful to student’s mind). This is true irrespective of the situation that the lawyers arguing the case are competent or not even though usually more money means better skills available on behalf of a client. In America or in any other country with a western system of jurisprudence if a client is rich more research can be done to collect more facts, select favorable jury’s or even to buy potential witnesses. In the third world countries run by black-whites even bribing a judge is a possibility. Sometimes even an innocent impartial judge after giving his decision could receive an unexpected offer of ‘recognition’ from a ruler who benefitted from that decision. There was a case of Mrs. B and her brother and the judge S.A. Kulatilaka, who was given ministerial post (cultural affairs) as a delayed gratitude.

White Man’s Law

The historical fact that the law in Sri Lanka is a White Man’s law (suddage neethiya) complicates the picture completely. One aspect of this law, apart from using it for the economic exploitation of the colony, was its use for the expressed and implied purpose of sabotaging the Sinhala Buddhist civilizational foundation in Sinhale. The operational aspect of this was to create disorder in the Sangha fraternity and damage the link between the Sangha and the laymen and women. A simple example was the law that prohibited a new school close to another school, which helped Christian schools to gain a larger service area. The rule that existed that anybody working as an officer of the education department if transferred to Colombo has a right to admit his children to a Colombo school (Royal/Ananda??) is a funny but not stupid law in the final analysis! Sri Lanka’s black-white politicians have failed to change this White Man’s law, because they thrive under it fooling the masses of Sinhala Buddhists.  They all damage the civilizational Trinity in the island, the village-water tank-temple. Today, laws of an evil triangle, -politician-officer-NGO- is crushing this Trinity with crocodile tears by way Gama Naguma, Gam Udava, Gamperaliya etc.

Continuing Education (CE) for Judges

If one re-examines the British colonial history of Sinhale (Ceylon came from the sound Sinhale), as a history of a clash between the white rulers (later black-whites) and the temple, no court or judge could deny the historical role the monks in this island played in the socio-economic-political affairs of the nation. Even if a judge is a non-Buddhist, he/she ought to know this. This is why in other countries judges have compulsory continued education programs conducted by experts in different fields relevant to judges’ performance of their public duties. For example, what I learned as a student of jurisprudence for the past 40 years on applied law (legal geography) in three different countries is good for a two-days CE course for all levels of judges in Sri Lanka. They avoid it at the risk of destroying their own system within as well as justifying extra-judicial inroads (the likes of Ranjan Ramanayakas) to sabotage it from outside.

Bodu Bala Sena Movement

Judges must understand (and read literature) that since 1948, several commission reports, including the Press Commission Report of 1964 and the Kandyan Peasantry (Rehabilitation) Commission Report of 1951, signaled successive black-white ruling parties in no uncertain terms that the Sinhala Buddhists in this country has had a long list of grievances, first such report in 1954-56 and the last in 2002. DS Senanayaka, the first black-white PM sarcastically tried to dismiss the spirit leading to the first report interpreting his white master Ivor Jennings’ advice that there is no such Precept/Refuge in Buddhism called, Anduwa Saranan Gachchami.” The last, a commission appointed by Mrs. Chandrika as a delaying tactics to the Movement floated by the late Ven. Gangodawila Soma, submitted its report in 2002, which was ignored by her, MahindaR and MaithripalaS. The 2005 razor thin election victory of MR was a result of him benefitting from the Ven. Soma dowry. These are social science evidence a court must consider, in the same manner the USSC did so in 1954 for the first time in US legal history.

Bodu Bala Sena (BBS) started in May 2012, had its meteoric rise due to neglect of Buddhist grievances by politicians in power since 1948. BBS did not say a new story, it was the same old message. It was not another failed JHU which was infected with enemies within who destroyed it. The unique difference was that for the first time, reminiscent of the days of Anagaraka Dharmapala in the 1940s, BBS brought open to the public arena the fact that Sinhala Buddhists have no political leader, and that politicians have been habitually treating Sinhala Buddhists as if they were like the proverbial kind-hearted woman. The black-white political machine tolerates any monk who operates within the parameters of the system. When Ven. Soma exhibited signs of going beyond, he had to face an untimely suspicious exit. From the very beginning the BBS cow did not confine itself to the pasture traditionally allowed by the length of the black-white given rope. It broke the rope and jumped over the fence. This made the entire black-white establishment to come after BBS leader’s head, making all kinds of false allegations against him. So many crook politician spades, got branded as spades by BBS. Not a single allegation against BBS has been investigated so far, and not a single act or demand made by BBS could be identified as undemocratic or illegal.

The position of BBS has been that we have grievances and we want discussions with the parties involved to resolve these issues. The last of this, the BBS discussion with the Maharagama Magistrate, on the subject of wholesale harassment of war heroes in the country by a political party perceived as agents of foreign powers trying to divide Sri Lanka, was a dialogue and not a confrontation. In fact, the Magistrate mentioned the role of the parliament in this regard, despite the common knowledge of all that parliament is a dud agency. The You tube video clip attached and a previous video clip of the actual dialogue tells this story making the law and fact issues found by the Court of Appeal look irrational and odd. The Supreme Court now has an opportunity to examine the evidence (facts submitted) and prevent the courts of Sri Lanka being perceived as an agency biased against the Sinhala Buddhist nation of this island. It was Governor North, who first noted the need to tame the monks, and during the last world war in the 1940s Admiral Layton had an alternative plan to take all Buddhist monks into war prison camps, just like what president Rossevelt did to the Japanese residents in USA.

Any reasonable person watching the video clip attached cannot help but have doubts about the way the Court of Appeal handled the BBS case, and the SC has a moral and a legal duty to show the country that not only justice is done, but it appears to be so done. The unusually harsh action by CA looks as if the judges got carried away by a long-awaited conspiracy by some anti-BBS entity to trap the monk capitalizing human weakness, in this case the monk’s emotional anger due to helplessness (The late Ven. Soma also succumbed to such human weakness, when he secretly decided to go to Russia to get a worthless Ph.D. certificate).  The SC cannot inspire public trust and confidence as promised by its motto if judges have tunnel vision and display ignorance and possible selfish future interests. When the last SCCJ  Siripavan said that appointment of national list MPs is not a national issue, what comes to my mind is what Shakespeare said, The first thing we do, let’s kill all the lawyers [judges].”  Public interest lawyer, presidential candidate Nagananda Kodituwakku, should appear in this case as a friend of the court, and educate the judges on the facts beyond the facts in the case file. The sooner we go to a system of Buddhist Jurisprudence (practiced by the Sanga society before it got corrupted by English rules), Sri Lankans will be a less litigious and more contended society, saving time, money and energy for more meaningful ventures.

2017 සැප්තෑම්බර් 26 දින සබරගමුව පළාත් සභාවේ කාලය අවසන් වූ අතර, අද ට මහජන නියෝජිතයින් නොමැතිව වසරක කාලයක් පළාත් සභාව පාලනය වී ඇත. නිදහස් හා සාධාරණ මැතිවරණයක් මගින් තේරී පත් වන මහජන නියෝජිතයින් ගෙන් තොර පාලනයක් ප්‍ර‍ජාතන්ත්‍ර‍වාදී නොවන අතර, පළාත් සභා ඡන්ද විමසීම පැවැත්වෙන දිනය පිළිබද කිසිදු බලාපොරොත්තුවක් නැති පරිසරයක් මේ වන විට ගොඩ නැගෙමින් තිබේ.

මෙයට වසරකට පෙර පළාත් සභා ඡන්ද විමසීම කල් දමා ගැනීමේ අරමුණ සහිතව කාන්තා නියෝජනය ඉදිරියට දමමින් පළාත් සභා ඡන්ද ක්‍ර‍මය සංශෝධනය කරනු ලැබීය.  එහි මුලික අරමුණ වූයේ ඡන්දය කල් දමා ගැනීම මිස, පළාත් සභා ඡන්ද ක්‍ර‍මයේ සංශෝධන සිදු කිරීම නොවන බව මේ වන විට ඉතා පැහැදිලිවී ඇත.

අද වන විට ලංකාවේ පළාත් සභා 9 න් 3 ක මහජන නියෝජිතයින් විසින් සිදු කරන පාලනයක් නොමැතිය.  අවසනාවන්තම තත්වය වන්නේ බලය බෙදා හැරීමේ අරමුණ ඇතිව බිහි වූ පළාත් සභා ක්‍ර‍මය, ප්‍ර‍ජාතන්ත්‍ර‍වාදී විරෝධී ලෙස අකුළා දැමීම පිළිබද සුළු ජාතික බහුතරයක් ජීවත්වන නැගෙනහිර පළාතේ දේශපාලනඥයින්ගේන් ද විරෝධයක් පළ නොවීම ය. උතුරු මැද පළාත් සභාව ද, වසරකට ආසන්න කාලයක් මේ වන විට අක්‍රීය පවතී.

සීමා නිර්ණය කමිටු වාර්තාව පාර්ලිමේන්තුව තුල පරාජයට පත් කිරීමෙන් පසුව මාස දෙකක් තුල සීමා නිර්ණය පිළිබද ගැටළුව විසදීමට අග්‍රාමාත්‍යවරයා ප්‍ර‍මුඛ පංච පුද්ගල කමිටුව ක්‍රියා කළ යුතුය. නමුත්, පාර්ලිමේන්තුව හරහා සූක්ෂම ලෙස තවදුරටත් මේ සීමා නිර්ණය ක්‍රියාවලිය ප්‍ර‍මාද කිරීමට රජය කටයුතු කරමින් සිටී.

ලබන ඔක්තෝබර් 28 දින වන විට මෙරට පළාත් සභා 9 න් 6 ක ධූර කාලය අවසන් වී මහජන නියෝජිතයින් නොමැති පළාත් සභා 6 ක් ඉතිරිවන්නේය.  ප්‍ර‍ජාතන්ත්‍ර‍වාදය පිළිබද මුලික නිර්ණායකය වන්නේ නිසි පරිදි නිදහස් හා සාධාරණ මැතිවරණ පැවැත්වීමයි.  මැතිවරණය පරාජයට බියෙන් ඡන්ද විමසීම් කල් දැමීම ප්‍ර‍ජාතන්ත්‍ර‍වාදී රාජ්‍ය ව්‍යවහාරයක් නොවන අතර, හැකි ඉක්මනින් උතුරු මැද, සබරගමුව හා නැගෙනහිර පළාත් සභා ඡන්ද විමසීම පැවැත්වීම සදහා අවශ්‍ය ප්‍ර‍තිපාදන යොදන ලෙස නිදහස් හා සාධාරණ මැතිවරණයක් සදහා වන ජනතා ව්‍යාපාරය හෙවත් කැෆේ සංවිධානය රජයට බල කර සිටී.

Sri Lanka as a Country and the Trade mark of TEA ……

These days I am in London for a medical procedure under National Health Service .In order to help the back pain among all other ailments, I visit a Sauna nearby run by the Local Council. When you sit in the Sauna in almost 100 degrees of heat , but very dry air  and  heat helps muzzles to relax .Then you take  very cold shower to create a create muscles spasms .

During the Sauna session you meet many Eastern Europeans (who may stop coming to UK after Brexit) .I generally speak to them though they speak poor English. Among Russians Ceylon Tea is my identity of Sri Lanka. When you say that I am from the country where best teas is produced, they identify it as Sri Lanka.

That day I was speaking to few people from Afghanistan, Iraq and Iran and also from Turkey. I almost guessed their origins monitoring their accent and mannerisms but they could not guess my origin .I told few of them that I am from an Island Nation surrounded by the sea where the Best Tea is grown but most of they could not guess .They were ignorant of our existence. One gave a ludicrous suggestions that I am from India or Pakistan and some said I am from Kenya or Tanzania or Somalia despite the fact they do not have the Best Tea and that they are not Island Nations.

One ludicrous answer after many tries was that I am from Tamil-Country and the Afghan Man uttered a filthy Tamil Word Punde” telling that few many people of my country  are working with him .This is how Sri Lanka which is multinational and multi religion known in some part of the world .

May be our Trade Mark Tea is not yet known all over the world and the world may be thinking that Tamils are the only people living in Sri Lanka

Our Trade Mark Tea should be more publicised.

ඉහළ නිලධාරියකුට මෙවැනි චෝදනාවක් එල්ල වුණාම කළයුතු පළමු දේ තමයි ඔහුගේ වැඩ තහනමට ලක් කරන එක. ඒ ඔහුට පරීක්ෂණ කටයුතුවලට බලපෑම් කරන්න පුළුවන් නිසා. නමුත් ඒ වෙනුවට ඔහු කළේ ඔහුව වෙනත් අංශයකට මාරු කරලා බේරා ගන්න පුළුවන්ද කියා බලන එකයි. අපි තදින්ම බලපෑම් කළාට පස්සේ තමයි ඔහුගේ වැඩ තහනම් කළේ.

මේ කාරණා එක්ව ගත් විට පොලිස්පති තනතුරේ පූජිත් ජයසුන්දර මහතා සිටින තුරු නාලක සිල්වාට එරෙහිව නිවැරැදි පරීක්ෂණයක් සිදු වෙන්නේ නෑ කියන එක පැහැදිලියි. 2002 අංක 5 දරන නිලධාරීන් ඉවත් කිරීමේ (ක්‍රියා පටිපාටිය) පනත අනුව පොලිස්පතිවරයා ඉවත් කළ හැක්කේ පාර්ලිමේන්තුවට පමණයි. පොලිස්පතිවරයා ඉවත් කිරීමේ යෝජනාවක් ගෙන ආ හැකි හේතු අතර පොලිස්පතිවරයා සිහි විකල්වීම, බලය අයුතු ලෙස භාවිත කිරීම, පක්ෂග්‍රාහීවීම, නොමනා හැසිරීම සහ දූෂණය යන කාරණා තිබෙනවා. මේ හේතු තුනම වර්තමාන පොලිස්පතිට අදාළයි. හැබැයි ඒ සඳහා මන්ත්‍රිවරුන් 113ක සහාය අවශ්‍යයි. වර්තමාන පාර්ලිමේන්තුවේ 113ක් ලබා දෙන්න පුළුවන් අගමැතිතුමාට විතරයි. ඒ නිසා තමයි පොලිස්පති ඉවත් කරන්න කියලා අපි අගමැතිතුමාගෙන් ඉල්ලන්නේ.

මිල සූත්‍රය ඉල්ලා මුදල් අමාත්‍යාංශයට මම යැවූ ලිපියට මුදල් අමාත්‍යාංශයෙන් පිළිතුරක් ලැබී තිබෙනවා. රාජ්‍ය මූල්‍ය ප්‍රතිපත්ති දෙපාර්තමේන්තුවේ සහකාර අධ්‍යක්ෂක ඩබ්.ජී.ඩී.සී.ඩී.එස්. රාජකරුණා ලිපියක් එවා තිබෙනවා. ඒ ලිපියේ සඳහන් කරලා තියෙන්නේ තොරතුරු දැනගැනීමේ පනතේ 5.1(ඇ) 4 වැනි උප වගන්තිය යටතේ ඉන්ධන මිල සූත්‍රය අනාවරණය කිරීම මඟින් බලශක්ති වෙළෙඳපොළේ ඉදිරි මිල ගණන් පුරෝකතනය කිරීමට ඇතුළත්ව ශ්‍රී ලංකාවේ ආර්ථිකයට බරපතළ අගතියක් ඇතිවිය හැකි නිසා ලබාදිය නොහැකි බවයි. මට කියන්න තිබෙන්නේ බම්බුව කියලා තමයි.

ආණ්ඩුව පවසන්නේ මාස් පතා ඉන්ධන මිල වැඩි කරන්නේ ‘ඉන්ධන මිල සූත්‍රය’ නම් අබිරහස් ක්‍රමවේදය අනුව බවයි. පුදුමය නම් මෙම සූත්‍රය පිළිබඳ කිසිවෙක් කිසිම දෙයක් නොදැන සිටීමයි. ඇමැති මණ්ඩලය එය නොදන්නා බව මහින්ද සමරසිංහ ඇමැතිතුමා කියනවා. ‘මිල සූත්‍රය හඳුන්වා දුන් දින සිට ඉන්ධන මිල ඉහළ යෑම පමණක් සිදුවීම පිළිබඳ මම ඉන්නේ කනස්සල්ලෙන්’ කියලා ජනාධිපති කිව්වා.

මුදල් අමාත්‍යාංශය මෙම සූත්‍රය සඟවා ගෙන සිටින්නේ ඇයි? ඇත්තෙන්ම ලෝක තෙල් මිල වෙනස් වීම සහ අපේ තෙල් මිල වෙනස් කිරීම අතර තාර්කික සම්බන්ධයක් නැති නිසා මිල සූත්‍රයක් තිබුණත් ඒක තාර්කික වෙන්න බෑ.

අභියාචනා මණ්ඩලයට අභියාචනා කළාට පස්සෙත් මිල සූත්‍රය හෙළි නොකළොත් ශේ‍ර්ෂ්ඨාධිකරණයේ මූලික අයිතිවාසිකම් නඩුවක් ගොනු කරන්න බලාපොරොත්තු වෙනවා.

There had always been conspiracies to kill us. There were death threats even when Prabhakaran was alive. But we endured all these threats due to virtues we posses, former Secretary of Defence Gotabaya Rajapaksa said.

Speaking as the chief guest at the religious ceremony on an invitation of the Chief Incumbent of Embulgama Rajamaha Viharaya-Ven Dankande Bodhiwansa Thera, held in connection with the unveiling of the Samadhi Buddha Statue and the inauguration of Sathara Maha Devalaya at the temple premises he said that one cannot afford to live in fear of death.

“We must do something for the country where we are born. I never asked to strengthen my security – people are there for my protection,” he said.

In response to the questions by the media personnel about Minister Sarath Fonseka’s remarks about his non-eligibility for security, Gotabaya Rajapaksa said leaders of the country would decide about providing security for him or otherwise. Anyone can express his opinion. I am also aware of a young UNP parliamentarian saying that I deserve protection as well as the president as I have served the country as defence secretary.

When asked whether he was satisfied with investigation on the incident, he said he only knows that investigation has been assigned to CID and believed they would do the duties well as they had done during his period.

Replying to the questions about IGP he said we have to be concerned about one’s post and not personally. We have had good IGPs in the past. When forces were engaged in war in the East and the North, police assured the security in other parts of the country. He also reminded about the then IGP who was ready to resign on an incident which happened in Katunayaka.

Various people have various skills-in singing, dancing but we expect nothing of these from an IGP, he said.

Alleged plot; serious than we thought- Samarasinghe

Minister Mahinda Samarasinghe today said that alleged assassination plot on President Maithripala Sirisena and former Defence Secretary Gotabhaya Rajapaksa, ‘is serious than we think as several individuals have been involved in it and called on the CID to investigate it thoroughly.’

Addressing the media the Minister also said that the CID investigations on the alleged assassination plot had taken a different turn after the media reports that an Indian has met Police informer Namal Kumara, who exposed the alleged conspiracy.

It seems that the alleged plot is serious than we think as several individuals have involved in it. The CID must go to the bottom of the conspiracy, expose all those involved if there was an assassination attempt, and take strict legal action against perpetrators without delay,” Minister Samarasinghe said.

A spokesman for the Indian High Commission for Sri Lanka has stated that the Indian national arrested at Namal Kumara’s house has had a history of mental disturbance.

An Indian national while at Director Operations of Anti Corruption Force Namal Kumara’s home has revealed that he was aware of a plot to kill the President Maithripala Sirisena, former President Mahinda Rajapaksa and his family members.

Accordingly, a spokesman for the Indian High Commission stated that upon hearing the news, the Indian Commission took immediate measures to conduct a background check on the said Indian national, despite the limited information provided to them by Sri Lankan authorities.

Preliminary reports of this investigation have revealed that the said individual has had a history of mental disturbances since 2000.

This information has been imparted to Sri Lankan authorities and the Indian High Commission assures Sri Lanka of full assistance and cooperation for conducting a thorough and professional investigation into the matter, said the official.

ලංකාවේ රණවිරුවන් යුද අපරාධකරුවන් බවට විදේශ රටවල් හා රාජ්‍ය නොවන සංවිධාන පරසක්වළ ගසන විට මානව හිමිකම් පිළිබඳ කවුන්සිලයේ 39 වැනි සැසිවාරය සඳහා සහභාගි වූ ශ්‍රී ලංකා රජය නියෝජනය කරන නිලධාරීන් මුනිවත රකිමින් සිටීම කනගාටුවට කරුණක් බව මවුබිම වෙනුවෙන් රණවිරුවෝ සංවිධානයේ කැඳවුම්කරු නීතිඥ මේජර් අජිත් ප්‍රසන්න පවසයි.

ආණ්ඩුව සිදුකරන මෙම අසාධාරණ ක්‍රියාව පිළිබඳ රණවිරුවන් කෝපයෙන් මෙන්ම කම්පාවෙන් පසුවන බවද ඔහු සඳහන් කළේය.

ඊයේ (25දා) පුංචි බොරැල්ල, වජිරාශ්‍රමයේ පැවැති මවුබිම වෙනුවෙන් රණවිරුවෝ සංවිධානයේ මාධ්‍ය හමුවට එක්වෙමින් ඒ මහතා වැඩිදුරටත් මෙසේද කීය.

ඒ පිළිබඳ ලිපියක් එක්සත් ජාතීන්ගේ ලේකම්වරයාට ලබාදීමටත් ජිනීවා මානව හිමිකම් කවුන්සිලයේ ප්‍රධානියාටත් ලබාදෙන බව” මෙය අපට හොඳ ප්‍රවෘත්තියක්.

නමුත් පසුගිය 10 වැනිදා සිට 28 දක්වා ජිනීවා මානව හිමිකම් කවුන්සිලයේ 39 වැනි සැසිවාරය පැවැත්වෙනවා. අපට මාධ්‍ය මඟින් පෙනෙනවා අද්මිරාල් සරත් වීරසේකර, මහාචාර්ය චන්න ජයසුමන, මහාචාර්ය නාලක ගොඩහේවා යන මහත්වරු කමිටු සාකච්ඡාවල ලංකාවේ රණවිරුවන් යුද අපරාධ නොකළ බවට කරුණු දක්වනවා. හැබැයි අපි දකින්නේ නැහැ අපේ රට නියෝජනය කරමින් ජිනීවා ගිය කිසිකෙනකු රට වෙනුවෙන් කරුණු දක්වනවා.

අපි යුද්ධයට ගිහිල්ලා තුවාල ලබලා කැපකිරීම් කළ නිලධාරීන් හැටියට අපි කල්පනා කළා මේ අවනඩුව ජනතාවට කියන්න. 2015 ඔක්තෝබර් මාසයේ එවකට විදේශ ඇමැති මංගල සමරවීර ජිනීවා මානව හිමිකම් පිළිබඳ කවුන්සිලයට ගිහිල්ලා ඇමෙරිකාවත් සමග යෝජනාවකට අස්සන් කළා. එය ලෝක ඉතිහාසයේ, ඉතිහාසගත වෙනවා. යම් කිසි රටකට විරුද්ධව යුද අපරාධ චෝදනා විදේශ සංවිධානවලින් සහ විදේශ රටවල්වලින් නැඟෙනවිට එම රට විසින්ම මානව හිමිකම් කවුන්සිලයට ගිහිල්ලා අපි යුධ අපරාධ කළා කියලා පිළිගන්න අපිම ඇමෙරිකාවත් එක්ක යෝජනා කරනවා මේ වගේ යාන්ත්‍රණයක් ඕන බව. ලෝකේ පළමුවෙනි රට මේ වගේ දෙයක් කළ.

එම යෝජනාවට කියන්නේ 30/1 කියලා. මෙහි කියනවා එවකට මානව හිමිකම් කවුන්සිලයේ ප්‍රධානියා සෙයිද් අල් හුසේන් මාසයකට දෙකකට පෙර වාර්තාවක් ඉදිරිපත් කරමින් කියනවා 2011දී එවකට එක්සත් ජාතීන්ගේ සංවිධානයේ ලේකම් බෑන් කී මූන් විසින් ඔහුට උපදෙස් ලබාදුන් බව කමිටුවක් පත් කිරීමට. එය ප්‍රසිද්ධ දරුස්මාන් කමිටුව ලෙස.

මේ වාර්තාවේ සඳහන් වෙනවා යුද්ධයේ අවසන් භාගයේදී දෙමළ ජනතාව 40,000ක් අපේ අතින් මියගිය බව. දෙවැනි චෝදනාව අපි ස්ත්‍රීන් දූෂණය කළ බව. තෙවැනි චෝදනාව තමයි යුද්ධයේ අවසන් භාගයේදී දෙමළ ජනතාවට අපි ආහාර හා බෙහෙත් ලබා නොදුන් බව. මේක මානව අපරාධයක්. ඊට අමතරව තවත් චෝදනා රාශියක් තිබෙනවා. සෙයිද් අල් හුසේන් කුමරු කියනවා මේ වාර්තාව පිළිගන්න බව.

ඒ අනුව අපි කරන්න බලාපොරොත්තු වන දේවල් කියලා මංගල එකඟ වෙනවා යෝජනා කිහිපයකට. ඉන් එකක් තමයි දෙමුහුන් අධිකරණය, විදේශ විනිසුරුවරුන්, අපරාධ පරීක්ෂණ කරන නිලධාරීන්, නීතිඥයන් ගෙනල්ලා දෙමුහුන් යාන්ත්‍රණයක් ඇති කිරීම. දැනටමත් අතුරුදන් වූවන්ගේ කාර්යාලය ඇතුළු විවිධ ක්‍රියාවන් සිදුකරනවා.

අපේ රණවිරුවන් යුද අපරාධකරුවන් කියලා හිටපු විදේශ ඇමැති මංගල සමරවීර පිළිගන්නවා.

ශ්‍රී ලංකා හමුදාවේ සේවය කළ රණවිරුවන් යුද අපරාධකරුවන් නොවන බවට සාක්ෂි බටහිරින්ම ලබාගන්න පුළුවන්. බි්‍රතාන්‍ය සාමි මණ්ඩලයේ නේස්බි සාමිවරයා මේ පිළිබඳව කරුණු දක්වලා තිබෙනවා.

 

AIADMK wants international probe against DMK,Cong for ‘war crimes’ against Sri Lankan Tamils

Chief Minister K Palaniswami Tuesday demanded an international probe against DMK and ally Congress for “war crimes” against Tamils in the 2009 Sri Lankan civil conflict when UPA was in power, as the ruling AIADMK staged a state wide protest over the issue.

Addressing a protest meeting in his native Salem district, he said the party wanted to draw the attention of the union government and global nations about the ‘betrayal’ of Tamils by DMK and Congress.

Reviving an old political issue, AIAMDK had last week announced the protest in the backdrop of former Sri Lankan President Mahinda Rajapaksa’s recent remarks that that the Indian government helped his country during the final war against Liberation Tigers of Tamil Eelam (LTTE) in 2009.

Palaniswami alleged the Sri Lankan Tamils, believing the word of then Chief Minister M Karunanidhi that the war had ended after his three hour fast here for their cause, had come out of hiding only to be killed by Lankan soldiers, leading to a ‘genocide’.

“There is a strong case against DMK and Congress for an international inquiry into this heinous crime and also human rights violations… the meeting is to highlight to the people, the real faces of the two parties,” he said.

The ‘truth’ came out after Rajapaksa’s recent comments “about the actual position,” he said.

Ministers and senior party leaders participated in protest public meetings held across the state.

The AIADMK used the state wide protests to hit out at arch rival DMK, which has been upping the ante against the government on various issues, including corruption.

Criticising AIADMK for holding the protests, DMK has alleged that it was a bid to divert attention from the corruption charges AIADMK faced.

Both Congress and DMK had faced flak for India’s reported assistance to Sri Lanka then and their failure to prevent casualties of Tamils despite being in power.

AIADMK had on September 19 adopted a resolution at a meeting here, alleging that DMK and Congress were responsible for the killings of thousands of Tamils during the war.

Addressing at a symposium organised by Virat Hindustan Sangam, led by BJP MP Subramanian Swamy in Delhi on September 12, Rajapaksa had said India’s “abiding friendship” was amply demonstrated by its rapid response to Sri Lanka’s needs at the time (2009), both material and moral.

Rajapaksa was at the helm when the nearly 30 year long ethnic strife in Sri Lanka ended then with the defeat of LTTE, while DMK was part of the Congress-led UPA that ruled India in 2009.

Against this background, the AIADMK resolution had said: “Now that Rajapaksa has openly admitted to all secrets, the DMK-Congress coalition government aiding the killings of 1.5 lakh Tamils and rapes of thousands of Tamil women should be treated as war crimes and those involved should be made war criminals and given punishment.”

The young Sri Lankan men posted the images of themselves at Pidurangala Rock on Facebook.

It prompted an angry reaction from people who considered them a religious insult, reports BBC Sinhala’s Azzam Ameen in Colombo.

Similar photos were posted on Instagram by foreigners, who were not arrested.

The arrests follow a complaint by a Buddhist monk who claims the photos, taken within sight of the Sigiriya rock fortress, a Unesco World Heritage site, are a religious insult.

The viral photos taken by foreign travellers were posted on the Cheeky Exploits Instagram page, an account that encourages people to take pictures at famous locations around the world.

While many have commended the police for taking action for insulting a religious place, others have criticised it.

“When our children are being raped and women being abused, Sri Lankan police do nothing. They only seem to act on nonsensical non-issues like this,” a Facebook user said.

Others questioned why police only took action against locals, not foreigners.

“So law enforcement should only be limited to brown bums? Sri Lanka Police should send several teams around the world to identify the rest,” wrote another Facebook user.

This is not the first time nude pictures near sacred sites have drawn condemnation from local communities.

In June 2015, a group of Western tourists climbing Mount Kinabalu in Malaysia caused massive outrage and a subsequent deadly earthquake was blamed on their disrespect towards the sacred mountain.

It was only after court proceedings, a few days in prison and a financial penalty that the tourists were allowed to leave Malaysia.

In 2017 a Playboy model took part in a nude shoot on New Zealand’s Mount Taranaki, angering Maoris who consider the mountain to be the burial ground of their ancestor.

COLOMBO, Sept 26 (Reuters) – The Sri Lankan rupee hit a fresh low of 169.05 on Wednesday on importer dollar demand, while intervention by the central bank limited the fall, market sources said.

Sri Lanka’s finance minister urged its people to buy local products and shun unnecessary imports in order to reduce the trade deficit and help stabilise a weak rupee, a day after Prime Minister Ranil Wickramasinghe said the government would take measures to impose taxes to curb imports by up to $1 billion to face the currency crisis.

The rupee fell to an all-time low of 169.05 per dollar on Wednesday, surpassing its previous low of 169.00 hit on Friday. It closed at 169.00/169.20 per dollar, compared with Tuesday’s close of 168.90/169.00.

Three men who exposed themselves near a Sri Lankan temple and posted the images online were arrested on Wednesday, as a social media “mooning” fad sweeps the island and angers its conservative Buddhist clergy.

The images of the trio sparked a flurry of complaints from Buddhist monks after they were uploaded to Facebook, as they had taken the photos from a smaller rock temple overlooking the Sigiriya rock fortress. They were quickly tracked down by the police.

It is believed the trio were inspired by “Cheeky Exploits”, an Instagram account with more than a quarter of a million followers that features bare-bottomed pictures from beauty spots around the world.

They will be prosecuted Thursday under the country’s obscenity laws which prohibit lewd behaviour in the Buddhist-majority island, particularly near religious sites.

Sri Lanka does not want any foreign power exerting influence, President Maithripala Sirisena has said, while appealing to the international community for room to resolve” the country’s problems.

Mr. Sirisena made the remarks while addressing the 73rd session of the United Nations General Assembly in New York Wednesday morning (India time). As an independent country we do not want any foreign power to exert influence on us,” he said, asking for the right of the Sri Lankan people to find solutions” to be respected.

His statement comes weeks after the island’s main Tamil party accused him of interfering in the investigation of a top military officer’s alleged link to a suspect involved in the case of 11 youth who were kidnapped and murdered in the final years of the civil war.

We are very concerned at such political interference from the highest level,” Tamil National Alliance (TNA) spokesman M.A. Sumanthiran had said, after Mr. Sirisena held an “emergency cabinet meeting” to discuss the matter. The Tamil lawmaker also sought an international element in probing wartime excesses, citing his waning faith in domestic processes.

While Mr. Sirisena had earlier said that he would make a strong case at the UNGA, for members of Sri Lanka’s armed forces to be exonerated from war crime blame, on Wednesday he stopped with hailing the soldiers’ immense contribution” to building lasting peace” by defeating the LTTE.

Though Sri Lanka’s war came to an end in May 2009, disturbing questions on the several thousand civilian deaths – UN estimates say 40,000 people were killed – and disappearances remain unresolved.

In October 2015, the UN Human Rights Council adopted a resolution that Sri Lanka co-sponsored, for a credible judicial process to address them. Sri Lanka committed to a four-pillar approach” for truth, reconciliation, accountability and non-recurrence. The government has taken some steps, including setting up of an office on missing persons, but critics say the efforts are rather slow-paced and inadequate.

Observing that his government had done well to address post-war concerns, Mr. Sirisena on Wednesday said: I request the international community to look at Sri Lanka in a new perspective and with new ideas…. with respect, I my request here is to let us solve our problems.”

Sri Lanka seeks investment, but China questions linger

A decade after the Sri Lankan Civil War, the country’s economy is growing fast. The government has big plans, but high debt levels — and high levels of Chinese influence — cast a cloud as the country seeks investors.

You don’t need to be an expert on international trade routes to look at a map and understand that Sri Lanka’s location is one of potentially serious economic advantage.

The island nation — population 22 million  — sits at the southern tip of India, almost as close to the Middle East and the Horn of Africa as it is to South East Asia.

The value of this location has not been lost on its northern neighbor China. Under Xi Jinping’s so-called ‘Belt and Road Initiative,’ the Chinese government has pumped billions into Sri Lanka in the form of both foreign investment and loans in recent years.

This reliance on Chinese money is part of a long-standing Sri Lankan problem. With a major trade deficit, as well as crippling levels of debt, the country needs foreign money. China has rushed to fill the gap more enthusiastically than anyone else.

The current Sri Lankan government came to power in 2015, when it replaced former President Mahinda Rajapaksa’s administration. His government had been unabashedly eager to seek Chinese money, regardless of the costs, and it left the incoming government with a major web of deals — and debt — to untangle.

China bets big on Sri Lanka

The need to diversify Sri Lanka’s export base, and indeed to woo other sources of foreign investment, has been a clear platform of the current government’s strategy.

It’s part of the reason why a high-powered business and government delegation, led by the country’s minister of development strategies and international trade, Malik Samarawickrama, has been visiting Germany this week.

Expanding exports, attracting investment

“We have just launched a national export strategy in Sri Lanka,” Indira Malwatte, chairperson of the Sri Lanka Export Development Board, told DW during her visit to Berlin.

“We have identified electronic and electrical components, food processing, ship building and information and communications technology as areas where we could attract German companies to come and invest in the country.”

Close to 50 percent of Sri Lankan exports are from the clothes and textiles sector, while tea alone accounts for 10 percent. The need to expand and diversify that base is clear.

As well as expanding its export base, the Sri Lankan economic strategy also includes cultivating a reputation as a regional hub for start-ups in the IT sector.

Sameera Nilupul, the fresh-faced founder of a human digitalization and computer graphics company in the capital Colombo, told DW that since he founded the company in 2015 with two other people, it has grown to have a staff of 32 and is thriving. He says that the Colombo start-up environment has blossomed rapidly over the last few years and that the potential for further expansion and innovation is obvious.

Sri Lanka’s contentious port projects

But it is impossible to avoid the China questions. The signature selling point on this trade mission is “Port City,” an ambitious project which seeks to reclaim 269 hectares of land from a section of Colombo’s port and turn it into a special financial zone and international financial center.

“A financial hub where south Asians could come and experience a standard of living and services that they cannot experience anywhere else in the region at the moment,” Liang Thow Ming, chief sales and marketing officer for the project, told DW.

Given that the land reclamation stage is not yet completed, and that the official plans say Port City may not be fully operational for at least 25 years, the project is in its extremely early days.

Yet whether these ambitious plans say more about China’s intentions or Sri Lanka’s is an important question. The project is powered by Chinese money and is being driven by the China Harbor Engineering Company, a subsidiary of the massive state-owned China Communications Construction Company.

China’s level of involvement in Sri Lanka’s business strategy has led to accusations that it has wider motives, particularly in the context of its continuing involvement in several territorial disputes in the South China Sea.

“I think we understand those concerns,” Liang, a native of Singapore, told DW. “Whether we endorse those concerns is a separate issue altogether. What we have, in real estate terms, is a willing seller, willing buyer situation.

“You have a country, Sri Lanka, which is in need of investments. They can’t find investments anywhere else. They try to get investments from China, and China, coincidentally, is looking to invest. Therefore, there is a match.”

Yet while the Port City project has attracted plenty of criticism, it pales in comparison to that which another Chinese-backed scheme has attracted: that of the Hambantota port, on Sri Lanka’s southern coastline.

Pursued by the Rajapaksa government and backed by vast sums of Chinese money from the start, the port has so far proven not to be economically successful, with critics saying this is because the area is far too underpopulated and has inadequate industry and infrastructure to sustain an international port.

The criticism has intensified since China took ownership of the port as a result of the fact that Sri Lanka could not service its debt on it.

International trade minister optimistic about Hambantota’s future

A recent article in The New York Times laid out in extensive detail how the acquisition of the port unfolded, as well as highlighting concerns that China’s intentions went beyond mere economics.

Malik Samarawickrama, the Sri Lankan International Trade Minister, told DW in Berlin that the accusations in the article were “baseless and unfair” and said that the new government had developed a new plan to make the port viable.

“Earlier there was no plan,” Samarawickrama said. “They [the previous government] built it and were just waiting for things to happen. But now we have set up a business plan and we are sure that in four or five years’ time, we can achieve it. We want to develop that port. We believe that Hambantota is in the right place.”

University of Birmingham receives £1.9 million for global heart research in China, Brazil and Sri Lanka

The University of Birmingham has been awarded £1.9 million through the National Institute for Health Research (NIHR) Global Health Research (GHR) Program to fund world class research into a common heart condition in disadvantaged populations in China, Brazil and Sri Lanka.

The University’s NIHR Global Health Research Group on Atrial Fibrillation will focus on ways of preventing and treating atrial fibrillation (AF) – the most global common cause of an irregular heartbeat which five times increases the risk of stroke.

Over a quarter of strokes are due to AF, and adults have a one in four life-time risk of developing the condition, the main causes of which are high blood pressure and diabetes.

Professor Neil Thomas, who is jointly leading the research at the University of Birmingham’s Institute of Applied Health Research, said: “A third of people with atrial fibrillation, and even more in low and middle-income countries such as China, Brazil and Sri Lanka, do not know they have the condition.

“To reduce the risk of stroke by around two thirds, patients with atrial fibrillation are given anticoagulant drugs to prevent blood clotting, such as warfarin, however under-treatment is common in these countries, leading to missed opportunities in preventing fatal and disabling strokes.

Professor Gregory Lip, a world leading expert in atrial fibrillation, who is co-leading the research, said: “Our established group at the University of Birmingham has already successfully led changes in atrial fibrillation management in the UK, and in European countries with different healthcare systems, by promoting stroke risk assessment and enabling clinicians to initiate treatment in an integrated manner.

“Given the importance of this need, we plan to support our partners in China, Brazil and Sri Lanka to develop tailored research to improve the treatment and management of this condition in these countries.”

The team plans two pilot research projects in each country, developing and adapting known effective methods to increase awareness and treatment of atrial fibrillation, by consulting with local patients, families, healthcare providers and policy-makers and findings from our systematic reviews.

On the ground training will be designed and delivered, and the team will focus on developing new funding proposals to sustain the collaboration in the long-term, including engaging with major stakeholders to develop sustainable models of best care practice.

The University of Birmingham is one of a total of 20 NIHR GHR Groups to have received a slice of £40 million funding, covering a broad range of research themes, including: improving asthma outcomes in African children; health system responses to violence against women, and preterm birth prevention and management.

Dr Louise Wood, Director, Science, Research and Evidence Directorate, Department of Health and Social Care, said: “The NIHR is adding substantive value to the field of global health and helping to keep the UK at the forefront of health knowledge for global benefit.

“These new activities complement the breadth and range of our existing portfolio of funded research to improve health outcomes across LMICs and demonstrate the NIHR’s role in supporting the UK Aid Strategy.”

The NIHR Global Health Research program allocates the Department of Health and Social Care (DHSC)’s Official Development Assistance (ODA) research funding, delivering internationally-outstanding applied global health research for the direct and primary benefit of patients and the public LMICs. Where’s the Sri Lanka Monitoring Mission report: 3,830 LTTE violations & 356 GOSL violations

On 22 February 2002 the then Prime Minister Ranil Wickremasinghe & LTTE facilitated by the Norwegian Government signed what is known as the Cease Fire Agreement (CFA) thereafter on 18 March 2002 the Norwegian Government & the GOSL signed a status of mission agreement to establish the Sri Lanka Monitoring Mission to which both GOSL & LTTE gave written consent. The Ceasefire Agreement was formally abrogated in January 2008.

The SLMM was tasked to monitor the implementation of the CFA through on-site monitoring. SLMM comprised members of Nordic countries & given diplomatic status under Vienna Convention (immunity from personal arrest or detention & legal process including words spoken or written by them). By March 2002, 23 monitors from Finland, Norway, Denmark, Iceland and Sweden were deployed to SLMM HQ in Colombo. SLMM had District Offices in Jaffna, Mannar, Vavonyia, Trincomalee, Batticaloa and Apmara with one SLMM Liaison Team deployed in LTTE HQ in Kilinochchi. Each SLMM District Office had a Local Monitoring Committee, consisting of five members; 2 from LTTE, 2 from GOSL and SLMM member functioned as the chairman. Another example of a sovereign nation being placed on par with an internationally banned terrorist movement.

The SLMM had freedom of movement including travelling in GOSL vessels & aircrafts.

SLMM were permitted to import operational supplies & equipment free of import taxes & duties. SLMM could reimburse for VAT/Goods & Services Tax on locally procured operational & equipment & were to also enjoy privileges for taxes on petrol. SLMM were also permitted to use all kinds of communication systems even satellite communications. They were also given the right to use codes & receive correspondence in sealed bags/courier. GOSL could not detain any communication directed to the SLMM. The GOSL even agreed to facilitate smooth custom clearance of SLMM’s operational supplies.

SLMM was even ready to facilitate LTTE requests to be given access to Jaffna islands for ‘political work’ and allowing LTTE to move in their own vessels from North to East to ‘visit their families’.

Perhaps everyone has forgotten how LTTE held 2 SLMM officials against their will in July 2002 and physically hindered from leaving the LTTE trawler.

This is what the SLMM press release asked of the people in December 2002 All people in Sri Lanka must work together with the Government and the LTTE leadership”

Between February 2002 and April 2007 LTTE had committed 3830 violations of the CFA against 351 by the GOSL. Why have these figures not been used in Geneva against the LTTE?

The noteworthy violations by LTTE as noted by SLMM include
• 119 assassinations
• 253 abductions of children
• 1743 child recruitment
• 579 abduction of adults
• 34 forced recruitment of adults
• 3 abduction of military personnel – WHERE ARE THEY NOW?
• 30 cases of extortion – HOW MUCH?
• 83 provocative acts
• denying access to LTTE military areas

LTTE had even obstructed SLMM 14 times from 2002 February to December 2004.

SLMM are also accused of indirectly assisting the LTTE. Wikileaks cable release gives news of a confidential cable sent by US envoy on 23 October 2003 by Charge d’Affaires James F. Entwistle who disclosed that the SLMM had admitted helping LTTE evade apprehension. The then President Chandrika Kumaratunga even accused the SLMM of deliberately tipping off the LTTE in a letter she sent to Norway. Noteworthy is that the UNP did not support the President & instead demanded her not to change Teleffsen in case it would upset the peace! The appeasement policy that the UNP adopts to this day.
However, SLMM’s chief Tryggve Teleffsen was asked to leave. There is little doubt that the SLMM & LTTE had an understanding special to that which SLMM did not have with the Sri Lankan Armed Forces.

The SLMM issued a statement that 4000 persons had been killed since Mahinda Rajapakse became President in November 2005. There is nothing to be surprised about the evidence-less figures that keep popping out of the sky on the guestimated number of deaths – ignoring classifying how many of the supposed dead were LTTE cadres, were civilians, how many were killed by LTTE, Armed forces or died naturally – all are being credited to the army only.

The SLMM wanted to imply that the new government was responsible for the killings. SLMM did not classify how many of the supposedly ‘killed’ were civilians or LTTE. Naturally the world was elated at the numbers charged against the Rajapakse government. When pressed the SLMM refused to even divulge the sources or showcase proof and the Rajapakse government did not take the SLMM to task for promoting unsubstantiated claims and the co-chairs US, EU, Norway and Japan also chose to stay silent as did the Secretariat for Coordinating the Peace Process (SCOPP) inspite of the army challenging the figures. It was identical to the drama unfolding about the supposed 40,000 dead! The GOSL also chose not to severely challenge these numbers.

Little said of the CFA is better – no one, not even the armed forces heads were shown a word in it before it was signed. For the first time a national army was put in par with a terrorist group, territory was officially given to these terrorists – CFA lines were almost LTTE borders, terrorists were allowed to travel to any part of the country armed while the national army were confined to barracks. By allowing a terrorist group to rule ‘air’ ‘sea’ & ‘land’ the Ranil Wickremasinghe government had virtually ceded Sri Lanka’s sovereignty. LTTE set up their own police, own banks, own courts, own administrative systems, tiger tax system, own checkpoints – there were 17 such check points after the 2002 CFA. LTTE were even arresting Sri Lanka Police that entered into ‘their’ area. The high security zones created by the army were all reduced or eliminated. It was during this period that a horrific betrayal took place with the incident of the Millennium City debacle resulting in the exposure of the intelligence operatives & LTTE killing 44 such brave anti-LTTE informants & officers. Most of the killings during the CFA were of people who were anti-LTTE. https://www.hrw.org/legacy/backgrounder/asia/srilanka080603.htm It was in August 2005 that the LTTE assassinated Sri Lanka’s Foreign Minister Lakshman Kadiragamar.

It was also before the CFA that the tiger proxy TNA was created in 2001 immediately after 9/11 & the war on terror – obviously the foreign think tanks were quick to establish a political proxy lest LTTE were pushed against the wall. It was also during the CFA that Karuna split from the LTTE and it has become fashionable to pass all credit for child soldier recruitment to Karuna instead of the LTTE.

Thankfully Prabakaran did not declare UDI, had that happened the West would have jumped to recognize Eelam.

The most hilarious news was the GOSL issuing passports for these terrorists to travel to Ireland for 3 month training! The GOSL even allowed LTTE to bring in sophisticated hi-tech communication systems and duty & taxes were paid by the Ranil Wickremasinghe Government signed by Austin Fernando then Defense Secretary and even transported complimentary to LTTE areas. SLMM helped Sea Tiger Soosai travel to Singapore helicoptered to the airport courtesy Ranil Wickremasinghe government.

While Colombo UNPers were boasting of a well-won ‘peace’ by their leader Ranil, the LTTE were busy setting up LTTE camps with across the North & East, replenishing their weapons & storing more weapons & ammunition. Ranil Wickremasinghe’s government orders to the army were ‘do not retaliate’ and even when LTTErs showed their backsides to the army or spat at them, the army had to simply watch their ugly backs! Isn’t this same humiliation not getting repeated now? The similarities are too shocking of both periods that Ranil ruled & the manner the armed forces & police are suffering humiliation & ridicule.

Another noteworthy aspect of the CFA was the prohibition of arrests under PTA and instead Criminal Procedure Code was adopted. Is it a surprise that the same parties are working to abolish the PTA though Armed Forces personnel are presently being arrested under PTA. Wherever have you heard of military personnel getting arrested as terrorists! What needs to be said & clearly understood is that the CFA provided the window of opportunity for LTTE to regroup, re-enlist adults & children, restock and prepare for a bigger battle.

The presence of the SLMM clearly established the futility of international presence & monitoring of a conflict.

The SLMM presence was clearly a proven failure by virtue of its own status report. The continued calls for foreign presence to monitor the situation proved futile. SLMM could not even stop the death of a very distinguished person like Lakshman Kadiragamar, Sri Lanka’s Foreign Minister. Moreover, apart from simply documenting what the SLMM thought fit to document, SLMM did nothing to stop LTTE killings, in fact LTTE only grew throughout the CFA, a factor many living in Colombo have failed to understand & admit. LTTE strengthened itself during the CFA as it freely moved not only throughout the country but overseas as well. LTTE was able to select & purchase a range of sophisticated weaponry far superior to that which the National Army had. It was able to establish links & contacts for military purchases & other technical requirements & these ‘freedoms’ afforded to by LTTE even under the watchful presence of the SLMM ended up with LTTE returning to their murderous ways with greater intent & fury …. Kebethigollawa bus deaths, LTTE air attack on Colombo & airport were just a handful of attacks carried out by the LTTE after the ceasefire ended. The ceasefire was only in name and the over 3000 violations by LTTE suffices to prove this.

Those who continue to say foreign presence, foreign truce monitors, foreign judges, foreign this – foreign that is needed to solve Sri Lanka’s problem need to only take the record sheet of the SLMM to realize with what bias they had conducted themselves & their inability or their lack of desire to prevent LTTE terrorizing the people of Sri Lanka.

Collapse of the Rupee and the yahapalana govt.’s economic mismanagement

 The Rupee has depreciated steadily against the US Dollar ever since the yahapalana government came into power – a trend which has now accelerated alarmingly. The value of the US Dollar which was Rs. 131 at the end of 2014 when I left office is now over Rs.170 and continuing to slide on a daily basis. Members of the government claim that the reason for the collapse in the value of the Rupee is the appreciation of the US Dollar against other currencies. During my Presidency, the currencies of many Asian countries such as South Korea, Indonesia, Thailand, and the Philippines declined sharply against the US Dollar due to the 2007-2008 global economic crisis. Sri Lanka was one of the few countries in Asia that emerged largely unscathed from that currency crisis.

Very few Sri Lankans were even aware that there was a global economic crisis in 2007-2008. The Sri Lankan Rupee which averaged Rs.110.62 to the US Dollar in 2007 was still Rs.114.94 in 2009 after the crisis had run its course. My government fought and won the war against the LTTE which had been ranked by the FBI in 2008 as the deadliest terrorist organisation in the world, in the middle of what is considered to be the worst global economic crisis since the 1930s. The government’s task is to manage crises, not to complain about them. It took some quick thinking to keep out of the crisis that was sweeping the world in 2008. When one commercial bank showed signs of stress, we placed it under state bank supervision and averted a crisis which could have affected the entire banking sector.

President Trump has strengthened the US economy through a policy of giving incentives to indigenous businesses and imposing tariffs on imports to encourage local production. My government also had a policy of producing whatever we could locally and reducing imports particularly of foodstuffs such as diary products, maize, soya, sugar, onion, potato, fruits, vegetables, poultry and certain industrial products. This government in contrast believes in limitless liberalization and free trade without a clear strategy to increase exports and reduce imports. The role of a government is to keep abreast of worldwide developments and to take steps to strengthen our economy instead of complaining that a foreign leader has strengthened his own economy and that our currency was collapsing on that account.

If we have a government that requires foreign countries to underperform so as to enable us to maintain the value of our currency, then this country is in deep trouble. The public should be warned that an all-round increase in the cost of consumer goods and industrial inputs will not be the only consequence of the currency depreciation that we are experiencing now. Central Bank reports show that even with the less dramatic currency depreciation that took place in 2015, 2016 and 2017, Sri Lanka’s foreign debt burden has increased by a colossal Rs. 697 billion. The government needs to raise Rupee revenues to buy the Dollars to meet foreign debt payments. The increase in the foreign debt burden this year will be very high due to the free fall of the Rupee.

The reckless salary increases, fuel price reduction and tax reductions on certain imported food items given in 2015 to win the Parliamentary election of that year led to a sudden increase in  government expenditure, and resulted in increased imports of fuel, motor vehicles etc. This led to widening trade and fiscal deficits and heavy borrowing to meet the shortfall. My government was very careful in taking foreign currency commercial loans because even a slight increase in the exchange rate results in the debt burden going up due to the exchange rate difference. For example, my government issued Sri Lanka Development Bonds only twice a year and that too for amounts that averaged less than USD 350 million per year.

The volume of foreign currency loans taken has to be carefully controlled to ensure that the economy is not overwhelmed by repayment commitments. However the present government has been completely reckless in its foreign commercial borrowings. From January 2015 to date, the total volume of foreign currency loans taken by the present government amounts to an unbelievable 20.7 billion USD, the breakdown of which is as follows – USD 8.2 billion through the issue of Sri Lanka Development Bonds from January 2015 to date, USD 6.1 billion through sovereign bonds issued in 2015, 2017 and 2018, USD 2.2 billion through currency swap arrangements with India in 2015 and 2016, USD 2.7 billion through syndicated loans arranged through international banks in 2016, 2017 and 2018 and USD 1.5 billion from the IMF Extended Fund Facility in 2016.

So we now see the economy barreling downhill with the foreign debt burden contributing to the depreciation of the Rupee and that depreciation in turn ratcheting up the debt burden further. In the meantime, the rapid depreciation of the Rupee is depriving us of the benefit of declining international prices of commodities. Fuel prices were increased thrice this year. Petrol is now Rs. 149 and diesel Rs. 123 per litre in a situation where crude oil is available at less than USD 80 per barrel which is very low compared to the average of USD 109 per barrel that prevailed during the last four years of my government. In 2008, when Sri Lanka was buying crude oil at the much higher rate of USD 97 a barrel, we sold petrol at Rs. 120 and diesel at Rs 70 per litre. The present mismatch between the low price of crude oil and the high retail prices of fuel in Sri Lanka is due largely to the depreciation of the Rupee and the government tax on fuel. The reason why the government is keeping the fuel pricing formula a closely guarded secret is because it will reveal to the public both the incompetence of the government as well as the taxes they are charging on fuel.

The government has been trying to downplay the depreciation of the Sri Lankan Rupee by claiming that the Indian Rupee has depreciated even more. The Indian economy however is growing at nearly twice that of Sri Lanka and they are better able to weather the shocks. We are paying a heavy price for shifting from an emerging production economy under my government to a trading economy under UNP policies. What we are faced with now is slow growth below 4%, increasing inflation, increasing imports even of items that can easily be produced locally, huge repayments of short and medium term foreign commercial consumption loans taken by this government and a Rupee that is depreciating by the day. The emerging economic crisis is the outcome of the ill-conceived economic policies of this government and the lack of a home grown economic management strategy.

රුපියලේ බිඳවැටීම හා යහපාලන ආණ්ඩුවේ ආර්ථික අවපාලනය

යහපාලන ආණ්ඩුව බලයට පැමිණි දා සිට ඇමරිකානු ඩොලරයට සාපේක්‍ෂව රුපියලේ අගය පහත වැටීමේ ප්‍රවනතාවයක් පැවතුණි. එය අද වන විට  භයානක නාය යෑමක් දක්වා වර්ධනය  වී ඇත. 2014 අවසානයේදී රුපියල් 131 ක් වූ ඩොලරයේ මිල අද රුපියල් 170 ඉක්මවා ගොස් දිනපතාම තවදුරටත් අවප්‍රමාණය වෙමින්  පවතී. රුපියලේ වටිනාකම මේ ආකාරයට කඩා වැටීමට හේතුව වෙනත් මූල්‍ය ඒකකයන්ට සාපේක්‍ෂව ඩොලරයේ අගය ඉහල යෑම යැයි ආණ්ඩුවේ ප්‍රධානීන් කියයි. මගේ ආණ්ඩු කාලය තුළ 2007 – 2008 වසර වලදී ඇතිවූ ලෝක ආර්ථික අර්බුදය හේතුකොටගෙන දකුණු කොරියාව, ඉන්දුනීසියාව, තායිලන්තය, පිලිපීනය, මැලේසියාව ඇතුළු ආසියානු රටවල් ගණනාවක මුදල් ඒකක ඇමරිකානු ඩොලරයට සාපේක්‍ෂව විශාල වශයෙන් කඩා වැටුණි.  එදා ඒ ඇතිවූ ලෝක ආර්ථික අර්බුදයෙන් ලංකාවට කිසිදු බලපෑමක් සිදු නොවන බවට වලබලා ගැනීමට අපේ ආණ්ඩුව සමත්විය. 

2007 – 2008 වසර වලදී මුලු  ලෝකය පුරාම හමාගිය දරුණු  ආර්ථික අර්බුදයක් තිබුණු බව වත් බොහෝ ශ්‍රී ලාංකිකයින් දැනගෙන සිටියේ නැත. 2007 දී රුපියල් 110.62 ක් වූ ඇමරිකානු ඩොලරය 2009 දී ලෝක ආර්ථික අර්බුදය අවසන් වූ පසුත් රු. 114.94 ක අගයක පැවතියේය. 2008 දී ඇමරිකාවේ එෆ්.බී.අයි ආයතනය ලෝකයේ දරුණුම ත්‍රස්තවාදී සංවිධානය හැටියට නම්කරනු ලැබූ කොටි සංවිධානය මගේ ආණ්ඩුව විසින් පරාජය කරනු ලැබුවේ 1930 ගණන් වලින් පසුව ලෝකයේ ඇතිවූ දරුණුම ආර්ථික බිඳවැටිම මධ්‍යයේය. ආණ්ඩුවේ කාර්යභාරය වන්නේ අර්බුද කළමනාකරණය කිරීම මිස ඒ ගැන මැසිවිලි නැඟීම නොවේ. 2008 දී මුලු ලෝකය පුරාම හමා ගිය ඒ දරුණු ආර්ථික අර්බුදයෙන් බේරී සිටීම අපටද යුහුසුලුව නොයෙක් පියවර ගැනීමට සිදුවිය. ලංකාවේ එක් වානිජ බැංකුවක් අස්ථාවර බවක් පෙන්නුම් කල විට, අපි එය වහාම රාජ්‍ය බැංකුවක අධීක්‍ෂණය යටතට පත්කොට මුලු බැංකු ක්‍ෂේත්‍රය පුරාම පැතිරීමට ඉඩ තිබූ අර්බුදයක් වලක්වා ගත්තෙමු.

ජනාධිපති ඩොනල්ඩ් ට්‍රම්ප් ඇමරිකානු ව්‍යාපාරික ආයතන වලට දිරිගැන්වීම් ලබාදී දේශීය නිශ්පාදනය උනන්දු කරවීම සඳහා ආනයන බදු වැඩි කිරීම වැනි ක්‍රියාකාරකම් තුළින් ඇමිරිකානු ආර්ථිකය ශක්තිමත් කොට ඇත. දේශීයව නිපදවිය හැකි දේවල්, විශේෂයෙන්ම කිරි නිශ්පාදන, බඩ ඉරිඟු, සෝයා, සීනි, ලූනු, අර්තාපල්, පලතුරු, එලවලු, කුකුල් මස් හා ඇතැම් කාර්මික නිශ්පාදන මෙරටේම නිපදවා ආනයන අඩු කිරීමේ ප්‍රතිපත්තියක් මගේ ආන්ඩුවටද තිබුණේය. ඊට වෙනස්ව වත්මන් ආණ්ඩුව අනුගමනය කරන්නේ කෙලවරක් නැති නිදහස් ආනයනික වෙළඳ  ප්‍රතිපත්තියකි. ආනයන අඩුකොට අපනයන වැඩි කිරීමට කිසිදු උපායමාර්ගයක් ඔවුන්ට නැත. ආණ්ඩුවක කාර්යභාරය වන්නේ ලෝක ප්‍රවනතා අධ්‍යනය කොට එයට සමගාමීව අපගේ ආර්ථිකය ශක්තිමත් කිරීමට පියවර ගැනීම මිස විදේශීය රටක නායකයෙකු ඔහුගේ ආර්ථිකය ශක්තිමත් කර තිබෙන බවත්, ඒ හේතුවෙන් අපේ රුපියලේ අගය බිඳ වැටෙමින් පවතින බවත් කියමින් මැසිවිලි නැගීම නොවේ. 

අපගේ මුදල් ඒකකයේ වටිනාකම පවත්වාගෙන යෑම සඳහා විදේශීය රටවල ආර්ථික උදාසීනත්වය මත රදා පවතින ආණ්ඩුවක් අපට සිටියහොත් මේ රට දරුණු අර්බුදයකට ඇද වැටීම වැලැක්විය නොහැක. රුපියලේ බිඳවැටීම නිසා සිදුවන්නේ සියලුම පරිභෝජන භාණ්ඩ හා අමුද්‍රව්‍ය වල මිල වැඩිවීම පමණක් නොවන බව අප අවබෝධ කරගත යුතුය. 2015, 2016, 2017 යන වසර වලදී අදට වඩා තරමක් අඩුවෙන් රුපියලේ අගය පහතවැටීම හේතුවෙන් වුවද ශ්‍රී ලංකාවේ විදේශීය ණය බර රුපියල් බිලියන 697 කින් වැඩිවී ඇති බව මහ බැංකු වාර්තා වල සඳහන් වේ. විදේශීය ණය ගෙවීම සඳහා රුපියල් වලින් ආදායම් උපයා ඩොලර් මිලදී ගැනීමට ආණ්ඩුවට සිදුවේ. මෙම වසර තුළ සිදුවී ඇති රුපියලේ කඩාවැටීම නිසා විදේශීය ණය බර කලින් අවුරුදු වලටත්  වඩා දරුණු අන්දමට වැඩිවනු ඇත.

2015 පාර්ලිමේන්තු මැතිවරණය ජය ගැනීම සදහා වත්මන් ආණ්ඩුව කිසිදු වග විභාගයකින් තොරව සිදුකල වැටුප් වැඩි කිරීම, ඉන්ධන මිල පහත හෙලීම හා ඇතුම් ආනයනික ආහාර ද්‍රව්‍ය වල බදු අඩු කිරීම වැනි ක්‍රියාකාරකම් නිසා ආණ්ඩුවේ වියදම් එක්වරම වැඩිවූවා පමණක් නොව ඉන්ධන හා මෝටර් රථ ආනයනයද වැඩි විය. මේ නිසා ඇතිවු වෙලඳ හා අයවැය පරතරය පියවීමට ආණ්ඩුව මහා පරිමානයෙන් ණය ගැනීමට පටන් ගත්තේය. විනිමය අනුපාතයේ සුලු වෙනසකින් වුවද විදෙස් ණය බර විශාල වශයෙන් වැඩිවිය හැකි නිසා මගේ ආණ්ඩුව විදේශීය වානිජ ණය ගැනීමේදී ඉතාමත්ම ප්‍රවේසම් විය. උදාහරණයක් වශයෙන් මගේ ආණ්ඩුව ශ්‍රී ලංකා සංවර්ධන බැඳුම්කර නිකුත් කරනු ලැබුවේ අවුරුද්දකට දෙවතාවක් පමණි. එයින් ලබා ගන්නා ලද ණය ප්‍රමාණයද අවුරුද්දකට ඩොලර් මිලියන 350 ක සාමාන්‍ය අගයක් ඉක්මවූයේ නැත.

ණය ආපසු ගෙවීම ආර්ථිකයට දරාගත නොහැකි බරක් නොවන්නට නම්, විදේශ විනිමය ණය පරිමාව ඉතා ප්‍රවේසමෙන් පාලනය කළ යුතුය. නමුත් වත්මන් ආණ්ඩුව ඉවක් බවක් නොමැතිව විදේශීය වානිජ ණය ලබාගෙන තිබේ.  2015 ජනවාරියේ සිට අද දක්වා මෙම ආණ්ඩුව ලබාගෙන ඇති මුලු විදේශ විනිමය ණය ප්‍රමාණය ඇ.ඩො. බිලියන 20.7 ක් වේ. ඒ 2015 ජනවාරියේ සිට අද දක්වා ශ්‍රී ලංකා සංවර්ධන බැඳුම්කර නිකුත් කිරීම තුළින් ඩොලර් බිලියන 8.2 ක්, 2015, 2017 හා 2018 වන වසර වලදී නිකුත් කරන ලද සවරින් බොන්ඩ් තුළින් ඩොලර් බිලියන 6.1ක්, 2015 හා 2016 ඉන්දියාව සමඟ ඇතිකරගත් කරන්සි ස්වොප් ණය තුළින් ලබාගත් ඩොලර් බිලියන 2.2 ක්, 2016, 2017 හා 2018 යන වසර වලදී ජාත්‍යන්තර බැංකු හාරහා ලබාගෙන ඇති සින්ඩිකේටඩ් ලෝන් ඩොලර් බිලියන 2.7 ක් හා 2016 දී ජාත්‍යන්තර මූල්‍ය අරමුදලෙන් ලබාගත් ඩොලර් බිලියන 1.5 ක් වශයෙන් වෙන්කොට පෙන්විය හැක.

විදෙස් ණය බර නිසා රුපියලේ අගය අවප්‍රමාණය වීමත්, ඒ අවප්‍රමාණය නිසාම අපගේ විදේශීය ණය බර තවත් වැඩිවන විෂම චක්‍රයකට අප දැන් හසුවී සිටී. රුපියලේ බිඳ වැටීම හේතුවෙන් ජාත්‍යන්තර වෙළඳපලේ භාණ්ඩ වල මිල අඩුවීමේ වාසියද ලංකාවේ ජනතාවට අහිමි වී තිබේ. මෙම වසර තුළ තුන් වතාවක් ඉන්ධන මිල වැඩිකොට ඇත. අද පෙට්‍රල් ලීටරයක් රු.149 ක් වන අතර ඩීසල් ලීටරයක් රු. 123 ක් වේ. නමුත් බොරතෙල් බැරලයක මිල ඩොලර් 80ටත් අඩුය. මගේ ආණ්ඩුවේ අවසන් අවුරුදු හතර තුළ දී වූ බැරලයකට ඩොලර් 109 ක්වූ සාමාන්‍ය බොරතෙල් මිලට වඩා අද බොරතෙල් මිල බෙහෙවින්ම අඩුය. 2008 දී අපි බැරලයකට ඩොලර් 97 ගණනේ බොරතෙල් ගෙන්වන විට ලංකාවේ පෙට්‍රල් ලීටරයක මිල රු. 120 ක් වූ අතර ඩීසල් රුපියල් 70 ක් විය. අද ලෝක වෙළඳපොලේ බොරතෙල් වල අඩු මිලත් ලංකාවේ ඉන්ධන වල ඉහල මිලත් අතර නොගැලපීමට  ප්‍රධාන හේතු රුපියලේ අවප්‍රමාණය හා ඉන්ධන මත පනවා ඇති බදුය. ආණ්ඩුව ඔවුන්ගේ ඉන්ධන මිල සූත්‍රය මොනම හේතුවකටවත් ප්‍රසිද්ධ නොකරන්නේ එයින් ආණ්ඩුවේ නොහැකියාව මෙන්ම ඉන්ධන මත අයකරන බදු ප්‍රමාණයද හෙළිවන නිසාය.

ඉන්දියානු රුපියල ලංකාවේ රුපියලටත් වඩා අවප්‍රමාණය වී ඇති බව කියමින් ආණ්ඩුව මේ ඇති වී තිබෙන තත්වය සුලුකොට පෙන්වීමට උත්සාහ දරමින් සිටී. නමුත් ඉන්දියාවේ ආර්ථිකය ලංකාවේ ආර්ථිකය මෙන් දෙගුණයක පමණ අගයකින් වර්ධනය වෙමින් පවතින නිසා ඔවුන්ගේ ඔරොත්තු දීමේ ශක්තිය වැඩිය. අප අද මේ අත්විදිමින් සිටින්නේ මාගේ ආණ්ඩුව කාලයේ මතුවෙමින් පැවති නිශ්පාදන ආර්ථිකය පසෙකලා එක්සත් ජාතික පක්‍ෂයේ ප්‍රතිපත්ති අනුව වෙලඳ ආර්ථිකයකට පරිවර්තනය වීමේ ආනිසංශයි. අපට දැන් ලැබී ඇති දායදය වන්නේ 4% කටත් අඩු වර්ධන වේගයත්, බඩු මිල ඉහල යෑමත්, දේශීයව නිශ්පාදනය කල හැකි භාණ්ඩ පවා වැඩි වැඩියෙන් ආනයනය කිරීමත්, වත්මන් ආණ්ඩුව පරිභෝජනය සඳහා ලබා ගත් කෙටි හා මධ්‍යම කාලීන විදේශීය වානිජ ණය ගෙවීමත්, දිනෙන් දින බාල්දු වන රුපියලත්ය. මේ මතුවෙමින් තිබෙන ආර්ථික අර්බුදය වත්මන් ආණ්ඩුවේ අමනෝඥ ආර්ථික ප්‍රතිපත්තිය හා ලංකාවට අවේනික ආර්ථික කලමණාකරන උපායමාර්ගයක් නොමැතිවීමේ ආනිසංශයි.

The Unsaved World

The rupiah is falling! Head for the hills! On second thought, keep calm and carry on.

In case you’re wondering, the rupiah is the national currency of Indonesia, and, like many other emerging-market currencies, it has fallen a lot over the past few months. The thing is, the last big rupiah plunge was in 1997-98, when Indonesia was the epicenter of an Asian financial crisis. In retrospect, that crisis was a sort of dress rehearsal for the much bigger crisis that engulfed the advanced world a decade later. So should we be terrified about Asia all over again?

I don’t think so, for reasons I’ll explain in a minute. But current events do bring back memories — and they are, in particular, a reminder of how little we learned from that crisis 16 years ago. We didn’t reform the financial industry — on the contrary, deregulation went full speed ahead. Nor did we learn the right lessons about how to respond when crisis strikes. In fact, not only have we been making many of the same mistakes this time around, in important ways we’re actually doing much worse now than we did then.

Some background: The run-up to the Asian crisis bore a close family resemblance to the run-up to the crisis now afflicting Greece, Spain and other European countries. In both cases, the origins of the crisis lay in excessive private-sector optimism, with huge inflows of foreign lending going mainly to the private sector. In both cases, optimism turned to pessimism with startling speed, precipitating crisis.

Unlike Greece et al., however, the crisis countries of 1997 had their own currencies, which proceeded to drop sharply against the dollar. At first, these currency declines caused acute economic distress. In Indonesia, for example, many businesses had large dollar debts, so when the rupiah plunged against the dollar, those debts ballooned relative to assets and income. The result was a severe economic contraction, on a scale not seen since the Great Depression.

Fortunately, the bad times didn’t last all that long. The very weakness of these countries’ currencies made their exports highly competitive, and soon all of them — even Indonesia, which was hit worst — were experiencing strong export-led recoveries.

Still, the crisis should have been seen as an object lesson in the instability of a deregulated financial system. Instead, Asia’s recovery led to an excessive showing of self-congratulation on the part of Western officials, exemplified by the famous 1999 Time magazine cover — showing Alan Greenspan, then the Fed chairman; Robert Rubin, then the Treasury secretary; and Lawrence Summers, then the deputy Treasury secretary — with the headline The Committee to Save the World.” The message was, don’t worry, we’ve got these things under control. Eight years later, we learned just how misplaced that confidence was.

Indeed, as I mentioned, we’re actually doing much worse this time around. Consider, for example, the worst-case nation during each crisis: Indonesia then, Greece now.

Indonesia’s slump, which saw the economy contract 13 percent in 1998, was a terrible thing. But a solid recovery was under way by 2000. By 2003, Indonesia’s economy had passed its pre crisis peak; as of last year, it was 72 percent larger than it was in 1997.

Now compare this with Greece, where output is down more than 20 percent since 2007 and is still falling fast. Nobody knows when recovery will begin, and my guess is that few observers expect to see the Greek economy recover to pre crisis levels this decade.

Why are things so much worse this time? One answer is that Indonesia had its own currency, and the slide in the rupiah was, eventually, a very good thing. Meanwhile, Greece is trapped in the euro. In addition, however, policy makers were more flexible in the ’90s than they are today. The International Monetary Fund initially demanded tough austerity policies in Asia, but it soon reversed course. This time, the demands placed on Greece and other debtors have been relentlessly harsh, and the more austerity fails, the more bloodletting is demanded.

So, is Asia next? Probably not. Indonesia has a much lower level of foreign debt relative to income now than it did in the 1990s. India, which also has a sliding currency that worries many observers, has even lower debt. So a repetition of the ’90s crisis, let alone a Greek-style never-ending crisis, seems unlikely.

What about China? Well, as I recently explained, I’m very worried, but for entirely different reasons, mostly unrelated to events in the rest of the world.

But let’s be clear: Even if we are spared the spectacle of yet another region plunged into depression, the fact remains that the people who congratulated themselves for saving the world in 1999 were actually setting the world up for a far worse crisis, just a few years later.

Law and order – Where are we heading?

A police force of any sovereign state is empowered to enforce the law, to protect people and property, and to prevent crime and civil disorder. Is it happening in this country?

After working and living in four countries over 25 years, other than my own country (including two developing countries which are poorer than Sri Lanka), it is regrettable to note here that our country’s police force appears to have corrupted persons (with some exceptions, of course) who have no hesitation to twist the law to harass people while engaging themselves in crimes. Stories appearing in the printed and social media these days, pointing fingers from very bottom up to the top brass of the police force are justifying this observation. Those who lived during ‘Bheesana Samaya’ of late 1980s, under Premadasa regime, need not to know any examples.

The main reason for this unfortunate situation, like many other things in our country, is the politicization. Politicization of the government and other institutions is minimal (or not at all), compared to that of ours, in other countries I have seen and lived.

The way the ruling politicians conducting the so-called investigation against the serious allegations against the IGP and his deputy and their attempts to defend the IGP and the course of actions are not surprising at all. We remember how the President Sirisena appointed the Opposition Leader  Ranil Wickramasinghe  as PM and removed the Chief Justice within minutes after he came to power exhibiting the current rulers disrespect for the country’s constitution, rules and regulations.  We too remember how the Ranil Wickramasinghe defended former Central Bank Governor Arjun Mahendran, who is responsible for the Bond Issue Scam, when allegations were made against him in 2015 and how the politicians responsible for the law and order conveniently paved the way for the culprit, Mahendran, to leave the country.  The politicians responsible for bringing the Singaporean and appointing him as Governor are still ruling the country.

The questionable conduct of the current IGP and his close associates in the police force, from top to bottom, looks very similar that of the ruling politicians of the country. Both parties do whatever possible for their survival while pleasing each other.  Thus, one cannot expect any justifiable outcome from the so-called investigations coming under police force lead by the current IGP and the ruling politicians.
