An open letter to Central Bank Governor Dr. Indrajith Coomaraswamy:Regulatory Oversight Accountability over Government Bond Issues and Related Secondary Market Transactions

You would no doubt agree, that effective and professional best practices embedded regulatory oversight over Government bond issues and related secondary market transactions, ensuring that engaged intermediaries duly discharge their professional commitments in line with best market practices, are an essential imperative of a well governed securities market in Sri Lanka.

Such a governance framework is also an essential investor right, as endorsed by the Securities & Exchange Commission of Sri Lanka and the Chartered Financial Analysts Society of Sri Lanka ( refer attachment). These rights need to be duly discharged through ensuring that; “all associated financial professionals and intermediary organizations are Honest, competent, and ethical in conduct and complies with applicable law;

Independent and objective in advice and assistance, based on informed analysis, prudent judgment, and diligent effort;

Financial interests of the investor takes precedence over those of the professional and organization;

Fair in treatment in relation to other clients;

Disclosure of any existing or potential conflicts of interest in providing products or services;

Understanding the clients circumstances and ensuring advice is based on clients financial objectives and constraints;

Clear, accurate, complete and timely communications;

Fees and costs involved be transparent;

Confidentiality of information assured;

Complete supporting records are maintained

Whilst acknowledging that the Central Bank of Sri Lanka has competent professionals and infrastructure support to provide the oversight framework as set out above, recent controversial bond issues related experiences have clearly demonstrated that the Central Bank suffers from definite conflicts of interests, due its role in

Being the primary issuer and manager of the Government Bond issues;

Being the effective Manger and Portfolio Investor of the largest Securities market player in Sri Lanka – the Employees Provident Fund

In addition, it is commonly believed that the secondary market information data set maintained by the Central Bank is inadequate and incomplete for effective regulation of market and associated intermediaries. It is reported that the records maintained in the Central Bank, covering the secondary market transactions, fail to record the basic market data relevant to the prices at which the secondary market transactions have taken place.

In the light of above it is urged that the Monetary Board resolves to assign the role and responsibility to for regulatory oversight over Government bond issues and the related secondary market transactions to the Securities & Exchange Commission, at the earliest opportunity.

You will note from the attached copies of correspondence with the Securities & Exchange Commission, that the Securities & Exchange Commission, needs to make a minor amendment to its empowering enactment, to undertake this expanded role of supervision of the Government Bond issues and associated secondary market..

I trust that you and the Monetary Board, will immediately begin negotiation with the Securities & Exchange Commission and the Government, for the formal transfer of the oversight responsibility over Government Bond Issues and associated Secondary Market dealings, to the Securities & Exchange Commission.

අතුරුදහන් වූවන්ගේ කාර්යාලයක් පිහිටුවීම තුලින් සන්නද්ද හමුදා පාවා දීමට යවන බව හිටපු ජනාධිපති මහින්ද රාජපක්‍ෂ මහතා පවසයි.

මේ සම්බන්ධයෙන් හිටපු ජනාධිපතිවරයා විසින් නිකුත් කර ඇති නිවේදනය මෙසේය.

අතුරුදහන් වූවන්ගේ කාර්යාලය තුළින් සන්නද්ධ හමුදා පාවා දීම

රටේ සියලුම දේශපාලන හා ආර්ථික ව්‍යාකූලතා මධ්‍යයයේ වුවත් ආණ්ඩුව ‘අතුරුදහන් වූවන්ගේ කාර්යාලය’ නමින් හැඳින්වෙන ආයතනයක් පිහිටුවීමට පනත් කෙටුම්පතක් පාර්ලිමේන්තුවට ඉදිරිපත් කර ඇත.  මෙය පසුගිය වසරේ සැප්තැම්බර් මස ආණ්ඩුව බටහිර බලවතුන් සමග එකතු වී එක්සත් ජාතීන්ගේ මානව හිමිකම් කවුන්සිලය තුළ ‘යටගියාව සම්බන්ධයෙන් කටයුතු කිරීමට’, පිහිටුවීමට එකග වූ ආයතනවලින් එකකි. යෝජිත අතුරුදහන් වූවන්ගේ කාර්යාල පනත් කෙටුම්පතේ අපේ ආරක්‍ෂක හමුදා දඩයම් කිරීමට සම්පාදනය කර ඇති වගන්ති ගණනාවක්ම තිබෙන අතර ඉන් කිහිපයක් මෙහිදී ගෙනහැර දැක්වීමට මම කැමැත්තෙමි.

  1. මෙකී අතුරුදහන් වූවන්ගේ කාර්යාලය ශ්‍රී ලංකාවේ නීතිය ක්‍රියාත්මක කිරීමේ හෝ යුක්තිය පසඳලීමේ ආයතන පද්ධතියේ කොටසක් වන්නේ නැත. මෙය පාර්ලිමේන්තුව විසින් සංස්ථාපිත ස්වාධීන ආයතනයක් වන අතර එයට රජයේ ආයතනවලට බලපාන සාමාන්‍ය නීතිරීති වලට පිටින් කටයුතු කිරීමට හැකියාව ලැබේ.
  2. මෙය ‘කාර්යාලයක්’ ලෙසට හැඳින්වුව ද එය සැබවින්ම විමර්ශන සභාවකි. මෙම අතුරුදහන් වූවන්ගේ කාර්යාලයට සාක්ෂිකරුවන් ගෙන්වා පරීක්ෂා කිරීමටත්, කැඳවුම් නියෝග නිකුත් කිරීමටත්, විභාග පැවැත්වීමටත් බලය ඇත. මෙම ආයතනයේ නිළධාරීන්ට වරෙන්තුවක් නොමැතිව වුවද, රෑ දවල් ඕනෑම වෙලාවක පූර්ව දැනුම්දීමකින් තොරව, ඕනෑම පොලිස් ස්ථානයකට, බන්ධනාගාරයකට හෝ ත්‍රිවිධ හමුදා කඳවුරකට ඇතුල් වීමටත්, විමර්ශනය කිරීම සඳහා ඕනෑම ලියවිල්ලක් හෝ භාණ්ඩයක් තම සන්තකයට ගැනීමටත් බලය ඇත. මෙකී කාර්යාලයට සහයෝගය නොදක්වන ඕනෑම අයෙකුට උසාවියට අපහස කිරීමේ චෝදනාව යටතේ දඩුවම් කළ හැක.
  3. පාර්ලිමේන්තුව ඉදිරියේ ඇති පනත් කෙටුම්පතට අනුව අතුරුදහන් වූවන්ගේ කාර්යාලයේ සාමාජිකයන් හත් දෙනාට විමර්ෂන පැවැත්වීම පිළිබඳ අත්දැකීම් මෙන්ම මානව අයිතීන් නීතිය හා ජාත්‍යන්තර මානුෂීය නීතිය පිළිබදව දැනුමක්ද තිබිය යුතු බව කියවේ. මේ අනුව එහි සාමාජිකයන් වීමට සුදුසුකම් ලබන්නේ බටහිර මුදල්වලින් නඩත්තු වන රාජ්‍ය නොවන සංවිධානවල සමාජිකයන් සහ බටහිර අනුග්‍රහය යටතේ පවත්වාගෙන යන ජාත්‍යන්තර යුධ අපරාධ අධිකරණවල සේවය කළ අය පමණි.
  4. පනත් කෙටුම්පතේ 21 වන වගන්තියට අනුව ඕනෑම විදේශීය පුද්ගලයෙකුගෙන් හෝ ආයතනයකින් ඍජුවම අරමුදල් ලබා ගැනීමට අතුරුදහන් වූවන්ගේ කාර්යාලයට බලය පැවරේ.
  5. ආයතනයේ රාජකාරී කටයුතු සම්බන්ධයෙන් අතුරුදහන් වූවන්ගේ කාර්යාලයට ඕනෑම විදේශීය පුද්ගලයෙකු හෝ සංවිධානයක් සමග ගිවිසුම්වලට එළඹීමට හැක.
  6. අතුරුදහන් වූවන්ගේ කාර්යාලයේ සාමාජිකයන්ට එම ආයතනය තුළ විවිධ අංශ හා ඒකක පිහිටුවා තමාගේ බලතල එම ඒකකවලට පැවරිය හැක. කාර්යාලයේ සේවකයන් පත් කරන්නේත්, ඔවුන් සේවයෙන් පහ කරන්නේත් එම ආයතනය විසින්ම පමණි. මේ කාර්යාලයේ සේවකයන් ශ්‍රී ලාංකික පුරවැසියන් විය යුතු බවට කිසිදු වගන්තියක් පනත් කෙටුම්පතේ නැත.
  7. මෙම කාර්යාලයට, අතුරුදහන් වූවන්ගේ ඥාතීන්ගෙන් හා මිතුරන්ගෙන් මෙන් ම වෙනත් ඕනෑම දේශීය හෝ විදේශීය පුද්ගලයෙකුගෙන් හෝ සංවිධානයකින් වුවද පැමිණිළි භාරගත හැක
  8. ත්‍රිවිධ හමුදා හා බුද්ධි අංශ ඇතුලු සියලුම ආණ්ඩුවේ ආයතන මෙකී අතුරුදහන් වූවන්ගේ කාර්යාලයට සම්පූර්ණ සහයෝගය ලබා දීමට බැඳී සිටින අතර රාජ්‍ය රහස් පනතේ විධි විධාන ද එහිදී බල රහිත වේ
  9. අතුරුදහන් වූවන්ගේ කාර්යාලය පිළිබඳ පනත් කෙටුම්පතේ 12(ඇ)(iii) වගන්තියට අනුව සාක්ෂි ආඥා පනතේ නියමයන් නොසලකා හරිමින් වුවද ඕනෑම ප්‍රකාශයක් හෝ භාණ්ඩයක් ‘සාක්ෂි’ ලෙසට පිළිගැනීමට මෙම කාර්යාලයට බලය පැවරේ
  10. මෙම කාර්යාලයේ වැඩ කටයුතු සම්බන්ධයෙන් තොරතුරු දැනගැනීමේ පනත බල රහිත වේ. මෙකී කාර්යාලයේ නිළධාරියෙකුට ලැබුණු රහස් තොරතුරු ගැන කරුණු විමසීමට ශ්‍රේෂ්ඨාධිකරණයද ඇතුලුව මොනම  උසාවියකටවත් බලයක් නැත.

මෙම කරුණු අනුව අපට පෙනී යන්නේ මෙම අතුරුදහන් වූවන්ගේ කාර්යාලය යහපාලන ආණ්ඩුව පිහිටුවීමට එකග වී තිබෙන යුධ අපරාධ විමර්ෂණ යාන්ත්‍රණයේ එක් කොටසක් බවයි. මෙම පනත් කෙටුම්පත නීතියක් බවට හැරවීමට ඡන්දය දෙන සියලුම පාර්ලිමේන්තු මන්ත්‍රීවරුන්ට රටත්, ජාතියත්, සන්නද්ධ හමුදාවනුත්, පාවා දීම සම්බන්ධයෙන් ජනතාවට වගකීමට සිදුවනු ඇත.

[1]. බැසිල් රාජපක්ෂ මහතාට එරෙහිව එවකට එජාපයේ ජනාධිපති අපේක්ෂකයා ඇතුළු එජාපය විසින් චෝදනා කළේ කොමිස් ගැසීම්, ඇමරිකාවෙ මාළිගා සෑදීම් ඇතුළු මහා බිල්ලෙක් මවා පාමිනි.

වරින් වර එතුමාව සැක පිට අත් අඩංගුවට ගත්තද ඒ සෑම අවස්ථාවකදීම නිර්දෝශී වී අධිකරණයෙන් පිටව ගියේ යහපාලන පච වල තරම ජනතාව ඉදිරියේ පසක් කරමිනි.

[2]. මෙවර එතුමාව සැක පිට අත් අඩංගුවට ගෙන තිබෙන්නේ රජයේ මුදල් ප්‍රාදේශීය සභා වලට දුන්නා කියමිනි. යහපාලකයින්ට අනුව ප්‍රාදේශීය සභා යනුත් රාජපක්ෂවරුන්ගේ පුද්ගලික බූදලයක් විය යුතුය.

මේ සමග දැක්වෙන්නේ 2016/07/19 දින මව්බිම පුවත්පතේ දැක්වුණ පුවතයි. බැසිල් රාජපක්ෂ මහතාව සැක පිට බන්ධනාගාරගත කළ අරුමපුදුම චෝදනාව මෙහි දැක්වේ.

[3]. රජයේ මුදල් ඉල්ලීමකින් තොරව තවත් රජයේ ආයතනයකට දීම වරදක් නම්, රජයේ මුදල් ඉල්ලීමකින් තොරව පූජ්‍ය ස්ථානයකට පූජා කිරීම ඊටත් වඩා බරපතල වරදක් වනු ඇත. කිසිවෙකු ඉල්ලීමකින් තොරව පන්සලකට කෝවිලකට පල්ලියකට රජයේ මුදල් පරිත්‍යාග කළොත් යහපාලනයට අනුව කඩුවෙල අධිකරණයෙන් සිරගත වෙනු ඇත.

[4]. ජන සටන පාද යාත්‍රාව අගෝස්තු 1 දක්වා පැවැත්වෙයි. හරියටම අගෝස්තු 1 දක්වාම බැසිල් රාජපක්ෂ මහතාව සැක පිට සිරගත කර තිබීම විශේෂත්වයකි.

යුක්තිය විහිළුවක් ද?

කඩුවෙල මහේස්ත්‍රාත්වරයා අද මා නම් මා මේ වන විටත් ඉල්ලා අස් වී ගෙදර ගොස් අවසන් ය. එතරම් ම නීතියට මෙන් ම සියළු යුක්ති ධර්මයන්ට එරෙහි තීන්දුවකිනි අද දින බැසිල් රාජපක්‍ෂ මහතා අගෝස්තු 1 වෙනි දා දක්වා රිමාන්ඩ් කරනු ලැබූයේ !

නගා තිබූ චෝදනාව වූයේ බැසිල් රාජපක්‍ෂ මහතා අමාත්‍ය ධූරය දැරූ ආර්ථික සංවර්ධන අමාත්‍යාංශය මගින් පළාත් පාලන ආයතන 56කට රුපියල් කෝටි තුන හමාරක (මිලියන 36) වියදමින් ජී අයි පයිප්ප බට බෙදාහැරීම ය. මූල්‍ය අපරාධ කොට්ඨාශයේ බී වාර්තාවට ම අනුව, ආදාළ පයිප්ප අමාත්‍යාශංය විසින් කිසිදු අක්‍රමිතාවකින් තොරව අදාළ පළාත් පාලන ආයතනය වෙත බාර දී ද ඇත. එසේ ම එකී පළාත් පාලන ආයතන විසින් ද අදාළ පයිප්ප බට බාරගෙන ඇති බවට වාර්තා ද තිබේ. මේ ක්‍රියාවලිය අතරතුර කිසිම තැනක වංචාවක් සිදු වී ඇති බවට ද චෝදනාවක් පොලීසිය විසින් ඉදිරිපත් කොට නැත. ඔවුන් නගා ඇති එක ම චෝදනාව නම් අදාළ බට ලබා ගැනීම සඳහා මේවා ලැබූ පළාත් පාළන ආයතන මගින් ඉල්ලීමක් කොට නොතිබීම ය. එනම් ඉල්ලීමක් නොමැති ව බට ලබා දීම වරද වී තිබේ. මෙම චෝදනාව පොදු දේපළ පනත යටතේ ඉදිරිපත් කොට තිබුණි.

ජී අයි පයිප්ප බට ලබා දී තිබුණේ ඇයි ?ඇත්ත වශයෙන් ම මෙකී බට ලබා දී තිබුණේ රජය විිසින් ගත් ප්‍රතිපත්තිමය තීරණයක‍ට අනුව ය. ගමක කිසියම් උත්සව අවස්ථාවක තාවකාලික මඩු සාදාගැනීම, මරණ හෝ වෙනත් ග්‍රාමීය මට්ටමේ උත්සව අවස්ථාවක කොඩි කණු ලෙස භාවිත කිරීම, සැණකෙලි අවස්ථාවන්හි දී නොයෙක් කාර්යන් සඳහා භාවිතා කිරීම ආදිය සඳහා ‍යොදා ගැනීමට මෙම බට ලබාදීමේ අරමුණ වී තිබේ.

නීතිඥ මහතුන් විසින් ඉතා දක්‍ෂ ලෙස පෙන්වා දුන්නේ නැගූ චෝදනාව තුළ කිසිදු හරයක් නැති බව ය. FCID නිලධාරීන්ට ද ඒ එකදු තර්කයකට හෝ ප්‍රතිතර්ක ඉදිරිපත් කිරීමට අපොහොසත් වූ බව අපි නිරීක්‍ෂණය කළෙමු. සියළු දේශන අවසානයේ සැකකාර බැසිල් රාජපක්‍ෂ මහතාට ඇප ලබා දීම ප්‍රතික්‍ෂේප කිරීමට කිසිදු හේතුවක් නැති බවට වන මානසිකත්වයක් උසාවිය තුළ ගොඩ නැගී තිබුණි. එහෙත් ඒ අතර සිදු වූයේ අසාමාන්‍ය දෙයකි. මහේස්ත්‍රාත්වරයා විසින් නඩුව පසුව ගන්නා බව කියමින් උසාවිය කල්තබන ලදී. සාමාන්‍යයෙන් උසාවියක් කල් තැබෙන්නේ උපරිම විනාඩි 30ක් බව උසාවියක භාෂණ පරිවර්තයෙකයෙකු ලෙස කලක් කටයුතු කළ මම අත්දැකීමෙන් දනිමි. එහෙත් කඩුවෙල උසාවිය පැය එක හමාරකට වඩා කල් තැබුණි. අනතුරු ව අසුන වෙත යළි පැමිණි මහේස්ත්‍රාත්වරයා එක් වරම පවසා සිටියේ ඇප ලබා දීම ප්‍රතික්‍ෂේප කොට බැසිල් රාජපක්‍ෂ මහතා අගෝස්තු 1 වනදා දක්වා රිමාන්ඩ්භාරයට පත්කරන බව ය. කීමට අන් දෙයක් නැත. සැලසුම ව තිබුණේ නාමල් එළියට එන විට බැසිල් ඇතුළට දැමීම ය. එය ඒ අයුරින් ම සිදුවිය.

American base in Sri Lanka with the blessings of the Government?

Thereafter I would suggest that we all lodge our strongest protest against this sinister betrayal by the government done without informing the Parliament and force the Government to withdraw permission given to USA to start this project on our soil.  Then sack

America needs this in the center of the Indian Ocean to control South and South East Asia as it will soon lose Okinawa in Japan and Diago Garcia in the Indian Ocean.

Once it is establish you can never send them back and this little Island will be a battle ground for all global power politics. Where is our non-align policy, Independence and national sovereignty? This will be a threat not only to us but to the whole of Asia

US Militarization of Sri Lanka : Sri Lankans to provide Canteen Services

There are over 1000 foreign US military bases and installations. The 4 losers of World War 2 host the biggest bases located in Germany, Italy, Japan and Korea. The newest strategy is to set up smaller detachments across the nations where US geopolitics pivots to. It is as a result of such bases in Diego Garcia, Saudi Arabia, Turkey and other Gulf states that the US was able to militarily intervene in targeted nations and thereafter set up bases in them. The recent announcement of US State Dept awarding a USD155m contract raises many questions that draw serious ramifications internally for Sri Lankan society and externally for the rest of Asia given the destructive nature of US military.

The Daily FT http://www.ft.lk/article/554084/US-to-construct-a—155-m-embassy-complex-in-Sri-Lanka has reported the construction of a USD155m contract awarded by the US State Dept to Caddell Construction Co to be built in 2 years in a 6 acre area (possibly joining the present US embassy with the former British high commission located right in front of Temple Trees) How is it that Sri Lanka came to know of this very important news only after the US State Department awarded the contract to a fellow US construction company?

Why has the GOSL kept this secret from the general public? Why is there no Parliamentary debate on this? Given that there is no Opposition, what has the Joint Opposition to say about this and why are they keeping mum too? Should such an important decision not be shared with the public and public opinion sought on the matter BEFORE agreeing with the US?

All of the US bases have a history of problems. These bases serve to proliferate weapons, they undermine both international stability and have resulted in increase in internal violence of some sort or the other. The bases have created social problems – rise in rapes by US military personnel, increase in prostitution with female sex industry thriving (high end and poor), increase in drugs, violent crimes by foreign soldiers, a country losing value of prime land in and around the complex, issues of pollution and health hazard caused by testing non-conventional weapons inside the compound.

The most shocking part is that NONE of these crimes committed by US personnel can be charged for criminal offence as the US military are granted immunity under SOFA or status of forces agreement which defines the legal status of US personnel and property in territory of another country covering the criminal, civil jurisdiction, carrying of arms, tax and customs relief, damage claims for US by the host government. The general understanding is that it is in the interest of the host country that the US base is set up. However the agreement provides the US and not the host government a host of rights. US forces are not accountable for anything in a host country. In 1998, host governments processed 5092 cases against US personnel under SOFA.

30% of Okinawa Island in Japan is occupied by US military since World War 2. Locals have been protesting since and the US response was to build another base in 2004 which was luckily stopped due to environmental concerns being raised. In Puerto Rico 2/3 of the island is occupied by US, inhabitants were expelled from their homes to facilitate US bomb testing. We know too well how the Chagossians were virtually carried from the homes and evicted by the civilized British to set up a base for US in Diego Garcia. These people were dumped in Mauritius and even after winning a court order the British Government used Executive Orders and ignored it.

So if a Sri Lankan is raped, killed, molested, kidnapped etc the victims will have no justice whatsoever. If anyone is in doubt they can ask the 65,000 Okinawans from Japan who protested demanding the removal of US military from their Island. It is good to note that despite the people of Japan demanding its government to close the US base, Japan cannot because of the agreement in place. Therefore, if any base has been allowed, Sri Lanka will NEVER be able to remove it.

The US also has more than100 bases in Korea and here too US military are not accountable for any crimes they commit. In 2002, two teenage girls on their way to a birthday party were run over by a US tank – the driver was repatriated where a US military court found him ‘not guilty’. In 2006, 2600 car accidents were reported in Korea involving US servicemen. Koreans could not claim damages. Korean Insurance companies refused to cover damages too.

The Netherlands hosts 7 US bases one which has nuclear warheads. Two bases monitor and intercept drug-transport on the Caribbean Sea and another serves as reconnaissance flights over Colombia making the Netherlands indirectly involved in the Colombian conflict. The bases allow US to bring arms and materials to the country without reporting to Dutch customs!

But then the CIA is famed for smuggling drugs! The present Pakistan-India-Sri Lanka and East Asia is a narcotics hotbed!

All of US bases are platforms for military manoeuvres – aerial bombings on Pakistan are launched from Diego Garcia, the base in Ecuador is used for covert military actions on Colombia, the bases in Iraq and Turkey have served as intelligence centres against Iran and Syria. Bases have also been used for extra-judicial transport, imprisonment and torture of people. Guantanamo Bay is the perfect example while there are numerous other secret centres across Middle East and Europe. Some bases are even used to test nuclear arsenal, while others are for intelligence operations such as the world-wide network of ‘Echelon” bases that monitor all email, phone, data communications traffic.

These bases serve to overthrow governments – of the over 300 overseas military interventions & invasions by US were possible because of the US military facilities in various nations.

US & NATO has managed to surround Iran by occupying Iraq & Afghanistan and placing bases in 8 neighbors of Iran with 3 US-backed nuclear powers in Israel, India and Pakistan and Turkey deploys US nuclear warheads. Iran has every right to protect its nation and its sovereignty. What nation wants to be attacked this way?

Does Sri Lanka want to be an enemy to our friends in Asia? These bases will certainly be used against Russia, China, Iran and even India (though India foolishly thinks itself to be a proud partner of the West – non-whites are never ‘partners’ but kept to serve the interests only)

Do we in Sri Lanka boasting of being a non-violent and non-aligned nation wish to encourage such SADISM by a country whose hobby is bulldozing nations and blowing them to pieces?

This is not a game of Cowboys and Indians!

These are all early warnings for Sri Lanka.

These bases host not only US military but US citizens – soldiers, civilians, and others that include their families. Why are so many 7 star hotels emerging in Sri Lanka, we do not have people to afford such luxury. These hotels are meant for the families and the top brass and other very senior officers who will be regularly flying in from all parts of the world.

The new US base is said to have a US marine residence and a warehouse among other sophisticated items. Why would an embassy need a Marine Residence? And a warehouse to store what? These are dead giveaway for the ultimate creation of a US military base pretending it to be a US embassy complex. The momentum obviously came when in November 2015 Daya Gamage reported that when Samantha Power visited Sri Lanka, she envisaged ‘enhanced military relations’ which is beyond the sale of military equipment and training (it was not given when we needed it and now we don’t need it as the conflict is over)

When scores of foreign military set up virtual residence in Sri Lanka, the GOSL will say these are opportunities for our people. What are the opportunities…we will have to send our women as prostitutes oh yes and they can make money selling their bodies, we will have men and women serving as stewards and waitresses, do parents spend so much on education for their children to be servants in our own country! But then there will be plenty of cocktail circles where the local lackeys will squirm in front of their superiors boasting of hobnobbing with them. What else are we likely to get out of this can anybody please elucidate!!!

In the end we would have become distanced from our historical friends choosing to become their indirect enemy and when we are ever in need of help we would have no one to come to our aid. Irony is that even those that helped the US to get their prize catch would also end up getting the boot one fine day as Saddam, Suharto, Ngo Diem, Pinochet & Osama found out too late.

Why would Sri Lanka knowingly want to suffer the same hassles that nations with US bases are going through?

Attack on Sinhala student in the Jaffna University

I note with grave concern the reported attack on Sinhala students of the Jaffna University by Tamil extremists and thugs. It reminds me of the events in 1970s by the LTTE and creates impression of deep rooted extremist Tamil syndrome emerging against the presence of Sinhala students in Jaffna. This trend must be arrested immediately lest it go far, back in to pre -2009 situation.

If Tamils still say or think Jaffna University is only for Tamils and Muslims say Batticalloa University should be only Muslims then there is something radically wrong with the Tamil and Muslim minorities in their approach to live in this country any more. Either they have to accept that this is the country of the Sinhalese people and they are only minorities who had to adjust tot that situation or decide to go back to countries from where they have come without making this country an eternal battle field for everybody or on the other hand adjust to the local situation and learn to live amicably with the Sinhala nation without waiting for USA, UK Norway or India to come and sort out our problems. There is absolutely no point in talking of reconciliation or peaceful coexistence without making these basic psychological adjustments. The most vital need required is a change in attitudes. Tamils must understand that they have India to go and Muslims a whole world of Arab countries where as Sinhalese have no place, even a square inch of land, anywhere in the world to go since this has been the only Land of their birth and death for millennia.

In this backdrop it is the primary duty of the Government of this country to protect the rights of Bhumiputras of this country first. Therefore under the present situation the Government should take immediate steps to arrest this situation and steps should be taken to guarantee that Sinhala students enjoy the right to study in those Universities and their lives are safe as much as those of the Tamil and Muslim students in other Universities all over the Island. Are we going back to Prabhakaran times when Sinhala students were brutally murdered and chased out of Jaffna in 1970s.  Although Prabhakaran is no more, his ugly ghost seems to be still hovering among all Tamils in the north. If this was an attack on Sinhala students by Tamil students and if they say no Sinhala student should come to those Universities all Tamil students in all other Universities in the rest of the Island should also leave those Universities and go to India, their historical Homeland. Similarly Muslim students should also go to Arab countries from where they have come and to where they want to go. Because we cannot allow mono Tamil or mono-Muslim Universities to exist in this country as this is the Land of the Sinhala people. All Tamils and Muslims should accept that this was the Homeland of the Sinhalese at least for the past 2500 years in known history and it will also remain so for many millennia to come..

Further more

1 Both these Universities should be closed down immediately and remain to be so until these parties concede to this status and are made safe and free for Sinhala students as well

2 If that situation cannot be brought about the Minister of Higher Education must resign immediately for his failure to implement the Government’s education policy, if it has any? There is no point in sending other Ministers in processions to Jaffna.

3 Then the two universities should never be opened until normalcy is restored

4 And the Government must close the doors of all other Universities in the country for Tamil and Muslim students and make them out of bound for them so that they will realize the plight of the Sinhala students in the Jaffna and Batti Universities.

This decision should never be withdrawn until and unless the Tamils and Muslims living in this country accept the right of Sinhalese people to live, own property, do business and educate their children in any University anywhere in the Island without any discrimination what so ever which both Tamil and Muslim people enjoy this privilege right through out in spite of all discriminations they do against the sons of the soil.

The Government of the country should make the Sinhalese feel that they are not living in India or Arabia and they live in their own land in which their ancestors lived and found the civilization. All polit5ical parties should immediately stop playing narrow politics and look at this issue as crucial national subject that needs a serious approach above Party politics.

All Tamils and Muslims also should accept without any reservation that this was and is the historical Homeland of the Sinhala people who have built up the civilization for the past 2500 years and it is non-negotiable. They also should understand that in spite of their sinister manipulations throughout history still Sinhalese number over 75 % of the total population of this country and that situation will continue for many more millennia.

Present day Tamils and Muslims on the other hand are only the left outs of invaders, illicit immigrants, traders who have come to this country and slaves brought by the Colonial Dutch and British and masters to work on their tobacco and tea plantations (In Jaffna and on the Central Hills) abandoned behind high and dry as non citizens when the colonial invaders were forced to leave the shores of this Island. That is an undeniable truth no one can contest on any ground, either historical or archaeological. As such none of them have a legal right to treat the Bhoomiputras in this barbaric manner and claim ownership over an inch of land in this country. Therefore they all should leave the shores of this Island to Tamilnadu or the Homes from where they have come in south India an Arab lands if they are not ready to concede to this non-negotiable fact and live peacefully integrated with the Sinhala people. Not only Tamil and Muslim politicians but even Sinhala politicians who cajole minorities for their vote like the proverbial fox that followed a goat for many years expecting something hanging between the hind legs and the so-called intellectuals among the Colombians as Gomin Dias call them will lock horns with me. But this is the bitter truth that everybody will have to concede one day or the other.

The need of the hour is a strong patriotic government that can drive this point to the heads of the minorities and bring back sanity and peace to this cursed country without any delay. If the present Government cannot restore this legitimate status then they should resign immediately and hand over the country to someone who can do that. We are not concerned as to who will do that, whether it is Ranil, Sirisena ,Rajapaksa or even Chandrika or any other we are not bothered. We only want someone who can stand up to this yeoman challenge and will do it just like the ancient Kings did it.

I believe that to do that first and foremost we must get rid of the present cancerous political party system and the electoral systems that have become the banes of political stability of this blessed Island nation for the past 68 years. Let us invent a homegrown political system that can bring back political, economic and social harmony that was there in the days of the yore and restore the Sinhala Buddhist Kingdom that was once Sri Lanka there for over 2500 years that captured even the envy of the whole world.

What we need is a patriotic leader who can make that dream true. Even a herd of buffaloes grazing in the wild jungle has a Leader. But as Rev Ellawala Medhananda Thera once said, unfortunately we Sinhalese who boast of a 2500 year old glorious civilization do not have one. Under these circumstances, and my knowledge of the past history of this country, my strong conviction is the Buddhist monks who had been the guardian deities of this nation from the advent of Buddhism to this country in the 4th Century BC must once again take over the reins of leadership of the country. It is high time that we change the practice of leaving the destiny of this country completely in the hands of rogue politicians. Because of cause all those present day UNP, SLFP, JVP, CP and LSSP nikaya monks should renounce their party political robes and once again become the followers of the dispensation of Gautama the Buddha and become protectors and guardians of the Sinhala nation in order to fulfill this onerous task. This process has to begin from the Mahanayakas of the respective nikayas. If they can once again revive the ancient village–temple relationship and restore the role of the temple and the robe in the process of governance and nation building in this Island nation, I think the answer to all our burning problems would be found there.

Because this is the only Land of the Buddha on this planet, thrice blessed by the Lord as the land where his dispensation will last for 5000 years. 2560 years have already passed and the balance too has to go definitely uninterrupted, as the Buddha had predicted.

Rev Sirs, it is your noble mission and your proper time too, to see the Masters word is proved a gospel reality.

If you ignore this warning and remain in deep slumber inside your cloisters like Nero who played the harp while Rome was in fire and fail in your historic duty you will be cursed for eve, for allowing the demise of a great civilization from the surface of this planet due to your negligence and sloth. Following the great tradition of Theraputthabhya  Maha Thera, shun all party politics and corrupt politicians and please come out of your cloisters and Arabbbhatha, nikkamatha and yunjatha Buddha sasane.

Kalo ayan te Bhante! To get down to the yeoman task of the protection of this country, Sinhala nation and the Sambuddha Sasanaya.

Accountability, Reconciliation and Seeking a Political Solution: Volcanic Time-Bombs along the Tectonic Fault-Lines of the Lankan State

 Center of the Storm:

The triple  issues of accountability, reconciliation and seeking a political solution to the National Question are at the epicenter of a gathering political storm. It could be a storm that would be even more embracing, volatile and destructive than any and all the storms of war, destruction and terror that we have been put through. This time around, the stakes are that much more decisive, on an international, regional and internal scale. This is a gathering storm of irreconcilable ideological polarization and violent political contention. Redrawing the map of the world, including that of countries and nations through genocidal war is the dominant trend in world politics. Such destructive violence can lay to rest what the Land of Lanka had once been, along with its current political map.

Context:

The National Question has itself evolved following the end of the war. It is now enjoined with the issues of accountability, reconciliation and implementing a just political solution, These issues of accountability, reconciliation and seeking a just political solution to the National Question stand as three banners tied together, the contest over which shall decide our fate and our future.

Each of these issues, separately and collectively, has been hi-jacked by international powers, and all local players are being played according to its tune– on all sides of the divide. The US and its allies, through the UN, has hijacked these issues as a means to get a strategic grip on the politics of Lanka. This had become an urgent necessity to confront a rising strategic threat issuing from China over the control of  the vital Indian Ocean sea-lanes and to address the shifting balance of power in the  Asia /Pacific region. China has its own fangs into the lifelines of the political economy of Lanka, as does India.  These international players  shall play ball with all three issues, appearing to be the deliverers of universal justice. The International Tamil Diaspora – sections of it – shall also play ball. The US-led ‘Western Bloc’ will support a government and leadership that could be relied upon as trusted strategic allies and friends against its rivals. It shall either stabilize or destabilize the Lankan state and the regime by using any and all these three issues depending on how the game is played. Either the Land of Lanka shall be divided or unified, according to these interests. The Sinhala-Buddhist nation, the Tamil nation, the Moslem and Hill Country Malayaga Tamil nationality and other ethnic/religious communities all shall be played according to the needs of marauding vultures of Capital and their local agents.

Triple Time-Bombs:

In my view, the question of establishing credible accountability for alleged war crimes is an essential element in any meaningful process of reconciliation, which alone  leads to implementing a just and lasting solution to the National Question. Accountability is necessary to lay the basis for legal justice and political and moral responsibility, and in ensuring non- repetition , and is the bed-rock basis for reconciliation. Reconciliation refers to the integrated process of de-militarization, return and restoration of all lands and means of livelihood, release or amnesty for all political prisoners, accountability for those disappeared and the end to all colonization. The process of reconciliation lays the basis for healing the wounds of war, building broken bridges of trust and creating a genuine process  of  mutual understanding and respect, paving the ground to approach a negotiated political settlement. The three issues are enjoined. The issue of accountability has become the barometer of sincerity and commitment to be demonstrated in building genuine reconciliation on the basis of truth, justice, dignity and equality, as the bed-rock basis of implementing a democratic political solution. For that very reason, these three elements taken separately and individually constitute what may be termed the tectonic fault-lines of the Lankan State, and concentrate the focal point of violent political division and contention in the country.

The Resurgence of the Neo-Fascist Agenda: 

In my view, any real, meaningful, concrete step taken towards solving the Tamil National Question on a democratic foundation that, by definition,  recognizes the right of self-determination – in whatever form – shall be twisted and manipulated to become the spark that ignites the flames of communal carnage, genocidal terror and willful self-destruction – once again, but on an unprecedented level of vengeful  ferocity. The rebellion shall be inspired, organized and led by the deposed Rajapakse dynasty, as a way of suppressing any move towards prosecution or punishment for heinous crimes they have committed.  Any step towards implementing accountability on the part of the armed forces of the State shall be pitched as a wholesale capitulation to ‘Western Imperialist Powers’ and as a tragic betrayal of the ‘valiant war heroes’ who had shed their blood and lost their life and limbs for the ‘defense of the Motherland’. Once again the clarion call for the purification and resurgence of the Sinhala-Buddhist Nation as the undisputed rulers of the Motherland defended by the unitary state shall be issued more vehemently, militantly and violently than ever before- from the roof tops and temples throughout the Land. A Holy Patriotic Crusade shall be mobilized against imperialism and all its agents and imposters, against all faiths, beliefs and practices, against all alien minorities that have contaminated the nation and undermine its undisputed hegemony. The tottering financial crisis and increasing economic hardships, the broken pledges, the state of crisis and instability of the State and society, the breakdown of morality shall all be attributed to the traitors, in league with the minorities – whether national, ethnic or religious. This shall be the neo-fascist/ chauvinist-hegemonic agenda wrapped in the garb of a sacred theocratic mission mandated by the gods.

In my humble opinion, neither the Ranil/Sirisena regime backed by all its imperialist and regional powers, nor so-called civil society combined would be able to withstand the ferocity of the resurgence of the neo-fascist agenda. Not that this agenda represents a popular, majority agenda, but that it shall be imposed and enforced through the power of violent indoctrination, mass mobilization, backed by naked terror. As did the Nazis. As the debased and demented leader of the Bodu Bala Sena declared recently that there would be a replay of Aluthgama, thus openly and defiantly acknowledging ownership and responsibility for the anti-Moslem carnage at Aluthgama previously.  Mahasona Brigade, Ravana Brigade and all such para-military, para-state forces are simply the robed ideological goon squads of a resurging, serpentine neo-fascist agenda. And yet not shall the SR Regime take any action to defang the venomous creatures and stem the rising tide, lest they shall also get washed away by the raging fury of the storm. The truth is that all successive regimes have promoted and pandered to this chauvinism and are guilty of sabotaging any political solution.

These developments towards anarchy and civil conflict shall play into the hands of the foreign powers. It will give reason to exercise the right to intervene directly, including militarily, invoking the right to protect (R2P). I have no faith in any of these foreign predator powers to play any positive role in solving the national question, since they are all out to advance their own strategic agendas at the expense of their rivals. Nor do I have any faith in the prevailing neo-colonial State and political system, and in any and all of the established ruling class political parties to deliver justice. They are complicit in shedding the blood of the people. They are all captive agents of foreign powers. Yet, given the perilous situation, it is of paramount importance that some middle way be designed that would be a principled step towards reaching a political solution. It is worth a try.

Vigneswaran-Champika Polarities and the Way Forward:

These two polarities serve to crystallize the divide in reaching a just solution. Hon. Vigneswaran stands for the right of self-determination of the Tamil nation, to be exercised internally, within a unified State, with some acceptable form and degree of devolution of power. Hon. Champika Ranawaka, along with the entire chauvinist camp, including the UNP, SLFP, JHU and JVP and others,  reject the right of self-determination, and stands for the unitary state, along with the acceptance of Sinhala-Buddhist supremacy and hegemony. He, like every other chauvinist force, plays to the fear of separatism created among the Sinhala masses. Champika and his ilk reject any demand for any form of devolution of power, and have a deep psycho-emotional echo among the Sinhala –Buddhist masses.  Is there a way out of this imbroglio?

Sharing Power at the Center: A Second Chamber?

So far, the discourse has been limited to the devolution of power to the periphery, while the Center shall remain the seat of exclusive majoritarian, Sinhala-Buddhist supremacist hegemony. This is a barren paradigm. I venture to suggest that the solution should be found in sharing state power at the Center, along with reasonable devolution that shall ensure equality, autonomy, security and democratic freedom to the minority nationalities. This would invoke a commitment to the State by all national minorities and serve to allay fears of separation. I suggest the formation of a Second Chamber to consist of eminent citizens who have won the trust of the people, including of the minority nationalities and religious communities. This Second Chamber shall be constitutionally empowered to review all legislation concerning the national-democratic rights of the nationalities and be able to submit any dispute to the Supreme Court. Sharing power at the Center would serve to establish equality and parity of status for all concerned and would be a step towards dismantling the prevailing chauvinist-hegemonic state and establishing a modern democratic State that would be made to honor the national-democratic aspirations of all nationalities. This is the only remaining path towards genuine national reconciliation and integration. We should strive to build a powerful popular consensus behind such a solution. The alternative is simply unthinkable.

TAMIL MOBS ATTACKING INNOCENT SINHALESE STUDENTS MUST BE BROUGHT TO ACCOUNT

Global Sri Lankans Forum, GSLF unreservedly condemns the attack on the Sinhalese students at the Jaffna University by the extremist Tamil students and Tamil thugs whose intents are purely racist based on the separatist political agenda.
The perpetrators have been exposed in photos and video footage, and we request the government to take immediate action to bring the unruly Tamil mobs to justice.

GSLF strongly believes that the criminal elements operating at the Jaffna University are mentored by the racist politicians actively promoting separatism, and considers this to be a blatant effort to spread disharmony among the communities living elsewhere throughout the island. We condemn this attack unreservedly.

We urge the:

  1. The Government of Sri Lanka to hold an impartial enquiry in to this matter and bring the perpetrators to justice without delay,
  2. The Jaffna centric Tamil politicians to investigate this criminal act advise all the students in the Jaffna University and other forces to maintain peace and harmony,
  3. Sinhalese living in the country not to get agitated by this dastardly actions of the separatist elements and hold the Government responsible for preventing such incidents,
  4. The Government should not relax security arrangements in Jaffna so that peace and harmony cannot be derailed by the racially motivated group,
  5. The Foreign Missions operating in Sri Lanka such as the US and Europeans parroting so called ‘reconciliation’ to condemn the attack on the Sinhalese students and demand justice.

Unless action is forthcoming, we have grave fears that the security situation in the country may deteriorate compromising the peaceful coexistence among all communities to create ethnic disorder to justify so called Tamil grievance in Sri Lanka.

ආර්ථික සංවර්ධන අමාත්‍යාංශය පිහිටුවීමේ පරමාර්ථය වුයේම දිලිදුකමේ සීමාවට පහළින් සිටින ජනතාව ඉන් මුදාගෙන පුද්ගලයා, පවුල, ගම , ප්‍රදේශය, පළාත ඇතුලු රටේ සමස්ත ආර්ථිකය ශක්තිමත් කිරීමයි.

ඒ සඳහා විවිධ අමාත්‍යාංශ, දෙපාර්තමේන්තු හා ආයතන සම්බන්ධීකරණය කිරීම එම අමාත්‍යාංශයේ කාර්යභාර්යය විය.

දිවිනැගුම පනනේ 6 ඕ වගන්තිය යටතේ යම් රජයේ දෙපාර්තමේන්තුවක්, සංස්ථාවක්, පළාත් පාලන ආයතනයක්, පෞද්ගලික අංශයේ සංවිධානයක් හෝ රාජ්‍ය නොවන සංවිධානයක් විසින් දිවිනැගුම ප්‍රතිලාභීන්ට සපයන සේවා සඳහා පහසුකම් සැලසීම” යන්න මඟින් අදාල නිළධාරින්ට මෙවැනි කටයුතු ඉටු කිරීමට අවශ්‍ය ව්‍යවස්ථාමය බලය ලබාදී ඇත.

ඔව්.ආර්ථික සංවර්ධන අමාත්‍යාංශය මෙන්ම වෙනත් අමාත්‍යාංශ මඟින්ද පළාත් පාලන ආයතන වලට විවිධ ප්‍රතිපාදන සපයා ඇත. උදා – ආපදා කළමනාකරණ අමාත්‍යාංශය මඟින් ජෙනරේටර්, ගලි බවුසර්, වතුර බවුසර්, පරිසර අමාත්‍යාංශය මඟින් ට්‍රැක්ටර්, කසල එකතු කරන හා ප්‍රතිචක්‍රීය කරන වාහන, සෞඛ්‍ය අමාත්‍යාංශය මඟින් සායන සඳහා බෙහෙත් වර්ග, ඩෙංගු මදුරු උවදුර මර්ධනය කරන උපකරණ හා රසායනික බෙහෙත් වර්ග ලබා දීම දැක්විය හැකිය.

එහෙත් ඒ කිසිදු අමාත්‍යාංශයකට එරෙහිව පැමිණිල්ලක් තබා චෝදනාවක් එල්ල කර නැත.

(03) වෙනත් අමාත්‍යාංශ පළාත් පාලන ආයතන වලට බට ලබා දී ඇද්ද ?

ඔව්. මෙම වකවානුවේදීම පළාත් පාලන අමාත්‍යාංශය මඟින් බට ලබාදී
ඇත. එහි ලේකම්වරයා පසුව මෙම අමාත්‍යාංශයේ ලේකම්වරයා බවට පත්විය. නමුත් ඒ සම්බන්ධයෙන් එම අමාත්‍යාංශයට ඇමතිවරයාට හෝ ලේකම්වරයාට නඩු පවරා නැත.

(04) එසේනම් බැසිල් රාජපක්ෂ මහතාට මැතිවරණ සමයේදී GI බට බෙදාදීම මඟින් රාජ්‍ය දේපොළ අවභාවිතය සහ මුදල් විශුද්ධිකරණ පනත යටතේ චෝදනා කර ඇත්තේ ඇයි ?

දේශපාලන පළිගැනීම බව ඉතාමත්ම පැහැදිලිය.

මේ සම්බන්ධයෙන් FCDI විසින් 2015.05.14 දින උසාවියට ගොනුකර ඇති B වාර්තාවට අනුව මෙම බට ලබාදීම සිදුකර ඇත්තේ 2014.10.31 දිනය. එනම් මැතිවරණයට පෙරය. එම නිසා මෙය මැතිවරණ නීතියට කිසිදු අදාලත්වයක් නොමැත.

එම B වාර්තාවට අනුව මෙම බට මිළදී ගැනීම සම්බන්ධයෙන් අමාත්‍යාංශ නිළධාරින් ප්‍රසම්පාදන ක්‍රියාවළියට අනුව කටයුතු කර ඇති බවත් පිළිගෙන ඇත.

මෙම බට කිසිදු පුද්ගලයෙකුගේ පරිහරණය සඳහා ලබා දී නැති අතර අමාත්‍යාංශය විසින් වෙනත් රාජ්‍ය ආයතනයකට ලබා දී ඇති ද්‍රව්‍යමය පහසුකමකි. එබැවින් එය අමාත්‍යාංශයකට ඇති ව්‍යවස්ථාමය බලයක් නිසා මෙම බට ලබාදීමේ කිසිදු නීති විරෝධි බවක් හෝ රාජ්‍ය දේපල අවභාවිතයක් නොමැත.

(05). මේ සඳහා දිවිනැගුම අරමුදල් යොදාගත් බව සත්‍යයක්ද ?

මෙම බට මිළදිගෑනීම සඳහා මුදල් ගෙවා ඇත්තේ දිවිනැගුම අරමුදල් වලින් නොව රාජ්‍ය අයවැයෙන් අනුමත අමාත්‍යාංශයට වෙන්කර තිබු මුදල් වලින් නිසා දුප්පත් ජනතාවට අයත් දිවිනැගුම අරමුදල් අවභාවිත කළාය යන්න සම්පුර්ණයෙන්ම අසත්‍ය ප්‍රචාරණයකී.

බැසිල් රාජපක්ෂ මහතාට එරෙහිව නඟා ඇති චෝදනාව අසත්‍යබව වර්තමාන සමාජ සවිබල ගැන්වීමේ ඇමති එස්.බී. දිසානායක මැතිතුමා පා.ම. නලින්ද ජයතිස්ස මහතා විසින් අසනු ලබන ප්‍රශ්ණයකට පිළිතුරු වශයෙන් පාර්ලිමේන්තුවේදී කර ඇත.

” මෙම බට බෙදාදීම කර ඇත්තේ දිවි නැගුම පනතේ පරමාර්ථ හා අරමුණු පුළුල් අර්ථයෙන් ගත්කල දිවි නැගුම ප්‍රතිලාභින්, දිවි නැගුම ප්‍රජාමුල සංවිධාන, දිවි නැගුම ප්‍රතිලාභි සාමාජිකත්වය දරන ගම් මට්ටමේ ක්‍රියාත්මක වෙනත් ප්‍රජා සංවිධාන සමග සම්බන්ධීකරණයෙන් ජනතාවගේ සමාජ ආර්ථික තත්වය නංවාලීම අරමුණු කර ඇත.

පළාත් පාලන ආයතන විසින් තම බල ප්‍රදේශයේ ප්‍රජා සංවිධාන හා ජනතාවගේ පොදු සමාජ අවශ්‍යතාවයන්ට යොදා ගැනිම පිණිස GI බට ලබාදෙන ලෙස එවකට විෂයභාර අමාත්‍යවරයා වෙත කර තිබු ඉල්ලීම සැලකිල්ලට ගෙන පළාත් පාලන ආයතන සඳහා GI බට ලබාදී ඇත. එම GI බට දිවිනැගුම ප්‍රතිලාභින් සම්බන්ධව වන උත්සවවලට කොඩි කණු වශයෙන් යොදා ගැනීමට අමතරව මරණාධාර සමිති වැනි ප්‍රජා සංවිධානවල තාවකාලික කුඩාරම් සකස් කිරීම, අවුරුදු පොළ, ග්‍රාමිය හා ප්‍රාදේශීය මට්ටමේ අලෙවි ප්‍රදර්ශන හා වැඩසටහන් පැවැත්විමේදී දිවි නැගුම ප්‍රතිලාභීන්ගේ භාණ්ඩ අලෙවි පොළවල් වල තාවකාලික අලෙවි මඩු ඉදිකිරීම ආදීය සඳහා භාවිතා කෙරේ”.

(05). මේ මඟින් මැතිවරණ වාසියක් ලබාගැනීමට උත්සාහ කල බව සත්‍යයද ?

නැත. ඒ බව වර්තමාන ඇමතිවරයාගේ පිළිතුරෙන්ම පැහැදිලි වෙයි.

පළාත් පාලන ආයතනවලට ලබාදුන් මෙම GI බට අදත් අවමංගල්‍යාධාර සමිති, විහාරස්ථාන ඇතුළු ආගමික සිද්ධස්ථානවල කටයුතු ආදී වශයෙන් පොදු අවශ්‍යතා සදහා භාවිතා කරයි.

(06). එසේනම් බැසිල් රාජපක්ෂ මහතාට චෝදනා කරන්නේ ඇයි ?

අතිගරු ජනාධිපති මහින්ද රාජපක්ෂ මැතිතුමා මහින්ද චින්තන වැඩපිළිවෙල යටතේ දැවැන්ත සංවර්ධන ක්‍රියාමාර්ග වලට ජනතාව අතිශයින් ප්‍රියවීම වැලැක්වීම සහා ඒවා කෙරෙහි අප්‍රසාදයක් ජනතාව තුල ඇතිකොට පටු දේශපාලන වාසියක් ලබාගැනීමට

වර්තමාන ආණ්ඩුවට කිසිදු ආර්ථික සංවර්ධන කටයුත්තක් සිදු කිරිමට ඇති නොහැකියාව වසා ගැනීම සදහා ආර්ථික සංවර්ධනය යනු ගසාකැමේ ව්‍යාපෘතියක් බව ජනතාවට ඒත්තු ගැන්වීම.

මහින්ද රාජපක්ෂ රජය බටහිරට කීකරු නොවීම නිසා කිසිදු රාජපක්ෂවරයෙකුට නැවත දේශපාලනය කිරීමට නොහැකිවන ලෙස කටයුතු කරන ලෙස පවතින බටහිරට කීකරු දුර්වල ආණ්ඩුවට එම රටවලින් ලැබි ඇති උපදෙස් ක්‍රියාවට නැංවීම.

එම රටවලම උපදෙස් මතම ත්‍රස්තවාදය පරාජය කිරීම ගැන වියරු වැටි සිටින කොටි හිතවාදී ද්‍රවිඩ ඩයස් පෝරාව හා ඔවුන්ගේ මතය රට තුළ පතුරන ව්‍යාජ සිවිල් සංවිධාන වල සාමාජිකයින් සතුටට පත් කිරීම සදහා ආණ්ඩුවේ ඇතැම් පිරිස් වලට අවශ්‍ය වී තිබීම.

ආර්ථික සංවර්ධන ඇමතිවරයා ලෙස බැසිල් රාජපක්ෂ මහතා විසින් කරඇති සේවාවන් පිළිබද ජනතාව තුළ අප්‍රාසදයක් ඇති කිරීම.

සිද්ධිය සිදුවු අකාරය පිළිබඳව රට ගැන හිතන ජනතාවටනම් යලි යලිත් කියාදිය යුතු නැත.නමුත් මහ ජාතිය හැටියට සිංහලයා ගුටි කමින් හිස පහත් කරමින් සිටිම අන්තවාදිය ලෙස සලකන මහත්වරුන්ට යමක් මා කිව යුතුමය.ඒ අන් කිසිවක් නොව යාපනය විශ්වවිද්‍යාල භුමිය පමණක් නොව යාපනයේ හෝටලයක සිට ඔනෑම කඩ සාප්පුවකට ගොඩ වි බලන්න ඔහුන් අපට දැන් කිසිදු ගරුසරුවක් නොමැතිව කතා කරන හැටි. ඒවා ගැන මොනතරම් සංහිඳියාවෙන් පොට්ට වු වන්ට කිවත් වැඩක් නැත අපි ඔහුන්ට මේ කතාව කියවන්නටද ආරාධනා නොකරමු…

යාපනය විශ්ව විද්‍යාලයේ විද්‍යාපිඨ සිංහල සිසුන්ට පසුගියදා එල්ල වු ප්‍රහාරය දකුණේ කුණු කන මාධ්‍ය මෙන්ම ශිෂ්‍යයන් වෙනුවෙන් පෙනීසිටින බවට වහසිබස් දොඩන ඇතැම් දේශපාලන රූකඩ ශිෂ්‍ය සංවිධාන අර්ථ දක්වනු ලැබුවේ ශිෂ්‍ය කණ්ඩායම් දෙකක් අතර ඇතිවු ගැටුමක් ලෙසය.ඇතැම් ආණ්ඩු ගැති දේශපාලන පක්ෂ සදහන් කළේ පිටතින් පැමිණි වෙනත් කණ්ඩායමක් මෙම පහරදිම සිදු කල බවයි.වෙබ් අධවි කිහිපයක් සහ සමාජ් ජාලා වෙබ් හරහා පමණක් දමිළ සිසුන් සිංහල සිසුන්ට පහරදුන් බව සදහන් කර තිබු අතර දමිළ කොටි හිතවාදි වෙබ් අඩවි පමණක් නොව යාපනයේ පුවත් පත් පවා සිංහල සිසුන් දමිළ සිසුන්ට පහරදුන් බවට පුවත් පලකර තිබු අතර ඒ හරහා ඔහුන් ඔහුන් විසින් කල පහරදිම සාධාරණීකරණය කර ගද්දී නිවට නියාලු යහපාලන මාධ්‍ය හා පොලිසිය එයට ඉඩ දි බලා සිටිය බව අමතුවෙන් කිවයුතු නැත.

විද්‍යාපීඨ සිංහල ශිෂ්‍ය සංගමය විසින් සංවිධානය කර තිබුණු මෙම පිළිගැනිම සදහා උඩරට වෙස් නැටුම් කණ්ඩායමක් සහභාගී කරවාගත් අතර දමිළ සිසුන් අඩෝ..ඔබලා කොහොමද එහෙම එවා මෙහේ කරන්නේ ” යනුවෙන් එයට විරෝධය පළකරමින් කෑ කෝ ගසමින් අනතුරුව එම ස්ථානයට කඩා වැදුණු කාලා පීඨ දෙමළ සිසුන් විසින් විශ්ව විද්‍යාල ආචාර්ය්‍යවරුන් බලා සිටියදීම පහරදීම සිදුකර තිබෙන අතර වීදුරු කඩා බිද දමමින් විශ්ව විද්‍යාල ගොඩනැගිවලටද හානිකරනු ලැබුවා.

පසුගිය 17 දා යාපනය සරසවියේ විද්‍යා පීටයේ සිසුන් අතර ඇතිවූ ගැටුම හේතුවෙන් සිසු සිසුවියන් 10 දෙනෙකු තුවාල ලබා රෝහල් ප්‍රතිකාර ලැබූ අතර ඉන් එක් සිසුවකු බරපතල තත්ත්වයෙන් කොළඹ ජාතික රෝහලේ ප්‍රතිකාර ලබනවා.

යහපාලන ජෙම්ස් බොන්ඩ් පන්නයේ පොලිස්පති පොලිස්පති පූජිත් ජයසුන්දර මහතාගෙන් මා හට ඇසිමට ප්‍රශ්ණ කිහිපයක් ඇත….

හීනෙකින්වත් හිතපු නැති සමහර අය රටේ පවත්නා නීතියට අනුව පරීක්ෂණවලින් පසුව අධිකරණයට ඉදිරිපත් කිරිමට කටයුතු කරන බවට පොලිස්පතිවරයා ලෙස ඔබ කල ප්‍රකාශය පුස්සක් නොවේ නම් වහාම අදාළ පාර්ශවයෙන් අත් අඩංගුවට ගෙන පෙන්වන ලෙස මා ඔබට අභියෝග කර සිටිමු.

ලංකාව පුරා විසිරි ඇති සෑම විශ්වවිද්‍යාලයකම දමිළ සිසුන් අධ්‍යාපණය හදාරන බව ඔබ හොදින්ම දනී යම් දකුණේ පෞද්ගලික විශ්වවිද්‍යාල තහනම් කරන ලෙසට බොරු උද්ඝෝෂණ කරමින් නවක සිසුන් සිය ග්‍රහණයට ගෙන ඔහුන් සිය දේශපාලන න්‍යාය පත්‍රයට අනුව දුවන අයවලුන් බවට පත්කර ගැනිමට කටයුතු කරන ඇතැමුන් කටපුරා අප ජාතිවාදින් යැයි කියනු ඇත. අප ඔහුන්ට එක දෙයක් කියන්නට කැමතිය අනුන්ගේ සංහිදයාවේ ගුබ්බැයම් වල ලගිමින් ඔබ දමන සංදර්ශන තව වැඩි කාලයක් පෙන්විමට නොහැකි බව මතක තබා ගැනිම ඇගට ගුණය.

අපි නැවතත් යාපනය විශ්වවිද්‍යාල භුමියට පය තබනු ඇත.මන්ද එය අපේ අයිතියකි…..නමුත් අපි ආපසු හැරෙන්නේ නැති බව දකුණේ නටන පෙනය නැති නයි මෙන්ම උතුරේ නටා නන්දිකඩාල් කලපුවෙන් අවසන් ගමන් ගිය බල්ලන්ද දැන සිටිම නුවණට හුරුය.

US Militarization of Sri Lanka : Sri Lankans to provide Canteen Services

There are over 1000 foreign US military bases and installations. The 4 losers of World War 2 host the biggest bases located in Germany, Italy, Japan and Korea. The newest strategy is to set up smaller detachments across the nations where US geopolitics pivots to. It is as a result of such bases in Diego Garcia, Saudi Arabia, Turkey and other Gulf states that the US was able to militarily intervene in targeted nations and thereafter set up bases in them. The recent announcement of US State Dept awarding a USD155m contract raises many questions that draw serious ramifications internally for Sri Lankan society and externally for the rest of Asia given the destructive nature of US military.

The Daily FT http://www.ft.lk/article/554084/US-to-construct-a—155-m-embassy-complex-in-Sri-Lanka has reported the construction of a USD155m contract awarded by the US State Dept to Caddell Construction Co to be built in 2 years in a 6 acre area (possibly joining the present US embassy with the former British high commission located right in front of Temple Trees) How is it that Sri Lanka came to know of this very important news only after the US State Department awarded the contract to a fellow US construction company?

Why has the GOSL kept this secret from the general public? Why is there no Parliamentary debate on this? Given that there is no Opposition, what has the Joint Opposition to say about this and why are they keeping mum too? Should such an important decision not be shared with the public and public opinion sought on the matter BEFORE agreeing with the US?

All of the US bases have a history of problems. These bases serve to proliferate weapons, they undermine both international stability and have resulted in increase in internal violence of some sort or the other. The bases have created social problems – rise in rapes by US military personnel, increase in prostitution with female sex industry thriving (high end and poor), increase in drugs, violent crimes by foreign soldiers, a country losing value of prime land in and around the complex, issues of pollution and health hazard caused by testing non-conventional weapons inside the compound.

The most shocking part is that NONE of these crimes committed by US personnel can be charged for criminal offence as the US military are granted immunity under SOFA or status of forces agreement which defines the legal status of US personnel and property in territory of another country covering the criminal, civil jurisdiction, carrying of arms, tax and customs relief, damage claims for US by the host government. The general understanding is that it is in the interest of the host country that the US base is set up. However the agreement provides the US and not the host government a host of rights. US forces are not accountable for anything in a host country. In 1998, host governments processed 5092 cases against US personnel under SOFA.

30% of Okinawa Island in Japan is occupied by US military since World War 2. Locals have been protesting since and the US response was to build another base in 2004 which was luckily stopped due to environmental concerns being raised. In Puerto Rico 2/3 of the island is occupied by US, inhabitants were expelled from their homes to facilitate US bomb testing. We know too well how the Chagossians were virtually carried from the homes and evicted by the civilized British to set up a base for US in Diego Garcia. These people were dumped in Mauritius and even after winning a court order the British Government used Executive Orders and ignored it.

So if a Sri Lankan is raped, killed, molested, kidnapped etc the victims will have no justice whatsoever. If anyone is in doubt they can ask the 65,000 Okinawans from Japan who protested demanding the removal of US military from their Island. It is good to note that despite the people of Japan demanding its government to close the US base, Japan cannot because of the agreement in place. Therefore, if any base has been allowed, Sri Lanka will NEVER be able to remove it.

The US also has more than100 bases in Korea and here too US military are not accountable for any crimes they commit. In 2002, two teenage girls on their way to a birthday party were run over by a US tank – the driver was repatriated where a US military court found him ‘not guilty’. In 2006, 2600 car accidents were reported in Korea involving US servicemen. Koreans could not claim damages. Korean Insurance companies refused to cover damages too.

The Netherlands hosts 7 US bases one which has nuclear warheads. Two bases monitor and intercept drug-transport on the Caribbean Sea and another serves as reconnaissance flights over Colombia making the Netherlands indirectly involved in the Colombian conflict. The bases allow US to bring arms and materials to the country without reporting to Dutch customs!

But then the CIA is famed for smuggling drugs! The present Pakistan-India-Sri Lanka and East Asia is a narcotics hotbed!

All of US bases are platforms for military manoeuvres – aerial bombings on Pakistan are launched from Diego Garcia, the base in Ecuador is used for covert military actions on Colombia, the bases in Iraq and Turkey have served as intelligence centres against Iran and Syria. Bases have also been used for extra-judicial transport, imprisonment and torture of people. Guantanamo Bay is the perfect example while there are numerous other secret centres across Middle East and Europe. Some bases are even used to test nuclear arsenal, while others are for intelligence operations such as the world-wide network of ‘Echelon” bases that monitor all email, phone, data communications traffic.

These bases serve to overthrow governments – of the over 300 overseas military interventions & invasions by US were possible because of the US military facilities in various nations.

US & NATO has managed to surround Iran by occupying Iraq & Afghanistan and placing bases in 8 neighbors of Iran with 3 US-backed nuclear powers in Israel, India and Pakistan and Turkey deploys US nuclear warheads. Iran has every right to protect its nation and its sovereignty. What nation wants to be attacked this way?

Does Sri Lanka want to be an enemy to our friends in Asia? These bases will certainly be used against Russia, China, Iran and even India (though India foolishly thinks itself to be a proud partner of the West – non-whites are never ‘partners’ but kept to serve the interests only)

Do we in Sri Lanka boasting of being a non-violent and non-aligned nation wish to encourage such SADISM by a country whose hobby is bulldozing nations and blowing them to pieces?

This is not a game of Cowboys and Indians!

These are all early warnings for Sri Lanka.

These bases host not only US military but US citizens – soldiers, civilians, and others that include their families. Why are so many 7 star hotels emerging in Sri Lanka, we do not have people to afford such luxury. These hotels are meant for the families and the top brass and other very senior officers who will be regularly flying in from all parts of the world.

The new US base is said to have a US marine residence and a warehouse among other sophisticated items. Why would an embassy need a Marine Residence? And a warehouse to store what? These are dead giveaway for the ultimate creation of a US military base pretending it to be a US embassy complex. The momentum obviously came when in November 2015 Daya Gamage reported that when Samantha Power visited Sri Lanka, she envisaged ‘enhanced military relations’ which is beyond the sale of military equipment and training (it was not given when we needed it and now we don’t need it as the conflict is over)

When scores of foreign military set up virtual residence in Sri Lanka, the GOSL will say these are opportunities for our people. What are the opportunities…we will have to send our women as prostitutes oh yes and they can make money selling their bodies, we will have men and women serving as stewards and waitresses, do parents spend so much on education for their children to be servants in our own country! But then there will be plenty of cocktail circles where the local lackeys will squirm in front of their superiors boasting of hobnobbing with them. What else are we likely to get out of this can anybody please elucidate!!!

In the end we would have become distanced from our historical friends choosing to become their indirect enemy and when we are ever in need of help we would have no one to come to our aid. Irony is that even those that helped the US to get their prize catch would also end up getting the boot one fine day as Saddam, Suharto, Ngo Diem, Pinochet & Osama found out too late.

Why would Sri Lanka knowingly want to suffer the same hassles that nations with US bases are going through?

අනගාරික ධර්මසේකර උපුටා ගැන්ම දිවයින

ශ්‍රී දළදා පෙරහැර අනුව යමින් රට පුරා නොයෙක්‌ ප්‍රදේශවල පැවැත්වෙන සම්ප්‍රදායික බෞද්ධ පෙරහැරවල ගෙන යන අලි ඇතුන්ගේ පාදවලට යදම් යොදා තිබීම ගැන ඉමහත් වේදනාවෙන් මෙන් කතා කරන සත්ව අහිංසාවාදීන් යෑයි කියාගන්නා අය අශ්වයන්ට කටකලියා දමා අශ්ව කුරවලට ලාඩම් ගසා අසුන් පිට යන අසරුවන්ගේ පාවහන්වලට සවි කළ සන්කුට වලින් කරන රිදවීම් ගැන කථා නොකරන්නේ ඇයි? සැබෑ අහිංසාවාදීන් අලියා, ඇතින්න හෝ ඔටුවා, ගවයා කියා වෙනසක්‌ දකින්නේ නැත. පිරිසිදු අහිංසාවාදීන් වන්නවුන් මස්‌ මාළු ආහාරයට ගැනීමෙන් පවා වැලකිය යුතුය.

මිනිසුන් වූ අපට විවිධ රෝග බෝකරන මදුරුවනුත් අපට කිසිම ලෙඩක්‌ බෝ නොකරන කුහුඹුවනුත් අතර මවුපියන් වශයෙන් ඇත්තේ සුවිශාල වෙනසකි. වතු=ර රැස්‌වන තැන්වල බිත්තර දමන මදුරුවෝ බිත්තර ගැනවත් මදුරු කීටයන් ගැනවත් සොයා බලන්නේ නැත. එහෙත් පැටවුන්ට කවා පොවා පෝෂණය කරන කුහුඹුවෝ විපත් අවස්‌ථාවල අලුත උපන් පැටවුන් හා බිත්තර කරගසාගෙන යන්නේ මිනිස්‌ දෙමවුපියන් තම දරුවන් වඩාගෙන යනවාටත් වඩා වෙහෙස විඳ දරා ගනිමිනි. කුඩාම සතුන් වූ කුහුඹුවන්ගේ ජීවන චර්යාවන් කෙරේ ද සංවේදීව හැඟීම් සහගතව සානුකම්පිතව කටයුතු කරන මම කුඩාම කුහුඹුවට පවා විපතක්‌ නොවන සේ කටයුතු කරන්නට ප්‍රවේශම් සහගත වෙමි. එසේවූ මා පෙරහැරේ ගෙනයන අලි ඇතුන්ගේ පාද වලට යදම් යෙදමීම අනුමත නොකරතත් මම එහිදී අපේ ඓතිහාසික සංස්‌කෘතික සම්ප්‍රදායක්‌වූ පෙරහැරේ අලි ඇතුන් ගෙනයාම ගැන විරුද්ධ නොවෙමි. කළ යුත්තේ, පෙරහැරට එක්‌වන කලාකරුවන්ගේත් පෙරහැර නරඹන ලක්‍ෂ සංඛ්‍යාත ජනතාවගේත් පෙරහැර සඳහා යොදාගන්නා අලි ඇතුන්ගේත් ආරක්‍ෂාවට හා යහපතට හේතුවන අයුරින් කටයුතු සැලසුම් කිරීමයි.

මහනුවර දළදා පෙරහැරේ නැතත් රට පුරා නොයෙක්‌ පෙදෙස්‌වල කෙරෙන පෙරහැර බලන්නට එක්‌රැස්‌වන ලක්‍ෂ සංඛ්‍යාත ජනතාව අතර වන ඇතැම් පිරිස්‌ පෙරහැරේ යන අලි ඇතුන්ට කෙසෙල්, කොමඩු ආදී පලතුරු දෙති. උත්සවවලට අශ්වයින් ගෙන යන නිලධාරීන් අශ්වයින්ට කටකලියා දමා ඇතත් පෙරහැරේ ගෙන යන අලි ඇතුන්ගේ මුවට හෝ හොඬට කිසිදු බාධකයක්‌ යොදා නැති බැවින් ඒ දැවැන්තයෝ හොඬ දික්‌කර පලතුරු ගෙන මුවෙහි දමා රස විඳිමින් යති. පෙරහැරේ ගෙනයන අලි පැටව් තමන්ට ඉදිරියෙන් යන නැට්‌ටුවන්ගේ නැටුම් බලමින් බෙර තාලයට පාද තබා නටමින් යන බවද පෙරහැර බලන බොහෝ දෙනෙකු දැක ඇති බවට සැකයක්‌ නැත. දිනපතාම පාහේ ගංගා, පොකුණු, විල් ආදියට ගෙන ගොස්‌ නාවනු ලබන අලි ඇතුන්ට දැන් අතීතයේ මෙන් ගල් පෙරළන්නට කඳන් අදින්නට සිදුනොවේ. මේවන විට අලි ඇතුන් යොදා ගැනෙන්නේ සංචාරක සමයේදී විදේශීය සංචාරකයන් පිටඋඩ තබාගෙන යැම වැනි සැහැල්ලු කටයුතු වලට වූවත් පෙරහැර නරඹන මිනිසුන්ට මෙන්ම පෙරහැරේ යන අලි ඇතුන්ටද ඓතිහාසික බෞද්ධ සංස්‌කෘතික සම්ප්‍රදායක්‌ වූ පෙරහැර පැවැත්වීමෙන් ලැබෙන්නේ සහනයකි, සතුටකි, ශාන්තියකි. ඊට හොඳම උදාහරණය නම් දළදා මාලිගාවේ කරඬුව වැඩමවන ඇතුන්ගෙන් වැඩිදෙනකු ඉතා හොඳින් දිගු කලක්‌ ජීවත් වීමයි. වනයේ ජීවත්වන කිසිම ඇතෙකුට නොලැබෙන තරම් සත්කාර හා සාත්තු සප්පායම් මාළිගාවේ රාජාට ලැබී ඇති බව රහසක්‌ නොවේ.

අලි ඇතුන් පෙරහැරේ ගෙනයාමත් අශ්වයින් අධිරාජ්‍යවාදී හා ධනවාදී උත්සව අලංකාර කිරීම හා රේස්‌ සඳහා යොදා ගැනීමත් අතර බොහෝ වෙනස්‌කම් තිබේ. ඇත අතීතයේ පටන් ආසියා රටවල් බොහොමක ජනතාව වැව් අමුණු බැඳීමේදීත් ලොකු ගොඩනැඟිලිවල අත්තිවාරම් සැකසීමේදීත් බරගල් කුට්‌ටි ගෙනයාම ආදී බරවැඩ සඳහා අලි ඇත්තු යොදාගත් බවද සත්‍යයකි. ලංකාවේද මහවැව් තැනීමේදීත් දාගැබ්වල අත්තිවාරම් සැකසීමේදීත් අලි ඇතුන් යොදාගත් බව ඉතිහාසගත වී තිබේ. අත්තිවාරම්වලට ගල්කුට්‌ටි දමා ගල් කුට්‌ටි අතරට කැටගල් හා බොරළු දමා සියුම් වෙඬරු මැටි යොදා තද කිරීම සඳහා අතීතයේ යොදාගත් ක්‍රමය වූයේ වඩා ලොකු බර ශරීර ඇති ඇතුන් යොදා ගැනීමයි. ගල්කුට්‌ටි හා ගල්කැට දමා පාගා තද කිරීමේදී ඒ සඳහා යොදා ගන්නා අලි ඇතුන්ගේ පාදවලට හානි නොවන සේ ඇත් පතුල් පාද සුරක්‍ෂිත වන සේ මීහරක්‌ හම් තට්‌ටු කීපයක්‌ බැඳ අලි ඇතුන්ගේ පාද අදාළ කාර්යයට උචිත සකස්‌ කළ ආකාරය මහාවංශ, ථූපවංශ ආදී ඓතිහාසික මූලාශ්‍ර ග්‍රන්ථවල සඳහන් වේ. එසේ වූවත් අශ්වයින් බිම පෙරලගෙන කකුල් බැඳ අශ්ව කුරුවලට ලාඩම් ගසන්නාක්‌ මෙන් අලි ඇතුන්ට ලාඩම් නොගසන බව ශ්‍රී ලංකාවේ පාසල් සිසුන් පවා දන්නා බවට සැකයක්‌ නැත. තම සේවයට යොදා ගන්නා අලි අතුන් ආරක්‍ෂා කිරීම සඳහා ඒ සඳහා වූ පරම්පරාගත වෛද්‍යවරුන්ගේද සේවය ලබාගන්නා බව නොදන්නා ලක්‌වැසියෙක්‌ නැත. එසේ වූවත් යුරෝපා රටවල රේස්‌ සඳහා යොදාගන්නා අශ්වයකුට අනතුරක්‌වී පාදයක්‌ බිඳුනොත් ලැබෙන ප්‍රතිකාරය වන්නේ වෙඩිතබා මරා දැමීමයි. යන්ත්‍ර සූත්‍ර බහුල වර්තමානයේ වැව් කණ්‌ඩි සැකසීම සඳහා හෝ දාගැබ්වල අත්තිවාරම් සැකසීම සඳහා හෝ අලි ඇතුන් යොදා ගන්නේ නැත. කෙසේ වූවත් අතීතයේ මින්නේරිය, කලාවැව, කවුඩුළුවැව, මහකනදරාව, පදවිවැව, කන්තලේ වැව හා පරාක්‍රම සමුද්‍රය වැනි ලෝකප්‍රකට මහවැව් තැනීම සඳහා අලි ඇතුන්ගේ ශක්‌තියද යොදාගැනීම වසර දහස්‌ ගණක්‌ තිස්‌සේ කෝටි සංඛ්‍යාත මිනිසුන්ටත්, ගවයින්ටත්, මුව ගෝන ආදීන්ටත් සිය දහස්‌ ගණනන් අලි ඇතුන්ටත් යහපතක්‌ වූ බව නොපිළිගන්නේ බටහිර අනුකාරක ඊනියා සත්ව අහිංසාවාදීන් පමණි.

අප මේ ලිපියෙන් ඉදිරිපත් කරන්නේ ලංකාවේ බෞද්ධ සංස්‌කෘතික පෙරහැරවල් සඳහා යොදාගන්නා අලි ඇත් සතුන්ට වන අමාරුකම් ගැන සිත් වේදනාවෙන් මෙන් කථා කරන බටහිර අනුකාරක මාංශ භක්‍ෂක අහිංසාවාදීන් අශ්වයින්ට අනුකම්පා නොකරන්නේ ලැබුණොත් අශ්ව මස්‌ වූවද ආහාරයට ගන්නට ඔවුන් පසුබට නොවන නිසා විය යුතුය. කෙසේවූවත් අශ්වයින්ට හිංසා පීඩාගෙන දෙන්නේත් ඒ සතුන් උත්සව හා රේස්‌ සඳහා යොදාගන්නේත් යුරෝපයේ හා අමෙරිකාවේ පමණක්‌ නොවේ. අපේ අසල්වැසි රටවූ ඉන්දියාවේ පවා අශ්වයින්ට පීඩාගෙන දෙන අයුරින් කටයුතු කරන බව රහසක්‌ නොවේ. ඉන්දියාවට එන සංචාරකයන්ගේ ගමන් සඳහා අශ්ව කරත්ත යොදාගන්නේ එයින් අශ්වයින්ට දුක්‌පීඩා හෝ වේදනා ගෙන දෙන බව නොදැන නොවේ.

අරාබිකරයේ කාන්තාරවල මහා මාර්ග තනා ඇති වර්තමානයේ පවා ඔටුවන් භාණ්‌ඩ ප්‍රවාහනය සඳහාත් කාන්තාර පරිසරයන්හි ගමන් සඳහාත් යොදා ගැනේ. ඔටුවන් රේස්‌ සූදුව සඳහාද යොදාගන්නේ ඒ සතුන්ට කොතෙකුත් වේදනා ගෙන දෙමිනි. ට්‍රැක්‌ටර් බහුල වර්තමානයේ වගුරුබිම් ආශ්‍රිත මඩකුඹුරු මැඩවීම සඳහා මීගවයින් තුන්දෙනා බැගින් ඈදා යොදාගන්නේ කෙවිටි පහර එල්ල කරමිනි. කඳුකරයේ ලියදි ගොවිතැන් සීසෑම සඳහා එලගවයන් නගුලට බඳින්නේ කරත්තවලට යොදාගන්නේත් නාස්‌විද නාස්‌ ලණු දමා ගනිමිනි. කෙසේ වූවත් අමෙරිකානු රටවලත් යුරෝපයේත් තරුණ ගවයින් මසට දිනපතා මැරෙන්නේ ලක්‍ෂ ගණනකි. එහෙත් සත්කෝරලයේ ගමක කුඹුරු වැඩට යොදාගන්නා ගවයකු අකාලයේ මියගියහොත් ඒ අසරණ සතා වෙනුවෙන් පන්සලට දාන දී මියගිය ගවයාට පිං දෙන බව මේ ලියන මා හොඳින් දන්නේ එවැනි දානවලට භික්‍ෂූන් වහන්සේලා සමඟ මමද සහභාගිවී ඇති හෙයිනි. ගෙදර ඇති කළ එළදෙන අකාලයේ මියගිය විට හඬා වැටෙන ලක්‌වැසි ගැමියන් පෙරහැර බලන්නට එනවිට පෙරහැරේ යන අලිඇතුනට කෙසෙල් ඇවරියක්‌ හෝ කොමඩුගෙඩියක්‌ දෙන්නේ පයේලා ඇති යදම්වලට වන්දි ගෙවීමක්‌ ලෙස නොවේ. දවසට කෝටි දහයක්‌ පමණ කුකුළන්, තාරාවුන්, එළුවන්, ඌරන් මරණ මාංස භක්‍ෂක කෑදර ලොවක පෙරහැරේ පලතුරු කමින් බෙරතාලයට පා තබමින් නැටුම් බලමින් යන අලි ඇතුන්ගේ පාදවලට යොදා ඇති යදම් ගැන කතා කරන්නේ අලි කුලප්පුවක්‌ සිදුවී හෝ සිංහළේ මහා සංස්‌කෘතියේ සජීවී අංගයක්‌වූ නැටුම් කලාවේ හා වාදනයේ මහා සංදර්ශනයක්‌වූ පෙරහැර අවසන් වේ යයි ප්‍රාර්ථනා කරන බටහිර අනුකාරක ආධානග්‍රාහී ඊනියා අහිංසාවාදීන් පමණි.

Royal Asiatic Society Monthly Lecture on Two millennia of coins in Sri Lanka

The presentation is based on descriptions on coins found in the old manuscripts and rock inscriptions of Sri Lanka. An effort will be made to place these coins in a chronological order. The messages embedded in the symbols and the legend inscribed on the coins will be discussed. The instructions for craftsmen who manufactured the coins are found in the text Vajyatantra.  Over seventy five types of coins issued during the two millennia ending with the 15thcentury Kotte period will be shown.

Auditor General in govt.’s crosshairs

 The government keeps telling us it is for an independent public service. But, it like its predecessor, obviously, does not want public officials to be so independent as to stand up to it on crucial issues that threaten its political survival. It spares no effort either in taming intrepid bureaucrats who have the courage to resist political pressure and act according to their conscience or in denying them their due promotions or in smoking them out.

The government has already made a mockery of its ‘yahapalana’ slogan by filling the top notches of the Attorney General’s Department, the Central Bank and the Police with persons of its choice at the expense of the most eligible officials who were not malleable. The much-touted Constitutional Council has been reduced to a mere rubber stamp of the powers that be; it is packed with members bound by a common political agenda; most of them joined forces to engineer last year’s regime change. The 19th Amendment has become a farce with the ruling party politicians continuing to interfere in the police, the judiciary and the public service.

Now, Auditor General Gamini Wijesinghe is in the government’s crosshairs if the hostile campaign some ruling party politicians and their cyber hit men have launched against him is any indication. He has ruffled the feathers of the government bigwigs by issuing a damning report on the mega bond scams. He has done the public service proud.

The Joint Opposition (JO) claims the on-going campaign against the Auditor General commenced the day the JVP raised a question in Parliament, quoting figures from a report he had prepared. The JVP demanded to know if the government had drawn loans in excess of the amount sanctioned by Parliament. The JVP insists it was a curve ball but its opponents argue it was a full toss and the government danced down the track and lofted it over the pavilion. The JO claims the  JVP helped the government potentates summon the Auditor General in a bid to intimidate him into submission before his report on the bond issue was released. The JVP has denied the allegation. Thankfully, the government’s despicable efforts came a cropper, but unfortunately the courageous official became a marked target.

It is imperative that the Auditor General withstand political pressure and remain in his post until the parliamentary probe into the bond scams is over. Else, a stooge will be appointed as his successor and the crooks responsible for the fraud will go scot free. That seems to be the battle plan of those who want to oust the intrepid official.

Strangely, most of the civil society activists who are making a public display of their commitment to good governance have not taken up the cudgels for the beleaguered Auditor General.

When the Rajapaksa government, intoxicated with power and blinded by hubris, targeted the then Chief Justice Dr. Shirani Bandaranayake, who did not succumb to political pressure as regards what became known as the Divineguma case many were the defenders of democracy who leapt to her defence— and rightly so. Why are they silent today?

Meanwhile, the Auditor General’s Department employees are protesting against a protracted delay in ratifying the National Audit Bill (NAB) and not-so-surreptitious government moves to do away with 20 out of 57 sections thereof to reduce the powers of the Auditor General. The Rajapaksa government blocked the presentation of the NAB to Parliament for ten long years and the incumbent administration which promised good governance is also sitting on it unashamedly.

Numerous professional organisations and civil society outfits which take to the streets at the drop of a hat ought to pledge solidarity with the Auditor General and campaign for the ratification of the National Audit Bill sans the amendments aimed at diluting it. That is the only we they can prove that they are not a bunch of hypocrites.

මුහුදේ මාළු ඇඟේ නැටීම (උතුරු මුහුදු සීමාව කොල්ලකන ඉන්දීය ධීවරයන්)

කතුවැකිය උපුටා ගැන්ම දිවයින

ව්‍යාපාරිකයන්ට කරදරය, වී ගොවියාට – එළවළු වෙළෙන්දාට කරදරය, ධීවරයාට කරදරය. ඒ සියලු දෙනාටම අර්බුද මතුවන විට රටේ ජනතාවට කරදරය. ඒවාට විසඳුම් ලබාදිය යුතු ජනතාව විසින්ම පත්කරනු ලැබූ ජනතා නියෝජිතයාට කිසිදු කරදරයක්‌ නැත. මේ ප්‍රශ්න ගැන වගේ වගක්‌ නැත. අර්බුදයක්‌ පැන නැගුණු විට යන්තම් එතැනට කරපොවා මුහුණත් තහඩුව පත්තරවල, රූපවාහිනී නාලිකාවල ප්‍රචාරය කරවා ගැනීම හැර ඒ කිසිවකුටත් ඊට හරි විසඳුමක්‌ ලබාදීමේ වුවමනාවක්‌ නැත. එවැනි විසඳුම් නැති සමහර ප්‍රශ්න දශක දෙක, තුන පැරැණිය. එන යන හැම ආණ්‌ඩුවක්‌ම ඒවා තොරොම්බල් කරනවා විනා විසඳුම් දීමට හිතන්නේවත් නැති බව පෙනේ. අදාළ කතාව කියන්නට එතරම් දිගු පූර්විකාවක්‌ ලිවිය යුතුමය. අදාළ කතාව උතුරු පළාතේ ධීවර ප්‍රශ්නයය. මාධ්‍ය මඟින් මෙය එතරම් “හයිලයිට්‌” නොකරන ප්‍රශ්නයක්‌ වුව එය තරමක්‌ බරපතළ ප්‍රශ්නයකි. මාළු ගිනි ගණන් වුව ආණ්‌ඩුවට බැණ වදිමින් ඒවා මිලදී ගෙන බුක්‌ති විඳිනවා විනා මේ ප්‍රශ්නය ගැන රටේ ජනතාවට තේරෙන්නේද නැත. පසුගිය සතියේද උතුරු පළාත් ධීවරයෝ තම ධීවර අයිතිය ආරක්‌ෂා කර දෙන මෙන් ඉල්ලමින් උද්ඝෝෂණයක නිරත වූහ.

අප සඳහන් කළ පරිදිම මීට පෙර දක්‌වා ඇති පරිදිම, නීති විරෝධීව ලංකා මුහුදු තීරයට ඇතුළු වන (ශ්‍රී ලංකා මුහුදු සීමාව පනින) ඉන්දීය ධීවරයන් මෙරට මත්ස්‍ය සම්පත කොල්ලකාගෙන යැම බොහෝ “පරණ” ප්‍රශ්නයකි. මේ කොල්ලකෑම “µqල් ෙµaස්‌” හෙල්මට්‌ පැළඳ රන්බඩු සාප්පු කොල්ලකෑම තරම් පහසු නැත. එහෙත් ඉන්දීය ධීවරයන්ට එය එතරම්ම පහසු වැඩකි. කාගෙත් දැනගැනීමට එය ලිවිය යුතුය. ඒ මෙසේය.

ඉන්දීය ධීවරයන් මේ කැත කොල්ලකෑමට භාජන කරන්නේ පරිසර විනාශකාරී “බොටම් ට්‍රොaලර්” ක්‍රමයයි. මේ ක්‍රමයේ දී විශාල යකඩ තහඩු දෙකක්‌ දැල සමඟ මුහුදු පතුලට වැදී නැවත ඉහළට එසැවෙන්නේ මුහුදු පතුල සම්පූර්ණයෙන්ම සූරා ගනිමිනි. මේ සූරාගැනීමේ හානිය කොතරම්ද යත් මුහුද පත්ලේ ඇති ශාක, කොරල්පර, ඒ ආශ්‍රිතව ඇති මුහුදු මාළු බිත්තර, විවිධ මුහුදු ජීවීන් සියල්ල විනාශව යන බව කියති. නිවැරැදිව කීවොත් මේ සිදුවන්නේ මුහුදු පත්ල ඩෝසර් කිරීමකි. එවිට සිදුවන්නේ මාළු ටික පමණක්‌ නොව ඉන් එහාට මුහුදු ජීවීන් බෝවීමට ඉඩකඩ ඇති පරිසර සාධකද ඉන්දියාවේ තමිල්නාඩු උදරයට පුරවා ගැනීමය.

කාරණය පැහැදිලිය, උතුරේ ධීවරයාගේ උද්ඝෝෂණය සාධාරණය. ඒ උදවිය මේ සටන් කරන්නේ මාළු ටික පමණක්‌ නොව උතුරු මුහුදු සීමාවම ආරක්‌ෂා කරන්නටය. නැතිනම් තවත් ටික කාලයකින් අපට සිදුවන්නේ රට වටේටම මුහුද තිබුණද ගිනි ගණනට පිටරටින් මාළුද ආනයනය කරන්නටය. (දැනටද රට වටේ මුහුද තිබුණත් මාළු ගිනි ගණන් වීම වෙනමම කතාවකි.) මේවා ගැන හිතෙන විට මුහුදේ නැටිය යුතු මාළු ඇඟේ නටන එක අහන්නත් දෙයක්‌ නොවේ. ඉන්දියාවට බොහෝ දේ දෙන්නට පොරොන්දුව තිබියදී “ඔය මාළු ටිකක්‌ ගෙනිච්චට මක්‌ වෙනවාදැයි” මෙය සාධාරණීකරණය කර ඇඟ බේරාගන්නට හදන වගකිවයුත්තන්ගේ කටින් පිටවුණද එය පුදුම වන්නට කාරණයක්‌ නොවේ.

ජාතික භික්‍ෂු පෙරමුණ

ජුලි 16 දින යාපනය විශ්වවිද්‍යාලයේ නවක පිළිගැනීම් අවස්ථාවක විද්‍යාපීඨ සිසුන් අතර ඇතිවූ ගැටුම සිදු නොවිය යුතු එහෙත් සිදුවූ අවාසනාවන්ත සිදුවීමක් ලෙස හෙළා දකින්නෙමු.

කුමන හෝ සිදුවීමක් තම ජාතිවාදී දුෂ්ඨ වුවමණාවන් තෘත්පත කර ගැනීම සඳහා අවස්ථාවක් සොයමින් සිටින අයට මෙය කදිම පැණි වදයක් මෙන් වී ඇත. එහෙත් ජාතිවාදය පිටුදකින සැමගේ වෙර යොදා එම දුෂ්ඨ අරමුණු පැරදවිය යුතුය.

ශී‍්‍ර ලාංකික, සිංහල, දෙමළ, මුස්ලිම් අපි හැමෝම මදිය නොකියන තරම් ජාතිවාදයෙන් බැටකා ඇත්තෙමු. එනිසා තවත් කුමන හෝ ජාතිවාදී සිදුවීමක් අපහට අවශ්‍ය නැත. දැන් අපට අත්‍යාවශ්‍යම දේ නම් ජාතික සමගියයි. එය සිංහල සමාජයට විතරක් නොව දෙමළ, සමාජයටත් එකසේ වුවමණා බව අපගේ විශ්වාසයයි. එහිදී යාපනය විශ්වවද්‍යාලයට, එහි සිසුන්ට සුවිශාල කාර්්‍යභාරයක්, වගකිමක් පැවරී ඇත. එය ඉතා ගැඹුරින් ඔවුන් තේරුම් ගතයුතුය.

සමාජය තුළ සෑම ක්‍ෂේත‍්‍රයකම ගැටුම් පවතී. එය කුටුම්බ පවුලේ සිට ආගමික මධ්‍යස්ථාන දක්වා පැතිරී ඇත. එය සමාජ පරිහාණියේ දර්ශකයකි. මහා උත්තරීතරයැයි කියා ගන්නා පාර්ලිමේන්තුවේ ජනතා නායකයින් යැයි කියා ගන්නා අය ඇතිකරගන්නා ගැටුම් අප කොතෙකුත් දැක ඇත. එහෙත් එය ජාතිවදීව යොදා ගන්නේ නැත. එනමුත් යාපනය විශ්වවිද්‍යාල ගැටුම් අද වන විට පරාජිත ජාතිවාදී කොටස් ෆේස් බුක් මෙහෙයුම් කරමින් සුවිශේෂ ලෙස උලූප්පා හපකරමින් ඇත. එය පැරදවිය යුතුය.

මෙම සිදුවීම් රජය ඉතා ගැඹුරින් සැලකිල්ලට ගෙන රජයේ ජාතික සමගි වැඩපිළිවෙළ පිළිබඳව නැවත සිතා බැලීය යුතුබවද අපි අවධාරණය කරන්නෙමු

HOW TO DIG FOR NEWS -PART 2

Modern bookshops and news stands are inundated with a multitude of magazines of all kind with topics including general health, beauty, royalty, medicine, yoga, and international politics. Some of the most interesting and educational ideas are buried in small but less significant news reports and narrow classified advertisements, as they are less likely to have been exploited.
One may discover in a tiny advertisement inserted in a popular Sunday magazine which reads as follows, “An expert rodent catcher required on full time or part time basis. Excellent remuneration. Apply to box no.xyz…”)
Keeping eyes open!
This may interest an inquisitive journalist who is looking out for material to compose an informative feature article. First of all, he needs to ask himself several questions: “Does this suggest anything? Immediately his mind should go through a prompting process with a string of other questions: “Why does the advertising company require a rat-catcher? What is the purpose behind this unusual advertisement? Does the advertiser experiencing difficulty in finding a rat catcher? What has caused such an explosion of rodents suddenly? Is it due to a strike by council employees, and uncollected domestic garbage piled up on roads and scavengers tearing off rubbish bags giving free access to breeding mice to run about? Could I write a pen-picture of one of the rat catchers? Unusual occupation eh! Is there a plague of rats in the country and is it becoming a health hazard? When the journalist reads news reports it is always best to keep his eyes open for the unanswered theme question of why?

Second option
Consider a brief report published in a tabloid about a social welfare officer making a request from a Court of Law against a rapist of an under-aged orphaned girl.
It doesn’t matter whether the Court complies with the request or simply adjourns the matter. To the journalist, who is looking for ideas, such news can leave a lot of questions unanswered, and in return the answers to those questions might provide him with the raw material for a single article or a series of articles looking at various angles. “What is the legal position about such a matter? Is there an age limit concerning under age or any kind of rape? Has the law been changed in recent years? If so, what is the current legal position? How do other countries deal with such a situation? If the journalist is living in a foreign country, could he compare the law in such a situation within his own native land?”

Other sources
Other sources for journalists to read should be professional or trade publications, house journals, women’s magazines and religious magazines. In a Buddhist journal one may find something written, from time to time, that would be worth following through. Or, the Parish magazine might announce about the peal of bells in the church that needs replacing. How about the latest trend in the Council of Churches’s attempt to sell out ‘unwanted’ old church buildings to property developers, while the local councils placing prohibition orders on such sales of buildings especially not to be converted into Muslim mosques. This will put the church and its bells, as much as the councils and the property developers, in the news for a while. The journalist needs to find out whether it is worth an article for a magazine or a newspaper?
If one cannot afford to buy a lot of magazines and newspapers, a good selection of those are available in the reference sections of public libraries and branches of the British Councils where journalists could benefit as a source of ideas for articles. Journalism is akin to gold mining, and one needs a hard digging at times to get the nuggets out. Informative ‘mines’ are usually written in English especially when it comes to legal jargon, although such terminology is meant to be perfect, clear and concise.
When journalists read a book, newspapers or a magazine, it is important for one to keep his eyes wide open and be inquisitive. For instance, during reading he might suddenly sets his eyes on a female climbing up a long rope ladder fixed on to a tall office block. Unusual and rare the scene may be, but it gives the onlooker a shock at first but, according to a journalist’s vision, it is worthwhile following it up. No one will know what the journalist can come out with through such a stunning experience. That knowledge itself might suggest an article about women doing daring and unusual jobs like window cleaning on high-rise buildings.
The journalist’s world is fairly bursting with all kinds of information all the time. Reading can be a never-ending source to collect ideas. Already published articles in newspapers or magazines may prompt him an idea, which he can follow through, whenever a journalist runs out of new ideas.
Two basic ways
There are two basic ways of obtaining facts for a journalist on any subject. The first and the best would be to go straight to the horse’s mouth – the person directly concerned with. If the journalist wanted to follow through the idea mentioned earlier about the bells in the church, the best person to contact and discuss the matter would be the Parish Priest. If the priest is unable to supply him with all the information, then he might almost certainly be able to put the journalist on to the right individual who could help. It would be the best policy to call in person whenever is possible when seeking information for an article. The telephone call is a poor substitute for a face-to-face conversation, but it is only good as a prelude to make an appointment.
Another fact-finding source would be the printed word. A journalist should be knowledgeable enough as to how and where to find and use reference media of all kinds in microfiche films that are available in modern libraries and museums in developed countries. To track down some information he will need a subject-index which is unlikely to be out in the open on a shelf. The librarian holds this information and anyone can seek the librarian’s assistance on any such endeavour. Every journalist needs to be on friendly terms with librarians as most of the modern libraries are computerised with large databases of all the reference books and material they hold.
Today with the new technology the computer can be the journalist’s closest friend, from writing to digging out information on any subject. Any information could be obtained with the help of search engines some of which are Wikipedia, www.yahoo.com, www.altavista.com, www.google.com, www.sky.com www.bbc.com, www.cnn.com, and www.youtube.com along with almost all the newspapers in the world and websites that are linked to all communication streams.

Parallels for Sinhala Buddhists from Brexit & the British

 When the views of the majority populace of a country are ignored and they react after enduring with patience they cannot be ridiculed as being xenophobic & racist. Going against the established system manipulated and well controlled by a handful of people is not an easy task but 52% of the Brits showed the world that it was still possible. The Brexit vote shook the mental disposition of many who thought they could drive any liberal-theory home and people would buy in blindfolded. Brexit showed that even the poor and downtrodden still had power to change and change they did creating a domino effect across the entire European Union. The lesson for Sri Lanka and in particular the Sinhala Buddhists who find themselves being treated like a minority majority is that they too have the powers to change the established system. Prof. Scott Anthony perfectly sums up the status quo which Sinhala Buddhists will well agree with the actual people who voted for Brexit are precisely not the people who get invited to explain their reasons, especially to an international audience.”  This is the same case ailing the Sinhala Buddhist majority in Sri Lanka.

According to Prof. Scott, the British that voted to Leave the EU did so against the advice of the leaders of all the major British political parties, ignoring US President Barack Obama and EU leaders, as well as an international array of major businessmen, scientists and cultural figures. It was one of the first occasions that the people’s will came to the fore devoid of media and other manipulations. The Brits went against conventional wisdom. They refused to fall prey to the fear psychosis media and powerful others were repeatedly telling them.

Brexit has exposed the political, economic and social crisis that prevails and ushered a rebellion of sorts against the established systems.

Prof. Scotts analysis of what the Brits were fed & similar stories are being fed to the majority in Sri Lanka

  • Leaving EU would increase terrorism
  • Pensions and public services would be cut
  • World war 3 would start
  • Brits were creating national hara kiri
  • The Brits who were voting out were labelled ‘racist’ ‘xenophobic’
  • The Brits under 30 saw the  EU as a marker of cosmopolitan internationalism
  • The older generation of Brits saw the EU as propagators of a false, almost parochial kind of internationalism
  • Trade unionists blame the EU’s enforcement of regulations on freedom of movement and freedom of capital for pushing down wages and undermining full-time, secure employment.

There are common traits that the Sinhala Buddhists share with the Brits.

For both, the vote was a mark of protest. Brits that voted for Brexit and the Sinhala Buddhists in general are poor – their decision invariably was one based on the logic that the less you have, the less you had to lose in voting. The poorer the area the more likely they wanted to leave EU. There was nothing in it for them to really stay. The Brexit voters were of an older generation, the Sinhala Buddhists today disgusted with how the country is being sold for toffees are similarly of the older vintage able to understand the ramifications. The Brexit voters were also less-educated, living in the outskirts while Sinhala Buddhists who make up the majority vote base as well as provide the manpower for the armed forces that defend the nation and also the Buddhist clergy that also continue to keep the identity of the country alive were also poor, less educated and living in the outskirts.

While the Sinhala Buddhists do not have a Nigel Farage what is interesting is that Nigel Farage the leader of the UK Independent Party did not even win the parliamentary seat he was contesting at the 2015 May election. Yet he was able to muster the sentiments of what the majority of Brits felt so while a ‘wanted’ sign for a true Sinhala Buddhist leader still prevails there is hope that a man or even woman can emerge at the right hour representing the majority populace in Sri Lanka!

Another hopeful moment for the Sinhala Buddhists is how racially and religiously diverse areas like Birmingham, Nottingham and Leicester in fact voted to leave the EU. Then there is Barking and Dagenham in East London where less than half its population were half British and 62% voted to leave EU. Therefore all is not lost afterall. Nevertheless, Scotland that voted unanimously to remain in the EU is more like the Northern Province always following orders of India in whatever votes that take place.

Of course there are issues that the majority populace in Sri Lanka can connect with sharing the sentiments of the Brits

Billionaire Peter Hargreaves, says Brexit will push Britain to emulate Singapore.

“It was a mosquito-infested swamp with no natural resources…….All they had were people with brains and hands and they turned it into the greatest economy in the world. I believe that will happen to us, too.”

What the Brits and the majority in Sri Lanka do overwhelmingly share is the issue of demographic changes visibly frightening the Brits as a result of free flow of immigrants/asylum seekers and what not while the Sinhalese see the signing of the ETCA with India on a similar footing with Indians flooding into Sri Lanka. In both cases the fears are valid.

If Brexit voters felt that Britain was losing something very valuable to the powerful bureaucracy in Brussels, the majority in Sri Lanka are fearing the same with India eventually ruling over Sri Lanka.

If the Brexit voters feared the authority of Brussels to impose laws & regulations upon all EU members and free trade of goods and serves, free movement of people the same fears are what engulfs the people’s objections to signing ETCA with India.

Just as the majority in Sri Lanka are proud of and wishes to keep its heritage, culture and traditions without it being kept on par with cultures that have come later day and are trying to place their cultures and traditions above that of the majority, the Brits too began feeling the same. Polish Interior Minister Mariusz Blaszczak has correctly pinned down how problems have been created ‘multiculturalism and political correctness’ is to blame.

In short, you just cannot put culturally diverse civilizations with different values and goals most of which aim to destroy historical identities of others, together and package it as multifaith, multi-religious etc. Ideologies that have hatred imbibed into their religious texts and teachings plus a plethora of new ideological schools of thoughts that are emerging as free-thinkers cannot harmonize with civilizations that are dharmic and nonviolent.

As Sri Lanka experienced with the hypocrisy of the ‘national government’ denying the franchise of the SLFP voters at the last election, the Brexit voters are now feeling that the UK MPs might do a U-Turn and find some way to avoid leaving the EU. Days after the Brexit result the possibility of this occurring looks a reality!

The Brexit voters has enabled the ignored lot to finally have their say which again is an inspiration to the majority in Sri Lanka. Political correctness has meant anyone questioning neo-liberal policies are branded a bigot or racist and silenced using the tool of global media and local lackeys. The inconvenient truth is always silenced. Brexit showed that there are plenty of possibilities to change the status quo. The vote in fact has shaken a lot of people who thought they could comfortably feed lies to people and fool them.

It is now time for the castigated majority in Sri Lanka to also rise and be heard.

නිකෝල් , නේතන් සහ ලංකාවේ සරසවි සිසුන්

යෝක් විශ්ව විද්‍යාලයේ ආපන ශාලාවේදී මට නිකෝල් කැප්‍රියෝටි හමු විය​. කැපචීනෝ කෝප්පයක් ගත් ඇය මගේ මේසයට ආවාය​.

“කොහොමද මැප් ගේ පරියේෂණ වැඩ ? මම ඇසුවෙමි.

ඇල්ස්ටෙයාර් මැප් පරියේෂණ මනෝ විද්‍යා මහාචාර්‍යවරයාය​.  නිකෝල් ඔහු යටතේ මනෝ විද්‍යා පරියේෂන විශයක් කරන්නීය​. ඇල්ස්ටෙයාර් මැප් අමුතු අන්දමේ චරිතයකි. ඔහු බොහෝ සෙයින් විහිළු කරයි. එහෙත් ඔහු සිටින්නේ දුකෙන් බව මගේ සිත කියයි.

” මහාචාර්‍ය මැප් ගේ හැටි දන්නවානේ ?  නිකොල් සිනාවක් පාමින් කියන්නීය​.

ඔහු සමග වැඩ කිරීම විනෝද ජනකය​. නමුත් විභාග ප්‍රතිඑල දෙන විට ඔහු ඉතා තදය​. මේ නිසා සිසු සිසුවියන් විභාග කාලයට ආතතියෙන් යුතුව මුහුණ දෙති.

උසස් අධ්‍යාපනය සඳහා නිකොල් කැප්‍රියෝටි වැනි සිසුවියන් මෙන්ම  පිත්සා බෙදා හරිමින් නේතන් වැනි සිසුන් කරන අරගල  මම දුටුවෙමි.  නේතන් උස සිසුවෙකි. ඔහු දෙමාපියන්ට බරක් නොවී තම අධ්‍යාපනය කරගෙන යයි.  මෙවැනි සිසු සිසුවියන් දකින විට හරකුන් මෙන් දක්කාගෙන ගොස් පාරවල් බ්ලොක් කර ගෙන උද්ඝෝෂණයේ යෙදෙන ලංකාවේ සරසවි සිසුන්  කෙතරම් ලාමකද කියා සිතේ.

ලංකාවේ සරසවි සිසුන්ට විශ්ව විද්‍යාල අධ්‍යාපනය නොමිලේ ලැබේ.

අහෝ ඔවුන් ඉගෙන ගැනීමට තිබෙන කාලය නාස්ති කරමින් පාරවල් වල උද්ඝෝෂණ කරන බව ඇය දන්නවා නම්. ඔවුනට මහපොල නොමිලේ ලැබුනද නිකෝල් සහ නේතන් වැනි සිසු සිසුවියන් අධ්‍යාපනය ලැබීමට ශිෂ්‍ය නය ආධාර ලබා ගනිති. එය යළි ගෙවිය යුතුය​.

පිටස්තර ලෝකය ගැන කිසිවක් නොදන්නා ලිං මැඩියන් වන් ලාංකික සරසවි සිසුන් නවක වධය කරති , ඉංග්‍රීසි ටිකක්​, පරිගණක විශය ටිකක් ඉගෙන නොගෙන පාරවල් පුරා රස්තියාදු වෙති. අරගල කරනවා කියා මහ පාරවල් හරස් කරගෙන වැඩ කරන ජනයා පෙළති. මොවුන් හරකුන් මෙන් දක්වන්නෝ අණ්ඩපාලලා  වෙති. ඔවුන් තම දරුවන් පිටරටවල පුද්ගලික විශ්ව විද්‍යාල වලට යවා ලාංකික සරසවි සිසුන් පාරවල් පුරා යවති.

එදා රාගම පුද්ගලික වෛද්‍ය විද්‍යාලය වැසීම සඳහා ත්‍රීමා විතාණ , කොල්ලූරේලා, වෙනුරලා වැනි බිලි බෝයිස්ලා දං ගෙඩියට යවපු සිසු නායකයන් ගේ දේශපාලකයන් ගේ දරුවන් අද ඉගෙන ගන්නේ විදෙස් රටවල පුද්ගලික විශ්ව විද්‍යාල වලය​.  ඔවුන් පිටරට ඩිග්‍රි ගසා ජීවිතය විඳිමින් සිටින විට බිලි බෝයිස්ලාගේ දෙමාපියන් පවුලේ සොහොයුරු සොහොයුරියන් තවමත් කඳුළු බොති.

මේ අතර ලාංකික සරසවි සිසුන්  රැකියාවක් ඉල්ලමින්  උපාවාසයේ යෙදෙති. ඒ අතරවාරයේ ඉංග්‍රීසි හැකියාව ඇති පිටරට උපාධි ගත්තෝ එති. පුද්ගලික අංශය ඔවුන් පාවඩ එළා පිලිගනිති. ඉංග්‍රීසිය , පරිගණක දැණුම නොමැතිව පුද්ගලික අංශයට ගියහොත්   තමන් නියත වශයෙන්ම ඇණ ගන්නා බව දන්නා දේශීය විශ්ව විද්‍යාල සිසුන් පතන්නේ රජයේ පින් රැකියාවකි. කළමනාකරණ සහකාර ලෙස රජයේ පත්වීම් ලබා ගන්නා මොවුන් ෆොටෝ කොපියක් ගැනීමට , ෆැක්ස් එකක් යැවීමටවත් දන්නේ නැත​. නිකන්ම ආයතන වල පුටු රත්කරන මොවුන් රජයට මෙන්ම ජනතාවටද බරකි.

රජයටවත් , දෙමාපියන්ටවත් , තමන්ටවත් බරක් නොවී නිකෝල් ලා නේතන් ලා උසස් අධ්‍යාපනය ලබති. විශය කරුණු හොඳින් හැදෑරීමෙන් උසස් ලෙස සමත් වී ජීවිත ජය ගනිති. අවසානයේදී එකී රටවල් දියුණු වන අතර අපේ රටවල් එක තැන පල් වෙති. අපගේ දේශපාලුවන් මේ කාලකන්නි තත්වයට හේතුව බටහිර කුමන්ත්‍රණ කියා ජනතාවට කියති. ජනතාව අත්පොලොසන් දෙති.  බටහිරට බනිති.

A Comment on above statement

Don’t worry Mr. Ex President. They will soon do that as well. They are counting down and marking time only until the proper time come. Don’t forget that it was one of the main pledges Chandrika-Ranil-Sirisena Trio has made to their advisers and conspirators led by USA, Briton, Norway and Western allies and India who hatched the Jan 08 2015 coup to ousted your patriotic Government.

I list below some of the other major sinister pledges they are reported to have made.

1)  Transforming Sri Lanka to a Federal state with separate regions for Tamils and Muslims

2) Sri Lanka to be  transformed to a secular State by paving the way to ‘end Sinhala Buddhist majoritarianism’ as Chandrika has once said to achieve reconciliation’ and eradicate the 2500 year old Sinhala Buddhist Kingdom and its unique civilization.

3) Providing for an Indian Tamil State right at the center of the Land of the Sinhalese by giving the entire tea an drubber country covering over 1/3 the land area of the country to Indian Tamils,

4) Enacting a new Constitution to accommodate these pledges

5) Changing the national flag of the country,

6) Allowing the Tamils to sing the National anthem in Tamil

7) Removing all Sri Lanka Government military bases from the Eastern and Northern Provinces as if these Provinces are not a part of Sri Lanka thereby conceding to a self autonomous EELAM on 1/3 the area of the country and 2/3 the coastal belt with all the adjoining Sri Lankan marine territory

(This in other words virtually amounts to giving EELAM on a platter which the LTTE could not achieve for 30 years by the bullet)

8)  Full implementation of the recommendation of the UN High Commissioner for Human Rights and to include foreign judges in the Sri Lanka war crimes panel, which is against the Geneva Convention

9) Removing all Sinhalese from east and Northern and Eastern and Provinces and giving Land and police powers to these PCC and stopping all Sinhala settlements in those Provinces in future

10 Accepting North and Eastern Provinces a historical Traditional Home land of Tamils as stated in the JR-Rajive Pact of 1987.

Some of these promises have already been made and steps are taken to implement others as soon as possible.

But these traitors are scared to put you behind bars as yet, as they expect a massive backslash from the patriotic people of this country including the 5.8 million who voted you at the Presidential Election and majority Sinhala Buddhist populous of those who voted them at the last elections but now disgusted and disillusioned with them over their one and half years of misgovernment, mishandling of the affairs of the State and right royal bungling all round, including breach of all false promises they made in Jan 8th  and Aug 17th 2015 . That is why they are doing it carefully and systematically by first taking in the men in the outer ring to be followed by the inner ring as prescribed by Kautilyan strategy. This is also a major part of the psychological war given in Arthasatra to weaken the leader’s morale. By putting behind bars and silencing those popular men with big mouths and capacity to organize the people in the outer rings firstly, they expect to deplete your man power base and thereafter to deprive the leader of those who can make a voice to get the people to the road. This is clearly seen when people like Gammanpilla and Buddhist monks like Uduwe Dhammaloka who speak on behalf of Sinhala Buddhist rights are taken in. You wait and see this trend will follow soon by taking in men like Weerawansa and many more laymen and Buddhist monks who support you will be in Welikada before long.

The leaders of the present anarchic regime have now become confused and impatient as the pressure from the West, India and Colombo based local anti Sinhala anti-Buddhist elements is very high. That is why the Trio has ordered men in the inner circle like Namal also to be taken in on flimsy charges even without a complain. Very soon these people will take in Basil and Gota as well. The ongoing process is only a rehearsal and they are testing the pulses of the people and marking time only. You should not be surprised even if hey imprison all those who have the name Rajapaksa in this country. That is the terrible fear and anxiety, I think, these fellows have to this name Rajapaksa. They must be shivering and screaming in beds at night in their dreams when they think of MR. As such they will resort to anything and everything to remove you physically or at least politically. Both Chandrika and Sirisena have already said this categorically and publicly many a time. One must not be surprised even if they get their Western allies or Tamil Diaspora to eliminate you like what America did to Sadam Hussain and Mohomad Gadapi.

When you look at the way how they have blatantly violated the Constitution of the country with impunity or public uprising, starting from the

1 Removal of the CJ and the

2 Appointment of the new CJ

and followed by

3 Appointing Ranil as the new Prime Minister

4 Removal of the sitting PM,

5 Appointing the leader of the Opposition,

6 Appointing the Chief Whip of the Opposition,

7 Appointing defeated candidates as MPP,

8 And even as Cabinet Ministers

9 Singing the national Anthem in Tamil and

10 Refusal to appoint the Joint opposition Leader as the legal Leader of the Opposition in Parliament,

One should not get surprised at all even if they resort to the meanest crime on earth to get their goals fulfilled.  They might even resort to inviting IPK or UN forces to quell and suppress any public uprising.

Mahinda Rajapaksa and his supporters will have to be extremely mindful of this situation and keep their eyes and ears fully opened in view of these imminent dangers. People of this country, especially the grateful Sinhala Buddhists have to be extremely vigilant to protect this man as the country needs him. It is very unlikely to get a patriotic Statesman like this for a long time to come even for another 500 years in this country. It is also important for all those who love him and their country to protect him from all these dangers for the sake of the country, people and the religion.

People in this country know that there would not have been a country left for anybody even to misgovern as they do now, had MR not defeated the LTTE terrorists in 2009. They also know very well that even the most three basic functions of a State (government) as stated by ancient sages like Kautilya namely,

  1. Raksha- protection of the State from external aggression
  2. Palana- maintenance of law and order within the State and
  3. Yogakshema-safeguarding the welfare of the people

have come to a total stand still today in this country.

In short besides good governance as they preach and boast day and night, there is no Government at all in this country today. When you look at the way things are happening there is absolutely no sign of any of these lofty ideals being practiced or their possible return in the foreseeable future. Instead of protecting the State from external aggression what these treacherous lunatics of the present Government are doing is opening the doors ajar and inviting all anti Sinhala, anti-Buddhist and anti-national forces of the world led by the so-called international community to come and destroy everything in this country we have protected for the past 2500 years. I don’t think I need to tell you about the state of law and order in the country or the welfare of the people as even a tiny naked tot on the wayside will know the appalling situation prevailing in the country.

‘History of a great country both ancient and modern cannot be swept clean like a blackboard so that we might inscribe our own there’ as Edward Said has once said in his Orientalism. The general populous in this country know who gave the historic commanding leadership to the elimination of the 30 year LTTE terrorist menace in this country. If he had not given that historic leadership when all previous leaders had miserably failed and some have even supported the enemy (Eg JR, Premadassa, Chandrika and Ranil) today we would not have had a country for these bunch of jokers even to misgovern or anyone of us even to breath.

Even the Chandrika-Ranil-Sirisena Trio now gunning at Rajapaksa would have been brutally murdered in broad day light long time ago ( to her it really happened but fortunately for her and unfortunately for the country) by the Tigers, if there was no Mahinda Rajapaksa as the Head of the State at that point of history in this country.

Black July 33 years ago

Thirty-three years ago – from July 24 to July 30, 1983 – took place one of the biggest massacres in Sri Lanka’s history. The perception of the Tamil people was that Black July 1983 was a crime well-planned by organized groups linked to the then Government. According to official Government statistics the number of those killed was 471 while the number injured was 3,769. The number of robberies was 3,835. However, unofficial reports say that the number killed was 2,000 and the number of Tamils displaced was around 150,000. Of the buildings destroyed were 8,000 houses and 5,000 commercial establishments. The value of property damaged or destroyed was estimated to be nearly 300 million U.S. dollars.

During the past half-a-century successive Governments reached various agreements with Tamil parties on what they called the Northern question, the North-East crisis, the ethnic issue, Tamil Eelam and Federalism. An armed campaign to secure a separate state commenced in the early 1970s causing the deaths of nearly 60,000 people both in the North and South due to the terrorist actions of Tamil separatist groups during the past three decades.

The UNP Government signed the Indo-Lanka Accord with India on July 29, 1987 hoping to end the conflict. As a result nearly 100,000 Indian troops arrived in Sri Lanka between July 1987 and March 1990 and launched military operations against LTTE terrorists in the North and East but they proved unsuccessful.
In the same period the JVP launched its second insurgency to protest against the Indian intervention among other issues. Consequently 41,813 people were killed in the South. However, 19 years later President Mahinda Rajapaksa succeeded in militarily crushing the LTTE on May 19, 2009 thus ending a 30-year armed conflict.

Fifty-eight years ago, in August, 1957, the Federal Party (which was formed under S.J.V. Chelvanayakam’s leadership in 1949) announced its decision to stage a hartal and satyagraha to protest against the Official Language Act. The first step towards solving Tamil separatism was the Bandaranaike-Chelvanayakam Pact signed on July 26, 1957. Earlier on June 26 secret talks were held between Prime Minister S.W.R.D. Bandaranaike and Federal Party leaders at Horagolla. Thereafter discussions continued at the PM’s office on July 9 and at Rosmead Place and the Senate on July 14.

The decisive meeting took place on July 25, 1957. The Pact was signed the following day but it was never implemented due to vehement protests.
After Tamil separatists assassinated Jaffna’s SLFP Mayor and the party’s Chief Organiser Alfred Duraiappah on July 27, 1975 tensions increased in the North.

On May 24, 1981 during the District Development Council Election the PLOTE (People’s Liberation Organisation of Tamil Eelam) assassinated UNP Candidate A. Thangaraja. Six days later two policemen on duty at an election meeting were shot dead. Reacting in anger pro-government gangs set fire to the four storeyed-Jaffna Public Library building (constructed in 1935) which had many invaluable books and around 97,000 hand-written manuscripts. Before and on the day of the District Development Council election several UNP Cabinet Ministers, including Gamini Dissanayake and Cyril Mathew and MP Gamini Jayawickrema Perera were sent to Jaffna.

In July 1982 four policemen were killed at Nelliadi junction, Jaffna. In October of the same year terrorists attacked the Chavakachcheri Police Station killing three policemen before escaping with weapons seized from the station.

Also, 1982 was the year when the UNP held the infamous referendum to extend its term in Parliament and secured 54.7 percent of votes. In October of the same year a Presidential Election was held and President Jayewardene won by 52.91 votes. Large scale violence and vote rigging occured during both the referendum and the election. When Opposition Presidential Candidate Hector Kobbekaduwa went to cast his vote he found that it had already been ‘cast’ fraudulently.

On July 15, 1983 the Army opened fire at Chavakachcheri killing Tiger terrorists Charles Lucas Anthony alias Seelan (a close associate of LTTE chief Prabhakaran) and Ramanadan Arulnadan. The Tigers decided to avenge their deaths by planting landmines at Thirunelveli Road.

On the night of July 23, 1983, a squad of 15 soldiers (Four Four Bravo Patrol) led by 2nd Lieutenant A.P.N.C. De Vas Gunawardena attached to ‘C’ Company of the Sri Lanka Light Infantry’s First Battalion, Madagal, were engaged in a road inspection. They travelled in jeep No. Army 4889 and Truck No. 26 Sri 3193. They had been also been ordered to arrest Sellakkili another close confidante of Prabhakaran and report to the Army Camp at Madagal.
About five minutes past 11.28 p.m. when the troops were passing the Urupirai junction their jeep was caught in a deafening explosion followed by relentless gunfire. The jeep was driven by Corporal G.R. Perera. Only Corporal Upali Perera and Lance Corporal Sumathipala were able to escape from the 22-member Tiger terrorist group which sprang the ambush. Thirteen soldiers died in the attack.

Army Commander at the time was Lietenant General Tissa ‘Bull’ Weeratunge. Arrangements were made to bury ther bodies at the General Cemetery, Borella where 14 graves had been for the purpose (Cpl. Upali Perera was mistakenly thought to be dead but survived with serious injuries). The dead were 2nd Lt. Vas Gunawardena, Sergeant I.S. Tillekeratne, Cpl. G.R. Perera (driver), Lance Cpl. G.D. Perera and Privates A.D. Mathapitiya, M.B. Sunil, A.J. Wijesinghe, K.P. Karunaratne, P.G. Rajatilleke, S.S. Amarasinghe, G. Robert, A.S. Manatunga (driver) and J.R. Fernando.

Although it was announced that the bodies of the dead army personnel were to be brought to Borella on July 24, 1983 at 5.00 p.m. they were not brought until 7.00 p.m. The crowd at the cemetery became restless. They reacted violently after Police Superintendent Gafoor ordered a baton charge on several of the mourners. This writer was an eye witness to the incident.

Angry crowds began attacking Tamil shops and houses in Borella and surrounding areas. These were happening at several places all over Colombo on the same night. Although earlier it was decided to take the bodies of the dead soldiers to their home towns, the decision was changed at the last minute and they were instead brought to Colombo.

It was only on July 26, 1983 – 24 hours after the rioting occurred – that President Jayawardene declared curfew in Colombo. By that time organized attacks on Tamil people were continuing in Colombo and nearby districts. There were strong allegations that Cyril Mathew, a powerful Cabinet Minister, was directing the violence. His supporters and others linked to the Government, armed with voters’ lists, were looking for Tamil houses to attack.

A trade unionist of the UNP-affiliated Jaathika Sevaka Sangamaya led the attacks in Wellawatte. The violence in Mount Lavinia was directed by a UNP Municipal Councilor. An underworld gangster organized the attacks in Pettah where 442 shops were destroyed and several were killed.

It was only on the night of July 28, 1983 – five days after the rioting – that President Jayewardene addressed the nation. Five days before, on July 18, 1983 the President in an interview with Daily Telegraph, London, said that he was not concerned with the views of the Jaffna people and that he could not think about them or their opinion of the Government.

After the rioting spread to Welikada Prison 35 Tamil Prisoners were killed at first followed by 18 others later. A total of 53 Tamil prisoners were killed between July 25 and 27. Among the victims were the founder of TELO (Tamil Eelam Liberation Organisation) Kuttimani and Jegan, another pioneer of the armed Tamil militancy. Kuttimani had been earlier sentenced to death by the Colombo High Court on August 13, 1982 after being convicted of killing a police constable in 1979.

The curfew was relaxed in Colombo, Gampaha and Kalutara after a few days but patrolling by security forces continued. However a shooting incident involving three armed Tamil terrorists who had climbed the upper storey of a building near the Bo-Tree junction Pettah on July 27, 1983 caused tensions to rise again in Colombo and suburbs.

The rioting spread like wildfire throughout the country from July 24 to July 30 resulting in organized Tamil groups chasing away Sinhala families in the North to the South. Hundreds of them were brutally killed in the North and East and their house and shops destroyed. The remaining property was forcibly seized.
What the UNP Government did in response to international criticism about the Tamil pogrom was to proscribe by Gazette notification on July 31, 1980 three Left parties, which had nothing to do with the rioting. President Jayewardene’s explanation was that the ban was imposed following reports that the Black July incidents were a conspiracy by leftwing extremists against the Government.

Accordingly, the JVP, the Communist Party and NSSP were proscribed. The CP and NSSP leaders who went into hiding for a short time surrendered to the government. Thereafter the ban on their parties was lifted.

The JVP however did not surrender although there were national and international appeals to lift the proscription. Later the JVP engaged in clandestine political activity and in 1986 launched a second insurgency which ended with the deaths of 41,813 people including JVP Leader Rohana Wijeweera who was killed on November 13, 1989.

Eventually, the UNP Government introduced the 6th Amendment to the Constitution, claiming it was mean to ensure the country’s territorial integrity. After an intense debate it was finally passed on August 8, 1983.

According to the 6th Amendment every MP should pledge not to support the establishment of a separate state. Since the TULF represented separatism all Northern Parliamentarians and two from the East did not sign the pledge. Consequently 16 MPs including TULF Leader Appapillai Amirthalingam and R. Sambandan lost their seats on October 23, 1983.

Anura Bandaranaike of the SLFP became Opposition Leader on November 8 the same year with the support of nine SLFP MPs and MEP Pariamentarian Dinesh Gunawardena and Communist Party MP Sarath Muttetuwegama.

As a result of Black July 1983 Tamil separatist organizations in the North established their base of operations in Tamil Nadu. Thereafter within a decade the Indian Government under Prime Minister Indira Gandhi’s Leadership allowed the establishment of 110 terrorist training camps in India. The Indian Government openly gave them material and monetary assistance.

After the rioting nearly 100,000 Tamils sought political asylum in the West. Thousands more fled by boat to India where they found shelter in refugee camps. Since then Tamils groups who left Sri Lanka have organized themselves as the Tamil Diaspora and continue to assist Tamil separatists directly and indirectly. ලාංකීය ඉතිහාසයේ දරුණුතම මිනිස් සංහාරයක් ලෙස සැලකිය හැකි 1983 ජුලි 24 වැනිදා සිට ජුලි 30වැනිදා දක්වා කාලය තුළදී වන අතර එය සිදුවී 2016 ජුලි 24වැනිදාට වසර 33කි. එවකට ජනාධිපති ජේ.ආර්. ජයවර්ධන ගේ එජාප ආණ්ඩුවට සම්බන්ධ සංවිධානාත්මක පිරිස්වල අනුග්‍රහය ඇතිව සිදුවූ 1983 කළු ජූලිය සැලසුම්ගත ව්‍යාපාරයක් බව ද්‍රවිඩ ජනතාවගේ ආකල්පය විය.

ආණ්ඩුවේ නිල සංඛ්‍යාලේඛන අනුව මරණයට පත්වූ සංඛ්‍යාව 471කි. තුවාල වලට ලක්වූ අයගේ සංඛ්‍යාව 3,769කි. සිදුවූ මං‍කොල්ලකෑම් සංඛ්‍යාව 3,835කි. එහෙත් නිල නොවන සංඛ්‍යාලේඛන අනුව මියගිය සංඛ්‍යාව 2,000ක් වූ අතර නිවාස 8,000ක්ද කඩ සාප්පු 5,000ක්ද විනාශ වූ අතර ද්‍රවිඩ ජාතිකයින් 150,000ක් පමණ අවතැන් විය. අලාභ හානියට පත්වූ දේපලවල  වටිනාකම ඇමරිකානු ඩොලර් දශලක්ෂ 300කට ආසන්න බව කියති.

එජාප ආණ්ඩු කාලයේදී යුද්ධය නිමා කිරීමේ අරමුණින් ඉන්දියාව සමඟ හොර රහසින් ගිවිසුමක් 1987 ජුලි 29 වැනිදා ගිවිසුමක් අත්සන් කල අතර එහි ප්‍රතිඵලයක් වශයෙන් ඉන්දිය හමුදා භටයින් ලක්ෂයට ආසන්න සංඛ්‍යාවක් 1987 ජුලි සිට 1990 මාර්තු දක්වා ශ්‍රී ලංකාවට පැමිණ උතුරු නැගෙනහිර ද්‍රවිඩ ත්‍රස්තවාදීන්ට එරෙහිව යුධ මෙහෙයුම් සිදුකලද එය අසාර්ථක විය. එම ඉන්දිය හමුදාව ශ්‍රි ලංකාවට බලහත්කාරයෙන් පැමිණීමට විරෝධය දැක්වීමද ජවිපෙ දෙවැනි කැරල්ලේ එක් ප්‍රධාන අරමුණක් වූ අතර එහිදී ඝාතනයට ලක්වූ දකුණේ ජනයාගේ සංඛ්‍යාව 41,813කි.  අනතුරව වසර 2009 මැයි 19වැනිදා තිස් වසරක යුද්ධය මුළුමනින් පරාජය කර රටට සාමය උදාකිරීමට එවකට ජනාධිපති මහින්ද රාජපක්ෂ සමත් විය.

ෆෙඩරල් පක්ෂය 1949දී එස්.ජේ.වී. චෙල්වනායගම්ගේ ප්‍රධානත්වයෙන් පිහිටුවා ගත් අතර රාජ්‍ය භාෂා පනතට එරෙහිව 1957 අගොස්තු මාසයේදී සත්‍යග්‍රහයක් සහ හර්තාලයක් පවත්වන බවට එමගින් නිවේදනය කරන ලදී. ද්‍රවිඩ බෙදුම්වාදයට විසදුම් වශයෙන් මුලින් ඇතිකරගනු ලැබූ එකඟතාවය සැලකෙන්නේ 1957 ජුලි 26වැනිදා ඇතිකරගනු ලැබූ බණ්ඩාරනායක චෙල්වනායගම් ගිවිසුමය. මේ පිළිබදව අගමැති බණ්ඩාරනායක සහ ෆෙඩරල් පක්ෂ නායකයින් අතර 1957 ජුනි 26 වැනිදා හොරගොල්ලේදී රහසිගත සාකච්ඡාවක්ද පැවැත්විණි. එම රහසිගත සාකච්ඡා පසුව 1957 ජුලි 9වැනිදා අගමැති කාර්යාලයේදීද 1957 ජුලි 14වැනිදා රොස්මීඩ් පෙදෙසේද, සෙනට් මන්ත්‍රී මණ්ඩල ‍ගොඩනැගිල්ලේද පැවැත්විණි. තීරණාත්මක සාකච්ඡා පැවතියේ 1957 ජුලි 25වැනිදාය. බණ්ඩාරනායක-චෙල්වනායගම් ගිවිසුම 1957 ජුලි 26 අත්සන් කෙරනුයේ එහි ප්‍රතිඵලයක් වශයෙනි. අවසානයේ විරෝධතා නිසා එම ගිවිසුම ක්‍රියාත්මක ‍‍නොවීය.

සමගි පෙරමුණ ආණ්ඩුවට පක්ෂපාතී වූ යාපන නගරාධිපති දුරේ අප්පා 1975දී ද්‍රවිඩ බෙදුම්වාදීන් විසින් ඝාතනය කිරීමෙන් පසු 1982 වන විට උතුරු පළාත ගිනියම් වෙමින් පැවතිණි. 1982 ජුලි මසදී පොලිස් භටයින් 4 දෙනක් යාපනය නෙල්අඩි හන්දියේද මරා දැමූ අතර 1982 ‍ඔක්තෝබර් මස වාවකච්චේරි පොලිස් ස්ථානයට කඩා වැදී භටයින් තිදෙනෙකු මරා ත්‍රස්තවාදීන් ආයුධ පැහැර ගෙන යන ලදී. එජාප ආණ්ඩුව මගින් 1982දී සිය පාර්ලිමේන්තු නිල කාලය දික්කර ගැනීම සදහා ජනමත විචාරය පැවැත්වූ අතර එහිදී ආණ්ඩුවට පක්ෂව ඡන්ද සියයට 54.7ක් ලැබිණි.

ජනාධිපතිවරණයද 1982 ඔක්තෝබර් 21වැනිදා පැවති අතර ඉන් එජාප අපේක්ෂක ජනාධිපති ජයවර්ධන ඡන්ද සියයට 52.91ක් ලබා ගනිමින් ජයග්‍රහකයා බවට පත්විය. එම ජනමත විචාරණ සහ ජනාධිපති මැතිවරණය අතිශයින් ප්‍රචණ්ඩ ස්වරූපයක් ගත් අතර හොර ඡන්ද දැමීම් මහා පරිමාණයෙන් සිදුවිය. විපක්ෂයේ අපේක්ෂකයා වන ශ්‍රිලනිපයේ හෙක්ටර් කොබ්බෑකඩුව සිය ඡන්දය පාවිච්චි කිරීමට ගිය අවස්ථාවේදී ඔහුගේ ඡන්දය හොරෙන් දමා තිබිණි.

එයට පෙර 1981 දිස්ත්‍රික් සංවර්ධන සභා මැතිවරණයේදී ප්ලොට් සංවිධානය මගින් එජාප අපේක්ෂකයෙකු වූ ඒ. තංගරාජා මැයි 24වැනිදා වෙඩිතබා ඝාතනය කල අතර මැයි 30වැනිදා මැතිරණ ප්‍රචාරක රැස්වීමක රාජකාරියේ යෙදී සිටි පොලිස් භටයින් දෙදෙනෙකුද ඝාතනය කරන ලදී. ඉන් ප්‍රකෝපයට පත් ආණ්ඩු හිතවාදි පිරිස් ‍1981දී ග්‍රන්ථ සහ අත්පිටපත් 97,000ක් පමණ තිබූ 1935දි ආරම්භ කරන ලද යාපනය සිව් මහල් පුස්තකාලය ගිනි තබා විනාශ කරන ලදී. සංවර්ධන සභා මැතිවරණයට පෙර සහ මැතිවරණ දිනයේදී ජනාධිපති ජේ.ආර්. ජයවර්ධන එජාප ආණ්ඩුවේ ඇමතිවරුන් කිහිප‍දෙනෙකු යාපනයට යවන ලදී. ඇමතිවරු වූ ගාමිණී දිසානායක සහ සිරිල් මැතිව්ද පාර්ලිමේන්තු මන්ත්‍රී ගාමිණී ජයවික්‍රම ඇතුළු කිහිප දෙනෙක්ද ඒ අතර විය.

වසර 1983 ජුලි 15වැනිදා හමුදාව එල්ල කල ප්‍රහාරයකින් චාවකච්චේරි මිසාලයේදී කොටි ත්‍රස්තවාදීන් වූ ලූකස් චාල්ස් ඇන්තනි නොහොත් සීලන්ද රාමනාදන් අරුල්නාදන් යන දෙදෙනා මිය ගොස් තිබිණි. මින් සීලන් යනු කොටි නායක ප්‍රභාකරන්ගේ එවකට සිටි සමීපතමයෙකි. එම මරණ වෙනුවෙන් පලිගැනීමට තීරණය කල කොටි කණ්ඩායම සිදුකළේ නිරුනෙල්වේලි පාරේ බිම් බෝම්බ වැලලීමය.

ශ්‍රී ලංකා පාබල රෙජිමේන්තුවේ සී කණ්ඩායමේ දෙවන ලුතිනන් වාස් ගුණවර්ධන ගේ නායකත්වයෙන් 15කගෙන් යුත් භට කණ්ඩායමක් 1983 ජුලි 23වැනිදා රාත්‍රී කාලයේදී මාර්ග පරික්ෂාවක නිරත විය. ඔවුන් ගියේ යු.හ. 4889 දරණ ජිප් රථයෙන් සහ 26 ශ්‍රී 3193 දරණ ට්‍රක් රථයෙනි. ප්‍රභාකරන්ගේ සමීපතමයෙකු වන සෙල්ලක්කිලි අත්අඩංගුවට ගැනීමට සිදුකරන මෙහෙයුමේදී මාර්ග පරික්ෂා කර ගුරු නගර් කඳවුරට වාර්තා කරන ලෙසට ඔවුන්ට නියෝග දී තිබිණි.

එදින රාත්‍රී 11.28ට ඌරුම්පිරායි හන්දිය පසුකොට විනාඩි 5ක් පමණ ගත වෙද්දී හෙන හඬක් නඟමින් ඇතිවූ පිපිරුමකට ජිප්රිය හසුවිය. වෙඩි ප්‍රහාර හා බෝම්බ වර්ෂාවක් මෙන් පතිත විණි. ජිප් රථය පැදවූයේ කෝප්‍රල් ජී.ආර්. පෙරේරාය. 22කුගෙන් සමන්විත වූ කොටි ත්‍රස්තවාදී කණ්ඩායමක ප්‍රහාර හමුවේ දිවි රැක ගැනීමට සමත්වූයේ කෝප්‍රල් උපාලි පෙරේරා සහ ලාන්ස් කෝප්‍රල් සුමතිපාල පමණි. භටයින් 13දෙනෙකු මියගොස් තිබිණි. එවකට යුධ හමුදාපතිවූයේ ජනරාල් තිස්ස වීරතුංගය. එම සිරුරුවල අවසාන කටයුතු බොරැල්ල කනත්තේදී සිදුකිරීමට මිනී වලවල් 14ක් හාරා තිබිණි. කෝප්‍රල් උපාලි පෙරේරාද මිය ගිය බවට සලකා තිබිණි. එහෙත් ඔහු බරපතල තුවාල ලබා ජීවත් විය.

එසේ මියගිය හමුදාවේ 13 දෙනාගේ කණ්ඩායමට දෙවන ලුතිනන් වාස් ගුණවර්ධන, සැරයන් එස්.අයි. තිලකරත්න, කෝප්‍රල් ජී.ආර්. පෙරේරා(රියදුරු), ලාන්ස් කෝප්‍රල් ජී.ඩී. පෙරේරා, සාමාන්‍ය සෙබළුන් වන ඒ.ඩී. මාතපිටිය, එම්.බී සුනිල්, ඒ.ජේ. විජේසිංහ, කේ.පී කරුණාරත්න, පී.ජී. රාජතිලක, එස්.එස් අරසිංහ, ජී. රොබට්, ඒ.එස් මනතුංග(රියදුරු) සහ ජේ.ආර්. ප්‍රනාන්දු යන අය අයත් වූහ.

උතුරේදී බෝම්බ ප්‍රහාරයකින් ඝාතනයට පත්වූ සෙබළුන් 13 දෙනා මළ සිරුරු 1983 ජුලි 24වැනිදා පස්වරු 5ට බොරැල්ලේ කනත්තට ගෙන එන බවට කීවද රාත්‍රී 7වන තෙක් එම මළ සිරුරු ගෙන ආවේ නැත. පිරිස නොසන්සුන් වූ අතර පොලිස් අධිකාරි ගෆූර් විසින් කලබලකාරී කිහිප දෙනෙකුට පහරදීමත් සමඟ කොළඹ කනත්ත ගාලගෝට්ටියක් බවට පත්වූ අයුරු එම ස්ථානයේදී සිද්ධිය සියසින් දුටු ලියුම්කරුට මතකය. කුපිත වූ පිරිස බොරැල්ල සහ ඒ අවට තිබූ ද්‍රවිඩ කඩසාප්පු සහ නිවෙස් වලට ප්‍රහාර එල්ල කලහ. එය එදිනම රාත්‍රී මුළු කොළඹ නගරයේ ස්ථාන කිහිපයක සිදුවෙනු දක්නට ලැබිණි. ඒ අතරතුර බොරැල්ලේ කනත්තේ වල දැමීමට ගිය සෙබළුන්ගේ මළ සිරුරැ යළිත් හමුදා මූලස්ථානයට ගෙනවිත් ගම්වලට පිටත්කර යැවීමට බලධාරින් තීරණය කරන විටද සියල්ල සිදුවෙමින් පැවතිණි.

ප්‍රචණ්ඩ ක්‍රියා හට ගැනීමෙන් පසු ජනාධිපති ජයවර්ධන කොළඹට ඇදිරිනීතිය පැනවූයේ පැය 24ක් ගතවීමෙන් පසුවය. එනම් 1983 ජුලි 26වැනිදාය. ඒ වන විටත් ද්‍රවිඩ ජනයාට එරෙහි කෝලාහලය සංවිධානාත්මක මට්ටමින් කොළඹ සහ ඒ අවට දිස්ත්‍රික්කයන්හි දියත් වෙමින් පැවතිණි. ආණ්ඩුවේ ප්‍රබල ඇමතිවරයෙකු වු සිරිල් මැතිව් එම ක්‍රියාවලියට සෘජුවම දායක වූ බවට බරපතල චෝදනා විය. ඔහුගේ සහ ආණ්ඩු හිතවාදී ඇතැම් ආධාරකරුවෝ ද්‍රවිඩ නිවෙස් සොයා ගියේ මැතිවරණ දෙපාර්තමේන්තුවේ ඡන්ද හිමි නාම ලේඛනද අතැතිවය. වැල්ලවත්තේ මැර කණ්ඩායම් මෙහෙයවන ලද්දේ ජාතික සේවක සංගමයේ ප්‍රධානියෙකි. ගල්කිස්සේ කෝලාහල ‍වලට නායකත්වය දුන්නේ නගර සභාවේ එජාප මන්ත්‍රීවරයෙකි. පිටකොටුවේ කඩසාප්පු 442ක් විනාශ කරමින් සහ ජීවිත හානි සිදුකිරීමේ අණදෙන්නා වූයේ දේශපාලනයට සම්බන්ධ පතාලයේ දාමරිකයෙකි. ජනාධිපති ජයවර්ධන ජාතිය ඇමතුවේ කලබල වලින් පසුව දින පහක් ගොස් 1983 ජුලි 28වැනිදා රාත්‍රීයේය.

dharman18071606යාපනය සංවර්ධන සභා ඡන්ද උණුසුම ඉහළ යමින් තිබියදී ආණ්ඩුවේ දේශපාලඥයින්ගේ ආධාරකරුවන් විසින් 1981 මැයි 30 ගිනි තබා විනාශ කල යාපනයේ පුස්තකාලය ගිනිතැබීමෙන් පසු.

වැලිකඩ සිරගෙදර සිටි දෙමළ සිරකරුවන් ප්‍රථමයෙන් 35 දෙනෙකුද 18 දෙනෙකුද අනුක්‍රමික ප්‍රහාරයන් දෙකක් 1983 ජුලි 25වැනිදා සහ 27වැනිදා එල්ල කරමින්  53 දෙනෙකු මරා දමන ලදී. ඒ අතර ටෙලෝ සංවිධානයේ නිර්මාතෘවරයා වූ කුට්ටිමනීද සන්නද්ධ ව්‍යාපාරයේ තවත් ආරම්භකයෙකු වූ ජෙගන්ද විය. කොස්තාපල්වරයෙකුට 1979දී වෙඩිතබා ඝාතනය කිරීමට වරදකරුවූ කුට්ටිමනීට 1982 අගෝස්තු 13වැනිදා කොළඹ මහාධිකරණය මගින් මරණ දඩුවම නියම කොට තිබිණි.

ජනාධිපති ජයවර්ධන දින 4ක් යන තෙක් කිසිදු ප්‍රකාශයක් ලබා දුන්නේ නැත. එයට දින 5කට පෙරාතුව 1983 ජුලි 18වැනිදා ජනාධිපති ජයවර්ධන ඩේලි ටෙලිග්‍රාෆ් පුවත්පතේ මාධ්‍යවේදී ග්‍රැහැම් ඩෝඩ් සමඟ කල සාකච්ඡාවකදී කියා සිටියේ “යාපන‍ය ජනතාවගේ මතය කුමක් වූවද තමාට කමක් නැති බවය. දැන් අපට ඔවුන් ගැන සිතිය නොහැකිය. ඔවුන්ගේ ජීවිත ගැන හෝ අප පිළිබදව ඇති ඔවුන්ගේ මතය ගැන සිතිය නොහැකි බවය.” දින කිහිපයක් ගතවීමෙන් පසු කොළඹ ගම්පහ කළුතර ඇදිරිනීතිය සීමා කල අතර හමුදා මුර සේවා ක්‍රියාත්මක විය.  අවිගත් ද්‍රවිඩ ත්‍රස්තවාදීන් තිදෙනෙකු කොටුව බෝගහ අසළ ගොඩනැගිල්ලක ඉහළ මහලකට නැගී 1983 ජුලි 27වැනිදා වෙඩි තැබීමක් සිදුකල අතර ඉන් කොළඹ සහ ඒ අවට ප්‍රදේශ යළිත් උණුසුම් විය.

කළු ජූලි කෝලහල ලැව් ගින්නක් සේ 1983 ජුලි 24වැනිදා සිට ජුලි 30වැනිදා දක්වා රටපුරා පැතිර ගිය අතර උතුරු නැගෙනහිර පදිංචි සිංහල පවුල්ද සංවිධානාත්මක ද්‍රවිඩ පිරිස් විසින් එම ප්‍රදේශ වලින් දකුණට පලවා හරින ලදී. එම සිය ගණනක් සිංහල පිරිස්ද උතුරු නැගෙනහිරදී තිරස්ථීන ලෙස ඝාතනය කල අතර ඔවුන්ගේ නිවාස, කඩසාප්පු විනාශ කල අතර සියළු දේපලද අවසානයේදී බලහත්කාරයෙන් අත්පත් කරගන්නා ලදී.

රජය මගින් 1983 අගෝස්තු 8වැනිදා සම්මත කරගත් 6වැනි සංශෝධනය අනුව වෙනම රාජ්‍යයක් පිහිටුවීමට සහාය නොදෙන බවට දිය යුතු ප්‍රතිඥාව පුතික්ෂේප කිරීමෙන් පසු පාර්ලිමේන්තු නියෝජනය අහිමිවූ දෙමළ එක්සත් විමුක්ති පෙරමුණේ නායක ඒ. අමිතලිංගම් ඇතුළු මන්ත්‍රීවරුන් පාර්ලිමේන්තුවෙන් පිටවූ අයුරු.

දෙමළ සංහාරයට එරෙහිව ජාත්‍යන්තර වශයෙන් එල්ලවූ විවේචන වලට පිළිතුරක් වශයෙන් එජාප ආණ්ඩු සිදුකලේ වාමාංශික පක්ෂ 3ක් 1981 ජුලි 31වැනිදා ගැසට් මගින් තහනමට ලක්කිරීමය. එජාප නායක ජනාධිපති ජයවර්ධන කියා සිටියේ කළු ජූලිය අන්තවාදී වාමාංශිකයන් විසින් දියත් කල ආණ්ඩු විරෝධී කුමන්ත්‍රණයක් බවට වාර්තා වී ඇති බැවින් එම තීරණය ගත් බවය. ඒ අනුව ජනතා විමුක්ති පෙරමුණ, ශ්‍රී ලංකාවේ කොමියුනිස්ට් පක්ෂය සහ නව සම සමාජ පක්ෂය තහනම් කරන ලදී. කොමියුනිස්ට් පක්ෂයේ සහ නව සම සමාජයේ නායකයෝ කෙටි කලක් සැඟවී සිට ආණ්ඩුවට භාරවිමෙන් පසු කොප සහ නව සමසමාජ පක්ෂවල තහනම ඉවත් කරන ලදී. ජනතා විමුක්ති පෙරමුණ එසේ භාර නොවු අතර  තහනම ඉවත් කරන ලෙස නිරතුරුව ජාතික සහ ජාත්‍යන්තර වශයෙන් ඉල්ලීම් කරන ලදී. ජවිපෙ අනතුරුව රහසිගත දේශපාලනයකට යොමු වි දෙවන වරටත් කැරැල්ලක් 1986 දියත්කල අතර එය 1989 නොවැම්බර් 13වැනිදා ජවිපෙ නායක රෝහණ විජේවීරද ඝාතනය වී 41,813 දෙනෙකු මරමුවට පත්විය. නිල නොවන සංඛ්‍යාලේඛන කියන්නේ එය 60,000ක් පමණ බවය.

එජාප ආණ්ඩුව අවසානයේ භෞමික අඛණ්ඩතාවය ආරක්ෂා කිරීමට යැයි කියමින් හයවෙනි ආණ්ඩුක්‍රම ව්‍යවස්ථා සංශෝධනය එක දිගට පාර්ලිමේන්තුවේ විවාද කර 1983 අ‍ගෝස්තු 8වැනිදා සම්මත කර ගත්තේය. ඒ අනුව පාර්ලිමේන්තුවේ සෑම මන්ත්‍රීවරයෙක්ම වෙනම රාජ්‍යක් පිහිටුවීමට සහාය නොදිය යුතු බවට ප්‍රතිඥා දිය යුතුය. දෙමළ එක්සත් විමුක්ති පෙරමුණේ මන්ත්‍රීවරුන් වෙනම රාජ්‍යයක් වෙනුවෙන් පෙනී සිටිය නිසා ඔවුනට එසේ දියුරුම් දිය නොහැකි විය. ඒ අනුව උතුරු පළාතේ සියළුම මන්ත්‍රීවරුන් සහ නැගෙනහිර පළාතේ ආර්. සම්බන්ධන්ද ඇතුළු මන්ත්‍රීවරුන් දෙදෙනෙකුද අයත්ව දෙමළ මන්ත්‍රීවරුන් 16 දෙනෙකුට පාර්ලිමේන්තු මන්ත්‍රීධූර 1983 ඔක්තෝබර් 23වැනිදා අහෝසි විය. එහි ප්‍රතිඵලයක් ලෙස දෙමළ පෙරමුණේ නායක ඒ. අමිර්තලිංගම් වෙනුවට ශ්‍රිලනිපයේ අනුර බණ්ඩාරනායක විපක්ෂ නායක බවට 1983 නොවැම්බර් 8වැනිදා පත්කරගනු ලැබුවේ ශ්‍රිලනිප මන්ත්‍රීන් 9කගේද මඑපෙ මන්ත්‍රී දි‍නේෂ් ගුණවර්ධන සහ කොපයේ මන්ත්‍රී සරත් මුත්තෙට්ටුගමගේ සහායෙනි.

කළු ජූලියේ ප්‍රතිඵලයක් ලෙස උතුරේ ද්‍රවිඩ බෙදුම්වාදී ත්‍රස්තවාදී සංවිධාන තමිල්නාඩු ප්‍රාන්තය සිය මූලස්ථානය කරගත්තේය. ඉන්පසුව ඉන්දියාවේදී දෙමළ බෙදුම්වාදී ත්‍රස්තවාදීන්ට  අවි පුහුණුව ප්‍රසිද්ධියේ ලබාදෙමින් ත්‍රස්ත පුහුණු කඳවුරු 110ක් ඇරඹීමට ඉන්දීය අගමැතිනි ඉන්දිරා ගාන්ධිගේ නායකත්වයෙන් ඉන්දිය රජය දශකයක් තුළ කටයුතු කළේය.  ඉන්දීය රජය ඒවාට මුදලින් සහ ද්‍රව්‍යමය ආධාරද එළිපිටම ලබාදෙන ලදී. ලක්ෂයකට ආසන්න ද්‍රවිඩ පිරිස් 1983 කළු ජූලියෙන් පසු ශ්‍රී ලංකාව අතහැර දේශපාලන රැකවරණ පතා යුරෝපීය රටවලට සංක්‍රමණය විය. තවත් දහස් ගණන් දෙමළ වැසියන් බෝට්ටු මගින් ඉන්දියාවට පලාගොස් දකුණු ඉන්දියාවේ සරණාගත කඳවුරුවල රැකවරණය ලබා ගත්හ. පසුව සංවිධානාත්මකව දෙමළ ඩයස්පෝරාව ලෙස ඒකරාශි වී ද්‍රවිඩ ත්‍රස්තවාදීන්ට සෘජුව සහ වක්‍රව ආධාර කළේය. කරමින් සිටී.

Parliamentary supremacy at the cost of sovereignty

Sri Lanka is currently engaged in the process of replacing the existing executive presidential system with a Parliamentary system of government. The compulsion for the change is primarily because executive presidential systems are seen as conducive to abuse of power since considerable power is vested in a single individual – the Executive President. While there are advantages and disadvantages in any system, the fact that Parliamentary systems, too, could turn out to be as or even more abusive depending on the personality of the leader is a reality that should not be overlooked. Furthermore, extreme caution has to be exercised to ensure that attempts to address issues such as abuse of power and corruption, etc. do not bring in its wake issues that would have the potential to undermine the very foundation of the State of Sri Lanka.

One vital component of that foundation is the right of franchise. The right of franchise is the one opportunity the people have to participate in issues that otherwise would be addressed only by the elected representatives in democracies based on Parliamentary systems of Government. The degree of importance attributed to franchise is evident from its inclusion as a part of the sovereignty of the people in Sri Lanka’s1978 Constitution. And because franchise is part of sovereignty, certain vital Articles of the Constitution, e.g., Article 83 cannot be amended, repealed or replaced without the expressed will of the people at a referendum. In such circumstances, the outcome of referenda are legally binding.

However, provision for referenda are usually not provided for in the Constitutions of Parliamentary systems. Consequently, the outcomes of referenda are not legally binding but are recognized as an expression of the will of the people as it was with the referendum conducted in Britain whether to remain or exit from the European Union. A matter of concern with far reaching implications on the very foundation of the Sri Lankan State is whether the right of franchise would be incorporated in the proposed Constitution as part of the sovereignty of the people or not. If not incorporated, participation of the people would be excluded from the decision making processes relating to issues that entrench their core values.

In such an event, the loss to the people of Sri Lanka would be far greater than what would be gained by replacing an executive presidential system with a Parliamentary system, because they would have lost the shield that protected their core values as listed in Article 83 of the 1978 Constitution which defines them and their State. The exclusion of franchise as a defining component of sovereignty in the new Constitution would grant Parliament the license to dismantle the core values that define the overwhelming majority of the People of Sri Lanka.

Existing Provisions For Franchise

In Sri Lanka

Currently Sri Lanka functions under a Presidential system of government the cornerstone of which is the separation of powers. Article 3 of the Constitution states: “In the republic of Sri Lanka sovereignty is in the people and is inalienable. Sovereignty includes powers of government, fundamental rights and franchise”.

1. Article 83 (a) states: “a Bill for the amendment or for the repeal and replacement of or which is inconsistent with any of the provisions of Article 1, 2, 3, 6, 7, 8, 9, 10 and 11 … shall become law”, if approved by 2/3 of the Parliament and by the people at a referendum.

The significance of including franchise in the scope of sovereignty is reflected in Article 83. This Article provides an opportunity for the people to participate and protect those core values and interests they cherish. Consequently, they are referred to as “entrenched’ Articles. In the absence of such a safeguard to protect the interests of the people they would be at the mercy of Parliaments because Parliaments would be free to amend, repeal, or replace any provisions in Constitutions as enabled by the 1972 Constitution, without any involvement of the people.

The 1972 Constitution was based on a Parliamentary system of Government. In this Constitution too (as in the 1978 Constitution), “sovereignty is in the People and is inalienable”. However, the sovereignty of the people was exercised as per Article 4 of the 1972 Constitution. This Article stated: “The sovereignty of the People is exercised through a National State Assembly of elected representatives of the People”. The fact that sovereignty did not include fundamental rights and franchise (as in 1978 Constitution) meant that the People were denied the opportunity to express their views in respect of the “entrenched” Articles listed in Article 83 of the 1978 Constitution that represent the cherished values of the overwhelming majority of Sri Lankans.

It is clearly evident from the foregoing that under Parliamentary systems the people surrender their sovereignty to their elected representatives in the National State assembly and the Assembly becomes the “supreme instrument of State power” (Article 5, 1972 Constitution). The question is, could Parliamentary systems that are based on the supremacy of Parliament limit their supremacy to accommodate Articles such as Article 83 of the 1978 Constitution to enable the People to participate in issues that are of special interest to them. On the other hand, if the supremacy of Parliament cannot be constitutionally compromised and Parliament retains powers to be the “supreme instrument of State power” in all matters, People would have lost out when compared with the opportunities they had under the 1978 Presidential system.

The Government has declared that the Constitution under preparation would be submitted to Parliament to obtain the needed 2/3 approval and to the People for approval at a referendum. If the outcome is such that after having obtained 2/3 approval of Parliament the people reject it, the Government would have no option but to accept the decision of the people because Parliament cannot override the decision of the people under the provisions of the 1978 Constitution where franchise is included as a component of sovereignty. However, if the people approve to abolish the current Presidential system and have it replaced with a Parliamentary system, any future referendum that is contrary to a decision of Parliament would have legality only if provisions for referenda are incorporated in the Constitution.

If on the other hand, the concept of referenda is constitutionally NOT provided for, the outcomes would not be binding as in the case of Britain. Under such circumstances Parliaments would be free to amend, repeal or replace any provisions in the Constitution without the involvement of the people. Therefore, constitution makers should ensure that provisions are incorporated to enable the People to exercise their franchise at a referendum in respect of the “entrenched” Articles listed in Article 83 of the 1978 Constitution, if the safeguards the People currently enjoy are not to be withdrawn. This is of particular relevance because of reported attempts to modify, dilute or eliminate some of the key provisions contained in the “entrenched” Articles.

Consequences Of Abolishiing Presidential Systems

The material presented above demonstrates the gravity of the issues involved in abolishing the Presidential system and replacing it with a Parliamentary system of Government. The natural question that arises is whether the crusaders who vigorously campaigned for the abolition of the Presidential system realized the complexities involved and if they did, would leaders of the crusade such as the late Reverend Sobitha Thera have undertaken such an initiative? For instance, what precautions would they have taken in order to preserve the “entrenched” Articles under a Parliamentary system? Had precautions been identified, would a Parliamentary system have permitted accommodating them under a system that functions normally on the premise that Parliament is the “supreme instrument of State power”?

The initiative to abolish the executive Presidential system was motivated because the opportunity to abuse power was built into the system. However, the remedy is not to abolish the whole system but to institutionalize arrangements where Parliament oversees Executive action in order to contain and control Executive excesses. The current alternative of diluting Executive power of the President under the 19th Amendment, with the balance Executive power being exercised by a Prime Minister and a Cabinet of Ministers is structurally unsound because division of Executive power leads to uncertainties in regard to a clear direction in formulating and implementing policy; a fact that is becoming starkly evident on a daily basis.

Therefore, instead of replacing a Presidential system that relies on separation of powers between the Legislature, the Executive and the Judiciary, and transferring all power to a single body – the Parliament – which becomes the “supreme instrument of State power”, could turn out to be as abusive as what Sri Lanka has had to endure under Presidential arrangements.

Conclusion

The Government is committed to replacing the current Executive Presidential system with a Parliamentary system of Government. This effort is being driven by the need to fulfill an election pledge. However, that pledge was made more as a rebuke and a rejection of the Presidential system that was seen as an arrangement systemically conducive to the abuse of power, since all executive powers reposed in one individual, rather than being based on a determination made after measured and carefully deliberated study as to whether a Parliamentary system or a reformed Presidential system (not as in the 19th Amendment), would better serve the interests of the People.

Fulfilling the pledge means reverting back to a Parliamentary system. Indications are that the opportunity presented would be used to dismantle those values cherished by the overwhelming majority of the people whose identity is inseparable with the history and heritage of the Sri Lanka State, through a process of State sponsored efforts in the name of reconciliation, liberalism, secularism and multiculturalism. The modus operandi would be to exclude from the proposed Constitution all the provisions currently provided in the 1978 Constitution for the participation of the people through the mechanism of referenda and the Articles listed in Article 83. If the effort succeeds, Parliament would become the “supreme instrument of State power” without any reservations as in the 1972 Constitution. This would enable Parliament to amend, repeal or replace any or all Articles associated with referenda and those listed in Article 83 of the current Constitution. Of these the Articles of significance to the overwhelming majority are:

Article 2: The Republic of Sri Lanka is a Unitary State

Article 3: In the Republic of Sri Lanka sovereignty is in the People and is inalienable. Sovereignty includes the powers of government, fundamental rights and the franchise.

Article 6: The National Flag of the Republic of Sri Lanka shall be the Lion Flag depicted in the Second Schedule.

Article 7: The National Anthem of the Republic of Sri Lanka shall be “Sri Lanka Matha”, the words and music of which are set out in the Third Schedule.

Article 9; The Republic of Sri Lanka shall give to Buddhism the foremost place and accordingly it shall be the duty of the State to protect and foster the Buddha Sasana, while assuring to all religions the rights granted by Article 10 and 14(1)(e).

Under the circumstances, the only option to protect the interests of the overwhelming majority is to carry out a campaign in Parliament for the inclusion in its current form the Articles cited above including all provisions pertaining to referenda and Article 83 in the 1978 Constitution. If such an effort fails, a national campaign should be launched for the rejection of the proposed Constitution in its entirety.

This approach is justified under principles of natural justice. The logic is that if all Sri Lankans are equally sovereign then the collective core values that define the identity of the overwhelming majority should prevail without prejudice to others. These core values that define the character of the Sri Lankan nation should also define the character of the Sri Lankan State. And it should be within such a nation that there should be dignity and justice for all. Therefore, every opportunity should be seized to ensure that these provisions are incorporated in the proposed Constitution.

Despite the many criticisms that have been made about the 1978 J.R. Jayewardene Constitution, its most significant contribution was that it recognized the need to make constitutional provisions through referenda and Article 83 to enable the overwhelming majority whose identity is associated with the history and heritage of Sri Lanka to protect those values that define them and their country. The game plan at play by the present administration is to delete these provisions and for Parliament to become the “supreme instrument of State power”. This would permit Parliament to launch a State sponsored project to dismantle the values that represent the overwhelming majority. This effort should be prevented at all cost.

Britain recently experienced a seismic shock because Parliament and the political establishment misread the palpable disconnect between them and the people. The current administration in Sri Lanka too would be in for a rude shock if they fail to respect the sense and sensibilities of the overwhelming majority of the Sri Lankan nation.

Digging for News

A journalist’s main function is to gather ideas. Here, the journalist is faced with a big question mark … ..  ‘Where to find them and the facts to support them’? This can be one of the biggest headaches for the beginners to journalism – the cub journalists!

A glance at any newspaper counter will reveal the vast number of newspapers and magazines that are available today. Therefore, information cannot be in short supply at all. Indeed not! There is a real stockpile of ideas, which demand only a certain approach to have access for a journalist to ‘think like a journalist’.

What was mentioned in my earlier columns dealt mainly how to formulate an article by training one’s mind and not just to browse as a reader while going through some informative material but to look at through ‘journalistic eyes’ and to think broadly as a writer.

In such situations the journalists will be training their minds to look at any issue impartially and objectively. Once turned into an ‘objective journalist’ one will be able to analyse what has been written by placing the whole written piece under the ‘journalistic microscope’ and to understand by carefully scrutinising paragraph by paragraph, the areas of strengths and weaknesses, if there be any at all, before despatching to an editor for publication.

Ideas will flow around those who have the knack of thinking like a journalist. The main ingredients necessary to gather news is to have one’s ears and eyes tuned in at public places – be it a supermarket, hair dresser’s salon, public places like the bus stand, railway station, or even on the road, news is everywhere including in their own neighbourhood. Generally people always come out with various topics which interest them, and those are the things that should enter a journalist’s head to write about.

What is News?

As an example, let’s take citizens Perera and Peiris discussing a topical issue while travelling by train about the latest hot potato, the VAT problem in Sri Lanka. Despite assurances given by the President on several occasions publicly by appearing on the TV, the Finance Minister has introduced this extra increase in tax, which is seen as an additional burden on the public. Naturally, this has expanded and become controversial and rather complex and a confusing issue where the ordinary man on the street has to suffer by having to pay extra money for everything he purchases; even for a cup of plain (black) tea! This is due to every trader, registered for VAT or NOT as stipulated by the government, is hell bent in taxing the poor public through the ulterior motive of fattening his wallet! This type of willy-nilly operation by unscrupulous traders will automatically put the cost of living up, at rocket speed!

Another area of controversy on the VAT, which is ammunition to journalists, will be this extra tax on channeling charges to doctors and also to the hospital separately, not forgetting on drugs, TV subscriptions telecommunication levy ( on mobile phones), which add up to nearly fifty percent as VAT on usage.

Objectivity

If the journalist can come up with an article comparing the cost of living immediately prior to the introduction of the VAT (11 per cent) and also with comparisons a year ago, five years ago, in the eighties or nineties, he will have sufficient information to write not only one article but several features by going into detail about the history of the VAT, and causes as to why the government is determined to tax the public; then from there he could touch on the fragile nature of the finances of the country, government borrowing, existing international debts amounting to billions of dollars etc, which will make the feature article balanced, newsworthy, educational as much as giving a full picture of the situation and the associated problems the government is facing which has led towards such taxation! Here, the journalist being objective gives the reader a balanced view rather than making the public prejudiced either way!

Another important aspect in such a situation is that the journalist does not have to prove that his common assumptions are correct as long as the article carries the nucleus of the problem highlighting the causes and compulsions on the part of the government, which affects ordinary households up to the cream of society.

Second example

In a similar fashion if citizen Silva and Professor Perera were to engage in a conversation about building techniques and high rise buildings in Sri Lanka as against the structure and the modus operandi in putting up skyscrapers and residential blocks in America and England, bringing into focus about the latest trend at home to change the skyline not only in Colombo but throughout the country with multi-storey boxes with numerous luxuries thrown into them at sky rocketing prices, it will be fodder for a journalist to come out with a juicy article highlighting the pros and cons about the exercise.

He could probe into the areas where prospective buyers are asked to make millions of rupee deposits as advance payments (to buttress developers’ budget) without any explanations about the COC (Certificate of Conformity) obtained by the property developer or not, and the level of service charges, tariffs and what interval of increases are to be expected (annually or at a specific period); how often the general maintenance is carried out on the building; who are responsible to share repair charges (for instance to roof repairs)? Do those who live at ground level pay for lift maintenance (although they are not using lifts in their daily use), as much as for roof repairs when it comes to all apartment owners of units below roof level etc.

The inquisitive journalist needs to probe well in to all such areas making use of all human faculties, and not only ears! The eyes, for a start, are used for seeing purposes primarily to read. But if a journalist reads local newspapers that circulate in his home town area, and has access to both local and regional tabloids, and community papers and magazines, apart from information from broad sheets, the journalist would be able to turn the ‘journalist’s antenna’ to dig out adequate material to write about.

Indian Style Secularism

India has started a project that would soon utilize cow urine to clean the floors in government offices and other institutions. The distilled urine will be added natural ingredients such as coconut or pine oil to cover the smell of urine. As per the details published in The Economic Times, Jagdish Bhatia, head of the company linked with Holy Cow Foundation that supplies housekeeping products to government offices praised the urine cleaner and claimed, It is a great product for the health of Safai Karamcharis  as well as for the cows. It is pertinent to mention here that the cow, also known as Kamdhenu”, that fulfils human needs and described in Hindu scriptures as the mother” of civilization. Interestingly, drinking cow urine is religiously practiced in the Indian countryside and is now becoming fashion in Indian elite and nightclubs. The Times of India published story about use of cow urine for dazzling teeth and increase in the demand for ‘Gomutra Arka’, a medicine distilled out of cow urine.

If we recall, BJP’s Madhya Pradesh MLAs Usha Thakur and Rameshwar Sharma issued a statements in the past saying, stating Muslims should taste cow urine or Panchgavya”.  On the other hand, Dargah Aala Hazrat in Bareilly has passed a Fatwa” against usage of products in which cow urine is used, “As per Shariat, it is forbidden for Muslims to use any product in which cow urine is mixed. Cow urine is considered unholy in Shariat”. The divinity of cow can be judged from the fact that Hindus consider cows to be sacred animals and allow them free to roam around and eat even in densely populated cities like Delhi, where there are an estimated 40,000 set-free cows. It is on record that an Indian farmer namely Muhammad Akhlaq, resident of Dadri, was accused of consuming beef and engaging in cow-slaughter. An announcement was made on loudspeaker from a local Hindu temple that a cow had been slaughtered and its corpse was found near a transformer. Resultantly, Muhammad Akhlaq and his son Danish were dragged on the road. Akhlaq was beaten to death with bricks while his son Danish was left critically injured but no FIR was registered in the Police station.

On 10 June 2016, two Indian nationals Rizwan and Mukhtiar were forced to eat Panchgavya” (cow dung and urine) to teach them a lessonas well as to purify them. There crime was that they were reportedly involved in transporting 700 kg of beef from Mewat to New Delhi. In another incident, two sisters, resident of Pune fled their home after they converted from Hinduism to Christianity. The victims sisters were tortured, assaulted, threatened with honour killing, labelled as Ashoodh (unholy), locked in a room for several days and forced to drink cow urine daily by their parents when they started reading the Holy Bible. Despite such an inhuman behaviour, Police refused to register FIR.  One wonders Pakistan is being criticized for Blasphemy law but why no one is pushed about the cold blooded murders on the grounds of Cow Slaughter Act and divinity of the holy cow in India.

Article 48 of the Indian Constitution provides, The State shall endeavour to organise agriculture and animal husbandry on modern and scientific lines and shall, in particular, take steps for preserving and improving the breeds, and prohibiting the slaughter, of cows and calves and other milch and draught cattle”. Interestingly, the article is in conflict with the fundamental rights gauranteed under Indian constitution. Ironically, in May 2016, a division bench of  Justice Abhay Oka and Justice SC Gupte of Bombay High Court struck down two provisions of the Maharashtra Animal Preservation Act, 1976, which prohibit the import of beef and criminalise its possession, saying they violate the right to privacy and the right to choice of food that is guaranteed under Article 21 of Constitution. The court passed orders that it will be no longer be illegal to consume or keep imported beef but upheld the Maharashtra government’s ban on slaughter of cows and bullocks in the state.

Where the constitution of the country supreme, it is equally important to honour judgments passed by various courts from time to time. It is the responsibility of every citizen of India to obey them in true letter and spirit. It is also the responsibility of the government institutions to implement constitution and the law. But something is really lagging as regard to minority rights. Although, India claims to be a secular country, where the rights of all the communities are honoured and respected but on ground, the minorities are suppressed class with no or very little voice. Ironically, Indian is also trying to become permanent member of United Nations Security Council (UNSC). One wonders with such a poor record of minority rights, how can the Hindu-styled Veto power can be acceptable to the world. It is high time that before dreaming a permanent seat in UNSC New Delhi must honour fundamental rights of the minorities and provide uniform justice to all its citizens. afshainafzal@yahoo.com

AI  calls for release of Burmese student-workers

Guwahati: Continuing its call to release all prisoners of conscience in Myanmar (also known as Burma), Amnesty International demands an immediate and unconditional release of 15 factory workers and student union members, who were detained by the Myanmar authority after clamping criminal charges for organizing a peaceful protest demonstration.

On 18 May, the Tatkton township police arrested more than 70 wood-factory workers and All Burma Federation of Students Union members. The protesters raised voices against the dismissal of many workers from the Myanmar Veneer Plywood private limited factory and began their peaceful march in Sagaing region. They were on their way to Myanmar’s capital Naypyitaw  with an aim to bring their concerns to the union government,” said a statement issued by the international rights body.

Next day, 20 protesters were released and 35 more detainees were pardoned on 1 June. However, the rest continued to be under detention with the charges of unlawful assembly act (section 143, 145, 147 etc).

Under these laws, Thein Oo (male), Win Min (m), Khaing Min (m), Saw Kai Htoo (m), Yan Naing Htwe (m), Kyaw Kyaw Myo (m), Naing Naing Aung (m), Hnin Aung (m), Kaung Zaw Hein (m), Than Htike (m), Ye Yint Paing Hmu (m),  Victor (m), Khin San Wai (female),Sein Lae Khaing (f) and Yu Thandar Aung face up to six years of imprisonment at Yamethin jail of Mandalay in central Burma.

Earlier  in February and April, more than 160 wood-factory workers belonged to Veneer Plywood private limited factory were dismissed. The workers believe that it was because of their demand for better working conditions, including the overtime pay, they were targeted.

It may be mentioned that the National League for Democracy led government in Naypyitaw on 7 April announced that it would work to release all political prisoners as early as possible. Since then, scores of prisoners of conscience were released, but arrests on politically motivated grounds also continued till date.

Tony Blair, Chilcot Report and the UNP led Government

However, dismissing Muslim sentiments, the UNP led coalition aligned itself, virtually unconditionally with the United States led British, French and Israeli neo con war mongers, who have unleashed worldwide a war against Islam and Muslims, destroyed several Muslim countries, killed millions of Muslims, forcing out millions of them into refugee camps and to cross the mighty oceans facing death for hundreds of them in deep waters and the rest finally ending up in the European streets as beggars.
As part of this Samaraweera foreign policy, Tony Blair and his family were invited by Foreign Minister Mangala Samaraweera on a two week holiday during November 2005.
This not only shocked but also insulted Sri Lanka–once a proud voice of the Non Aligned Movement and a fearless defender of justice for oppressed people worldwide in all third world fora and beyond.
Allowing Tony Blair to step into the soil of Sri Lanka, dismissing the island’s intelligentsia and the sentiments of the Muslim community is the last thing one could expect from a Government claiming to establish good governance.

The two executed a Zionist- Israeli plan to destroy Muslim countries in the Middle-East, who were fast developing with their oil wealth.
The US had to make Israel safe at all costs. The US and Britain benefitted with roaring sales of arms all round.
Over 500 arms manufacturing industries in the US and Europe benefitted immensely, a small part of the proceeds of which they dole out to the Third World countries imposing on these poor nations conditions, that will keep them chained to these neo-colonialists for generations to come!

This clearly showed that despite all claims of Good Governance the UNP remains the same and the Government’s foreign policy has been hijacked by the United States led Israeli, UK and European neo con countries. They have begun their sordid rule of Sri Lanka through puppets! Minister Samaraweera’s and Government’s special love for the US, the UK and the European countries and Israel is not unknown.
However, what one cannot understand is the wisdom of welcoming him, despised by even the British public, on a Government invitation?
Despite the UNP Government aligning with US led war mongers the country was not flooded with investment as expected. Instead the island’s economy is continued to be sustained by the almost million Sri Lankan employed and remitting around seven billion dollars from the Gulf States!
Not only the Gulf, the whole Muslim world, not the dictators there, are watching carefully those, who collaborate with the Israeli sponsored, US led on-going campaign of demonising Islam and Muslims.
The question is whether a small country like
Sri Lanka, with almost three fourths of the population of Pakistani city of Karachi, can afford to antagonise the Muslim world, which remains the most sincere friend of Sri Lanka.

Will the govt implement 13A?

Joint Opposition MP Shehan Semasinghe is concerned with the Electoral System Committee’s proceedings, in which he is a member.

“The government,” he states, “is still not clear whether executive powers should continue with the President or transfer to the Prime Minister, and President to be ceremonial. But without deciding how and who will manage the executive powers the discussions are centred on devolution and what the electoral system, what the Constitution and how the country should be.”

“I think the government has already made up its minds to go ahead with the full implementation of the 13th Amendment (13A). To the public, they are showing that an effort is made to follow a democratic process. But, they already have their framework and they are just trying to get it endorsed. Then, what’s the point of even appointing these committees and steering committees?”
Exactly a month since Semasinghe shared his concerns with this writer, US Assistant Secretary of State, Nisha Biswal visits the Eastern Province with US Assistant Secretary of State for Democracy, Human Rights and Labour, Tom Malinowski and Charge d’affaires of the US Embassy, Robert Hilton. There, at the Eastern Provincial Council, she had a closed door conference with main political party representatives.
Afterwards, Eastern Province Chief Minister, Hafeez Nazeer Ahamed revealed, “We have emphasized that the 13A fully must be implemented as soon as possible…no discussion needed. Any constitutional reforms needed, must be done without further delay.
Devolution of power
When it comes to devolution of power, there had always been delaying tactics. So, we emphasized that for genuine process to take place and to sustain the peace we have achieved, there should be no further delays. Land and police powers must be given in full. Also, the monies for these must be given directly instead of through the Central Government. Otherwise, we’ll not be able to carry out our duties.”
Retired Senior DIG Gamini Gunawardane, writes to ‘The Island’, that in a unitary Constitution, it is not possible to devolve the function of internal security and maintenance of law and order to Chief Ministers.
He explains, “Law and order and internal security in the country are a fundamental precondition necessary for all other activities. All economic, political, social and cultural activity could take place in a community only in a secure environment. For that matter, even the basics of life, food, clothing and shelter, could be enjoyed by a person only if one could have them in a secure environment.
Thus, maintenance of law and order becomes a fundamental responsibility of governance. That may be the reason why the subject of defence and internal security, is kept directly under the President and earlier, under the PM, under the previous Constitutions. It is thus a basic/core responsibility of the Head of State, in governance. Therefore, it could be construed as an ‘inalienable’ responsibility.

Responsibility and accountability
“With responsibility goes accountability. This means accountability for the preservation of law and order in the country lies directly on the government and more specifically, on the Head of State. He is primarily accountable for the whole country’s peace, law and order. Hence, is it practical or legitimately possible for him to devolve this responsibility and accountability to somebody (viz. Chief Minister) who is independent of him and over whom he has no effective or direct control?” Presidential Counsel Manohara de Silva agrees.
“Especially, looking at the Sri Lankan situation with its separatist elements,” he says, “It’s essential that there’s some kind of presidential control, so no one abuses power.
“We ought to practise good governance, which is something separatists don’t want us to do. Their first step is to create a weak Central Government and a strong provincial government. Then, it is a hop, skip and a jump to separation. The amendments to the Constitution expose this thinking clearly.”
13A divided the police as the National Division and the Provincial Division. “This,” DIG Gunawardane and PC de Silva explain “created structural problems, that subsequent amendments, chiefly 17A and 19A, seeks to exploit.”
DIG Gunawardane questions whether “The IGP, as head of the Sri Lanka Police Force – now divided as the National Division and Provincial Divisions – remain responsible for the policing of the whole country, when he had lost his Territorial Policing Arm, which is the core police activity and responsibility, to the Provincial Division?”
“National Police are concerned with offences,” explains PC de Silva, “of the nature committed against the State, currency, elections, public officers and ministers.”
“Then, through whom does the President exercise his total responsibility and accountability,” asks DIG Gunawardane, “for the other aspects of law and order, especially at territorial level?”
The problem
“Here lies the problem,” agrees PC de Silva. “According to section 11.1 of the Constitution, “The DIG of the province shall be responsible to and under the control of the Chief Minister of the Province.”
“Though the national defence and national security are with the Central Government, there is a limitation in item K of the reserved list under national security. It states that without the consent of the Provincial Council, members of a police force belonging to any province to any area outside that province, cannot exercise powers and jurisdiction.”
Though the IGP is instrumental in appointing the DIG, it is only with the concurrence of the Chief Minister. The DIG is not only accountable to, but also is under Chief Minister’s control.
“Then where is the Territorial Command of the IGP?” questions DIG Gunawardane. “What is he responsible for, beyond the appointment of the DIG, whom he cannot remove without the Chief Minister’s concurrence? How could the DIG be held accountable to the IGP who in turn, is accountable for policing the whole country?
“This situation becomes further complicated when the Chief Minister happens to be a member of a political party that is different to that of the President/Defence Minister/Internal Security.”
“If a perpetrator,” explains PC de Silva, “is under the Chief Minister’s protection of another Province, they can simply cross the border and evade the law. We had a similar experience in mid 2000, when a police unit from the National Child Protection Authority crossed over to LTTE infested area in pursuit of a paedophile. The terrorists allowed the paedophile to escape, even though the victim was a Tamil, and forcibly kept the police officers for nearly a year.
Dangerous situation
“Actually, this is a very dangerous situation. If a Provincial Council supports an attack against the State, then that ground level activities can be effectively kept from reaching the National Police.
“As the department head, the IGP can be expected to act somewhat fairly. But can we expect the same from our politicians and rest assured that the system will not be compromised?”
“The delay of more than 12 hours caused in moving the Special Forces to Mumbai to deal with the deadly terrorist attack on the major tourist hotel there,” says DIG Gunawardane, shows how dysfunctional the Indian police was because of the command chain breakdown. “How many unnecessary deaths were caused as a result of this delay? Then, how in the ’80s, the IGP of Tamil Nadu behaved under Chief Minister M.G. Ramachandran whenever his police arrested Sri Lankan terrorists operating there – he was virtually a lump of clay in the Chief Minister’s hands!”
On the other hand, he argues, “We were able to have the World Cup matches in 1996, even in the midst of the battle with the LTTE terrorists going on in full cry. Similarly, Sri Lanka Police has been able to develop a countrywide rapid police response system where any citizen anywhere in the country could activate the police through a mere telephone call to 119.
Police Ordinance
“This is because of the Police Ordinance provides by section 56, for any police officer to exercise his police powers in any part of the country and intervene trans-provincial or otherwise, without the permission of anyone – leave alone Chief Minister or even the PM.”

“The 13A was bad enough,” exclaims PC de Silva, “that divided the Police and placed the DIG directly under the Chief Minister. But, when the 17A was introduced, the composition of the National Police Commission was amended, but not the composition of the Provincial Police Commission. Surely, that couldn’t have been an oversight.
“In the 13A, the National Police Commission was composed of, the IGP, a person nominated by the Public Service Commission in consultation with the President and a nominee of the Chief Justice.
The Provincial Police Commission is composed of the DIG of the Province, a person nominated by the Public Service Commission in consultation with the President and a nominee of the Chief Minister of the Province.
“Under the 1978 Constitution, the President appoints the IGP. So, he’s under the President’s total control. The Public Service Commission is also appointed by the President.
So, the nominee would also be under the President’s control. The Chief Justice’s nominee cannot be said to be under the President’s control. So, in the National Police Commission, two members were directly or indirectly under the control of the President.
“On the other hand, except for the nominee of the Public Service Commission, in the Provincial Police Commission, the other two members are under the Chief Minister’s control.
“In the 17A, the National Police Commission composition was changed to seven members appointed by the President on the recommendation of the Constitutional Council (CC), who may consult the Public Service Commission in making its recommendations. The CC’s controlling vote is with the PM and the Opposition Leader, who at most represent only two districts as opposed to the President.
The President, on the CC’s recommendation shall appoint one member as the Chairman.
“This goes to prove that the 17A seeks to weaken the Centre whilst strengthening the Provinces.
“In the 13A, there is another curious clause. Section 10.1 states, “Member of the National Division shall ordinarily be in plain clothes provided that they may wear uniforms when performing any duties in respect of the maintenance or restoration of public order as set out in paragraph 12:2, 12:3 and 12:4.
“To be in plain clothes when off duty is one thing, so let’s see what 13A omits – 12:1, which states the Provincial Division shall be responsible for the preservation of public order and prevention, detection and investigations of all offences within the Province, where as the National Division responsibilities are separate.
“Now Tamil politicians claim that they don’t have sufficient security under what they call a ‘Sinhala government’. Having said that, the Provincial Council is empowered for the entire Provincial Division, which is to be under the Chief Minister and the National Police have no powers to protect a regional minority of that Province.
“We’re trying to copy a system,” points out Semasinghe, “from a country whose smallest state is larger than Sri Lanka.
“If police powers are given, then for my security to come to Anuradhapura from Colombo, I’ll have to take permission from three Provincial Councils – from Western, North Western and North Central Provincial Councils.
At each, I’ll have to surrender my weapon, take permission from all these three to carry my weapon and only then take it back.”

Is USA Planning to loosen its grip on Sri Lanka

Last week, fans of the Nuga Sevana programme in Rupavahini witnessed US Assistant Secretary of State for South and Central Asian Affairs Nisha Biswal, who is on an official visit to Sri Lanka, preparing a polos embula –local spicy with guidance and tips from none other than Sri Lanka’s celebrity Master Chef Dr. Pubilis Silva of Mount Lavinia Hotel.

Biswal, who arrived in Sri Lanka after visiting Bangladesh, went to the Holey Bakery in Dhaka, and paid respects to the victims of heinous terrorist attack that took place, a few weeks back.
Interestingly Biswal’s arrival fell a few days after Chinese Foreign Minister’s low-key yet important visit to the country. Biswal has been a frequent visitor to Sri Lanka since President Maithripala Sirisena was elected to office in January 2015 with her visiting the country at least three times in 2015, first in February which later followed her visits in August and December.
On her first visit, Biswal pointing out challenges the new regime would have to face noted that “President Sirisena and Prime Minister Wickremesinghe have put forth an ambitious agenda for their first one hundred days and much has already been accomplished in such a short time. But we recognize that there is a lot of hard work ahead and some difficult challenges.”

“Sri Lanka can count on the United States to be a partner and a friend in the way forward: Whether it is on rebuilding the economy, on preventing corruption and advancing good governance, and ensuring human rights and democratic participation for all of its citizens.”
“The United States stands with Sri Lanka. Our friendship dates back generations and since Sri Lanka’s independence, the United States has provided over $2 billion in assistance. No country in the world buys more Sri Lankan products than the United States and we look forward to growing and deepening our partnership, to advancing trade and investment.”
While she enjoyed preparing a polos curry, her visit to the island most certainly could not be as lighter a matter as cooking a local dish.

 UNHRC
While, the attention may have drawn to progress and what the government should accomplish before the progress was discussed at the UNHRC in October this year, the fact Biswal was accompanied by Assistant Secretary of State for Democracy, Human Rights, and Labour, Tom Malinowski shows that USA has put Sri Lanka amongst their priority list.
The visit was part of a planned visit to two different countries in the region –Bangladesh and Cambodia, and projected as a farewell gesture as President Barrack Obama’s tenure coming to an end. Experts in international relations, however, are of the view that this visit was to display USA’s solidarity to Sri Lanka and its wish to continue the goodwill in a manner that Sri Lankan rulers will not be pushed once again towards China.
Not only is Sri Lanka strategically important to both USA and India, but at a time tension between China and the USA is rising, the possibility is such that the world’s most powerful country would not take any stern action that would hurt Sri Lanka.
Sri Lanka-US relations
Time and again, the US top officials insisted that Sri Lanka-US relations at an all-time high and on a tremendous trajectory of partnership between the two countries which include last year’s visit by Secretary Kerry, Ambassador Samantha Power, and the Partnership Dialogue USA inaugurated in February this year.
She also said that Sri Lanka itself has been on a remarkable trajectory of addressing not only the internal issues that have challenged it, but also engaging with the broader international community in a spirit of partnership and dialogue.
“The United States has welcomed a deepening of ties between our two countries. The United States and Sri Lanka share common goals as fellow democracies, which are both working to promote and protect human rights and fundamental freedoms. We are partners, and today our relations are at an all-time high.
We have been proud to partner with Sri Lanka over the past 60 years, during which development and humanitarian assistance has improved countless lives, livelihoods, and living conditions all across Sri Lanka.
She also promised to continue to make substantial investments in multiple sectors — agriculture, enterprise development, education, health care, energy and natural resources, and humanitarian activities.
“As the Government of Sri Lanka moves ahead with its plans for constitutional reform, for justice and reconciliation, the United States will continue to partner with the government to foster economic development and encourage foreign investment, to work to advance opportunities for all Sri Lankans.”
These two top US officials arrived at a time where a clear division between the Executive President and part of the government on the matter of letting foreign experts is evident.

Not long ago President Sirisena amidst growing resistance from his opponents on involving foreign judges and other experts in an accountability process on alleged war crimes contradicted his Minister of Foreign Affairs Mangala Samaraweera and pledged the Maha Sangha that he would not allow any foreign involvement in the matter as long as he was in office.
It is despite this strong resistance by the Head of the State that Biswal following her meeting with Mnister Samaraweera noted that “We continue to support the Government of Sri Lanka as it takes meaningful and concrete steps in response to concerns of its people related to democratic governance and advancing respect for human rights, for reconciliation, for justice and accountability. We can envision a future which brings benefits to both countries, and to peace and prosperity and security across the Indian Ocean as Sri Lanka assumes a greater role as a key partner in this region, as Sri Lanka assumes its great potential as a hub and a gateway to connect to rising economic societies of South and Southeast Asia.”
“Much work remains, but the United States is committed to partnering with the Sri Lankan people to address challenges and help this country and its people to realise their true potential,” she said.
Meanwhile, Assistant Secretary Malinowski after meeting Minister Samaraweera said, in the last few months, and in particular the last several weeks, they have seen Sri Lanka take very concrete steps forward in its reform, democratization, and reconciliation agenda: the bill to establish an Office of Missing Persons, ratifying the convention on disappearances, additional land releases by the military, the President’s very important directive on arrests under the PTA, and progress in work on the Constitution.
“A lot of this work was foreshadowed in last year’s Human Rights Council resolution. That resolution embodied commitments the Sri Lankan people have made in their own national interests to restore accountability and the rule of law to their country. The United States was a co-sponsor of that resolution, and as such we feel we have a shared responsibility to help see this process through. So we look forward to supporting Sri Lanka as it puts into place the remaining institutions and reforms that the resolution endorsed. We very strongly commend the government for working closely with the United Nations and High Commissioner Zeid to advance that progress.
“I also want to strongly second my colleague Assistant Secretary Biswal’s comments on economic development and on the opportunity and responsibility we have as a partner of Sri Lanka to help the people of this country achieve the peace dividend that they so deserve. I want to stress that in our minds these two objectives — economic development and reconciliation — go hand-in-hand. Without a peace dividend, it will be harder to pursue reconciliation.

“But reconciliation is also advanced, as we have seen in country after country in the world, where people can come together rather than let themselves be split apart. In a larger sense, this reminds us why what is happening in Sri Lanka is so important to people all over the world, because if you look at what’s happening in the world today, there’s obviously not a lot of good news to be found. A lot of the problems that we see are rooted in something that Sri Lanka knows all too well — this contest between the politics of division and the politics of common ground. We’ve seen, unfortunately, in many places around the world that it is easier to win in politics by making simple appeals to racial, religious, or national pride, than by doing the hard work of governing. Easier sometimes to blame others for our problems than to take responsibility ourselves. In that way you can distract people from your own failures and lack of vision.
“I think the people Sri Lanka have shown us again and again, that regardless where they come from, or what language they speak, or what faith they belong to, everyone has the same fundamental interests. Everybody has an interest in peace, everyone has an interest in law and order, in accountability, in moving this country forward. The people of Sri Lanka chose a government that seeks to serve all its people rather than setting them against each other. For that reason, the whole world needs Sri Lanka to succeed and to show others the way. We are proud to be your partner in that effort.”
If there is anything that both India and the USA do not wish to see, that is China occupying the major portion of Sri Lanka’s ground and the ocean. For USA, who is planning on increasing its presence in Indian Ocean, China increasing its presence in Sri Lanka is surely not the appetite.
At a time a Chinese company eying to acquire lands and properties occupied by World’s largest cement producer, Lafarge Holcim who is planning on fully divesting its Sri Lankan operations, its subsidiary Holcim Lanka as part of a global rationalization strategy of the Switzerland-based building materials group, USA is unlikely to do anything that would push Sri Lanka towards China. It was believed that USA’s stern approach in matters of Sri Lanka pushed the Rajapaksa regime towards bonding strongly with US opponents like China, Russia and Pakistan.

If China succeed in acquiring the deal, it will make sure Chinese presence in all salient points including Colombo Harbour, Galle Harbour and more importantly Trincomalee Harbour.
It is also no longer a secret that US is planning on stationing its Pacific Command in the Indian Ocean with the assistance of Sri Lanka. The first sign of this was US Navy’s Seventh Fleet Flagship, USS Blue Ridge, arriving in Colombo on 26 March 2016 for a five-day port call, with 900 sailors on board.
In November 2011, Hillary Clinton, the then Secretary of State, in her Foreign Policy article ‘America’s Pacific Century’ has defined the Asia-Pacific as “stretching from the Indian subcontinent to the western shores of the Americas, the region spans two oceans – the Pacific and the Indian – that are increasingly linked by shipping and strategy.
In his 17 November, 2011 address to the Australian Parliament, President Obama said that the future being sought in the Asia-Pacific was “security, prosperity and dignity for all”.
On the other hand, the Strategic Guidance Document published by the US Department of Defence in 2012 stated that, “US economic and security interests are inextricably linked to developments in the arc extending from the Western Pacific and East Asia into the Indian Ocean Region and South Asia, creating a mix of evolving challenges and opportunities”.
Under these circumstances, it is likely that USA who also does not face domestic pressure like the UK or Canada, will only push Sri Lanka to get foreign technical assistance in certain areas and not push for setting up a ‘hybrid’ court as predicted, experts opined.

The front page of The Island of July 13 carried a media statement of His Eminence Malcolm Cardinal Ranjith, on delays in the rehabilitation of those who suffered from the explosion of ordnance at Salawa. The statement “urged government to waive red tape”, to get the job done. In the God-Caesar divide, rehabilitation is clearly Caesar’s responsibility, overseen by People’s elected representatives, the politicians from the Pradeshiya Sabha, Western Provincial Council and Parliament. If there is a failure, it is the politician who will pay. Physical rehabilitation does not fall within the remit of God.

Both the Catholic Church and Public Administration (Caesar’s minions) are the oldest formal organisations known to man. Both bring together a large number of workers, priests and public servants, in structures based on hierarchy. The organisational structure of a Divisional Secretariat and that of a monastery is the same, though their clienteles, vision, missions and, consequently, their work methodologies and expected outputs are different. Both are bound by sets of rules, laid down elsewhere, to which those who work within them have to adhere. If a catholic child, in a distant parish, suffers a major accident for which, remedial measures are available only in Colombo, the parish priest cannot rent out an ambulance-helicopter, on his own volition, without getting approval at higher levels. During these negotiations, the child may even die. Rules restrain the taking of the Right decisions and constrain the decision maker to taking correct decisions. Rules, covering both eventualities are called Red Tape. The existential despair of public servants arises when he has to transit from the correct decision to the right one.

Salawa after the disaster

His Eminence has two responsibilities, to be the highest spiritual guide to his flock and, to manage and safeguard the Catholic Church. It is in his second capacity, as a manager, that His Eminence has shared his views on Red Tape. I, a humdrum and dull ordinal, who had Red Tape for breakfast, lunch, dinner and dreams, am responding to His Eminence, for, I am troubled: my employment justification has been exposed as a hoax. What worthwhile work had I been doing all these years? My employment, I thought, lay in reciting poetry, now, according to His Eminence, it lay only in murmuring doggerel.

Salawa suffered a heart-rending disaster, the subject of His Eminence’s media statement. It required an immediate response by governmental institutions and their personnel to offer immediate alternative accommodation, food, clothing, give attention to medical needs – especially of children- and provide other humanitarian assistance- the first stage. They, Caesar’s minions, were immediately on-sign and worked unbelievable hours, in an environment of uncertainty. There would have been small road blocks: these were overcome. Caesars minions did not issue media statements or draw attention to themselves. His Eminence’s cryptic statement admitted that, “urgent assistance, in the form of food and drink were supplied to them (those affected)”. While Caesar’s minions do not expect bouquets, it would not have gone amiss, if His Eminence had referred more expansively to their committed efforts.

The body of the statement of His Eminence, deals with failures of the second stage- i.e. after immediate relief was provided in the first stage, that of an alleged non-taking of necessary actions, to speedily ensure resettlement, rehabilitation and placing the affected population back to positions they enjoyed prior to the disaster. The public servants accused of this tardiness, were the very ones who did such an excellent job at the first stage. Therefore, individual public servants cannot be faulted: it is the system riddled with Red Tape, “official procedures like filling forms, sending them to different offices for approvals procedures, perhaps outlined in rule books”, which are the culprits. His Eminence recommends a bonfire of these rules, “appealing to the President, the Prime Minister, the relevant ministers and officials to waive off procedural snags to urgently help the people to get back to their normal lives”. “Procedures Bungawewa!” is the resounding implication. This seems a populist war cry, verging on anarchy.

His Eminence, with many others in the parallel government of civil society, have been strong advocates of Good Governance. The significant components of Good Governance are accountability, transparency and non-corruption. Accountability is in enumerating and justifying to questioners with documentary evidence of actions which had been taken. It is difficult to imagine how this could be done, if all procedures were to be waived. According to the newspapers, the total cost of “helping the people (of Salawa) to get back to their normal way of life” would be Rs. 1.2 Billion.

If funds of this magnitude are to be splurged, willy-nilly, without documents being kept, justifying expenditure or recording it, would not there be rampant corruption?

The lessons of the tsunami should be learnt; funds were obtained from trusting donors for housing schemes: there are no housing schemes visible. The same goes for the recipients of funds. To get rehabilitation funds, the affected of Salawa need identity: all NICs have been destroyed. To receive funds for the restoration of stock-in-trade, documents are required: all such documents have been destroyed. To receive house restoration funds, deeds are required to prove ownership: all such deeds have been destroyed. It would take time to reconstruct these documents. These documents give certainty: uncertainty, which provides extensive discretion, is the prowling grounds for the corrupt.

The solution is not to indulge in stump approaches, but undertaking painful, systematic searches, to enable accountable, transparent and non-corrupt decision making to take place. Public servants have shown themselves to be imbued with social concern, as seen in their response to disaster at the first stage. There can be little doubt about theirs, for the second stage. If His Eminence’s recommendations about abolishing procedures were accepted, public servants could look forward to attentions by CIABOC and FCID, and having a tryst with State remand houses.

His Eminence concludes the media statement with a request “a top level discussion be held with the representatives of the affected people”. He has not offered a suggested list of participants for this discussion, an agenda, possible objectives for the meeting, nor has he appended a list of expected outputs on which the discussion could focus. The suggested discussion, while detracting from the current work of rehabilitation, could only add another circle of confusion.
